Adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned from the regular
meeting held May 13, 1968 - was called to order at 7:30 p.m. on May 27, 1968 in the Council Chamber
by Council President Lester Anderson in the absence of Mayor Cone (entered the meeting later).
Other councilmen present were: Mrs. Lauris, Dr. Purdy, Mr. McNutt, Mr. Lassen, Mrs. Hayward (entered
during meeting); Mr. McDonald, and Mr. Wingard.

Councilman McNutt asked about the status of the Crest Drive project and was told it is
scheduled for bids this summer.

Councilwoman Lauris recognized the presence of Boy Scout Troop 177 attending the meeting
as part of their, attainment of Citizenship Badge.

Mr. Lassen moved seconded by Mrs. Lauris to accept the bid of First National City Bank of New York
at an effective interest rate of 4.334%. Rollcall vote. All councilmen present voting aye,

mended approval of waiver of bid procedure - and award of contract to Wildish Construction
Company for $60,564.64 for construction of streets and sewers in Valley West Subdivision.

3 !. Closing East Park Street, Roundup Association - A letter was read from the Roundup Associa-
tion requesting closure of East Park Street between 8th Avenue and the alley to the south
on July 8 and 9, 1968. The closure is requested to permit operation of pony rides during
the Roundup Celebration on those two days. The staff reported closure would not appear to
create too great an inconvenience, and traffic would be able to move properly from East
Park Street to Pearl Street through the alley.

1. Town Hall Meeting and Chamber of Commerce Forum - The City Manager called the Council's
attention to the Town Hall meeting to be held by Governor McCall in Eugene on June 28,
1968 at 10:30 a.m. The Governor will speak at a Chamber of Commerce Forum following
the meeting and review results of the Town Hall meeting concerning ways the Governor's
office can more effectively bolster ~he economy of Lane County.

2. Planning Commission Report - April 30, 1968
a. Rezone to RG, 18th between Polk and Chambers, Cosgrave and Associates - The Peti-
tioners requested withdrawal of their zone change application. The Planning Com-
mission recommended approval. Mr. Lassen moved seconded by Dr. Purdy to approve
the recommendation. Motion carried.

b. Sidewalk Waiver, 2668 Donner Place - A petition from residents of Donner Place,
a cul-de-sac off Country Lane, requested waiver of requirement for sidewalk in-
stallation in conjunction with construction of a new residence at this location.
The Public Works Director said this area is under a blanket waiver awaiting com-
pletion of sewer construction. Mr. Wingard moved seconded by Mrs. Hayward to
grant the waiver. Motion carried.

c. Time Extension, Use Variance Donald and Willamette - Balzhiser, Rhodes, Smith and
Morgan, architects for John Hirons' garden center project, requested extension
of time for presentation of design development drawings and bid documents. The

seconded by Mr. Wingard to approve the recommendation. Motion carried.

Charter Study Commission - A letter was read from the Lane County Labor Council request-
ing (1) establishment of an ad hoc Charter Study Commission to analyze the City Charter
with respect to legislati~authority of the Council in those matters affecting City-
employe relationships; (2) a report to the Council based on that analysis with such a
report to be used in the future in establishing policy with regard to City-employe re-
lationships; and (3) the Commission membership to include legal counsel for the City,
representatives of the Lane County Bar Association and of City employe labor unions,
and such other citizens as the Council may direct. The City Manager said if the
Council decides to proceed with a Charter revision program, rather than analyze only
that portion having to do with City-employe relationshipk probably a complete Charter
study should be made~ He pointed out that because of the many ramifications and time
consuming work involved, appropriation of funds should be considered for the neces-
sary legal work.

than just employe matters, suggesting that it may be necessary to seek a different'-
type of City government more responsive to the will of the electorate and possibly

a matter of reorganization. He said such a study might be funded through a grant
from an outside agency.
The City Manager suggested a preliminary study to determine the scope of Charter
revision which might be undertaken. Councilman Anderson suggested that the Mayor
appoint a committee to determine procedures - whether to seek foundation money to
revise the Charter, membership of a Charter Study Commission, and generally to give
guidance with regard to areas of the Charter which should be given study. Mayor
Cone expressed firm opposition to any change in the Council-Manager IDrm of government.
Mr. Anderson moved seconded by Mrs. Hayward that the Mayor appoint a committee to
bring back a report as to whether a Charter revision should be made, procedures to
be followed should it be made, and methods of funding. Motion carried.
Mr. Anderson moved seconded by Mr. Lassen to approve Item 3 of the Committee report. Motion carried.
Councilwoman Lauris asked if the League of Oregon Cities would do this work under fees paid by the
City. The City Manager said the League would provide materials f~om their library and advice with
regard to general proposals, but the dues structure would not provide for technical drafting help
necessary if the Charter is revised.

