of inclement weather - was called to order at 7:30 p.m. on February 3, 1969 by His Honor Mayor
Lester E. Anderson in the Council Chamber .withthe following Councilmen present: Mrs..Hayward, Dr.

The Mayor commended agencies of the City, radio, staff and City Personnel for the excellent
work done .during the recent snowstorm..
The City Manager reported on the function of city'departments during the emergency, and the
many problems 'which have arisen. The estimated cost of snow removal, snow clearing and storm
related action is $51,626;00. The Manager expressed appreciation to individuals,3commercial
firms and emerge~cy agencies for their tremendous assistance during and after the storm.
In answer to a question from Councilman McDonald, the Manager explained that $10,000 had been
budgeted Public Works funds, $15,000 would come from emergency funds, leaving $26,000 which
will have to be provided from other unexp~nded funds to cover this unexpected expenditure for
snow clearance. Mr. McDonald suggested that the budget committee should give consideration
to funding for a snowplow, as bu~iness~en .must s~ay in business.
After a discussion of the possibility of assistance from the Federal Government, the Manager
explained that the State Department of. Emergency Services is reviewing

1. Items from Mayor and Council
a. Mayor Anderson introduced Bob Richter, who will take notes for Councilman Wingard in his

Mrs. Hayward moved seconded by Dr. Purdy that the Budget Committee appointment be approved. Motion
carried.

c. T.V. Cable, 37th and Onyx - Councilman Mohr had an inquiry concerning franchise of
Teleprompter Corporation in the City. He submitted a letter for the record, and stated
that it was the feeling of Mr. Marshall D. Wattles that Teleprompter had not lived up to
an agreement for installation of service in his area.
In answer to a question from Dr. Purdy the City Manager stated that it was'his impression
that Teleprompter did not have an exclusive franchise. He said his office would respond
to this letter.
Mrs. Hayward moved seconded by Mr. Mohr to receive and file. Motion carried.
The City Manager reported 'that Mr. Ray had contacted Teleprompter and had found that
service will be available in this area later in the year.
A vote was taken on the motion and the mot~on carried.

d. Ordinance, Loitering and Prowling - Councilman Mohr circulated a draft of an ana~ysis
he had made for the Council concerning the Loitering Ordinance now held over for'hear-
ing Januar~ 27th. Mr. Mohr said he felt the Council needed an overall policy re:
the City's criminal code, and that, in terms of social issues, they may not be con-
sidering rights of individuals. Mr. Mohr recommended that the Council establish an
ad hoc committee to review the entire question of criminal law in the City and its
possible redundancy and constitlJvb:i:.onality, and to prepare a recommendation for policy
guidelines. The committee suggested by Mr. Mohr would ~e composed of three lawyers
an~ one layman.

There was considerable discussion, with the consensus being that a committee of
the Council could be formed to sit with the Bureau of Governmental Research to
evolve a policy and direction in updating not only the criminal code, but the
balance of the City code. For a broad attitude in suggesting policy, such a committee
could include attorneys, someone from the judicial field arid prosecuting field', a repre-
sentative of the police department and others.
Mrs. Jane Novick, 3960 Blanton Road, read a statement in which she pointed out that care
should be taken to protect the right of individuals,'and that such an ordinance should
be framed in such a way that it could not be used to harass people we don't ,like, or those
who offend us visually, and who are otherwise committing no offense. She also advocated
that the city provide public places where loitering is permit-eed"arld even encouraged.
In answer to a question from Mr. Teague, Mr. Hendershott pointed out that the proposed
ordinance concerns a question of loitering under unusual circumstances.
Mrs. Beal asked for information on coming State legislation. Mayor Anderson pointed out
that the Chamber of Commerce has a series of luncheon sessions every other Saturday
beginning February 15th concerning legislative sessions, ana,he';s).1gg'ested that the' Council
have a representative at these meetings. The City Manager said that the League of Oregon
Cities publishes a weekly newsletter to keep members informed of ' new legislation, and that
this bulletin will be on file in the Manager's office for the convenience of Council members.
The Planning Director commented that several people from Community Goals Conference have
offered to participate in legislative activities ,in various ways.
Mrs. Hayward moved seconded by Mr. McDonald to receive and file. Motion carried.
After a discussion of the motions involved and appointment of a committee, the Attorney stated
that Councilman Mohr had furnished a brief to both his office and that of the 'Police Dep-
artment requesting information about this ordinance. The Attorney requested postponement
for further study. Councilman McDonald deplored the lengthy delay, and asked that this
matter be scheduled for a work session as soon as possible.

