Adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned from the meeting
held February 5, 1968 - was called to order at 7:30 p.m. on February 26, 1968 in the Council Chamber
by His Honor Mayor Edwin E. Cone with the following Council members present: Mr. Anderson, Mrs.Lauris,
Dr. Purdy, Mr. Lassen, Mrs. Hayward, Mr. McDonald, and Mr. Wingard. Mr.McNutt was absent.
Minutes of Council meetings held January 22 and February 5, 1968 and of zoning ordinance hearing held
January 29, 1968, as mailed to Council members, were approved.
NEW BUSINESS

Councilwoman Hayward referred to the zoning ordinance hearing minutes of January 29,1968
wherein a question was raised with regard to exclusion of restaurants which sell alcoholic
beverages from the conditional uses permitted in R-P Residential-Professional districts
and whether this was a proper area of concern for zoning. She asked in light of the City
Attorney's remarks as shown in the minutes whether the City has a policy with regard to
sale of alcoholic beverages in residential neighborhoods. The City Attorney said his re-
marks as shown in the minutes were taken out of context, and said there is no policy
against sale of liquors in any area under the present zoning ordinance except in school
areas.

Councilman Lassen asked whether it will be the responsibility of the City or the County
for lighting the intersections of West Belt Line Road, especially the intersection at
11th Avenue. The City Manager said lighting the 11th and Belt Line intersection will be
the City's responsibility, but that all street lighting funds inthe current: budget have
been used. He said it would be investigated to see if something can be arranged.

Councilwoman Hayward said she received a number of calls concerning recent publicity with
regard to the Regional Air Pollution Authority. She said the callers were concerned that
it appeared the Authority may be heading toward lowering standards if burning permits
were issued by fire departments when it was felt the Air Quality Control Officer is quali-
fied and trained to know conditions under which permits could be issued. Other specific
items she mentioned were that Cottage Grove should be welcomed as a member of the Authority,
and that the Air Pollution Control Officer should be able to issue citations to people
whose cars discharge heavy smoke.
Councilman Lassen, member of the Authority, said the last two meetings of the Authority
were informal work sessions in which the members were trying to set up a program and
methods of implementing it. He said with regard to issuing citations for automobiles
emitting smoke, the Authority's concern was centered on the staff's issuing citations
in civilian clothes and using unmarked cars. The Authority questioned whether burning
permits could be issued by various fire departments and whether for commercial or other
type of burning, but there will be clarification on this at a later date. Mr. Lassen
said with respect to including Cottage Grove as amember of the Authority that it is felt
there will be inquiries from other cities in the area asking to be included. However, the
Authority is at a disadvantage with regard to including them this year because of the time
element of budget requirements. He said it will be considered as soon as possible.

Proclamation, Canvass Votes February 20, 1968 City Election was submitted and read in full.
Mr. Anderson moved seconded by Mr. Lassen to accept the proclamation. Motion carried.

Laurelwood Bonds - Councilman Purdy suggested that the Laurelwood measure be resubmitted
to the voters at the May 28 primary election, excluding the $144,000 for improvements,
making a bond measure for the purchase price only, $371,000. The City Manager said other
alternatives should be scheduled for discussion by the Council, and that there are possibly
two more Council meetings - or a special meeting could be called - at which a measure could
be put on the ballot. He said other financial problems will be discussed, so there may be
other decisions.

The Finance Department recommended acceptance of E. J. Burns' bid of $3,850.00, retirement
of outstanding liens in the amount of $2,483.87, with the balance reverting to the General
Fund.
Mr. Anderson moved seconded by Mr. Lassen to approve the recommendation. Rollcall vote. All council-
men present voting aye, motion carried.

