Anderson in the absence of Mayor Edwin E. Cone at 7:30 p.m. on January 22, 1968 in the Council Chamber. Other councilmen present were Mrs. Lauris, Messrs. Purdy, McNutt, and Lassen (arrived late), Mrs. Hayward, and Messrs. McDonald and Wingard. 1 NEW BUSINESS Councilwoman Hayward reported that she received a call with regard to inadequate street lighting at the corner of 27th and Pearl. Because of the Socio-Environmental seminar scheduled for that day, the luncheon meeting at Pacific First Federal will be rescheduled. I Councilman Lassen entered the meeting. 2 Werner Prehsl, an exchange student from Salzburg, Austria, presented a book about Salzburg to the people of Eugene with greetings from the Mayor, City Council, and people of Salzburg. Acting Mayor Anderson accepted the gift and presented Mr. Prehsl with a water color of a covered bridge to be taken back to Austria. e COMMITTEE REPORTS Committee meeting held January 11, 1968: "Present: Councilmen Anderson, Lauris, Purdy, McNutt, Lassen, Hayward, McDonald, and Wingard; City Manager and staff; members of the Bethel Swimming Pool Advisory Committee; representatives of School District 52; and others. 3 1. Commendation, Police Department - Councilman Anderson presented a letter received from Jack D. Sills of Portland, Oregon, complimenting Eugene's police force on their handling of traffic on the day of the Oregon- Oregon State football game. . Mr. Lassen moved seconded by Dr. Purdy that Item 1 of the Committee report be received and filed. Motion carried. I 4 2. Echo Hollow Pool - Council members were given reports showing design development pre- pared by Briscoe and Berry, architects, of the 50-meter swimming pool proposed for the Danebo area. Jon Berry explained the concept and answered questions from the Council. The City Manager explained that estimated cost of the proposed design is $138,842 more than anticipated. Originally, funds were budgeted for a 25-meter ~ool. Subsequent Council action authorized a 50-meter pool which would allow competitive swim meets. The amount needed over budgeted funds to construct a 50-meter pool as designed could be cut to $106,930 by deletion of the wading pool, some planting and irrigation, exterior radiant heat, and diving tower, and with School District 52's providing the interior radiant slab. e 1/22/68 - 7 ~ r G)6) o ...~ e 11/22/68 ! Mr. Lauris moved seconded by Mrs. Hayward to accept the preliminary plans and raise the necessary $106,930 for financing. I Councilman Lassen asked if there is any alternative - whether a portion of the pool can be constructed now and the additional length constructed later. Mr. Berry said it probably could, although difficult to accomplish. Councilmen Anderson and McNutt and members of the Advisory Committee urged completion of the entire pool at this time. The City Manager suggested constructing a smaller community building at Amazon Park to make available about $140,000 from the balance of the bonds authorized - $750,000 _ to be sold in April. Mrs. Lauris moved seconded by Mrs. Hayward to accept the plans as presented with the recommended deletions and transfer $106,930 from the April bond sale to complete the financing. Councilman Lassen expressed concern about elimination of the wading pool. He said its elimination would preclude use of the entire facility by families with small children. Representatives of School District 52 appeared concerned about delay in construction of the pool and urged its rapid completion. The Manager explained the change in con- dept occasioned the delay for designing. Mr. Berry said that with approval now the pool could be under construction in June 1968, with probable completion in June 1969. e Mrs. Lauris moved seconded by Mrs. Hayward that the wading pool be included and the plans accepted and that $5,325.00 in addition to the $106,930.00 be transferred from the April bond sale to complete the financing. Motion carried unanimously. I Mr. Lassen moved seconded by Mrs. Lauris that Item 2 of the Committee report be approved. Councilman McDonald recommended that a top figure of $608,000 be considered for the swimming pool. The City Manager said the total estimated cost is $585,000 with the deletions recommended, .and that it could be worked out within the $608,000 figure. Councilman Purdy commented on the increased cost over the originally considered 25-meter pool and asked if there will be ample parking to accommodate competitive meets. The City Manager said parking was discussed with the School District people and ample space will be made available. Mr. Berry said that since the estimate of $470,000 was given for a 50-meter pool, they were asked to consider other items such as extra depth for a diving tower, wading pool, radiant heat, etc. He said the present cost estimated is based on accurate drawings, he doesn't anticipate any great variation, and any changes which could affect the budgeted amount would be brought to the Council's attention. . Mr. Lassen moved seconded by Mrs. Lauris to approve the preliminary plans at a total estimated cost of $585,913.00 including $5,325.00 for a wading pool, and less $4,200.00 to be assumed by School District 52 for interior radiant heat slab. Rollcall vote. All councilmen present voting aye, except Counil- men Purdy and Wingard voting no, the motion carried. 