Adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned from the meeting held October 14, 1968 - was called to order at 7:30 p.m. on October 28, 1968 in the Council Chamber by Council President Lester E. Anderson in the absence of Mayor Cone. Other Council members present were: Mrs. Lauris, Dr. Purdy, Mr. Lassen, Mrs. Haywar9, and Messrs. 'McDonald and Wingard. Council- man Teague\was absent. Approval of the minutes ofth~ Council meeting held October 14, 1968, as mailed to Council m~mbers, was considered. The Director of Finance asked that the minutes be amended to reflect the following addition on Page 4 of Resolution 1583 - Awarding Sale of $7.7 million General Obligation Sewer System Bonds, Series D - with respect to payment of interest on redeemed bonds: 1 "Bonds to be in the denomination of $5,000.00 each and, maturing as follows: $320,000 on November 1 in each of the years 19.70 to 1989 inclusiye, and . $325,000 bonds on November 1 in each of the' years 1990 to 1993 inclusive, :i provided, however, that all bonds maturing on and after November 1, 1979 should be subject to prior redemption and call in inverse numerical order on November 1, 1978, and on any interest paymen~ date thereafter, upon payment pf the principal thereof together with interest -~ accrued thereon to the date'fixed for,redemption,plus a premium of two' per cent (2%) of the principal amount of each bond so redeemed on or before November 1, 1983." . Nr s . Lauris moved seconded by'Mr. Lassen that the October 14, 1968 Cbuncil minutes be so amended. Motion carried. NEW BUSINESS 2 I Councilwoman Hayward introduced Una He~derson, American F~eld Service exchange student from Bushmill, Ireland, who is attending South Eugene High School. , ' I 3 Back Yard Burning Ban - Councilwoman Hayward suggested the Council discuss and consider adoption of an ordinance banning all back yard burning. Councilman Lassen questioned whether the City can adopt controls separate from those of the State Sanitary Authority. It was understood the City Attorney would bring back an opinion~ .. 3 Overnight Parking on Streets - Councilwoman Hayward said she received complaints concern- ing overnight parking of log trucks in residential neighborhoods. The City Attorney said there are no restrictions with regard to overnight parking, except that the streets cannot , be used for storage of vehicles such as' campers, trailers, etc. It was understood the City Attorney would bring back an opinion with regard to possibility of restricting on- street overnight parking"of heavy vehicles in residential neighborhoods. , . 4 Human Rights Commission Report - Councilwoman Hayward asked if the Council could receive a monthly report from the Human Rights Commission or copies of minutes of its meetings. It was understood copies of the Commission minutes would 'be sent to Council members. . 5 Voters Pamphlet, November 5, 1968 Election - Councilman Purdy said he found it difficult to read the voters pamphlet because of the way it was stapled, and that more space should have been allotted statements on the various measures. 6 I Drainage, Elmira Road - Councilman Lassen asked if something could be done about the : drainage on Elmira Road between Louis and Waite Streets where a culvert was nor properly !I! replaced after sewer construction two years ago. He also asked about picking up broken glass on Belt Line at Barger Drive and Royal Avenue intersections, and whether Royal Avenue will be restriped soon. It was understood the Public Works Department would investigate. 7 Fire Hazards, Back Yard Burning - Councilman Wingard asked for a report on comparison of fire hazards during the periods when back yard burning was banned entirely during summer months and the present time. 8 Transportation Study - Mrs. John Northway, p~~sident of the League of Women Voters, presented the League's report "Mass Transportation in Eugene." She said the report is designed to provide information on the~resent tocal transportatio~ system, the type arid degree of service which should be considered in making a change, ~pd some of the owner- .: ship and financing possibilities. The City Manager reported that the Central Lane Plan- ning Council received notice that its application for funds for an areawide mass transit study has been approved. ! ,,' '1: '<.~ ,I '. \.~ " = ~ Councilman Wingard left the meeting. 9 Bids , Commercial Space, 10th and Oak - Two bids were received - one from Eugene Indus- trial Development Corporationfor $2.10 per square foot per year, and one from Nils B.Hult and Associates for $2.12 per square foot per year. It was recommended that the bid of Nils B. Rollcall vote. All . counctlmen present voting aye, motion carried. It was understood the lease ,agreement would be brought back to the Council for consideration. 1 Rebid, Sale of Property, 11th and Danebo - One bid was received from G C. Jastad for $11,350 based on rebids on a cash basis with alternate of cash and property. The Finance Department recommended accepting Mr. Jastad's bid. Mr. Lassen moved seconded by Mrs. Lauris to sell the 11th am Danebo property to G. C. Jastad for $11~350;00;' Rollcall vote. All councilmen present voting aye, motion carried. 