2L Appeal, Conditional Use Permit, 7th and Lawrence - Mayor Anderson read a letter from Mr. Robert
Bennett appealing a conditional use permit apprpved by- the Planning Commission for a Rehabilitation
Center at 7th and Lawrence.
Mr. Edward A. Butier, attorney for Mr. Bennett, said that insufficient notice had been given his
client to prepare for the Planning Commission meeting'. He stated that they did not object to the use,
but felt it should not be located on this site, in that it was not consistent with a commercial
distr~ct. Mr. Butler said that if the conditional use is permitted Mr. Bennett ~a~ asked' that it
be subject to annual review. Mr. Bennett felt the permit should be temporary because. of traffic
and parking problems. Mr. Butler presented a petition signed by residents in the area opposing
establishment of' this center.
Mr. M. B. Fear stated that he owns an apartment occupied by elderly women, and that they do not
favor this use in close proximity.to th~ir home. He present~da 1is~ of ~partments and motels
in the vicinity and explained. that the center would tend to downgrade this residential area.

Mr. Robert Moulton stated that he represented two property owners" one of whom resides out of the
state, and the other deceased, whose estate he. represents. Mr. Moulton stated that.bis clients had
not received notification in time to present a case to the Planning Commission, and that he had
just this afternoon been able to arrange to see the file in.th~ .P1~~ningO~fic~. Mr. Mo~lton
cited the Zoning Ordinance, stating that in his opinion the request as stated was improper, in
that group care homes, as defined in the Ordinance, included only those persons eighteen and
under. Also, the application had been improperly handled by the Planning Office.
Mr. Ed Fadeley, a member of the Lane County Council on alcoholism, explained the' use they plan for
the facility, and the arguments presented at the Planning Commission meeting. He explained that
legal notification was given, and that no new arguments had been presented at this meeting. The
question of notification had been sa-tisfied at the Planning Commission meeting.
Mr. Fadeley and Mr. Gordon Coleman outlined arrangements made for adequate parking by a lease
arrangement with a neighborIng service station. Mr. Coleman indicated that the 7th and Lawrence
site was under option and that they would probably lose it if they could present no positive
guarantee that they could use it as planned. They also had staff under contract, waiting to
start work.

Mr. Mohr stated that, in his opinion, the Council should be considering the appeal, not the
matter of insufficient parking spaces and proper~notification. Mrs. Hayward agreed, but was
not sure that denial of due process had been established. The City Attorney stated that deter-
mination should be made in what particular field due process had not been granted to interested
parties. Since Mr. Bennett had been at'the Planning Commission meeting and had presented his
case at that time, he could not say he had not been granted due process.
Mr. Moulton pointed out that his client, who lives out .of state, had not been granted. due
process, that notification had not been received in time for him to prepare a case, and that he
had not been heard at the Planning Commission meeting.
Mrs. Hayward moved, seconded by Mr. Wingard, that this matter be referred back to the
Planning Commission to allow Mr. Moulton's clients the opportunity to be heard.
Mrs. Be.tty Niyen, president of the Planning Commission, stated that there was really no provision
under the Ordinance for referring this. matter back to the Planning Commission, and that, to
reverse the Planning Commission oecisions, cert'ain questions must. be answered and conditions
met. Regarding notification, the Planning Commission had not only complied with the law, but
had done much in excess of that required. Mrs. Niven pointed out that if notification were
given far in advance of a hearing, application would have to be made several months in advance
to allow sufficient time for clerical work.
A rollcall vote was taken on the motion as stated. Mr. Mohr and Mr. Wingard voted aye and
Mrs. Hayward, Dr. Purdy, Mr. Teague, Mrs. Bea1 and Mr. Gribskov voted no. The motion was
defeated.

Mrs. Hayward, seconded by Mrs. Bea1, then moved to grant a Conditional Use Permit for Lane
County Council on,A1coholism for a Rehabilitation Center at 7th' and Lawrence Streets.
Mr. Wingard, seconded by Dr. Purdy, moved to amend the motion to provide that. this permit
be subject to annual review. for a period not to exceed two years.

Councilman Mohr explained why he was going to support this motion - that it was his belief
that the entire question of alcoholism as a social disease is up to local government, and that
the burden is on local government.

1. Appointments - Mayor Anderson announced the following appointments and reappointments:
Planning Commission - Morven C. Thomas and John E. Stafford~ reappointed for terms
ending January 1, 1973
Garbage Board - Wallace Swamson and Ervin Mo1ho1m, reappointed, and Bruce Lassen,
appointed to replace Dan Christensen, resigned.
The Mayor also recommended reappointment of Winfield Atkinson and Mrs. J. C. Keever
as members of the Library Board for terms ending January 1, 197-3. Mr. Anderson s'a'id
the International Co-operation Committee would continue functioning with a mee~ing
of new members scheduled for January 13~ 1969.
Mrs. Hayward moved seconded by Mrs. Bea1 to approve the Library Board reappointments.

