July 22, 1968
Adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned from the meeting
held July 15, 1968 - was called to order at 7:30 p.m. on July 22, 1968 in the Council Chamber by
His Honor Mayor Edwin E. Cone with the following councilmen present: Mr. Anderson, Mrs. Lauris,
Messrs. Purdy, McNutt, and Lassen, Mrs. Hayward, and Messrs. McDonald and Wingard.
Minutes of the Council meeting held July 8, 1968, as mailed to Council members, were approved.
NEW BUSINESS
1 Workable Program - Councilman Lassen asked about the status of recertification of Eugene's
Workable Program. The City Manager said the City was unofficially informed recertification
was approved at the regional level and that the Program is now in Washington for review and
official approval which is expected any time.
.
2 Sight Clearances - Councilman Lassen asked the staff to check the fence location at the
corner bf 12th and Garfield, and p1antings at the southwest corner of 27th and Lincoln
for possib!le violation of sight clearance.
3 Bills for the period July 9 through July 22, 1968 were submitted and read:

steel sewer pipe or a new plastic lined pipe instead of concrete. The Public Works
Director said contractors now have the option of bidding onsteel pipe for storm sewers
only, but that bids are never submitted on that basis. It was understood a report
would be submitted on comparative costs of the different types of pipe available.

recommended not to proceed with the project until the right-o~-way is cleared and
Ii both sides can be assessed. Mr. McNutt moved seconded by Dr. Purdy to reject the
petition. Motion carried.
4 3. Paving Broadview, Hawkins Heights to Sunrise - Petitioned by owners. of 100% of. abut-
ting properties. It was explained that it is too late to prepare this project for
construction this year, and recommended that the petition be held and included with
next year's projects. Mr. Lassen moved seconded by Dr. Purdy to approve the peti-
tion and hold theproject for construction in 1969. Motion carried. .

5 :, 4. Minda Drive Right-of-way - Louis M. Meyer, owner of property on Minda Drive just west

" of Elsena Drive, refuses to dedicate right-of-way for this project on which the con-
tract award was held pending acquisition of right-of-way. The Public Works Director
!: explained that the Department is reluctant to buy property for residential streets
" adjacent to land where the City will eventually acquire the right-of-way through plat-
ting. The project includes improvement of Long Island Drive and will serve as a con-
" nector between Norkenzie and Gilham. A sewer easement is also required through the
! property. Mr. Anderson moved seconded by Mrs. Hayward to negotiate for the sewer .
" easement through the property in question, and pave all but the property involved.
Motion carried.
The Public Works Department reported that the sewer easement was obtained, but it is now recommended
to install the sewer and pave only that half of the street on which the right~of-way has been dedicated.

6 ' 5. Oversize Curb Cut, 1895 McLean Boulevard - Raymond Rexius requested a 50-foot curb cut
at this address to allow proper use of the existipg driveway. The Public Works Depart-
ment recommended approval because of the contour of the land and driveway construction.
Dr. Purdy moved seconded by Mr. McNutt to approve the oversize curb cut. Motion carried.

7 6. Bids, Skinners Butte Park Plant Materials, Opened July 8, 1968 - The Parks and Recreation
Director reported only one bid was received, which was $4,290.00 from Lane County Nursery. t

Half of the project is to be financed by Land and Water Conservation funds. Dr. Purdy

