The regular meeting of the Common Council of the city of Eugene, Oregon was called to order at 7:30~m.
on October 14, 1968 in the Council Chamber by Council President Lester Anderson in the absence of
Mayor Edwin E. Cone. Other council members present were: Mrs. Lauris, Dr. Purdy, Mr. Lassen,
Mrs. Hayward, and Messrs. McDonald and Wingard. Councilman Teague was absent.
Minutes of the Council meeting held September 23, 1968, as mailed to Council members, were approved.
NEW BUSINESS
1 Regular Council Meeting, November - Because the date of the first Council meeting in
November falls on a holiday, November 11, the Council set Wednesday, November 13, as
the date for that meeting.
. 2 Water Pollution Control Award - James Gra1ow, superintendent of the Eugene Sewage
Treatment Plant, presented Council President Anderson with a plaque awarded to the
city of Eugene at the Pacific Northwest Pollution Control Association meeting in
penticton, B.C. The plaque was in recognition of Eugene's water pollution control.
The City Manager commended the people of Eugene, the Council, Public Works Director
- Don Allen and his engineering staff, Mr. Gra10w and the sewage treatment plant staff,
the consulting engineers, Cornell, Howland, Hayes and Merryfield.

, Mr. Lassen moved seconded by Mrs. Lauris to award the sale of bonds as recommended. Rollcall vote.

1 Delinquent ~ssessments - A memo from the Finance Director was~read concerning a fore-
closure sale scheduled' for November 14, 1968. There are 496 properties involved against
I. which there are 514 delinquent assessments ln the total amount of $406,653.60. e
2 Airport Automobile Parking Proposals - Two written proposals were received for operation
and management of automobile parking at Mahlon Sweet Field. Diamond Parking Company
proposed a management fee of 14% of gross receipts, guaranteeing a total of $75,000 for
a nine-year period, and paying for the original installation of ?ecessary equipment. The
Airport Parking Company of America proposed a management fee of 22% of net receipts,
guaranteeing $10,000 annually :for 'ten years, with indication they would spend $75,000 ,~
for parking area expansion and improvements during the lease term. The Airport Commission
recommended acceptance of the APCOA proposal.
, Councilman Wingard asked who would decide. when expansion is required. The City Manager
said it would be a joint decision between the City and the Parking Company when the de-
mand is great enough t~ justify- expansion. Mike Griffin, representing APCOA, said ex-
pansion would not be done until the City indicated it is necessary and that a statement
to this effect could be included in the contract..
Councilman McDonald asked if all free parking at the terminal building would be eliminated,
and Mr. Griffin said it would.
Councilman Wingard asked what rates would be established. The Manager replied that APCOA
I: proposes a rate of 25~ for one hour, 10~ for each additional hour, and a maximum of $1.25 ~\
for 24 hours. No proposal was made for weekly or monthly rates.
\' Councilwoman Lauris asked how rates would be handled for those cars parking longeitf1an 4
.i 24 hours. Mr. Griffin explained that on cars which are parked behond the 24-hour limit
the rates would be the same as those initially charged - 25~ one hour, etc. The City
Manager said the management proposal fs:.'for-':a' 24-'hour 7-day week attendant, with a
resident operator, and a willingness to operate under a validation program. Fur th ermor e ,
the parking lot adjacent to the main lot would be set aside for parking for permanent
employes and others working at the airport.

The Airport Manager in response to a question from Councilman Purdy said the lot used
. for parking by customers of Green's Flying Service would remain free, but a l2-hour
limit will be imposed. He said the other fixed based operator has his own parking
facility.
Mr. Lassen moved seconded by Mrs. Lauris to accept the proposal of Airport Parking Company of America.
Councilman Purdy said he would like to see a copy of the proposed contract before voting,
and asked that the item be considered at a committee meeting.
Councilman Lassen with the consent of the second withdrew his motion.
Mr. Griffin said he would submit a draft of the contract covering the proposals recom-
mended by the Airport Commission.
Mr. Lassen moved seconded by Mrs. Lauris to tentatively accept the APCOA proposal and that a
specific agreement be brought back for consideration. Rollcall vote. All councilmen present
. voting aye, motion carried.
1 18th Avenue Right-of-Way, Gulsvig - A memo from the City Attorney was presented recom-
mending settling for $2900 a suit brought against Clayton and Joanne Gulsvig for acquisi-
tion of right-of-way at 2980 West 18th Avenue in which $1065 was offered. The defendants
. requested $5280 plus $2000 attorney fee. The City Manager said that in actual construc-
tion of West 18th Avenue, the contractor did not follow the specifications and cut a bank
against the Gulsvig property line which will make a retaining wall probable at a cost of
. about $3000. A though there will probably be a claim against the contractor, a t this time
the matter is between the City and theproperty owner.
Mr. Lassen moved seconded by Mrs. Lauris to settle out of court for $2900. Rollcall vote. All
councilmen present voting aye, motion carried.

1 Contract Penalties - Councilman Purdy asked what effect the weather has had on contract
completion dates, what streets would have to be carried over, .and what penalties may be
involved. The Public Works Director said a report on projects under construction will
be brought to the Council. He said, in answer to Councilman McDonald, that Minda prive
is fairly well rocked and part of curbs.in" In addition, that airport improvement is
the most important project which is affected.

