The regular meeting of the Common Council of the city of Eugene, Oregon was called to order at
7:30 p.m. on May 13, 1968 in the Council Chamber by His Honor Mayor Edwin E. Cone 'with the
following councilmen present: Mr. Anderson, Mrs. Lauris, Dr. Purdy, Mr. McNutt, Mr. Lassen,
Mrs. Hayward, Mr. McDonald 'and Mr. Wingard.
Minutes of the April 8 and 22, 1968 Council meetings, as mailed to Council members, were approved.
NEW BUSINESS
Mrs. Lauris commented on the very successful Rhododendron Show and the use of City Hall
for the purpose it was intended. I

1. Paving 5th. McKinley to Highway 99 - The Public Works Department recommended award to the low
bidder on the alternate bid.
Mr. Anderson moved seconded by Mrs. Hayward to award contract to the low bidder on the alternate
bid. Rollcall vote. All councilmen present voting aye, motion carried.

2. Paving Willamette from 40th to south boundary 7th Addition to Edgewood Estates - The Public
Works Department recommended award to the low bidder on the alternate bid.
Mr. Leonard Oswald, 4295 Willamette, spoke in favor of the project and asked if the crown
of the hill would be lowered for better visibility. The City Manager stated the design
of the project would lower the crown of the hill.
The Public Works Director explained the original petition for this project was signed by
49% of the property owners. Since the first public hearing on the project was held, the
petition has been reduced to 21% in favor of the project. A petition against the project
was signed by 39.8% of the property owners, with 37.6% remaining neutral and 1:6% with no
response.

Mr. Hal Merrill, 40 Oak Court, spoke against the proposed paving. The back of his property
abuts on Willamette Street, and he does not have direct access to Willamette. He said
the project is not warranted since there is not sufficient traffic in the area and feels

**The Public Works Department recommended award of contracts to the low bidder on each project.
Mr. Anderson moved seconded by Mr. Lassen to award contracts to the low bidder on each project,
and the bid on project number 5 for Alternate #2 and on project number 6 for the Alternate bid.

the City should do those projects and provide those services with greater need priority.
Mr. C. Marlin Withrow, 20 East 46th, .started the petition in favor of the improvement., He
said the project is warranted from the standpoint of safety, drainage, and property
improvement, and that if it is don~ this year i~ will cost less money.
Mr. Chester Worthy1ake', 10 Coachman Drive, spoke against the project. He said Wf11amette
would become more of a speeaway than it is already, and that widening the street would
provide street parking so that no extra width would be provided for thru traffic. The
City Manager stated the speed limit on Wil1amette was 55 miles per hour when the Coun~y
owned the roaa and that the State of Oregon sets the speed limits. "
Councilman Purdy asked if present drainage problems co~ld be solved. The Public' Works Director
said that the proposed paving project would provide for sanitary and storm sewers to drain the
street properly. Councilman Purdy asked if there is any case where a subdivider has paid
for arterial improvement, and the Public Works Director said this was a border street on
the city limits and the City had no control over it at the time it was put in.

The City Manager said this project will: be done at some time or another, this is a good bid
and chances are there will not"be another one as iow, and that there is a need to control
the run of water on Wi11amette. .

Councilman Lassen said that the properties abutting Wi11amette along the back side will be
legally responsible for assessments now or 10 years from now.
6. Paving, Sanitary and Storm Sewers, Sidewalk and Driveway Approaches, Harlow Road from Coburg
to Garden Way and within Monaco Park Addition - MI. Philip Grant, 2991 Harlow Road, spoke
against the proposed project. "He stated the study that was made with reference to this,
arterial was done in'1963 and the projection for use of Harlow Road as a highway was not
appropriate. He asked if other alternatives had been'studied and suggested Harlow Road should
be limited to two lanes with a turning lane provided in the center. He asked that the
council postpone~a decision on this project until a study could be made of other alternatives.

The City Manager read a summary of the research which has been done on this project since
1960 and stated this project has had more study than any other street in the City. He also,
stated by 1980 Harlow Road will need to be a 4-1ane road.
The Traffic Engineer stated that Harlow Road is one of the main connections between Eugene
and Springfield and a recent traffic count indicated 5,000 to 8,000 vehicles use Harlow Road
per day and there has been approximately a 4% increase per year in the number of vehicles
using Har10w'Road.

