Regular meeting of the Common Council of the city of Eugene, Oregon was called to order by his Honor
Mayor Lester E. Anderson at 7: 30 p.m. on April 28, 1969 in the Council. Chamber. Councilmen present.

Equal Opportunity Ordinance - Mayor Anderson explained the' many months the Equal Opportunity Ordinance Ii

had been undersconsideration, and that it a een submitted to the Council about thre~ months ago.
A public hearing was s.cheduled on April 7th, and wide publicity was given before the hearing. In Ii
regular procedures of the Council, a third reading was called before the Ordinance became final. I'll',

The City Attorney, Dr. Pott and Mr. Art Johnson answered questions and explained sections of the
ordinance in answer to questions. The City Attorney explained that, in th~ event conciliation is not
effected by the Civil Rights Commission or panel charged with that responsibility"the matter goes
to the ~ity Attorney's office for review and for the action prescribed on Page 8, Subparagraph 8 of
Section',;-;g;. The City Attorney read the paragraph and explained that there is a diffE;rent basis for
bringing a complaint, depending on whether this is a first offense or a repeatedv~olation. In
a civil case the burden ?f proof is by a preponder~mce of the evidence. When the City prosecut~s
for the criminal penalty it has the burden of pr?ving the offense beyond a. reasonable doubt.

In answer to a question from Mrs. Beal the City Attorney explained that the state. law. prohibiting
discrimination has been in effect,since 1949. It generally prohibits discrimination in.housing as
it applies to persons in the business of leasing or selling, but doesn't apply to individual,home
owners to the extent the City Ordinance does.

In answer to a question concerning evictions, the City Attorney said this ordinance will not affect
t he laws of the State of Oregon and would not affect any landlords right in that regard.
Mr. Fred Schuster suggested that this ordinance be put to public vote. Mrs. Hayward explained the
Council is elected to enact laws, and since this'..is a law prop?sed to the Council, the Council will
act on it.
In answer to the, comment. regarding make-up .of .the Comm:ilssion, Mr. Art Johnson. explained that the
Commission is made up of a cross-section of the community, and is appointed by the Mayor. There are
property owners and other business men on the Commission, and it is very representative and a well-
qualified group to ass~st in enforcement of the ordinance for the benefit of all the citizens of the
city of. Eugene.
Mr. McDonald moved seconded by Mr. Gribskov that the referral of this ordinance be taken to a public
vote of the people.of Eugene.
A vote was taken on the amendment to refer this ordinance to the people. Gribskov, Teague, McDonald
voted in fav9r and' Beal,Hayward, Mohr and Wingard voted against. Motion failed.

Mr. Teague said the City Ordinance was different fram state law. He felt the awner af a hame shauld
have the right to. selct whaever she ar he wants to. live in that hame. It was his apinian this
was different fram cammercial renting.

occupied hames and duplexes, to. canfarm to. state law".
Mrs. Hayward asked to have clarified exactly what state law sa'id, and stated she had been advised by
an attarney that it said something different thantshe had been tald at the meeting.
The City Attorney read Sectian 659.033 af Oregan Revised Statutes w~th regard to. thase engaged in
selling, renting and leasing af real property.

cases cited to. interpret the language question. He felt it was cantrary to Mr. Hendershatt's inter-
pretatian, but knew af no case that defined it. If you rent a raom ar duplex for a prafit, that is
a business enterprise.

licant, shall not be construed to. be necessarily discriminatary. This exception applies anly to.

Mr. Wingard asked Mr. Hendershott if this ardinance was subject to. state laws of initiative and refer-
endum. Mr. Hendershatt,replied. that it was; and by signatures can be referred to. the vaters. It is
not autamatically referred.
Mr. Wingard commented that many people, when they came to. meetings such as this, feel the Cauncil have
already made up their minds, and he had received calls asking haw he wauld vate an certain issues.

Mr. Mahr asked far a ruling on the' germaneness af that questian to. the issue at ha~d. He asked the
City Attarney if Mr. Teague's matiandaes nat speak to. the rules and regulatians af the Human Rights
Commissian administrative pracedure, rather than speaking to. this particular matian.
The City Attorney said he understaad Mr. Teague's motian to. be an amendment af that part af the admin-
istrative section regarding assigning a panel.
There was a ~iscussion cancerning the'prapased amendment and whether alternatives shauld be given far
chaosing a panel,.

