Cone with the following councilmen present: Mr. Anderson, Mrs. Lauris, Messrs. McNutt and Lassen, Mrs. Hayward, and Messrs. McDonald'and Wingard. Councilman Purdy was absent. I' Minutes of the apecial meeting held June 3, 1968 and of the regular meeting held June 10, 1968, I as mailed to Council members, were approved. :i , NEW BUSINESS :' ,I 1 I Proclamation - Canvassing votes cast in the May 28, 1968 election was read showing the " following results: ~' I' Measure No. 51 - Charter Amendment Allowing Annexation Removing Health Hazards Yes - 17,045 No - 6,607 " Measure No. 52 - Charter Amendment Authorizing I, .New Tax Base ~es - 10,755 No - 12,289 . ,: Proclamation - Canvassing votes cast in the June 18, 1968 election was read showing the S following results: I. ,. Measure No. 51 - Authorizing $587 ,281 Tax Levy Outside Limitation Yes - 3,045 No - 3,568 I I: I' Mr. Anderson moved seconded by Mr. Lassen to ~ccept the proclamations. Motion carried. 2 !: 1968-69 Budget - The City Manager recommended inclusion in the 1968-61R1 budget of several capital improvement items ($108,618) and sewer utility capital project ($35,000) , to- gether with cash carryover to fund them. These items were included in the 1967-68 budget ! but not completed. Authority was also requested to increase the sewer utility capital projects budget by $34,800 to provide funds for extending sewers to Bethel-Danebo areas ~ not yet serviced. The Manager recommended adoption of the 1968-69 budget, including the recommended changes, with the understanding no figures would be certified to the County Assessor until the revenues 'problem is resolved. Adoption at this meeting will give '. legal authority for the City to pay for operations after July 1, 1968. Mr. Anderson moved seconded by Mr. Lassen to approve the recommended additions in the 1968-69 budget ($108,618 capital improvements and $69,800 sewer utilities). Rollcall vote. All councilmen present voting aye, motion carried. City Manager and staff; and others. 1 This,:co1i1.rnittee meeting was held at the University of Oregon TV studio in Villard Hall so that it could be filmed for broadcast over their Station PL-3, Cable 10. 1 COUll ty- Sales/Income Tax Study - Councilwoman Hayward asked about 1. the progress of this -. study. The City Manager said the Lane County Commissioners asked the chief adminis- '~ . trative officers of the County, Springfield, and Eugene to meet to explore procedures ,- before action is taken to begin a County-wide sales or income tax study. These people " have met with a consultant from the Bureau of Governmental Research who is gathering " information regarding taxes on a loca I level from which a study can be launched. A report is expected soon. ;1 2 2. Council Agenda - Councilman McDonald asked if the Council's regular meeting agenda could be arranged so that assessment ordinances could be considered earlier in the meeting. He said he felt people appearing to protest assessments should not have to sit through three or four hours of other Council business before being heard. Councilman Anderson said he felt there should be professional assistance from the Public Works Department at Council meetings to explain the applicant's request, and ,. ': Mayor Cone suggested that some staff members should be available in the Public Works :. office when the Council convenes so questions could be answered, then if they still I I, wish to be heard by the Council they would have the opportunity. It was understood . ., an attempt would be made to formulate a time-saving method of hearing assessment , protests. 3 3. EWEB Bond Prospectus - Copies of a Eugene Water & Electric Board bond prospectus cover- ing $2 million water and $6 million electric utility system revenue bonds were dis- tributed to Council members. The City Manager said the EWEB staff feels a meeting between the Board and Council members would be desirable to discuss a number of items. ll' ~ ~ 6/24/68 - 13 2 5 5 --, . 6/24/68 -~._---'-~_._- --..------ ~-- -- -- ---_.._.~ ------ ---- I He asked the Council to give any suggestions they may have to his office regarding items they may wish to have on the agenda for such a meeting. Mrs. Lauris said one item would be to ask how the Water Board is able to give people money for install- ing new electrical appliances. Councilman Purdy asked if City Bancroft bonds could be sold when EWEB bonds are sold. The City Attorney said they could be sold at the same time but must be as separate issues since the two agencies are completely separate entities. No action was taken. Mr. Anderson moved seconded by Mr. Lassen that Items 1, 2, and 3 of the Committee report be received and filed. Motion carried. 1 4. Vacation portions Arthur, Cooper, Cross, and Cleveland - This item was tabled at the May 27 Council meeting so the Council could tour the area before taking action. The Manager said existing dedicated street rights-of-way have been developed with private construction, whereas streets actually in use are not on rights-of-way as shownby legal description. This vacation and dedication will permit realignment of dedicated I' streets as they now exist on the ground and carryon to the west to connect to Roose- velt Boulevard. The Planning Commission and Public Works Department recommended ap- prova 1. Dr. Purdy moved seconded by Mrs. Hayward to approve the vacation. Motion carried. Mr. Anderson moved seconded by Mr. Lassen to approve Item 4 of the Committee report. I Juanita Duty, 2091 Roosevelt Boulevard, objected to the proposed vacation. She said she felt the land was too valuable to take out of public ownership and that the present street system will be needed when Highway 126 is completed. It was explained that the vacation and subsequent dedication of an area equal to that vacated will allow realignment of streets to better serve the industrial area, and that each individual ownership will have access to a public street. A vote was taken on the motion to approve, and motion carried. 