Mr. Goerge Adams, 715 Lee Street, said he was concerned about the assessments to abutting
properties owned by people who do not want the project. He said the traffic does not warrant
widening of the road. The City Manager explained that Harlow Road was acquired from the county
by annexation and does not meet City standards and in order to develop sidewalks and drainage
the improvements are necessary.
Mrs. Betty Niven brought up the point that the property owners abutting the proposed project
have never been assessed for any costs on. Harlow Road.:
Mrs. Hayward moved seconded by Mr. McNutt to amend the original motion to exclude Project.
number 2.

A rollcall vote was taken on the original motion as amended, and motion as .amended carried
with all Councilmen present voting aye.
Mr. Anderson moved seconded by Mrs. Hayward to table Project number 2. Motion carried.

Mayor Cone left the meeting, Council President Anderson presiding.

1. Appeal Use of Plastic Conduit. Cooke Electric - Bernard Cooke submitted an appeal from
the Electrical Board's decision to uphold the Electrical Inspector's action with regard
to violations of the Electrical Code by Cooke Electric in the installation of plastic
conduit in an apartment building at 1025 West 7th Avenue. The Board's decision was
based on (1) wiring having been started and continued before a permit was secured;
(2) use of plastic conduit rather than metal raceways required by Code; and (3)
installation being covered and partially hidden before inspection was called for. The
Superintendent of Building Inspection recommended rejection of the installation and
modification to comply with the Code.
Mr. Cooke said he had talked to the Superintendent of Building Inspection and to the
Electrical Inspector and understood he had approval for the use of plastic conduit.

He maintained it was an exterior installation. The Superintendent of Building Inspection said
the main question is that the installation was not ma4e in accordance with plans which were
approved and, s~nce inspection ~as not called for while the work was being done, the inspectors
do not know what is in the installation.

Don Robinson and James Mitchum, members of the Electrical Board, commented on the use of
plastic conduit in relation to the Code and said Mr. Cooke had asked the Board to consider the
possibility of amending the Code to permit use of plastic conduit~ They upheld the Building
Superintendent's statement that the manner of installation was the main item of contention.

2. 'Lock Your Car' Meter Stickers - The City Manager said the request from Insurance Women of
Eugene-Lane County for the meter stickets is part of a National campaign and there is no
objection from the staff. Mr. McDonald moved seconded by Mrs. Hayward to allow placement of the
stickers on the City's meters. Motion carried. It was suggested the Insurance Women be
requested to remove the stickers when they begin to deteriorate.

3. Leasing City Parking Lots - Diamond Parking, Inc., proposed operation as:managing agent of,
the City's off-street parking lots not connected with an asseBsment district - 12th and Oak,
Broadway and Charnelton, 13th and Olive. Diamond would guarantee a minimum earning to the
City equal to what ~s nqw being earned on the three lots and would operate them in conjunction
with the downtown validation program on a management fee basis. The City Manager explained that
the tax exempt status of the lots would be retained through the proposed arrange~ent, and that
rat~s would be similar to present rates in th~ vicini~y of the lots. Diamond will maintain the
lots and upon 60 days written notice will remove their equipment and return the lots to their
present condition. Some discussion with respect to on-street meter rates and posBibili~y qf
chaqging them to a lO~ minimum. '

b. Variance 27th and Oak. Bennett - The Planning Commission recommended approval of 19.5 room
count increase over the allowable 111.9 on R-3G zoned prope~ty on Oak Street between 27th
and 28th. The City Manager explained a v.al'iance previously gr~nted alLowed a room count
based on Lots 1 through 7 and Lots 7 through 11, and an apartment .house was constructed
using the variance on Lots 1 through 7. Renewal of the variance to allow construction of
an apartment building on Lots 7 through 11 was rescinded when ,a bu~lding permit application
was rejected because of the uS,e of Lot 7 twice in computing the room count. The present
Planning Commission recommendation allows an increase over the allowable count, but less
than that originally planned. Dr. Purdy moved seconded by Mr. McNutt to approve the

with regard to previous rezoning of property abutting the alley on the west and the Council's

property owner. Dr. Purdy moved seconded by Mr. Anderson to approve the petition subject to
the petitioner's paying the entire cost of the improvement. Motion carried.

Dr. Purdy asked what the legal aspects would be if assessments to the Very Little Theatre,
2350 Hilyard, were deferred until such time as they sold the property. The City Attorney explained
that such an agreement could be made between the City and the property owner, but that it would be
binding forever.

