Regular meeting of the Common Council of the city of Eugene, Oregon was called to order by Council
President Lester E. Anderson in the absence of Mayor Cone at 7:30 p.m. on December 9, 1968 in the
Council Chamber with the following other councilmen present: Mrs. Lauris, Dr. Purdy, Mr. Lassen,
Mrs. Hayward, and Messrs. McDonald, Wingard, and Teague.
Minutes of the Council meeting held November 13, 1968 were approved and mailed to Council members.

The Public Works Department recommended, with the City Manager concurring, that the contract be
. awarded to the second low bidder, Wildish Construction Company, for apron and runway overlay and
taxiway renovation on their alternate bid price of $325,125.10, and to Steeck Electric for taxiway
.. lighting on their bid price of $60,634.00, subject to approval by the Federal Aviation Administration.
A report from the Public Works Department was read with regard to an existing contract with C. J.
Montag & Sons, the low bidder. The City Manager said it would be in the best interest of the City
not to accept another contract from Montag until problems are resolved on the existing contract.
He said Montag was informed of the recommendation, which resulted in the letter addressed to Council
members explaining Montag's position.
Councilman Lassen asked if all the cost of the project is covered by the FAA grant. The Manager
said not, and that Federal money would not cover the difference between the~low bid and second
low bid.
Councilwoman Lauris asked if the delay on Montag's present contract was caused by weather. The
. Manager said it was a major factor and was taken into account in making the recommendation to award
to the second low bidder. The Assistant City Engineer reviewed the history of the present contract
giving award and completion dates; extension, etc. In answer to questions from Councilmen. Purdy and
Lassen, the Public Works Director compared bids on the taxiway lighting on the first bid call with
the single bid received at this opening.
Mr. Wingard moved seconded by Mr. Lassen to hold action on the contract award to allow discussion
at the Thursday, December 12, committee meeting. Motion carried.
It was understood copies of the Public Works recommendation with material concerning the present
Montag contract would be given Council members prior to the Thursday meeting, and that the Montag
e people and other interested bidders would attend the committee meeting.

equitable rates be given to occupants of low-cost housing ,units. The Manager said a
letter would be addressed to Teleprompter inquiring about that possibility.
4 4. Commendation, Parks Department- A letter from Mrs. Harry M.'Lichty, 1035 Jefferson' .
Street, was presented commending, the Pa'rks'Department for the manner in which crews

5 ,.5. Alcoholic Rehabilitation Council - Copy of a memo from the Police Chief was pre-'
sented'with regard to contact by members of the Reh'ab.ilitation.Coundl with al- I
coholics in'jail. The memo, resulting,"from an: inquiry~from' Councilwoman Hayward, I
indicated arrangements' have been made for representatives of: the Council.' and Al-
I coholics Anonymous to consult with those charged with drunkenness or drunk driving
who are still in jail at 6:00 p.m. each Sunday. I

6 6. Parking Meter Receipts - A report,ftbm the Finance Director was presented estimating I
on-street parking meter receipts in the downtown area to be $9,000 to $10,000 for I
the two weeks preceding Christmas Day. 1

7 7. Recognition, Eugene Employes Association -.A letter from the Eugene 'Employes Associa- I
tion was' read requesting official'Council recognition of the Employes Associat'ion I I
for purposes as outlined in their Constitution - (1) ,To 'foster a spirit of loyalty \1 I
and service to the City, (2) to provide more direct communications between all of I
the'employes in the different departments' and division's of.the ,City, and (3) to Ii
promote the welfare, desires, and needs of all City employes. They'arso requ~sted
Council approval of their Constitution. Copies of the letter together with the I
I
Constitution were distributed:with copies of a'proposed'resolution which would I
give the requested recognition if adopted. .TheCity Manager said 'the resolution'does I
not instruct collective bargaining'but w~ll allow representatives of the:employes to I
be acknowledged to speak for employes in!discussion of City policies affecting employes. -

8. Planning Commission Report - 'November 12, 1968
Ii a. Annex area both sides of Floral Hill Drive south of 20th, deJung-Weber - The
Planning Commission recommended annexation of about 1.53 acres at 20th and -- I
lj Floral Hill Drive petitioned by John deJung and James Weber. The Commission ~'

created by the deJung-Weber annexation. There are ,failing septic tanks in' 1

II the area. The Public Works Director said that one parcel on the east side of I t
Floral Hill Drive cannot be 'served by gravity sewer lines, and recommended the
annexation be made with the understanding the property owner would have to
provide a pump system to the City sewer or that that property could not be served. I.
Mr. Wingard moved seconded by Dr. Purdy to approve the annexation with that I:

