Home My WebLink About11/27/1967 Meeting ~ e 511 11/27/67 rJ Council Chamber Eugene, Oregon November 27, 1967 Adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned from the meeting held November 6, 1967 - was called to order at 7:30 p.m. on November 27, 1967 in the Council Chamber by His Honor Mayor Edwin E. Cone with the following councilmen present: Dr. Purdy, Mrs. Lauris, Messrs. McNutt, Anderson, Lassen, Mrs. Hayward, Messrs. McDonald and Wingard. Minutes of the meeting held November 6, 1967, as mailed to Council members, were approved as cor- rected to show Councilman Purdy did not mention pedestrian traffic when discussing vehicle movement at 13th and Agate. NEW BUSINESS 1 Water Supply, Barger Drive - Councilman Lassen said there is no public water supply e in the state street area north of Barger Drive - Ohio, Minnesota, Dakota, Wisconsin - and asked that the Eugene Water & Electric Board be contacted with regard to any plans they may have to extend water to the area for domestic use and fire protection. 2 Budget Committee Appointment - Councilman Anderson recommended Carl Raynor for reap- pointment as a member of the Budget Committee and said Mr. Raynor agreed to accept the appointment (term ending December 31, 1970). J 3 7th and Olive Parking Validation Program - The City Manager said that although bids will not be opened until December 7 on proposals for leasing the parking lot at 7th and Olive, with contract award scheduled for the December 11 Council meeting, Mr. Archie Weinstein had contacted property owners in the district, some of whom are from out of town, to discuss the proposed program at this meeting. Brian Bronson said the proposed lease of the lot at 7th and Olive will set the pattern for the 7th and Willamette lot with many property owners being assessed for both lots, and that he has reservations about any change of the 5~ per ~-hour charge on City operated meters. Councilman Purdy asked if tokens could be used in City on-street meters in adjacent areas, and the City Manager replied there would be some concern about integrating the meters because there is no way of checking the source of tokens. Mr. Archie Weinstein commented about postponement of discussion of the program and difficulties he encountered in contacting property owners. This amount. includes the basic bid of $37,682.75 and the following alternates: , Add Spicer transmission #6452-8 instead of Mack TR-676 $ 100.00 Add electric pump controls with manual override 210.00 Add change from 24' extension and 14' roof ladders to 28' 3-piece extension and 12' roof ladders 65.00 Delete piping from main pump to booster pump 140.00 I Mayor Cone left the meeting and Council President Purdy assumed the Chair. Mr. Anderson moved seconded by Mrs. Lauris to purchase two fire trucks from Pitchford Mack Sales on their bid price of $37,917.75 each for delivery during 1968-69 fiscal year. Rollcall vote. Millrace - The Millrace Commission reco'mmended C~uncil initiation of a program which will tie the lower millrace into the existing storm sewer, contingent upon acquisition of properties abutting ~he millrace by deed or easement at no cost to the City. The cost of the proposed program is estimat.ed at $18,000.00. Ken Morin, chairman of the Millrace Commission, said owners of property abutting the millrace are generally in agreement with the proposed program for increasing 'the millrace flow, and with Council commitment the Commission can go to the property owners for the necessary deeds or easements. The Public Works Director. said that although the proposed improvement e will double the minrace flow,. in the present channel the apparent increase will be negligible. Mr. Morin said the Commission feels any flow increase will be an improve- ment inasmuch as it would lower the bacterial count in the stream, and that bringing ownership under City jurisdiction would be the first. step toward possibl.e overall improvement of the race through co-pperative effort with the University.- Councilman Anderson asked if there could be some assurance of ultimate development of I the properties along the millrace for park purposes. ~r. Morin replied that i~ is doubtful the Commission c'an obtain deeds or easements if improvement other tha'n in- crease in the flow is cont'emplated at this time. Abatement. 955 East 43rd - A letter ~rom,Elmer Sahlstrom was read_ asking that the Council rescind its resolution ordering abatement of the residence at 955 East 43rd. He said the purchase contract with the Lees is now in escrow pending Circuit Court action on the abatement proceedings. A detailed report from the Building Department was read listing specific items of structural deficiency which would have to be cor- I rected before the building could be occupied. Dr. Purdy iQquired about an ordinance to reg~late house moving and set criteria to relieve the Building Department of decisions:6f this nature.; The Superintendent of Building Inspection said a proposed ordinance including items with. regard to house moving procedures is now ~eing con~idered by the Planning Commission. -- The City Manager said detailed plans and specifications from Mr. Sahlstrom's, designer, Silas Messer, were presented earlier in the day showing how the building could be brought to Code, and that Mr. Sahlstrom asked delay of the discussion until later in the meeting when he could be present. The delay was granted. (See Page 3 4. Traffic Control. 15th and Washington - The traffic engineering department recommended no additional control at the intersection of 15th and 'Washington unless the inter- sections at Charnelton and Lawrence are also controlled, in effect making 15th an I east/west arterial from Olive to Jefferson. Residents of the area had petitioned the Council for a stop sign at 15th and Washington because of accident incidence. Dick Clark, 1533 Washington, urged the Council to authorize a stop sign'at the intersection. .. Variance Extension, Trailer House, 356 Mill - Earl Fisher requested renewal of a variance which would allow a trailer house at this location. Mrs. Fisher said the trailer is to be used in connection with the operation of their paint spraying business. Mr. Anderson moved seconded by Mr. Lassen to deny the renewal. Motion carried. Dr. Purdy moved seconded by Mr. Anderron to approve Item 5 of the Committee report. Motion carried. 