Regular meetrng of the Common Council of the city of Eugene, Oregon was called to order by His Honor
Mayor Edwin E. Cone at 7:30 p.m. on March 11, 1968 in the Council Chamber with the following council-
men present: Mr. Anderson, Mrs. Lauris, Mr. McNutt, Mr. Lassen, Mrs. Hayward, and Mr. Wingard.
Councilmen Purdy and McDonald were absent.
Minutes of the Council meeting held February 26, 1968 and of zoning ordinance hearings held February 12
and February 19, 1968, as mailed to Council members, were approved.

NEW :'BUSINESS
Mayor Cone introduced Kang "Chris" Chul, a student from Chinju, Korea' attending the
University of Oregon. Mr. Chul acknowledged the introduction and commented on the
similarity between the sister cities of Eugene-and Chinju.

Zoning Ordinance - The City Manager said, the. new zoning ordinance was edited and put into.
final form for adoption. He said Articl~ 22 was deleted in its entirety except for the
title~ to be broug~~ back for later'consideration when standards. necessary for enforcement
have been estab'lished for flood haz~H;d.zon'es.

The Manager tp,ld the Council he had been contacted by a group of engineers who said they
felt the ord'inance was being rushed to adoption and that they had not had the opportunity
to review the document in its final form. He sa-id. the Planning Commissiun-recommended
proceeding with adoption as soon as possible, but if the Council wished to delay it should
now be noted, otherwise the bill would be brought on for consideration at its regular place
on the agenda later in the meeting. It was understood the Council would consider adoption
of the ordinance at this meeting.

The Public Works Department recommended award of contracts to the low bidder on each project:
Paving and storm sewer on 26th, 27th, and Madison - A letter of protest was read from Everett H.
Gardner, Milton-Freewater, in which he contended the procedure followed in giving notices and calling
for bids was illegal. The City Manager said the procedure for calling bids on improvement projects
is provided for in the City Charter and this procedure was followed.

Mr. Anderson moved seconded by Mr. Lassen to award the contract to McKenzie Road & Driveway Company
for $51,073.04. Rollcall vote. All councilmen present voting aye, the motion carried.
Paving and storm sewer on Hayes and 10th - No written protests were received.
Mr. Anderson moved seconded by Mr. Lassen to award the contract to McKenzie Road & Driveway Company
for $51,688.00. Rollcall vote. All councilmen present voting aye, motion carried.

Paving, storm sewer, sidewalk, and driveway approached on Coburg Road - Mr. Anderson moved seconded by
Mr. Lassen to award the contract to Cushing Bros. for $66,348.81
Councilwoman Lauris asked why there were two thicknesses for sidewalk - 4" and 7", and the City Manager
explained the thicker walk is installed in driveway areas for added strength. The Manager said the
entire cost of the project will be assessed to owners of abutting properties except $5,000.00 of the
paving and $14,000.00 for storm sewers.
Rollcall vote. All councilmen present voting aye, except Mr. McNutt abstaining, motion carried.
Storm sewer between Charnel ton and Olive, 15th to 20th - Mr. Anderson moved seconded by Mr. Lassen to
award the contract to Crest Construction Company for $31,514.61

Councilman Lassen asked if this was a reconstruction project, and the Public Works Director explained
it was an extension and will be the first storm sewer in this area.

Sanitary sewer between Amazon Channel and west boundary Berkeley Park Addition, 18th to Bailey Hill -
Mr. Anderson moved seconded by Mr. Lassen to award the contract to Wildish Construction Company for
$70,427.61.

Several property owners inquired whether they would have a second assessment on their properties as a
result of construction of this sewer. The Public Works Director explained the method of assessment for
sewers abutting two sides of a property. He also again explained that assessment is made only for
eight-inch sewer with the proceeds from bonds paying for anything over eight inches, the ~~ per square
foot assessment and its purpose, and the cost of stubs.

Sidewalk on 18th, City View to Oak Patch - Mr. Andersonmoveaseconded by Mr. Lassen to award the con-
tract to K. A. Wardell for $4,364.35.
Mrs. Fred Broders, 1905 Hawkins Lane, objected to construction of the sidewalk at this time because of
assessments for other projects in the area.
Rollcall vote. All councilmen present voting aye, motion carried.