e. 10th and Oak Parking Structure - The City Manager commented on the problem of getting
possession of two spaces in the 10th and Oak parking district site. The tenants maintain
that they did not receive proper notice, and wish to remain until the Urban Renewal Contract
is signed, as this would enable them to receive benefits to cover the cost of the move. The
Manager said that he had tried to be considerate in not setting an eviction date when tenants
must vacate, and that the City is now faced with a delay. RathertIDRart' Jeopardize comple-
tion of the project by the deadline, the City has made arrangements-for a monetary con-
sideration, and the tenants have agreed to move without delay.

The City Manager explained to ,the Council that, to expedite removal of structures, the amount
of $3,000 had been paid to Eugene Blue Print and $4,650 to Martinizing Co.

2. City Holidgy Policy.- The Manager recommended that the Friday,following Thanksgiving and a
holiday to be taken at employees convenience, be substituted for holidays now taken on
Lincoln's and Washington's birthday. This would eliminate one' day of closure of City Hall
at a time when other businesses are customarily open.

3 3. Planning Commission Report - December 23, 1968
a. Vacation, 18th Avenue between Oakpatch Road and 19th Avenue, Bierly -jThe Planning
Commission recommended the vacation, since realignment of 18th Avenue eliminated the
need for right of way. Vacation would take the property out of public ownership.
Dr. Purdy expressed concern that vacation of. this property could create a lot of sufficient
size for construction of a house. The Planning Director assured him that this could not
be done without subdivision, and, an ,approved subdivision could not be created if it did
not meet requirements of the subdivision ordinance.
Dr. Purdy moved seconded by Mrs. Hayward to approve the recommendation of the Planning
Commission. Motion carried.
Mrs. Hayward moved seconded by Dr. Purdy to approve Item 3b,of the Committee report.
Dr. Purdy still was concerned about Lot 6400' and its possible subdivision. 1l11elPl.9.nning
Director again assured him that proper subdivision was assured by the subdivision ordinance
and said that this lot had previously had, legal access.

b. Annexation, Area between Bertelsen Road and Four Oaks Grange Road, Krumdieck - The
Planning Commission recommended approval of annexation subject to a contrpct stating
Krumdieck Bros. will pay the sewer assessment for present hook-up and accept further
assessments for any system developed in Bertelsen Road. The City Manager said it
was his understanding that the Planning Commission did not recommend, at its last
meeting, annexation of an island which would be created by annexation of this property.

Mr. Oscar Krumdieck, 2880 Gilham Road, explained that he had moved a duplex onto this
property, and that he had requested annexation for sewer and water connections. Creation
of the island had been unintentional.
Dr. Purdy moved, seconded by Mrs. Hayward, to approve the annexation. Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald to approve Item 3b, subject to a contract Motion carried.

4. State Legislation, Bancroft Bonds - A memorandum previously distributed to the Council
summarized the problem faced by the City when submitting a prospectus showing not only
City bonded indebtedness, but overlapping bonded indebtedness. If the City issued Bancroft
Bonds without general obligation backing, the issue would not jeopardize the City's general
obligation debt limit, and it could absorb increased interest costs, while protecting
general obligation debt margin for larger issues. It is proposed that the State Statute
be amended to make the general obligation pledge optional.
In answer to a question by Dr. Purdy, the Manager said that, so far as he knows, bonds
would be salable at a slightly increased interest rate, but there ts no indication that the
6% interest rate would be approached.

Mrs. Hayward seconded by Mrs. Beal moved that necessary amendments be drafted and submitted
for this legislation to give cities a choice in bonding. Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald to approve Item 4 and to draft the necessary legisla-
tion.
Councilman Wingard commented that this bill is already in the legislature.
A vote was taken on the motion as stated and the motion carried.

