Adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned from the meeting
held February 10, 1969 - was called to order at 7:30 p.m. on February 24, 1969 in the Council Chamber
by His Honor Mayor Lester E. Anderson with the following councilmen present: Mrs. Hayward, Messrs.
Purdy, McDonald, Wingard, Teague, Mrs. Beal, Messrs. Gribskov and Mohr!
Minutes of the Council meetings held February 3 and 10, 1969 as mailed to Council members were
approved with a correction to show that Mrs. Mildred MacKinnon had resigned from the Human Rights
Commission.
COMMITTEE REPORTS
Committee Meeting held February 10, 1969:
Present: Councilmen Hayward (presiding), Purdy, McDonald, Beal, Gribskov, Mohr and Teague:
City Manager and staff; and others.

Request for Salary Review
,"
Councilman McDonald asked about the status of the budget, and whether there was any money to
cover a salary adjustment. He commented that, if the Council were going to allow salary
increases on January 1st, money should be budgeted for this purpose. There is anticipated
a cash carry-over of $180,000 July 1st, which will be needeqfQrfunding.the early part of
the next fiscal year.
Mrs. Hayward commented that this meeting was at the request of employee gDoupS who had the
opinion that some mention had been made of a salary discussion at mid-fiscal year. Material
has been distributed from employe groups and from management..
Dr. Purdy said it was his oplnlon the Council should decide on a policy before discussion of
the amount of increase. If an increase is to be allowed every six months, it should be put into
the budge t .
Dr. Purdy moved seconded by Mr. Mohr that the Council not consider a mid-fiscal year increase,
since this is a budget item and should be considered at budget committee meetings.
Mr. Frank Jackson, President of IAFF, stated that his organization had been under the impression
that the City Council would review salaries in December of 1968. Since nothing had been done,
they had written requesting to be heard on the matter of a salary adjustment.
Mr. Patrick M. Flynn, business agent for IAFF, asked the Council for a negative vote on the
motion, so that they could continue with discussion and explain their reasons for a request
for a salary adjustment at this time.
There was considerable discussion concerning whether or not consideration of a mid-year request
had been promised, and of percentages of cost-of-1iving increasjsz and other reasons for a
request for salary adjustment.
Councilwoman Bea1 agreed that the major question was one of policy, and that a vote should be
taken on the motion.
The question was called on the motion. A. vote was taken and .a11 voted in favor except Mr.
Mohr and Mrs. Hayward, who voted no. Motion carried.
In answer to a question from Mr. Flynn, Mrs. Hayward said this matter would come up for formal
action at the next regular Council meeting.'
A letter from the Lane County Labor Council was read, expressing displeasure at the action of the
Counc~l regarding a mid-year salary review request at the committee meeting, and asking the Council
to reverse its position.
Mrs. Hayward moved seconded by Mr. McDonald that the Council not consider a mid-fiscal year increase
at this time.
Mr. Pat Flynn, City Fireman, asked the Council to consider, at this time, the request made by repre-
sentatives of 570 City employes to review the budget.

The Council discussed availability of funds, and whether a salary adjustment should be considered
at this time, or should be discussed by the budget committee. Council members concluded that Council
p01~yy had been to review sala~s every three years, at the time the budget committee met for budget
review.
Mayor Anderson said the budget committee tried to arrive at fair and equitable salaries, comparable
with those in private fields.
A vote was taken on the motion as stated, and Mr. Gribskov, Mr. McDonald, Mr. Purdy, Mr. Teague and
Mayor Anderson voted aye; Mr. Mohr, Mr. Wingard, Mrs. Bea1 and Mrs. Hayward voted no. Motion carried.

