The regular meeting of the Common Council of the city of Eugene, Oregon was called to order at
7:30 p.m. on July 8, 1968 inthe Council Chamber by His Honor Mayor Edwin E. Cone with the following
councilmen Present: Mr. Anderson, Mrs. Lauris, Messrs. Purdy, McNutt, and Lassen, Mrs. Hayward, and
Messrs. McDonald and Wingard.
The Minutes of the meeting held June 24, 1968, as mailed to Council members, were approved.
NEW BUSINESS
1 Broken Glass on Streets - Councilman Anderson suggested arrangement be made with towing companies to
remove broken glass from streets after auto accidents. The Manager said the matter will be checked
with the Police Chief.
i 2 Industrial Plant, 10th and Seneca - Councilman Wingard asked that the Air Pollution Authority be re-
quested to determine the source of the odor and whether it is dangerous for residents near the in-
dustrial plant at 10th and Seneca. Councilman Lassen, member of the Regional Authority, said it would
be considered at the Authority's meeting on July 10.
3 Traffic, Roosevelt and Highway 99 - Councilman Lassen requested investigation to determine whether
. traffic could be channeled into right-turn, through, and left-turn lanes for cars entering Highway 99
from the west on Roosevelt Boulevard. Also, whether better movement can be provided for cars entering
. the shopping center west of the highway off Roosevelt Boulevard. It was understood the situation
would be investigated.
4 Sewer Connections, Bethe1-Danebo - Councilman Lassen asked about the progress of the poll on sewer
connections in the Bethe1-Danebo area. The City Manager said the poll would be started next week.
5 City Bus System - Councilman McNutt inquired about the status of the City bus system. The City Manager
said Eugene, with Springfield and Lane County, has applied through the Central Lane Planning Council
for funds to finance a transportation study for the metropolitan area. The study will be undertaken
by Voorhees & Co., transportation consultants, to determine how mass transportation in this area should
be financed, by whom, equipment necessary, routes, etc. Local matching funds are available and ap-
proval of the grant is expected shortly, after which decisions can be made concerning the local bus
, system.
6 Assessment Hearings - The City Manager explained that in an attempt to save time on assessment hear-
ings staff people were available in the Public Works Department to answer questions with regard to
calculation of assessments, then if there were some who still wished to be heard by the Council, they
would have the opportunity at the time assessment ordinances were considered. He said the staff could
also answer questions with regard to bids which were scheduled for hearing.

. 1 Echo Hollow Pool - A l~tter was read from Jon Berry, architect for the pool, listing recommendations
for changes in pool design and construction to bring the cost within the budgeted limit of $609,000.
The City Manager and Parks and Recreation Director recommended redesign of the pool and call for new
bids, which will delay the project about nine weeks. It was explained the cust proposed are non-
essential so far as operation of the pool is concerned, that some of the items could be added in the
future from general operating budget and some of the work could'be done by City crews.
Councilman Purdy said he feels the redesign should be for a 25-meter pool as originally planned for
$470,000, that now is not the time for a 50-meter pool, and that when a larger pool is constructed it
should be more centrally located.
Councilwoman Hayward asked if the contemplated changes will affect use of the pool for competitive
. meets. The Parks Director said that the change in depth from 15 feet to 11~feet would not sacrifice
the original concept, but that there would be considerable savings so far as site excavation,
Chlorination, heating, circulation, etc. The Manager pointed out that the shallower pool will give
more room for recreation and teaching.
Mr. Wingard moved seconded by Mr. Lassen to rebid as recommended, holding the cost to the budgeted
$609,000. Motion carried unanimously.

