Regular meeting of the Common Cpuncil of the City of Eugene, Oregon was called to order by His Honor
Mayor Lester E. Anderson ~oat 7:30 p.m. on March 10, 1969 in the Council Chamber. Councilmen present
were: Mrs. Hayward, Dr. Purdy, Messrs. MeDgnald,,'Wiiligard and Teague, Mrs. Beal and Messrs. Gribskoy
and Mohr.
1 Minutes of the Council meeting held February 24, 1969 were approved as mailed to Council members.
2 Proclamation, International Festival Week - The Mayor's Committee on International Cooperation, under
the leadership of Mrs. Albert Kitzhaber has planned an International Festival to promote better int~r-
national cooperation in the community. - Mayor Aridersori -introduced 'Mr.Mike Gooley, 'who represented the
committee in Mrs. Kitzhaberls absence. Mr. Joseph Gomal, sutdent at the University, explained how the
International Festival promotes community understanding of other nations, and allows residents of
other nations studying at the University an opportunity to show a part of their country's culture to
residents of the City.
Mayor Anderson read a Proclamation declaring the week April 6-12, 1969 International Week.
COMMITTEE REPORTS
Committee meeting held February 26, 1969
Present: Mayor;Anderson, Councilmen Hayward, McDonald, Beal, Gribskov and Mohr; City Manager and
staff; and others.

1. Items from Mayor and Council
a. Appointments - Mayor Anderson appointed Mrs. Don (Kathy) Siegmund tm a position on the Human
Rights Commission.
Mrs. Wickes Beal was appointed to replace Mrs. Catherine Lauris on the Community Goals
Conference.

b. Butte Cross- Wendy Ray stated the Associated Press reported the Supreme Cour,t; by a 4-3 .
vote, ruled the cross on the Butte is not a religious symbol, and does not ~ave religious
significance to most people, and therefore, will remain on the Butte.

c. @ouncil Reports - Mrs. Hayward said Mrs. Leo Gorman, 160 West 37th, had reported circulation
of a petition requesting removal of car lots to Coburg Road area to provide more room in the
Central Business District.
Mrs. Hayward reminded the Council of Chamber of Commerce Legislative Luncheons. Mrs. Beal
will attend. Mrs. Hayward also reminded the Council of the Council Legislative meeting
Friday at 4:00 p.m. State sales tax will be discussed, and all members are welcome.
Mayor Anderson adv.ised that the Land and Water Conservation Fund Interagency Advisory
Committee will meet noon Friday. $9,601.00 is available, and it is suggested thi~ amount
be divided between City and County parks projects. The Mayor asked for a represenaative
to attend. Mr. Gribskov volunteered.

d. Deferred Assessment - Mr. Dan Morris, 4680 Fox Hollow Road, has requested deferment of a
sewer assessment. Since the p~operty is an island within the city limits and cannot legally
be assessed, Public Works Department recommends assessment be deferred until the property is
annexed and the owner wishes to use the sewer.
Mr;3.Hayward moved seconded by Mr. Gribskov that the City Council approve the requested
deferment of assessment. Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald that Item ld of the Committee Report be approved.. Rollcall
vote. All councilmen present voting aye, the motion carried unanimously.

Mr. Dwayne Fullerton, 1211 High, Mr. Arthur W. Krieg, 3252 Onyx Place and Mrs. Donald Ridenour
3768 West 11th, spoke in favor of a stricter law, and objected todrunning at large in neighbor-
hoods.
Mr. Everett McVicker, Manager of Lane County Humane Society, was very much in favor of a stricter
law. He objected to Section 5, "Killing Certain Dogs'~, saying this was unrealistic and medically
unsound.
~. Mohr suggested that Section 5 be deleted from the ordinance, as it did not pertain to a
leash law. Mrs. Hayward agreed, and moved seconded by Mrs. Beal, to delete Section 5 from
further consideration in this ordinance. Motion carried.