Committee meeting held February 12, 1969:
Present: Councilmen Hayward, Purdy, McDonald, Beal, Gribskov, Mohr and Teague; City Manager

1. Items from Mayor and Council
a. "Door-step" Legislation - Councilman Mohr asked Mrs. Betty Niven to report on the pos-
sibility of future legislation to resolve the problem of land use issues which come
before the County Planning Commission which are in reality City business. Mrs. Niven
said she had discussed with Representative W~gard the possibility of introducing
legislation which might set forth some legal criteria for resolution of these types
of problems, and outlined proposed legislation. She pointed out a map which illustrated
that over 90% of 1967 and 1968 county land use agenda items concerned property within
the fringe of the Eugene-Springfield metropolitan area. Mrs. Niven asked that the
,Council adopt a policy supporting corrective legislation.
Mr. Gribskov moved seconded by Mr. Mohr that the City Council support legislation which
would provide that no land use change within four miles of an existing city could be
enacted by a County Commission without concurrence by the governing body of that city
or the governing body of those cities lying within four miles. A copy of this proposal
should be forwarded to state legislators immediately. Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald to approve Item la of the Committee report. Motion carried.

b. Chamber of Comerce Legislative Luncheons - Mrs. Hayward asked for volunteers to attend
the first of the Chamber of Commerce luncheons Saturday, February 22, 1969 at 8:00 a.m.
Mrs. Beal said she would attend.

c. Community Goals Review -' Mrs. Hayward a~ked that an evening meeting be arranged to
review Community Goals. Mrs. Niven will~Uiena to explain the community goals and
policy to new Council members and to answer questions.
Mrs. Hayward moved seconded by Mr. McDonald that items la and lb of the Committee report be received
and filed. Motion carried.

d. Low Income Credit Union - Lane Human Resources has been meeting to discuss the possibil-
ity of formation of a Credit Union to serve ,the needs of Low Inrome Residents. Appli-
cation has been made to the Bureau of Federal Credit 'Unions. The purpose of this
Credit Union would be to provide loans to low income people and to offer membership
savings accounts'. Mrs. Hayward asked if the Council wished to support formation of a
low income credit union.
Mr. Mohr moved seconded by Dr. Purdy that the City Council of Eugene, in line with ~ts
general policy of encouraging development of economic strength in the community, recog-
nize the proposed development of a credit union for low income residents of Lane Oounty,
and offer its continued support (non-financial) for such a program. Motion carried.
Mrs. Hayward moved seconded bY'Mr. McDonald to approve Item ld of the Committee report. Motion carried.

e. Council Study Committee - Since the Council has expressed such an interest in proposed
legislation, it was suggested that a committee of two or three council members meet
once a week to study material relating to legislation of particular interest to the
Council. There was some discussion of availability of material, and time and place for
a meeting. Mrs. Hayward, Mrs. Beal and Dr. Purdy agreed to meet on Fridays at 4:00 p.m.

f. Budget Committee, Unexpired Term - The City Attorney, in answer to a question concerning
eligibility of members on the Budget Committee, submitted a memorandum in which he advised
the Council that a member of the Budget Committee who will be absent from the State of
Oregon for an entire year, would be considered unable to serve the term for which he was
appointed, and a new member should be appointed. Nomination would fall to Mr. Mohr.
Mrs. Hayward moved seconded by Mr. McDonald that Items Ie and If of the Committee report be received
and filed.
After a discussion concerning Mrs. Campbell's extended absence]. and the possibility of her early
return, Mrs. Hayward said she would report to the Council on the extent of her absence from the City.
A vote was taken on the motion as stated, and the motion carried.

Joint Housing Committee Recommendations - Mrs. Betty Niven summarized proposed legislation

In answer to a question from Mrs. Betty Niven, Mr. Wingard said if the sales tax bill passes, the
homestead tax exemption would not be eliminated, but persons could use whichever exemption gave the
most deduction.

c. H.B. 1614 - bill sponsored by Urban Affairs Committee to provide that home improvements
be exempt from ad valorem property tax for the first five years after completion, pr~-
vided the total true cash value of the residential structure on which improvements are
made remains less than $14,000, including value of improvements. Mrs. Niven explained
that this bill would provide increased housing by encouraging improvements to bring
substandard structures up to standard.
Mr. McDonald moved seconded by Mr. Teague to support this recommendation.
The City Attorney suggested wording be "that have been brought up to code". The motion
was amended to include this wording.
A vote was taken and the motion as amended carried..