Committee meeting held February 29, 1968:

1. Child Care, Inc. - The City Manager read a report submitted by Mr. Aubrey Trimble of
Child Care, Inc., which stated Child Care's present operating procedures and costs
and their plan to extend the program to an all-day operation on June 15, 1968. In
order to do this, they will need to increase their monthly budget from $375.00 to
$1,400.00, and request that the City donate $600.00 for remodeling costs and also
$55.00 per month for utilities. The City Manager expressed concern about using
City funds for this purpose. He said the City has made a substantial contribution
by making the house at 169 North Washington available to Child Care, Inc. Mr. Trimble
stated they have and will continue trying to raise the money for their operation from
other sources, cash as well as labor, but they are appealing to the City for im-
mediate help inorder to keep the program going. Mrs. Hayward stated she was con-
cerned the City has not been particularly involved in poverty programs. She said
the City and the Council should show they are eager to help in ways they can.
Mrs. Hayward moved seconded by Mrs. Lauris that the City provide the $600.00 re-
quested for the remodeling and budget funds in 1968-69 to pay the monthly utilities.
Mr. Anderson stated the City established a precedent when it provided Child Care, Inc.
with the facility and probably should make the building suitable for operation. He
suggested a one-time appropriation of $600.00 for remodeling but not any portion of
operating budget. It was suggested $600.00 from the Boxing and Wrestling Fund could
possibly be used. The Finance Director explained this fund is committed for next

year to the Buckley House and to assist transients who become stranded in Eugene.
Mr. Wingard suggested the possibility of establishing a room tax and that funds from
such a tax could be used.

as economically as possible and to delete operating costs. Motion carried.
Mr. Anderson moved seconded by Dr. Purdy to approve as amended the original motion.

2. Minor Subdivision, 1255 Hughes Street, Bishoff - Mr. Donald R. Bishoff, Jr., 1244 Hughes
Street, asked for Council review of the Planning Commission approval of a minor sub-
division for Mr. Gordon P. Olsen. He contended a letter from Mr. Olsen requesting
modification of the Subdivision Ordinance did not state required facts for Commission
approval of the modification and was back dated and presented after approval of the
modification. The City Attorney explained the Planning Commission had not followed
procedure but that they had already set a precedent for subdivision for this entire
area, and that the subdivision is legal and valid. Mrs. Lauris suggested a letter be
written to the Planning Commission asking them to be sure to follow procedures in the
future. The Planning Director is to submit a report of backgounrd information on the
subdivision and explain staff action in this case to the Council at a later date. The
City Attorney explained the Council does not have jurisdiction in this matter since
the State law takes precedence, and Mr. Bimoff's only appeal is through the courts.

3. Planning Commission Report - February 19, 1968
a. Student Housing Study - The Planning Commission recommended proceeding with the
Student Housing Study in which the Planning Commission, Central Lane Planning,
and the University of Oregon will work jointly to determine the impact of student
housing in Eugene. The estimated cost of the study will be $2,000.00, and these
funds were budgeted in this year's planning budget. Dr. Purdy moved seconded by
Mr. McNutt to proceed with the study. Motion carried.

Councilman Wingard asked of what benefit the information gained would be. The Planning Director said
one of the primary problems is that University students occupy many'of the low-rental units in the
City thereby placing a burden upon other people in the community requiring adequate housing at rents
they can pay. He said it is expected University enrollment will increase, and the proposed study will
determine the effect University enrollment has on the present housing market and what effect can be
anticipated. The study also will be of benefit in developing the General Plan and will help the Joint
Housing Committee in reaching some of its decisions. Rollcall vote. All councilmen present voting'

b. Street Map Plan - The Planning Director displayed for Council cons'ideration the
new Street and Highway Right-of-Way Plan. This is the list of streets in the
present zoning ordinance plus additional streets indicated by the ESATS study
indicated in map form and to be adopted with the new zoning ordinance. Dr. Purdy
questioned the reduction in right-of-way on West 11th and Oakway. The Planning
Director explained these reductions would not be made until the alternate routes
were completed. He explained the rights-of-way could be amended if it was found
they were not needed. He also explained the Plan was intended to preserve rights-
of way for future streets. No action was taken.

4. Joint Meeting, ESATS Review - A joint meeting of the Council and Planning Commission
was scheduled for Monday, March 11, 1968, at 12:00 noon for re,view of the ESATS study.

5. Sewer Committee Meeting - A meeting was set for the Council Sewer Committee for
Monday, March 4, 1968, at 12:00 noon. The committee consists of Mr. McNutt,
Mr. Anderson, Dr. Purdy, and Mr. Lassen.

