(,) tjk ,',,& 2~5~68__.. ..,. e Council Chamber Eugene, Oregon February 5, 1968 I Adjourned meeting of the Common Council of the City of Eugene, Oregon - adjourned from the meeting held January 29, 1968 - was called to order by Council Vice President Bruce Lassen in the absence of Mayor Edwin E. Cone and Council President Lester E. Anderson. Other councilmen present when called to order at 7:30 p.m. on February 5, 1968 in the Council Chamber were:'Mrs. Lauri.s, Mrs. Hayward, Mr. McDonald, and Mr. Wingard. Counci.1men absent in addition to Mr.Anderson were Dr. Purdy and Mr. McNutt. Minutes of the Council meeting held January 8, 1968, as nlai1ed to Council members, were approved. 1 NEW BUSINESS Rezoning 1330 Coburg Road - The City Manager asked that this hearing be. continued to the February 26, 1968 meeting since the City Attorney was not able to be present at this meeting. Mr. Camarot had no objection, but did request that he receive copies of the City Attorney's affidavits or other material a few days before the February 26 meet- ing to give him an opportunity to review it. e Mrs. Lauris moved seconded by Mrs. Hayward to continue the hearing to February 26, 1968. The Public Works Director said he received a letter of protest from one owner of abutting property objecting to installation of the sewer. He said there is a planning problem involved, but the Department does not want to wait until the February 26 meeting for award of the contract. The Public Works Department also recommended award of the contract for sewer reconstruction in the alley between Columbia and Moss, 19th and Fairmount, to the low bidder. - Mrs. Lauris moved seconded by Mrs. Hayward to award contracts to the low bidders on each project, with the award on the 20th Avenue sewer subject to Council approval at the February 8 comm~ttee meeting. The City Manager explained that because of an apparent problem of loose soil at one end, soil tests were required before the architect could proceed with the design. Councilman Wingard questioned the reason for the air conditioning unit in the Public Works Department - whether the building is going to be air conditioned a room at a time. Taxation of Signs Over Right-of-way -' Councilwoman Hayward asked for a report concerning a tax on signs extending over public rights-of-way as a possible source of revenue for the City. The City Manager said it is an item which possibly could" be discussed at the time the sign ordinance is under consideration. 2 2. Oregon Arts Commission - Announcement was made of a dinner meeting at the Eugene Hotel on February 8, 1968 at which the Oregon Arts Commission will make a presentation of its activities. Mrs. Lauris moved seconded by Mrs. Hayward that Items 1 and 2 of the Committee report be received and filed. Motion carried. e 3 3. Trailer Variance, 3758 West 11th, Ridenour - Donald F. Ridenour requested permission to place a house trailer for watchman living quarters at 3758 West 11th. Mr" Ridenour plans to use the property for sale of ornamental garden-type products and is apprehensive of vandalism in the area. Total land area is about 3100 square feet. It was explained that severance damage is more than the value of the property since the right-of-way will be brought: to within 11 feet of one house. Human Rights Commission Report - Dr. Norman Pott, chairman, and Mr. Edgar Brewer, member, Human Rights Commission, presented the Commission's recommendations on two CORE demands with regard to employment and housing referred to the Commission by the Council. The third item referred - municipal legislation - Dr. Pott said is still be investigated with further work to be done before a report is made. The Commission felt the current method of examination for one c1assificationof employes based on verbal performance has little value so far as future success on the job is concerned. (6) That special efforts be made to make availability of City positions known to the Negro community. With regard to the CORE demand for low-cost housing on an open-occupancy basis, the Commission recommended: e (1) That the Council take immediate steps to authorize an application by the Lane County Housing Authority under the Leased-Housing Program for 300 additional rental units to be made available to low-income families in Eugene. The Commission felt it would be well to make the leased-housing program a continuing one because of the expected population growth in the community and the time element involved in gaining appropriations under the Program. I (2) That the Council encourage creation of a non-profit housing corporation to sponsor housing projects for low-income families, utilizing various Federal programs. Dr. Pott said it is recognized there is activity in this area now through the Joint Housing Committee, but that the Commission would support the Joint Committee with a resolution from the Council to form the corporation. (3) That the Council support distribution of information to Negroes through all available channels regarding housing programs now operational, pro- cedure for application for this housing, and procedure for filing a dis- crimination complaint if it is indicated. Dr. Pott said one Commission project now is an attempt to itemize all channels of communication in the City, and particularly communication with the people who could benefit. He said if the Commission is to do the job, it would require an increase in the Commission's budget allotment, and that the COmmission would bring back an estimate of the cost involved. . Betty Niven, chairman