5. Dog Control - The Manager explained that, under present procedure, the City enforces dog
control within its limits, for which it may retain 80% of the fee collected for licenses
sold within the City. Income from this fee will be approximately $12,000 and the City
now expends about $22,000 for control. The County has:'submitted a contract to continue
this agreement, but the Manager will contact the County to attempt to arrange for the
Coun~yyto take over enforcement with retention of the entire fee.
Mrs. Hayward moved seconded by Mr. McDonald to receive and file.
The Manager explained that the present contract will be in effect for the remainder of the fiscal
year. The County will not enforce control in the City at this time, but perhaps the City
can make arrangements for County enforcement for the next fiscal year.
Councilman McDonald felt the City should have a more stringent dog control ordinance, and asked
that there be an investigation into the cost and possibility of a leash law. Mayor Anderson
suggested that this be placed on an early agenda.
A vote was taken on the motion as stated and the motion carried.
4 6. Parking Restriction, 5th and Lawrence - Oregon State MOtor Association "has requested
elimination of one parking stall at the northeast corner"of this intersection. The Traffic
Engineer states that tfiis request is valid and recommends removal of this stall.
Mrs. Hayward moved seconded by Dr. Purdy that thisJrecommendation be approved.
Mrs. Hayward expressed concern with the difficulty caused by cars parking too close to
intersections and asked if a study had been made of this problem. The City Manager said
no overall study had been made, but that parking restrictions have been extended along
18th and 19th and Oak and Pearl Streets. .
The question was called on the motion and the motion carried.

7. Joint Meeting, Planning Commission, City Council - The Council was reminded of the Joint
Meeting Monday, January 20, 1969 at 12:00 noon in the Eugene Hotel. This meeting. is in
reference to rezoning of property on Country Club Road requested by Kendall Ford Company.

8. Joint Meeting, Lane County Auditorium Association - Lee Biship, president of LCAA has
asked that the meeting between the Association and Council be held as soon as possible.
Manager was instructed to contact Mr. Bishop to try to arrange a meeting date.

7 9. Off-Street Parking Assessment District, Broadway and Charnelton - Mayor Anderson said that
a meeting will be held by owners of property in the area of Broadway and Charnelton, with
a view toward creation of an assessment district for construction of a multi-story parking
structure in that area.
Mrs. Hayward moved seconded by Mr. McDonald to receive and file Items 6, 7, 8 and 9. Motion carried.

The Manager stated'with re;Ee:repceyto Item 8 that Mr. Lee Bishop had requested that this meeting be
held Feb~uary 17, 1969 at 7:30 p.m. in the McNutt Room. This was agreeable to members of the
Counc il .
Mayor Anderson, on behalf of the Mayor and City Council, extended congratulations of the city of
Eugene to Councilman Wingard for having been elected First Citizen of the City of Eugene. Mayor
Anderson said that Mr. Wingard was very deserving of this honor.

1. Items from Mayor and Council
a. The Mayor welcomed the second year reporting class from the University School of
Journalism.

b. Traffic Control, 8th and Van Buren - Councilman Gribskov presented a petition signed
by twenty residents of the area near West 8th and Van Buren streets concerning
traffic control at that intersection. He turned the petition over to the City Manager.

c. Council Study Session - Mrs. Hayward called a Council Study Session for Monday,
7:00 p.m. in the City Manager's conference room. All agreed to meet at this time.

d. Jaycee Awards Banquet - A letter was read inviting members of the Council to attend
the JC Awards Banquet January 23, 1969 at 7:00 p.m. in the Elks Lodge.

Councilwoman Bea1 moved seconded by Mr. Mohr that the Council schedule a work
session meeting with the various employee organizations as soon as possible, and
that the City Manager prepare the necessary data for background on discussion.

2. Planning Commission Report - January 7, 1969
6 a. Amendments to Zoning Ordinance - The Planning Commission recommended amendment of
Section 26.01 of the Zoning Ordinance #15158 by adding Controlled Income and Rent
Housing - Purpose; amend Sections 4.03, 5.03, 6.03, 7.03, 8.03, 9.03 and 10.03 by
adding a new use "Controlled Income and Rent Housing (Subject .to Criteria set forth
in Section 26.04 (d)"; add new Section 26.04 (d) "Controlled Income and Rent Housing _
Criteria"; amend Article 34 by adding definition "Controlled Income and Rent Housing".
In answer to a question from Dr Purdy, Mr. Pearson explained that, to insure compliance
with conditions imposed by the Planning Commission, the City would enter into an
agreement with the sponsor.
Dr. ,Purdy moved, seconded by Mrs. Hayward, to approve the amendments recommended
by the Planning Commission. Motion carried.
The Planning Commission recommended amendment of Section 19.03, "Building Height
Exceptions" and recommended that Section 19.03 (d) be amended to delete Area III,
maximum allowable height for signs. The Manager explained that this action would
remove sign restrictions along Franklin Boulevard from the Zoning Ordinance. This
control is now a part of the Sign Ordinance and is no longer needed in the Zoning
Ordinance.
Councilwoman Hayward, seoonded by Dr. Purdy, moved to approve the amendments as
recommended. Motion carried.

b. Sign Code - The Planning Commission recommended deletion of Section 2.44, "Franklin
Boulevard Special Setback" to .bring the Sign Code into conformance with the
Zoning Ordinance.
Mrs. Hayward moved, seconded by Mr. Gribskov, that the Sign Code be amended'as
recommended. Motion carried.

c. Rezone to C-2 area east of Coburg Road on the north side of. Centennial B~ulevard,
McKay'and Parrish -ThePlanning Commission recommended approval of this request,
subject to the owner agreeing to develop the property under Planned Unit Development
regulations under one of two methods.