The Public Works Director explained that the cost to the City onthe 1st Avenue paving and sewers
. was not budgeted since the project was extended by petition of property owners.
With regard to the storm sewer in Bar M 6th Addition, the Director said the'recommended
alternate was for two side-by-side culverts rather than one large, and that the project was
proposed under agreement whereby the City would participate up to 28.3% of the cost or not
to exceed $10,000. The project was rebid from last year to give the developer an oppor-
tunity to bid, and the Public Works Department now recommends acceptance of the low bid of
Bostick so the project will not have to be rebid again.
The Public Works Department recommended award of contracts on the July 2 opening to the low
alternate bidder on Items 1, 3, and 6 - Item 1 award being contingent upon completion of
contract whereby the subdivider agrees to pay for cost of storm sewer, and upon approve1 of
plat - Item 6 award being contingent upon acceptance in writing by petitioners; to the low
basic bidder on Items 2, 4, 5, and 7 - Item 2 award being contingent upon approval of the
plat; and on the July 5 opening to the low alternate bidder on Item 1 and to the low basic
bidder en Item 2.
. Mr. Anderson moved seconded by Mr. Lassen that the contracts be awarded as recommended.
Henry Camarot, attorney, said his client objects, with regard to paving and sewers in Foot-
hills West 2nd Addition, to possibility of assessment against eight lots lying between
Chambers and Fillmore for improvement of the two streets. He asked that the contract be
. awarded, but that the required assessment against the eight lots fronting on Chambers be
excluded as a condition of approval of the plat now before the Planning Commission, since
. those lots will not have access to Chambers. The City Manager explained that Chambers
Street is already under construction and those lots subject to assessment. He said it was
understood when the job was initiated that that property would be assessed. The City
Attorney explained that the Council has no jurisdiction with regard to approval of plats -
that decision rests with the Planning Commission - but he did say there may be a problem
with regard to whether the property will be benefitted if there is no access to Chambers.
Mr. Camarot then asked that the Council award the contract subject to the Planning Commis-
sion's excluding, as a condition of plat approval, the assessment for Chambers Street.
The Public Works Director remarked that bids should not be prepared unless plats are
actually filed by January 15, but this has been done as an accommodation to the subdividers
. because of the time element in accomplishing the improvements during the current construc-
tion season.
Noble Chowning, the subdivider, protested the assessment for both streets. He said they
would rather have had a frontage road and now are subject to an agreement which will fore-
go any later protest. The Manager said agreements are now being used prior to construc-
tion because of challenges on assessments when it was thought it was understood the sub-
divider would pay.
Mayor Cone left the meeting. Council President Anderson presided.
A rollcall vote was taken on the motion as stated, and motion carried unanimously, Mr.Lassen
abstaining on contract award on alley paving between Olive and McMillan, 26th to 27th.

1 Special Election, July 30, 1968 - The City Manager recommended calling a special election on July 30
to submit a $330,000 tax levy outside the 6% limitation for the 1968-68 budget. He said Pierre
VanRysse1berghe has accepted appointment as campaign co-ordinator and chairman, and that Ralph Cobb
will work with him. Mr. VanRysse1berghe will be present at the July 11 committee meeting when Council
members may have suggestions and work with him in development of a campaign program.
. Mr. Lassen moved seconded by Mrs. Lauris to call a special election on July 30. Motion carried.
2 Planning Commission Report - June 24, 1968
Amazon Parkway Access, Rubenstein Property - The Planning Commission at a joint meeting with the
Council reaffirmed its previous recommendation that the limited access character of the Amazon Parkway
be maintained, with no additional ingresses or egresses.
Mr. Lassen moved seconded by Mrs. Lauris to concur in the Planning Commission recommendation.
Otto Poticha reviewed previous action and recommendations of planning and traffic staffs, and said
the only issue appeared to be one of precedent. Councilman McNutt expressed the opinion that it would
be reasonable to grant egress only if on a revocable basis with no penalty to the City, under con-
. tractua1 arrangement, should the egress be revoked.
Discussion followed with regard to traffic patterns in the area and whether previous action took into
. consideration the revocable basis. Minutes were read of action taken at the May 27 Council meeting.
Mayor Cone returned to the meeting and presided.
Mr. Lassen said he would withdraw his motion to deny the access if it was granted on a revocable basis.
Mr. McNutt moved seconded by Mr. McDonald to grant egress only from the Amazon Parkway to the Ruben-
stein property on a revocable basis with no penalty accruing to the City should the permit be revoked.