of the Joint Housing Committee, described the aims of the Com- mittee and progress it is making. She distributed copies of a questionnaire with which the Committee is attempting to collect data with regard to need for low-income housing in relation to public transportation and to desires of low-income families as to location and type. She asked that the Human Rights Commission help in getting responses to the questionnaire from those people the Commission represents. I Councilman Anderson, also a member of the Joint Housing Committee, explained possibilities explored in arriving at a recommendation concerning which type of non-profit development corporation should sponsor low-income housing. He said the Joint Committee will consider a recommendation which will be part of a recommenda- tion to the City Council to establish a private non-profit corporation composed of citizens of the community interested in housing who would represent vusiness and have access to financial assistance and advice, and patterned after the Eugene Industrial Development Corporation with the necessary modifications to meet the non-taxable status required to be eligible for Federal grants. e Lee Anderson, Lane County Housing Authority, reviewed the progress of the Authority in leasing the present units authorized under the Leased-Housing Program, and said additiona1U1its wou1d~obab1y be needed about the first part of 1969. He said the data supporting the recent application may still be valid, and that possibly the only delay inapprova1 of an application would depend upon allocation of appropria- tions at the Congressional level. Mrs. Hayward moved seconded by Mr. McDonald to authorize application for 300 addi- tional units under the Leased-Housing Program. Motion carried, Mr. Lassen voting no. Mrs. Hayward moved seconded by Dr. Purdy that the Council direct the Human Rights Commission to bring to the Council a recommendation for a program to ensure getting information about housing programs to the Negro community (and other minority groups), with an estimate of the necessary funds to accomplish the program. .' Dr. Pott asked that employment and housing be included in the same motion. I Kurt Neustadter, Commission member, said additional units are needed beside the 300 units authorized. He said there is merit in a non-profit corporation for low-income housing since it would keep the property on the tax rolls. Councilman Anderson said the two major objectives of the Joint Housing Committee are to get information on needs of the community and to get a non-profit development corporation underway. Councilman Wingard expressed the opinion that formation of a non-profit housing corporation does not mean public housing - that it is a means of keeping a supply of land available. e A vote was taken on the motion as stated, and motion carried. 2/5/68 - 10 ~ ~ 52, e 2/5/68 The Council turned to the Conunission's reconunendations concerning employment, and with regard to the first reconunendation, Dr. Purdy said he felt the City should co- operate with employers in Lane County to place people in the private .sector, rat~ r than rewrite the City's employment policies. Councilman Anderson remarked that any program for training must have qualified people to do the ". training which will add to personnel costs. Mr. Neustadter said it was not the Conunission's intent with regard 'to its employment reconunendations to create "featherbedding" - rather that realignment of job responsibilities might be used to help the handicapped and unskilled. With regard to the Conunission's reconunendations 2, 3, 4, and 5 on employment, the City Manager said it has been the City's general and traditional policy to employ the best people possible and pay the going rate for their services - that it has not been a City personnel policy function to train and assist the unskilled and unemployable in developing themselves to become better able to selytheir services. He said if this policy is changed, it would need to be spelled out to determine what the results might be in terms of expense for the services given. He -said the City's personnel section was recently reorganized, and it would be most desirable for the new Personnel Director to have an opportunity to work with the Human Rights Conunission to try to determine the best implementation of the Conunission's reconunendations and the cost involved.. The Manager expressed special concern with regard to any change in pro- cedure established for selection of policemen" and firemen which would result in .less qualified people for these departments. The City Manager said most of the staff feels there is a need for better testing and selec- tion methods, but not formal civil service. He said standardization of employment practices for all departments is needed, and that a progress report would be forthcoming from the Personnel Department with regard to changes being made. I Councilman McDonald asked if the words "as an equal opportunity employer" legally could be added to the regulations setting up civil service. The Manager said equal opportunity in employment so far as civil service is concerned can be clarified in the resolution which will be brought back declaring the City is an equal opportunity employer. Councilwoman Lauris suggested the possibility of applying for Federal funds to help defray expense of in-service training. The Manager. suggested Lane Conununity College and Lane Human Resources as sources of specific training programs. e :i ;1 A vote was taken on the motion to approve the