Cone with the following councilmen present: Mr.Anderson, Mrs. Lauris, Dr. Purdy, Mr. McNutt, Mr. Lassen, Mrs. Hayward, and Mr. McDonald and Mr. Wingard. Minutes of the meetings held March 11 and.March 14, 1968, as mailed to Council members, were approved. NEW BUSINESS Fence, West Belt Line Floodway - Mayor Cone announced the appointment of Councilmen Purdy and Lassen to meet with County Commissioners with regard to moving the fence along the West Belt Line Road floodway to the east side of the ditch and to set policy for future similar situations. e Bids, Public Works Improvement Pro;ects Pro;ect and Name of Bidder Sanitary Sewer Reconstruction between Charnelton and Olive from 24th to 24th Place Wellette Construction Company Jeske Construction Company McKenzie Road & Driveway Company Wildish Construction Company Norman Green A. Mr. Anderson moved seconded by Mr. Lassen to award contract to Jeske Constru~tion Company for sewer on Barger at Belt Line Road on their bid price of $701.00. Rollcall vote. All councilmen present Shining Star Animal Welfare League - The city of Springfield requested a representative of the Eugene City Council to meet with representatives of Lane County, the city of Springfield, and the League Thursday noon, March 28, 1968. The meeting is for the purpose of discussing implementa- tion of dog birth control program. Since the regularly scheduled committee-of-the-whole meeting will be held at that time, it was understood a staff member would attend the Animal Welfare meeting. COMMITTEE REPORTS Committee meeting held March 21, 1968: "Present: Mayor Cone; Councilmen Lauris, Purdy, Lassen, Hayward, and Wingard; City Manager and staff; and others. 1. Sewers, Bethel Area - C~uncilman Las~en asked about plans to install sewer laterals in the area between Bethel Drive and Highway 99N. He said he felt they should be installed by 06uncil initiation, The Public Works Director said petitions were out for sewers in that area and in the "state" street area, but there was no indication of how many prop- erty owners in the area would favor the installations. The City Manager suggested pre- paration of a map showing areas not serviced by sewers to be brought back for Council consideration of initiating installation. 2. House Sewer Connections, Bethel Area - Councilman Lassen inquired about the number of properties which have not been connected to the sewers since their installtion in the Bethel area. It was understood a survey would be made and the information brought back to the Council with a recommendation, Mr. Anderson moved seconded by Mr. Lassen that Items 1 and 2 of the Committee report be received and placed on file. Motion carried. 3. Collective Bargaining - Copies of a report from the City Manager were previously dis- tributed to Council members which set out the Manager's position and recommendation with regard to the unions' request for recognition and formal collective bargaining based on information exchanged in discussions with the unions with regard to questions raised if formal bargaining is approved. There was considerable discussion between Council members and union spokesmen (Fred Mohr, Patrick Flynn, Frank Jackson) concern- ing the gneral philosophy of collective bargaining. No action was taken. Councilman Anderson said he questioned whether the Council has the authority to grant collective bar- gaining privileges and enter into a formal contract, and that he thought such authority should be granted through a Charter amendment. He said he also questioned whether benefits would accrue to the City itself and mentioned the research just being started by the League of Oregon Cities in the area of collective bargaining with municipal employes. II II II II I, II Il \ :1 l:: Mr. Anderson moved seconded by Dr. Purdy that the City Council initiate a program (1) to provide better methods of communication between itself and employes of the City in matters affecting employe working conditions, compensation, fringe benefits, and other matters affecting employe welfare, (2) to enable employes to participate in decisions in new areas, with emphasis on those which apply to their well- being, (3) to attempt to create among City employes a greater sense of involvement in City government and policy formulation; that the City Council direct the City Manager to make a reassessment of present personnel policies and prepare recommendations to effect the previously mentioned objectives, after consultation with representatives of employes in all departments of the City government and after an evaluation of recommendations from them. Patrick Flynn, speaking as business agent for Local 851 Fire Fighters, read a petition from fire de- partment employes asking recognition of the local as their legal representative. He said the position of the Fire Fighters would be to oppose the motion in its entirety. Jerry Carroll, international representative speaking for Local 1724 AFSCME, and Richard Beck, Public Works mai~enance employe, also opposed the motion. 