Withdrawal Rezone Request, Cheshire between Lincoln and Lawrence, McMillan - The petitioner requested .withdrawa1 of his, request to rezone the area to RG Garden ,Apar,tment Residential ,and refund of .the,$50.00 filing ,fee. The.petition was filed in October 1967 and action deferred pending completion of the General Plan. The Planning Commission recommended approval'of the request. In making the recommendation ,the Pl~nning Commission ~equeited that'the'School'Bo~id'be~asked' to consider retaining the property in public ownership for use by governmental agencies in the future. The City Manager. said it was understood it is the intent of the School Board to retain the land and lease it for commercial use since they I feel it eventually should be a part of the civ~c center. Dr. Purdy~moved seconded f by Mr. Teague t~, ~ezone the property C-2 with the ~nderstanding the'School,Board' will be requested to consider keeping it in public ownership to eventually become a part of the civic center. Motion carr'ied. ~ I . 12/23/68 - 1 " Ii ,~,~ 479 ..."., I' 12/23/68 - - -- ---- I d. Annexation of area on south side Cal Young Road east of Norkenzie Road, Century . Homes - The ~lanning Commission recommended approval of the annexation subject to conditions of the Oakway Planned Unit Development. In its recommendation the Planning Commission asked that the final reading of the annexation ordinance be delayed until final Planning Commission approval of Phase I of the Development. The Planning Director pointed out Phase I on a map and explained procedure for development and annexation of the entire area. In answer to questioning from Councilman Purdy, the Planning Director said an additional 20 feet of right-of-way for Oakway Road is required as a condition of approval of the development. He said the developers would be required to pay for improvement of Oakway Road as well as Cal Young Road and that that requirement could be part of the conditions for the planned unit development approval. He said the extension of Norkenzie Road has not yet been resolved but that it will be prior to the phase of development where it is concerned. ,.. Mr. Wingard moved seconded by Mr. Lassen to approve the annexation as recommended . and call a public hearing. Motion carried. Mr. Anderson moved seconded by Mr. Lassen to approve Item 2d of the Committee report. Motion carried. 2 e. Renewal Plan, Central Eugene Pm iect - The Planning Commission recommended ap- proval of the Central Eugene Project Renewal Plan as prepared by the Eugene . Renewa 1 Agency. It was understood action on the Plan would be taken at the Council meeting on December 19, 1968. .' No action was taken (see Council minutes December 19, 1968). 3 3. Planning Commission Report - December 16, 1968 a. Joint Housing Committee Report - The Planning Commission recommended adoption of the Joint Housing Committee report dated December 16, 1968 in its entirety. The Joint Housing Committee requested Council action supporting proposals for State legis la tion (1) to amend the Homestead Property Tax Exemption Act to allow an annual gross family income not exceeding $3500 and to provide for disabled persons under 65 years of age to obtain relief under that Act; (2) to enact a law requir- ing all State agencies, cities, and counties to give relocation assistance and make relocation payments to persons displaced by public projects; (3) to enact a law requiring State agencies to comply with local codes; and (4) to amend State .. law to enable cities to co-operate with non-profit or limited-dividend corpora- tions as they are allowed to co-operate with Housing Authorities. Mrs. Niven explained the type of assistance which is intended under the proposed legislation requiring assistance from local public agencies. There was general discussion with regard to paying costs of such a program, and whether such legislation would be contrary to the traditional system of home rule. It was agreed the Housing Committee is asking approval of the general concept of the proposed legislation and that specifics as to costs, type of legislation, whether it can be accomplished, etc., would be brought back at a later date. - Dr. Purdy moved seconded by Mrs. Hayward to support the proposal for State legislation which would increase exemption under the Homestead Property Tax Exemption Act to $3,500.00. Motion carried. Dr. Purdy moved seconded by Mrs. Hayward that the proposal for State legislation which would require all State agencies, counties, cities, and public corporations to give relocation assistance and make relocation payments to persons displaced it by public projects be referred to the staff for information with regard to effect such legislation would have on the city of Eugene. Motion carried. Mr. Wingard moved seconded by Mr. Lassen to support proposed State legislation which would require State agencies to comply with local codes. Motion carried. Mr. Lassen moved seconded by Dr. Purdy to support State legislation which would enable cities to co-operate with non-pr-6fit or limited-dividend corporations as they no co-operate with Housing Authorities. Motion carried. The Joint Housing Committee also requested the City to provide for a Housing Expediter to co-ordinate howing