7. 10th and Oak Parking - The City Attorney reported the Supreme Court decision on 10th
and Oak suit. The decision handed down by the Court was that the City does have the

2. Traffic, Washington-Jefferson Bridge Area - Dr. Purdy requested a report from

He said it has not been done.

4. Bon-E1 Cafe, 4-Corners - Councilman Lassen asked the City Manager to investigate
the situation with regard to the abandoned Bon-E1 restaurant located in the future
highway alignment at 4-Corners.

5. Councilman McDonald asked to be excused for about three weeks because of his
undergoing surgery.

6. Collective Bargaining - Fred Mohr, speaking for the Unions, asked that the col-
lective bargaining issue be added to the March 11 Council agenda with continuation
to a special meeting on the 18th. The Manager had no objection to a March 18 meeting.
He said he would prepare a summarization regarding the union position, his recommenda-
tions, and the major items of correspondence on collective bargaining for the Council's
information. It was suggested a Committee meeting be set aside for discussion of the
Manager's memorandum, and it was generally agreed this would be on March 21 with full
discussion with the unions at the March 25 Council meeting.

7. ESATS Review - A joint meeting of the Council and Planning Commission for review
of the ESATS study was tentatively rescheduled for March 26, 1968 at 7:30 p.m. in
the McNutt Room.

8. Economic Opportunity Meeting - The City Manager said there will be a meeting re-
garding the Economic Opportunity Act at Harris Hall on Monday, March 11, 1968,
at 1:30 p.m. The meeting is being sponsored by the Governor's office with Marko
Haggard as co-ordinator. There will be discussion of legislative changes in the
Act, involvement of local government in theprogram, and procedures and requirements
of the new law.

and filed. Motion carried.

9. Bids, Public Works - A tabulation of bids opened March 5, 1968 was submitted. The
Public Works Department recommended award of contract to the low bidder on each
project, except that with regard to Coburg Road attention was called to the high
minimum cost per front foot of $13.20. The Public Works Director said properties
abutting the portion of Coburg Road to be improved have not been assessed for any
previous paving, and that if this project is not assessed it will cost the City
about $26,000.00. Mr. Lassen moved seconded by Mr.Anderson to award contracts to
the low bidder on each project, and to assess the cost of the Coburg Road project.
Motion carried, Mr. McNutt abstaining.
Action taken under Bids, New Business, earlier in the meeting.

10. Audit, Winn& Co. - A proposed contract with Winn & Co. for audit of the City
records for the fiscal year 1968-69 was presented. The City Manager recommended
acceptance of the rate increases. Mr. Lassen moved seconded by Mr. McNutt to
approve the audit contract with Winn & Co. for 1968-69. Motion carried.

11. Sewer Assessments, Matthews and McKendrick (BD-66-10) - Terry J. Metthews and
R. D. McKendrick asked for relief of the assessment on those lots in their owner-
ship completely encumbered by BPA easement which restricts the use of these lots
for construction of any permanent structure. The Public Works Departmentrecom-
mended that the City enter into an agreement with these property owners to defer
the assessment for a period of two years, during which time the Parks Department

and Planning Department can determine if any public benefit can be gained by the
City's acquisition of these lands. The City Manager pointed out the difference be-
tween these lots and the Hawthorne Street lots which werenot entirely covered by
the BPA easement. He also said interest would not be added to the assessment during
the deferral time. Dr. Purdy moved seconded by Mr. McDonal~ to approve the recom-
mendation. Motion carried.

Mr. McKendrick questioned the two-year limit on the deferment, and the City Manager explained that at
the end of that time if no benefit to the public is determined should the land be acquired by the City
the Council would then decide--whether to make a permanent deferment or to take some other action.

12. Sewer Assessment, Jorgensen (BD=66-l0) - Mr. Jorgensen asked relief on assessment
against a corner lot at 500 North Bertelsen Road which has been assessed for sewer
on three sides. The Public Works Department reported no relief can be _recommended
at this time since this tract of land has the potential of being divided into seven
lots. Mr. Jorgensen also protested that unauthorized stubs were constructed on his
property, and said he requested one stub to service one proposed site. There are
two other potential sites and the two additional stubs were provided for those.
The Public Works Department recommended'that the cost of the two additional stubs
($522.00) be deferred until the property is subdivided. Dr. Purdy moved seconded
by Mr. 'Wingard to proceed with the assessment and to defer the cost of the 'two
stubs. Motion carried.