Ii Councilman Purdy said he received a ruling from the City Attorney. that there is no conflict .of in-
I; terest with regard' to his (Purdy's) voting on this item. Mr. Rubenstein raised the question, .
, Dr. Purdy said, beca4se a renter in a building in which Dr. Purdy has a part interest might move to'
the building proposed by Mr. Rubenstein. Dr. Purdy said h~ voted against granting the egress because
it had been difficult to accomplish the Charter amendment permitting limited access road$, that
limited access roads should be retained as such, and that he felt it was in the pest ineeFests of the
City.
A letter from the Eugene-Springfield Area'Transportation Study Advisory Committee was read urging re-
tention of Amazon Parkway as a limited access street, and recommending denial of the off~~amp. Mrs.
Robert Moulton member of the Committee, urged denial of the request and said the Committee felt the
I' precedent set if this egress is granted would result in the Committee's having to fight the'same
i! bstt1e again and again in the future.
Councilman Anderson asked if it is feasible to plan the development. to provide for acce~s from the
Parkway at some future time if it is found enough traffic is generated to warrant it. Mr. Poticha
said he" believed it could be so constructed although difficult. He also said if the egress is not
granted, he dpesn't believe his client should be requested to const~uct access from the Par~ay ,should .,~
the traffic problems arise because of the development. ' ,
Councilman Lassen asked if the motion included payment by the. developer of costs involved or any
obligation on the part of the City to refund 'the difference in cost should the access be closed. He
mentioned the difference in cost of right-1f-way from those properties where access was denied.
Mr. Wingard moved seconde~ by Mr. Lassen to amend the motion to include that all costs involved in 411f~
construction of the egress shall be paid by the property owner.as well as cost of land originally ,~
taken for right-of-way; cost of improvement of the Parkway which would have been assessed had access ,-,--'

for Mayor and Councilmen will be Friday, August 23, 1968, 5':00 p.m. - He said 25 signatures of qualified.

4 Jury Trials for Indigent Persons - The City Attorney recommended that the Gity consider removing from
1 the Charter the provision of trial by jury for municipal court offenses, and asking the Legislature to
remove the same provision from State law. The Bureau of Governmental Research concurs. A letter from
Councilwoman Lauris 'was presented suggesting the American Civil ,Libe.rties Union be given the' oppor,-'
,tunity to express their views, and Dr. Purdy suggested inviting members of the Lane County Bar Associa-
tion. It was understood the item would be scheduled for a committee meeting.

1 Oregon Electric Franchise, 5th east of Almaden - An extension of the existing franchise was requested
. for one year, and the staff had no objection.
Mr. Anderson moved seconded by Mr. Lassen to grant the extension.
Councilman Wingard remarked about the lack of co-operation on the part of Oregon Electric in matters
of concern to the City. Difficulties in resolving problems on crossings at Prairie Road and at
Roosevelt Boulevard as well as cost of crossings on Garfield were mentioned.
A rollcall vote was taken on the motion to approve, and motion carried,. Dr. Purdy voting no.
2 Speed Zones - Chambers, 2nd, Coburg - Resolutions from the State Speed Control Board were presented
setting speeds at 30 mph on 2nd Avenue from Blair to Garfield, and at 40 mph on Coburg Road from the
Bridge to the City limits. The Board agreed to retain the present speeds on Chambers Street south of
24th as requested by the City. The resolutions were received for filing.
3 Fire Protection Contract, Spencer Creek-Bailey Hill - A proposed contract was presented with Spencer
. Creek-Bailey Hill Rural Fire Protection District covering terms for providing fire protection for the
District. The District will pay on the basis of a 6-mi11 levy, increasing to 8 mills in the next two
years, for protection of buildings only, using City fire equipment and Bethel manpower. The agreement
does not cover forests, brush, or fields.
Mr. Anderson moved seconded by Mr. Lassen to approve the contract. Rollcall vote. All councilmen
- present voting aye, motion carried.
.. 4 Sale of Property, 1-105, EWEB - The Eugene Water & Electric Board requested authorization to exchange
with the State certain properties along 1-105 for transmission lines through the Belt Line interchange.

