The regular meeting of the Common Council of the city of Eugene, Or~gon was cal~ed to order at 7:30pm
.. on August 12, 1968 in the Council Chamber by'Council President Lester Anderson with the following
other councilmen present: Mrs. Lauris, Messrs. Purdy and Lassen, Mrs. Hayward, and Messrs. McDonald
and Wingard. Mayor Edwin E. Cone arriv~d later in the meeting. Councilman McNutt was not present,
but Councilman-elect Teague was present, taking his seat after being administered the oath'of office.
Minutes 'of the Council.meetings held July 15, 22, 29 and August 5, 1968, as mailed to Council-members,
were approved.
NEW BUSINESS
1 Mrs. Lauris moved seconded by Mr. McDonald that Item 2 of the August 1, 1968 committee report be taken
out of order and approved. Motion carried.

Charles 'Teague - Mr. 'Anderson moved seconded by Dr.
"2. Appointment, Purdy to accept the
unanimous selection of Mr. Charles Teague to fill the Council position being vacated
by R. E. McNutt, Ward 4, for the term ending January 6, 1969. Mr. Teague was selected
from a field of six candidates; Motion carried.
Dr. Purdy moved seconded by Mr~' Lassen that Mr. Teague's term begin August 12, 1968. .'
Motion carried."

The oath of office was administered to Mr. Teague by'the'City Recorder. Mr. Teague took his seat as
a Council member and expressed his appreciation for having been chosen to serve.
2 Crest Heights Annexation - Councilwoman Laurisinquired about progress toward annexation of the Crest
Heights area. The City Manager explained that the State law covering annexation of health hazard
areas requires preparation of a preliminary plan for provision of sewers to be presented to t~e State
Sanitary Authority as well as.the 'governing body of the annexing agency. He said the City engineering
department is now developing a preliminary design, construction schedule, and cost estimates prepara-
tory to proceeding with the next step.
3 Bills against the City for the period July 23 through August 12, 1968 were submitted and read:

Committee meeting held July 25, 1968: --
"Present: Mayor Cone; Councilmen Anderson, Lauris, McNutt, Hayward, McDonald, and Wingard;
City Manager and staff; and others.
2 l. Leash Law - Councilman McDonald moved seconded by Mrs. Lauris that the City Attorney
develop a leash law for adoption by the Council. Motion carried.
3 2. Sign Ordinance Hearings - Councilman Anderson suggested that if hearings on the new
sign ordinance are not completed soon the sign moratorium will have to be extended
beyond its expiration date (Augus t 12, 1968). He moved seconded by Mrs. Hayward that
the Council accept no new material or information with regard to the sign ordinance
after the Monday night meeting, July 29. .

In discussion it was brought out that numerous meetings were held by the Planning Com-
mission at which there was the opportunity to present information and arguments, and
that if sections of the ordinance are found to unworkable after its adoption, it
can be amended. The City Attorney reminded the Council that this is a legislative
ordinance and has nothing to do with zoning, that the Planning Commission is making
recommendations only, and the Council needs not refer any part of the ordinance back
to the Planning Commission.
A vote was taken on the motion as stated, and motion carried, Councilmen Anderson,

Finance Department recommended approval. Mr. McDonald moved seconded by Mrs. Lauris

6 5. lQth and Oak Parking Structure - Copies of a report prepared by N. G. Jacobson &
Associates, consulting engineers, were distributed to Council'members giving the
proposed schematic design and cost estimates of the 10th and Oak "Overpark." Also
submitted was a report from economic advisers, Shorett & Riely, on the feasibility ~I
of commercial development of the ground-floor area.
Norman Jacobson showed schematic drawings of the structure which provide about ,t
25,000 square feet of commercial space on the ground floor and mezzanine level, with ~-
alternate desi~s for screen wall facade permitting 617 parking spaces or precast
spandrel facade permittfng 597 parking spaces. Mr. Jacobson explained proposed
operation of the structure, traffic patterns, ramp grades, 'clearances, etc. The
proposal contemplates a 20-foot setback on the Oak Street side and widening of Oak
to allow two lanes of traffic to enter the structure, with the 10th Avenue setback
remaining as it now is.