13. Sewer Assessment, Reiersgaard (BD-66-l0) - Edwin Reiersgaard requested either a re-
duction or deferral of the sewer assessment against h~ property at 311 North Bertelsen
Road since it is one of four properties located within the proposed alignment of the
Eugene-Mapleton Highway which will eventually be purchased by the State Highway De-
partment. The City Manager suggested making the assessment but de~erring collection
so that alien will be placed onthe property, then when the State purchases it, the
State will pay the assessment. The Public Works Director suggested that if the
property owner wishes a sewer connection before the property is sold to the State
Highway Department, he be required to pay the sewer ?ssessment as a connection fee.
Mr. Anderson moved seconded by Mr. McNutt to assess the property and defer collection
until the State acquires the property unless sewer connection is made by the property
owner in which case the assessment will be collected as a connection fee. Motion
carried.

against the Cowley property just east of Olive. He said it may be possible to pave a 28-foot width

16. Parking Prohibition west side Alder,llth to 13th - Sacred Heart Hospital requested
prohibition of parking on the west side of Alder from 11th to 13th during the next
ten months while construction at the Hospital limits entrances for emergency vehicles
to the Alder Street entrance. The Public Works Department reported this prohibition
will eliminate 15 metered parking spaces along the west side of Alder, and recom-
mended leaving three spaces nearest to 11th Avenue. Mrs. Lauris moved seconded by
Mr. Lassen to prohibit parking on the west side of Alder between 11th and 13th
temporarily, leaving three spaces adjacent to 11th. Motion carried.
Mr. Anderson moved seconded by Mr. Lassen to approve Item 16 of the Committee report.
Councilwoman Lauris asked if use of metered parking spaces on Sacred Heart property can be negotiated
to replace those removed from Alder Street. The Manager said inquiry would be made. Councilwoman
Hayward asked if charges can be made as is the case in construction in downtown areas. The Manager
explained a contractor is charged if a portion of the street or sidewalk is used on the basis of
time and area used, but would not be so in this case since the contractor will not be using the
public right-of-way.
A vote was taken on the motion to approve, and motion carried.

17. Taxi Loading Zone, lath and Pearl, 8th and Willamette - Western Greyhound Lines re-
quested that the taxi zones on lath Avenue near the Greyhound depot be moved to the
Pearl Street side. Both taxi services are in favor of the request. The City Manager
recommended against moving the zones because of conflict between use by private ~utos
and by taxis and the resulting enforcement problem. It was recommended that the taxi
zones on the west side of Willamette south of 8th be eliminated, and one zone be in-
stalled on the north side of 8th east of Willamette. Mayor Cone suggested allowing
scooter parking in the restricted zones at intersections where no visibility problem
would exist. It was explained that restrictive provisions would apply to all vehicles,
but the City Manager said it would be investigated.
Dr. Purdy moved seconded by Mrs. Hayward to approve the taxi zone on the north side
of 8th east of Willamette, elimination of taxi zones on the west side of Willamette
south of 8th, and no change in the taxi zones on lath Avenue east of Pearl Street.

1. Parking Permit, Davidson Bakery, 2nd Avenue - Davidson Bakery requested permission
to use for parking purposes the 2nd Avenue dedication where it terminates at the
Southern Pacific tracks east of Jackson Street. The Public Works Department
recommended permission be granted under a revocable permit providing Davidson
maintains the surfacing of the area.

2. Millrace Agreement, University of Oregon - A proposed agreement with the University
of Oregon was presented which would renew for five years the existing responsibilities
for water level and cleaning and maintaining the millrace. He said a separate agree-
ment will be negotiated concerning the control gate where the race crosses Franklin
Boulevard. Councilman Wingard asked if it would be proper to refer the agreement
to the Millrace Committee, and the Manager explained the agreement covers only the
draining and cleaning and has no relevance to bank improvements or landscaping.
Mr. Anderson moved seconded by Mr. McNutt to approve the agreement. Rollcall vote. All councilmen
present voting aye, motion carried.

3. Parking, Fairfield Street - A report was read from the Public Works Department with
regard to the parking prohibition on Fairfield Street north from Royal Avenue. The
report recommended no change in the prohibition, and that no consideration be given
to allowing parking of automobiles in the strip adjacent to the curb. It was the
conclusion of the Public Works Department that the street eventually should be
widened to 36 feet with sidewalk at the curb and parking allowed on both sides.
Councilman Lassen commented on the ease with which traffic is able to move on the
street since parking has been prohibited.