2 6. Bids, Fire Truck - Basic bids were submitted to furnish a dielsel 1000 GPM triple combination pumper, with alternate bids taken on a gasoline unit which would provide e the same minimum horsepower requirements. The Fire Department recommended purchase of the Mack diesel unit bid by Pitchford Mack Sales at $37,682.75, including altera- tions making the total bid $37,917.75. The Assistant City Manager said because of the attractive bid price and because the equipment will not be delivered until next budget year, it was recommended that two units be purchased on the bid price for de- livery during the 1968-69 fiscal year. Mr. Anderson moved seconded by Mr. McNutt to approve the recommendation and purchase two units. I ~ouncilman Lassen asked if any problems are anticipated in use of the diesel units with all other units now in use being gasoline, and was told in time all units will be diesel and the only problem at this time is diesel storage for which a tank is now being installed. Mr. Lassen also inquired about the cost of this equipment com- pared to that previously purchased, and the Fire Chief explained the comparative costs and anticipated use of various pieces of equipment now in the Department. Community Buildings and Pool Progress Report - The Parks Director reported that the Sheldon pool and community building are in the final phase of construction and will be ready for use in the near future. The Bethel pool, for which $460,000 was budgeted, is expected to be bid about March 1 and under construction by April 1, 1968. The Amazon project is going ahead as originally planned, the only deletion being 'the pool cover because of lack of funds. The City Manager said the Sheldon pool will open on Saturday, December 2. 4 8. Budget Committee Appointments - The Assistant City Manager mentioned that the terms of Budget Committee members Campbell, Raynor, and Ellwood expire December 31, 1967. Sale, 9th and Almaden Property - The Council previously viewed the area at 9th and Almaden which Joseph Houben offered to purchase from the City for $477.79. Parking Prohibition, Fairfield from Royal north - Because of the narrow width and interference of on-street parking with traffic movement, the Public Works Department recommended prohibition of parking on both sides of Fairfield Street from Royal Avenue rD rth about 900 feet. Dr. Purdy moved seconded by Mr. Anderson to approve the recommendation. Councilman Lassen inquired if property owners on the street had been contacted, and was told they had not. However, the Public Works Department did report the Fairfield School property abuts the street I on one side and the school's officials favor the prohibition. Rezoning to R-2 area on Knob Hill between 38th and 39th, Marlow - The Planning Com- mission recommended denial of the R-2 rezoning request, modified from the original request for R-3G. Lane Air Pollution Authority - The City Manager explained the present arrangement under which the A~r Quality Control office is operated co-operatively with Springfield and Lane County. He said legislation enacted by the 1967 Legislature is worded in such a way as to prohibit Lane County's participation. beginning January 1, 1968. He recom- mended creation o~ ,a regional authority under the new legislation whereby Eugene, Springfield, and Lane County could continue the present air quality control function through a governing body comprised of one representative from each of the three agencies. .The authority under State law is given no taxing authority and must depend upon budget- ing by the participating agencies. . Funds have been budgeted under the present arrange- ment and would be used under the new authority on a contractual basis with each of the agencies until July 1, 1968. The Manager stated also that State law provides for 50% matching funds under a regional authority, whereas individual cities would receive only 30%. I 4 -Abatement, 955 East 43rd (See Page 522-2) - The City Manager explained Mr. Silas Messer, designer enga~ed by Elmer Sahlstrom, has indicated the building in question can be broughi to Code according to requirements listed in the detailed report from the Building Depart- ment with the exception of the upstairs ceiling height. A variance would have to be granted by the Building Board of Appeals for a substandard ceiling height. He recommended th~ ~batement proceedings be rescinded if a building permit can be issued on the plans and specifications to be submitted by Mr. Messer. Both'Mr: Sahlstrom'and Mr. Messer were present. I Mr. Henry Baitis said the legality of the subdivision has not been established, a street cannot be put through because a necessary signature is missing from the deed~ and the City ~ did not comply with subdivision ordinances or house moving regulations. Ervin E. Lay, owner of Lot 29, Mapledale, objected to the time elapsed since start of the Council meeting. He said his assessment notice indicated the public hearing would be at 7:30 p.m., and he moved that the meeting be adjourned to another date when people wanting to discuss the assessments could be heard instead of having other business discussed by the Council first. Mayor Cone ruled the motion out of order. Mr. Lay then protested the amount of his assessment and objected to his prop- erty's being served with sewers and assessed when adjacent property was not. It was explained the property adjacent to his lies within the tentative right-of-way for Highway 126. Mr. Lay also com- mented on the monthly charges made for sewage treatment plant and trunk1ine construction.
