I held October 28,1968. -,was called to order,at 7:,30 p.m. on November, 13, 1968 in the Council Ghamber ,
II by His Honor Mayor Edwin E. Cone with the following counciilmen present: Mr. Anderson, Mrs. Lauris, II
il Dr. Purdy, Mrs. Hayward, and Mr. Teague. Councilmen Lassen, McDonald, and Wingard ,were absent. I

1 I Councilwoman Hayward asked if anything had developed with regard to the drainage ditch I!
I on ..Roosevelt Jr. High, ~roperty., The City Manager' said the City ,is' awaiting a report
I from the County Health Department on results of sampling ,of water in the ditch. ,

2 I, Mayor Cone recognized the presence of Professor Nestvold and a class of journalism , I :1
!: students :from the University of Oregon.." Councilman-elect Ivan Gribskov w,as introduced. I

3111 Management Agreement, Airport Parking Company '- Th,e City Manager explained amendments 'I'
I to the ,agreement, copies of which were previously distributed to Council members, ,
,I covering operation of the parking space ~or auto,mopiles at Mahlon' Sweet Field. The .
Ii amendments covered operation of additional parking space if and when it i's needed, ,;
I: changing the ,$8,000.00 Parking, 'C!ompany investment to approxima,tely $9,000.00, and...
11 added parking rates of 109 per 20-minute period with a maximum of one hour to accommodate I ~
II short-term parking. -
Ii Councilman Purdy asked if maintenance of the parking facility "at City's expense" as
:~ covered under Paragraph 2, page 2" of the agreement ,would be paid from gross or net I
'Ii receipts. The City Attorney explained that the agreement guar'antees the City $10,000 II
Ii annually and that maintenance costs ,would come from gross receipts. Councilman Andersqn II
I suggested the wording be changed to ".. .at City's expense from the gross, receipts ,from c' II
I the operation of the parking fad. Ii ty." "
I Councilwoman Lauris asked that the Parking Company be informed of the City's policy 1
Ii of trying to hire from minority groups (Paragraph 2(b)), and that the City, under !I
II Paragraph 2(c), request appropriate landscaping. The City Manager said landscaping .
i would be part of the City's investment unless the contract stipulates otherwise. ~

!l Mr. Anderson moved seconded by Mrs. Lauris to approve the agreement with Airport Parking Company,
I~ changing the language in Paragraph 2 as suggested to call for payment of maintenance costs from gross
Ii receipts.
il Councilman Anderson' asked at what point it would be determined expansion is needed. I
11 The City Manager explained that the agreement provides terms of expansion will be nego- i
II tiated between the City and the Parking Company, and will be mutually initiated. ,

\1 Dr. Purdy moved seconded by Mrs. Hayward to amend the contract to include landscaping. 1.-

I Professor Nestvold asked when the contract would be effective. The City Manager re- :
II plied that the agreement itself would be effective upon a favorable vote of the Council I
and signing by City officials, and that paid parking would commence as soon as the im- I!
II
provements are accomplished. II
A vote was taken on the amendment to include landscaping, and motion carried. !.
II A rollcall vote was taken on the original motion as amended, and motion as amended carried, all I AI

Dr. Purdy reviewed plans discussed ,some years ago between the University, Sacred
Heart Hospital, and Northwest Christian College for closing 13th which was contingent

traffic between Agate and Villard, and building. a bypass from 13th and Alder to 11th
and Kincaid. ' Tlfe University, he ,said, wa,s to' come ,back with a solutiop ,to, the problem
and he felt until there is a commitment from the University, 13th should remain 'open--
through the campus.
Councilman Anderson. suggested that, since traffic on 13th Avenue is part of a total I
pattern and. consid~red in the Eugene-Springfield Area Transportation Study, the I

The City Manager said, the traffic pattern: of the €t).tire area will be considered by
the Traffic Engineer in working with the University students on the 13th and Agate

Councilwoman Lauris reiterated her intent in suggest,ing the closure of 13th was to try for some one-
way movements to make it possible for motorists to drive around the block inane direction, with
the possibility of some head-in parking spaces. Also to' encourage motorists to-use University and
18th to go onto the campus. 'It was: understoqd the' two' sketches'she pre~ented depicting the sug-
gested traffic movement would be considered by the Traffic Engineer in his review of the entire area. -

2 2 . Leash Law - Councilman McDonald moved that the Council enact astrict leash law, giving
the City authority to go upon pr~vate property for'dogs not:on a leash or confined to
an enclosure, subject to the City Attorney's review with regard to legality of such an
ordinance. The Assistant. City Attorney said an ordinab.ce on dog control is being pre-

