The regular meeting of the Common Council of the city of Eugene, Oregon was called to order at 7:30 p.m.
on December 11, 1967 in the Council Chamb er by His Honor Mayor Edwin E. Cone wit h the following
councilmen present: Dr. Purdy, Mrs. Lauris, Messrs. Anderson, Lassen (arrived late), Mrs. Hayward,
Messrs. McDonald and Wingard. Councilman McNutt was absent.
Minutes of the adjourned meeting held November 27, 1967, as mailed to Council members, were approved.
NEW BUSINESS
1 Councilwoman Hayward congratulated and expressed appreciation to the Jaycees for their
tree planting project on Patterson Street.

Committee meeting held December 7, 1967 :
"Present: Mayor Cone; Councilmen Purdy, Lauris, McNutt, Anderson, Lassen, Hayward, McDonald,
and Wingard; City Manager and staff; and Others.
1 L Budget Committee Appointments - Cou'ncilman Lassen recommended Maynard Sandberg, 1085
Louis Lane, for appointment to the Budget Committee for the term ending December 31,
1970. Previously recommended for. reappointment were Carl Raynor, 387 Dartmoor Drive
(Councilman Anderson) and Mrs. Robert Campbell, 3575 Glen Oak Drive (Councilwoman
Lauris) .
2 2. City Employe Holiday Policy - Councilman Purdy questioned the present policy on holi-
day pay for shift personnel, and the Assistant City Manager explained that shift
personnel are givep an extra day's pay for, each poliday observed by gener& City em-
ployes, unless the~holiday fallson Saturd?y. e
3 3. Open House. School of Public Affairs - The Council was invited to an open house on
December 8, 1967 - 3:00 to 5:00 p.m. - at Hendricks Hall for the newly organized
school of Pub1ic Affairs and Community Services at the University of Oregon.
4 4. Jury Fee. Mainor vs. City - The City IAttorney gave a resume of events leading to the
fil ing of a suit in Circ~it Court by Henry J. Mainor challenging the City's ordinance I
requiring a $30.00 deposit by anyone wishing a jury trial. Mr. Mainor was cited on a
"Driving while right to apply for a license was suspended" violation, said he was
indigent, and requested the right to a jury trial without the required fee. The City
Attorney said the Oregon Supreme Court ruled the, right to trial by jury does not apply
for violation of City ordinances; but that the Eugene City Charter provides right to
trial by jury providing jury fee is paid for one day. If the person tried is convicted,
the deposit pays one day's fees for six jurors; if the person is not convicted, the
deposit is returned to him. No action was taken.

5 5. Parking Validation, 7th and Olive Lot - The City Manager said no bids were received on
the bid call for a parking validation program for the 7th and Olive parking lot. He
said Diamond Parking's proposal for leasing the City lot was based on being able to
operate it in'conjunction with two adjacent lots, but plans have changed for operation
of'the two adjacent lots and Diamond will not be able to operate the three lots as a
unit. The Manager suggested investigation of changing the operation of the Charnelton
and Broadway lot into the ,parking validation program, since it is not concerned with
a parking assessment district nor a borrowing situation. Dr. Purdy again suggested
the use of tokens in on-street meters in areas adjacent to City lots. Councilman Wingard
suggested finding some method of exchanging tokens for coins.
6 6. Auditorium Financial Feasibility Report - Copies of a report were distributed' to
Council members showing the operating costs of a proposed Center for the Performing Arts.
7 7. Urban Renewal Planning Review Committee - The City Manager announced that this Committee I

a. Danebo Fire Station to Goodwill Industries - The' Planning Commission recommended
donation of the Danebo fire station building to Goodwill Industries upon completion e
of the new D~nebo station, subject to conditions to be established by agreement:
(1) To be completed within one year
(a) Existing property to be operated and maintained so as to b~ compatible
with surrounding residential neighborhood.
(b) Submit a detailed plot plan indicating present and, future development,
said plan to be subject to review and amendment as circumstances vary.
(c) Landscape to proyide site screen.from Elmira Road and adjoining properties.
( d) Site obscuring wooden fence, at least 6 feet high, to be maintained on
the east, north, and west property lines.
(e) Rem ove all storage piles of repairable items from visibility from
Elmira Road.
(2) To be completed within two years
(a) All storage piles of repairable it~s to be concealed from visibility

Goodwill Industries is agreeable to the conditions, providing the plot plan to be