Support H.B. 1147 requiring County Assessor to notify senior citizens about homestead
exemption provisions within the. state law.
Mr. Teague moved seconded by Mr. McDonald to endorse H.B. 1147. Motion carried.
Mrs. Hayward seconded by Mr. McDonald moved to approve Items lb, lc and ld of the Committee report.
Motion carried.

e. Amend state law to require all cities, counties and state agencies acqu~r~ng property
for public purposes to pay.up to $200 moving costs for occupants displaced and provide
them with information concerning alternative housing available. Dr. Purdy suggested
this amendment should state that this provision apply only to owner or occupant of
property at time of acquisition, and that future renters would pay own moving costs.
Mr. McDoaald moved seconded by; Mr. Teague to support Item e as amended. Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald to approve item Ie of the Committee report.

The Manager said items of local concern should be decided by the City Council, since the City has a
home rule charter, and that the City should initiates its own legislation to pay such ~oving costs.
The Council discussed whether Counties should be excluded from the bill, since they too ryave home rule
charters.
Mrs. Hayward moved seconded by Mr. McDonald to amend to motion in Item e of the Committee report to
delete the words "City and County", the motion to read: I Council support le.gislation to amend the
state law to require state agencies acquiring property for public purposes to pay up to $200 moving
costs to original occupants displaced by such action, and provide' them with information concerning
alternative housing available."
A vote was taken on the motion as amended. Motion carried.
Mr. Wirgard stated the housing committee thought this bill was worthy, and invited City officials to
come to Salem and .back the legislation.
Mrs. Hayward moved seconded by Mrs. Beal that legislation be prepared for Council consideration which
would require the City, when acquiring property for public purposes, to pay up to $200.00 moving costs
for occupants of property at the time of acquisition, and provide them with information concerning
alternative housing available. Motion carried.

f. Senate Bill 195 - provides Counties be required to zone all land within them. A state-
ment of goals and standards is included to serve as a guideline.
Mrs. Beal moved seconded by Mr. Gribskov to support this recommendation.

g. Joint Housing Committee, Authorization to Support Legislative Bills - Mrs. Niven said
bills come in which are clearly within the scope of ~he housing resolution adopted by
the City Council, and asked that the Joint Housing Committee be allowed to support such
bills without having to explain each one to the Council.
Mr. Gribskov moved seconded by Mr. Mohr to give authority to the Joint Housing Committee
to support bills conforming to the concept of thephousing resolution adopted by the
Council. Motion carried.

carried.

and staff; and others.

1. Items from Mayor and Council
a. Sidewalks - 28th Avenue between Friendlv and Taylor ~ Councilman Teague had an inquiry
concerning installation of sidewalks on 28th Avenue from F~tendly to Taylor. Children
walking to and from school are forced to walk in the street. The Manager said the City
must purchase ad~quate right of way to install sidewalks at this location,. and money must
be budgeted for that purpose. Mr. Teague was also concerned about the crossing situation
on Patterson Street at the location of the YMCA.

b. Sign Ordinance Amortization - Councilman Mohr asked for a report at the next regular
Council meeting on implementation of the Sign Ordinance, and length of amortization period
for removal of signs.

c. Transient Business - Councilman Mohr asked for a report on conditions under which various
kinds of business can operate off open lots or various rented lots in the City. The
Manager said the Planning Commission had taken action on this type of business, and a
report would be forthcoming.