3 3. Council Self-Study Program - Coun~ilman Anderson suggested the Council undertake a
self-study program through a small group:comprised of some members of the present
Council, newly elected members of the Council, members of various boards and commis-
sions, and lay people involved with Council action, and with the City Manager and
City Attorney. Mr. Anderson s~id his suggestion was not made with the idea of a
Charter revision,9ut to determine how the Council could be of better service to
the community. The recommendations he proposed to be made by the group were with
regard to whe~her present procedures provide for thorough consideration of issues
coming before the Council, whether adequate information is available prior to meet- .\
ings, whether everyone is given the opportunity to make a good presentation and has
enough information to do so, whether rules anq procedures of conduct of Council meet-
ings can be improved, notification procedures for those involved with City business, "'"'
revision in organization of agenda to possibly eliminate matters of-lesser importance, I
delegating some authori:1:y'to 'give the Council time for more important issues, possibly
holding meetings more frequently because of greater volume of Dusiness, etc, No
action was taken.

Councilman Anderson suggested tentative meeting dates of November 21, December 2, and December 16
. for work sessions. He suggested the first meeting be for present Council members, Mayor Cone, City
Manager, and City Attorney to outline subject areas to cover and prepare an agenda for the ensuing
meetings. The City Manager was requested to prepare a survey of items considered by the Council.
1 4. Petition, Sewer Construction Practices and Assessment Procedures, Palomino Drive _
A petition from residents of Palomino Drive was read requesting that the City re-
pair damage to sidewalks and restore them to the condition existing prior to sewer
construction on the street, and that the City adopt policies which will result, in
more equitable treatment of property owners on similar projects where assessment
does not take into account the greater damage to properties on the side of a street
on which the sewer is constructed. Also read was a report from the Public Works De-
partment outlining contract requirements and listing items to be corrected by the
contractor prior to release of the project.
Mrs. Robert Abel, 307 Palomino Drive, and Mrs. Justin Sauntry, 235 Palomino Drive,
said property owners were not informed of many other factors involved in the sewer
f construction which should have been brought to their attention. They described
the condition of the sidewalks in the area and asked if the City would be responsible
for repair of future damage resulting from present conditions. Considerable dis-
cussion followed with regard to the contractor's responsibility and those items
felt to have been in existence prior to construction, whether pre-existing condi-
tions can be documented, how to determine if present conditions could result in a
. dangerous condition or damage to the usefulness of the sidewalks.
. Mrs. Lauris moved seconded by Mr. McDonald to hold to the list of items prepared by
~'" the engineers to be completed by the contractor and take note of suggestions in' the
petition for information on future projects. Motion carried.

2 5. Pay for Unused Sick Leave - Fire Fighters Local 851 requested reimbursement for un-
used sic~ leave for employes who retire or otherwise terminate employment with the
City under honorable conditions. The City Manager explained that the entire manual
on employe rules and regulations is being rewritten, and he recommended that the
Fire Fighters' request be considered by the Council when the other regulations are
considered. He said that at this time the recommendation would be not to treat sick
I leave as earned income, but the policy on this item would be better discussed at the
same time other rules and regulations are discussed.
Pat Flynn asked that the Council consider the sick leave policy since, he said,
there is none at the-present time, and called attention to changes in the rules
and regulations which were first presented about 18 months ago and have not yet
been a matter of discussion.
The City Manager read the policy which exists as a part of the present employe manual
and which states that sick leave is provided as an insurance against an employe's
illness or inability to work and is in no way to be used for any purpose other than
- actual illness or accident causing personal disability. He said the Fire Fighters
were contacted by letter asking them to document why this policy change should be
considered, but the only response was to ask that it be considered by the Council.
Frank Jackson also called attention to the delay in rewriting the employe rules and
regulations. The Administrative Assistant eXp;lained the procedure followed in re-
writing the manual. He said it has now been reviewed by the staff and department
heads and is being printed for distribution and review by the employes themselves.

Patrick Flynn requested that any change in the policy which results in payment for unused sick leave
be made retroactive to the termination of Mr. Richard Small who left City employment May 1, 1968.
Mr. Flynn said the request for change in present policy was initiated at the request of Mr. Small.
The City Manager said there would be no objection to including consideration of Mr. Small if any
change in policy is made.

. David Hunt, Renewal Agency director, explained the status of the application for funds. He said the
Agency is fairly sure the Department of Housing and Urban Development will approve the application,
and the public hearing will be rescheduled, probably in December, when notice of approval is received.
