Adjourned meeting of' the Common Council of the city of Eugene,. Oregon - adjourned f~om the meeting
held July 22, 1968 - was called to order at 7:30 p.m. on July 29, 1968 in the Council Chamber by
His Honor Mayor Edwin E. Cone with the following councilmen present: Mr. Anderson, Mrs. Lauris,
Messrs. Purdy, McNutt, and ,Lassen, Mrs.' Hayward, and Messrs. McDonald and Wingard.

I Resignation, Councilman McNutt - Mr. McDonald moved seconded by Dr. Purdy to accept the

resignation of Councilman McNutt to be effective as soon as the City Council selects a
replacement for the unexpired term ending January 6, 1969. Motion carried.
It was agreed that the Council would meet at 11:30 a.m. on Thursday, August 1, 1968, to
consider names submitted by Council members and select a replacement.
3 Council Bill No. 8571 - Sign Ordinance (Hearing continued from July 2Q, 1968)
Mrs. Betty Niven presented changes recommended by the Planning Commission as a result of ,4
changes requested by the New Car Dealers Association. Addition of a new paragraph to
Section 2 - Sign Standards - was suggested: "When a single business exists on parcels
separated by an existing street, each parcel shall be treated separately for signing
purposes." Addition of a new paragraph to Section 2.12 C was suggested: "Where a free-
standing sign is used as the principal sign on a business location with more than 200
feet of continuous street frontage on one street, a second free-standing sign, limited
to fifty (50) square feet in sign area and twenty (20) feet in height, is permitted."
Other material was presented from Eugene Motel Owners Association; Martin Bros. Signs,
Inc. , Oregon Outdoor Advertising Association; Lew Williams Chevrolet; and the Metro
Civic Club Ad Hoc Committee for Better Sign Control - all recommending changes or amend-
ments to various sections of the proposed ordinance. A statement was presented from the .
League of Women Voters substantially supporting the ordinance as recommended by the
Planning Commission.
Councilman McDonald inquired about the Renewal Agency's sign regulations for the Central
Eugene Project in relation to the sign ordinance. James Pearson explained that the
proposed sign ordinance will prevail. However, the Renewal Agency's requirements can be
more restrictive. He said the Agency has recommended adoption of the ordinance as sub- ,~
mitted by the Planning Commission.
Councilman McDonald asked what effect the sign ordinance would have on the community's
economy so far as personal property tax is concerned, and in particular in what amount
it would affect the City's revenues. Brian Obie estimated an annual reduction of $1800
on billboards only. Hal Cross said the electrically operated signs would amount to much
more, but no firm figure was given.
Mr. Anderson moved seconded by Mr. McNutt to table Section 2 temporarily to give an opportunity to re-
view the suggested changes. Motion carried.
Mr. Anderson moved seconded by Mr. McNutt to adopt Section 3 - Special Signs.

Mrs. Niven read a paragraph suggested for addition to Section 3.33: "If limited to a "i;i'
maximum sign area of twelve (12) square feet, a directional sign, used only to identify
and locate a service entrance or service facility, is exempt'from the provisions of this ~,
ordinance, provided that such sign cannot project' any further than the allowable projection ",
for an identity sign for the sign district in which it is located."
With regard to Section 3.4 - Roof Signs - Hal Cross said the sign industry suggests a
ratio of one-half foot of sign height for each vertical foot of building height with
a maximum of 15 feet to the top of the sign.
Coun~ilman Lasse~ inquire~ about the regulations of this section in relation to fire pre- ,.
vent~on. Mrs. N~ven repl~ed that the regulation in the proposed ordinance was checked ..
against both the fire and building codes and no problems are anticipated. ~/

Mrs. Lauris moved seconded by Mrs. Hayward to amend the motion to add a Section 3.6 recommended by
. the Metro Ad Hoc Committee and reading: "Section 3.6 - Off-Premise Signs. The primary purpose of
off-premise signs is to provide a service for the traveling public entering or leaving the city
along major thoroughfares, where motels, restaurants, service stations, and other tourist services
are concentrated. A business may have one directional off-premise sign within one mile distance from
the business within the Highway Oriented District, providing such sign is not over thirty-two (32)
square feet in surface area."
Ray Wolfe, speaking for the Ad Hoc Committee, requested delay in consideration of this
amendment until discussion of Section 6. James Pearson explained that this amendment is
tied to the Ad Hoc Committee's request for deletion of Section 6 in its entirety.
Mrs. Hayward withdrew her second, and the motion died with no other second.
Mr. Anderson moved seconded by Mrs. Hayward that Section 3 be tabled temporarily. Motion carried.
Mr. Anderson moved seconded by Mr. Lassen to adopt Section 4 - Prohibited Signs.
. Gordon Cottrell, representing the Used Car Dealers, said the use of string lights was
beneficial in the display of merchandise and lighting of used car lots, and he mentioned
the relationship between this section and Section 10 having to do with retirement schedules.
He suggested changing the ordinance to allow use of streamers, banners, etc. , for special
promotional events not to exceed four in a year for 3D-day or two-week periods.
. John Tiffany said he felt flags, pennants, posters, etc. , should be allowed for certain
. merchandising events and asked who was to determine the standards set by Section 4.7 -
Unsightly Signs. Mrs. Niven said the Planning Commission still recommends the unde-
sirability of this type signing and urged the Council to make no alteration. Dan Herbert
also supported the section as written. He also asked for a three-year amortization
period for string lights.
Ray Wolfe presented the Metro Ad Hoc Committee's recommendation to add a Section 4.8
which would prohibit any off-premise signs except the directional signs suggested under
the recommended Section 3.6. Considerable discussion followed with regard to determina-
tion of standards set by Section 4.7. Dick Richards, Goetling Signs, asked if a committee
would be appointed to determine which signs would be allowed under this section. Mrs.Niven
said this section was taken directly from the old zoning ordinance and it was understood
the Building Department would continue to issue permits under the present procedure.

