Home My WebLink About06/10/1968 Meeting 2;}'f 6/10/68 Council Chamber Eugene, Oregon June 10, 1968 Regular meeting of the Common Council of the city of Eugene, Oregon was called to order at 7:30 p.m, on June 10, 1968 in the Council Chamber by His Honor Mayor Edwin E.Cone with the following councilman present: Mr. Anderson, Mrs. Lauris, Dr. Purdy, Mrs'. Hayward, and Messrs. McDonald,and'Wingard; Council- men McNutt and Lassen were absent. Minutes of the Council meetings held May 13 and May 27, 1968 were approved and mailed to Council members. NEW BUSINESS 1 Learn-To-Swim Fees - Mrs. R. L. Bentsen, 950 West 16th Avenue, presented a petition protesting the $2.50 fee per child for the learn-to-swim classes, and asked the Council to continue the' program of teaching water safety to as many children as possible. She said she felt there were other programs which could be discontinued in order to finance the swimming les'sons, and that some of the petition signers expressed the opinion that, the fee schedule adopted by the Council at its June 3, 1968 meeting was cr~ated as a result of the defeat of the tax bases measure in the recent election. The City Manager explained that the fee schedule had been under discussion for a number of years and was not presented as the result of 'the election, rather because of the larg~ deficit which became apparent this year in the operation of the City's swimming pools. Mr. McDonald moved seconded by Mrs. Lauris to rescind the motion of June 3, 1968 adopt.ing-. the learn-to-swim portion of the swimming fee schedule. \., l! Motion carried. A vote was taken on the original motion as amended, and motion as amended mrried. It was understood the $1.00 charge for out~of-City swimmers would be continued. Committee Meeting, University of Oregon TV Station - Ed Hallock issued an invitation to the Council to hold a committee -of-the-whole meeting at the University's TV station in Villard Hall. It was agreed to accept the invitation. With regard to the bid tabulation of June 7, 1968, the Public Works Department recommended acceptance of the low alternate bids on each project, with the award of contract on the F1intridge 3rd Addition project to the second-low bidder if the City Atrorney rules the low bidder submitted unbalanced bids. Mr. Anderson moved seconded by Mrs. Lauris to award contracts as recommended. With regard to paving Olive and 34th, a representative of Lenord Cowley, owner of property at 124 West 34th, protested inclusion of 34th Avenue in the project on the basis of limited benefit to the property and resulting narrow street with no general access. A letter of protest from Mr. Cowley was presented. Also, a letter of protest from Joseph and Rose Harl, 150 West 34th. The Public Works Director reviewed Council action at the time Olive and 34th petition was presented. He said at this time owners of a little more than 60% of the property to be assessed between McMillan and Olive on 34th are in favor of the paving. Mr. Lew Wright, 3393 Olive Street, restated his position in favor of paving 34th between Olive and MCMillan. On the Crest Drive paving, Willamette to Lincoln, Mr. Clarence Scott, 23 Crest Drive, questioned the desirability of paving since the street, he said, has been paved twice in the past 25 years. The Public Works Director said tests were taken and the street will be constructed to heavier than stand- ard design because of soil conditions. The Director also pointed out that previous surfacing was not paved- to' engineerd standards but was an oil mat done by Lane County. A letter was read from C. H.Strong, 1655 Prospect Drive, objecting to the Birch Lane project. The Public Works Director said a 24-foot street on a 30-foot right-of-way is proposed, with parking re- stricted. COMMITTEE REPORTS Committee meeting held June 6, 1968: "Present: Mayor Cone; Councilmen Anderson, Lauris, Purdy, McNutt, Hayward, 'McDona1d, and Wingard; City Manager and staff; and others. 1 1. Fire Protection Contract, Spencer Creek-Bailey Hill District - The Council was asked for authorization to negotiate a contract with the Spencer Creek-Bailey Hill Fire Protection District whereby the City's equipment would be used to fight fires within the District wxth manpower to be provided by the Bethel volunteers. The City Manager explained that the District requested the City to furnish fire protection based on the same formula used in contracts with other fire districts (6~-mi11 levy this year increasing to an 8-mi11 levy in another two years). He said however it was the general feeling the dollar valuation which the City would realize under that formula would not be sufficient to give the necessary protection, nor would it offset the potential hazard to the City by having personnel and equipment so far removed from the area where City services are needed. The Manager said no contract would be given consideration if the area involved were in a position to be annexed - it is an area roughly the size of the entire City and sparsely settled with no need for other City services. The Fire Chief explained why he would not recommend the normal contract, citing travel distances from various stations and personnel which would be needed. He said any contract with the District would cover only structures, it would not cover timberlands, and negotiations would resolve procedures to cover fires in areas where grass fires might occur. Councilman Wingard said he felt if such a contract is entered into, the people within the District should understand that if the City finds it necessary to terminate the contract, and the District is in a position to be annexed, the District will not construe termination as applying pressure to secure annexation. Dr. Bond, represent- ing the District, said they are pleased with the type of contract outlined, and said the people in the District realize that the protection which can be offered is limited because of travel distances and time involved. Mr. Wingard moved seconded by Mr. McDonald to proceed with negotiation of contract as outlined. Motion carried. Mr. Anderson moved seconded by Mrs. Lauris to approve Item 1 of the Committee report. Kendall Ford Location, Country Club Road - Walter DeMartini requested the Lane County Commissioners for rehearing on Kendall Ford's petition to rezone property lying west of Coburg Road between Country Club Road and Delta Highway to allow location of an automobile dealership. Jess Hill, chairman of the Board of County Commissioners, asked the City to indicate its position with regard to rezoning the property in ques- tion since it lies adjacent to the City limits. The Eugene Planning Commission has reaffirmed its position that the Interim Plan for the Wi11akenzie area, which ex- cludes commercial use for properties on both sides of Country Club Road adjacent to the Chase property, is still valid. Mr. DeMartini said the County Commissioners have expressed approval of the rezoning, but would not act without the City Council's approval because they feel the property will inevitably be annexed. He said he felt the City was denying the rezoning with- out having heard a thorough presentation from Kendall Ford, and asked for a joint meeting of the Council and County Commissioners. He also said he would withdraw the legal action pending against the County in the previous rezoning denial and would .