Other Council members present were: Dr. Purdy, Messrs. McDonald, Wingard and Teag~, Mrs. Beal, Messrs. Gtibskov and'Mohil 1 A letter was read from Mr. David P. Benseler, 2975 Oak Street, regarding an intolerable weekend traffic situation in the area of 29th Avenue and 30th Avenue and Oak Street and Pearl Street. Suggested solutions included one-way street couplets, additional street lighting or higher intensity of present street lighting, cuI de sacs, or even street closure Mr. Bensler agreed that any of "these suggestions would help the situation, but work on these measures could not be undertaken until June~ and Mr. Bensler was requesting some immediate relief. Police enforcement had helped the situation, but was only a temporary measure. It was the sugges"tfon of alternative suggestions. was taken. the City Manager that a neighborhood meetingmight'be arranged to discuss The matter could then be heard at a Committee of the Whole meeting. Committee meeting held February 5, 1969: Present: Mayor Anderson; Councilmen Hayward, Purdy, McDonald, Beal, Gribskov, Teague and Mohr; City Manager and staff; and others. 1. Items from Mayor and Council 2 a. Chamber of Commerce Legislative Meetings - The Mayor announced the Chamber of Commerce Legislative Committee meetings, and said that he had asked Councilwoman Hayward to act as coordinator'to insure attendance of at least two councilmen at each of these bi-weekly meetings, the first of which will be February 15, 1969. 3 b. Status, House Bill 1027 - Councilman Mohr requested a report on the legislative status of H.B. 1027, which concerns annexations. Mayor Anderson reported that Central Lane Planning Council is involved with coordination on this bill, and will have some organization repre~ sentation at the hearings. The Manager reported that there have been some organized meet~'l ings with resultant amendments to the bill. These amendments mainly concern local govern- mental representation on Boundary Boards. It was the consensus of the Council that there should be Council representation at legis- lative hearings whenever possible, and that matters of particular interest to the City should be brought up whenever they come to the attention of individual councilmen. 4 c. Salary Increase -The Manager stated that the Council had agreed to discuss requests from employe groups regarding saJ.ary increases whenever written material was available. Council- woman Beal felt that an informal discussion would be preferable, and since the employe groups were anxious for an early hearing, it was 'decided to adjourn the regular Monday meeting to a Committee Meeting in the McNutt Room at 8:30 p.m. February 10, 1969. 5 d. Commendation, Snow Removal - K;metter of commendation was read from Floyd Trowbridge, who also requested enforcement of the ordinance requ{ring clearance of sidewalks. Mrs~ Hay- ward suggested that the City start with enforcement at fraternity houses and public agencies. 6 e. Loitering Ordinance - This Ordinance will have the third reading at the Gext regular meet- ing, and Councilman Mohr has asked to discuss a proposed committee to study the City's criminal law code. It was decided to put this on the Agenda for official approval at the same time as the reading of the Ordinance. Mr. McDonald moved seconded by Dr. Purdy that Items la, lb, lc, ld, and Ie of the Committee Report be received and~ftled. Motion carried. 7 f. Annexation, Beltline-River Road - The Planning Commission has requested an early hearing on this annexation because of classif{cation as a health hazard. The Planning Director explained the location of this annexation and the reasons for the proposal. The Manager stated that part of the area is being held for final annexation action until agreements for sewer construction "financing have been completed between individual owners and the City. This additional annexation might make it possible to bancroft the assessments. The City coul<:];"proceed with this annexation and" hold it as a package with the pr"evious annex- ation until sewer financing agreements were reached with all proper~y'owners. In answer to a question from" Councilman Gribskov; the Dir.ector of "Public Works explained that this system would connect into a pressure line on Beltline Road, and that construction would have to coincide with construction of "the River Road overpass. - Dr. Purdy moved seconded by Mr. Mohr to approve the Planning Commission action and proceed with annexation of the area, and to hold final approval until agreements are signed with all property owners. Fhe motion carried. Mr. McDonald moved seconded by Dr. Purdy to proceed with the annexation and call a public hearing. After approval, this annexation should be held for final reading with the previous Beltline-River Road Annexation, pending agreement on financing of sewers. ~ 2/10/69 - 1 39~ --- -<----- - _._-------------~--~------------.~----~ 2/10/69 I A vote was taken on the motion as stated, and the motion carried. 