Anderson - at 7:30 p.m. on March 24, 1969 in the Council Chamber. Councilmen present were: Mrs. Hayward, Messrs. McDonald, Wingard and Teague, Mrs. Beal ..and Messrs. Gribskov and Mohr. . The Mayor welcomed members of High Y Junior High Government class and commented that Local Government Day will be celebrated April 5, 1969. COMMITTEE REPORTS Committee meeting held March 12, 1969 Present: o Mayor Anderson; Councilmen Hayward, Purdy, Teague and Mohr; City Manager and Staff and others. 1 . 1. Items from Mayor and Council a. Chamber Legislative Luncheons - Mayor Anderson reminded Council membe~s of the Chamber of Commerce.Legisl~tive luncheons at the Eugene Hotel and encouraged Council members to attend. Mrs. ,~aywargMoved.seconded by Mr. McDonald to receive and file Item la of the Committee report.Motion carried. . f 2 b. Resolution, Sales Tax Legislation - Councilman Mohr introduced a Resolution regarding the present sales tax legislation, and mo;ved seconded by Mrs. Hayward that the Council' endorse the resolution and not support the present sales tax legislation. He explained that the present proposal does not measure. up to standards prescribed by the League of Oregon Cities as supported, for financing local government. The Council discussed the resolution, and whether or no~ present legisla~ion should be supported. It was the consensus that all proposed legislation has not been considered, and that some part of the total package might provide needed relief for city finances. The Council should not express its dissatisfaction at the present time. Dr. Purdy moved seconded by Mr. Teague to table this item. Motion carried with Mr. Mohr voting. no. Mrs. Hayward moved seconded by Mr. McDonald to table Item lb of the Committee report. --=--. __ 5. Councilman Mohr commented that no adequate programs for city financing had been passed by State, and the City would be faced with inadequate measures for local governments. A vote was taken on the motion as stated, and the motion carried with Councilman Mohr voting no. 3 2. Oregon Tavern Owners Request to Permit Amusement Devices - (Outlawed by City Ordinance adopted in 1959). Mr. Bud Nixon explained the position of the Oregon Tavern Owners Association in requesting repeal of the present ordinance, and explained that this would bring a tremendous increase in city revenue, without increasing problems. of enforcement. ,~ .1 The Manager read reports from the City Attorney and Chief of Police outlining problems caused in the past by this type device, and reasons for not repealing the ordinance at this time. The Chief of Police explained that this type amusement is undesirable, in that it encourages gambling, and any revenue received would be required to ensure enforcement. Mrs. Hayward moved seconded by Mr. Mohr to deny Mr. Nixon's request. Motion carried. Mrs. Hayward moved seconded by Mrs. Beal to deny Mr. Nixon's request. Motion carried. 4 3. Request for Card License, Golden Canary Tavern - The Manager explained that a card license renewal for the Golden Canary Tavern had ;been denied last year, because of violations resulting in two arrests fo~ gambling. Mr. Nixon has resubmitted an application for issuance of license for card tables. Staff recommends denial, based upon a report from the Chief of Police, rec- ommending no further consideration be given before July 1969 to this license. Neighborhood Traffic Problem, 29th Place at Oak Street - The Traffic Engreneer pointed out the location of the problem site.on maps and suggested possible solutions. After meetings with property owners, two plans evelved, and ,petitions in favor of "Plan D" have been signed by 56% of owners of property to allow temporary closing of certain streets. To discourage counterclock- wise traffic, barricades would be placed to close 29th Place and an alley off 29th. Mr. Mohr presented a letter from Mr. David Bensler commending the Pplice Department for their excellent cooperation during this period. 1 5. Planning Corrunission Report, February 24, 1969 - The Planning Corrunission recorrunended approval of exception requests of Pyle and Sandford, 1893 Garden Avenue, to build an apartment in a C-2 zone, and Wayne L. Johnson, 932 West 7th, to construct apartments. These projects were ~. under way at the time of adoption of the new zoning ordinance, and could not be completed if the new zoning ordinance were ad~ered to. Dr. Purdy moved seconded by Mrs. Hayward to uphold the recorrunendation of the Planning Corrun~ssion. Motion carried. Mrs. Hayward moved seconded by Mr. McDonald to approve Item 5 of the Committee report. Motion carried. 