I 1 9. Planning Commission Report - November 27, 1967
a. Vacation Keeler Avenue east from Sweet Gum Lane, Rogers - The Planning Commission
recommended denial of the vacation request by Wyatt S. Rogers on the basis that
the street will be necessary to subdivide properties to the east. Dr. Purdy
moved seconded by Mr. Lassen to deny the vacation. Motion carried.
2 b. Vacation Utility Easement, 28th and Taylor, Chowning - The Planning Commission
recommended approval of request from Noble Chowning to vacate a 7-foot easement
along the south line of Lot 10, Block 7, 7th Addition to Ellendale. The Planning
Director said the easement will not be needed since relocation of the sewer.
3 c. Vacation Utility Easement, west of Candlelight Drive, Gilb ert - The Planning Com-
mission recommended approval of request from Kenneth Gilbert to vacate a IS-foot
easement along the west ,line of Candlelight Park.
Dr. Purdy moved seconded by Mr. Lassen to approve the vacation of both utility ease-
e ments. Motion carried.

4 d. Condit ional Use, Group Foster Home, Valhalla Street - The Planning Commission
granted the Lane Juvenile Department a conditional use permit whichwould allow
I a group foster home on Valhalla Street just north of Jeppeson Acres Road for
eight girls, with no'more than ten girls for short periods, and with review of
the permit should three formal, written complaints be filed from neighbors living
within 200 feet of the property. Several letters were addressed to the Council
requesting reversal of the Planning Commission decision. Councilman Lassen asked
if a time limit of one year could be set for review. It was explained the Juve-
nile Department is leasing the house and any time limitation on the permit would
create lease problems, and any scheduled hearing would tend to create neighborhood
problems. The Planning Commission felt the provision for review upon complaint
of three neighbors would provide any review necessary. No action was takm It
was understood the item would be before the Council for further consideration at
its December 11 meeting.
The City Council previously viewed the site, and a slide was presented showing residences of those in
the neighborhood objecting to the home at 1935 Valhalla Street. Arnold Droge of the Lane Juvenile
Department explained the purpose of the home and its proposed operation. He said a similar home for
boys recently in operation on Bailey Hill Road gives no complaint, and that a survey of neighbor s
in the Valhalla neighborhood prior to the Planning Commission hearing resulted in only one objection.
Protests were voiced by residents of the Valhalla Street area on the basis of undesirable association
for younger children in the neighborhood, increase in traffic and teenage drivers, devaluation of
properties, and not being beneficial to girls in the home if neighborhood objects. Those objecting
were Mr. and Mrs. Chester Frew, 1960 Valhalla; Mr. and Mrs. Tom Kokkeler, 2127 Valhalla; Duane Sand-
berg, 2143 Valhalla; William Harman, 1990 Valhalla; Kenneth Pickett, 2158 Valhalla; Richard Kennedy,
I 2270 Valhalla; J. B. Webster, 2126 Valhalla; Mrs. B. E. Thalman, 2725 Jeppeson Acres Drive;
Terry Paulsen, 2035 Medina; and Mrs. Ralph Miller, 2575 Jeppeson Acres Drive.
Mrs. M. C. Petersen, 2215 Valhalla, suggested a rural area for location of the home, and Mr. Droge
explained the purpose of the group home is to integrate the children into the community, whereas a
rural location would tend to isolate them even more. Conversation followed between Council members,
Mr. Droge, and Jewel Goddard, also of the Lane Juvenile Department, with regard to average age of the
girls, average length of time each girl would live at the home, type of supervision, and backup
e counseling service provided by the Juvenile Department. It was explained again that upon complaint
of three neighbors living within 200 feet of the home the Planning Commission would review the
operation.
Edith Maddron, with the Juvenile Advisory Council to the Circuit Court, said the Advisory Council
favors the group foster home concept and that it is working very well across the country. She said
the individual group homes have proven the best way of combatting juvenile delinquency.
Dr. Purdy moved seconded by Mr. Anderson to uphold the Planning Commission in its granting of the con-
ditional use permit for a group foster home for girls at 1935 Valhalla Street, subject to:
(1) Review of the permit by the Planning Commission upon receipt of three formal,
written complaints from neighbors living within 200 feet of the property;
(2) No more than eight girls in residence, except on a short-term basis, when no
more than ten girls would be housed;
(3) Maintenance of the property in a residential manner; and
I (4) Retaining the garage for storage of automobiles and not converting it into
living quarters.
Councilman Lassen asked about maintenance of the property, and Mr. Droge said a caretaker will be pro-
vided. The City Manager explained the provision for group foster homes in the Zoning Ordinance and
said the Fire Code and Public Works requirements have been met.
A vote was taken on granting the permit, and motion carried unanimously.'.