2 Appeal, Conditional Use, 938 Jefferson - The Planning Commission granted a conditional use permit to James H. Lynch for operation of a private education clinic (counseling services) in the R-3 zone at 938 Jefferson Street, with review of the operation after one year. A petition signed by several residents of the neighborhood appealed the Planning Commission decision. Frank Lemons, 1204 Lincoln Street, speaking for Mr. Lynch, . said he contacted neighbors who originally objected and explained the proposed operation, but was unable to contact all those signing the appeal. He said he would like to hear specific objections. Mr. Al Pierce said he had no specific objections but understood there was no longer interest in the property involved. Mr. Lemons explained there was a change in plans, but said if the conditional use permit is approved negotiations on the property will be closed immediately. The Planning Director said Mrs. Gertrude e Kaufman, 996 Jefferson Street, wished it known she favors the proposed counseling service center. Mrs. Lauris said she is a member of the counseling service Board of .. Directors and is in favor of the proposal. Dr. Purdy moved seconded by Mrs. Hayward to uphold the Planning Commission decision granting the con- ditional use permit. Motion carried. 3 Harlow Road Right-of-way, Lethin - The City Attorney said $3,570, the appraised value set at the time of filing, was offered in a condemnation suit for right-of-way at 3125-3127 Harlow Road owned by Ronald R. Lethin. Mr. Lethin asked $5,775, the value set by his appraiser. The City then requested a third appraisal which set a value of $5,700. The City Attorney said Mr. Lethin will accept $5,470 and recommended buying the property for tha t amoun t . Discussion centered on methods of appraisals, with Councilman McDonald questioning the .. disparity in the City's two appraisals. Dr. Purdy moved seconded by Mr. Lassen to buy the right-of-way for $5,470.00. Rollcall vote. Legislature/Council, Wingard - Councilman Wingard said he would retain his position on the Council after the election if he is elected to the State Legislature. He said he felt he could do justice to both jobs, serving both the City and this dis- trict in the Legislature on a high level. 4 2. Greetings from Council President, Baulkham Hills Shire Council, New South Wales - A letter was presented as received from a member of a team of Rotarians visiting this '. Rotary District in return for a visit made to New South Wales by local Rotarians a few years ago. Mr. Fred Elliott, city finance officer from Blue Mountain Shire, was , introduced and briefly described the local governmental operations in his Shire as compared to Eugene. 5 3. Traffic Engineer, Williams - The City Manager introduced Mr. Al Williams, new traffic engineer for the city of Eugene. 6 4. Payment in Lieu of Taxes, Lane County Housing Authority - A check in the amount of $6,332.25 was presented from Lane County Housing Authority for payment inlieu of taxes on properties under their management in Eugene. Oregon Daily Emerald Editorial, Police Department - Copy of a letter from Charles Porter, attorney, to the Editor of the Oregon Daily Emerald was 'presented. Mr'."Porter ' objected to the editorial criticism of the Eugene Police Department and suggested a public apology was due. 3 7. Field Burning Injunction - A letter was read from Paul Hoffman, mayoralty candidate, requesting time on the Council agenda to present a sequence of steps that should be taken to stop grass burning by legal injunction. The City Manager asked if the Council wished to discuss the matter at this meeting, put-it on a future agenda, or refer it to the staff before Council discussion because of its technical nature. Councilman Purdy expressed the opinion that it is wrong for the Council meetings to be used as a forum for po1itica1'candidate~'to express ideas. He said official Council meetings should not be used for that ,purpose unless all mayoralty and council candidates were heard at the same time. Mrs. Hayward remarked that the matter had r- been initiated by the Council and that Mr.~Hoffman should be allowed time to present tJ his ideas. Councilman Purdy said he brought the matter to the Council because of the accusation that it 'had not acted, and because he felt the City Attorney should be allowed to present an opinion as to why nothing could be done. .' ; , Councilman Lassen said he felt the, staff should have,the opportunity to look over . Councilman Wingard'returned to the meeting" Councilwoman Lauris said one thing which Mr. Hoffman suggested is that,dates be set for field burning and that it be limited to a two-week or shorter period of time. 4 8. Traffic Control, 13th and Agate - The City Manager reviewed ,the history of traffic I] controls at the intersection of 13th and Agate ?s the'result of a reqgest from Mr. Dick Jones, ASUO president, for public review. The Manager said the City has never felt signals were the answer at this'intersection because pedestrians do not observe signals at this and other intersections in and around the campus. He said traffic signals would create greater hazards because:of the habit of students and faculty to wander aGross the streets at 'any time and any place. The staff recom- mendation at this time is for installation of four-way stop signs. Sketch maps of the intersection were distributed'to Council members. Dick Jones said the ASUO is considering a proposal for control at the intersection .~ based on traffic flow on 13th because of increased traffic and increased hazards. A formal presentation will be made 'later. He 'said they concur in the four-w?y stop recommendation. The City Manager suggested that the new traffic engineer work with them. John Lal1as, director of Campus Planning, called Mr. Jones' attentio~to the fact that the recommended four-way stop,is not electric. Mr. Jones withdrew his con- currence in the recommendation and introduced Larry Chadwick who outlined the ASUO ~ proposal for an overhead, four-way flashing red light rather than stop'sign's. ' Mr. 