~eed a part of the property for park purposes. The City Attorney expressed the opinion that should the litigation be withdrawn, and if the County Commissioners ask the City for an opinion with the understanding they asked because they would proceed with rezoning, and if a statement of intent was made to annex at some point, then it would be appropriate for the City to participate in consideration of a new rezoning petition. 6/10/68 - 12 ~ "'2:36 . -=' 6/10/68 i: I' " i: 'I II Some discussion took place with Mrs. Niven, Planning Commission chairman, explaining the City Commission's action in recommending denial. Also, the City Manager said an informal meeting had been held between auto dealers, the County, and the City with respect to locating areas which would be acceptable to the auto dealers, but there was very little progress. No action was taken. It was understood the item could be con- sidered at a joint meeting of the City Planning Commission and Council in the near future. . Amazon Parkway Access, Rubenstein - The Planning Commission re.quested a meeting with the Councilto discuss the request for access from the Amazon Parkway to property be- tween Pearl and Willamette south of 24th Avenue. The Planning Commission opposes granting the access; the Council has indicated it would favor the overall plan pre- sented by the architects and planners for the project. Wallace Swanson, Council member at the time the Amazon Parkway was created, reminded the Council of the difficulty encountered in accomplishing the limited access road and stressed the need for retaining limited access. Mrs. Niven also objected to granting access from the street on the basis of safety hazards. She also cited the definition of limited access given by Howard Buford, Central Lane Planning Council planning di- rector, as limited for public access, if private access is given then standards would be difficult to set. The City Manager said if it is decided to grant access, it would be under contractual arrangement so that should traffic increase to the point where access becomes undesirable, the access couid be removed. ,:>.' . . . . i ~ Otto Poticha, architect, again explained the proposed development and the reasons for their requesting access from the Parkway. The Public Works Director said other than traffic problems had been taken into consideration in designing the access, engineer- ing shows it is technically possibl~, and the reason no recommendation is made from his Department is because whether access is granted is a policy decision to be made by the Council. Bob Scott, 3780 West 11th, said the stub for sewer connection was installed at the opposite end of the property from where the line runs from the house. The Public Works Director explained the procedure followed in locating stubs. He said either the property owner had asked for it at the location, or there had been no response from the property owner and the engineers had located it at the most likely place. Fred Schulke, 2891 West 11th, objected to the assessment against his property for the West 11th proj- ect. He said his building was already connected to a sewer on 10th Place and it was his understanding the assessment for that sewer was included in the price of his property. The Public Works Director explained that the Schulke property is 397 feet deept and is therefore assessed to a depth of 160 feet from each sewer line. Al Masengil, 2940 West 11th (Aerolite Neon), said West 11th was a good paved street prior to this widening project but that the assessment amounted to as much as it would be for a new street. He called attention to a manhole cover in the center of his driveway where he said there is no manhole, and said that there is considerable flooding during rainy periods. The Public Works Director said the actual cost of the project is less than estimated when the contract was awarded, and that the flooding condition would be investigated. Mrs. Louise Nickels, 2111 West 11th, said she felt the cost of street improvement should be borne by the general public since it is an arterial street. Mr. Blackstone, Emerald Auto Service at 2889 West 11th, objected to the amount of assessment and said his driveway was not restored to its original condition. He questioned the use of funds derived from the water/sewer user charge. The City Manager explained the formula used in assessment for street improvements in commercial, industrial, and residential zones. He also pointed out that replacing driveways would increase individual assessments in the overall project, whereas not every property would have driveway replacement. Also, he explained the use of funds derived from the water/sewer user charge. Janice White, owner of property at the intersection of Buck Street and 11th Avenue, said her property was assessed in error. The Public Works Director said this intersection is offset, that the City paid half of the Buck Street intersection and half the Seneca Road intersection, so that the frontage in Mrs. White's ownership on 11th is properly assessed. They feel the policy of assessing properties 'in new subdivisions for storm'sewers up to 24" is discriminatory since properties in other areas of the City are not subject to storm sewer assessments. Mr. Camarot asked that this council bill be held over so that additional information could be gathered on the City's policy with regard to storm sewer assessment. The City Manager said the Council adopted the policy that storm sewers up to 24" in new subdivisions would be paid for by the subdivider and property owner after many discussions between the Council, members of the Homebuilders Association, P:'anning Cormnissiori, and others. He said that this par- ticular project was petitioned by the subdivider with the knowledge that the cost of storm sewers would be assessed, and that the ordinance authorizing the project included storm sewers and was passed at a public hearing with no protest from the subdivider. He further stated that if the City is challenged on this policy, it may be that assessment for future projects will have to be made be- fore the work is done arid the City I S funds used. .