2 6. Review of Request for Experimental Buring, Airport Property - Mr. Ken Drew, member of the Seed League, explained the need for a large tract of land for experimentation to obtain information which might curtail' field burning. The acreage, could, still bring, revenue .to the city, and research would benefit the community. Dr. Chilcote explained that Oregon State University would participate in coordinating research on the tract. Small tracts would be given different treatments for a three year period. , The Council discussed details. of this program with Dr. Chilcote and Mr. Drew, with possible pollution effect on the city. Dr. Purdy moved seconded by Mrs. Beal to refer the matter of fieJd experimentation on city property to the Lane County Air Pollution Authority for irrunediate action. Motion carried. Mrs. Hayward moved seconded by Mr. McDonald to approve Item 6 of the Corrunittee repprt. Motion carried. The Manager said Lane Air Pollution Authority had discussed this matter and have sent a recommendatipn which will be presented to the Council at the Wednesday Corrunittee meeting. 3 v 7. Review of Runway Maintenance Problems at Airport - The Airport Manager explained problems of deterioration of runways, esp~cially since jet traffic has increased. He explained that reg~ ular maintenance cannot keep the runways in repair, and for this reason, the engineering firm of CH 2M was retained to make a study of surface problems before a planned overlay project was started. There is a possibility the airport will have to be temporarily closed to jet traffic. Staff wmll make a recommendation regarding contract for resurfacing when CH 2M reports on results of the study. . . . , . Items from Mayor and Council a. ,Airport Closure ~ Because of the importance of action on the problem of possible. closure of the airport, Mayor Anderson suggested that the Council proceed directly to Item 5 on the agenda. The Manager read minutes of.a special meeting held by the Airport Corrunission Tuesday, March l8tq.hrecommending that no action be taken on closure of the airport until engineering reports have been seen, and that the City continue to ,patch the runw~ys. The airport manager recorrunended that the Council place a 40,000 pound load limit on the airport effective March 25, 1969 in line with a March 14th reco~endation from the Federal Aviation Administration. The Council discussed problems of drainage, and whether oontinued patch- ing wou~d be effective. A representative of CH 2M pointed out that additional tests were required and results from these tests were expected by March 28th. The Mayor suggested that the airport be kept open, and that means of obtatning additional funds be explored. The Manager said the airport budget has already been exceede9, and that money will have to be used from other city functions if the"patching" program continues for an extended period of time. ~ representative from United Airlines was asked if his airline would be willing to accept full responsibility for continued flights if the airport remained open. He, said he was not in a position to corrunent on that. Mr. Teague moved seconded by Mrs. Hayward that the Council delay action on airport closure pending results of tests by CH 2M. Councilman Mohr suggested that CH 2M contact. Mr. Munk, who has offered his soil testing services to the city. f ~ . . - . The Mayor expressed appreciation to the Governor and Mr. Bob Dunn~ Director of the State Bureau of Aeronautics for their assistance with this problem. Councilman Mohr questiOned the relationship. of the Governor's study corrunittee to the CH 2M study. Mrs. Hayward asked that the Council be provided with copies of the letter from FAA. Mr. Mohr moved seconded by Dr. Purdy that the airport be kept open, subject to results of tests conducted by CH 2M. Motion carried. Mrs. Hayward moved seconded by Mrs. Beal that a resolution be adopted thanking not only the Governor, but State Senator Fadeley and Representative Dellenback for assistance with problems at the Airport: Motion carried. The Manager said he had a report from the Airport Manager that the main runway would be closed for testing Friday and Saturday and all traffic would be required to use the secondary area. The Manager outlined the expense of continuing to patch ,runways, and recommendation of the Airport Manager that a load limit of 40,000 lbs. be placed on the airport as a temporary restriction on the main runway, and a permanent restriction on the secondary runway. e I . The Manager said he had been at the airport with Mr. Juilfs and Mr. Altman, Vice President ,in charge of operations at Air West. They concurred that the secondary runway was no longer safe for jet air- craft now using the' field, and could possibly present a ]:i.azar.d due to deterioration of asphaltic con- crete. The Manager explained the danger of permanent damage to runways, and that FAA has indicated it will not