The Planning Director said five acres of this property are under negotiation
for an automobile dealer~hip. The attorney representing the tentative buyer has selected
the alternative to submit detailed plans to satisfy the Planning Commission concerns,
about proximity to Alton Baker Park and about the critical traffic problem.
Counci1man Teague 8sked how this differed fro~ the Kendall problem and the
Planning Director explained that this rezoning conforms to the Comprehensive
Plan which shows this area suitable for future C-2 development. There is no
residential property adjacent to this site.
Dr. Purdy said he could not agree with Mr. Porter, and that it was his opinion
that tais would be an ideal site for development of a low cost housing project.
Planning Commission member Pearson agreed with Dr. purdy's concern about this
gateway to the. City; and stated that he .had added the PD suffix to the C-2 zoning
to insure a compatible development. . He shared Dr. Purdy's views concerning low
cost housing on the-site; but explained tlIt: this .housing relates to land cost,
and that the cost of this prQperty is astronomical.

Mr.s. Hayward moved sem nded by Mr. Gribskov, to rezone the property to C-2,
subject to compliance with planned unit development regulations before the final
reading. Motion carried.

d. Rezone to R-3 area between 16th and 18th and Lincoln and Charnelton Streets, School
District #4 - The Planning Commission recommended that the portion of school pr.operty
located north of. 17th Avenue be rezoned to an R-2 classification and the block
south of 17th Avenue be rezoned to. R-l in accordance with the General Plan, and that
the R-3 zoning requested not be allowed. The Planning Commission had made this
recommendation, hoping th8t the School.District ~uld take advantage of the amendment
to the Zoning Ordinance,which would permit construction of low cost housing under
a conditional'use permit.
Mrs. Hayward moved, seconded by Mr. Teague to rezone the property north of l7th~=~
Avenue to R-2 and that south of 17th Avenue to R-l.
Dr. Purdy e~pressed his concern that this property might be zoned to higher use after
School District sale, with resultant financial loss to the School District.
In answer to a question from Mrs. Beal the Manager explained that the Planning
Commission had hoped that the School Board would sell the property with an option to
repurchase at a later date. To allow this arrangement, the property had to be
rezoned from public land.
Planning Commission member James Pearson said that the Planning. Commission had .been
trying to avoid the kind of economic inequity mentioned by Dr. Purdy. The Commission
gave the lowest possible zoning to ,encour,age the School District to retain ownership
of the property. In view of future trends, the School District will need this property
in forty years for school use.
The Planning Director explained that rezoning this proverty to R-2 would set a
precedent for further rezoning in the area to higher density.. This is against
good planning principles.
A vote was taken on the motion as stated, and the motion carried.
Mrs. Hayward moved seconded by Mr. McDonald to approve Items 2a, b, and::c.: d:. of the Committee
report. Motion carried.
The Manager stated with reference to Item 2d that he had. received a telephone call from the
School District asking that Item 2d be tabled until the School Board has a chance to meet with
its lay advisory committee to discuss this matter.
Mr. Donald Short, 6048 River Road, Junc'tion City, asked to be notified when this matter would be
taken up by the Council. He presented a list of inter.ested persons in the neighborhood and asked
that they also be notified.

e. Rezone to R-J area at southeast corner of intersection of 19th Avenue and Pearl,
School District #4J - The Planning Commission recommended denial of this rezoning,
hoping that the land would be kept in public ownership, and possibly leased. The
Manager said that there is an understanding 'between the School Board and Junior
Achievement for possible lease of the buiillding.

Mrs. Hayward moved seconded by Mr. McDonald to table Item 2d of the Committee Report. Motion carried.
Dr. Purdy moved seconded by Mr. Teague to approve the recommendation of the Planning

f. Readopt Section XVI, Ordinance No. 10691 of the City Code - The City Attorney requested
this action to reinstate code requirements for fencing wrecking and junking yards.
Mrs. Hayward'moved seconded by Dr. Purdy to readopt'Section XVI of Ordinance No.
10691. Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald that Item 2f of the committee re~ort be approved.