1 7. Waivers for Signs in Special Setbacks - As a matter of Council policy, for some
. time waivers have been issued administratively through the BuildingDepartment per-
mitting signs in special setbacks on streets designated in the zoning ordinance
for possible future widening. These waivers were granted with the understanding
the signs would be removed when requested by the City. The new zoning ordinance
includes some special setback streets, and the Planning Commission has asked that
the practice of granting waivers be discontinued in order to protect the setbacks
not included in thenew zoning ordinance. The moratorium, declared until adoption
of the new sign ordinance, prohibits signs which are not in compliance with the
new ordinance. The sign industry requests that the "permit by waiver" continue.
Mrs. Lauris moved seconded by Mr. Lassen to rescind the staff authority to grant
sign waivers in special setbacks. Motion carried.
2 8. Baggage Service, Southern Pacific - The Public Utilities Commissioner notified
interested pa rties of Southern Pacific's proposal to discontinue handling Oregon
intrastate baggage, other than hand, in passenger train service. Interstate handl-
ing between Oregon and California was discontinued May 1, 1968. The PUC asked
. interested parties to notify his office of any affect by discontinuance of either
service and whether they desire to appear at public hearings in the proceeding.
Councilman Wingard said he felt everything possible should be done to maintain
what service there now is, and mentioned the possibility that if service continues
to diminish present transportation rights-o€-way will have to be purchased for
mass transportation facilities in the future.
- Mr. Anderson moved seconded by Dr. Purdy to withhold action until a report is
. brought back from the local Southern Pacific agent on the extent of use of baggage
service in and out of Eugene. Motion carried.
Mr.Anderson moved seconded by Mr.Lassen that Item 7 and 8 of the Committee report be approved. Motion

3 9. Swimming Pool Attendance - The Parks Department reported an increase of 9,294 in
attendance over the same period last year at the City's swimming pools.
4 10. Riverfront property payments - The City Manager reported notes signed by individual
citizens as collateral for borrowed money to purchase Riverfront properties are due
and will require payment of $20,000 or renewi of the notes. He said funds were in-
. c1uded in the 1968-69 budget for this purpose with no consideration of deletion in
the recent budget reductions. Application will be made to the Federal government
for reimbursement through the open-space program. It was understood the notes
would be paid.
5 II. Special Election, July 30, 1968 - Pierre VanRysselberghe, Ralph Cobb, David Whit-
bread, and Leonard Calvert were present to discuss campaign plans for the forth-
coming election to gain approval of a $330,000 levy outside the 6% limitation.
Possibility of utilizing speakers, telephone campaigning, public meetings, etc. ,
was discussed. Councilman Purdy asked if the City can legally purchase advertising
and television and radio time to explain the election issue. The City Attorney said
City funds cannot be used to "sell" the measure, but he will check further and report
. back with regard to use of City funds to pay such media for material used in the
nature of a voters pamphlet. It was understood the campaign committee would meet
with the Council at its Thursday noon meetings to continue discussion and planning
as the campaign progresses."
Mr. Anderson moved seconded by Mr. Lassen that Items 9, 10, and 11 of the Committee report be received

6 I. Poverty Program, Lane Human Resources - Councilwoman' Hayward called attention to a
hearing scheduled for Saturday, July 20, on the Lane Human Resources proposal for
a poverty program in this area. She suggested the City be represented at the hear-
. ing and recommend that poverty programs be adminstered locally. The City Manager
explained that it was necessary for local governing bodies to take action by
July 15 to indicate whether a poverty program is wanted in the community. Lane
. County was eligible but did not act. As a result, it is the responsibility of
the Governor's office to determine poverty needs in this area, which is the pur-
pose of the hearing.
Robert Elfers, Lane County administrator, said the hearing is being co-ordinated by
the Governor's office and the County, and the County will probably take a position
after the hearing when the feeling of the community has been determined with regard
to what has been accomplished by Lane Human Resources.

2 3. Amazon Parkway Access - Councilman Wingard asked that it be suggested to the Planning
Commission before approval of the planned mit development for the Rubenstein property
gaining access from the Amazon Parkway that it is made certain that plans for develop-
ment include proper traffic patterns should the access be revoked. He asked that it
be emphasized that the plans not be approved unless they provide for Proper ingress and .
egress to Willamette'Street should the Amazon Parkway egress be closed: The Planning

Director said the development is in the pre-preliminary stage at this time, and the
Planning Commission has expressed concern about height of buildings proposed and the
traffic'patterns.
Mr. Anderson moved seconded by Mr. Lassen that Item 3 of the Committee report be received and filed. .:
Councilman Wingard said he felt a sign should be posted near the off-ramp informing the public of the
revocable nature of the access so that tenants of theproperty would be forewarned should the entrance II
be closed.

near the property line reading, "This egress may be closed at any time by action of the Eugene City