share in additional cost of repair resulting from continued use. Staff recommends a restric- tion on the main runway to 40,000 lbs~,until a report is received from engineering tests, and permanent restriction to 40,000 lbs. on the secondary runway. Mrs. Hayward moved seconded by Mr. McDonald to accept the recommendation of staff to restrict ,the main runway to 40,000 lbs. until receipt of engineering tests, and indefinite restriction on .secondary runway to 40,000 lbs. Mr. Altman said the a~rport is, from a physical appearance, definitely upsafe for jet o~eration. Det- erioration is extremely rapid. Air West has made temporary arrangements with Corvallis airport for jet servic~,and ~ill provide limousine service for passengers from Eugene. I In answer to a question from Mr. McDonald, the City Manager said money from the bond issue' has not been used for repairs to the field. Bids have been opened for reconstruction, but the contract has not been let. Mr. Sperber, Regional Manager of FAA, anticipated a contract would be approved Tuesday, but did not want ,to proceed with work until the engineering report is in. Mr. Carlson Stark, Northwest Regional Vice President, United Airlines, agreed with Mr. Altman's state- ments. He said they wanted to assist, the City and serve the Community, but were not able to use the Corva llis Airport, ahd Salem was having difficulties ,witp its runway. Mr. Altucker, Member of the Airport Commission, felt'work could be done on runways at night when air flights are not scheduled, and closure would then be unnecessary. After further discussion of weight rating of runways and weight of flights qow using them, a voteswas taken on the motion as stated and the motion carried. -, I b 1 2. Equal Opportunity Ordinance - Mayor Anderson introduced Dr. Norman Pott, chairman of the Human RiW1ts Commission, who introduced Mrs. Theo Allen, Mr. Phil George and Mrs. Flora Anderson, other members of the Commission. Dr. Pott explained the purpose of the Equal Opportunity Ord- inance and reasons why it should be adopted. Dr. Pott suggested t~at, even though there is ~ state and federal legislation in this area, he felt that local legislation was necessary in order to emphasize local concern for the problem. Councilman Mohr suggested that the import- ance of this legislation warrants a special meeting so that it can be thoroughl~ discussed. e Mrs. Beal moved seconded by Mrs. Hayward that the Council adopt the Ordinance as presented by the Eugene ~uman Rights Commission. Motion carried. Manag~r will schedule da~e for hearing. Mrs. Hayward moved seconded by Mr., McDonald to approve Item 2 of the Committee report and set a public hearing for April 7, 1969. Motion carried. 2 3. Community Seminar on Aging - Mr. LeRoy Owners, Seminar Coordinator for Mbbilab Center, told of the need for a sponsor for the Community Seminar on Aging and explained who, would receive and disburse funds for the project. If the city' accepted the~position, they would not incur any responsibility, financial or otherwise., I Mrs. Ha~~ard mov~d seconded by Mr. Mohr 'that the City serve as sponsor to the Community Seminar on Aging. Motion carried. !Mrs. Hayward moved seconded by Mr. McDonald that Item 3 of the Committee ~eport be app~oved, and that the city receive and disburse funds in connection with this facility. Mr. McDonald wanted it understood that disbursing of funds would not commit the City to any responsibil- lity should a deficit occur. Dog Control Ordinance - The Manager suggested that the Council take action on thi's ordinance at its next regular meeting. (Mrs. Hayward moved seconded by Mr. McDonald that the Council adopt tne ordinance on Dog Control as I presented. I I 11 II Ii II I I , II I i I I Mrs. HaYwqrd ~ommented that some prov~s~on should be made for protection of dogs being provoked to bark. The City Attorney said this could be handled administratively. There was discussion regarding notification of owners, and it was ,pointed out that public notice was provided by posting on the bulletin board of the City Hall. It was felt that posting at the Humane Society would be more practical, and the Council agreed 'that this provision should be changed. e Mr. Earl McVickers, Manager of Lane County Humane Society, suggested elimination of ;the words "Dog Control Officer" and substitution of "Animal Control Officer for the City of E'ugene". Council discussed disbursement of funds received from detention fee of $20.00 and the boarding fee. This will be studied and an equitable system worked out. Mrs. Hayward moved seconded by Mr. Gribskov to amend the dog contr'ol ordinance to "Dog Control Officer" and substitute therefor "Animat Control Officer" and to 'add Humane Society" the words "or representative of animal shelter". No action taken. 