Cone with the following council- men present: Mrs. La~ris, Mr. Lassen, Mrs. Hayward, Mr. McDonald, and Mr. Wingard. Councilmen absent were Messrs. Anderson, Purdy, and McNutt. Minutes of the March 25, 1968 Council meeting, as mailed to Council members, were approved. NEW BUSINESS Miss Jo Anne Saraceno, newly selected Miss Eugene, was introduced by Ed Sardello of the Eugene Jay~ees, sponsors of the Miss Eugene cpntest. Miss Saraceno expressed appreciation for the opportunity of representing Eugene at the State competition for the selection of Mis s Oregon. 1 ! Paving Elwing, Calvin to Arcadia - The Public Works Department recommended award to the low bidder Mr. Lassen moved seconded by Mrs. Lauris to award contract to the low bidder. Rollcall vote. All councilmen present voting aye, motion carried. . 2. Paving 20th, Friendly to Washington - A letter was read from Joan L. Rich, 2050 Madison Street, re- questing consideration of creation of cul-de-sacs as an alternate to paving 20th the entire distance proposed. A petition was also presented objecting to the project signed by owners of 44.5% of the property involved. The Public Works Director presented a sketch showingpossible design of cul-de- sacs as suggested and said there would be some street vacation, rededication, and pedestrian ease- ments involved if a plan of this type is followed. I Catherine Cornish, 2011 Madison Street, objected to creation of the cul-de-sacs on the basis that traffic would then use 19th Avenue as a through street. Mrs. Don Menafee, 660 West 20th, and Garry Blodgett, 2010 Monroe Street, favored the cul-de-sac plan. Mr. Blodgett inquired concerning a comparison of costs between the cul-de-sacs and paving a through street. The City Manager replied that if a new design for the street is approved, the project would have to go back to bidding and that it probably would not be as costly because of the square footage involved. He recommended referral to the Planning Commission if cul-de-sacs are considered. e Mr. Lassen moved seconded by Mrs. Lauris to hold this project for consideration of cul-de-sac plan by staff and Planning Commission with a report to be brought back in two weeks to enable acceptance of the low bid if it is decided to pave the street through as originally proposed. Motion carried. 3. Paving alley between 3rd and 4th, Polk to Blair - A sketch of the area was shown indicating prop- erties in favor of and against the proposed project. Several prople opposed the paving because they felt it would create a traffic hazard since the paved surface would allow greater speeds. They thought a graded and maintained alley would provide ample access. Those speaking were M. E. Lusk, 1225 West 4th; Lenard J. Hansen, 1201 West 4th; A. G. Jackson, 1259 West 4th; and Jim Sittser, 339 Polk Street. Mr. Lusk urged the Council to consider opening 3rd Avenue rather than paving the alley. Bob Baldwin, owner of Baldwin Heating and Air Conditioning at 340 Blair Boulevard, asked the Council to approve the paving. He said the alley provides the only access to his place of business. Mrs. Glen Hankins read a letter from John and Velma Swafford, 1260 West 3rd Place, favoring paving. . I Some discussion followed with regard to maintenance of the alley and the City's present policy on alley maintenance. The Public Works Director said street and alley maintenance is paid for from gas tax refunds and is not assessed to abutting properties. He explained too, upon questioning by Councilwoman Hayward, about completing half of the project, that a storm sewer would have to be in- stalled in the west half to Polk Street since the drainage slopes to the west. The City Manager reminded the Council that under the Charter two-thirds vote of the Council is re- quired to approve a project when remonstrances are presented. Councilman Lassen asked if there are plans to open 3rd Avenue in this area, and the Public Works Director said it has not been investi- gated, that it would require right-of-way dedication since it would be for local traffic only. - Councilman Lassen said he felt the alley should be paved, and moved, seconded by Mr. McDonald to hold the award for two weeks. Motion carried. 4/8/68 - 2 ~ r- 134 e 4/8/68 r ;, 4. il Paving and sewer, Chalet Plateau - The Public Works Director said there is one ,property, owner in- volved in this subdivision project, and recommended the award to be held two weeks ,to allow the owner to study further the costs involved. I Mr. Lassen moved seconded by Mrs. Lauris to hold the award for two weeks. Motion carried. 5. Paving and sanitary sewer, Tamarind Park 6. Paving and sanitary sewer, Erin Park 7. Paving and storm sewer, Ferry from 32nd to 34th 8. Paving and storm sewer, Knob Hill from 37th to 39th; 38th from Willamette to Knob Hill The Public Works Department recommended award of contract to the low bidder on each project. Mr. Lassen moved seconded by Mrs. Lauris to award contract to the low bidder on projects numbered 5, 6, 7, and 8. Rollcall vote. All councilmen present voting aye, motion carried. 