Mrs. Beal moved seconded by Mrs. Hayward to authorize the staff to proceed with rev~s~on of the
ordinance, reflecting the general consensus of the Council, and present the revised ordinance
at another meeting. Motion carried.

taken.
Councilman Mohr suggested that there might be people present to speak to this issue. Mr. Blaine Ackley,
162 HighlStreet, spoke in favor of the Ordinance, but felt there should be provision for people to walk
dogs in pagks iwiphout a '-leash.
1 3. Report re: Outdoor Sales of Merchandise Affected by Zoning Ordinance A report was read from
the City Attorney outlining provisions' for Outdoor Sales of. Merchandise not connected with the
main business operation normally on the premises. The-Manager explained that the Planning
Commission had heard this matter and had agreed, as policy, this could be handled as a Condition-
al Use, which would permit operation in C-2 zones under Conditional Use application after public
hearing. Mrs. Ridenour uses five different locations so would require five'separate permits.
Mrs. Niven, Planning Commission President, explained that it would not be necessary for Mrs.
Ridenour to obtain the permit - businesses owning the property would obtain the permit, and it
could be used for outdoor sales other than Mrs. Ridenour's.
In answer to a question from Councilman Mohr, Mrs. Ridenour said other towns license this type
operation, and she thinks this is the best solution.

Mrs. Catherine Lauris suggested amendment of the Zoning Ordinance. or licensing to allow tgis
type merchandising. The Planning Director explained that the Conditional Use covers many uses,
and that an indefinite period can be set for expiration of a ~ermit.
Mrs. Hayward moved seconded by Mr. McDonald to uphold the Planning Commission recommendation,
with regard to the policy concerning Outdoor Sales. Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald tbhapprove Item 3 of the Committee Report. Motion Carried.
Mrs. Ridenour asked the Council why some businesses in the City were permitted to sell merchandise
similar to theirs. She explained that an arrangement had been made with a local merchant to buy into
his business, and asked if this arrangement would permit them to sell in a like manner. The Mayor
explained that the Council was now acting on material presented at the meeting of the Committee of the
Whole. If Mrs. Ridenour had a new proposal, this should be submitted to the"Planning -Commission for t
their recommendation to the Council at another meeting.
A vote was taken on the motion as stated. Motion carried with Councilmen Teague and Mohr voting no.
2 4. International Festival - Mayor Anderson introduced Mrs. Albert Kitzhaber,'Chairman of the Inter-
national Cooperation Committee, who asked Council support for the Internation Festival on the
University of Oregon campus.
Mrs. Hayward moved seconded by Mrs. Beal that the Council request the staff to prepare a resol-
ution declaring the week of April 6.th~ough 12, 1969 International Week. Motion carried.

3 5. Jail Facility - Councilwoman Beal discusseu the possibility of Lane County and Eugene Planning
Commissions initiating a study of future city buildings, and land acquisition, with the jail a
part of a total building program.
Mrs. Beal moved seconded by Mrs. Hayward that every priority consistent with orderly planning
be given to the construction of new jail facilities. Motion carried.
The Council discussed the possibility of County participation and cooperative funding of a new
facility.
Mrs. .Beal moved seconded by Mr. Mohr to pursue with diligence negotiations with governmental'
agencies regarding assistance in funding construction of new jail facilities. Motion carried.
Mrs. Hayward moved seoonded by Mr. McDonald to approve Item 5 of the 80mmittee report. Motion carried.

1. Items from Mayor and Councilmen
a. Cross, S~inner's Butte - Councilwoman Hayward suggested that, until mitigation is settle9,
the Council maintain the attitude of neutrality established before the appeal was.taken to
the Oregon Supreme Court.

Mrs. Hayward moved seconded by Dr. Purdy that the Council not discuss or take into'consider-
ation anything to do with the Cross at this time.
Mr. Teague suggested that there be no discussion without public notice, and that all members
of the Council be present at that time.

1
b. Ordinance, Parking of Trucks on Residential Streets - Mr. Arthur Krieg, 3252 Onyx Place,
objected to trucks parking on residential streets, and suggested the Council give priority
to looking into an ordinance concerning this matter. The Manager said the City Attorney
and Traffic Engineer have been working on this problem, and will make a recommendation whether
or not an Ordinance would be enforceable on this matter.

c. Congressional-City Conference - The Manager requested a Council member attend the March 30-
April 1, 1969 Congressional-City Conference in Washington, D.C. Mrs. HayWard, Dr. Purdy
and Mrs. Beal may be able to attend. .
Mrs. Hayward moved seconded by Mr. McDonald that Items lb and lc of the Committee report be received
and filed. Motion carried. Manager said City Attorney is working on material concerning control of truck
parking inr~sia~nti~l districts, but has no schedule for presentation.
3 d. Planning Commission, Community Goals Discussion - The Planning Commission has asked if the
date of March 17, 1969 would be agreeable to the Council to meet for Community Goals discus-
sion. Councilman McDonald will be unable to attend. The Council will meet with the Planning
Commission in the McNutt Room on March 17, 1969 at 7:30 p.m.