1 9. Planning Commission Report - November 25, 1968
a. Rezone to C-2 area on north side of Broadway between Hilyard and Alder,
Campbell - The Planning Commission. recommended rezoning the area from M-2
to allow construction of a motel on the condition that the Building Depart-
ment is instructed to issue no building permits for that property until the
Planning Commission is informed and agreement reached between the City and
Mr. Campbell with regard to phasing out of the existing ice plant. The
Manager reviewed the history of this rezoning request and said approval would
make the ice plant a non-conforming use and prohibit the issuance of any build-
ing permit for that property. He said no commitment has been made relative to
a time limit on the operation of the ice plant, but the Planning Commission
feels a C-2 zone is better from the City's standpoint.
Mr. Anderson moved seconded by Mr. Wingard to approve the rezoning on the
" conditions set forth by the Planning Commission. Motion carried.
Mr. Lassen moved seconded by Mrs. Lauris to approve Item 9a of the committee report.
The City Manager, in response to a question from Councilwoman Lauris, said no time limit was set for
. phasing out operation of the ice plant. He said it is a one-man operation, and Mr. Campbell plans to
cease operation of the plant when that one man retires.
. A vote was taken on the motion to approve, and motion carried.
2 b. Street Opening, 5th west from Bertelsen Road - Lane Coun~y requested opening
of 5th Avenue west from Bertelsen Road to give access to properties severed
from public right-of-way by the County. The Public Works Director requested
that the City's acceptance of dedication of this right-of-way be subject to
the County's being responsible for drainage of the area.
Dr. Purdy moved seconded by Mr. Anderson to accept the right-of-way from the
County subject to working out agreement on responsibility for the drainage.
Councilman Lassen asked if ditches to the west would be cleaned out. The
Public Works Director said nothing can be done by the City until ~he Soil
. Conservation Service program is s.tarted downstream.
A vote was taken on the motion as stated, and motion carried.
Mr. Lassen moved seconded by Mrs. Lauris to approve Item 9b of the Committee report. Motion carried.
3 10. Echo Hollow Pool, Change Orders - The Parks Director and architects for the Echo
Ho llow Poo 1 recommended ,change order s add ing the fo llowing: (1) Better qualtiy
of pool deck equipment, mainly guard chairs and diving stands - $6,437.00; (2)
Increase tint in glass on west wall and add tint in glass on east wall, originally
plain -$4,759.00; and (3) Change 4-foot acoustical grid in natatorium to 5-foot
. grid - $1,710.00. The City Manager said the proposed additions are within the
amount budgeted for the project and are items cut from the original plans to
assure the building would be constructed. The Parks Director said these items,
if they are to be included, would have to be installed now or not at all.
Dr. Purdy moved seconded by Mr. Lassen to approve the change orders submitted.
Motion carried.
f) Councilman Lassen asked if other. additions are anticipated at this time. The
Parks Director replied that as the project proceeds and it appears savings are
being made, other items cut from the original plans could be put back in so long
as the overall project cost is not exceeded.
Mr. Lassen moved seconded by Mrs. Lauris to approve Item 10 of the Committee report. Rollcall vote.
All councilmen present voting aye, motion carried.
4 11. Bids, Sidewalk on McLean Boulevard - The Public Works Department recommended award
of contract to R. C. Parsons at the low bid price of $1,392.49 for construction of
sidewalk on McLean Boulevard from Chambers to McKendrick. Mr. Anderson moved
seconded by Mr. Lassen to approve the recommendation. Motion carried.
5 12. Bids, Fence, West Belt Line Floodway - The Public Works Department recommended
. award of contract to Fred Stubbert at the low bid price of $3,644.20 for construc-
:./ tion of a fence along the West Belt Line Floodway. Councilman Lassen asked about
l maintenance of the fence and whether there would be access to the ditch. The
Public Works Director said maintenance would be the City's responsibility and that
the matter of access has not yet been resolved.
Mr.. Anderson moved,:seconded by"Dr~ Purdy to award the contract as recommended.
Mr. Lassen asked if there was provision for reimbursement for existing fences
constructed by individuals. The Public Works Director said-it was the attorney's
recommendation that, because of legal entanglements in trying to work with prop-
erty owners on a fence, the City build the entire fence itself and maintain it.

4 d. Parking Prohibition, 30th east of Willamette '- The Public Works Department I
recommended prohibition, of parking on the ,north side of :30th Avenue 'e~st 'from I
Willamette Street 325 feet. The City Manager said the narrow paving and con-
venienc~ for tenants of the apartment house to Rark ?n the street resu~ts i~
congestion which does not permit .traffic to go through. . He said there is
off-street parking which is not being utilized.