1 2. Contract, University of Oregon for Police Services - The University of Oregon has contracted with the City for police services beyond those which could normally be provided. The amount of $47,473.61 covers' the City cost for providing'services from September 3, 1968 to September 1, 1969. The Cith has the right to call the patrolmen off the campus ~n an em~rgency. Mrs. Hayward moved seconded by Mr. McDonald to approve this contract. Motion carried. Mr. McDonald moved seconded by Dr. Hurdy to approve Item.2 of the Committee report., Rollcall vote. All councilmen present voting aye, motion carried. 2 3. Ordinance Creating an Airport Commissillon, Providing its Appointment and Duties - The Manager explained that this Ordinance would set up regular terms and provide a method of appointment for an official Airport Advisory Commission. There, has been a question concerning the appoint- ment of a member from the Chamber of Commerce Aviation Committee, and it has been suggested that he be appointed as an ex officio member. Dr. Purdy moved seconded by Mr. McDonald to adopt the Ordinance with the suggested change that the chairman of the Aviation Committee of the Chamber of Commerce be appointed as an ex officio member. I Councilman Mohr was not sure that ex officio implied non-voting, and the City Attorney said this specific wording would be included in the ordinance. Mrs. Beal questioned the necessity for an airport commission. She felt this could well be handled by the Planning Commission. The Manager explaine'd the reason for this Commission, and that planning for airport facilities, as well as land planning, were the province of this body. The Commission is composed of those familiar with the aviation industry. Mayor Anderson asked if all seven members would be appointed at one time; and if their terms would be staggered. The City Attorney stated that provision for staggering,of terms 'could be included in the Ordinance. A vote was taken on the motion as stated, and the motion carried. . . -- .. Airport Rules and Regulations - Copies of the proposed Airport Rules and Regulations have been distributed to the Council for study, and adoption is recommended. Mrs. Hayward moved seconded by Mr. McDonald to adopt the Airport Rules and Regulations. Motion carried. Mr. McDonald moved seconded by Dr. Purdy to approve Item 4 of the Committee report. Motion carried. l 4 5. Ordinance Permitting Additional Parking in Bus and Taxicab Zones and Establishing Two and Three Wheeled Vehicle Parking in Certain Areas - The Manager 'explained tha~ passage of this ordinance will permit parking in bus zones when not in use by buses and utilize triangular areas formed by striping for diagonal parking f~r two and three wheeled vehicles. The City Attorney recommends adoption of this ordinance. Councilman Purdy suggested that the wording in this ordinance should be changed to indicate City or Public buses. The Attorney said the ordinance would be amended. Mr. Teague moved seconded by Mrs. Hayward to adopt the ordinance as recommended. Motion carried. Mr. McDonald moved seconded by Dr. Purdy to approve Item 5 of the Committee with the recommended change in wording. Councilman McDonald was concerned regarding obstruction of bus zones during regular loading and unload- ing. Police Chief said signing w011ld control this, and after consultation with the Traffic Engineer this ordinance had been prepared to alleviate a double-parking problem. A vote was taken on the motion as stated, and the motion carried. 5 6. Planning Commission Report, February 3, 1969 - The Planning Commission has tabled zone change requests of Nathan Rubenstein, located on the west side of Echo Hollow Road between Avalon Street and Knoop Avenue; Harry Rubenstein, located on the south side of Crest Drive between Willamette Street and Olive Street; Noble Chowning, located on the east side of Coburg Road between Willakenzie Road and Bailey Lane; Allen L. Colburn, located on the north side of Barger Drive and east of Golden Garden Street; Blinkhorn Company located south of East Briarcliff Lane between River Road and Polk Avenue; Harry Ritchie located at the southwest corner of the inter- section of 11th Avenue and Patterson Street; E. Charles Pressman, located at the southwest corner of the intersection at 29th Avenue and Portland Street, pending developments of preliminary or final approval under the Planned Unit Development section of the Zoning Ordinance. The Planning Commission requests that the City Ceuncil officially table these ~equests until the Planning Commission takes them from the table for official action. , Mrs. Hayward moved seconded by Mr. McDonald to approve the Planning Commission request to table these items. Paving Bendix from Sunshine Acres to Van Duyn and Van Duyn from Bendix north 130 feet - Petitioned by owners of 84.9% of, the property to be assessed. I Mrs; Hayward moved seconded by Dr. Purdy to approve the petition.: .Mo,tion carried. 2 b. Paving, sanitary and storm sewers within the First Addition to Terrace View - petitioned by owners of 88% of the pr6perty to be assessed.. Mrs. Hayward moved secol1ded by Dr. Purdy to approve the petition. Motion carried. Mr. McDonald moved seconded by Dr. Purdy to approve Items 7a and 7b of the Committee report. Motion carried. 