9. Paving, storm sewer, and sidewalk on Chambers, 24th to McLean - The Public Works Department recom- mended award of contract to the low bidder on Alternate 2, deep strength asphalt base. He said Alternate 1 was bid on a rock base. Mr. Lassen moved seconded by Mrs. Lauris to award the contract as recommended. Rollcall vote. All councilmen present voting aye, motion carried. e : 10 I . Bailey Hill - The Public Works Depart- Mr. Lassen moved seconded by Mrs.Lauris A representative of the Friends Church, owner of about 250-300 feet of frontage within the project limits, asked that the Church be allowed to build its own sidewalk. He said they would build a retaining wall if necessary in order to save the trees which otherwise would be removed. The Public Works Director said that part could be deleted from the project with excavation of suffi- cient width provided only to install the curb if there is assurance the Church will complete the work at the same time of the contract completion date. [ Mrs. Lauris moved seconded by Mr. McDonald to amend the motion to delete that portion of sidewalk abutting the property of the Friends Church with the understanding the Church will complete the sidewalk by October 1, 1968. Motion carried. A rollcall vote was taken on the original motion as amended, and motion as amended carried with all Councilmen present voting aye. '. 11. Paving, sanitary and storm sewers, Cambridge Park 2nd Addition 12. Sanitary sewer, Judkins Road -area The Public Works Department recommended award to the bw bidder on each project. , Mr. Lassen moved seconded by Mrs. Lauris to award contracts to the low bidder on each of the projects numbered 11 and 12. He said values have been adjusted in line with present-day values, and the liability policy has been renewed with limits of $100,000/ $300,000 with an umbrella policy over and above general liability to bring it to $1,000,000. Premiums have been reduced about $2,000 per year. Councilman McDonald asked about vandalism coverage, and was told it had been investigated but the premiums, compared to losses ex- perienced, are too high. Mr. Camarot requested a copy of the paper, and then went on to point out the Planning Director's affidavit as presented covered rezoning on Coburg Road prior to annexation to the City. He said it should be recognized the affidavit extends only to the City Planning Commission's jurisdiction. Some discussion ensued with regard to proper density for the area, with Mr. James Pearson, Plan- ning Commission member, saying it was his understanding the petitioners wanted the entire area rezoned as petitioned (R-3G and C-2 on the corner lot) or none at all. Mr. Pearson said the Commission did not go into the detail of densities allowed under the general plan for the Willakenzie Area nor the possibility of R-2 zoning of the Rust property because of the request for the service station on the corner lot. The general plan does not designate commercial use at that location nor is there a need for a service station in that area, he said. John Axtell, 2573 Sharon Way, and George Taylor, 2560 Sharon Way, both objected to a service station on the corner lot on the basis that the traffic generated would constitute a hazard for the children attending school in the area. Mr. Camarot said that the buyer interested in the property now wants it for a service sta- tion, but that a bank is also interested so that C-2 zoning could be used for a purpose other than that for which it was requested. A vote was taken on the motion to rezone to RG, and motion carried, Councilmen Lauris, Hayward, and Wingard voting aye; Councilmen Lassen and McDonald voting no. (It was understood the item would be referred to a joint Planning Commission/Council meeting.) COMMITTEE REPORTS Committee meeting held March 29, 1968: " "Present: Mayor Cone; Councilmen Anderson, Lauris, Lassen, Hayward, McDonald, and Wingard; City Manager and staff; and others. 1. Kerner Report, Civil Disorders - Councilwoman Hayward said she believes the Council has the responsibility of directing the attention of the citizens of Eugene to the report 4/8/68 - 9 I e . I d " 'I I' 'I II It e I - I t I e . I - ., 141. 4/8/68 from the National Advisory Commission on Civil Disorders (Kerner report). She called attention to the seminar concerning this report sponsored by the University of Oregon to be held on the campus beginning April 1, 1968. The report directs attention to causes of civil disorders and suggests what communities and local governments may do to prevent civil disorders. Mrs. Hayward moved seconded by Mrs. Lauris that the Human Rights Commission be asked to prepare and carry out an education program for Eugene which relates to the Kerner report; to establish in this program measures oy which citizens might be able to solve some of the problems; and that the Council en- dorse the seminar being conducted on the campus. Motion carried. Mr. Lassen moved seconded by Mrs. Lauris to approve Item 1 of the committee report. Mr. A1 Casady said he had heard that at a private lodge meeting at which a policeman gave a speech it was reported it was necessary for two policemen, one of which must have a rating of sergeant or higher, to arrest a negro, and that this was the result of an agreement between the University of Oregon and the City Council. The City Manager said he knew of no such agreement nor had he heard of any such report. A vote was taken on the motion, and motion carried. 