activities in the City for low- and moderate- income persons, his responsibilities to include collecting and making available specific information on supply and demand of housing, to offer guidance on avail- . able Federal housing programs, and to undertake a permanent housing inventory. ~~ Considerable discussion followed with regard to whether this should be a City or County function, funds to cover the cost, inclusion in an existing City depart- , men t , etc. The City Manager said between now and July 1 it is estimated about $4,000.00 to $5,000.00 would be necessary to provide for a position of Housing Expediter. He said the responsibilities could not be added effectively to those of the existing staff, that clerical work could be shared with existing employes, and that funds could be worked into the present budget without overexpenditure. It was the consensus that need for the proposed position would warrant."creating it within the present organization but that future operation should be negotiated with the County so that a larger area would be servea. . .~ 12/23/68 - 2 ..... ~480 ! , I I~. Councilwoman Lauris said if the position doesn't require~full-time work, hiring a woman might be considered. Considerable discussion followed with the consensus being that because of the need for collecting and making available information with 'regard to housing progr~ms, and because this function ,is not per- ~ formed by any other agency at this time, the pro.posed posit.ion of. Housing E-xpediterwould have to be full time. Property Purchase, Ferry Street at south end of Bridge -' Owners of this property requested a zone change to permit construction of an office but have co-operated in waiting to see if it is possible for the City to purchase the property~ The River- I -1.1 front Development Corporation has offered to purchase the property.for tpe City, . I~ holding it until the City has funds available. The Manager said there is possibility I that up to 75% State and Federal funds will be available for this purpose. The pur- chase price is determined to be between '$25,000 and..' $"3 0, 000. I , The City Manager said an appraisal of the riverfront property is being made to de- termine a purchase price, 'and that then, the amount of State and Federal participation can be determined. Even if there' is no participation, he' said, the Riverfront De- velopment people' feel the property should be purchased for the City. I A vote was taken on the motion as stated, and'motion carried. 1 . Mr. Anderson moved seconded by Mr. Lassen to approve Item 4 of the Committee report. Councilwoman Lauris expressed c~ncern with regard to retaining access to the Riverfront properties. The City Manager explained what is now propos~d in connectionwith..extension of 1-106 and planned pedestrian and autoac~ess. Councilman Lassen suggested provision of boat launching facilities at some point along the public ownership. A rollcall vote was taken on the motion to approve, and motion carried, all. councilmen present voting aye. I I .: 2 5. Kendall Ford Rezoning, Country Club. Road west of Coburg Road -.A letter from the County Commissioners was presented aski~g forrecommendatio~ with regard to Kendall I, Ford's request for rezoning property immediately adjacent to the City limits. The Planning Commission recommended three alternatives (1) reaffirm previous action in adopting the Interim Willakenzie Plan; (2) request the Central Lane Planning Council for information based on the new Comprehensive General Plan now being.,prepared' to be presented to a joint meeting of the City'and County Planning Commissions at'a public I hearing, after w~ich the City Pla~ningCommission would make a recommendation to the {t City Council, or (3) refer the item in the routine manner to the City Planning Com- mission~ The City Manager-recommended following tl}e second alternative since th~ CLPC.staff feels they.have progressed far enough on the General plan to be able to review the Interim Willakenzie "Plan and indicate whether any changes should be made. Mr. Lassen moved seconded by Mr. Teague to'proceed with the second alternative. Motion carried. Mr. Anderson moved seconded' by Mr. ,Lassen to approve Item 5 of the Committee report: MOtion carried. ,I 3 6. Transfer of Funds, Laurelwood Payment - The City Manager said a resolution would be ! presented for Council consideration at the December 23 meeting which would authorize I borrowing $70,687.50 from the General Fund to make the.Laurelwood payment. The funds I '.' will be repaid before the end of the fiscal year from sale of bonds. Dr.. Purdy, moved ~ seconded by Mr. Teague.to authorize the loan. Motion carried. Closing 10th, Overpark Cons.truction - For. safety purposes, it was recommended that 10th Avenue be closed from Oak Street to the alley between Oak and Willamette beginning with start .of construc,tion of ,the parking structure and continuing until its completion. Motion carried. .' ;;;;:: The City Manager said conversations with the design engineers indicate that with some changes in mechanical facilities and commercial space, the construction cost could be lowered so that a bid award could be made. He said a recommendation would soon be brought to the Council. 