d. Public Buildings, Renewal Area - Councilwoman Hayward asked Mrs. Miller of the Eugene
Renewal Agency for information concerning reports of plans for erection of public buildings
in the renewal area. Mrs. .Miller said the Renewal Agency had not discussed this matter,
but she would look into it and report to the Council.
Mrs. Hayward moved seconded by Mr. McDonald that Items la, lb, lc and ld of the Committee report be
received and filed.
The Manager read a report from the Superintendent of Building Inspection explaining administration and
enforcement of the Sign Ordinance, and defining nonconforming or illegal signs. A discussion ensued
concerning nonconforming signs and the period of time for amortization of the various types. No action
was taken.
A vote was taken on the motion as stated and the motion carried.

e. Trailer Variance - Ridenour - Mrs. Ridenour requested extension of a variance permitting
use of a trailer on commercial property on West 11th. The staff recommends approval.
Mr. Gribskov moved seconded by Dr. Purdy to grant renewal of a permit for a house trailer
at 3760 West 11th. Motion carr{ed.
Mrs. Hayward moved seconded by Mr. McDonald to approve Item Ie of the Committee report. Motion carried.

2. Ambulance Rate Increase - Councilman McDonald explained that a committee composed of Eugene
and Springfield officials had been meeting with representatives of the Ambulance Company
to discuss feasibility of an increase in rates. After a study, the committee recommended
that the requested rate change be approved.

Mr. McDonald moved seconded by Mr. Teague that the proposal be accepted.
In answer to a question from Dr. Purdy concerning service charge, Mr. Leonard explained that
a penalty is charged for non-payment within 15 days. If a patient calls to report his
insurance company will make payment, this fee is not charged. This penalty also eliminates
many non-payment problems.
A vote was taken on the motion as stated, and the motion carred.
Mrs. Hayward moved seconded by Mr. McDonald to approve Item 2 of the Committee report.
Councilmati Purdy objected to the length of time allowed on the penalty charge. Mr. McDonald explained
that the joint city committee had discussed this, and that it was not a reuenue-making charge, but
intended 'to encourage prompt payment.
A vote was taken on the motion as stated, and the motion carried.

3. Plumbing Revision, Child Care, Inc. - With a revision in the plumbing facilities in its build-
ing to add one toilet and one wash Basin, Child Care, Inc. could accommodate seven more children
at its Child Care Center. The City has the necessaLY fixtures and could install them at a
nominal expense.
Dr. Purdy moved seconded by Mrs. Beal to approve a change in plumbing fixtures in the Child
Care Center at 169 North Washington Street. Motion carried.

8 4. Assessment for Paving 22nd Avenue between Chambers and Grant, Attorney Report - The City
Attorney has indicated he has not completed research on this matter and will report to the
Council as soon as possible.

5. Annual Audit - The Annual Audit Report and a memo from the Finance Department were previously
distributed to the Council for study. Mr. Harry Jacobs and Mr. Don Wall of Lybrand, Ross
Bros. and Montgomery, have prepared an audit to assure the Council the city administration
is adequately accounting for the City's fu~ds, Mr. Jacobs reported that great strides have
been made in the past three years, and the records are in good shape.
Mr. Teague move,d seconded by Mr.' Gribskov to accept the audit and place it on file. Motion
carried.
Mrs. Hayward moved seconded by ~r. McDonald to approve Item,S of the Committee report and accept

6. Proposed Contract with State of Oregon - Lighting Washington-Jefferson Bridge and Approaches _
The State of Oregon has proposed a contract whereby the State will install and maintain stEeet
lights on the Washington-Jefferson Bridge and its approaches, and the City will pay for power
for those lights within the City limits. The City share will be $660.00 per year. Staff
recommends that the City enter into this agreement.
In answer to a question from Dr. Purdy the Manager sai~ he has no information on arrangements
made by the County with the State, but he will look into it.
Mrs. Beal moved seconded by Dr. Purdy to approve the contract for installation of lights on
the Washington-Jefferson Bridge,approaches, and that the City Manager investiggte arrange-
ments made for similar situations by the County and State. Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald to approve Item 6 of the Committee report.
The Manager reported the County was not asked to bearEthe cost for power for lights outside the City
limits. Dr. Purdy requested the Manager to check the number of street lights in the city of Portland
on State highways, and whether that City is charged for those.
Rollcall vote. All councilmen present voting aye, motion carried.