2. Planning Commission Report, March 4, 1969 a. Recommended zoning change denials 1) C. Robert Suess., south side of 36th Avenue between Hilyard and West Amazon, R-2 to RG - The Manager explained that Mr. Suess had, developed this, property uJ1der an R-2 Perm- is.sive Use, and that the property now requested for rezoning was to be used for recreational purposes under provisions of the original request. Mr. Suess now proposes to develop' it to a high density to be used for rental units for low-cost housing. Mr. Suess explained to the Council his reasons for the request for increased density, and that he planned a planting buffer to protect adjacent residential housing. Mrs. Hayward agreed with the Planning Commission that the intent of the development was, admirable, but that it would impose unnecessary_hardship on nearby property owners of single family dwellings. I =, :;' Mrs. Hayward moved seconded by Mr. McDonald' to uphold the recommendation of the Planning Commission to deny the r.~quest ror change of zone. The Council discussed the plans'Mr. Suess proposed and best use for the property. The question was called for and the motion carried. e 2) E. B. Sahlstrom, north side bf intersection or Portland Street and Willamette Street, RA to R-3 - The Manager explained that the Planning Commission had denied this request, since this property acts as a buffer for the residential. area to the west, and because of critical traffic problems in the area. Mrs. Hayward moved seconded by Mr.' McDonald to uphold the recommendation of.the Planning Commission to deny this zone change. Motion carried. 3) A. W. Berg, 13th and Lawrence, R-3 to C-2' - The Manager explained that Mr. Berg has constructed a building which provides ground floor commercial space with apartments aobve on the corner of 13th Avenue and Lawrence in an area zoned C-2. He wishes to expand this development to the west with similar buildlngs. The Planning Commission recommended denial on grounds there is a great deal of unused C-2 property in the area at the present time~ so no justification can be fbund for added C-2 zoning. I I i I II .1 :! ....: ~ i Mrs. Hayward moved seconded by Mr. McDonald to follow the recommendation of the Planning Commission to deny this request for zone change. I Mr. Larry Cooley, 3308 Olive, represented Mr. Ber'g and explained that this was a unique situation, in that Mr. Berg wanted to continue the design of the building now existing. He felt in ~ight of the hardship ~mposed upon him by this zoning that C-2 should be extended to the west. The Planning Director pointed out that there is sufficient'C-2 in this area which has pot been used. Under. the Zonipg Ordinance, Mr. Berg could utilize his ground floor area for a clinic for healing arts under a conditional use permit. e 3/24/69 - 4 , , f , 1 ~ 191 3/24/69 Councilman Teague said he was impressed with the condition of houses in that area, and felt Mr. Berg's building would be a definite improvement. If Mr. Berg felt he could utilize commercial buildings, Mr. Teague was in favor of him going ahead with the development. A vote was taken on the motion as stated, and the motion carried. Mr. Teague voted no. 1 b. Rec~mmended zoning change approvals: 1) Gordon T. Olson, north of 18th on east side of Oakpatch, RA to R~2 - The Planning Commission recommended approval of this request for zone change, subject to develop- ment under Planned Unit Development regulations and procedures. Mrs. Hayward moved seconded by Mr. McDonald to approve the Planning Commission recommendation,. and asked if Planned Unit Development requirements were agreeable to Mr. Olson. The Planning Direc,uor said Mr. Olson expressed approval of the conditions at the Planning Commission meeting. A vote was taken on the motion as stated, and the motion carried. 2 2) Robert C. Bennett; east side Mill Street, between 12th Avenue and 13th Avenue, C-2 to R-4 - The Manager explained that Mr. Bennett had lost his option on part of the parcel, but was still requesting zone change on Tax Lot 9700. The Planning Commission found that this was a logical extension of the R-4 now in the area, and recommended approval of the request. Mrs. Hayward moved seconded by Mr. Beal to follow the recommendation of the Planning Commission and rezone Tax Lot 9700 from C-2 to R-4. Motion carried. Mr. Wingard abstained from voting, since he has property in the area. 3 c. Vacation of Easement between North Shasta Loop and Vine Maple Street (Oscar Spliid) _ The P.1anning Commission recommended approval of this vacation, subject to the petitioner paying all costs for work of having sewer relo~ated; providing city with new easement for relocated sewer line and paying all liens on sewer for area to be vacated. Mrs. Hayward moved seconded by Mr. Gribskov to approve the vacation of sewer easement between North Shasta Loop and Vine Maple Street, subject to conditions as recommended by Planning Commission. Motion carried. 