2 5. Abatement, 2738 Charnelton and 178=180 West 27th - A memo from the Superintendent of Building Inspection was read reporting on the condition of these properties. Mr. A.H. Petersen, owner, has been sent abatement notices but has chosen to sell the property as it is and let someone else repair the buildings. The Superintendent recommended that the Council set a hearing date and proceed with abatement. Councilman McDonald asked if the buildings could be rehabilitated, and the Superintendent replied they could although there is a question whether it would be economically feasible. The I property has been vacated and, as a result, subject to considerable vandalism. Mr. Anderson moved seconded by Dr. Purdy to set a date for a public hearing to con- sider abatement proceedings against both properties. Motion carried. 3 6. Abatement , 955 East 43rd - A report was read from the Superintendent of Building In- spection reviewing the history of Council action and subsequent Court action with re- gard to a house moved to this address by Harvey Schaffer and Elmer Sahlstrom. No work has been done on the building since February 23, 1968 and the l20-day time period specified by Code for completion of a building moved from another location has expired. , Abatement was recommended. Several questions were asked by Council members regarding street dedication, minor subdivision, and present legal action. Henry Baitis, owner of adjacent property, said the court action is invalid because the time has expired for completion of the building, a street dedication will not be signed, and, further, that the barricade of a one-foot freeze strip given to the City onEast 43rd has been removed, according to the owner, by order of the City. He said no new houses have been constructed in the neighborhood nor can the lots be sold. Dr. Purdy moved seconded by Mr s . Lauris to proceed with abatement. Motion carried. #I Mr. Anderson moved seconded by Mr. Lassen to approve Items 5 and 6 of the Committee report. Henry Baitis reviewed past action of the Council with regard to the house moved to 955 East 43rd and urged the Council to proceed with abatement. The City Manager said he had discussed this abatement with Elmer Sahlstrom, owner of the house, and Mr. Sahlstrom said the house was substantially com- pleted except for outside work when someone gained entrance and damaged the interior. The Manager said there is no reason not to proceed, since Mr. Sahlstrom was advised the item would be before the Council at this meeting for the purpose of setting a public hearing date. A vote was taken on the motion to approve, and motion carried. 4 7. Prairie Road, County Transfer of Jurisdiction - The Lane County Commissioners have issued an order surrendering jurisdiction of a portion of Prairie Road to the City. . The City Manager said this is one step in attempting to remove the dangerous acute- angle intersection at Prairie Road and Highway 99. It is proposed to vacate a portion .- of Prairie Road and extend Maxwell Road to Highway 99 with a right-angle intersection. The Public Works Director explained that the Public Utility Commissioner has requested the County to build an above-grade railroad crossing in this area, and if it is on Prairie Road this responsibility will be assumed by the City if it accepts jurisdiction of Prairie Road. He said,however, it was his understanding the overpass is to be lo- cated on the Belt Line-Highway 99 complex. The City Manager suggested that more in- formation be obtained before taking action. 5 8. Storm Sewer Policy - The City Manager read excerpts from minutes for Council meetings , held May 9 and May 23, 1966 wherein action was taken to adopt policy for assessing the cost of storm sewers up to 24" in diameter in new subdivisions. I' ,I II I' II Prairie Road and Highway 99 - A letter was read from Forrest Cooper, " 1 Ii 9. Traffic Signals, ;1 II State highway engineer, addressed to Mr. Vernon L. Hagedorn in response to his inquiry II regarding the need for traffic signals at this intersection. Mr. Cooper explained il that this intersection does have a poor accident record, but that it still is not near 'I the top of' the priority listing. Special Election, June 18,1968, Levy Outside 6% Limitation - The City Manager . pointed out on a map the results by precincts of the June 18 tax levy election com- pared to the results of the May 38 tax base election. Unofficial count shows the levy outside the 6% limitation failed - 3,568 voting no; 3,045 voting yes. The Manager mentioned three alternatives (1) balance the budget within the 6% limita- tion; (2) cut the budget with the idea of resubmitting the issue to the voters as a special one-year levy; or (3) resubmit the measure in its present form. He said the budget was cut by some $1,600,000 at the staff level before it was submitted to the Budget Committee with a few items added back by the Budget Committee. Discussion revealed that this election cost about $4,000 and that, if it is decided to ,take the issue to the voters again, there will be about six weeks in which to develop a measure, with August 1 being the latest date on which figures can be certified to the County Assessor. Mrs. Hayward called attention to the results in those precincts where a campaign was conducted in the June 18 election, and said she felt if another election is held there definitely should be a campaign to inform the voters. . Mr. McDonald moved seconded by Mr. Lassen to refer the budget back to the Budget Com- mittee before deciding whether to resubmit an amended measure to the voters or re- submit the present one. Motion carried. A meeting was scheduled for Wednesday, June 26, 1968, at 7:30 p.m. in the McNutt Room. . Councilwoman Lauris suggested earmarking items, showing itemized costs of various services. Councilman Purdy said he would rather see services cut which are not . essential, such as some parks services instead of street lights, etc. The City Manager said there are many areas in particular departments which cannot be con- sidered without determining how they would affect the overall operation of the City. He said he feels the community wants to meet demands of its growth and that accept- ance of the decision of the small percentage of voters opposing this levy would seriously cripple programs this year plus increasing needs and compounding problems in future years. Councilman Anderson remarked that a policy should be set with re- gard to areas to be considered, i.e., whether to eliminate additions to personnel, delete certain public works projects, etc. , rather than going over the budget item by item. Ray Hawk, former councilman, said he felt the Manager should have the opportunity to make recommendations and that it would be an abrogation of managerial functions to establish priorities for cuts. Frank Jackson of the Fire Fighters It Association suggested that. the Council hold public meetings, with the Council as a group explaining the issue to the people rather than on an individual basis. Bids, Echo Hollow Pool, Opened June 19, 1968 - Copies of the bid tabulation were distributed to Council members showing the low bid submitted by Howard Nelson about $116,000 more than the architect's estimate. The City Manager said he would like to review the bids again before making a recommendation. Jon Berry, architect, said the bids would be reviewed with the idea of making several changes and bringing back a recommendation. No action was taken. . 3 4. Bids, Public Works Department, Opened June 18, 1968 - Copies of bid tabulation cover- ing paving and sewer projects were distributed to Council members. The Pub lic Works Department recommended award of contract to the low bidder on the basic bid for paving and sewer on Minda Drive and Long Island Drive, and for sanitary sewer in area bounded by Valley West, Bailey Hill, 18th, Churchill Highlands; and on the low alternate bid for paving and sewers in Olsen-Weiseth Plat, Pine Ridge 1st Addition, and Quaker Park Addition. . Mr. Wingard moved seconded by Mr. McDonald to approve the recommendation. The Public Works Director said the cost to the City will be about $2,000 for the street extension to Hillside Drive on the Pine Ridge project. Councilman Lassen asked if the storm sewer in the Quaker Park project would be assessed. He said he did not completely agree with the policy of assessing for storm sewers in new sub- divisions only. The Public Works Director explained that all property owners are being asked to sign contracts prior to start of construction agreeing that they will pay for any storm sewers involved in new subdivisions. Mrs. Hayward asked if the City is committed to going ahead with these projects, and the Manager replied that the money to pay for them does not come out of the general . operating funds. Parking Meters, University of Oregon - The City Manager displayed a map showing pro- posed location of parking meters in the University area. He said the University has agreed to deletion of meters in the residential area west of the campus, but still wants short-term meters along Kincaid near the Library and Prince Lucien Campbell Hall. No acticn was taken. It was understood further information and sketches on street dedication in relation to density would be brought to the' June 24 Council meeting. Referring to the Turnkey Program under Item 1 above, she said the Joint Housing Committee felt the private sector should have an opportunity to meet the recommended housing needs, and if the private sector has not acted by the Council's October 14 meeting, then the Council could authorize participa- tion in the Turnkey Program. Councilman Wingard said he was agreeable to his letter from Mr.Alford with regard to the Turnkey Program being placed on file until October 14, 1968 (see action Item 1 above) . Joint Meeting with EWEB - Scheduled for Monday, July 1, 1968, 7:30 p.m. at the Thunderbird to discuss a number of subjects important to the City. 3 10. Sanitary Sewer Service, Bethel-Danebo - A report was read from the Public Works Department concerning areas serviced with sewers in the Bethel-Danebo area, and stating the more critical of two areas not having sanitary sewers is between Ohio and Minnesota Streets from Barger Drive north about one-half mile. The City Manager said EWEB is reluctant to install water mains in the area until the City installs sewer systems, because of the'resulting $2.00 per month water/sewer user billing made for the City, and until they can anticipate enough connections to justify the invest- ment. He suggested the area be canvassed or a public meeting held to determine whether residents involved are in favor of sewer installation. . Councilwoman Lauris suggested that this may be the area in which to start changing the policy of assessing for all sewers, that investigation might be made of obtaining Federal funds on the basis of its being a public health factor, Or, she suggested, perhaps the City could change the formula to provide for a flat minimum assessment to each living unit. Some Council members felt the 1geal implications and resulting in- . equities in assessment would be too great, and the Manager pointed out that the pur- pose of the Bancroft law was to lessen the burden of public improvement assessments. . No action was taken, but it was understood exploration would be made of a method to contact residents in the "state street" area to determine their feelings with regard to sewer construction, either by door-to-door interviewing, a written poll, or a public meeting. 4 11. Sign Ordinance - Copies of a letter were distributed to Council members from Luvaas, Cobb, Richards, and Fraser, representing Lew Williams Chevrolet Co., setting forth their objections to the proposed sign ordinance now under consideration by the Plan- ning Commission.