James Longwood, architect showed photographs and designs depicting exterior appear-
. ance of the structure and height in relation to other buildings in the area, arcade
type arrangement of ground-floor commercial area, and proposed arrangement for span-
ning 10th Avenue. It was explained that because of concern with getting the garage
into operation by August 1969 it would be necessary to complete working drawings by
November 1968, so that authorization to proceed beyond the schematic design phase
is necessary. Approval of the exterior facade is not necessary at this time since
it will be presented in more detail at a later date.
The City Manager informed the Council that development of commercial space on the
ground floor will add costs not originally contemplated and will necessitate financ-
ing in conjunction with or in addition to the district assessments. There may also
be need for some legal research. If the commercial space is financed separately
from the assessment, then the original estimates of the assessments would be within
reason. Commercial space will increase revenues from the structure and make a
difference in repayment of the assessments.
. Mrs. Aauris moved seconded by Mrs. Hayward to accept the schematic design presented
and authorize proceeding with the design development phase.
Councilman McNutt said it should be made certain that owners of property within the
assessment district benefit from the revenues derived from the commercial area.
- Councilman Wingard asked about the difference in cost in developing the commercial
space. Mr. Jacobson said the total estimated cost of the structure with a screen
. wall facade is $1,826,500 - with spandrel, $1,723,000 - both estimates including fees
and contingencies. With the screen wall design, the commercial portion is estimated
at $471,300 - the parking portion, $1,355,200. Councilman Wingard suggested waiting
until tenants are determined before developing the commercial space and asked if it
wouldn't be less cost if each space were to be completed by the individual tenant to
fit his own needs. Mr. Jacobson said the structure could not be designed to take park-
ing in the commercial space, then have it removed later. He stressed the importance
ot control of the exterior appearance and use of materials. He said there is assurance
at this time that 60% of the commercial space can be leased.
The Public Works Director asked whether above-street level ramps to adjacent buildings
are contemplated, and Mr. Jacobson said they could be added later with no problem.

On question from Councilman Lassen, the City Manager said the original estimatecl cost for the 10th and
Oak parking garage and land was $2,000,000 which did not contemplate commercial use of the ground
floor. Land costs so far amount to about $540,000. Financing of development of the ground floor
commercial area appears to be feasible which will guarantee the City's costs.
1 6. Eugene Representative. CLPC - A memo from Lawrence Rice, Central Lane Planning Council
executive secretary, reminded that representative appointment to the CLPC is necessary
. before August 27, 1968 when officers will be elected. Mrs. Lauris moved seconded by
Mrs. Hayward to reappoint Councilman Anderson as the City's representative. Motion

2 7. Barefoot Hazards - A report was read from the Police Chief stating the Department's

3 8. National League of Cities Meeting - Announcement was made of the National League of
Cities Congress of Cities scheduled for December 7-11, 1968 in New Orleans.
4 9. Resignation, Councilman McNutt - R. E. McNutt submitted a letter of resignation as a
member of the Council, to be effective prior to the expiration of his term on January 6,
1969 and as soon as a successor is appointed. He said he is in the process of a major
reorganization of his company which may create a possible conflict of interest.
4 10. Weeds - Councilwoman Lauris called attention to weeds in various areas of the City.
The Public Works Director said Wickwire Tractor Service is working full time under
contract, and that the Parks Department is mowing park properties. He said the
. program has developed into one of mowing private properties and parking strips in-
stead of just vacant lots as originally intended. It was suggested that the rates
for mowing be raised from the current $10.00 per hour, $12.00 minimum, to encourage
. owners to mow their own properties. The City Manager suggested investigating the
problem between seasons to determine whether something can be done to better take
care of the problem."