4 3. Warrant, 7th and Willamette Parking Lot - The City Attorney has drafted an ordinance for purpose of authorizing temporary loan of on-street parking meter funds to retire a warrant for the 7th and Willamette Street parking lot property acquisition. This loan will be retired within 60 days. Mrs. Hayward moved seconded by Mr. McDonald that the City purchase warrant for Willamette Parking Lot with on-street parking meter revenues. Rollcall vote. present voting aye, the motion carried. the 7th and All councilmen 5 4. ehange Orders, 10th and Oak Garage - The Manager explained that about $10,000 could be saved by using a hydraulic elevator instead of the electric originally bid. After discussion, it was decided to use the faster electric, but change the design of buttons:.~and dials. Staff recommended award of contract to Otis Elevator Company for electric elevator, but reduce button and dial facility in the amount of $2785 from 'or"iginJ3l '~A~'~<~ " Mrs. Hayward moved seconded by Mrs~,Beal to approve Change Order it2 and award the contract to Otis Elevator Company with a deduction of $2785 from the present amount of the contract. Rollcall vote. All councilmen present voting aye, the motion carried. Change Order #3 is for extra charge for membrane to prevent seepage. this to be the best material for the price. The amount of~~565 for the budgeted amount originally discussed for this material. Investigation has shown this material is within Mrs. Hayward moved seconded by Mr. McDonald to approve change order #3. Rollcall vote. All councilmen present voting aye, the motion carried. 6: 5. Audit Contract, Lybrand, Ross & Montgomery Proposal - The Manager explained that Lybrand, Ross and Montgomery (formerly known as Winn and Company) have submitted a proposed contract which meets minimum standards of audit reports, certificates and procedures as required by State law. The Manager said there is some value to employing a firm familiar with the City of Eugene books and methods of keeping records. Mrs. Hayward moved seconded by Mr. McDonald to award the auditing contract to Lybrand, Ross and Montgomery. Rollcall vote. All councilmen present voting aye, the motion carried. 7 6. Liquor License, New Retail Malt Beverage - Class "A" - Paul N. Jackson The Falcon 1953 Garden Avenue, ,I The Manager explained that this ms a new location, not previously licensed, and that the Police 1 Department recommends denial, on the": basis that it is in the center of a, residential area. There has been no publicity of a proposed tavern, and no objection from residents of the area. Mrs. Hayward suggested that, rather than decide for residents in the neighborhood, they should be notified and asked for comment. 3/24/69 - 5 ..olIIl ~92' 3/24/69 Mrs. Hayward moved seconded by Mr. McDonald to solicit neighborhood comment as to the location of this applicant for Class "A" license, and reschedule the hearing for the meeting of April 14, 1969. Motion carried with Mr~ Teague voting no. , , Mr. Mohr objected to the Council acting on liquor licenses and felt this was an administrative process. He asked the staff to inform the Oregon Liquor Control Commission that the Council no longer 'wishes to participate. 1 7. Annexation, north of Green Acres, west of Norkenzie ,(K. Ray Barnes),- This request for 'annexa- tion originally came from the Planning Commission January 22, 1968. The City Council approved, subject to conditions. Mr. Barnes dropped the idea of building a mobile home park on the prop- erty at that time, but:~now, with new people coming into the area, is anxious to proceed with construction. Conditions of the original annexation would still prevail. Mrs. Hayward moved seconded by Mrs. Bea1 to approve the annexation of K. Ray Barnes location, subject to' conditions recommended by the Planning Commission and subject to payment of fees for both annexations. Mrs. Hayward moved seconded by Mrs. Beal to support Senate Bill 474 Councilman Wingard explained some of the pitfalls of this bill, and hardships it could cause to property:: ,I ' owners. :: The Council said that, ;under the present system, there is no way to achieve an underground wiring program in Eugene, especially as it pertains to conversion. Mrs. Hayward suggested that, if possible, amendments should be added which would clarify city concerns and be of more assistance to cities. Mrs. Hayward moved seconded by Mr. Teague to table the bill and allow legislative committee to attempt to amend the bill with assistance of staff, and to propose legislation which might be more helpful to cities.