4. Trailer Variance Extension, 13th and Olive - The variance allowing use of a trailer
for Kendall Ford office at 13th and Ulive has expired. The City Manager explained
that the variance permitting use of a tent at the same location for sales space will
soon expire and suggested extension of both since there are no Code enforcement
problems. Mr. Lassen moved seconded by Mr. Wingard to grant a six-month extension
of the variances, with review at the end of that time. Motion carried.
Mr. Anderson moved seconded by Mr. Lassen to approve Item 4 of the Committee report. Motion carried.
Councilmen Lassen and McDonald questioned extension of the variances after this. They both felt
another extension should not be granted unless Kendall Ford has another site located and buiMings
under construction.

5. Curb Cut, 62 West 29th Avenue - Keith Carter requested lO-foot extension of the
existing 20-foot curb cut at 62 West 29th Avenue to accommodate safe exit from the
car wash building. The Public Works Department recommended approval. Mr. Wingard
moved seconded by Mr. Anderson to approve the oversize curb cut. Motion carried.
Mr. Anderson moved seconded by Mr. Lassen to approve Item 5 of the Committee report. Motion carried.

6. Curb Cut, Valley West at Bailey Hill Road and Warren Street - The Planning Commis-
sion approved a planned unit development for Ellison and Platz in this area, including
design of the parking area in a single-family residential section to accommodate park-
ing perpendicular to the street and requiring a 192-foot curb cut. The City Manager
said the arrangement is contrary to normal requirements and isn't desired as a rule,
but would be acceptable in this situation. Mr. Anderson moved seconded by Mr. Wingard
to approve the requested curb cut. Motion carried.
Mr. Anderson moved seconded by Mr. Lassen to approve Item 6 of the Committee report. Motion carried,
Councilman Purdy abstaining.

7. Hayes Street Parking - A report was presented from the Public Works Department with
regard to investigation of prohibiting parking on one side of Hayes Street from 18th
Avenue south requested by Councilman McDonald. It was felt removal of parking from
one side would not lessen hazards for children because of resulting two-way traffic.
The Public Works Department recommended circulation of a questionnaire to owners of
property on Hayes Street between 18th and 22nd to determine if they want a parking
restriction on one side of the street, and if so, which side. Dr. Purdy moved
seconded by Mr. Anderson to approve the recommendation. Motion carried.
Mr. Anderson moved seconded by Mr. Lassen to approve Item 7 of the committee report.
Councilman McDonald pointed out that most of the homes on Hayes from 18th south are occupied by
renters.
Discussion resulted in Mr. Anderson's changing his motion, with the consent of the second, to approve
circulating a questionnaire, but that it be sent to both renters and property owners, providing they
are separately identified. Motion carried.

8. Ordinance, Garbage Haulers License Tags - An ordinance was proposed which would require
issuance of metal license tags to garbage haulers to identify all garbage trucks licensed
by the City. The City Manager explained enforcement problems with regard to City
licensed garbage trucks because of garbage trucks from outside the City using the same
dump site. Mr. Lassen moved seconded by Mr. Wingard to adopt the proposed ordinance.
Motion carried.

9. Ordinance, Auctioneers License - The Finance Department recommended issuance of
auctioneers license on a six-month basis instead of a three-month basis as now re-
quired. A proposed ordinance was presented which would amend the Code to provide
for the change. Dr. Purdy moved seconded by Mr.Anderson to adopt the ordinance.

of Day T. Bayly's request for segregation of $695.05 of the assessment against property

12. Survey, South Willamette Alternate - The Citizens' Advisory Committee for the Eugene-
Springfield Area Transportation Study recommended that the City and Lane County make
a survey for an alternate route for the Willamette Street arterial from the proposed
Amazon Parkway/South Willamette connector to the proposed 'South Belt Line Road. The
Committee feels the suitability of the route now proposed is questionable and an
alternate route should be surveyed as soon as, possible.. Mr. Anderson moved seconded
by Dr. Purdy to proceed as recommended. Motion carried.

l3.LeArts Custodial Contract - In response to a question from Councilman Purdy at the
Mayl3 Council meeting, the Finance Department reported a payment of morethan
$1,000.00 was made to LeAEts for the first time in March. The larger amount was
caused by addition of the Data Processing Center to the cleaning schedule.
Mr. Anderson moved seconded by Mr. Lassen that Item 13 of the Committee report be received and filed.