Dr. Purdy moved seconded by Mr. Gribskov to approve this petition. Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald that Item Ie of the Committee report be approved. Motion

2. Appeal from Staff Decision, Aalseth - The Manager outlined the background of Mr. Aalseth's
operation at Mahlon Sweet Field, and the results of the Airport Commission. hearings' into the
matter. The Airport Manager indicated the Commission would further consider the matter if
Mr. Aalseth made formal application and complied with minimum standards for operation.
Mr. Edward Fechtel, attorney for Mr. Aalseth, stated that part of Mr. Aalseth's problem had
been caused because Rules and Regulations had not been adopted for the Airport. Since they
were ado~ted February 11, 1969, Mr. Aalseth now understands the.requirement~, and will file
application under Section 10 of those Rules and Regulations. He requests that status-quo be
maintained until action has been taken on this application.
Dr. Purdy moved seconded by MrS. Hayward to refer Mr. Aalseth's appeal back to the city staff
with the understanding Mr. Aalseth will file within thirty days for a specialty license under
Section 10 of the new Rules and Regulations for the Airport.. . Motion carried,.,
Mrs. Hayward moved seconded. by Mr. McDonald to approve Item 2 of the Committee report. Motion carried.

3. Experimental Burning, Mahlon Sweet Field - A Memorandum of February 26, 196 was read from
the Airport Manager requesting permission to use 240 acres of airport property for experiments
in contro: of ryegrass field burning.

Mrs. Beal moved seconded by Mr. McDonald that the Council reject the proposal of the Airport
Manager.
Dr. Purdy suggested this type expermmentation might help solve some of the problems of air
pollution. Mr. Juilfs explained that publicity would be given to indicate exactly what was
being done, and that this might improve community relations. The Mayor said this might be an
opportunity for the City to cooperate with those trying to alleviate the problem of air pollu~
tion, and suggested that Dr. Chilcote and Mr. Drew be invited to meew with thee Council and
explain the experiments and the provisions made for improving public relations.
Mr. Mohr moved seconded by Dr. Purdy to table the pending motion and extend an invitation to
Dr. Chilcote and Mr. Drew to meet with the Council for further discussion. Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald to approve Item 3 of the Committee report. "~'
The Mayor asked that Lane County Air Pollution Authority also be adi~8ed of Committee discussion on this'
matter, and be invited to the discussion with Dr. Chilcote and Mr. Drew

4. Planning Commission Report, February 4, 1969
a. Annexation, south of Floral Hill Road between Riverview and Floral Hill - The Planning
Commission recommended this annexation, based on an existing health hazard, .since it can
be corrected by connection to sewers now in the a~ea, and is adjacent to recently annexed
property.
Mrs. Hayward moved seconded by Dr. Purdy to approve the annexation as recommended by the
Planning Commission.

b. Beltline-River Road Annexation - The Council approved this annexation'at a previous meeting
and needs only to note and place on file at this time.

c. Vacations
1) Easement over south half of vacated 2~th Avenue as extended from Lincoln Street 150 feet
t to the east.
Mrs. Hayward moved seconded by Mr. McDonald to approve the vacation as recommended by
the Planning Commission. Motion carried.

2) McLean Boulevard west of Graham Drive
Mrs. Hayward moved seconded by Mr. McDonald to approve the vacation as recommended by

Motion carried.
3 5. Purchase Negotiation, Street Right of Way between Polk and Grand - Purchase of this property
would provide a portion of right of way necessary to connect two streets north of 1st Avenue.
Previous Planning Commission action indicates the desirability of opening this street.
Mr. Teague moved seconded by Mr. Gribskov to recommend authorization to proceed with negotiations
for purchase of street right of way. Motion carried.

6. One-Way Street Proposal, 10th from Willamette to High, eastbound - Construction ot the Overpark
has accellerated need for this action. The Council discussed future plans for permanent
tr~ffic movement 6n this arterial in relation to future parking structures~.
Mrs. Hayward moved seconded by Mr. McDonald that a one-way traffic pattern be established on
10th Avenue from Willamette to High, eastbound. Motion carried.