1 3. Planning Commission Report - December 11, 1967 a. Amend Code re: Trailers in Setbacks - The Planning Commission recommended a 48- hour restriction on parking in the front yard setback trailers, camp trailers, boat trailers, camperettes, and other vehicles not used daily, and to allow such vehicles to be parked within the interior yards. Dr. Purdy moved seconded by Mrs. Hayward to approve the recommendation. Motion carried. I Mr. Lassen moved seconded by Mr. McNutt to approve Item 3a of the Committee report. Motion carried. 2 4. Lane Housing Authority Leased-Housing Report - A letter from the Housing Authority was presented reporFing that 51 families of the 300 authorized have been placed under the Leased-Housing Program. e 3 5. Land and Water Conservation Funds, Hendricks Park - A letter was presented from Central Lane Planning Council informing the City the Hendricks Park project qualified under the Land and Water Conservation Funds program. A recommendation was made to the Lane County Advisory Board that $12,159.43 be established as Eugene's share for 1967-68. Mr. Lassen moved seconded by Mrs. Lauris that Items 4 and 5 of the Committee report be received and filed. Motion carried. 4 6. National Council on Aging - An invitation was issued to Councilwoman Hayward to take part in the program as an elected representative of local government at the San Francisco meeting of the National Council on Aging January 29-31, 1968. Mr. McNutt moved seconded by Mrs. Lauris to authorize Mrs. Hayward's attendance at the meeting. Motion carried. . ~j 5 7. SUA Jail Report - Council members were invited to hear presentation of the preliminary jail report prepared by SUA, January 17, 12:00 noon, at the England Grille. Congressional/City Conference - The annual meeting of city officials with Congressional members sponsored by the National League of Cities will be held April 7-9, 1968 in Washington, D.C. 7 9. Motion carried, Councilman Wingard abstaining. 2 11. 7th and Willamette Parking Lot - Otto Poticha, architect, objected to the appearance of the parking lot nearing completion at 7th and Willamette. He said it is 100% blacktop and has no provisions for plantings. He suggested the Renewal Agency and Chamber of Commerce make use of the area in terms of information booths, etc., rather than filling the entire corner with cars. The temporary nature of the lot was ex- plained since it is within the boundaries of the Central Eugene Project now in the planning stage. The Manager said permanent landscaping will be installed if it is decided the lot will be permanent. In the meantime, removable plants, screening, etc., will be installed. No action was taken. 3 12. Parking ProhlbEion, Fairfield Street - Councilman Wingard asked if residents on the street could be allowed to park automobiles in the parking strip. The Manager said it would require an amendment to the Code or would have to be allowed on a variance basis. He said two of the residents objecting to the parking prohibition had corner lots, but the situation would be investigated." Water Supply, State Street Area - Councilman Lassen asked if any information was re- ceived concerning supply of water for domestic and fire protection purposes to the Ohio, :Wisconsin, Dakota, Minnesota Street area, and was told EWEB has not responded to the City's inquiry. Mr. Lassen moved seconded by Mrs. Lauris that Item 1 of the Committee report be received and filed. Motion carried. 5 2. Planning Commission Report - January 2, 1968 a. Rezoning C-3P area on south side of Green Acres Road between Delta Highway and Norkenzie, Vik - The Planning Commission recommended approval subject to modifica- tion of the original agreement concerning landscaping and buffering, and approval of building plans by the Building Department. No action was taken. 6 b. Rezone to CR area south of Oakmont Way between Coburg Road and Oakway Road, McKay - The Planning Commission recommended approval subject to modification of the original agreement with regard to landscaping, buffering, off-street parking, and building design. No action was taken. 7 c. Rezoning to C-3P area at 1950 and 1955~ Empire Park Drive, Abbott - The Planning Commission recommended approval to allow expansion of existing mobile home sales business, subject to agreement requiring removal of structures on the property within one year and screening along the west property line. No action was taken. Mr. Lassen moved seconded by Mrs. Lauris to approve Items 2a, 2b, and 2c of the Committee report. Motion carried. 8 d. Rezoning to C-3P area on north side of 19th between Oak and Pearl, Whitaker - The Planning Commission recommended denial. No action was taken. The City Manager explained Miss Whitaker requested postponement of her petition at the Planning Com- mission meeting, but the Planning Commission felt it was not likely the request would be granted and therefore recommended denial. Miss Whitaker asked that it be referred back to the Planning Commission and then withdrawn from the Planning Commission's agenda so that it could be brought back for con- sideration if she so desires. Mrs. Lauris moved seconded by Dr. Purdy to refer the item back to the Planning Commission. Motion carried, Mr. McDonald voting no. 9 e. Rezoning to M-2 Light Industrial area at 1710 and 1712 West 8th, Echo Spring Dairy - Requested to allow expansion of existing offices. The Planning Commission recom- mended denial of the M-2 zone, but recommended rezoning the area to CR Commercial Residential. No action was taken. Rezoning to R-2 Two-Family Residential area south of 37th between Kincaid and Potter, Barnes - The Planning Commission recommended denial. Rezoning to C-2 Neighborhood Commercial and R-3G Garden Apartment area at 1330 Coburg Road, Cosgrave and Associates - The Planning Commission recommended denial of the rezoning which would allow a service station si;lie.