1 15. Ambulance Rate Increase, Committee - The Eugene Ambulance Service requested base
-: rate increase in both Springfield and Eugene from $28.00 to $35,00 plus auxiliary
"= charges. Springfield has asked their Finance Director and a councilman to bring
their Council a recommendation, and it was suggested a member from the Eugene
Council and the Finance Director meet with Springfield for a joint recommendation.
Dr. Purdy moved seconded by Mr. Lassen to appoint Councilman McDonald to meet
with the Springfield people. Motion carried.
Mayor Cone suggested the use of a Volkswagon type vehicle at an investment of
about one-fourth or one-third that of the vehicle now used by the Ambulance
Service. He said this would make provision for less expensive service for those
people in the community who cannot afford the services of the more expensive
vehicle. It was understood this suggestion would be broached at the joint com-
mittee meeting and a report brought back.
Mr. Lassen moved seconded by Mrs. Lauris to approve Item 15 of the Committee report. Motion carried.
. Councilwoman Lauris said representatives of the insurance adjusters organization had informed her they
wish to be heard on the request for increase in ambulance rates. The Manager said there would be a
public hearing at the time the rate increase is considered by the Council.

. The City Manager presented another application for renewal - a Retail Malt Beverage Class A license
submitted by George McKenzie for Sam's Place, 825 Wilson Street.
Mr. Lassen moved seconded by Mrs. Lauris to recommend approval of the new and renewal applications,
including that for Sam's Place. Motion carried.
3 17. Progress Pavrnent, Winn & Co. - Authorization was requested for payment of
.. $10,000.00 to Winn & Co., as partial payment for 1967-68 audit of the City's
books. Mr. Anderson moved seconded by Mr. Lassen to allow the payment.

6 Resolution No. 1602 - Requesting Lane County Housing Authority to impose six-month residency
requirement prior to applying for 10w-cos't leased housing, was ~~bmitted apd read in full.

Councilman McDonald asked for reconsideration of the six-month residency requirement. He reiterated I .
his position.that people moving ~nto Eugene under rehabilitation programs, etc., would be penalized
by such. a requirement:' Council President Anderson said it was the Joint Housing Committee's intent,.
and the Council's, to set general policy; with specific cases to be given consideration when required.
The City Manager said the resolution itself does not specify any variations, but that. the letter
transmitting the resolution to the Housing Authority could convey that the City's intent in requesting
the six-month residency requ~rement was that the resolution be accepted as general guidance and not
bind the Authority with regard to not allowing any exceptions.. He exp1ain"edthat the fina1.decision
on imposing such a requirement is the Authority's; the City is merely requesting that it be given I,
consideration.

The reworded lease also sets forth the time in relation to completion of the structure when the lessee
would start receiving credits on the advance payment he has made for the space. Resolution No. 1605 I
revokes Resolution No. 1600 and authorizes the modified lease. I

The City Manager explained the agreement authorized by this resolution would provide for loan of
~ police services, one to the other, when requested by either Salem or Eugene.
Mr. Lassen moved seconded by Mrs. Lauris to adopt the resolution.
In answer to questions from Councilman Wingard, the City Manager said there would be no funds involved
except in those instances when officers are required to stay over, then the borrowing city would pay
housing costs. The loaning city retains control of its officers and would have authority in making a
loan, denying it, or putting limitations on length of stay.
A rollcall vote was taken on the motion to adopt theresolution, and motion carried, all councilmen
present voting aye.
1 Resolution No. 1607 - Transmitting to Planning Commission Zoning Ordinance Amendments re: Special
Setback, Judkins Point; Conditional Use in Var~Qus Districts; for hearing before the Planning Commission
on January 7, 1969; was submitted and read in full.
Councilman Lassen asked if the amendment on special setback on Judkins Point referred to a specific
. property. The Planning Director replied that it referred to an amendment removing from the zoning
ordinance sign setback regulations, since they are now covered by the recently adopted sign code.
Mr. Lassen moved seconded by Mrs. Lauris to adopt the resolution. Motion carried.
. 2 Resolution No. 1608 - Authorizing Revocable Permit for' Private Sanitary Sewer Connection at 42
North Polk Street (Rose) was submitted and read in full.
I. The City Attorney explained that the owner of property at 42 North Polk wishes to connect a private
sewer line to the trunk. He said when laterals are constructed, the line will then be connected to
the lateral.
Mr. Lassen moved seconded by Mrs. Lauris to adopt the resolution. Motion carried.
Upon motion duly made, seconded, and carried, the meeting was adjourned to Wednesday,
December 19, 1968, for public hearing on Eugene Renewal Agency plan for the downtown area.
