January 8, 1968
The regular meeting of the Common Council of the city of Eugene, Oregon was called to order at 7:30 p.m.
on January 8, 1968 in the Council Chamber by Council President Glen Purdy in the absence of His Honor
Mayor Edwin E. Cone. Other Council members present were: Mrs. Lauris, Messrs. McNutt, Anderson, and
Lassen, Mrs. Hayward, and Mr. Wingard. Mr. McDonald was absent.
Minutes of the December 11, 1967 Council meeting, as mailed to Council members, were approved.
NEW BUSINESS

Election of Council President and Vice President
Mrs. Lauris moved seconded by Mr. McNutt that Councilman Anderson be nominated for the
position of President of the Council and that the nominations be closed and a unanimous
ballot cast for Mr. Anderson. Motion carried unanimously.

Councilman Anderson assumed the Chair.

Mr. McNutt moved seconded by Mrs. Hayward that Councilman Lassen be nominated for the
position of Vice President of the Council and that the nominations be closed and a
unanimous ballot cast for Mr. Lassen. Motion carried unanimously.

Mayor's Message, 1968 - In the absence of Mayor Cone, the City Manager read the Mayor's
message for 1968. The message was received and filed.

1. Crest Drive - Councilman McNutt asked about the condition of Crest Drive between Willamette
Street and the City limits. The Public Works Director said it is an unimproved street and
that an improvement petition or Council initiation is necessary if it is to be paved. No
action was taken.

mended annexation of William Emery's property subject to his agreeing to pay the entire

3. Planning Commission Report - October 10, 1967
a. Rezone to C-2 area at northwest corner of West Amazon Drive and Larch Street, Maxwell -
The Planning Commission recommended rezoning this property from RA Outer Residential
subject to contractual agreement with the petitioner covering lighting plans, ex-
terior signs,' architectural plans for development, and delay of construction of serv-
ice station on the site until permits are issued for at least 50% of the remaining
structures of which at least 25% are complete. Mr. McNutt moved seconded by Mrs.LaurE
to concur in the Planning Commission recommendation. Motion carried.

Mr. Lassen moved seconded by Mrs. Hayward to approve Item 3a of the Committee report.
A petition signed by 26 home owners in the area and objecting to the rezoning and proposed shopping
center was presented and read. Wayne Carter, 4585 East Amazon Drive, opposed the rezoning on the
basis that it will create too much traffic, there are already other shopping centers and markets in
the area, and the development generally would be a nuisance to the residential area. T~e Planning
Director said restrictions would be written into an agreement covering the rezoning, requiring proper
landscaping and prohibiting high intensity lighting.

Mr. Slaughter, owner of the Jiffy Market at 3443 Hilyard, remarked that there is not enough business in
the area to warrant another shopping center. The City Manager said the Planning Commission can con-
sider only land use when deciding on zone change requests.
A vote was taken on the motion to approve, and motion carried unanimously.

4. Planning Commission Report - December 5, 1967
a. Amending Zoning Ordinance, Veterans Group Care Homes - The Planning Commission recom-
mended amendment of the zoning ordinance to define U. S. Veterans Administration
Group Care Homes and allow them in R-4 through commercial zones, and as a condi-
tional use in R-l, R-2, R-3, andR-3G zones. Mr. Anderson moved seconded by'Mrs.
Lauris to approve. Motion carried.

b. Vacation Easement Firland Heights, Western Engineers - The Planning Commission recom-
mended vacation of a l4-foot utility easement between Lots 3 and 4, Block 2, and be-
tween Lots 3 and 4, Block 3, Firland Heights (off 30th Avenue). Substitute easements
have been dedicated, and the Public Works Department has no objection. Mrs.Lauris
moved seconded by Mr. McNutt to approve. Motion carried.

c. Variance to allow garden center at Willamette and Donald, Hirons - The Planning Com-
mission recommended granting a variance which would allow a garden center in R-l and
R-3G zones at Willamette and Donald. Henry Camarot, attorney representing John
Hirons, asked that sale of gift accessories be allowed. James Pearson, Planning
Commission member, said the Planning Commission thoroughly discussed the l~ of
items to be allowed for sale, and if the scope is enlarged the matter should be re-
ferred back to the Commission. Mr. Camarot suggested limiting the gift accessories
to small garden-type items. Mr. Wingard moved se~onded by Mrs. Lauris to grant the
variance and to include small garden and flower oriented gift accessories in the
merchandise allowed. Motion carried.