3 8. Ab~tement, Partially Demolished Building at 23 West 27th - Public Works Department recommended aoatement of a partially demolished building which constitutes a ijazard. Dr. Purdy moved seconded by Mrs. Hayward to abate the property. Motion carried. Mr. McDonald moved seconded by Dr. Purdy to approve Item 8 of the Committee report and to call a public hearing. Motion carried. 4 9. Parking Restriction, 19th and Patterson - Traffic Engineer has recommended 'establishment of "No Parking at Anytime" restr~ction on the north side of 19th Avenue from Patterson.to a point 94 feet easterly of the center line of Patterson. Mrs. Hayward moved second~d by Mr. Gribskov to approve this restriction. Motion carried. t Mr. McDonald moved seconded by Dr. Purdy to approve Item 9 of the Committee report. Motion carried. 10. ;Miscellaneous 5 a. Annual Conference of Regional Councils, San Francisco, March 9-11, 1969 - Mrs. Bealc;in- dicated she would attend this conference if possible. 6 b. Letter of Appreciation re: Removal of Parking, 29th Avenue - Cascade Manor Residents for- warded a resolution indicating parking restriction has result~d in reduced traffic and less hazardous crossing for pedestrians, and expressing appreciation. . Mr. McDonald moved seconded by Dr. Purdy that item lOa and lOb of the Committee report be received and filed~ Motion carried. 11. Overpark, 10th and Oak, Change Order - The City Manager explained that a change order submitted by N.G. Jacobson & Associates, Inc. for elimination of or substition of items on the elevator would decrease the amount of the contract by $4,265.00. The Manager asked that this change order be approved, subject to possibility of substitution of another type elevator which W041d be less expensive. Mr. Wingard moved seconded by Dr. Rurdy to approve the change order, subject to approval of engineer Jacobson. Rollcall vote. All councilmen present voted aye, motion carried. ORDINANCES 1 Council Bill No.J8692 - Amending Code re: Loitering or Prowling and Repealing present Section 32.65 was submitted and read the first time in full on January 13, 1969 and lacking unanimous consent on second reading by council bill number only was held over to the meeting of February 3, 1969, and lacking unanimous consent was held over for further consideration to the meeting of February 10, 1969. Mr. McDonald moved seconded by Dr. Purdy that the council bill be read the third time by council bill number with unanimous consent of the Council. Motion carried unanimously and the bill was read the third time by council bill number only. Mr. McDonald moved seconded by Dr. Purdy that the bill be approved and given final passage. A memorandum was read from the City Attorney in answer to questions asked previously by Councilman Mohr. Mr. Mohr did not want his motives misunderstood, and stated that it had been his intention to explore all aspects of the bill berore passing such an Ordinance. Mr. Les Swanson, a Eugene attorney, commented that ordinances of this type give the police power which may be unnecessary. A discussion ensued regarding the ;need for an ordinance which allowed a police officer to question persons under unusual circumstances at unusual hours. The Police Chief stated the city's officers are well enough trained to be able to ascertain what constituted such circumstances and to protect citizens rights. Mr. Mohr asked the City Attorney if the present Ordinance was not sufficient for this purpose, and the Attorney replied that the present Ordinance should be repealed and a new one substituted. Mrs. Beal moved seconded by Mr. Mohr to table action on this Ordinance until the next regular Council meeting. A vote was taken, with Mrs. Beal and Mr. Mohr in favor, Mrs. Hayward, Dr. Purdy, Mr. McDonald, Mr. Wingard,?Mr. Gribskov and Mr. Teague voting no. The motion failed. A rollcall vote was taken on the motion for final passage of the ordinance. All councilmen voted aye except Mrs. Beal who voted no. Motion carried. Bill declared passed and numbered 15531. Mr. Mohr moved seconded by Mr. Wingard that a committee of four persons, to study revision of the criminal code and to act in an advisory capacity to the Council, be appointed by the Mayor, with :-. - ,'t'".. recommendations for appointments from the Council. There was a discussion of revision of the Code by the Bureau of Governmental Research, 'and whether the suggested committee should be formed before or after the Code revision is completed. The City Attorney stated that such a committee could be very helpful to the codification staff of -the Bureau, and should, upon appointment, meet with the staff to determine the ~best method of proceeding to accomplish its purpose. The question was called on the motion, and the motion as stated carried unanimously. 2 Council Bill No. 8698 - Readopt Section XVI, Ordinance No. 10691 City Code. (Fencing certain business operations) was submitted and read the first time in full on February 3, 1969, and lacking unanimous consent on second reading by council bill number only, was held over to this meeting for further consideration.
