Cone on April 22, 1968 at 7:30 p.m. in the Council Chamber with the following ~ouncilmen present: Mr. Anderson, Mrs. Lauris, Dr. Purdy, Mr. McNutt, Mr. Lassen, Mrs. Hayward, and Messrs. McDonald and Wingard. NEW BUSINESS 1 Stop Signs, 15th and Mill - Councilman Anderson presented a petition forwarded to him by Ronald J. Lovinger" 1491 Mill Street, requesting stop signs at the intersection of 15th and Mill. It was understood it would be referred to the traffic division for investigation. 2 Charter Study Commission - Councilman Anderson presented a letter ,from the Lane County Labor Council requesting establishment of an ad hoc Charter Study Commission for the pur- pose of analyzing the City Charter,with respect to legislative authority of the ,Council concerning City/employe relationships. The Labor Council asked that a report o~ such ,an analysis be made to the City Council and used as the basis for any further City Council action concerning policy affecting employe ,matters. The Labor Council suggested that the, Study ,Commission be comprised of the City's legal counsel, representatives from L~ne County Bar Association, representatives of City employe labor unions, and other citizens the City Council may direct. It was understood the item would be discussed at acommitte~- 6f-the-whole meeting. 3 Office of Community Relations - Councilman Anderson said he would like to see the City consider establishment of an office which ,would provide (1) information to the public on City services available, (2) administrative help to the Human Rights Commission so as to better implement programs giving assistance to all citizens on social problems, (3) assistance in police community relations, (4) assistance on participation in available Federal programs, ,(5) liaison with the business community, and (6) generally, better communications for the City in meeting the human needs of the community. Mr. Anderson moved seconded by Mrs. Hayward to authorize the City Manager to make a study and bring back to the Council recommendations on procedures for establishment of an Office of Community Rela- tions, the study to include costs for funding out of the City's budget and for a full-time staff. Councilman Wingard sugg~sted a Social Planning Commission, using volunteers," rather than creating a new agency. Councilman Anderson replied that the problems with which such an office would be involved are not confined to social problems. The need is for persons experienced in imparting information to the community and se'rving those areas' of government and the community' particularly concerned with human needs. A vote was taken on the motion as stated, and motion carried unanimously. 4 "Lock Your Car" Meter Stickers -" Councilman McDonald called attention to a letter he re- ceived from Insurance Women of Eugene-Lane County requesting authorization for placing "Lock Your Car" stickers on City parking meters. It was understood a recommendation on the request would be brought back to the Council. 5 Setback, Roosevelt and Seneca - Councilman Lassen requested an investigation of the set- back area at Roosevelt and Seneca Road, a trailer sales estaM ishment. 6 Appointments, Traffic Safety Commission and Human Rights Commission - Mayor Cone announced the appointment of Dr. Richard Schlaadt, 1077 Anderson Lane, as a member of the Eugene Traffic Safety Commission, replacing Dr. Robert Kime, resigned. Appointments were also announced to the Human Rights Commisslon b~ Mayor Cone: Mr. Ollie Chambers, 720 East 13th Avenue, Apt.3, balance of the term ending January 1, 1969. Replacing Robert D. Kraus, resi'gned. Mr. Bruce McKinlay, 1946 Villard Street, balance of the term ending January 1, 1970. Replacing Elizabeth Stubbs, resigned. Mr. Robert Adair, 2028 University Street, balance of the term ending January 1, 1971. Replacing Kurt Neustadter, resigned. Mrs. Richard G. Allen, 4927 Old Dillard Road, balance of ,the term ending January 1, 1971. Replacing James Bagan, resigned. Mr. Anderson moved seconded by Mr. McDonald to confirm the appointments. Motion carried. 