14. Pearl Street Access, Rubenstein - Unthank, Seder, and Poticha requested access from
Pearl Street to the Rubenstein property onthe west side of the street north of 23rd
Avenue for a proposed planned unit development on the site. Access'was requested
for ingress only; egress will be provided onto 23rd and Willamette. The City Manager
said the Pearl Street improvement, because of limited access, was not assessed against
abutting properties, and if access is permitted some assessment should be made to re-
imburse the City for the facility. The Public Works Director said purchase of right-
of-way was based on limiting access resulting in higher assessments. He said the
access could be accomplished without jeopardizing the traffic system.

Councilman Purdy said he felt the City should be remunerated for street improvement,
and for land cost in excess of normal because of limited access purchase basis. The
City Manager raised the question of northbound traffic making left turns to enter the
property, and the Traffic Engineer said some provision for control of that type of
movement will have to be made.

Mr. Wingard, with the consent of the second, changed his motion to approve the access
subject to the property owner's paying any costs involved in construction of the exit
ramp to City specifications and, any liabilities, and that the City Manager negotiate
such costs with the property owner.
The Planning Director said the planned unit development design was worked out with
the thought of eliminating a severe traffic problem on Willamette Street which would
result without access from Pearl Street. He said the circulation plan for the project
will be brought to the Council for review prior to Planning Commission consideration.
In answer to a question from the City Manager, the Public Works Director said the
sidewalk proposed for the area will be installed on the east side of the Amazon through
the Park and will not be adjacent to the Parkway.

asked if the Council was aware that when the property in question was zoned RG it was expressly
understood there would be no access to Pearl Street.

Pearl Street to the Planning Commission rather than this particular situation, and Mr. Wingard said
he would second such a motion. Mr. Anderson said he felt this particular access should be decided
now so the developers would know whether to proceed with plans.
Mr. Lassen seconded Dr. Purdy's motion to refer as stated. That motion was defeated, Councilman
Purdy, McNutl; and Lassen voting yes; Councilmen Lauris, Anderson, Hayward, McDonald, and Wingard
voting no.
Mr. Wingard moved seconded by Mr. Lassen to amend the original motion to refer the item to the Plan-
ning Commission, with the Council's approval of the overall plan. Motion carried, Councilman McDonald
voting no.
A vote was taken on the original motion as amended, and motion as amended carried unanimously.
The Public Works Director told the Council that action taken by a previous Council on a similar
request for this property allowed the owner to use a portion of the right-of-way between the curb
and the property line to build a frontage road.

15. Jury Fee and Court-appointed Attorney - The City Attorney reported on the request of
Jon Shumate for waiver of the $30.00 jury fee and for a court-appointed attorney
in his appearance on a charge of receiving and concealing stolen property. Both re-
quests were denied by the Municipal Judge, and Attorney Ed Fadeley has appealed the
case to circuit court on behalf of Mr. Shumate. The City Attorney said the decision
ona similar case now pending in the Oregon Supreme Court will govern the City's
responsibility in this case. He said funds should be budgeted to cover expense of a
part-time public defender in the event the Supreme Court decision is to allow jury
trials for indigent persons without payment of the required fee. Councilman Anderson
suggested the possibility of working with the Lane County Bar Association in their
public defender program. It was understood the City Attorney would recommend an
amount to be budgeted for such purposes at the public hearing on the 1968-69 budget.

16. Alcoholism Committee - The City Manager suggested appointment of a committee comprised
of one councilman and two lay people to work with Buckley House and the Lane County
Council on Alcoholism on development of an overall program to prevent overlapping of
services for which the City has budgeted funds. It was understood the Mayor would
appoint such a committee."