5. Planning Commission Report - December 11, 1967
a. Vacation and Dedication, Maxwell Road at Highway 99N - The Public Works Department
recommended vacation of a portion of Prairie Road between Maxwell Road and the
Oregon Electric right-of-way and of an unnamed street between Highway 99N and Bethel
Drive between the Rickhoff and Beckley Estate properties. Also recommended was ex-
change of property with the Beckley Estate at Prairie Road railroad crossing to al-
low realignment and extension of Maxwell Road to Highway. 99N. The Prairie Road
vacation will be completed when a grade crossing north of the present crossing over
Oregon Electric tracks is granted by the Public Utilities Commissioner. Mrs.Lauris
moved seconded by Mr. McNutt to approve the vacation and exchange of properties.

b. Annexation area south of Lorane Highway west of Whitbeck and Storey Boulevards,
B1inkhorn - The Planning Commission recommended approval of the 100% consent peti-
tion for annexation of this property, but requested the Council to withhold final
action until it is determined if the total College Crest Water District annexes.
Approving the annexation petition at this time will permit sewer service to the
property upon completion of an agreement between the City and James Blinkhorn that
will ensure future annexation. Mrs. Lauris moved seconded by Mr. McNutt to approve
initiation of annexation procedure. Motion carried.
James Blinkhorn, 1250 Lorane Highway, asked for relief from sewer assessment because a line already
constructed and connected to contiguous property is adequate to serve the property to be annexed.
The City Manager recommended no additional assessment because Mr. B1inkhorn has already paid assessment
for sewer to serve both lots, but the annexed property would have to be assessed the ~~ per square foot
levy.
Mr. Lassen moved seconded by Mr. McNutt to approve the annexation with the property to carry no addi-
tional sewer assessment other than the ~~ per square foot levy. Motion carried.

Public Works Department recommended award of contract to Bostick Construction Company
on their low bid of $4,599.40. Mrs. Lauris moved seconded by Mrs. Hayward to approve

9. Parking Structure, 10th and Oak - The City Manager said $10,000.00 has been made avail-
able to the City to proceed with design financing of the proposed parking structure at
10th and Oak. The funds were provided by Eugene Industrial De~elopment Corporation
through the Chamber of Commerce .to employ Norman Jacobson to proceed with a . schematic
design with the understanding that if the City is successful in the suit pending before
the Supreme Court and the project proceeds, the money will be repaid to EIDC. If the
City loses its case, EIDC will have made a donation to the project. The City"Attorney
said all necessary papers have been filed for the City w~th .the Supreme Court in addi-
tion to a request that the case be advanced on the.docket so as to qe heard as soon as
possible. Councilmen McNutt suggested the Chamber of Commerce and EIDC be complimented
on behalf of the Council.

Court and the hearing is now scheduled for February 5.

10. Southern Pacific Franchise, 7th Place Crossing - The Southern Pacific Company requested
a 10-year extension of its franchise for crossing at 7th Place in the industrial area.
The present franchise will expire February 3, 1968. There were no objections. Mr.McNutt
moved seconded by Mrs. Lauris to extend the fr~nchise as requested. Motion carried.

11. Harlow Road.Right-of-way, Potter - The Public Works Department recommended purchase of
a 20-foot by 58.6-foot parcel for widening Harlow Road from Roy and Marjorie Potter

12. Curb Sidewalk on Greiner, Ellen, 19th - The Public Works Department recommended loca-
tion of sidewalks at the curb on Greiner Street from 18th to its southern terminus,
Ellen Avenue in South Acorn Park Addition, and 19th Avenue from Greiner Street east.
Mrs. Lauris moved seconded by Mr. McNutt to approve. Motion carried.