Dr. Purdy moved seconded by Mrs. Lauris to amend the motion to change Section 4.5 to read: "Which ro-
tates or has a rotating or moving part or parts, except time and temperature indicators."
There was considerable discussion with regard to prohibition of any type of movement which
this amendment would provide, and it was established that it pertained to mechanical move-
ment only, not lighting movement covered by Section 5.
A vote was taken on the motion to amend as stated, and motion to amend carried, Councilmen McNutt,
Lassen, and Wingard voting no.
. A vote was taken on the original motion to adopt Section 4 as amended, and motion as amended carried.
Section 6 - Billboard Signs and Other Off-Premise Signs - was introduced. Section 5 -
Illumination - was postponed to assure discussion of Section 6 at this meeting.
Mrs. John Northway read a statement of the League of Women Voters supporting the billboard
restrictions.
@I' Dan Herbert referred back to Section 4.4 and said the directional purpose provided by
billboards is needed. Mrs. Niven suggested that Section 4.4 include the words "...except
as provided in Section 6 of this ordinance."
Brian Obie introduced Roger Emmons, executive secretary of Oregon Outdoor Advertising
Association, who presented slides and distributed to Council members a list of recommended
changes to the ordinance. Mr. Emmons explained the Association's position with regard to
each of the requested amendments.
Mr. Anderson moved seconded by Mr. Lassen to adopt Section 6 of the proposed ordinance
Mrs. Hayward said she felt billboards should be eliminated, and she moved that the motion be
. amended to delete Section 6 entirely. The City Attorney ruled the motion out of order. He said it
was contrary to the original motion.
. Some discussion followed with regard to proposed fees in relation to fees now charged for bill-
board construction permits, areas of the City where billboards would be prohibited under the
proposed ordinance, and the financial impact on outdoor advertising business. Mr. Obie said,
on inquiry from Councilman Purdy, that he would support removal of billboards on Willamette
from 19th south if it would help in obtaining a reasonable ordinance.
Ray Wolfe urged the Council not to accept amendments proposed by the Outdoor Advertising
Association, but to prohibit billboard signs in the City on the basis that they obstruct
the view, are detrimental from the viewpoint of serving special interests, and contribute
. to safety hazards. Mrs. Niven said prohibition of billboards inthe City would only slightly

increase density of such signs in permitted areas and that the percentage of billboard i ~ -

advertising inside the City is small when compar~d to the total, and that prohibition
in other than highway oriented areas would not materially affect the overall billboard
business.

Walter Dennis of the New Oregon Motel said he felt the phasing out periods for noncon-
forming signs should be of longer duration, and he commented on the value of signs to
competition.

Phyllis Ear 1y asked that the Outdoor Advertising amendment which would allow billboards in
C-2 and C-3rzones,'not be adopted because of the residential areas surrounding shopping
centers allowed in those zones.

Bud Nixon, 3530 West Amazon Drive, said he felt restraint on advertising would result in
" reduction of revenues to governmental agencies, and Fred Braatz, Travel Inn Motel, was

concerned that the greatest percentage of billboards which would be removed would be of
, the community service type. --

Mrs. Ruth Miller supported prohibition of billboard signs in any part of the City on the
basis that it would improve the City's appearance and that signs should serve for identifi-
cation only, not advertising.
Eaton Conant, 2255 Columbia Street, said he felt retention of available area for billboards .
in the downtown area would result in an increase in that type of advertising.
Harold Parmenter explained the.prob1ems ,with which he has been confronted in trying to ~~
find a new location for his business, Parmenter Pontiac.
Mr. McDonald moved seconded by Mr. Lassen to amend the motion to incorporate into Section 6 the pro-
posed Outdoor Advertising Association amendments, excluding the proposed change of permit fees to
$10.00 and $12.50, and adding a provision to prohibit billboard signs on Wi11amette from 19th south.
The City Attorney ruled the motion out of order on the basis that it w~s in'conf1ict with the original
motion.
Councilmen Lassen and McNutt expressed the opinion that Section 6 as written is too re-
strictive. Mrs.Niven expressed concern with regard to tying the sign regulations to ,the
new zoning ordinance. Mrs. Darrell Smith said she didn't think the Council could rightly '.
vote on adoption of Section 6 when no decision has yet been made on adoption of Section 2 -
Sign Standards.
Dr. Purdy moved seconded by Mr. Lassen to adjourn to August 5, 1968 and continue the hearing at that
time. Motion carried.