2. Sidewalk, Roan Drive - Councilman Wingard requested an investigation of sidewalk'
possibilities on Roan Drive. He said residents of the area are concerned with the

partment would use MACE, a chemical compound which will temporarily incapcitate a
person when sprayed on the body. The City Manager replied. that the Department has

4. Planning Commission Report - April 29, 1968
a. Rezoning 1330 Coburg Road, Cosgrave & Associates (Rust) - Referred back to the
Planning ~ommission as a result of the Council's action to rezone the entire area
RG, the. petition now has a Planning Commission recommendation to rezone the entire
area R-2 as the highest practical density on the basis of existing sewers.

Henry Camarot said he had not heard before that sewers were the basis for making a decision on this
zoning. He said an RG zone, as approved by the Council previously~ would be economically feasible
with redesign of portions of the property, and asked that the Council reject the PlanningCommission
recommendation for R-2 and rezone the property RG.

The Planning Director read the Planning Commission recommendation which was that they "expressed the
general feeling that the existing sanitary sewers were not designed in the Wil1akenzie Area for the
RG density, and that the approve plan, as interpreted by the Planning Commission, permits an R-2 PD
as the highest density for that area. The precedent of allowing a higher density along Coburg Road
and its effect upon both land use and public facilities (sanitary sewer systems) was felt to be
detrimental."

Councilwoman Lauris asked why, with new sewer construction there is not the capacity desired, and was
told that although the lines would accomm9date this development now, that capacity would not be avail-
able to other developments. Mr. Wingard ravored rezoning to RG with a contractual arrangement to

5. Planning Commission Report - May 13,1968
a. Eugene-Springfield Community Goals - The Planning Commission recommended acceptance
of the Goals as presented byrthe Plan Advisory Committee, noting the Committee's
exception with regard to some specifics, particularly as applied to air travel,
which they felt should be more general. The Goals have been adopted by both Spring-
field and Lane County. Mr. Anderson moved seconded by Mrs~ Lauris to adopt the
Goals as submitted, with the exceptions noted. Motion carried.

b. Zoning Ordinance Variance, 1859 Franklin Boulevard - The Planning Commission recom-
mended approval of a request from Mr.Fred Braatz for a variance to allow construc-
tion of an apartment at 1859 Franklin Boulevard which would not be per~ted under
the new zoning ordinance. Development of the area has been in the planning stage
for some time based on the old zoning ordinance. Dr. Purdy moved seconded by
Mr. Anderson to allow the exception. Motion carried.

c. 20th Avenue Design - The Planning Commission recommended approval of a design
providing for three cul-de-sacs on 20th Avenue between ~efferson and Friendly.
The original design suggested by the Public Works Department 'provided another
cul-de-sac between Washington and Jefferson, but the owners of property in that
block decided they would rather have the street paved through. Mrs. Hayward mov~d
seconded by Mr. Wingard to approve the Planning Commission recommendation.

Councilman Lassen said he felt the cul-de-sac designis not the best solution in a
street grid system. The City Manager replied in this particular situation where
the street deadends at a park the cul-de-sac design will prevent through traffic

type where some benefited properties will not abut the project and therefore
cannot be assessed. The Planning Director said meetings are being held with
property owners in the area to try to work out an equitable method for paying
thepaving cost.
Mr. Wingard, with the consent of the second, changed his motion to include in-
stallation of sidewalks when the street is paved, and a vote taken on the motion
as amended carried unanimously.
Mr. Anderson moved seconded by Mr. Lassen to approve Item 5c of the Committee report.
A petition was presented signed by residents of the block between Madison and Jefferson requesting
curb sidewalks on that block. The City Manager suggested that, because of work to be done such as
closing intersections, vacating and width acquisition for cul-de-sacs, and actual design of the
project, the Council approve the idea so that a specific design may be brought back for consideration
with possible inclusion of curb walks in the entire area.
G. F. Blodgett, 2010 Monroe, asked if 100% approval was necessary for going ahead with the cul-de-sac
design, and whether property owners would have duplex rights on corner lots created. The Planning
Director replied that in essence 100% approval is necessary, since the required vacations must have
100% approval. With regard to duplexes on the corner lots, he said it would depend upon the angle
of the streets and frontage on the resulting two streets.
A vote was taken on the motion to approve the committee report, and motion carried.

d. Variance Extension, Bethel Drive - Manning Seed Company requested extension of
a variance which allows cone storage on property on Bethel Drive north of
Roosevelt Boulevard. The Planning Commission recommended approval of an exten-
sion for one year from the date of Council approval. Dr. Purdy moved seconded
by Mr. Wingard to approve therecommenda tion. Motion carried.