Mrs. Hayward moved seconded by Mr. McDonald to approve Items 5 and 6 of the Committee report. Motion
carried.
5 7. Engineering and Administrative Charges, Public Works Assessment pro;ects - The City now adds
10% to contract costs to cover cost of engineering design, inspection, warrant interest,
notifications, assessment calculation and billing. Recent analysis indicates the 'average
costs on these project~ is at least 15%. Staff recommends raising the charge, with another
review at the end of the 1969 construction season.
Mrs. Hayward moved seconded by Mr. McDonald that administrative charges to be applied to this
years projects be increased to 15%, subject to review'of the 1969 season. Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald to approve Item 7 of the Committee report. Rollcall vote.
All councilmen present voting aye, the motion carried unanimously.

8. Consideration of Change in Medical Insurance - After a great deal of study, the staff recommends
a change in medical insurance to a comprehensive plan, including major medical coverage. The
proposed'plan would increaae the Cityls cost from $7.50 per month to $10.00 per month per
employee. The Director of Personnel said that he had been contacted by representatives of the
local Life Undersriters Association who felt that several agents should be appointed by the
City. The Director of Personnel said he had considered their viewpoint, but still felt it
was in the best interests of the City to appoint only one agent, and recommended appointment of
Mr. Phil Kellar as agent-of-record. He_said different types insurance had been discussed
with employe groups, and this type coverage was preferred to the present insurance. He dis-
cussed the various aspects of the comprehensive insurance .plan with the Council, and Mr.
Kellar's role as a disinterested party.

Mrs. Hayward movee seconded by Mr. Gribskov.to appoint Phil Kellar agent-of-record for City
medical insurance.
Mrs. Beal requested the staff to discuss this matter with University officials who have made
a study of various types insurance. The Personnel Director a'greed to do this.

The Manager explained the office has received a number of inquiries regarding City insurance specifica-
tions. Deadline for submission of .bids has been changed to March 22, 1969 to allow more time.
Mr. G. E. Evans, 3320 Harris, objected 'to the appointmen't of an agent of record. He said the agent
of record should be chosen by the company awarded the. bid. Personnel Director explained that many
companies were contacted and many avenues explored before a decision was made to appoint an agent of
record. Mr. Kellar is a broker for many insurance companies'and has had considerable'experience w{th
the type of coverage the city decided'would best suit its'needs. He assisted in writing specifications
for a comprehensive coverage and these have. been mailed to companies writing this type insurance. All
qualified companies may bid.

7 9. Bids, Public Works Pro;ects, opened February 25, 1969 - Copies of bid tabulation covering paving
. and sewer projects were previous ly distributed to Council members.' A. public .-' hearing will
accompany award. of bids at the March 10, 1969 Council meeting.

With regard to paving Robin Avenue, the basic bid was excessive, and Public Works. Department

recommends rejection and rebidilater.
On sanitary sewer for Floral Hill Drive, low bidder requested withdrawal because of mistake in
bid. Public Works Department recommended award to D.&.D. Backhoe Service.
On revision to East Bank Trunk, Public Works Department recommended award to low bidder.
Regarding sanitary sewer in Alfred's Plat, the bids were exceedingly high, and the high assess-
ment would cause hardship to property owners. Public Wprks Department recommended rejection.
In answer to a question from Dr. Purdy, the Public Works Director said they will attempt to
rebid, separating trunk sewers from laterals to attract more bidders.
On the s~~rm sewer between 19th and 20th from Willamette to Amazon Creek and sanitary and
storm sewer, 24th from Columbia to Van Ness, Public Works Department recommended award of
bid to low bidder. !
Mrs. Hayward moved seconded by Mr. Teague to approve the staff recommendations in the matter
of warding bids in each of these projects. Motion carried unanimously.
Mrs. Hayward moved seconded by Mr. McDonald to approve Item 9 of the Committee report. Rollcall.
All councilmen present voting aye, the motion carried unanimously.

10. Assessment Deferral, Sanitary- Sewer, Morse Street - The Manager explained that the Weber
property does not wish to dedicate the remainder of the street or make use of the sewer at
this time, and is requesting deferment. Weber's were not petitioners, nor were they notified
of the proposed project, so Public Works Department recommends deferment be granted.