13. Sidewalk, University between 15th and 18th - A letter was read from a staff writer of
the Oregpn Daily Emerald, Gilbert Hulin, requesting installation of a sidewalk on the
west side of University Street between 15th and 18th abutting the Pioneer Cemetery.
The Manager said contact was made with the University concerning their paying the cost
of installation with the result that the University will place the project on their
list of needed improvements to be presented to the State Board. The City Manager did
not recommend the City's paying for the sidewalk since it would serve only the Uni-
versity. The traffic division is now studying a meter program for the parking area
created by the University adjacent to the walk, and if meters are installed it is possible
that the necessary 3-foot slab for setting meters would provide a portion of a walkway.
It was the consensus that the University should be responsible for installation of the
sidewalk. A motion to that effect was made by Mr. Lassen, seconded by Mr. McNutt,
and carried unanimously.

14. Liquor Licenses - The City Manager explained that the application for Class B Dis-
pensers license submitted by Aristo Foods, Inc., for the Holiday Inn at 215 Coburg
Road covered change of ownership, formerly Southern Lounge of Oregon, Inc., for the
balance of 1967, and that a renewal for Aristo for 1968 would be forthcoming. Both
have approval of the Police Department. Other applications for renewal presented

4. Voters Pamphlet - Proposed statements for a voters pamphlet with regard to the bond
election to be held February 20, 1968 were distributed, with the Council to submit
any suggestions at the January 8 Council meeting.

5. Agreement, Sheldon High School Baseball Field - Responsibility f or development of the
baseball field at Sheldon High School into alighted field, originally started by the
Lane County Baseball Association, has been accepted by Eugene Boys Athletic Association.
According to provisions of the proposed agreement between the City, School District
No.4, and EBAA, lights, previously purchased for the field by the city of Eugene, will
be installed by EBAA and will become the property of the School District. The field
will be maintained by the City with the School District paying a proportionate share
of the cost according to the amount of time used by school activities. Scheduling use
of the field during the sunnner months will be done by Eugene Parks and Recreation De-
partment. Mr. Anderson moved seconded by Mrs. Lauris to approve the agreement. Motion
carried.

6. Amazon-Flat Creek Watershed Pro;ect - A report from the Public Works Department was
presented to the Council reconnnending that the City accept responsibility for obtaining
rights-of-way and maintenance for an additional section of approximately one-half mile
of the Amazon-Flat Creek Watershed drainage project. since this project is essential to
the drainage of the Danebo area in the western pa r t of the City. The City has con-
tracted to do the mapping and will be paid for the costs by the Soil Conservation Service.
Mr. Donald Stettler of the United States Soil Conservation Service explained that the
work on this part -of the project could probably not be started this year but that the
land rights must be acquired by June 1968. Dr. Purdy moved seconded by Mr. Anderson
to approve the City's participation in the project and that the City make every effort
to accelerate the project in order to get construction started in 1968. Motion carried.

7. Harlow Road Right-of-way, Kisska, Johnson - The Public Works Department reconnnended
purchase of two properties for.widening Harlow Road:
a. A 20-f6ot strip of land on Harlow Road from VanDuyn to Calvin from Lester and
Virginia Kisska for $930.00.' .
b. A lot about 252 long by approximately 70 feet deep at 3280 Harlow Road from
Charles and Lola Johnson for a total price of $17,750.00 with the owners to be
allowed free occupancy until March 15, 1968.
Mr.' Anderson moved seconded by Mrs. Hayward to approve purchase of the two properties
as reconnnended. Motion carried.

8. Parking Prohibition, Fairfield Street - Reconsideration of the prohibition of parking
on Fairfield Street between 99N and Royal Avenue was requested by several residents
of Fairfield Street. The Traffic Engineer reconnnended that the parking ban be con-
tinued since the street is narrow and acts as a -funnel for large numbers of venicles
from 99N to a large residential area. It was explained that the signs would be re-
moved and the curbs painted as soon as weather permits. Mr. McNutt moved seconded
by Mrs. Hayward to continue the ban on parking on both sides of Fairfield Street.
Motion carried.