8. Harlow Road Right-of-Way - The Public Works Department recommended buying property from
Billy G. and Carey Hill at 3325 Harlow Road for $510.00. Mr. Anderson moved seconded by
Mrs. Lauris to approve the recommendation. Motion carried.
Robert F. and Ruth Ann Sneddon have agreed to sell property at 3393 Harlow Road for $2,510.00,
$370.00 more than the City's appraisal. The City Manager said there was considerable
severance damage and that it would probably amount to more than $370.00 to proceed with
condemnation. Mr. McNutt moved seconded by Mrs. Lauris to buy the property for $2,510.00.

9. Fence. West Belt Line Ditch - It was reported that the Lane County Commissioners will not
permit mpving the fence to the east side of the drainageway east of the West Belt Line Road
between Barger Drive and Royal Avenue. The Public Works Department estimated a cost of
$6,800.00 for construction of a new fence. There was some discussion with regard to setting
precedent in fencing the ditch, with the general consensus that it could be justified on the
basis that the City created the ditch after homes were constructed in the area. Mrs. Lauris
moved seconded by Mrs. Hayward to build a fence on the east side of the West Belt Line
Drainageway. Motion carried, Mr. McNutt voting no.

10. Parking Prohibition. Donald between 40th and 41st - Breedon Bros. requested prohibition of
parking on the west side of Donald Street wouth of 40th Avenue in the commercial zone. The
Public Works Department recommended prohibition on the west side of Donald for 380 feet
south of 40th, and on the east side for 180 feet south of 40th and for 40 feet beginning
350 feet south of 40th. Dr. Purdy moved seconded by Mr. Wingard to approve the recommendation.

11. Parking Prohibition. 30th between Harris and University - School District 4 requested
prohibition of parking on 30th Avenue between Harris and University. The School District
reported it is difficult for children crossing 30th to see oncoming traffic. The Public
Works Department recommended prohibition of parking on the eorth side of 30th from Harris
to University, and on the south side for 100 feet east and west of the centerline of
Potter Street. Dr. Purdy moved seconded by Mr. McNutt to approve the recommendation.

I 12. Parking Prohibition. Wilson and 7th Place- The Public Works Department recommended parking
prohibition on the east side of Wilson Street for 200 feet south of 7th Place to give better
vision for ingress and egress for Chuck's Truck Repair off-street parking. Mr. McNutt moved
seconded by Mrs. Lauris to approve the recommendation. Motion carried.

moratorium recently requested by the Planning Commission during consideration of new sign
regulations.H
The City Manager stated the Planning ,Commission has recommended approval of the ordinance in order
to protect against oversize signs being put up by companies who would anticipate restrictive
changes 1n the new sign ordinance.
Mr. Hal Cross asked that the sign moratorium not be passed since it was not necessary. He said
his sign company has received no unusual orders in the past few weeks for oversize signs and does
not anticipate any.

Mr. Ray Wolf, speaking for the Ad-Hoc Sign Committee, said he felt there was a definite need for
the ordinance.

3. 30th Avenue Overpass - Joe Richards, attorney speaking for the Harris School PTA, reviewed
previous 'Council action with regard .to an overpass on 30th Avenue at ~otter Stieet. : He
said the PTA is concerned because of the speed of highway traffic abruptly entering the
residential neighborhood on the sustained, extreme steep grade of the arterial bordering
Harris'Bcihuo~. ThePTA feels too that opening of Lane Community College will result in
increased traffic volumes:on the street. They requested constiuction of the overpass by
the fall of 1968 on a 50/50 cost sharing basis between the.City and:School District 4;

Mr. Wingard moved seconded by Mrs. Hayward that the staff review cost estimates and design'
alternates for an overpass, and contact School District 4 to determine their attitude at
this time toward sharing construction costs.
Discussion followed between Council members and PIA members' on the probability of the
Harris School boundary line's being shifted to 30th Avenue, design of overpass to
accommodate bicycles, fencing to force use of an overpass, and inadequacy of present
traffic signing. Mayor Cone expressed the opinion that the City should pay ,no more than a
third of the cost, with the School District paying the balance, since the School Board was
aware that 30th would be used as an arterial before Harris School was constructed.
A vote was taken on the motion as stated, and motion carried.

Mayor Cone commended Mr. Wyatt for his hard work and the fact that he brought considerable measure
of dignity and respect for his position and wished him the best of success in his new position.