Mr. Wingard maved secanded by Mr. Gribksav to amend Mr. Teague's motion to. read that the Y~yar shall.
appaint a panel af three members afthe Cammissian (Line 1 under Sectian C(9). In ather wards,
substitute Mayar far the ward Chairman af .the Cammissian.
Mrs. Hayward said this had been discussed previausly and that the Mayar felt the Chairman af the
Commissian wauld be better qualified to chaase such a panel.

The Mayar asked to. clarify that the panel shauld be campased af members af the:Cammissian. This was
agreed. The Mayar said he had no. real strang canvictian about the matter, but he merely wanted to.

A vote was taken on the amendment to change the wording. All voted aye and the motion carried.
A vote was taken on the main amendment as amended. Motion carried unanimously.
Mr. McDonald had a question about employment applications and whether they could contain a division
of sexes. The Manager said the ordinance did not prohibit a private employer from having informa-
tion on the application about the sex of the applicant.
A vote was taken on the main motion as amended. Mr. Teague and Mr. McDonald were opposed.

Mr. McKinley said since the vote was not unanimous, the bill would have to be read in full. The
Council discussed the matter and Mr. Mohr moved seconded by Mrs. Hayward to reconsider the question.
The Mayor explained that the vote had been for third reading by counciLbill number only, with
unanimous consent of the Council. Since the vote was not un?nimous, the bill would then have to be
read in full. Mr. Teague explained that he and Mr. McDonald had been under the impression the vote
was for final reading.
A vote was taken on the move to reconsider. Motion carried.

Mrs. Hawyard moved seconded by Mr. McDonald that the bill be read the third time by council bill
number only with unanimous consent of the Council. Motion carried unanimously and the bill was
read the third time by council bill number only.
Mrs. Hayward moved seconded by Mrs. Beal that the council bill be approved and given final passage.
Rollcall. All councilmen present voting aye, the bill was declared passed and numbered l5675~A
The Mayor expressed appreciation to all, the people who attended the hearings. Mrs. Hayward also
offered her thanks to members of the Human Rights Commission and to Dr. Pott, who had been most
helpful to the people in the community in aiding them to understand the ordinance.
Mr. Teague asked to add his thanks, and said it would help if in some way a letter could be attached
to the ordinance for clarification, so that in years to come there would be a guide'Hme for inter-
pretation. \
It was suggested that the Council adjourn to Tuesday to finish the items on the Agenda.
Mr. Mohr moved seconded by Mr. McDonald that the Council set a time for adjournment and reconvene
Tuesday, Ap~il 29, 1969 at 7:30 p.m. Motion carried.
The Mayor announced that tre Council will hear the items where people are in attendance.

10. Kendall Ford Suit - The Manager said the Council had authorized the City Attorney to inter-
vene in the Kendall Ford case; but due to lack of time, this had not been confirmed
at the regular meeting on April 14. Council approval is required for the Attorney to
proceed with the intervention proceeding before the next regular meeting. The Council
agreed the Attorney should proceed with the clerical work necessary for intervention in
the case.
The Manager explained that the hearing on city intervention in the Kendall Ford case has been set
for April 29, and if the Council wishes to confirm its action, the Attorney should know before that
time.

Mrs. Hayward moved seconded by Mr. Mohr that the City Council authorize the City Attorney to proceed
with intervention in the Kendall Ford suit on behalf of the City.
Mr. Wingard said the City had voted against intervention in a previous Kendall Ford suit, and asked
why they were considering intervention in this case. The Planning Director explained that, although
the City would not itself file a suit against the County, if someone else:c.entered a suit the city
could file an intervention and take up points not brought up by the private suit. Mrs. Hayward said
the Council had considered that they had asked to have state legislation prepared which was con-
cerned with rezoning matters in the area within a four mile limit of the City, and that they had
felt it was their responsibility to the citizens of the city to intervene in this suit under the
circumstances.

Mr. Wingard said this was not an opportune time to enter into a suit, and the cooperation of the
County would be better if the City avoided it. The Mayor explained that this had been discussed
with the County Commission and the Cpunty Planning Commission, and that they bore no ill will
toward the City.
A vote was taken on the motion, Messrs. Teague, Wingard, McDonald and Gribskov were opposed. Mrs.
Hayward, Mrs. Beal and Mr. Mohr voted in, favor. Motion failed.
The City Attorney asked that the record show that the zoning matters will be continued to April 29,
since they have been advertised.