Ernest Igo, 869 Fairfield, and Welbern Lowwood, 849 Fairfield, requested that the parking prohibition
be limited to the west side.
Councilman Lassen suggested striping the street off-center to designate travel lanes and marking park-
ing areas. The Traffic Engineer said parking stalls are marked in time limit zones only, and the '

City Manager said if parking is allowed on the east side, it would be better not to have center line
striping to allow maneuvering fro two-way traffic.

9. Paving Crest Drive - It was explained that City initiation of paving Crest Drive from
Wil1amette Street to the City limits has been discussed several times in the past but
had been postponed. The drive is arterial in nature and serves a large residential
area just outside the City limits. It was explained that this area is under pressure
from the County and State to annex in order to have sewers installed to solve serious
sanitation problems. Discussion brought out the fact that the new enabling State
legislation to allow cities to annex adjacent territories because of sanitation problems
which cannot be solved otherwise could not be used unless a Charter amendment is ap-
proved by the voters. Mrs. Hayward moved seconded by Mr. Anderson to initiate paving
Crest Drive. Motion carried, Mr. McDonald voting no.
After further discussion concerning the Charter amendment, Mrs. Hayward moved seconded
by Mr. Anderson that the City Manager be directed to prepare a report on the necessary
amendment and the possibility of putting it on the May 1968 election ballot. Motion carried.

10. Assessment Segregations - Authorization was request to segregate $95.71 from a
total assessment of $1,033.25 against property at 44th Avenue and Pinecrest Drive
(File S67E) which would leave a balance of $1,937.45, Byrnes-Lemke. Another request
was for segregation of $1,097.36 from a total assessment of $1,937.45 against prop-
erty at Coburg Road south of Tandy Turn (File S67I-Weiser-Ze11ner) 1aeving a balance
of $840.09. Mr. Anderson moved seconded by Mr. McNutt to approve the segregations.
Motion carried.
Mr. Lassen moved seconded by Mr. McNutt to approve Items 9 and 10 of the Committee report. Rollcall
vote. All councilmen present voting aye, motion carried.

11. Miscellaneous
a. A letter from LeeBishop was presented objecting to the proposed plan for making
a one-way couplet of 18th and 19th Avenues.

b. Medical Bill, Jail Inmate - A report concerning a medical bill incurred by an
indigent prisoner who became ill and was sent to the hospital by the jail staff
and subsequently underwent brain surgery was presented to the Council. The total
including hospital and doctors bills was $3,966.15. Since the prisoner's sentence
expired while he was in the hospital, about $600 of the total was incurred after
termination of his sentence. The City Attorney reported that under State statutes
the City is responsible for at least the amount of the bill which was incurred
before the prisoner's sentence expired. Mr. McNutt moved seconded by Mr. Anderson
to pay the bill from the Emergency Fund. Motion carried."

The letter of protest from Mr. Gaskill was read. Mr. Gaskill was present and compared estimated costs
published prior to annexation with actual cost. The 'error in the publication was explained. Mr. Gas-
kill questioned assessments on property in the assessment area owned by Mayor Cone. Councilman Lassen
said at the present time there is no access to the Mayor's property. Councilman Wingard asked for a
report on the status of assessments levied against property belonging to Mayor Cone.

is large enough to accommodate another building lot. He said if an adjustment is made in the assessment
against this property, adjustments would have to be 'made against other lots in the area assessed ,in the
same manner.

Mrs. Betty Niven, Planning Commission member, suggested the mapped streets statement not be limited
to arterial streets. She said she felt it should include any type of street for which right-of-way
may be needed. It was understood the City Manager and Mrs. Niven would work out the wording of the
statement.
With regard to the statement on continuity of local government, Councilman Wingard asked for a limit
on the length of time an interim Council would serve. The City Attorney explained the interim Council
would serve only long enough to choose Council members from citizens of the community.
Mr. Lassen moved seconded by Mr. McNutt to approve the statements as read and amended. Motion carried.
Upon motion duly made, seconded, and carried, the meeting was adjourned to Monday,