Rezoning 1330 Coburg Road, Rust - The City Attorney read an affidavit signed by Gordon
Wyatt, City traffic engineer, citing traffic counts at the intersection of Coburg and
Ca1 ~oung Roads and comparing them to those at other intersections in the City in resi-
dential zones. The Planning Director and City Manager read affidavits which they sub-
mitted for the record. The Planning Director's deposition reviewed rezoning to com- .
mercia1 districts those areas on Coburg Road previously referred to by Cosgrave and "
Associates in their presentation suppprting their contention that C-2 is proper rezoning
of a portion of the Rust property at 1330 Coburg Road. He also cited reasons for the
Planning Commission recommendation for denial of the requested rezoning. The City Manager's
affidavit served to identify and clarify location of photographs of various properties
along Coburg Road and in the vicinity of 1330 Coburg Road.

Mr. Camarot, attorney for the Rusts, presented affidavits submitted by Cosgrave and
Associates in response to those submitted by the Planning Director and the Traffic Engineer.
He said with regard to the City Manager's affidavit that it was not his client's intention'
to exactly identify the photographs originally. He also called attention to the Traffic
Engineer's reference to the Rust property as 1430 Coburg Road instead of 1330 Coburg Road,
and argued several other points of contention in the Planning Director's affidavit.

Moe Thomas, Planning Commission member, reviewed the bases on which the Planning Commission.
reaches its decisions in rezoning requests, and reaffirmed the Planning Commission recom-
mendation to deny this one.
Mr. Anderson moved seconded by Mr. Lassen to postpone final action until the March 11, 1968 meeting in
order to give the Council an opportunity to review the record as corrected, clarified, and challenged,
and to give an opportunity to examine any findings or recommendations the City Attorney has to offer.
Motion carried.

City Manager and staff; and others.

1.Annual Audit - 1966-67 - Mr. Harry Jacobs, auditor of Winn & Co., reviewed the audit re-
port, copies of which were previously distributed to Council members. Mr. Jacobs explained
that his letter covered only the period to June 30, 1967, and that since that time many
improvements have been made which will be reflected in the 1967-68 audit report. He .said
the City's investment program is excellent. The City Manager expressed appreciation for
help given by the auditors. Mr. McNutt moved seconded by Mrs. Lauris to accept the audit
report. Motion carried.

Mr. Anderson moved seconded by Mr.. Lassen to approve Item 1 of the Committee report. Motion carried.

2. Sanitary Sewer, 20th from City View to west 400 feet - The Public Works Director read a
letter from Loris F. Inman, 1980 City View Street, objecting to construction of this
sewer on 20th Avenue. Mr. Inman maintained the sewer could be constructed on McKinley
Street to 20th to service the property for which it is requested. Mr. Inman's property
is now serviced with a private sewer and has never been assessed for sewer service.
Hr. L. W. O'Dell said he has an option to buy property abutting 20th Avenue and urged
construction of the sewer as bid. He said construction of the sewer on McKinley Stree~
from 18th would create a larger assessment. The Public Works Director said a line con-
structed on 20th could serve properties both to the north and south, but that if it is
to be a main line it would have to be installed at a greater depth. He said if it is
found necessary to construct the line at a greater depth, it cQuld be handled through
change order, and any additional cost could be held and assessed against any future de-
velopment so that the three properties now being serviced would not be penalized.

before the sewer was available. The Public Works Director explained that sewer connection on City
View was available for the house in question, but the petitioner also would have to pay an assessment
for the 20th Avenue sewer when it was constructed, so he petitioned it at this time so that he would
not have to connect to the City View line. Owners of adjacent properties are objecting to the 20th
Avenue sewer because they have already made connections to the City View line.
A vote was taken on the motion to approve, and motion carried.