1 10. Free Swimming Lessons - The City Manager read a letter from Mrs. Harry Cronan

2 11. Protests, Dry ZoneChanges - The City Manager read a letter from Mrs. Grace Myrtle
Payne protesting changes in the "dry zone" around the University of Oregpn which
would make liquor easier to chtain.
3 12. Adult Education Classes, Jail Trustees - A report was read from the Police Chief stating
a program was started in April in connection with the Lane Community College Adult Educa-
tion Section, for the purpose of educating jail trustees toward obtaining their high
school equivalency certificate. The Program is paid for by the Adult Education Division
of the Lane Community College. Since the program was started, several prisoners have
been taught to read and write, two have taken their GED test and passed and another will
be tested shortly. The course is on a voluntary basis and will be conducted for as long
as any benefit will be gained from it.

13. Planning Commission Report - July 22, 1968

approval of Lee Trippett's request for temporary use of this property for light
manufacturing, until Urban Renewal acquires the property, subject to review of the
- use in 18 months. Dr. Purdy moved seconded by Mr. McNutt to approve the recom-

. 5 b. Vacation City View - Amending previous action taken on July 8, 1968, the Planning
Commission recommends to the City Council approval of vacation of City View north

channelization will require relocation of bus stops on 13th Avenue which have been ap-
proved by the Bus Company. Motion carried.

the Public Works Department recommendation to grant a 45-foot curb cut requested by
Mark W. Christensen at 3550 West 18th to accommodate storage of large drilling rigs

8 16. Stop Signs, West Belt Line at Barger and Royal - Mr. Lassen moved seconded by Mr.McDonald
to approve the Public Works Department recommendation to install stop signs for eastbound
and westbound traffic at the intersections of Royal Avenue and Barger Avenue with West
Belt Line Road. This is an emergency measure and will be in effect until a signal system
is ins ta lled . The Public Works Director said the new stop signs could be presigned to
alert drivers of the new stops. Motion carried.

. 11 19. New Careers Conclave, San Francisco, September 3-5 - The City Manager read a letter
from the League of Oregon Cities inviting Eugene to send four representatives to the
.. New Careers Conclave in San Francisco, California, on September 3-5, 1968. The New
Careers program is designed to give on-the-job training to people who do not normally
qualify for the position in which they are placed. With this on-the-job training,
eventually the employe will be qualified for the job and for advancement to other
positions. The City Manager cited the city of Portland as an example as they are
initiating a training program of this nature in the police department. The City
Manager recommended that the city of Eugene participate in the Conclave. Mr.Anderson
moved seconded by Mrs. Lauris to endorse the City's participation in the Conclave and
to send three or four representatives. Motion carried. Mrs. Hayward was nominated'
C- as a candidate to go, along with the Personnel Officer and the City Manager, plus a

given to measures to be on the November ballot. :The :following items were cons idered,

would have on the l~% tax levy limitation. Mr. McDonald said it would make the
I l~% limitation seem very appealing to the voters. Mr.Anderson stated the Council

The City Manager said that the August 26, 1968 Council meeting will be the last opportunity to take
action on measures intended for the November election ballot. Since State law prohibits consideration
of a new tax base at elections other than general elections, it will not be possible to take this
measure to the voters again until May 1970. With regard to a hotel-motel room tax, the Manager ex- .'
plained that authority could be given under either State law or a Charter amendment. He saie). it has
been several years since estimates were made of potential income from this source, but at that time it '.
was estimated a 3% tax would raise $60,000 to $70,000 per year. On the Laurelwood 'property, the
Manager said conside~ation could be given to submitting a bond issue for funds to complete the pur-
chase. He said neither the hotel-motel tax nor the Laurelwood issues would have to be on a general
election ballot, so both could be submitted at a'special election if desired.
Mayor Cone asked if any consideration would be given to a County-wide income or sales"tax. The Manager
said a preliminary study was made but has not progressed too far; and that it would not be possible
now to prepare an acceptable measure for submission to the voters at the November election.