2. Policy, Use of Remodeled Residences for Professional Offices - Councilman Wingard
asked for review of the City's policy with regard to allowing use of remodeled homes
for professional offices. .The Superintendent of Building Inspection explained criteria
in the various fire zones which control physical changes permitted in residential
buildings, but said that the courts have ruled adversely with regard to change in
occupancy.
Mrs. Hayward moved seconded by Dr. Purdy to receive and file. Motion carried.

3. Commendation, Eugene Register-Guard - Councilwoman Hayward called attention to the
special section on the City in the Register-Guard issue of January 5, 1969. She
expressed appreciation for the Guard's review of the City's work for the past ten
years.

4. Boards and Commissions - Councilwoman Bea1 asked for a list of members of the City's
various boards and commissions and was told copies will be furnished members of the
Council.
Mrs. Bea1 moved seconded by Dr. Purdy to receive and file. Motion carried.

5. Council Vice President - Councilman Wingard nomi~ated Counctlman McDonald for the position
of vice president of the Council. Dr. Purdy moved seconded by Mrs. Hayward to close the
nominations and cast a unanimous ballot electing Mr. McDonald as Council vice president.
Motion carried unanimously.

Mrs. Hayward moved seconded by Dr. Purdy to approve Item 5 of the committee report. Motion carried.

6. Appeal, Duplex Privilege, 26th and Potter, Champion - Mr. George Champion's letter of appeal
was read asking reversal of the decision of the Zoning Board of Appeals denying construction C~eY
of a duplex on property at 2585 and 2597 Po'tter Street. Staff report was also read review-
ing circumstance~ of subdivision of Mr. Champion's property and subsequent application for
duplex building permit. The Planning Director explained that the property was purchased
as one parcel and at that time could have been subdivided to allow a duplex. However,
application for a minor subdivision was made after adoption of the new zoning ordinance
which requires 10,000 square feet for duplex construction. The lot in question contains
8,640 square feet.
Mr. Champion said he didn't believe the 10,000 foot requirement should apply because he
is contemplating only 21% coverage of the lot.
Mr. Wingard moved seconded by Mr. Gribskov to grant a variance allowing construction of
the duplex according to the plans submitted by.Mr. Champion. Motion carried, Mr. McDonald
voting no.

7. Policy, Liquor License Applications - Mr. Frank Ransom of the Oregon Liquor Control
Commissio~ w~s invited to explain the Commission's desires with regard to recommendations
made by local governments on new and renewal applications for liquor licenses. The City
Manager explained the present Police Department policy on review of new and renewal
applications. Mr. Ransom commented on the co-operation between his office and the police
agencies, and said the Commission depends largely upon local agency recommendations when
problems are encountered with outlets.

Mrs. Hayward moved seconded by Dr. Purdy to approve Item 6 of the committee re~ort. Motion carried.
Dr. Purdy asked with regard to the "dry zone" boundaries in the University area if the
Council should take this into consideration in making recqmmendations on license appli-
cations. Mr. Ransom said the boundary was set as the result of a verbal agr~ement made
about 18 years ago between the University, the Liquor Commission and the City, and that
the Commission has had no indication from either the University or the City that they
wish to abolish it.
Councilman Mohr asked whether the Commission would accept an administrative recommendation
rather than requiring Council action on each application. It was understood Mr. Ransom
would consult with the Commission's attorney to determine if an administrative recommend-
ation would be accepted.
The City Manager asked whether the Oregon Liquor Control Commission would like local
jurisdictions .to make more.than a police r~view .in considering application endorsements -
should there be consider~d di~tances between o~tl~ts, type of development surrounding a
proposed location, social factors which may be involved? Mr. Ransom remarked that the
Commission is interested in gaining all the information possible. The Police Chief
explained the procedure followed in reviewing applications in his department and said
when problems are encountered the Commission is informed.

Dr. Purdy moved seconded by Mr. McDonald to ask the University if it desires the City to
use the "dry zone" as a basis for making recommendations on liquor license applications at
the City level. Motion cqrried.
Mrs. Hayward moved seconded by Dr. Purdy to approve Item 7 of the Committee report.
Mrs. Hayward explained that the Council was confused about use of the "dry zone" and she had
written the Commission, requesting clarification. The Commission had replied that it doesn't
recognize the dry zone, but tries to decide each application on its merits.
A vote was taken on the motion as stated, and the motion carried.