~and apartments. Councilman Anderson asked if consideration was given to R-3G for the entire area. The Planning Director said it was felt R-2 is the highest density desired in such areas to serve as a buffer from major arterials. No action was taken. Mr. Lassen moved seconded by Mrs. Lauris to deny the requested rezoning. Henry Camarot, attorney representing Frank and .Grace Rust, property owners, and Cosgrave and Associates, displayed exhibits showing development of area surrounding the property petitioned for C-3P andcR-3G zoning. He also presented affidavits citing other zone 'changes in the area, option taken by an oil company for service station construction, history of rezoning requests on this property, other com- mercial interests in the area~ etc. Mr. Camarot stated that the Rusts are denied use of the property if it is restricted to residential use when that use is not feasible nor practical, and that the Rusts are discriminated against when commercial rezoning is denied and other properties in the area have been rezoned commercial. He said increase in vehicle traffic and noise make it impossible to use the prop- erty for residential purposes, and that the character of the entire neighborhood has changed from residential. Mr. Camarot stated his clients are willing to enter into any type of agreement imposing limitations for rezoning the property. e John R. Axtell, 2573 Sharon Way, objected to rezoning which would allo~ a service station on the prop- erty. He said he was also concerned about children going to and from school pas~ this corner if a service station is permitted. He suggested an R-2 zone for the property, or some other zone permitting higher density than single-family residential. I George Taylor, 2560 Sharon Way, and Leonard Frojen, 360 Van Avenue, also objected to C-3P zoning. Mrs. Niven, Planning Commission chairman, explained the Planning Commission recommendation for denial was because the Commission felt planned unit development of the property would be the best use, with the corner portion used for buffering from adjacent commercial use. The City Attorney said in view of material presented by Mr. Camarot, it might be well to continue the hearing to allow the Council an opportunity to review the exhibits. Mr. Camarot had no objection to a I continuation. He said he felt the corner portion of the property is not suitable for any type of residential zoning - a bank branch would be acceptable, or perhaps parking on the corner lot. .j Mr. Lassen moved seconded by Mr. McNutt to continue this item to the February 5, 1968 Council meeting. Motion carried. I 3,.1 h. Rezoning to R-4 Multiple-family Residential area at 3015 South Willamette, Mayer _ Tpe Planning Commission recommended denial. No action taken. Mr. Lassen moved seconded by Mrs. Lauris to deny the rezoning. I Mr. Mayer, owner of the property petitioned for rezoning, said he did not feel he could develop the property properly under R-3G which the Planning Commission indicated it could recommend, that it would take too much investment with no increase in return, and asked that the requested R-4 zoning be granted. James Pearson, Planning Commission member, said the Planning Commission recommended denial because R-4 wouilid constitute spot zoning since all adjacent properties carry R-3G density. e A vote was taken on the motion to deny R-4 zoning, and motion carried. 4 i. Rezoning to R-3 northwest corner of 15th and Lawrence, Wilson and Bettis - The Planning Commission recommended denial. No action was taken. Mr. Lassen moved seconded by Mrs. Lauris to deny the request. Mr. C. M. Stafford, 620 East 33id Avenue, said he owns property north of the area petitioned for rezon- ing. He said the area generally needs new dwellings and asked that his property be included in the petition and considered at another Planning Commission meeting. The Planning Director said this is one of the first areas which will be considered when the General plan is updated - that it will be at least a year and a half before the General Plan is completed and approved by various local jurisdictions. . A vote was taken on the motion to deny, and motion carried. 5 j. Salary Adiustment, City Employes - The City Manager requested consideration of a 1% increase in salaries for all City employes to offset the increase in payroll deduc- tions for PERS and Social Security. He said a 1%' increase to all employes will cost about $17,000 to $18,000 for the period January 1 to July 1, 1968, and that existing receipts and appropriations are sufficient to absorb the expense. Dr. Purdy moved seconded by Mr. McDonald that salaries of all City employes be increased 1% effective January 1, 1968. Motion carried. Councilman Purdy asked for a review of the City's retirement program. 