3 \, Laurelwood - The City Manager explained the bond measure presented at the May election included the

Laurelwood property purchase price plus funds for improvements at the golf course to increase income.
I He said a bond issue of $360,000 to $370,000 would cover the purchase price, including. interest. The

next payment is due on January 1, 1969 but could be postponed a year if necessary.,
Mrs. Hayward asked if the agreement with the Scho~l District precludes selling any of the land. The
Manager replied that the only restriction is that the School District be given the first right of re-
fusal should the City desire to sell.
Councilman Teague asked if the bond issue could be retired by revenues from the golf course, and the
Manager said it was doubtful, even over a 20-year period, since revenues jus t about carry the opera ting
cos t. .'
Dr. Purdy moved seconded by Mr. Anderson to proceed with preparation of material for submitting a
bond issue to cover the purchase price of the Laurelwood property, including interest, for the
; Council's consideration.

Councilman Wingard suggested that because of the steep terrain which makes the property undesirable
for recreational purposes it might be well to consider selling a ring of lots around the golf course .
to raise funds for the purchase. Councilman McDonald asked if there were restrictions on types of -/
enterprise which could be started on the perimeter of the property. The City Manager said it would be
governed by zoning regulations and that all of the surrounding property is zoned for single-family use.
Councilwoman Lauris suggested that when the property is acquired, there should be restrictions to keep
it as open space. Dr. Purdy said he understood there was an oral agreement between the School Board
and the owners that none of the property would be sold separately. The City Manager said at the time
the City Council entered into the purchase agreement with the School District, this property was con-
sidered extremely desirable for multirecreational functions. A study carried on by the Parks Depart-
ment has shown that the property is adaptable to several types of recreational uses. Mr. Lassen
stressed the importance of informing the voters of the potential for multirecreational uses.

4 Hotel-Motel Room Tax - The City Manager said although the estimates indicated about a $60,000 potential .

revenue from a 3% room tax, it would no doubt amount to more now because of recent construction of
large units in the city. He said if a Charter amendment is adopted authorizing a room tax, the funds .
should probably be used for cultural/convention type facilities. Councilman Anderson asked if any
judgment has been given on legality of this, type tax. The City Manager said that with Charter
authorization, there would be no problem.

. 1 1~% Limitation - The City Manager called attention to a preliminary report on the proposed l~% property
tax limitation, copies of which were distributed to Council members. The report resulted from a study
by the State Tax Commission of the effect of the limitation on local government financing, based on
1967-68 tax levies. He said the estimated loss to Euge ne , according to a breakdown by the League of
Oregon Cities, would have amounted to $791,000 in 1967-68 - on present day levies, about $900,000.
The Manager said if the limitation measure is passed at the November election, the City will be forced
to look for new sources of revenue, possibly including increases in other City fees, to make up the
loss in property tax levy. It is hoped a State-wide organization will be formed through the Governor's
office to distribute information with regard to the effect of this measure on local governments and
school districts. If not, a local organization should be con~dered for that purpose.