7. Improvement Petitions
a. Paving Douglas Drive from McLean, 750' east - Petitioned by owners of 66% of the property.
Dr. Purdy moved seconded by Mrs. Beal to accept the petition. Motion carried.

b. Paving alley between Madison and Monroe from 1st Avenue to 2nd Avenue - Petitioned by
owners of 64% of the property.
Dr. Purdy moved seconded by Mr. Gribskov to accept the petition. Motion carried.

c. Paving alley between Portland and Willamette; also alley between 27th Avenue and 27th
Avenue from Willamette to the north-south alley - petitioned by owners of 81% of the
property.
Dr. Purdy moved seconded by Mr. Teague to accept the petition. Motion carried.

d. Paving 50th Avenue from Imperial Street to the east boundary of Chalet Plateau - petitioned
by owners of 100% of the property. Storm sewer cost included in paving assessment to
developer of Chalet Plateau.
Dr. Purdy moved seconded by Mr. Gribskov to accept the petition as stated. Motion carried.
e. Paving, sanitary and storm sewer, 1st Addition to Valley West - petitioned by owners of
100% of the property. Cost estimate for city share of storm sewer is $5,000.
Dr. Purdy moved seconded by Mr. Teague to accept the petition. Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald to approve Items la, lb, lc, ld, and Ie of the Committee
report. Motion carried.

8. Request for Waiver for Asphaltic Alley Paving - NilsB. Hult and Associates have requested
permission to improve the north-south alley, east of Mill Street, to provide additional
parking for the Medical Arts Building. The alley dead-ends at the north property line, and
cannot be used as part of ~he;street system. Staff recommends approval of this request, since
the alley will actually be used as part of a parking lot..
Dr. Purdy moved seconded by Mr. Gribskov to permit Nils Hult and Associates to pave the north-
south alley east of Mill Street as requested, subject to City authority to revoke the permit
at any time. Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald to approve Item 8 of the Committee report. Motion carried.

9. Authorization to Purchase Street or Sewer Right-of-Way
a. Crescent between Tulip and Gilham - Public Works Department has requested authorization to
acquire:,a twenty-foot sanitary sewer easement at the appraised value of the land of $420.00.

on Creseent between Tulip and Graham. Motion carried

b. 18th Avenue east of Oakpatch - Public Works Department has requested authorization t~
purchase street right-of-way on 18th Avenue west from State Finance Company per appraised
price of $207.35 from Oakwood Manor Corporation and $1,235.98 from State Fina~ce Company.
Dr. Purdy moved seconded by Mr. Mohr to authorize purchase of street-right-of-way for the
amount stated.
In answer to a question from Mrs. Beal the Director of Public Works explained that the
property had been appraised two years ago, but negotiations have been in progress for that
length of time.
A vote was taken on the motion as stated, and the motion carried.

2 10. Improvement of 20th Avenue, Washington to Friendly - The Manager explained that this matter
had been discussed previously by the Council, but the project had not been initiated.
Mr. Teague moved seconded by Mr. Gribskov that the Council initiate improvement of 20th Avenue
from Washington Street ~0 Friendly Street. Motion carried.

11. Parking Restriction, West 7th Riliace~ and Wilson - The Traffic Engineer recommends elimination
of parking on 7th Place at Wilson to increase sight distance.
Mr. Gribskov moved seconded by Mrs. Beal to approve the recommendation. Mo~ion carried.
Mrs. Hayward moved seconded by Mr. McDonald to approve Items 10 and 11 of the Committee report.