7 Paving alley between 3rd and 4th, Polk to Blair - The City Manager reported that since this project was last considered, more opposition to paving the alley was presented, "and now owners of 66.9% of the property involved are opposed. He said with this opposi- tion, the staff is hesitant about proceedings with the project. I It 157--' 4/22/68 Letters of protest were presented from Mr. and Mrs. Galen Boles, 1283 West 4th, and from Vera Lambert, 1740 West 15th. Mrs. Lambert as well as R. B. Johnson, 394 Blair Boulevard, verbally objected to the alley paving. Mrs. Lauris moved seconded by Mr. Anderson to table the item. Motion carried, Councilmen Hayward, McDonald, and Wingard voting no. 1 Paving and sewers Chalet Plateau - The Public Works Department reported the subdivider wishes to proceed with the project on the low bid submitted. Mr. Anderson moved seconded by Mr. Lassen to award the contract to Wi1dish Construction Company on their low bid of $16,613.70. Rollcall vote. With regard to the sewer between 5th and 6th, Fillmore to the east, it was explained this is a reconstruction project to replace an inadequate line. Award to the low bidder was recommended. Mr. Anderson moved seconded by Mr. Lassen to award contracts to the low bidder on each project, the award on the East Bank sewer to be made on the alternate bid. Rollcall vote. COMMITTEE REPORTS Committee meeting held April 18, 1968: .' ~ "Present: Mayor Cone; Councilmen Anderson, Purdy, McNutt, Hayward, McDonald, and Wingard; City Manager and staff; and others. I' 1. Dog Control - Councilman McNutt said he received several calls with regard to dog con- trol in the City and said he felt something should be done to more strictly enforce the leash law. The City Manager said Eugene's ordinance is difficult to enforce since it provides that dogs must be under either physical or voice control. He said it gives no authority to go upon private property to capture dogs, and that the only way to gain that control is to have a strict leash law, i.e., a dog must either be on a leash or in a fenced area. The Manager said there is one man assigned to dog control and most of his time is spent on complaints. Another person was requested in the bud- get but deleted because of shortage of funds. No action was taken. ~ 2 2. Joint Housing Committee Report - Councilman Anderson reported on the progress of the Joint Housing Committee to establish means of providing housing for low-income families and elderly people. He said the Committee has gathered data on government programs, has interviewed representatives of government and private individuals, and circulated a questionnaire to gain general public opinion. Also, ex;loration has commenced, with the assistance of the Chamber of Commerce, on establishment of a non-profit corpora- tion to take advantage of either government or private capItal or both to increase avail- ability of low-cost housing. He mentioned the leased-housing program in existence and the Committee's concern about regulations preventing use of two-or three-bedroom houses for those fami1ise needing larger homes when the larger homes are not available. The Committee also is studying the construction of sewers in relation to population density to determine if proper sewers are available for the units constructed. Councilman Wingard said he wanted to stress that private industry will be included and will play an important part in providing this~type housing. -j 3 3. Collective Bargaining, IAFF #851 - A letter was read from Local 851, International Association of Fire Fighters, requesting reconsideration of Council action with re- gard to collective bargaining for City employes and asking that the Fire Fighters be considered separately and independently from other City employes. /."-,. -' Patrick Flynn, business agent for Local 851, said one reason for requesting separate consideration was the legal position reflected in the City Attorney's opinion that the City Manager's prerogatives with respect to "hiring and firing" would be nullified if a contract for collective bargaining is made. He said the City Manager's authority with respec~ to the Fire Fighters is already nullified because of their operation under civil service rules governing hiring and firing. Another reason for the request was the organization of an employes association and representation as 'proposed in its constitution which originally gave the Fire Fighters one vote out of nine, whereas he said the Fire Fighters constitute about 25% of all City employes. He. said also the association constitution originally proposed that the City Manager's office would provide a secretary to take minutes of the associa- tion's meetings, and that this caused concern among the Fire Fighters that the association was a "company" union. Mr. Flynn said he felt that there would be dif- ferences between such an employe association and the Local, and that this will not serve the best interests of the City. .. ~ .