. 2 1. Planning Commission Report - August 6, 1968
a. Amendments, Zoning Ordinance - The Planning Commission recommended amendment of
Sections 12.02 and 12.03 of Zoning Ordinance 15158 to include in C-2 zones other
permitted and conditional buildings and uses. Dr. Purdy moved seconded by
Mr. Anderson to approve the amendments. Motion carried.
- Mr. Anderson moved seconded by Mr. Lassen to approve Item 1a of the Committee report. Motion carried.
. 3 2. Sign Ordinance - Mrs. Betty Niven reviewed the bases on which the proposed sign ordinance,
now before the Council for adoption, was written. She explained the difficulties
which will be encountered in incorporating into the ordinance the amendments adopted by
the Council which will allow billboards in pedestrian-auto districts. She said if the
Council thinks it is important to allow billboards in the downtown area, it will be
necessary to rewrite Section 2.1 - Pedestrian-Auto District, and the purpose and scope
of the ordinance, and extend the sign moratorium to allow time for revision of the
ordinance to incorporate the changes made. September 9 was estimated as the earliest
possible time the ordinance could be revised. Mrs. Niven suggested that it may be
possible to change the Sign District Map to accomplish essentially the same purpose
as intended by the Council rather than rewriting the ordinance itself. If this is
done, then the changes could be ready for presentation to the Council by its
. August 26 meeting.
James Pearson said the Planning Commission unanimously recommended extension of the
Highway Oriented District through the downtown area on 6th and 7th. He explained
the resulting decrease in the number of billboards which would have to be removed
eventually, at the same time increasing the potential area in which billboard would
be allowed compared to the regulations originally recommended by the Planning Com-
mission. Mr. Pearson said the recommended change in the Map would eliminate the
necessity of rewriting the preamble to Section 6, all of Section 2.1, and eliminates
incorporating off-premise advertising into the downtown area.
Some discussion followed on allowing billboards in the industrial area on specific
- streets or in the area as a whole. Mr. Pearson referred to the Comprehensive General
Plan for the metropolitan area which is now being developed and suggested the possi-
bility of parts of industrial areas being rezoned to a use with which billboards
would be incompatible. He suggested, if billboards are permitted in the indus~ria1
area, specific streets be designated, then changes could be made if desired after the
General Plan is completed.

clude Pedestrian-Auto District. Motion carried, Mr. Wingard abstaining.

Councilman Lassen asked about the sign restrictions in the downtown area in relation to the Central
Eugene Project. The City Manager said the Eugene Renewal Agency intends to develop a sign review
committee which will work with property owners and developers in consideration of signs proposed for
those properties which the Agency acquires or on which it has agreements with owners for upgrading,
. rebuilding, etc. It is anticipated that initial work on the Project will concentrate in the southern
portion, so the five-year phasing out period covered by the Sign Ordinance will not interfere with the
Project so far as the 6th and 7th Avenue area is concerned.
. Gordon Obie of Obie Outdoor Advertising reviewed some of the restrictions proposed in the new ordinance
and the effect they would have on his firm. Don Smith, 2140 Agate Street, said 6th and 7th Avenues
between Lincoln and High should be considered a part of the downtown area, and he urged the Council
not to extend the Highway Oriented District through that section.

1 3. Sign Moratorium Extension - The moratorium on issuance of permits for replacement .
i or alteration of existing signs will expire August 12, 1968. Since it is expected
the new draft of the proposed sign ordinance will not be ready by that time, extension
of the moratorium was requested. Dr. Purdy moved seconded by Mr. Lassen to extend the

The City Manager said if the draft of the new sign ordinance including the changes is brought back for
Council consideration at its August 26 meeting, the sign moratorium ordinance could be repealed at
that time.
2 4. Crash/Rescue and Fire Fighting Equipment, Airport - The Fire Chief introduced Fred Darby
and Frank McRae who had demonstrated a Go-Track, Ltd., chasis with Ansul Corporation
fire fighting equipment for crash/rescue equipment at Mah10n Sweet Field. Films were
I shown illustrating maneuverability, power, speed, load weights, etc. , of the tractor
,
vehicle, and of the fire fighting equipment showing effectiveness of light water and ,
Purple K dry chemical. It was explained that the chasis is distributed only by North-
west Roads, but that the fire fighting equipment would be purchased under bid. The cost
of the complete unit was estimated at $55,000 to $57,000. The Fire Department recom-
mended its purchase.
Councilman Lassen asked about plans for manning the equipment, and the Fire Chief said .-
volunteers from the airport will be used until such as annexation and growth warrant a
.' fire station for the airport and surrounding area. Dr. Purdy asked if funds have been .
" budgeted, and the Manager replied that funds are available from bond issues.