3 4. Campaign Information,Juiy.30 Election - Pierre VanRysselberghe made a report on progress
of the campaign and asked for comments from the Council. He said there have bem no re-
sults in trying to raise funds needed for printing and to defray the cost of using
school buildings for public meetings. Short announcements are being made at service .
club meetings and'''Letters to the Editor" are being encouraged.
Councilwoman Hayward reported a group of ladies she met with suggested sending post-
it cards to those not voting at the lastCity election instead of making phone calls,
l' information through news media on how to obtain absentee ballots, .and some illustra-
i' tion at public meetings of City services such as a bookmobile, fire engine, demon-
;' stration by police department, etc. They also suggested a real effort be made to
inform senior citizens of services available through City services. The City Attorney
was asked if ~ is possible to hold the City election concurrently with the next School
Distric.t election; and he .replied it is possible but because of the limited time avail-
~ ; able for necessary legal advertising, there may be a problem of mechanics.

sion recommended approval of the petitioner's request for withdrawal of the peti-

5 b. Rezone to R-2 area east of Potter Street at East Amazon Drive, Thompson - The
, Panning Commission recommended denial of the change from RA to R-2. However,

. Mr. Mohler purchased the property and converted the structure to a duplex with-
out a building permit.
Councilman Wingard asked if possibility of a variance was discussed. The Plan-
ning Director said variances are not provided for under the new zoning ordinance,
and that in previous denial of a request for expansion of the existing non-
conforming use (substandard lot) the Planning Commission based its action on in-
adequate parking space and substandard size of lot for either RA or R-2.
Mrs. Hayward moved seconded by Mr. McDonald to deny the R-2 zoning. Motion carried.
1 e. Rezone to RG area on east side of Portland between 25th and 26th, Rubenstein -
The Planning Commission recommended approval of change in zone from RA to RG
Garden Apartment Residential. The City Manager explained that this property is
adjacent to the area where consideration is being given to vacation of a portion
of 26th Avenue. Negotiations were carried out with the final result that agree-
. ment was reached on dedication of a 20-foot alley to Willamette Street from the
end of the existing alley, and vacation of that portion of 26th projecting into
the Rubenstein property. The final agreement actually results in value of dedica-
tion greater than value of vacation, and Mr. Rubenstein is willing to exchange for
no exchange of dollars. The Manager recommended that if the zone change is ap-
e proved, the exchange and dedication also be approved. He said it is not part of
this proposal to improve the alley, and if it is done later the cost will be
assessed. The Public Works Director said a stop sign can be installed on the
. alley where it enters Willamette Street upon inquiry from Councilman McDonald.
Mrs. Lauris moved seconded by Mr. Wingard to approve the rezoning, dedication,
and exchange of properties with Mr. Rubenstein. Motion carried.

6. Planning Commission Report - July 8, 1968
2 a. Annexation of 8.28 acres south of Bailey Lane east of Coburg Road, Johnson -
The Planning Commission recommended approval of the annexation petition subject
to Soil Conservation Service improvements of the drainage channel in the Willa-
. kenzie area which will provide satisfactory drainage of the property in question,
maintenance of the basic street pattern established in adjacent subdivisions,
payment of sanitary sewer assessment prior to annexation (unless Bancroft payments
are arranged), and recognition by the petitioner that the Updated Willakenzie Plan
does not provide for high residential density for this property. The Commission
reported the petitioner stated he understood the problems with the site and that
development would not be started for about a year and a half. The Planning Di-
rector said the developer originally petitioned for an RG zone for the property,
which was denied, and that R-I PD is planned at this time.
Mr. McDonald moved seconded by Mrs. Lauris to approve the annexation subject to
the conditions recommended by the Planning Commission. Motion carried.