5. OversLle Curb Cut. 1045 Garfield - Council members previously viewed the site where
Friction Materials Corporation requested removal of a 15-foot curb between two
30-foot cuts, making a total cut of 75 feet on a 100-foot frontage. The Public Works
Department recommended denial, and prohibition of parking adjacent to the driveway
approaches with construction of a curb at the property line to define the approaches.
Mrs. Hayward moved seconded by Mr. Lassen to grant a variance allowing the 75-foot cut.
Motion carried.

7 6. Echo Hollow Pool - Jon Berry, architect, presented the completed design of the Echo Hollow
Pool, and copies of the cost estimate were distributed. The Parks Director said the cost,
including alternates, falls within the $608,000 previously authorized, and leaves about
$245,520 of the bond issue for the Amazon community center building. Mr. Anderson moved
seconded by Mrs. Hayward to call for bids on the project as outlined. Motion carried.

7. Parking Meters. Universitv of Oregon - The Traffic Engineer presented a chart showing areas
around the University of Oregon campus proposed for installation of 830 new 2-, 5-, and
10-hour parking meters to provide additional parking for commuter students. He said the
University Planning Committee has approved the plan. Councilman Anderson said he felt
that before expanding the on-street parking, plans should be explored for multistoried
parking facilities in the University area. The Traffic Engineer replied that the University
has requested the State Board for development of parking structures but has not been able
to gain priority over other building requirements.
Councilman Wingard objected to installation of the meters in those areas where no other
parking is available for apartment house occupants. The City Manager said revenues from
the meters will more than compensate for their purchase and for additional personnel
necessary to enforce them.
Dr. Purdy moved seconded by Mr. McDonald to approve the plan as presented. Motion carried,
Mr. Wingard voting no.
Mr. Anderson moved seconded by Mrs. Lauris to approve Item 7 of the Committee report.
Discussion followed with protests from several University students stating they would not be able
to afford to park on campus and that the meters would not eliminate the problem of shortage of
parking. The Traffic Engineer said the original request for the meters came from the Campus
Planning Committee, which has student representation. Mr. Orville Lindstrom, Director of Fiscal
Affairs, representing the Committee, stated plans are in the preliminary stages for a parking
structure at 14th and Kincaid and that the University is in the process of purchasing land from
Eugene Sand and Gravel to provide ~dditional parking space. Mr. Art Keith, faculty member at
the University, said he felt the parking meters would serve no purpose except to provide revenue
for the City and that they would not solve the parking problems on campus.
The Traffic Engineer stated the meters would force a turnover in parking and eliminate cars being
left on the street for days at a time. He also stated the meters are self-sustaining and that
about 75% are long-duration meters.
Councilman Wingard recommended the parking meters be excluded from the residentially zoned area
west of Kincaid Street since this is an area for low-cost housing for students and there have
never been parking meters installed in residentially zoned areas.
Mayor Cone asked if it would be feasible to have bids on the parking meters rather than the
contract-buying basis proposed. The Traffic Engineer explained there were two companies who
submitted prices on the meters. The low price was accepted and the total cost for quantity
provided considerable discount (5% interest on a 3-year contract).
Mr. Wingard moved seconded by Mrs. Lauris to amend motion to exclude all residentially zoned
property west of Kincaid Street.

8. Aircraft Tie Down Fee. Mahlon Sweet Field - The Airport Commission recommended establishment
of tie down and parking fees for aircraft at Mahlon Sweet Field, with the fixed base
operators to act as collection agents for the City in return for one-third of the fees
collected. The fees recommended were: Per Month - $6.00; Semiannual - $36.00;
Annual - $66.00; Single-engine Transient Aircraft - $1.50 per day; and Twin-engine Transient
Aircraft - $2.40 per day. Councilman Purdy questioned the lower rents collected for ground
space from hangar owners, and the Airport Manager explained that more expense is incurred
in equipment and time with the tie down areas.
Mrs. Lauris moved seconded by Mrs. Hayward to approve the recommendation. Motion carried.

paid and controlled auto parking at Mahlon.Sweet Field, either through negotiation ofa

Mr. Art Keith, 2311 Alders Street, protested assessment against property at 2479 Alder Street for
which he has a land sales contract. Assessment bill was sent to the owner of the property a year ago,
and since that time the property has changed ownership several times. He did not feel he should be
held responsible for the bill and reltthe City had been lax in billing procedures. The Finance
Director explained the billing procedure for assessments of this type is done on a monthly basis and
reviewed the billing record on this particular assessment.