Charles Wiper said the Airport Commission recommends purchase of the equipment. He ex-
plained that the-airport is without crash equipment and he stressed the urgency for its need.

The Manager said it has -not been considered, that this type of equipment was assumed to be the re-

3 5. Airport Runway and Taxiway Proiects - On the basis of Federal Aviation Administration
advice that Federal matching funds were :'available for rebuilding and lighting taxi-
ways and strengthening the main runway, the City gained approval of bond issues to
finance the City's share. Specifications were developed with co-operation of the FAA,
bids were called and opened with a completion date of October), 1968. Under FAA regula- efJ
tions, before contracts can be awa-rded, bids must be submitted to the FAA for approval.
This was done, with no indication from the FAA that funds would not be forthcoming.
However, the FAA now advises that Federal funds are not available at least until after
, October 1, and that availability of funds then is dependent upon appropriations; The
, Manager recommended trying to obtain the grants originally offered to the City, rather

than accepting enough for a portion of the plDject in the hope that the balance will
be forthcoming at a later date.
Charles Wiper explained that if the City proceeds with the projects on its share of the funds,
I Federal funds will be lost. He said commercialaperation at the airport has reached a
critical point, the runways are breaking down under use by the DC9's, and maintenance is
constantly in process to accommodate present use. He said even if funds are available by
October 1, it would be well into winter before the work can be accomplished. The Airport .-
Commission recommended that contact be made with elected repres~ntatives in Washington to
gain contractual agreement with FAA, to assure release of the committed funds by a certain
, date. fj

The City Manager said Senator Morse has been contacted but so far nothing has been accom-
I' plished. It was understood contact would be made with every elected representative possible
who may be able to help, as well as with administrative people in an attempt to get commit-
ment of the Federal funds allocated for both projects.

. 1 6. Alley Vacation between 12th and 13th east from Hilyard, Sacred Heart - A letter from
the Administrator, Sacred Heart Hospital, was read requesting waiver of proposed
charges for vacation of this alley. It was explained a public hearing was set for
August 12,1968 and that under normal procedures an estimated is made of the value of
the land to be vacated and assessed against the benefiting property. The Manager said
a value of $3.80 per square foot has been placed on the land by the Public Works De-
partment, based on recent sale of adjacent property, making a total of $7,098.88 for
the land to be vacated. The basis of Sacred Heart's request for waiver was that the
alley to be vacated deadends and does not serve as a public thoroughfare and does not
represent an investment of public funds.
Mrs. Lauris asked if a pedestrian way would be provided when construction of the
Hospital's new wing is completed and was told byMr. Williams there would be.
Some discussion took place with regard to the triangular piece of City-owned property
at 13th and Alder used by the Hospital for parking, and the normal procedure of assess-
ing value of vacated land unless dedicas ion of like value is received.

Mr. Anderson moved seconde~ by Mr. Lassen to waive one-half of the proposed assessment,
charging $1.90 per square foot for the land to be vacated. Motion carried, Mrs. Lauris
voting no.

Mayor Cone questioned whether to reduce the appraised cost for the vacated land. Councilman Lassen
. asked if there have been other instances that would compare, and the Manager replied there appeared to
be none where no assessment was charged unless land of equal value was dedicated, or where property
was returned to a recently filed plat when it was decided a street or alley was not needed. The
policy of assessment has been in effect only since 1961, he said, so there may have been vacations
without payment before that time. Councilman McDonald said it was his, understanding the alley has
never been used by the public. The Public Works Director said the alley was improved with assessment
to owners of abutting properties prior to the time it became surrounded by one ownership.