~ Mr. Harry Williams, International vice president of the IAFF, supported Mr. Flynn's request for reconsideration and distributed to Council members copies of a report and recommendations of a Fire Fighters Fac~ Finding and Review Commission with re- view Commission with regard to the "no strike" provision in the Constitution of the International Association. /' . ~ 4/22/68 - 7 163~ ., 4/22/68 . Mayor Cone said he felt the Fire Fighters have very good working conditions and are one of the better paid departments, and asked if they had grievances they felt col- lective bargaining would resolve. Mr. Flynn said there were several areas of concern, one being the individua11s liability if involved in accidents while on duty. He said if a contract were in effect, the employer would be held liable. He said he was not satisfied that a contract would improve the Fire Fighters position with respect to wages, but he did feel it would eliminate concern within the department and provide means of change in the future. The City Attorney said the City now carries liability insurance covering employes in the performance of their duties for the City, that in the event an individual fire- man is named defendant, the insurance company would cover him and defend him. .. Frank Jackson, vice president of Local 851, wanted the Council to be aware of the Fire Fighters opposition to being represented in the employes association. He said they have no need for that organization, and asked the Council to take a position in that respect. . . Councilman McDonald inquired about the present method of conununication with the Fire Fighters, and the Manager explained that individuals or organizations are asked first to refer any problems to the Fire Chief for resolution. If no resolution is made at that level, then they are free to come to the Manager's office with the Chief. Bill Dwyer asked the Mayor what his objections are to recognition of employe groups, and the Mayor replied that he felt the City is now providing good working conditions and pay, that recognition will put pressure on the City to provide more benefits which the City cannot afford in light of the present shortage of funds. Councilman Wingard asked Mr. Flynn about statements concerning removal of the "no strike" clause from their constitution, and Mr. Flynn said the Fire Fighters took action to support the Commission's findings as shown in the report distributed earlier. Mr. Williams said with collective bargaining in effect, the "no strike" clause would be in effect. I It was understood the Council would bring the item back for later discussion and decision on whether to reconsider their previous action. Mr. Anderson moved seconded by Mr. Lassen that Items 1, 2, and 3 of the Committee report be received and filed. Councilwoman Lauris asked for separate discussion of the items, and Mr. Anderson with the consent of the second withdrew his motion. 1 On Item 1, Mrs. Lauris said she felt the present ordinance should be rewritten to gain strict en- forcement of the leash law. Councilman McDonald said he recommended at the committee meeting enact- ment of a strict leash law. - Mrs. Lauris rroved that the City take part in the proposed countywide leash law study being undertaken by Lane County. There was no second, the general feeling being that the Council should be concerned with the problem within the City limits, and that the County's study would take too long. Mrs. Lauris moved seconded by Mrs. Hayward to determine what kind of new law could be written to re- place the present ordinance, taking into consideration Lane County's action. Motion carried. . 2 Mr. Anderson moved seconded by Mr. Lassen that Item 2 of the Conunittee report be received and filed. Motion carried. 3 With regard to Item 3, Mrs. Lauris moved seconded by Mrs. Hayward to extend formal recognition to IAFF Local #851 as bargaining agent for Eugene Fire Department employes, and that the Council set up a conunittee to explore procedures and report back on collective bargaining. In response to a question from Councilman McDonald concerning hiring and firing procedure under civil service, the Manager explained the procedures in effect with regard to po1icement and firemen. He said civil service rules and regulations governing appointment, promotion, and dismissal are more restrictive and dilute the Manager's prerogatives which is not true with regard to other City employes. . Councilman Wingard suggested that, before recognition, a committee be formed comprised of members of the Council, staff, and fire department employes to determine what