1 Councilwoman Hayward said she had been requested by the Lane Human Resources to present to the Council the proposal, and she so moved, that (1) the Council join with the Springfield City Council, the Springfield and Eugene Chambers of Commerce, the Lane County Commissioners, and the Lane Human Re- sources to call an immediate conference of leaders of business and industry in Lane County to consider provision of jobs and job training first and immediately for unemployed negroes in the community, and secondly on a continuing basis for all low-income and no-income persons, with the objective of attempt- ing to eliminate poverty in Lane County so far as provision of jobs, job opportunities, and trmning can achieve this objective; (2) the Council appoint a representative to serve on a committee to be made up of representatives of agencies named, this committee to be charged with the responsibility of setting up a conference to be called within a week, if possible, with the conference itself to be held within the next ten days or two weeks; and (3) that this committee call on resources within the com- munity for whatever assistance it may need in setting up the conference (State Employment Service, CORE, Human Rights Commission, etc.). She said she thought the Lane Human Resources hoped that one result of the conference would be a continuing committee of business and industry people to address the problem with continuity, and that she would be pleased to serve as the Council's representative. Councilman McDonald said he would second the motion but that he felt since the majority of low-income and no-income people in the community are white people, he would like the motion stated so as not to place these people in second place. Mrs. Hayward replied that because of the recent assassination of Martin Luther King, she would urge something more definite be done with regard to negroes. Mr. McDonald moved that the motion be amended to read "not only negroes, but also unemployed and low- income white people and other minority groups...". There was no second. Mr. Dale Hogan, 210 East 42nd Avenue, said he felt a great deal was being done on an emotional basis because of the death of King. He said experience has shown that many who have gone out of their way to hire negroes have found they do not want to accept responsibility. Mr. Wingard moved seconded by Mrs. Hayward to amend the motion to read "...with emphasis placed on negro groups, however not any greater emphasis than on other minority groups suffering from unemploy- ment..." instead of "...first and immediately for unemployed negroes...". Motion carried. A vote was taken on the motion as amended, and motion as amended carried. Mr. Lassen moved seconded by Mrs. Lauris to appoint Councilwoman Hayward as the Council's representa- tive on the committee. Mr. Wingard moved seconded by Mr. Lassen to appoint Councilman McDonald. Mrs. Hayward withdrew her name, and a unanimous vote was cast for Councilman McDonald to represent the City. Later in the meeting, Councilman Wingard moved, seconded by Mr. McDonald, to reconsider the action with regard to Eugene's representative on the committee. Mr. Wingard said that he felt to ensure pr~er representation for Eugene, there should be two representatives on the committee. Motion carried. Mr. Wingard moved seconded by Mr. Lassen that both Mrs. Hayward and Mr. McDonald represent Eugene on the committee to set up the conference requested by Lane Human Resources. Motion carried. 2 2. Street Cut Notification - The City Manager, in response to a question from Council- woman Hayward with regard to notification when street cuts are to be made, said the policy differs with varying circumstances, but that a descriptive explanation would be brought back to the Council for consideration. Mr. Lassen moved seconded by Mrs. Lauris that Item 2 of the committee report be received and filed. Motion carried. 3 3. Appointment, Budget Committee - Ralph Cobb, 3550 West Amazon Drive, was recommended by Councilman McNutt to complete the term on the Budget Committee vacated by C. F. Shearer, resigned. Tax Base Change - Mayor Cone announced that Ralph Cobb was appointed chairman of a committee which will undertake the task of informing voters concerning the measure which {s to be placed on the May 28 primary ballot concerning a change in Eugene's tax base. The Mayor said a co-chairman will be named at a later date. Mr. Cobb said he would bring back to the Council for its consideration his recommendations for methods of explaining the measure. RMBA License, Sam's Place, 825 Wilson - Council members previously viewed the site where George McKenzie proposes to establish a tavern in the industrial area. A letter from Bud Nixon of the Oregon Tavern Owners Association was read objecting to the Council's recommending approval of any more licenses in the West 11th area. Mr. Wingard moved seconded by Mrs. Hayward to recommend approval of the license. Councilwoman Hayward suggested that the Planning Commission review the provision for in- clusion off taverns in industrial districts and was told because of those now located in industrial areas too many non-conforming uses would be created in those districts. Councilman Anderson suggested the Eugene Industrial Development Corporation, responsible for development of the West 11th area, be contacted for an expression of opinion 'with re- gard to taverns in the industrial area. The City Manager said there are no deed restric- tions on taverns in the EIDC area. A vote was taken on the motion to recommend approval, and motion carried, Councilmen Anderson and Lassen voting no. Appeal, Trailer