3/25/68 - 7 I - I I: r r :1 ,r I ~ !: '. " I: .', .. I - e 1 e I .. I e . I -- 123 -., 3/25/68 Charles Sikes and Pat Blair, Cascade Employers Association, spoke against recognition of the unions and collective bargaining. They expressed the opinion that collective bargaining is not proper nor desirable in the area of public employment and that a good grievance procedure is ample. Others opposing union recognition and granting collective bargaining rights to City employes were D. c. Branstitre, airport employe, and Bob Ezell, Public Works engineering employe. Karl VanAsselt, League of Oregon Cities staff member, explained methods and procedures for employer-employe communica- tions in several other Oregon cities. Councilman McDonald read the City Attorney's op1n1on that the City Charter would have to be changed with respect to that portion governing the City Manager's duties if an agreement is entered into with the unions. The question was called for, and motion carried, Councilmen Anderson, Purdy, McNutt, Lassen, and Mayor Cone voting aye; Councilmen Lauris, Hayward, McDonald, and Wingard voting no. Councilwoman Hayward left the meeting. 1 4. Over length Curb Cuts, Oakway Mall - The Public Works Department recommended approval of McKay Investment Company request to widen to 50 feet each of the three existing curb cuts on the west side of Coburg Road leading to the Oakway Mall. Mr. Lassen moved seconded by Mr. Wingard to approve the overlength curb cuts. Motion carried. 2 5. Parking Prohibition. Oak between 16th and 17th mended approval of a request from Harry Jacobs the west side of Oak Street for 275 feet south seconded by Mr. Lassen to approve the request, - The Public Works Department recom- of Winn & Co. to prohibit parking on from 16th Avenue. Mrs. Hayward returned to the meeting. 6. 18th Avenue Right-of-way, Brabham - James ~abham offered to sell right-of-way to the City for widening 18th Avenue at Oak Patch Road for $4,288.00, and he will grant the City a slope easement, with any retaining wall in the future to be constructed at Brabham's expense. This was submitted as an alternate to the City's previously authorized offer to pay Brabham's $2,910.00 plus construction of a retaining wall. Dr. Purdy moved seconded by Mr, Lassen to accept Mr.Brabham's counteroffer. Motion carried, 4 7, Property Sale, 1290 West 28th, Burns - Ellwood J, Burns requested refund of $3,850,00 he bid and paid the City for a 197~-foot lot at 1290 West 28th Avenue. The City has title to only 160 feet. Dr. Purdy moved seconded by Mrs. Hayward to cancel the sale, refund the money to Mr. Burns, and call for new bids on the City's property. Motion carried. Ordinance Amending Fire Prevention Code, LP Gas - A proposed ordinance was presented which would amend the present Code with regard t 0 installation and inspection of liquid petroleum gas equipment in the City, and bring the City's Code to standards set by the State Fire Marshal. Parking Lot 7th and Willamette, Zumwalt Suit - The City Attorney reported that an offer was made to settle for $80,000,00 the condemnation suit brought by the City against the Campbells, owners of the former Zumwalt property at the northeast corner of 7th and Willamette. He said $67,500,00 was tendered in court, but the property was appraised at $77,500.00. Mr. Wingard moved seconded by Mr. Lassen to settle the case for $80,000.00, Motion carried. Mr.Carter proceeded on that information, ordered equipment, but when applying for a building permit he was told the new zoning regulations would not permit parking on the Portland Street lot. The Planning Commission has indicated its favorable considera~ tion of an exception which would allow Mr. Carter to proceed with his' original plans. \ti .~ The City Attorney presented an ordinance whereby the Council could authorize variances and exceptions to the new zoning regulations under certain conditions.