3. Public Works Pro;ects, 1968 - A report was presented listing projects and estimated
costs to the City recommended by the Public Works Department for the 1968 construc-
tion season:
a. Paving, sidewalk, and storm sewer on Harlow Road from Coburg Road to Garden Way
($82,000-paving and sewer only) - The City Manager said about half of the necessary
right-of-way properties have been acquired for widening. It is recommended to
proceed this year because of maintenance required on the present street and safety
factors. Councilman Wingard asked if islands will be provided for children cross-
ing to Washington School. The Public Works Director said islands can't be pro-
vided on the 48-foot paving, that it is planned to concentrate crossings at one
place where a traffic light could be installed. It was decided the Public Works
Department in designing the proposed street would consider the possibility of
flaring the pavement in several places to accommodate center islands. Dr.Purdy
moved seconded by Mr. McNutt to approve. Motion carried.
b. Paving, sidewalk, and storm sewer on Chambers, 24th to McLean ($24,000-paving

plained that because of engineering problems with connecting to the 30th Avenue
trunk and because Federal funds won't be forthcoming for about two years, the
Public Works Department recommended construction of a pressure line designed to
serve as a lateral system and a temporary pump system in order to service the
Marist School and Valley River Shopping Center. The system will be connected as
a gravity system when the 30th Avenue trunk is completed. Mr. McNutt moved
seconded by Mr. McDonald to approve. Motion carried.

The City Manager explained that approval of the projects at this time will enable engineering work to
proceed. At the time of contract award, public hearings will be held and the Council at that time
has the authority to proceed or abandon.

With regard to the paving on Birch Lane (f), Charles Strong, 1655 Prospect Drive, said he felt paving
this street wouJd create a safety hazard because of speeding cars and suggested either closing the
street or leaving it as it is. He asked a delay on the Council's decision to provide an opportunity
for owners of abutting properties to organize a ,maintenance program. The City Manager said the City
does not normally maintain unimproved streets, that the project is a portion of Hendricks Park improve-
ment to make another safer access, and if it is felt it could be maintained by owners of abutting prop-
erties as a private street that decision can be made at the time of contract awards so that engineering
work can proceed at this time.

Councilman Lassen inquired about the street width. The Public Works Director said at this time a
28-foot width is planned, but after the design work is started an alternate may be brought back to the
Council. He also said there is no provision for sidewalk because of topography and only a 30-foot
right-of-way.
Councilman Lassen asked with regard to paving and storm sewer on Crest Drive (h) if the entire project
is inside the City limits. The Manager replied that,both sides of the street as.far as Lincoln Street
are inside the City, and that the street creates an expensive maintenance problem. Councilman McDonald
asked if the cemetery abutting the south side will be assessed, and the City Attorney explained the
method of assessing that property. Mr. McDonald said he felt this project should be delayed until
annexation of the Crest Heights area is determined.

With regard to the Willamette Street project (q), the City Manager said that withdrawal of signatures
frum the original petition had brought the percentage dO~l to 43.3% of the frontage favoring the
project, and that owners of 36.5% of the frontage object. Dale Ramsey, 4875 Willamette Street, asked
for a show of hands of those present objecting, and 13 people in the audience indicated they did not
want the paving.

Marlin Withrow, 20 East 46th Avenue, said he felt the engineering should proceed because development
in the area and safety factors will necessitate the street paving eventually.
The question of assessment arose, and the City Attorney said since there is nothing to prohibit access
to Willamette Street in the way of deed restrictions, the properties can be assessed for the ,improvement.
Mr. McDonald moved seconded by Mrs. Hayward to amend the motion deleting for separate vote the Crest
Drive and Willamette Street projects. Motion carried.

1. Study Committee, Local Sales and Income Tax - In line with the suggestion made by
Mayor Cone in his annual message for 1968, the Council was asked to authorize ex-
ploration of formation of a committee composed of representatives from Eugene,
Springfield, and Lane County for a study of the feasibility of a Countywide income
or sales tax. The formation of such a committee would not entail any expense,
merely authorize exploration of methods of levying such taxes. Mrs. Hayward
moved seconded by Dr. Purdy to examine the possibility of a joint study committee
as recommended. Motion carried.

2. Shining Star Animal Welfare League - Mrs. Wilson asked the Council's help in publi-
cizing the League's spaying program. She also requested that the Council ask the
Lane Humane Society not to give out any unspayed female dogs. General discussion
followed concerning the Humane Society's practice, City funds budgeted for dog con-
trol, and possibility of obtaining co-operation of veterinarians in the area in a
spaying program. No action was taken.