1 8. Liquor License, Danebo Grocery and Service Station, 4690 Royal Avenue - Application for new Package Store Class A license submitted by Thomas 'E. Scheidt, approved by the Police Department. Mrs.Hayward moved seconded by Mr. Teague to recommend approval. Motion carried. ., Renewals were submitted for Package Store Class B for Andy's Food Market, 304 East 13th Avenue, and for Class B Dispensers for The Embers Club, 1181 Highway 99N, both approved by the Police Department. Dr. Purdy moved seconded by Mrs. Hayward to recemmend appreval. Motion carried. Mr. Anderson moved seconded by Mr. Lassen to approve Item 8 of the Committee report. Motion carried. . 2 9. Abatement, Tyler between 15th and 16th, Suess - A meeting was held between Mr. Suess and a building inspector to determine which of the buildings on the property must be demo lished. A letter addressed to Mr. Suess from the Building Department was read notifying him that abatement would be recommended on all buildings on the property except the one at the northwest corner, and that the Council would consider that e recommendation at its December 23 meeting. Mr. Teague moved seconded by Mrs. Hayward to proceed with the recommended abatement. Motion carried. 4 Mr. Anderson moved seconded by Mr. Lassen to approve Item 9 of the Committee report. A letter from Mr. Suess was read stating his position with regard to the abatement. Mr. Suess was present and expressed cencern abeut removing items stored in the buildings by absentee owners. He said it would take six months to accomplish demolition. Mr. Wingard moved seconded by Mrs. Lauris to amend the motion providing that the abatement be accom- plished by July 1, 1969. Motion carried. A vote was taken on the original motion as amended, and motion carried. 3 10. Variance for Temporary Office, 13th and Charnelton - Kendall Ford requested a six- .. month variance to allow use of a wood frame building constructed at this location without a building permit for office purposes. A report from the Building Department was read reviewing the history of the building, its construction, and subsequent use. No action was taken. Mr. Hall, truck salesman for Kendall Ford, explained their position in the construction of the wood frame building, and said even after another location is decided upon by the,firm it would take another ten to twelve months before construction could be completed. The City Manager said there have been no complaints and there is no great hazard in its use, rather it is a question of not allowing others to operate with similar facilities. e Mrs. Lauris moved seconded by Mr. Lassen to grant a variance for use of the wood frame building for office purposes, the permission to run concurrently with existing permits on the mobile home and tent at 13th and Olive (July 1, 1969). Motion carried. 4 II. Speaker, Boy Scouts - The City Manager said he had a request for someone to speak to Boy Scout leaders on January 2 at Silver Lea School about city services and discuss with them how to get troops involved in becoming more familiar with city government. It was understood calendars would be checked to determine which Councilman would be .- free to undertake the task." Councilman Teague agreed to meet the engagement if his schedule would allow. Other items on December 19, 1968 committee agenda not considered at that time: 5 1. Conditional Use Permit, 7th and Lawrence, Rehabilitiation Center - An appeal was filed by Robert C. Bennett from the Planning Commission decision granting a cendi- tional use permit which would allow a rehabilitation group-care facility for people with alcoholic problems in an existing home at 7th and Lawrence. Mr. Anderson moved seconded by Mr. Lassen to schedule a public hearing en the appeal at the January 13, 1969 Council meeting. Motion carried. . 6 2. Back Yard Burning - A memo was read from the City Attorney in which he stated back yard burning could be prohibited by having Fire Department instructed to issue no p burning permits. Roan Drive Sidewalk - A.reportfrom the ,Public Works Department was read giving I results of a poll taken of property owners with regard to location and construction I of a sidewalk on Roan Drive from Palomino Driv~ to Dapple Way. Estimated cost of tiling the channel to clear new school construc- tion was '$26,000.00; $79,100.00 for tiling the entire slou'gh to Amazo'Q,Chal).l).eL ,The City Manager said the di~ch'could be fenced on both sides for approximately $700.00. He, said if the fence is to be installed 'it is felt the School District should pay the cost since interiordrain'age is the property owner's responsIbility. If the Council ti feels the City is obligated, then negotiations should be ca~ried on'with the School ~-~ District for a cost sharing formula. The Manager said the fence should be installed because of proximi,tyof school buildings and reported bacteria in the ditch. He said the School District is aware of the problem but no contact has been made since the I I County's report and since tiling 'costs were estimated. Public Works DeP!lrtmen re- porting that the low bidder, Fred Stubbert, erred in submitting his bid for the project, I lit' having based his estimated cost for fencing on 20-rod rolls instead of 10-rod rolls.