8. Annexation, Crest Heights - The City Manager explained the State law which permits unilateral
annexation of an area if a sanitary problem exists, and the procedure for making such
annexation. He said the Public Works Department has reviewed the Crest Heights sewer
requirements, ,after encouragem~nt .from the County Health pepartment to proceed with annex-
ation, and a gravity system was designed. Cost estimates have not been determined since
easements will have to be acquired; the street system is not adequate to take care o~
lines. A sketch showing proposed annexation boundaries was displayed. A resolution
stating boundaries of the proposed annexation area and conditions causing health problems
must be sent to the Oregon State Board of Health, along with a schedule for sewer c~nst-
ruction. The City Attorney recommended referral to the Planning Commission for hearing
before adoption of such a resolution by the Council.

Mr. Wingard moved seconded by Mr. McDonald to refer the item to the Planning Commission.
Councilman McDonqld asked if a larger annexation area has been contemplated. The
Public Works Director explained the system is designed only for that area under consider-

under this law allows use of this procedure only where a sanitary problem exists.
He said if the item is referred to the Planning'Commiss{on, prompt consideration
should be given in order to include the project in this season's construction,
schedule.
In answer to question from Councilman Purdy with regard to medical problem involved,
Mr. John Stoner, County health officer, explained problems existing .in the area and'
methods by which a survey was made on which the recommendation to annex was based. He
said diseases are difficult to relate to the conditions which exist, but that the
potential is there. He mentioned a recent recommendation for formation of a Metro-
politan Sewer District, but said the problem in this' particular area. should be solved
now', and he urged immediate action.
A vote was taken on the motion to refer the item to the Planning Commission and to
proceed with annexation posthaste, and the motion carried.,
Mrs. Hayward moved seconded by Dr. Purdy to approve Item 8 of the Committee report.
The City Manager reviewed the study made by the County Sanitarian and developments leading to this
annexation.

Mr. A. C. Schaeffer stated that he is a buildev in this area and that he objects to annexation of
the area known as Crest Heights. He feels septic tanks are adequate in this area, and that there
is a quantity of vacant land included which shou~d not be annexed at this time.
Mr. Roy Burns, County Health Department, explained the method used to determine how much of this
area presented a health hazard and how boundary lines had been set. He showed a map of the area
to the Council and explained the areas now having sewage effluent on the .surface, and how septic
tank failure affects city property below.
Mr. Harold Wald, 2973 Portland Street, asked how the cost of improvements made as a result'of
this annexation would be assessed. The City Manager said that a cost estimate had not yet been
made, and that assessment would be made against benefited properties served by the sewer system.
Mr. Robert Suess explained that an attempt had been made to form a sewer district in this area,
but it had failed. Owners in the area of 40th Street felt they could take care of their problems
by enlarging their septic tank systems. Mr: Burns explained that the problem was that effluent
would show up in a lower area, and the entire area presented a hazard.
Mr. Howard Buford, speaking as a citizen of the College Crest area, stated that, in his opinion,
there was only one way to eliminate problems in the area, and this was by annexation.
A vote was taken on the motion as stated and the motion carried unanimously.

9. Ordinance, Loitering - A memo was read from the City Attorney which recommended repeal
of the present Section 32.65 of the City Code prohibiting loitering on City streets
after 12:00 midnight, and substitution of a new Section 32.65, copies of which were
previously distributed to Council members, based upon the ordinance suggested in the
model penal 'code. He said the present City regulations with regard to loitering 'are
similar to those in the city of Portland which have been declared invalid by the
Oregon Supreme Court. The Police Department also recommends adoption of the new ordinance.

Mrs. Hayward moved seconded by Mr. Wingard to adopt the ordinance as recommended.
Councilman Mohr questioned the need for the new 'regulations. He said he felt the police
now have authority for action authorized under the new ordinance, that it would add
another mechanism, that it is very restrictive and places burden of crime on a person
before proof of a crime having been committed. The City Attorney said it gives an
officer the opportunity to make investigation and to evaluate whether suspicious actions
warrant arrest, and said it meets the constitutional objections of the courts.
Councilwoman Beal suggested the ordinance be held for review and possible checking
with the University law school. It was understood the o~dinance could be brought on for
first reading at the January 13 meeting and held at that time if further investigation
is felt necessary. The Manager said there is some urgency inasmuch as the existing
regulation cannot be relied upon.