Mr. Anderson with consent of the second changed his motion to proceed with vacation of the alley and
charge the full amount of the appraisal ($3.80 per square foot). Rollcall \0 te. All councilmen pres-

2 1. Variance, Small Animal Clinic, Villard Street - Gordon York requested further extension
of the variance granted two years ago allowing a small animal clinic on Villard Street
near Garden Street. He said the University of Oregon will purchase the property upon
which his existing clinic is located, and the variance extension will allow time to com-
plete the transaction before a new building is constructed.
Dr. Purdy moved seconded by Mrs. Hayward to grant a one-year extension of the variance. Motion carried.
II 3 2. Minda Drive Right-of-way and Paving - In working with the contractor to develop a change
order covering specifications for paving one-half of the right~of-way on Minda Drive
between Norkenzie and Gilham, it appears that this plan will add about $1200 to the cost
of construction. In the meantime it has become possible to purchase fbr $1100 the neces-
sary right-of-way to pave the full width. Paving, sewer, and curb and gutter costs will
be assessed against the owners of all abutting properties.

4 3. Paving Alley between 32nd and 33rd, Willamette and Donald - Petitioned by owners of
62.2% of property to be assessed. The Public Works Department called attention to
the special assessment requirement whereby Mr. John Hirons anticipated paying the en-
tire cost of the alley improvement.
Mr. Anderson moved seconded by Mr. Lassen to approve the petition. Motion carried.
. 5 4. Buckley House - A proposed agreement was presented covering payment of funds budgeted
for Buckley House. The City Manager explained that the Lane County Council on Alcoholism
has not developed a program to where they are providing services similar to that provided
. by Buckley House. He recommended approval of the agreement which provides for quarterly
payment of the monies budgeted for this purpose.

State Milk Law - ,The City Manager said an' .amendment changing the wording of. the State ,i

of raw milk within its boundaries and discontinue, its milk inspection service.

2 6. Protest, Southern Pacific Service - A l~tter was read from Thomas A Beaumont, student
at the University of Oregon fromSeattle, asking the City to protest the discontinuance
of Southern Pacific Cascade passenger service. The City Manager presented information
received from the Southern Pacific with regard to intrastate baggage service and statis-
tics concerning am~unt of ~aggage.ha~dled at Eugene.
Mrs. Lauris moved seconded by Mr. Wingard to enter a formal protest against any further discontinuance
of passenger or baggage service by the railroads. Motion carried. .'
3 7. SP&S Co~operation with City - A lette~ was presented from Spokane, Portland and Seattle
Railway in answer to a protest previously authorized by the Council on lack of Oregon
Electric co-operation with the City. The letter indicated Oregon Electric felt the lack
of co-operation was on the part,of the City. It was understood the matter would be handled
at the staff level., .~

I Letters of pr.otest were presented from Floyd and Willa McAllister, 1010 West Hilliard Lane, and
Elizabeth Ann Cully, 962 Ferry Lane.
The Public Works Director explained that the sewer on the easement was bandoned when a new sewer line
was developed' on Patterson Street to se!ve the College Inns building. The easement is completiy within
the boundaries of ColLege Inns ownership. He said previous legal opinions were that Ferry Lane, serv-
ing the property from the west, is a private street, and there is a law suit now pending to determine iI

whether it is private.
Scott Lawlor, attorney representing Ann Cully, said the easement was used in prior years for vehicular
service to the College Inns building. Ferry Lane is now being used for this purpose, he said, and his
client is attempting to restrain this use through court.action.. He asked postponement of action on
this vacation request until after August 16 when the suit will be tried, so that ,the owners of College
Inns will not come into court without easement rights.

exerted by Hospital purchases in the area. He.said he felt $2.00 per square foot would have been a
realistic price for the land, and he moved that the assessment charge be reconsidered. There was no
second. .
The City Manager said passage of the vacation ordinance could proceed, since it wouldn't be effective
until it was signed by the Mayor - or the Mayor could veto it - then the matter of assessment could be
reconsidered.