4 12. Correspondence - A letter from the Lane County Sanitarian reports on the status of the annex-
ation of College Crest Water District. State and County Sanitarians will form an investigat-
ing team which will begin March 3rd to evaluate the alleged health hazard.
No action was taken on this Item.
At this point Dr. Purdy left the meeting.

b. H.B. 1027 - Boundary Board Bill. Under present proposal, even small 100% consent annex-
a~ions will go before the Boundary Board, which could create a large backlog burden. Leg-
islation should be written so that minor annexations would not be subjected to boundary
board supervision. Mr., Mohr stated one of the reasons for the change was that, under
the previous proposal, minor annexations were not defined. After discussion of proposed
wording, Mr. Teague moved seconded by Mr. Gribskov that the administration be authorized
to express the view of the Council that standards should be set for minor annexations,
and these should be excluded from the jurisdiction of the Boundary Board. Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald to approve Items l3a and l3b of the Committee report.
Ceuncilman Wingard said the committee had disucssed this bill, and had. left it in its present form.
They came to the conclusion small annexations really cause more problems than large ones.
A discussion followed on whether 100% consent annexations should not be excluded from boundary board
study to enable more time to be spent on larger annexation.

Council to study the bill. Motion carried..

c. H.B. 1398 - Cigarette Tax. Proposed bill reduces revenue available to the City from the
cigarette tax. Present bill distributed 2~ to property tax relief, l~ to County and l~
to City. New proposal would use money from cigarette tax as a property tax off-~et.

d. S.B. 211 - Extends from two weeks to three weeks period of time those serving in armed
forces summer camp receive full pay from public ~mployer, plus military pay. Private
employers are required to give leave, but without pay. 12 days of active duty are all

any service requires, so the extension is without reason.
Mrs. Beal moved seconded by Mr. Teague that the Council go on record opposing S.B.

e. H.B. 1252 - provides time and one-half for all time worked over 40 hours per week. The
Council will study the bill for further consideration.
The Council discussed the proposed bill, present city policy and reasons for change. The Manager
pointed out that supervisory personnel now receive no overtime, and the Fire Department would be put
in a difficult position by adoption of this bill.
Mr. Teague moved seconded by Mr. Gribskov that~the~Council go on record opposing H.B. 1252. Motion
carried.

1. Jail Addition, Approve Specifications and Plans - Plans for a proposed addition to the jail
have been prepared and have been approved by the County Commissioners, and presented to the
Council for authorization to call for bids. The Plans were shown to Council members, and
the Manager explained that the cost woiliilld be fifty to sixty thousand dollars.
Mrs. Hayward moved seconded by Mr. McDonald to authorize calling of bids for proposed addition to
present jail.
Councilwoman Beal objected to improving the present facility, and asked about the possibility of
replacement.
Councilwoman Hayward explained that the Council had long been concerned about jail conditions and had
participated with the County in a study. It was the consensus at that time that the present facility
should be maintained until the voters approved financing to build the jail at another location.
Mrs. Beal asked that the Council request City and County Planning Commissions to report to the Council
with regard to possible locations for a new jail. Mayor Anderson suggested that admini~tration and
funding should be discussed prior to looking at locations.

2. Segregation of Assessment, Ho1ger D. Berntzen - Staff recommends that the Council approve
a segregation of this assessment.
Mrs. Hayward moved seconded by Mr.McDonald that the council approve a segregation of assessment for
Holger D. Berntzen, to'alloW"deferral of a lien of $2,230.28. A rollcall vote was taken on the motion
and all councilmen pnesent voting aye, the motion carried.

Mrs. Hayward moved seconded by Mr. McDonald to approve a new application for Charter Oak Restaurant.
In answer to a question from Councilman Mohr, the Manager said no answer had been received from the
Liquor Control Commission on request to permit administration recommendations on applications, rather
than formal Council action.

Addition to Edgewood West was submitted and read the first time in full on February 3, 1969 ~nd held
over to this meeting to allow proper notice of assessment to be given owners of affected p~operties,

consideration with a written protest from John R. and Lesley H. Meninger, objecting to assessment
until settlement of placement of property line. Department of Public Works has discussed the matter
with owners and agreement will be reached.