Mr. Teague moved seconded by Dr. Purdy to recommend assessment be deferred on Weber property.
Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald to approve Item 10 of the Committee report. Rollcall.
All council men present voting aye, the motion carried unanimously.
2 11. Loading Zone, East Side of Agate, 13th to 15th - The Traffic Engineer recommended establishment
of a loading zone at this location, since the present "No Parking" zone has caused increased
traffic congestion, and a proposed loading zone would provide a higher level of enforcement
than now exists in the area.
Mr. Gribskov moved seconded by Mr. McDonald to approve the recommendation of the Traffic Engin-
eer, and instruct the Police Department to pay particular attention to enforcement of the load-
ing zone area.
A discussion took place about nighttime food vendors in the University area, and whether
licensing was required for this type service. The City Attorney said the restaurant which pre-
pares the food is licensed, but no vending license is required.
A vote was taken on the motion as stated, and the motion carried.
Mrs. Hayward moved seconded by Mr. McDonald to approve Item 11 of the Committee report. Motion carried..
3 12. Traffic Controls, 15th and Washington - The Traffic Engineer reported the accident rate at this
corner had been decreasing gad recommended the request for traffic controls at this intersec-
tion be denied. No action taken by Council.
Mrs. Hayward moved seconded by Mr. McDonald to receive and file Item 12 of the Committee report. Motion
carried. Mr. McDonald asked the Manager to notify interested parties of this action.
4 13. Horseback Riding on Sidewalks - The Manager said City Department heads have received several
reports of problems with horses being ridden on sidewalks. Since City street cleaners do not
clean sidewalks, some control is needed.
Mrs. Hayward moved seconded by Mrs. Beal to request the staff to prepare an Ordinance prohibit-
ing riding of horses on City sidewalks. Motion carried.
\Mrs. Hayward moved seconded by Mr. McDonald to approve Item 13 of the Committee report.
Mr. Everett McVicker spoke in favor of an Ordinance prohibiting horseback riding on sidewalks, and
asked that the Council consider adding a clause requiring display of a warning light on horses ridden
on streets after dark. ~.

14. Anti-discrimination Ordinance - An Ordinance was distributed to the Council from the Human
Rights Commission with its recommendation for adoption. No aation taken.

State Sales Tax Legislation - Discussion took place on sales tax legislation and its affect
on City financing and income. Councilman Mohr suggested the Council merge provisions of the
now-passed sales tax legislation against positions taken and stated by the Leggue of Oregon
Cities in its paper "Financing Local Government", to set forth satisfactory criteria. City
or County sales tax was discussed, with suggestions for proper time to present such anmeasure~
to the voteDS. The Manager will request the League of Oregon Cities to prepare a progress
report, as ~t. applies to the position paper, both past and preposed. It was suggested the
Council meet at 7:00 before its regular meeting to go over this tax with Representative Wingard.

Mr. Henry Camerot, attorney for the developer of property between Chambers and Filmore, said the developet'
had petitioned the Planning Commission to allow one lot to front on Chambers. This plan was opposed; ,
and it was suggested by the Planning Commission that all lots front on, Filmore. Since these lots back
up to Chambers, the developer objects to paying assessments, when he has no egress. 'Mr. Camerot circu-
lated photographs and explained that the lots could not' utilize Chambers Street. Council asked who had
puilt the earth burm on the rear of these lots. Director of Public Works said, to his knowle~ge,
Breeden Bros. had built this mound. Attorney advised Council in his memo of March 10th that the City'
~ould legally make an assessment 'upon the property 2wners whose lots abutted Chambers for their propor-
tionate share of the cost of improvement.
Mr. Earl Eggers, 2105 West 29th, explained that his property has only 25' fronting on Chambers Street;
and that he would not, at any time, take advantage of sanitary sewer service off Chambers Street. He
pbjects to paying the sewer portion of the assessment. Director of Public Works said a stub was put
in as a matter of policy.

Councilman Mohr .moved that the Council amend Council Bili 8738 to recognize lots on Chambers Street
derive from use of sidewalk and should be assessed, but Council finds no benefit derives from abutting

the assessment on this project, s~ying that the charges are far in excess of the bid for the project.
Residents outlined problems faced due to delays and stated that they did not feel they should be .
charged for the contractors failure to complete the project on time. Public Works department explained
the problems faced by the contractor on the project and that penalties pssessed against the contractor
were not assessed against the property owner. Projects. are not assessed on average costs o'f paving
during the current year, but on the actual costs of the proje~t.

,Mrs. Thelma Fowler, attorney representing a property owner affected by this annexation, said her
client objected to the agreement, since he could be assessed more than onee for sewers on the same
property. ~he Manager explained that the Planning Commission and Council action in proceeding with the
annexation was based on the understanding that construction of a sewer system was necessary to properly
develop their properties. The system will not be permanent, and will only insure use of their property
until such time as River Road is annexed and a permanent system installed.