Park, 1850 Highway 99N - Mr. and Mrs. Gordon Barron, 1540 Hughes Street, and Mr. and Mrs. F. P. LaChapelle, 1510 Hughes Street, appealed to the Council for re- versal of the Planning Commission's approval of Joe Schmidhamer's request to establish a trailer park at 1850 Highway 99N. The City Manager reviewed the Planning Commission's action with regard to this conditional use permit and said a formal hearing is scheduled forthe April 8 Council meeting. He said the site of the mobile home park was approved in October 1966 and the item before the Council at this time is approval of the design for development of the site. A petition was presented from residents of the area object- ing to the proposed trailer park. Sketches showing the development and design of ac- cessory buildings were presented. No action was taken. Mr. Lassen moved seconded by Mrs. Lauris to uphold the Planning Commission's action in approving the development plans for the site. William Neel, architect, said that the Planning Commission in its consideration of the permit was con- cerned about the development of the site. He asked that a study be made with regard to adopting planned unit development ,regulations to trailer parks. Joe Richards, attorney speaking for Joe Schmidhammer, urged the Council's approval of the site plans and said the Planning Commission's only concern was with the aesthetic effect of two accessory build- lings. Garrett requested per- mission to retain the trailer at this location fo r watchman living quarters. The subdivided properties have not been developed nor sold. It is felt there is no need until the property is developed for 28th to be paved. PAC Metropolitan Area Goals - Copies of "Eugene-Springfield Metropolitan Area Goals," approved by the Plan Advisory Conunittee of the Central Lane Planning Council, were distributed to Council members. The City Manager said the goals, the first step in preparation of a metropolitan area general plan, were referred to the Plalrill1g Commission for review and will be brought to the Council later for consideration. 6 15. He said the City could not provide all of the paving and sewers necessary until further annexation, that the cost to the City would be too great because of the de?sity involved, and that the area would not "pay its own way" for some time. Lee Smith, Beverly Robertson, Mrs. Donald Ridenour, and Cecil Hodges, all owning property within the proposed annexation boundaries, urged the Council to approve the annexation because of development needs in the area. The Public Works Director described the portion of the properties which could be served immediately with paving and sewers, and those which would have to wait until trunk service from 43rd is provided. The City Manager said that Attorney Glade Shimanek, representing the petitioners ' requesting the reopening of this street, gave assurance of, clear title to ,the neces- sary right-of-way at no cost to the City. However, should the crossing be permitted, the City may be obligated to install crossing guards and/or signals. Rezoning RA Districts to R-1 - Councilwoman Hayward asked if there is any way of knowing whether the Planning Commission has under consideration changing RA areas in the City to R-1. She inquired specifically about the Ellis Parker Elementary School area. The Planning Director said this area and others similar will be in- cluded in the comprehensive plan. 2 4. Public Works Bids, Opened April 1, 1968 - The Public Works Director reviewed the tabulation of bids which included Council initiated projects. He said notices of public hearing at the Council meeting on April 8, 1968 were sent to owners of all properties which would be assessed for the projects. With regard to paving 20th from Friendly to Washington, a Council initiated project, the Public Works Director said residents in the area want assurance of a stop sign at 20th and Madison or rep1atting to create a cul-de-sac rather than paving the street between Madison and Monroe. He said a stop sign at this intersection cannot be justi- fied, that there is no objection to a cul-de-sac although it would be substandard, and that it may be well to reduce the length of the paving project. A letter of protest was read from T. E. Davis, owner of property at 544 West 20th. On the alley paving between 3rd and 4th, Polk to Blair, the Public Works Director ex- plained that the original petition was signed by owners of 51% of the property in- volved. Several property owners asked that their names be removed, and when the Council authorized calling for bids on February 26 the percentage was 33%. He read a report on the City's alley maintenance policy and the maintenance required on the alley in question. A letter was read from John A. Swafford in favor of the paving. Councilwoman Hayward asked if percentages should be considered, or whether the de- termination should be if the project is necessary for public benefit. The City Attorney said percentages need to be taken into account because when remonstrances are presented, a two-thirds vote of the Council is necessary to authorize a project. The City Manager said there are properties facing on the alley which have no other access. With regard to paving and sewer in Chalet Plateau Addition, the Public Works Director recommended award of contract to the low bidder, subject to approval of the developer because of the high