3. Christensen Attorney Fees, Fire Fighters Association - The City Manager reviewed
events leading to the Fire Fighters request for payment by the City of attorney
fees for pursuing Mrs. Leland Christensen's claim for double indemnity payment of
$7,000.00 as the result of the death of her husband while fighting the 1966 Kendall
Fora fire. The Aetna Life Insurance Company claimed death was due to a heart con-
dition and denied double indemnity. Mrs. Christensen, upon advice of the Fire
Fighters, filed suit for the claim, retaining the Fire Fighters' attorney to plead
the case. The Insurance Company subsequently settled the claim out of court for
the full $7,000.00, but claim for attorney fees of $2,500.00 was not recovered, and
Mrs. Christensen was required to pay $2,358.83 to the Fire Fighters' attorney.

A letter from John Collins, personnel director at the time of the claim, was read
concerning a meeting of City personnel and Mrs. Christensen wherein Mrs. Christensen
was advised the City had no further legal responsibility, and that since she was the
beneficiary under the policy, she would have to pursue the claim. The City could
not file a claim as third party. The City Manager said the City's position primarily
is that if there was a question about the City's obligation to go further, the
question should have been raised at that time. He said the City had no part in
selection of attorneys nor in the law suit itself or its settlement.
The City Attorney reviewed his office's involvement in the case and advice given
Mrs. Christensen at the time the claim was discussed with her. His opinion was
that'the City has' no moral or legal responsibility to pay the attorney fees and
recommended that the Fire Fighters Association pay the fees inasmuch as they ac-
knowledged they hired the law firm to handle the case for Mrs. Christensen.
Patrick Flynn, speaking for Local 851 Fire Fighters, said the Fire Fighters position
is that Mrs. Christensen did not have anyone to represent her at the meeting with
City personnel, that the City was at fault in not advising Mrs. Christensen the

5. Driveway, 150 North Cleveland - Council members viewed the site at 150 North Cleveland
prior to the meeting where driveway replacement was requested. A report was presented
from the Public Works Department together with a chart showing variations occurring in
paving projects and reconstruction procedures employed. Because of potential unlimited
expense involved if this procedure is relaxed, it was recommended that there be no change
in present policy. Mr. Lassen moved seconded by Mr. Wingard not to replace the drive-
way at 150 North Cleveland. Motion carried.

6. Sewage Treatment Plant, Digester Modifications - The Council was asked for authoriza-
tion to waive bid procedure and employ Steel Structures, Inc., to furnish and install
eight new digester heat exchanger panels in the Sewage Treatment Plant at a cost of
$8,447.00. Steel Structures installed the original equipment, and the heat exchanger
panels are deemed necessary to gain proper operation of the digesters. Mr. McNutt
moved seconded by Mrs. Hayward to authorize the work as requested. Motion carried.

7. Planning Commission Report - January 8, 1968
a. Annexation of area between Holly Drive and Green Acres Road, west of Tabor Street;
b. Annexation of area at northeast corner of Green Acres Road and North Delta High-
way, Vik - The Planning Commission recommended annexation of both areas providing
that all building floor elevations are above the 400-foot level, or at an eleva-
tion recommended by the City Engineer; that the owner installs and maintains at
his own expense a private sanitary sewer pumping station on the property north of
Green Acres Road; and that the property be subject to the FH regulations contained
in the new zoning ordinance. Councilwoman Lauris asked that the name "Miller's
Little Farm Road" be preserved.