2 4. PP&L Easements, Airport - Authorization was requested to convey easements to Pacific Power & Light for relocated power lines to serve Mahlon Sweet Field. Alley Entrance, Johnson Furniture - Dean Morris, architect, requested permission for an unprotected entrance from the south side of Johnson Furniture Company building to the 7th and Willamette parking lot. The Superintendent of Building Inspection said no problems are anticipated. The property owner will assume responsibility for any hazard, and there will be no penalty to the fire rating. Councilman Anderson suggested the Eugene-Springfield Area Transportation Study should be presented at that time. The City Manager suggest Jerry Attig, chair- man of the ESATS policy committee, be asked to present the study. Agreement, Oakhill-Interstate 105 Section - The City Manager explained a review of a pro- posed agreement with the State on the Roosevelt extension from the Washington-Jefferson Bridge indicates interchange designs are inadequate to handle anticipated traffic volumes as shown in the recently completed ESATS study. Also, the agreement proposes severance of Polk Street which appears questionable in view of its possible need for local traffic and for access to park property. Modification of the agreement has been requested from the State Highway Department to allow individual interchange designs to be presented to the city of Eugene for approval prior to construction, and to allow further considera- tion of the Polk Street severance. The City Attorney explained that Oregon Electric Company and the city of Eugene have agreed, as stipulated by the Public Utility Commissioner, that the City will remove the paving around the main crossing and two spur crossings on Garfield Street to allow Oregon Electric to accomplish track work necessitated by the City's improvement of Garfield Street. Removal of the pavement will be at City expense, as well as its replacement when Oregon Electric completes the track work. The Public Works Department and the City Attorney recommend approval of the agreements. HEARING ON ZONING ORDINANCE 9 Council Bill No. 8257 - Regulating Zoning in the city of Eugene, was submitted and read in full. e I Mr. Lassen moved seconded by Mrs. Lauris that the bill be read the second time by council bill number only, with unanimous consent of the Council. Mrs. Betty Niven, Planning Commission chairman, and Moe Thomas, Planning Commission member, described the procedure followed in the preparation and consideration of the new zoning regulations and the major differences between existing and proposed ordinance. , Mrs. John Northway, president of the League of Women Voters, made a statement in behalf of the League favoring the proposed ordinance and urged co-ordination of City and County zoning regulations. A letter from the Urban Affairs Committee of the Southwest' Oregon Chapter of American Institute of Architects was presented favoring adoption of the new ordinance. Also, a letter was presented from Quiner and Britton, consulting engineers, takang exception to Section 18.05 and questioning five other specific areas of the new regulations. . "" George Marx, co-ordinator for various organizations which worked with the Planning Commission throughout preparation of the ordinance, said the organizations generally endorse the new regulations except for three major areas which need to be resolved. I The City Manager read the descriptions and purposes of Articles 1 through 6, with Mr. Marx commenting on each article and general discussion on each article as they were read. ~ith regard to Article 2, Section 2.01(e) ~ Establishment of FH Flood Hazard Area: Sub-District _ ~r. Marx commented on the difference between City and County zo~ing, especially with reference to areas annexed to the City, and recommended a committee be formed to work on zoning requirements in these areas. e ~ ~ 39 e 1/22/68 I Article 4 - RA Suburban District - Mr. Marx recommended that regulations on sale of crops in this district be the same as in AG Agricultural. It was the consensus that there would be no problems in this area. Article 5 - R-l Single-Family Residential - Mr. Marx said he felt the ban on parking in front yards and driveways and the requirement for two parking spaces per dwelling unit, provided for in another section of the ordinance, could cause trouble. Article 6 - R-2 Limited Multiple-Family Residential - Mr. Marx said many developers feel the allowance of 2700 square feet for each living unit in multiple-family dwellings is too much. Mrs. Niven pointed out that this requirement could take a small adjustment to accommodate existing standard lots, but the Council should not consider less than 2650 or 2660 square feet per unit. e Wayne Johnson, developer, said he felt consideration of the ordinance was moving too fast, and recom- mended that the 1959 zoning ordinance remain in effect until the new General Plan is completed. Mrs. Niven remarked that if the new zoning ordinance is not effective when the updated General Plan is reviewed, the review could not be done properly. Mr. Wingard moved seconded by Mrs. Hayward to change the square footage requirement for each living unit in multiple-family dwellings to 2650 square feet (Section 6.01, 1st paragraph).