6. McLean Boulevard Design - The City Manager presented a proposed design for improve-
ment of McLean Boulevard from Lindsay Loop to Graham Drive which was developed to
save as many trees as possible. He said the proposed design will provide for an
offset from the centerline to the north enough to permit a 24-foot street, with a
28-foot street constructed where trees do not present a problem. Parking will be
restricted at some future time; at the present time the street deadends and traffic
is light.
Mrs. Lauris moved seconded by Mrs. Hayward to modify the standards f@r this street
as proposed.
Some Council members felt the parking should be restricted immediately upon comple-
tion of the project. The Public Works Director said it would entail striping,
traffic signs, etc., and because of the distance from the enforcement area, restric-
tions would be abused.
A vote was taken on the motion as stated, and motion carried.

7. Public Works Pro;ects, 1967, Extensions and Deferrals - Council approval was requested
for time extensions and assessment of liquidated damages on various public works
contracts. Copies of the report listing contracts involved were distributed to
Council members. Dr. Purdy moved seconded by Mr. Anderson to accept the report and
assess the damages.
The Public Works Director pointed out that the contractors do have the right to
appeal to the Council on the liquidated damages. He also suggested the Council
authorize the Public Works Department to grant extensions to seven days without
council approval, but it was felt better because of public relations to retain
the present procedure.
A vote was taken on the motion as stated, and motion carried.

8. Speed Recommendations
a. Chambers from 7th to Lorane Highway - The State Speed Control Board recommended
a 30-mph zone on Chambers from 7th to 50 feet south of 24th, and 40 mph from that
point to Lorane Highway. The existing speeds are 30 mph from 7th to 300 feet
south of 25th, and 40 mph from that point to Lorane Hlighway. The staff recom-
mended retaining the present speeds on- the basis that speeds should be reduced
for a distance farther from 24th since it is an east/west arterial. The report
of the Speed Control Board's investigation was read pointing up the reasons for
their recommendation. The Public Works Director said that when the improvement
of Chambers is completed, because of its being a safer street with less access,
a 40-mph speed may be warranted.
Mr. Anderson moved seconded by Mr. Wingard to recommend to the State Speed Control
Board that the present speed zones be retained on Chambers Street. Motion carried.

Mayor Cone said that the Board's experience generally is that requests from city and county officials
are the result of citizens' complaints. He said if the Board doesn't assist local governments, then
local governments would act under pressure which would result in unrealistic speeds. The Traffic
Engineer also pointed out that should the City undertake the amount of investigation done by the
State in setting the speeds, it would require an increase in personnel and equipment, probably as
much as $30,000 to $40,000 annually.
A vote was taken on the motion to approve, and motion carried unanimously.

b. Coburg from Ferry Street Bridge to north City limits - The existing speed onCoburg
Road is 40 mph from south of the Ferry Street Bridge to the north City limits, and
the State Speed Control Board recommends retaining that limit. The Public Works
Department' recommended a 30-mph zone from south of the Bridge to just north of
Oakway Road, or a 35-mph zone from south of the Bridge to Harlow Road.

c. 2nd from Blair to Garfield - The existing speed limit on this section is 25 mph,
and the Control Board recommended changing it to 35 mph. The Public Works Depart-
ment feels 30-mph limit should be set since the street is similar to Garfield on
which the State Board set a 30-mph limit. Dr. Purdy moved seconded by Mr. Anderson
to recommend a 30-mph speed limit on 2nd from Blair. to Garfield. Motion carried.

such instances to defer the assessment and interest, both to be collectible if
sewer connection is made, or if the State acquires the property, or if plans for

14. Amending Code, Parking Enforcement - A proposed ordinance was presented which would
permit a car which was booted to be towed after 9:00 a.m. on the day following the
day the boot was put on. Under the present ordinance, a car cannot be towed until

amendment. Motion carried.

Juanita Duty, 2091 Roosevelt Boulevard, objected to vacation of the streets on the basis of devalua-

Director explained these vacations were worked out with Oregon Electric Railroad, owner of abutting
properties, over a period of time. An equal volume of property, less about 300 square feet, will
be dedicated by the Railroad Company for public right-of-way.
Ralph Hamilton, Oregon Electric representative, explained that the exchange of land will provide for
realignment of the streets and was originally proposed by the City to better serve the industrial
area.