8. Planning Commission Report - January 22, 1968
a. Annexation of area east and west of River Road south of River Avenue, Chowning
et al - The Planning Commission recommended approvalsubject to the conditions
that:
(1) Owners of properties within the annexation area construct and operate to
City standards a private sewer system until a sewer system for the River
Road area is constructed by the City;
(2) Owners of properties in the annexation area contract to pay an equitable
share of the assessment for the private sewer system, and all properties
serviced by the private system must be annexed to the City prior to re-
ceiving such service;
(3) The City's sewage treatment plant be included in the annexed area;
(4) Future assessments for sewers will be necessary when a system for the
River Road area is developed, and property owners cannot expect to receive
service of the City's police department, dog control, highway maintenance,
and traffic engineering until a phasing schedule for services is completed;
(5) It is not the intent to allow creation of small, private sewer systems,
and future annexations in the area will be approved only upon development
of a sewer system for the entire River Road area.
The Fire Chief reported that the Oregon Insurance Rating Bureau indicated if
an adequate water supply is available, the area would participate in the City's
Class 3 rating. If there is not sufficient water, then it would fall into a
Class 5 category. The Fire Chief said there is no doubt of having an ample
water supply, and that the annexation would in no way be detrimental to the
City's Class 3 rating. It was pointed out that the annexation was initiated
by Chownings toenable development of apartments west of the Treatment Plant,
and by Safeway for a building site on the west side of River Road, and that
there are no single-family dwellings in the area. The Planning Director ex-
plained the County would not issue permits for development to the density de-
sired without public sewers.
Mrs. Lauris moved seconded by Mrs. Hayward to approve the annexation subject to
the conditions recommended by the Planning Commission. Motion carried, Mr.Wingard
abstaining.

b. Annexation of area north of Green Acres Road, west of Norkenzie Road, Barnes -
The Planning Commission recommended annexation provided that:
(1) The Eugene Planning Commission receives and holds a public hearing on the
final plans approved by the County Building Department for the proposed
mobile home park prior to issuance of a building permit;
(2) The property owner pays total costs for installation of a sanitary sewer
pumping station and its maintenance;
(3) Floor elevations for the mobile home park be established by the City's
Public Works Department;
(4) Design and construction of the mobile home park comply with the City's
mobile home ordinance.

Petitioners requested the street's reopening and indicated they would go through the
courts to gain use of the street based onits many years' use as a public thoroughfare.
The Manager said State law provides that only a plililic body may petition the Public
Utility Commissioner for grade crossings, hence this request to the Council. The
PUC also might order signalization and establish the distribution of costs of such
signalization. The Planning Commission recommended proceeding with application to the
PUC for the Side Street grade crossing.

d. Zone Change Restriction - The Planning Commission recommended approval of the Plan Ad-
visory Committee's resolution that the City not initiate any major zone change, but
that individual rezoning requests be considered on their individual merit during the
next twelve months to allow development of the comprehensive general plan. It was
also recommended that if any major zone changes are considered, theCen~ral Lane Plan-
ning Council be consulted prior to any action.

In response to a question from Bob Suess as to what constitutes a major zone change,
the Planning Director explained it would be one which would substantially' alter density,

5. Truck Size Limits - The City Manager explained hearings are being held before a
Senate subcommittee with regard to increase in truck weight and width limits.
The Public Works Department recommended that the City present objections to such
increases to the Senate Committee.
Mr. Wingard moved to approve the increase if trucks are limited to the interstate freeway system and
use of city streets is regulated. There was no second.
After further discussion, it was the general consensus that the City should object to any increase in
truck sizes if trucking terminals are used which are not located adjacent to freeway interchanges.

6. Variance 27th and Oak, Room Count, Green - Earl Green requested renewal of a 1963
variance granting room count in excess of regulations for apartments at 27th and
Oak (Resolution 994). There was no objection from the Planning office.

for $1,800.00 to widen Harlow Road.

c. 18th Avenue at Oak Patch Road from Fred and Marion Miller, 2904 West 18th,
for $2,330.00 for street improvement.
All of the purchases were recommended by the Public Works Department.

8. League of Women Voters announced a panel discussion on poverty programs to be held
February 29, 1968 at 10:00 a.m. in the Council Chamber. The City Manager said
amendments concerning the Office of Economic Opportunity will require that the
Council assume more responsibility in the operating and legislative functions of
the local programs administered by Lane Human Resources.

Councilman Purdy said the trailer should not be allowed on the property until the business is in
existence. The Manager said it could be so stated in the resolution.