1 l. Ordinance, Conflict of Interest - Paul Hoffman, candidate for the office of mayor,
. proposed adoption of an ordinance by the City which would (1) require disclosure
of assets by candidates for City office at time of filing f or election; (2 ) set a
limitation on campaign expenditures of $5000 for the office of mayor and $2000 for
the office of councilman, these amounts to include both expenditures made by the
candidate himself and any committee on his behalf; and (3) require filing of income
and expense statements by candidates for City office 30, 15, and 5 days before
election. Mr. Hoffman said he felt the regulations should apply also to kep ap-
pointed officials in City government. He said there is a need for strong election
laws to prevent graft and corruption and to determine conflict of interest. With
regard to filing of statement of campaign contributions, Mr. Hoffman said a minimum
of $50.00 was suggested rather than $5.00 as required by Oregon law.
Discussion took place on setting up procedure to determine conflict of interest,
intent of the proposed ordinance with regard to giving the public information on
possible anticipated conflicts, what bearing a declaration of State-wide interests
would have on City offices, and need for consideration of this type of legislation
. because of the continued growth of the City. Dr. Purdy said the people seeking
election to City offices do so because of interest in the community, and disclosure
of campaign contributions and financial interests would not affect voting. Mr . McDona ld
commented that these positions are unpaid and said he felt people who serve in City
office do so to contribute to the community rather than for personal gain. He ques-
tioned bringing the matter up at this time. Mrs. Lauris expressed the opinion that
. the public should know where interests of candidates for City office lie. Mrs.Hayward
said accusations are sometimes made because the public does not have information, and
. she suggested a hearing be held to gain public expression on the subject. Mr.Hoffman
said he would like to bring back documented examples from other cities of instances
involving conlifct of interest.
Dr. Purdy moved seconded by Mrs. Hayward that the item be referred to the staff and
information on what is required in other cities brought back to the Council after
the November 5 election. Motion carried.
Mayor Cone expressed the opinion that a successful businessman might be more ef-
fective as councilman or as mayor. Councilman Lassen said that he felt the dollar
amounts set in the proposed ordinance for campaign expenses were too high and that
disclosure of State-wide interests would discourage capable people from seeking
office. Mrs. Hayward asked about the policy of the Eugene Planning Commission. The
I City Attorney replied that there had been discussion by the Planning Commission but
that no formal action was taken. He said that the report to be brought back to the
Council will include the proposal presented to the Planning Commission.
Mr. Lassen moved seconded by Mrs. Lauris that Item 1 of the Committee. report be approved. Motion
carried.
2 2. Ordinance, Shoplifting - Dave Whitbread informed the Council of work being done by
the Chamber of Commerce in developing a proposed ordinance in an attempt to curb
shoplifting in the City. Councilman Purdy asked if the Chamber committee has con-
sidered raising funds to cover the cost of a police officer for patrol of retail
- businesses only. Mr. Whitbread said it would be suggested to the committee, and that
a draft of the proposed ordinance would be brought to the Council when it is completed.
Mr. Lassen moved seconded by Mrs. Lauris that Item 2 of the Committee report be received and filed.

3 3. Representation, Lane Human Resources Board of Directors - Mayor Cone announced the
t; appointment of Councilman McDonald as the Council's representative on the Board of
Directors of Lane Human Resources. The Board is being reconstituted to meet re-
quirements of the Green amendment to the OEO program and, according to procedure
adopted at a meeting of representatives of governmental agencies involved, Eugene
was delegated one representative. Mr. Lassen moved seconded by Mr.Wingard to approve
the appointment. Motion carried.
4 4. Catch Basin Modifications - Mrs. C1audeen Naffziger, 2005 Floral Hill Drive, requested
that the Council's attention be called to an accident she suffered when the front wheel
of a bicycle she was riding caught in the grating of a catch basin on 19th between
Emerald and Agate. The Public Works Department reported that there have been few acci-
dents of this type, but that vandalism is a major problem. The Department recommended
modification of grates to prevent bicycle wheels being caught and to prevent removal
and dropping of the grates into the basins. It was estimated there are about 7000
. basin grates to be changed at a cost of about $2.00 to $4.00 each. It was understood
the recommended program would be initiated.

5 5. Planning Commission Report - September 23, 1968
a. Vacation of Arthur Street from 24th south 888 feet, Leach - The Planning Commission
recommended approval of the street vacation requested by James W. Leach. The Plan-
. ning Director displayed a sketch showing the area to be vacated and explained that

school fence could be installed to be paid for out: of maintenance funds. Construction

7 11. Voter Pamphlet Candidate Listing - A report from the Finance Department was presented
: explaining that the names of council and mayor candidates can be rotated on the list-

, ings in the voter pamphlet. However, it would cost about $450 to $500 because of
time involved in sorting and keeping the pamphlets separate by wards so that council
candidates' names will be rotated in those pamphlets' going to the wards from which
the candidates will be elected. The Manager said the names are rotated on the ballot
but in the pamphlets all are listed on one page in alphabetical order for each ward.
Dr. Purdy moved seconded by Mr. Lassen to list the names in alphabetical order.