present voting aye, motion carried.
5 Liquor Licenses
Millers Grocery, 1065 East 20th - Package Store Class A, submitted by Selma and George Scott. The
Police Department gave no recommendation other than the information that the locat~on is within the
University "dry zone."
Hillside Tavern, 368 East 40th - Retail Malt Beverage Class A, submitted by Harvey C. and Lois Field,
. as approved by the Police Department.
Mr. Anderson moved seconded by Mr. McNutt to recommend approval of the licenses.
Some discussion followed with regard to the "dry zonell ar<;mnd the University - how it was established
and the general area covered. Councilman Anderson said the Council is passing on applicants only as
citizens of the community, that the matter of approving or denying a license for a location in the
"dry zonell is a matter to be resolved between the University and the Oregon Liquor Control Commission.
Councilman Purdy commented that since both applications were for new licenses - one in the "dry zone,"
the other in a new area - he thought people in the neighborhoods should have an opportunity to be
heard. He moved seconded by Mr. Lassen to table the applications until the July 22 meeting.
- Mrs. Field urged the Council to act on the application for the Hillside Tavern. She said their present
license for The Ship at 746 West Park where their lease has expired is being held until they find a
new location.
A vote was taken on the motion to table, and motion carried - Messrs. Purdy, Lassen, McDonald, Wingard,
and Mayor Cone voting aye; Mr. Anderson, Mrs. Lauris, Mr. McNutt, and Mrs. Hayward voting no.
.. Further discussion on voting separately on the applications resulted in a motion by Mr. Anderson
seconded by Mr. McNutt to remove from the table the Hillside Tavern application. Motion defeated,
Messrs. Purdy, Lassen, and McDonald voting no. (Two-thirds required.)
6 Parking Prohibition, Hayes from 18th to 22nd - A report from the Public Works Department gave the re-
sults of a poll taken on Hayes Street with regard to prohibiting parking to ease traffic movement be-
tween 18th and 22nd. There were 6% favoring removal of parking from the east side, 4% from the west
side, 75% favoring leaving parking on both sides, 15% no return. No action was taken.
7 Capital Drive Design - The Public Works Director reviewed design plans for Capital Drive and said if
the Council desires to expedite so that construction can be accomplished this summer, the bid award
and public hearing can be scheduled for the same meeting, although it will be late for this season's
. work. Proposed is a meandering 20-foot paving and 3-foot sidewalk on a 40-foot right-of-way which ex-
cludes parking. Slope problems forego location of the paving on the right-of-way centerline.
. Mr. Anderson moved seconded by Mr. Lassen to proceed with the proposed design, prepare plans and
specifications, and call for bids and public hearing. Motion carried.

I' ment of the cost of the stub ($139.02) until it is put into service.
:' Councilman Anderson said he had inquiries about proper restoration of the area, and the Public Works
Director explained the schedule for inspection and completion by the contractor. Several residents
of the area protested the extra cost to them for reseeding parking strips where the sewer was con-
!: structed behind the curb.' The Public Works Director said this cost was not included in the contract,
and that the sewer was constructed behind the curb in those area~ where a majority of the residents
I requested it at that location.

A letter was read from Marvin Hendrickson requesting deferment of assessment against property at
2494 ,Roosevelt Boulevard on the basis he'requested' the'stub run to Fech Street side where a sewer has
not been installed. It was explained that Mr. Hendrickson requested the stub on the Foch Street s~de
and that the Roosevelt Boulevard line was available and of benefit to the property.

Mrs. Earl Neer, 990 East 23rd Avenue, objected to assessment against Tract 14,Fox Hollow No.4. She
i said they were not notified of the street and sewer construction, were not aware the street touched ,II
their property, and sold the property assuring ~he buyer there were no liens against it.
The Public Works Director explained that the proper legal advertising was carried out but that,the
project was:'started prior to ad<?Ption of the policy of sending notices to individual property owners on