The City Manager said variations in purchase price generally are a result of severance
damage determined by proximity of the right-of-way to residences. Some discussion
took place with regard to replacement of trees necessarily removed, and the Public
Works D~rector explained the present policy of paying damages for tree removal.

5. Right-of-way, 18th, Brabham - Mr. James A. Brabham requested a substandard sidewalk
from Oak Patch Road along his property line on 18th Avenue. The Public Works Depa~t-
ment recommended denial, and. reported concerning negotiations for acquisition of
right-of-way from Mr. Brabham at Oak Patch Road for widening 18th Avenue. Mr.Brabham
was offered $3,910.00 based upon a slope fill from the sidewalk to his home which was
rejected-. This amount included $2,000.00 as severance damages for proximity of the
right-of-way to Mr. Brabham's home. He asked for construction of a retaining-wall
instead. . The Public Works Department estimated th~ cost of the retaining wall at
$3,103.00,. and reduction in severance damages of about $1,000.00 if the retaining
wall is constructed.. The Department recommended offering Mr.Brabham construction of
the wall at the City's expense plus $2.,910.00 for the right-of-way. Councilman Lassen
asked if it would be better to straighten the alignment rather than moving the street
to the north, and the Public Works Director answered that the damages would be much .
greater because of resulting inaccessibility to so~e of the properties. He said also
it would not be possible to construct a sidewalk on each side of the street.

Kreklau requested segregation of asses?ment against his property at this location in

plus interest has been paid, and the Finance Depa!tment recommended approval of the
segregation.

Mr.Nick Dershon, 285 Waite Street, objected to the assessment on the basis that the sewer would be of
no benefit since the land lies within the proposed right-of-way for the Eugene-Mapleton Highway. The
Public Works Director explained it was the intent to enter into agreement with owners of properties
lying within the projected right-of-way to defer collection of the assessment unt~l the State acquires
the land. He said no interest would be charged during the deferment period. He also said there were
several otherproperties within the right-of-way: on which agreement similar to that authorized with
Mr. Reiersgaard on deferment of collection would have to be made.

Mr. Arnold Fowler, owner.of property at Waite and Elmira Road, objected to the assessment for three
stubs to his property'when only one was requested. The Public Works Director' explained the addi-
tional stubs were installed because of the potential for development of the property. He recommended
deferment of the cost-of two of the stubs untilthe property is developed. .

Councilman Lassen asked inclusion of designers in the "design team" required in Section 18.05.
Betty Niven, Planning Commission chairman, said that professional designers do not have standards
which enable distinction of those capable of performing the desired function. She said a letter has
been distributed by the Planning Commission asking architects to establisha limited scope-of-services
statement and fee schedules, then it would be possible for designers to function as designers.
Wilson Hutchison, engineer, protested final adoption of the ordinance at this meeting. He said
several of those interested and involved in its preparation have not seen a copy of the ordinance
in its final form, and asked that its adoption be delayed until the March 25 Council meeting.
Considerable discussion followed with regard to amendment procedure should the ordinance be adopted
at this meeting. Mrs.Niven read a list of those changes authorized by the Council in its hearings,
and George Marx said the ordinance was edited and in its final form includes those items approved
by the Council.
Mr. Anderson moved seconded by Mr. Lassen to delay final passage until an adjourned meeting of the
Council on Thursday, March 14, 1968, at 11:45 a.m. in the Council Chamber. Motion carried.
Councilman Wingard expressed concern with regard to building permits applied for but not issued at
the time of adoption of the ordinance. The City Manager said a resolution has been prepared to cover
the situation and will be presented for consideration.
Mayor Cone expressed appreciation to the Planning Commission, members of professional groups, and
staff members for time and effort put forth in preparation of the zoning ordinance.

It was explained 'this resolution will freeze permits as of this date, so that those applied for but
not issued may be taken to the Board of Appeals for consideration of a variance. Mr. George Pyle
said he had an application for construction on Garden Way with plans drawn up under the old regula-
tions. If changed to comply with the new regulations, it will mean an additional $10,000 to $25,000
for parking underneath the structure instead of using a parking lot. He was told he could apply to
the Board of Appeals for a variance.