front-foot cost. On paving, sewers, and sidewalk on both the Chambers Street and 18th Avenue projects, award of contract to the low bidder on Alternate 2 bid was recommended. The Public Works Director explained that Alternate 1 was for rock base, and Alternate 2 was for deep strength asphalt. On the balance of the projects, it was recommended to award contracts to the low bidder on each project. No action was taken. Building Permit Appeal, 2170 Hayes Street, Schi11enger - A report from the Building Department was read concerning denial of a building permit which would allow B. G. Schi11enger to convert an accessory building into a dwelling unit on a panhandle lot with access to 22nd Avenue between Garfield and Hayes. The Building Department denied the permit on the basis that the lot is substandard, and that it was not created in conformance with the zoning regulations. Mr.Schi11enger appealed the decision to the Council. Mrs. Lauris moved seconded by Mr. Lassen to deny the appeal. Motion carried. Sewer Assessment, 3092 Whitbeck Boulevard, Means - A letter was read from Howard Hansen, Hansen & Cougi11 Realtors, asking relief of sewer assessment against property at 3092 Whitbeck Boulevard purchased by C. C. Means. The letter outlined the history of the sewer construction, subsequent purchase of the property by Mr. Means, and mis- representation by the seller whereby he assured Mr. Means the sewerwas available but did not inform him it was not paid for. Because of a time lag of aoo ut 14 months be- tween sewer construction and filing of lien against the property for the assessment, the realtors had no way of knowing such an assessment existed. Cougi11 & Hansen have tried to collect the assessment from the former owner of the property with no success. The City Manager said the City cannot set precedent by accepting responsibility for paying assessments made after a property is sold. He said an adjustment in the in- terest was offered, but payment of the delinquent principal plus interest would have to be made before the balance of the principal could be Bancrofted. Mr. Hansen said he did not feel the interest adjustment is enough because of the time element in- volved in assessing the project, and that the City should assume some responsibility. Considerable discussion took place with regard to value of the property involved, ways of avoiding similar situations in the future, and amount of assessment ($454.00) and interest involved. Mr. Wingard moved seconded by Mr. Lassen to waive the interest accrued to the time of payment of the delinquent principal, but no later than April 30, 1968. Harlow Road Pedestrian Crossing at Washington School - A sketch was presented showing the design of a proposed pedestrian island, between traffic lanes- at Washington School on Harlow Road. The design provides for raised asphaltic concrete markers. The Public Works Department reported proper signing and lighting would be required if the island is installed. Alternates would be a raised concrete island, which the Public' Works Department felt would be a distinct hazard, or an overhead crossing. He said the School District has requested an unloading zone on the north side of the street const.ructed at Cit'y expense in return for right-of-way dedication. I, The City Manager pointed' out several reasons why the proposed island would be hazardous and said it would be undesirable unless the School District would agree to man it dur- ing crossing hours. He said the Traffic Engineer did not recommend its installation. Councilman Wingard suggested the School District people be urged to resume their training program on school crossings and use of school boy patrols. Considerable disucssion followed touching on the City's responsibility with respect to school crossings or any pedestrian crossing. Motion carried. 9 Resolution No. 1522 - Authorizing acceptance of options - 10th and Oak parking structure site (Fordham-Harris) was submitted and read in full. The City Manager said the City has options for the 10th and Oak off-street parking structure on the Harris property ($24,000), the Fordham property ($22,000), and Pacific First Federal property ($160,000). He asked authorization to proceed with negotiations for acquisition of the balance of the properties on the parking garage site at the City's appraisals and to issue warrants to cover costs which would be good for two years at 4% interest. Mr. Lassen moved seconded by Mrs. Lauris to adopt the resolution and authorize negotiations and issuance of warrants. Rollcall vote. All councilmen present voting aye, motion carried. 10 Resolution No. 1523 - Repealing Resolution No. 1508 - Variance extension at 27th and Oak Street, Earl Green, was submitted and read in full. The Council previously authorized renewal of a variance to allow greater density for property inthe ownership of Earl Green at 27th and Oak. When the building permit was applied for, it was found an apartment house built on adjoining property was constructed with a room count based upon Lots 1 through 7 of the blocks involved. The renewal requested was for room count based upon Lots 7 through 11, thus using Lot 7 twice. The item is now before the Planning Commission for reconsideration. This resolution would repeal the variance renewal previously authorized. Mr. Lassen moved seconded by Mrs. Lauris to adopt the resolution. Motion carried.