In answer to a question from Mrs. Hayward the Manager explained that the ~equirement for fencing
had been deleted when the new Zoning Ordinance was adopted, as it was covered in another way in
the new ordinance. This Council action is nequired to pass a new ordinance to enable the City
to enforce fending requirements on established businesses, which are not covered by the zoning
ordinance.
A vote was taken on the motion as stated, and the motion carried.
2 3. Sewer Right of Way - 1155 Norkenzie Road - The Public Works Department has recommended
purchase of a portion of property at 1155 Norkenzie Road for condemnation 'of Crescent
Avenue right of way and construction of Crescent Avenue sewer. Price of $20,460 has
been agreed on by property owner and the City. The Manager explained that'there is now
a house on the proper~y. which may possibly be used for rental.
Dr~ Purdy moved seconded by Mrs. Beal that the recommendation of the Public Works
Department be approved. Motion carried.

3 4. Kendall Ford Rezoning - The Planning Commission, at a joint meeting of the Planning
Commission and City Council, reaffirmed its previous recommeridation, and stated it felt
the Updated Willakenzie Plan is still valid, since there have been no changes to substantiate
a need for additional commercial land. The City Manager explained that the Council has been
asked for a recommendation at this time, since the County Commissioners have 'informed him
that they rescheduled their hearing to' January 24', 1969 at 10:00 a'.m: and have asked to
have action of the City Council before that time. The Council viewed the area this morning.
The Manager read a letter of objection from Mr. John R. AXtell, a resident of the Willa-
kenzie area.
Mrs. Hayward moved seconded by Mrs. Beal that the Council approve the recommendation
of the Planning Commission regarding rezoning of the Chase property.
Councilman Teague said he thinks Kendall Ford needs help, and that this'proper~y would be
ideal for such a dealership.

Mrs. Hayward agreed with Mr. Teague that Kendall Ford is a good citizen and should be
helped, but also felt that residential property in. the area should be protected. The
Council should assist them to find another location.
The Planning Director explained the basis of the Planning Commillssion decision, based on
the Interim Willakenzie Plan, and that this plan does not show this area for future
commercial development. If one rezoning is granted, there is no basis for not granting
other requests in the area.
Dr. Purdy thought the problem was stated by the Chairman of the Lane County Planning
Commission when ;he said it was his opinion the area north of Coburg Road should be
commercial. Actually, this is what would happen if this rezoning was allowed. Dr.
Purdy recommended that the County attach a requirement that this area be annexed if this
rezoning is allowed.
Mr. DeMartini asked if this would be on the basis of service available. r
Mr. Hoffman, attorney representing Dale Fisher, opposed this rezoning, and stated that the
roning problem remains the same. A revised site plan has been present~~, but this does not
alter the original problem. They had asked for a twenty-two acre site,. far in excess
of the land needed. Mr. Hoffman said it was a tragedy that a group of non-residents'could
create a problem and the city would have to live with it. He said he'thought this group
should be concerned with government problems involved, and the best interest for the
greatest number of people.
Mayor Anderson said this expression of the County Commissioners was a step toward good
government, since they had asked for an opinion from the City. '
~r. DeMartini asked to seLthe record straight that they had requested only seventeen
acres for commercial zoning, and that they felt this amount was necessary for their
development.
Planning Commission member James Pearsan asked that the Council consider that Dr. Purdy's
suggestion might create a permissive attitude, and that it would be preferable that the
Council just indicate to the County Commission that they are against rezoning and wait until
they have made their decision before advocating annexation.

Mrs. Bea1 commented that it might be a good ~dea to contact the Commissioners and
give the Council's reasons for denial and that this area is an obvious one for future
annexation to the City.
Mrs.:UayWard moved seconded by Mrs. Bea1 to approve the Council recommendation. Mrs. Hayward
asked if the City could take legal action in connection with this rezoning. The Manager
stated that the City is not in a position to initiate legal action, but if affected
private property owners initiated action, the City could consider petitioning for inter-
vention into the case as an interested party.
A vote was taken on the motion as stated and the motion carried with Mr. Teague and Mr. McDonald
voting no.