is to be discussed under collective bargaining. In answer to questioning from Councilman Purdy with regard to the union's "no strike" clause, Mr. Flynn explained if collective bargaining is rejected by the Council, the local membership would vote to ask the International organization to come in, and they then could warrant a strike. Ii The Manager expressed concern about procedure should Local 851 be recognized. He said although the petition presented was signed by nearly all the fire department employes, he felt recognition should require a secret ballot to ensure the employes do want recognition. Mr. Flynn agreed, and said if recognition is extended, an election will be held immediately. . Jim Curtis, Bill Dwyer, and Jerry Dodd questioned the reasons for the Council's reluctance to give recognition. Mayor Cone commented that he felt with recognition there would be a tendency to divert monies from public works projects to the employes. 4/22/68 - 8 _~,~ JII": 1'6,4 - 4/22/68 A vote was taken on the motion as stated, and motion was defeated, Mrs. Laurisand,',Mrs. Hayward voting yes; Messrs. Mr. Wingard moved seconded by Mrs. Hayward to form a commit~ee of Council members, selected by the Council, and Fire Fighters representatives to discuss collective bargaining, to lead to collective bargaining with conditions set in ordinance form on recognition. Councilman Purdy said he felt all of the Council members should be included on such a committee. A vote was taken on the motion as stated, and motion was defeated, Councilmen Lauris, Hayward, McDonald, and Wingard voting yes; Councilmen Anderson, Purdy, McNutt, Lassen, and Mayor Cone voting no. Councilman Lassen asked if the legal department could do more research and make recommendations as to what the Council can do legally with regard to collective bargaining under the Charter. The Manager replied that discussion in committee of the Labor Council's request for a Charter Study commission would do this in effect. Mayor Cone left the meeting. Council President Anderson presided. .' 1 4. Planning Commission Report - March 25, 1968 a. Vacation Utility Easements, Jensens Industrial Tract (south of 1st and east of Bertelsen) - The Planning Commission recommended vacat:ioo. of the easements as re- quested. There were nO objections from utility companies who would have need of the easements. Dr. Purdy moved seconded by Mr. McNutt to approve the vacation. Motion carried. 2 5. Planning Commission Report - April 2, 1968 a. Rezone to RP, Oakmont betweenCoburg and Oakway, McKay - The Planning Commission recommended rezoning this area from RA to Residential Professional to allow con- struction of a professional building, subject to agreement on setbacks, landscaping, illumination, signing, and parking and driveway layouts. Douglas McKay asked that the property be rezoned without an agreement setting specific conditions. He said all of the requirements provided for in the agreement are covered under the new zoning ordinance, therefore he felt the agreement unnecessary. The Planning Di- rector said the Planning Commission felt because of extreme opposition from owners of adjacent properties to the original rezoning request for the Oakmont area, the Commission had an obligation to enSure the property's compatibility with the surrounding area. Mr. Anderson moved seconded by Mr. McNutt to approve the Planning Commission recommendation. Motion carried. . -,~, I ~- 3 6. Rent Supplement, Ya-Po-Ah Terrace The City Manager said that Resolution 1516, previously presented to the Council, would authorize participation in the Federal rent supplement program under the juris- diction of the Federal Housing Administration. Eligible tennants would have an income limit of $3,000.00. The present authorization for parttcipation in low-rent housing is under the jurisdiction of the Departmentof Housing and Urban Development and ad- ministered by the Lane County Housing Authority. Mrs. Gladys Toycen and Mr. Jens Horstrup explained that a maximum of 48 units in the Ya-po-ah Terrace apartment building could be used under the rent supplement program for those elderly people who meet the eligibility requirements. Mr. Wingard moved seconded by Mrs. Hayward to approve the resolution. Motion carried. .r Mr. Lassen moved seconded by Mr. McDonald to approve Items 4, 5, and 6 of the Committee report. Motion carried. 