Conunittee report, and motion carried (with agreement that the words "and other minority groups" be added after the words "Negro conununity" in the Hayward- Purdy motion directing the Conunission to bring a reconunendation with regard to disseminating informa- tion on housing programs). Mrs. Hayward moved that members of the administration be asked to meet with members of the Human Rights Conunission to explore the possibility of adopting the Conunission's reconunendations on employ- ment - regrouping of functions and jobs and training possibilities. There was no second. The City Manager asked that the balance of the report be placed on file to give the staff an oppor- tunity to bring back a report on the balance of the Commission's reconunendations in the employment area. Alternate Emergency Command Post - A letter from the State Department of Emergency Services was presented informally requesting permission to place the Governor's emergency command post in the Eugene City Hall basement as an alternate to its Salem location. The space would be provided rent free, and would include a small office space for use two or three days a month by the District Co-ordinator. Assuming the State would pay the cost of necessary communications installations, the City Manager recommended they be asked to submit detailed plans when ready to proceed. Mrs. Lauris moved seconded by Mr. McDonald to approve the location of an alternate command post in the City Hall basement. Motion carried. 2 2. Eugene Renewal Agency, Redevelopment Bonds - A letter from David Hunt, executive director of Eugene Renewal Agency, requested that the City provide $200.00 to pay for services of Schuler, Rankin, Myers & Walsh for a review of the Agency's organiza- tion to determine whether a Charter amendment is necessary to permit issuance of Redevelopment Bonds for the Central Eugene Project. He also requested consideration of establishment of a budget account for Agency expenses which. are not considered project costs and therefore not eligible for payment from survey and planning funds made available by the Department of Housing and Urban Development. Councilman McDonald asked if the City's share of the renewal project will be a part of the 1968-69 budget. The Manager said the local one-third share will be in the form of sewers, paving, street lighting, etc., for which cash credit will be given. Redevelopment bonds are another method of providing the City's share. The bonds will be retired from increased tax returns on property within the project. He said the Renewal Agency has been using funds provided by Eugene Industrial Development Corporation, and that Mr. Hunt will provide the Budget Committee with an estimate of the Agency's needs for inclusion in the 1968-69 budget. Mrs. Lauris moved seconded by Mr. Wingard to authorize $200.00 for a review to determine whether a Charter amendment is necessary if the Agency is to issue bonds. Rollcall vote. All councilmen present voting aye, except Mr. McDonald voting no, motion carried. 3 3. Completion Date Extension, 260 East 2nd - The Building Department recommended extension of the completion date to March 1, 1968 for moving an apartment house to this location and bringing it to Code. The extension was requested by William A. Davenport. Mrs. Lauris moved seoonded by Mrs. Hayward to approve the time extension. Motion carried. 4 4. Assessment Segregation, 4120 West Amazon Drive - Martin and Ruth Lee requested segre- gation of $537.32 from the assessment against property at West Amazon Drive and East 43rd Avenue. Curb Sidewalk, Hawkins Heights Boulevard - The Public Works Department recommended location of sidewalk at the curb on Hawkins Heights Boulevard from 18th Avenue to Broadview Street because of a topographical situation. Mrs. Lauris moved seconded by Mr. McDonald to approve location of the walk at the curb. Motion carried. 7 7. Parking Restriction, 12th between Lincoln and Lawrence - Deka Electronics requested parking restriction at this location. The Traffic Department recommended a two-hour restriction on the south side of 12th between Lincoln and Lawrence. Mrs. Lauris moved seconded by Mr. McDonald to approve the restriction. Motion carried. 8 8. Lighting, 27th and High - The Traffic Department reported only two accidents at this intersection since 1965, and that it is felt lighting at the intersection is adequate. Councilwoman Hayward questioned whether all accidents occurring at ~he .intersection have been reported. Harlow Road Right-of-way, Edwards - The Public Works Department asked permission to exercise option to purchase a 20'x80' strip of land at 3590 Harlow Road from Paul G. and Dora M. The Public Works Director said the driveway was installed before the area was annexed to the City and projected into the street right-of-way. The County does not establish grade so the driveway will not meet the street grade. He said if the concrete driveway is replaced it will have to be a direct cost against the property and not assessed as a part of the whole project. I The City Manager explained the City's present policy when a grade variance exists is to take out the driveway to a point where a proper grade can be established, then fill with rock and leave it to the property owner as to the type surface he wants. He suggested the Council look at the property in question before determining whether to replace the driveway, and said any determination would not affect the assessment. It was understood the Council would look at the property on tour with regard to the driveway.