5. Police-Community Relations Award - Mr. Mohr moved, seconded by Mrs. Hayward, that the
Council put on the agenda for its next regular meeting considerat10n of an award to
recognize outstanding and important work and ideas for police-community relationship in the
City of Eugene. Mr. Mohr explained that he wished this award to recognize those kinds of
relationships which are in addition to normal law enforcement and crime responsibilities
of the po1ire force. This award should also recognize utilitarian and social concerns
within the City of ~~gene. Mr. Mohr explained that he wished this award to recognize

named the Catherine Lauris Award for recognition of police-community relations and improve-

Mrs. Hayward said that she isP?articu1ar1y interested in this award, and feels that persons
should be rewarded who have ideas such as having a member of the police force in
attendance at Junior High Schools just to give information. Mrs. Hayward suggested
establishment of a committee of community representatives and representatives of the
police force to implement the intent of the resolution.
A vote was taken on the motion and the motion carried unanimously.
Mrs. Hayward moved seconded by Mr. Mohr that Item 5 of the committee report be approved.
Mr. Mohr explained the meaning of this award and the type of service it should recognize. ffihe
Mayor commented that the motion provided no means for setting up the committee to implement the
intent of the resolution.
Dr. Purdy moved seconded by Mr. Mohr that the motion be amended to provide that the Mayor
appoint a committee to implement the intent of the resolution.
A vote was taken on the amendment and the motion carried.
Dr. Purdy expressed concern that this award should be concerned not only with the police-community
but with the overall interests of the city. Mrs. Hayward explained that the award was intended
for service beyond regular duty, and that the award should go to persons contributing ideas for
closer community relations.
A vote was taken on the motion as amended and the motion carried, with Dr. Purdy voting no.

6. Lane County COQnci1 on Alcoholism - A letter was read from Lane CouDuy Council on Alco-
holism requesting funds allocated by the City Council for establishment of a rehabilitation
center. The Manager said there would be no conflict with Buckley House and that this
request meets the recommendation of the Budge Committee. Since Councilman McDonald had
been asked to serve on a committee to review this matter and was not present today, the
request could be on the Agenda for the next regular Council meeting.
Dr. Purdy moved seconded by Mr. Gribskov to appropriate $5,000 for Lane County CVounci1
on Alcoholism. Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald to approve Item 6 of the Committee Report. Motion carried.

7. Airport Rules and Regulations - Rules and Regulations of Mah10n Sweet Airport were dist-
ributedsto the Council for study. This item will be placed on the Agenda of February 10th

Council Bill No. 8679 - Levying assessments for paving 22nd Avenue from Chambers to Grant
(Defferred by Ordinance 12948 3/5/63, no access - access approved with building permit 9/3/63
(1099) was submitted and read the first time in full on December 9, 1969 and held over to the
meeting of January 13, 1969 to allow proper notice of assessment to be given owners of affected
properties, was brought back for consideration and held over at the request of the attorney
for the property owner.

Mr. Robert McCrea" qa ttorney, representipg~ Mrs'.~ ':O'utka'" outlined the' background of this assessment,
stating that the Building'c,arid"Finance Departm~n,~s,....should have placed a lien on the property at
the time a building permit was issued. ,This. lien, '21'1ould have remained on the p.ropeEty wben.the
_builder sold _ it. When Outka 's bO-ugh~ the' propertY andit.was financed, the builder would have
paid,the-li'en,bei-ng' reimbursed< by'th'e' fiii'aIlee' 'e:omp.'ail'y.' Mr. Outka died in 1967 without know-
ledge of an assessment, and when mortgage insurance paid the mortgage, the potential lien was
not paid, leaving Mrs. Outka facing a $l,OOO assessment. Mr. McCrea feels that the City, having
failed to levy this assessment at the time the building permit was issued, and allowing this to
continue for such a period of time, should not now levy this assessment.
The City Attorney stated he had not reviewed this matter and asked that it be held over to give

payment of street construction assessments prior to approval of PUD. Assessments cannot be levied
outside the City except by way of an agreement.

In answer to a question from Mr. McDonald the City Manager explained that the City had initiated
paving of a larger area with a system of cu1 de sacs, but property owners could not agree to a pro-
posed plan. This resolution would develop one cu1 de sac and prevent 20th Avenue f~om becoming a
through street. In answer to Mr. McDona1ds question concerning sidewalks, Ar. Allen explained that
sidewalks would be on one side only, expept in the block between Washington Street and Jeffer,son Street
where there were already several sidewalks on both sides of the street. Mr. Allen displayed a map
illustrating the proposed cu1 de sac and the location of sidewalks.