3 b. Vacation of portions of Arthur, Cleveland, City View - Shields - The Planning Com-
mission recommended approval of Clifford Shields' request to vacate a portion of
Arthur and Cleveland Streets, but recommended denial of vacation of a portion of
City View Street until an agreement is reached between Mr. Shields and Roger
" Chrysler to provide suitable public access to the Chrysler property abutting the
old alignment of City View which is unimproved. Vacation of these streets by
Lane County, prior to City annexation, was found to be invalid because of vaca-
tion procedures. As a result, streets thought to be vacated are still public
rights-of-way running through individually owned properties, clouding titles of
record. The Chrysler property at present has physical access only by agreement
over private property to the south to McLean Boulevard. Legal access is available
over that unimproved portion of City View, on which vacation was set aside, to
Shields Avenue. The Planning Commission felt the old City View right-of-way could
be vacated after its new alignment is extended south of Shields Avenue, giving
access to the Chrysler property by connection with a future 31st Avenue.
Mr. Shields said he was agreeable to the Planning Commission's proposal to vacate
. only that portion of City View lying north of Shields Avenue, which would give
Chrysler's property access on the old City View north to Shields Avenue, an
improved street. He said this portion of City View has a grade of less than 21%.

of its intersection with Shields Avenue.
Mr. Chrysler reviewed the dedication and vacation of the streets in question. He
said only through the litigation which he initiated was the vacation of the streets
nullified, and that he is attempting to regain the cost of the suit. For this reason,
he said, he is opposed to the vacation of any of the streets on the basis that it
would remove his leverage to settle the matter of access. Mr. Chrysler said he would
.. present a petition to the Council signed by other property owners in the area who
supported his position.

Ray Wiley, 2100 Shields Avenue, said there are 29 properties affected by nullifica-
tion of the street vacations, and that he couldn't understand how the Council could ~

: LaVerne Strand, Cascade Title Company, said Cleveland and Arthur Streets were . ,
I' never dedicated, that they were "reserved roadways," and that any action taken at ~
" this time would merely be a bookkeeping function. He said the status of City View
would not jeopardize the status of. Cleveland and Arthur.
Mr. Chrysler said he realized the City should not judge between citizens on equity
concerned with the public interest, but that if t4e City remained neutral he felt
with more time he could accomplished an agreement' with Mr. Shields, then he would

Thompson and John Reynolds, University professors speaking unofficially, said that
although no decisive vote was taken at a recent faculty meeting the consensus was
that the "dry zone" no longer has a place in connection with the campus and should

A letter was read from A. H. Petersen requesting a 60-day extension of the abatement order. The
. Superintendent of Building Inspection said Mr. Petersen has been notified several times and, although
a building was removed from the property, debris has not been taken out and is a source of constant
complaints from the neighborhood. The Building Superintendent said he felt the ten days allowed by
abatement procedure is ample.

A letter was presented from Elmer Sahlstrom requesting extension of time to give him anopportunity to
gain settlement of an insurance claim for vandalism on the structure in question. The insurance
carrier, he said, will not repait or replace under the policy. Mr. Sah1strom said if he cannot get
. settlement with the time requested then he will proceed with abatement.
Gary McCollum, 945 East 43rd Avenue; Ronald Schmaedick, 947 Hiwan Court; and Henry Baitis urged the
Council to proceed with abatement. They described the condition of the property and hazards to which
the neighborhood is subjected. The subdivider of the property on which the structure stands asked
that the barricade be returned to its location in order to stop travel over the freeze strip until
43rd is opened to Amazon Drive.

Ray Wolfe objected to the possibility of allowing signs higher' than .20 feet and said if allowed
they would be detrimental to r~sidential areas abutting. commercial districts.
Hal Cross and Mr. Johnston reiterated their argument that size. and readability are most .important
in co~sidering regulations. They displayed lettering on the 4'2" allowable .area and a comparable area ..
for a vertical sign and argued that the English language is not easily read vertically. Neither did
i. they feel the size allowed proper design. The City Manager displayed a vertical sign of a size which
would be allowed on a building with frontage comparable to John Warren Hardware occupancy. Betty Niven
remarked that the results of a questionnaire printed in the Register-Guard revealed a majority prefer
the vertical and wall signs now in existence. Mayor Cone said flat. wall signs would be preferred if
all signs were so constructed, but if projection is allowed a 4'2" area is not enough for proper design. -'