2 14. League of Oregon Cities Convention, November 17-19, 1968 - The Manager informed
Council members of the November 1 deadline for making reservations for the annua 1
meeting of the League of Oregon Cities at the Hilton Hotel in Portland.
3 15. Local Government Finance Seminar - Scheduled for 4:00 to 9:30 p.m., October 3, 1968,
at Lane Community College. Councilwoman Lauris said similar seminars have been held
throughout the State so that community leaders may become more familiar with the
problem s of financing local governments. She said the seminars were initiated at
the suggestion of Councilwoman Hayward and have met with great success. Mrs.Hayward
was congratulated."

4 1. Items from Council Members
a. Fencing West Belt Line Floodway - Councilman Lassen asked about the progress on
fencing the West Belt Line Floodway. The Public Works Director said bids have
been called on the project.
Mr. Lassen moved seconded by Mrs. Lauris that Item la of the Committee report be received and filed.
Motion carried.
The Public Works Director said no bids were received on this project and that it would probably be re-
advertised. He said, in answer to a question from Councilwoman Lauris, that City crews could install
I the fence if there is no response to the new bid call, but that installation by a contractor exper-
ienced in this type of work would be better.
5 b. Traffic Light, 13th and Agate - Councilman Wingard said it was his understanding
funds were budgeted for a traffic signal at the intersection of 13th and Agate.
He inquired about present plans for traffic control. The City Manager said funds
were budgeted for a light but after further discussion with the Campus Planning
Committee, trial of a four-way stop with overhead flashing light was recommended.
The Council did not favor the four-way stop and voted to retain the existing con-
trols. The Manager said students at the University are now requesting reconsidera-
tion, and the item is scheduled for the October 17 committee meeting.
- 6 c. Traffic Light, Coburg and Oakmont - Councilman Purdy inquired about installation
of a traffic signal at Oakmont and Coburg Road. The Public Works Director said
lights would be installed upon receipt of poles. Delivery is expected this week
or next.
Mr. Lassen moved seconded by Mrs. Lauris that Items lb and lc of the Committee report be received and
filed. Motion carried.
III The Public Works Director informed the Council that notification was given by the supplier of the
light poles that additional work on them is necessary and delivery will be delayed about 20 days.
He said because of this delay installation of the traffic lights at Coburg and Oakmont is not ex-
pected until about December 1.
7 d. Air Quality Control - Councilman Purdy said he thinks the criticism of the City
Council expressed by one of the mayoralty candidates is completely wrong with
regard to water and air pollution control. Dr. Purdy said he felt Eugene has
taken the lead in the State in this regard and asked the City Attorney's opinion
on the criticism of the City for not obtaining an injunction to stop field burning.
The City Attorney explained the legalities involved and why the City cannot act
against areas outside the City limits. He said there is no law being violated at
the present time, ~hat agricultural lands are exempted from State Sanitary
- Authority regulations, and that enforcement of existing regulations is practically
impossible.
, Councilwoman Hayward asked about field burning at Mahlon Sweet Field. The City
Manager explained that permission was given to burn a wheat field as the last
resort because birds attracted by seeds were hazardous to airport operations.
Mr. Lassen moved seconded by Mrs. Lauris to receive and file Item ld of the Committee report. Motion

The City Manager. explained that State law requires bidding on City leases, and the
bid procedure in this case was worked out with EIDC to assure financing through some
method other than assessment against abutting properties. Fut thermore, it would be
advantageous to have one paramount lessee rather than going to bids. for individual
leases each time a space becomes vacant. The Manager said EIDC has money available .
I. for investments of this type by which it earns money for Chamber of Commerce opera-
: tional purposes. It is not in position to loan the money because sufficient return

2 3. Sewers, State Street Area - Results of a survey of Ohio, Wisconsin, Dakota, and
Minnesota Street area were presented showing that owners of 55.1% of the property

administrative intern in the Finance Department. Mrs. Montgomery said Mr. Rhinevault and Mr. Gause,
City finance director, were a credit to the City.
3 4. Drainage Ditch~ Roosevelt Jr. High - A report from the Public Works Department was
presented estimating a cost of $26,000 to extend the tile for the drainage ditch
on Roosevelt Jr. High property to clear construction, and $79,100 to tile the entire .

drainageway to Amazon Creek. The Department recommended a report be requested from
. the County Health Department as to pollution in the waterway and suggested the
alternate of fencing the ditch to cut off access by children. Discussion has been
held in the past with the School District with regard to 50/50 sharing of project
cost. It was understood sharing of cost would be discussed further with the School
District after receipt of the County Health report before the item is brought back
to the Council for action.

1 5. Crest Heights Annexation - Mr. Joe Early asked about plans for installation of sewers
in the Crest Heights area. The City Manager explained that the Public Works Depart-

Sanitary Authority to comply with requirements for authorization to annex the area
under the "health hazard" annexation law.

on it once a month, and that it is probably held because of the freeze of funds in the last three
or four months.