'Lal1as said,the recommended use of'four-way stop' signs' is appropriate, but he felt the flashing red light would create a higher degree 'of visibility. The City Manager explained that it was the staff's intent in recommending the four- way stop signs that they be instal1ed'on a trial basis, with the'idea that they will reso1ye, the major part of the safety program. Councilman Anderson said this problem is recognized and is being considered in the ESATS program. Councilman Purdy explained that some years ago the City Council recommended that the University try to provide an alternate route, but that the University has not brought back any recommendation. A vote was taken on the motion as stated, and motion carried. Mr. Lassen moved seconded by Mrs. Lauris that Item 8 of the Committee report be approved. Motion carried. Councilman Wingard said from his observation it would appear the median strip causes the traffic problem at the 13th and Agate intersection. 1 9. l~% Limitation Measure/City Budget - The City Manager submitted a list of reductions in City operations which. would be necessary should the l~% property tax limitation It measure be adopted. It is estimated the city of Eugene would be faced with a reduc- tion of $1,100,000 in revenues. A further loss of about $140,000 would be anticipated because of the limitation on tax revenues to fire districts, and the resulting in- ability to collect revenues from those districts under existing fire protection con- tracts. The Manager said if the Legislature in its next session does not provide replacement revenues, consideration should probably be given to a countrywide sales . or income tax, increasing license fees, charging for City programs, or the possi- bility of enacting a gross profits licensing tax similar to Portland's. He said it . was his understanding that all four mayoralty candidates are in accord on opposition to the l~% limitation measure. Dr. Stansbury, budget committee member, said he saw no objections to the budget reductions as presented. Dr. Purdy moved seconded by Mr. Lassen to go on record recommending that the voters defeat the l~% property tax limitation measure. Motion carried. Patrick Flynn said that labor in the State and in this community is opposed to the measure and that the Fire Fighters are attempting to bring to the attention of the people the curtailment of services which would be necessary if it is adopted. Mr. Lassen moved seconded by Mrs. Lauris that Item 9 of the Committee report be approved. Motion carried. " The City Manager said the most recent estimate of loss of revenue to the City, based on a formula which would distribute $3.00 of the $15.00 per $1000 true cash value to cities, 'is $1,135,000. He said if the l~% measure is adopted, and the City's proposed levy to make up the lost revenues is adopted, it is estimated there still will be only $200,000 leeway to cover the inflationary trend for next year. 2 10. Bids, Commercial Space 10th and Oak Parking Structure - Two bids were received on the 10th and Oak commercial space - one from Eugene Industrial Development Corpora- tion for $2.10 per square foot per year, and one from Nils B. Hult and Associates for $2.12 per square foot per year. The City Manager said a proposed contract with - Hult will be brought to the Council for consideration. The contract will be for ten years with option to renew for ten years, terms to be renegotiated at time of renewal. No action was taken. 3 11. Bids, City Property at 11th and Danebo.- One bid was received from G. C. Jastad for $11,350 on the new bid call on sale of ,this property. The Finance Department recom- mended acceptance of the bid price. Dr. Purdy moved seconded by Mr. Wingard to sell the property to G. C. Jastad for $11,350.00. Motion carried. . 4 12. Petition, Pedestrian Traffic Signal, Highway 99N at Gilbert Shopping Center - Copy of a petition bearing about 500 signatures was received as presented to the State Highway Department by R. Glade Shimanek for Mr. and Mrs. Donald E. Harvey, contract operators of the postoffice station across the highway from the Gilbert Shopping Center. The petition requested installation of an electrically controlled traffic signal on Highway 99N for people crossing from the Gilbert Shopping Center to the postoffice. The City Manager said the staff feels the signal is not justified, that the postoffice probably should be moved across the street. No action was taken. Abatement, Dwelling at Barger and Empire Park Drives - The Building Department tecom- mended abatement of a building in theownership of Windsor Graville, and located at the northwest corner of Barger Drive and Empire Park Drive. The report indicated , that the Department has tried since April 1968 with no success to get the owner to rehabilitate the building or demolish it. Mr. Lassen moved seconded by Mrs. Lauris to adopt the resolution. Mr. Bob Suess reviewed the history of his acquisition of the property and his inquiry concerning possible vacation of Tyler Street at this location. He asked delay of the abatement because of the mortgage on the property. The City Attorney said notice of abatement was given to the mortgage holder. The report from the Building Department was read listing existing hazards on the property. Mr. Suess said he had con- siderable constructionmaterial stored in one of the buildings which would have to be moved, tha t the building is in good condition, but that other buildings on the property should be taken out. Dr. Purdy moved seconded by Mr. Lassen to table the resolution until Mr. Suess "and someone from the Building Department inspect the property and reach agreement on what is to be done.