" projection will determine diemsnion. He said it is not a matter of individual signs but of clusters

no projecting signs, the signs are small and easy to read, and initials and symbols are used a great
deal to identify shops.
I Mrs. Darrell Smith, 3650 Knob Hill Lane, supported the regulations governing signs in outlying
.: commercial districts as written and said the use of signs as identification is essential. She pre-
!i sented proposed amendments to Section 10 - Nonconforming Signs - which would require phasing out non-
conforming signs in three years, or five years from date of installation, with a. ten-year period al-
lowed for those signs not falling within the 10% leeway for allowable dimensions. .
Jim Wood, Shell Oil Company, referred to Section 2.3l-B which requires that lights on signs ad-
jacent to residential property be turned off between 10:00 p.m.and 6:00 a.m. He suggested the ordi-
; nance may be regulating hours of operation by regulating the lighting.
The Superintendent df Build ing In~pection commented that a survey by his department revealed that
all of the oil company hallmark signs can be accommodated in a 40-square-foot area.
Section 2.4 - Highway Oriented Signs - was' introduced. Charles Johnston said the sign inqustry
feels the setback is too restrictive, that signs should be allowed to the property line with the
" understanding merchants will move them if and when the streets are widened. He said an area of 100

square feet is not enough for highway oriented signs, and that 90% of present signs of this type will .
have to be redone under the ordinance. He suggested five square feet for every linear foot of frontage~
I' Charles ~otterf, Eugene Radiator Service, objected to the proposed regulations and said he will
; lose three signs under the ordinance.
Joe Richards presented amendments to various sections of the ordinance proposed by the New Car ~
Dealers Association: He said the proposed regulations present problems peculiar to automobile
oriented businesses and that signs are needed to indicate both new and used car locations as well as
service installations. Mr. Richards said bids received indicated a cost ranging from $9,000.00 to
$15,000.00 to replace any string lights (Section 5) with comparable illumination permitted by the
regulations. He said leases on such lights run from two to four years and asked that the six-month
period to remove nonconforming lights be extended to three years to minimize hardship on the car dealers.
Bud Bauer, Independent Used Car Dealers, called attention to the investment in string lights and ob-
jected to the amortization period. Mr. Richards presented bids received for installation of substitute.

Mr.Frojen commented on the slide illustrations shown by Mr. Johnston saying the signs therein .
should be shown in proper perspective - highway oriented signs from the road, and downtown signs from
the sidewalk. He said the Oakway Mall sign is a good example of a wall sign that conforms to the
ordi nance. A spokesman for the Electrical Advertising Institute also took exception to the angle

Ed Fadeley, representing the Lane County Motel Association, said the ordinance should permit
larger main identification signs for motels since their business is dependent upon informing traveling
customers what is available. He said :' the Association supports the aesthetic value to be gained by
the proposed regulations, but that it should be recognized aesthetics are not necessarily based on size;
Douglas McKay referred to Section 2.42 under which each occupancy is allowed an identification
sign and called attention to the one Oakway Mall sign which was installed instead of 22 individual
signs for the shopping area. He suggested that shopping areas be ,allowed larger and higher signs to .
prevent the use of many small signs. ~/

Ray Wolfe again mentioned as most important the readability of signs from a distance. He said
. first impressions are important to tourists and suggested an information center would suffice to
direct customers to businesses instead of off-premise signs.
Bill Maddron presented a copy of "Print - America's Graphic Design Magazine." He said it is ex-
tremely costly to maintain the large signs and felt the proposed ordinance would remove the factor of
smaller businesses trying to compete with larger businesses in sign installations.
Section 2.34 - Reader Board Signs, Outlying Commercial District - was considered. Ed Stevens,
manufacturer of changeable message boards, objected to the required 50-foot setback from the property
line and said the proposed ordinance would not permit very many signs of this type in Eugene.
Mrs. Niven said distract ion was the basic problem in considering regulations for reader boards and
that it was felt their purpose is to announce services only.
Ed Harvey, owner of Mr. Ed's Used Cars, said he owns his sign which will have to be removed along
with the string lights under the ordinance. He said his prime concern was to attract people from out
of town and that the cost of major repaids to bring signs into compliance with the ordinance would
. present an economic hardship. He suggested phasing out signs on the basis of need for repair or
replacement "
It was decided to continue the hearing at another meeting, and on motion duly made, seconded, and
carrieg., the meeting was adjourned to Monday, July 29, 1968.