The Police Chief cited several examples where the ordinance is needed. He explained
"field interrogation cards" and said police department personnel are well enough
trained to determine whether suspicious actions at odd hours warrant arrests. He urged
adoption of the new ordinance.
A vote was taken on the motion to adopt, and motion carried.
Mrs. Hayward seconded by' Dr. Purdy moved to adopt Item 9 of the C'ommittee report. All voted
in favor except Mr. Mohr who voted no. Motion carried.

10. Excused - Councilman McDonald - Councilman. McDonald asked to be excused from the
January 13, 1969 Council meeting. He will be out of town.
No action was taken on Item 10 of the Committee Report.

11. Appointments, Budget Committee - Councilman McDonald recommended appointment of Wyman
Hammer, 3279 West 15th Avenue, as a member of the Budget Committee for the term ending
December 31, 1971. Councilwoman Hayward recommended appointment of Eleanor Herbert
(Mrs. Dan), 4450 Hilyard Street, for the term ending December 31, 1971. No action was
taken.

Mrs. Hayward moved seconded by Dr. Purdy that the Council approve the appointments as recommended
in the Committee report. . Motion carried.
Other items on the January 8, 1969 committee agenda not considered at that time:

1. Jury Trials ,.. Municipal Court - The Council has received copies of a letter from the City
Attorney recommending that the State law which requires jury trials in municipal court be
repealed.
Mrs. Hayward moved seconded by Mr. Mohr that the City of Eugene request that necessary legislation
be prepared for presentation to the legislature for repeal of ORS 221349 which requires jury
trials in municipal courts.
Discussion followed concerning the practice in other states, and whether the entire court
system should be updated and modernized.
A vote was taken on the motion and the motion carried.

2. Variance, Mobile Home, '.1790 Highway 99 North, Poole Mobile Home Sales - A previous variance
was granted by the Council which expires January 23, 1969. The Building Department rec-
commended that the variance be renewed, since all conditions have been complied with.

Mrs. Hayward seconded by Mr. Wingard moved that the recommendation be approved. Motion carried.

3. Substitute "Stop" for "Yield" signs at 39th and Donald Streets - The Traffic Engineer
recommended substitution of "Stop" for rrYield" signs at the intersection of 39th and
Donald Streets.
Mrs. Hayward seconded by Dr. Purdy moved that the recommendation be approved. Motion carried.

4. Repeal Resolutions 416 and 548, Parking Zones 6th and Taylor - The Traffic Engineer
recommended that Resolutions 416 and 548 providing for parking zones at 6th and Taylor
be repealed, since the postoffice is no longer in this location.
Mrs. Hayward moved seconded by Dr. Purdy that the recommendation be approved. ' Motion carried.

5. Correspondence
a. 13th and Agate Report - The City Manager read a letter from the Traffic Engineer
recommending that the four way stop at 13th and Agate be retained, since it appears

b. Cable TV, Low Rent Housing - City Manager said a letter had been circulated to the
Council wherein Teleprompter stated they were investigating the possibility of
providing TV service to tenants of Lane County Housing Authority building.

6. Oversize Curb Cut, 18th and Oak, First National Bank - Public Works Department recommended
approval of a request by First National Bank for a 42 foot curb cut to replace two exist-
ing curb cuts at 18th and'Oak Streets.
Mrs. Hayward moved seconded by Dr. Purdy that the recommendation be approved. Motion carried.

7. CLPCRepresentative - The City Manager explained a request from Central Lane Planning
Council for prompt action in appointment of a representative to Central Lane Planning
Council.
Mrs. Hayward moved seconded by Dr. Purdy' that Mayor Anderson be reappointed as representative to
Central Lane Planning Council. Motion carried.

size of the building to 18,000 square feet in a variance based on hardship caused by enactment of the
Zoning Ordinance. Expansion was planned previous to enactment of the new ordmnance~arid would have been

Resolution No. 1620 - Initiate Annexation College Crest Area was submitted and read in full. The
Planning Commission recommended that annexation be approved since the area is considered an extreme
health hazard.

6 Resolution No. 1621 - Repeal Resolution 416 and'548, Parking zones 6th and Taylor.

. The City Manager explained the procedure proposed by the Council in the Kendall Ford rezoning matter
and that the County has set a time for its hearing on January 24, 1969, which will not allow time for
the procedure planned by the City Council and Planning Commission. Therefore, the Planning Commission
has requested a joint meeting January 20th'at 12:00 noon in the Eugene Hotel to consider the matter
and perhaps eve1ve a recommendation to the County Commissioners.

There was further discussion on the problems of sufficient notification. In answer to a suggestion
from Dr. Purdy that notification be given at least seven days prior to a hearing, the Manager stated
he will ask Wendy Ray to review the procedure and try to set up standards.
Upon motion duly made, seconded and carried, the meeting was adjourned to January 27, 1969.