4 7~ City Hall Flags - The City Manager said representatives of the negro community re- quested the flags at City Hall be flown at half-mast for 30 days after the death of Martin Luther King. It was explained that the flags were lowered the day following King's death and kept at half-mast until after his funeral, and in accordance with the State's practice. He said the postoffice and Reserve units were contacted with regard to Federal practice of raising the flags after the funeral. Mr. Wingard moved seconded by Mr. McDonald to fly the City Hall flags at half-mast until May 6, 1968. Motion carried. . The City Manager distributed to Council members material on display of the flag as requested by Mr. Albert Casady. The Manager said the Federal law provides that the President of the United States declares when the flag shall be flown at half-mast, and that President Johnson, upon the death of Martin Luther King, proclaimed the flag would be a't half-mast until after interment. Mr. Lassen moved seconded by Dr. Purdy to fly the City Hall flags according to the proclamation of the , President of the United States. Motioncarried. II -.y?- 5 '. 8. Coburg Road Curb Cuts and Sidewalk Location - Owners of properties at 271, 273, 275, 277, 285, and 305 Coburg Road requested modification of proposed sidewalk location in connection with the improvement of Coburg Road. The Public Works Department recom- mended location of the walk at the curb in this area. Also requested was one 50-foot and one l4-foot cut at 275 Coburg Road. The Public Works Dep~tment had no objection and also recommended approval of requests from Douglas Oil Company for one 60-foot and One 50-foot cut at 340 Coburg Road, and two cuts (one 33-foot and one 36-foot) at the southwest corner of Coburg Road and Frontier Drive for Richfield Oil Company. Mr.McNutt moved seconded by Mrs. Hayward to approve the sidewalk "location at the curb and the re- quested curb cuts. Rezone Bailey Hill Road between 18th and Warren, Ellison and Platz - The Planning Commission recommended approval of rezoning from RA to R-1 PD and C-1 PD, subject to an agreement to ensure compliance with plans, drawings, illustrations, and time schedules. The Planning Director said 20% of the commercial area must be con- structed within two years or that portion will revert to RA. Vacation Arthur, Cooper, Cross, Cleveland - The Planning Commission recommended approval of these vacations requested by SP&S, subject to their dedication of Cross Street between Foch and Garfield. There were no objections in the area, and the City's traffic circulation is adequately served. Mr. Anderson moved seconded by Mr. Lassen to approve the vacations. Motion carried. Appeal, Day Nursery, 28th and McLean - A petition was presented from residents in the area appealing the Planning Commission approval of a conditional use permit to allow a day nursery and kindergarten at 28th Avenue and McLean Boulevard. The peti- tioners' objections were based on increased traffic and impairment of operation of the convalescent home to the west. Council members previously viewed the site of the proposed nursery. Mr. Anderson moved seconded by Mrs. Lauris to grant the permit. Mrs. John Jaap, 2690 Polk; Harold Napper, 2770 Polk; Craig Lucas, 2590 Polk; Millard Sp1ane, 2630 Polk; and Mrs. Frank Dunlap, 2785 Polk stated their reasons for objecting to the nursery - increased traffic, devaluation of property, changing character of the residential neighborhood to commercial, no benefit to the City as a whole. Mrs. Frank Trocino, 5070 Donald Street, said she anticipated very little change in traffic as a result of the nursery, and explained its proposed operation. David Hoffman, Planning Commission member, said the Planning Commission felt this was an ideal location for a nursery and kindergarten, that very strict conditions are set for suchinsta11ations, and he urged the Council to uphold the Planning Com- mission action. A vote was taken on the motion to approve the permit, and motion carried, Mr. McDonald voting no. 5 4. Echo Hollow Pool - The City Manager reported the proposed time schedule for presenta- tion of final drawings and revised estimates on the Echo Hollow Pool. The schedule contemplates bid call by May 15 with start on construction by July 1, 1968. No action was taken. 6 5. Insurance Agent-of-Record - A report was read from the Finance Director recommending appointment of Smith & Crakes as agent-of-record for the City's insurance program. " The City Manager explained the agreement between K. Ray Barnes and the City, a condition of the annex- tion of area north of Green Acres Road and west of Norkenzie Road, was not signed, hence the repeal of the annexing ordinances.