Consideration of Request, Firefighters - Mr. McKinley read a statement regarding a proposed
firefighters strike. He discussed the desire of the fire department for a pay schedule equivalent
to the schedule proposed for positions in the police department, and their request for "parity"
with the schedule of salaries recommended for. police. He outlined meetings held with representatives
of firefighters and explained that little progress had been made, and'that the threat of a st~ike
was still imminent. He indicated possibilities and alternatives if such a strike developed.

Mayor Anderson said the Council recognizes the importance of this issue and the difficulty with' ,
which it will probably be solved. He recommended that the Council appoint a committee to consist
o~ Mrs. Hayward, Mr. Teague and a third party, possibly a non-resident with experience in personnel
relationship, to hear both sides of. the issue and m?ke a fact finding study with recommendations to
the Council, as it felt desirable and necessary. Recommendations would be non-binding, and wouJd
serve only as guidelines.
Mrs. Hayward said there might be sentiment on the Council to resolve the problem right now, and in
her opinion, this should be established before appointing a mediation board.

Mr. Wingard moved seconded by Mr. McDonald that a committee be appointed ~onsisting of Mrs.' Hayward,
Mr. Teague and a third party, possibly a npn-resident, with experience in personnel relationships,
etc., to make a recommendation for mediation proceedings, which might be adopted by the Council.
Mrs. Hayward said that committee recommendations would be non-bipding, and council members sitting
on the committee would have to vote upon their own recommendations. It would make a great deal
more sense to avail themselves .of State conciliation s~rvices.
Mrs. Hayward moved seconded by Mr. Mohr tq amend the motion to provide for State conciliation
services, 'rather than a commit.tee., as suggested by the M?yor.
Mrs. Beal agreed that the matter should be put in arbitration, and suggested that the motion be
further amended .to request the services of the State Conciliation Service in dr~wing up a~ arbi-
tration agreement between the city of Eugene and the firefighters, subject arbitration to be final,
and binding upon both parties.
Mrs. Hayward asked if it was legal for the city to be involved in binding arbitration.
Attorney said a decision of arbitrators has to beplace~ in action in the budget. The
limitation will certainly apply to this arbitration board. Arbitration cannot set the
budge,t!

felt a fact finding committee might be helpful, but that it should be an impartial committee. There
was some feeling that the question should.be decided by the Council now, because of the timing.
Mr. Wingard moved to amend the motion on the floor to seek the services of the State Conciliation
Service to arrive at a decision on salaries through mediation.

Mrs. Hayward was asked to clarify her motion. She said. she thought it should be fact finding, and
should be done by an impersonal g:udge, with a recommendation to the Council. Mrs. Hayward did not
think council members should be on the committee.
Mr. McDonald said the budget committee had passed to the Council a decision on salaries for the
fire department and asked to amend the amendment to the motion on the floor, based on this question.
The Mayor ruled this out of order as not relevant to the main motion.

Mr. Pat Flynn, Busine~s Agent, Local 851, found the motion for arbitration attractive, and thought
possibly it could solve the situation. What the Council is acting on is in the realm of the budget
committee. He pointed out the Council had had ample evidence. One fact. stood out. Nobody on
the Council budget committee or administration will say that the fire.departmen~ is less than first
rate, but in the state of Oregon, they are in the 8th pay structure. He outlined arguments the
firefighters had previously presented to the Coun~il and Budget Committee, He asked the Council to
vote down both motions and establish parity asked by the firefighters, and put it to the people and
see if it can't be passed.
Mrs. Beal moved ~econded ;by Mr. Mohr to table both the motions on the floor and the amendment.
Motion carried unanimously.
Mr. Mohr moved seconded by Mrs. Hayw~rd that the City Council direct the administration of the City
to report back to the budget committee a schedule of salaries for firemen equal to salary schedules

Mr. McKinley presented a statement indicating other city positions in the same classifications as
firefighters. He said. the staff has a question as to the equivalency of schedules, because there
isn't a direct comparison in the number of positions in the series for police and firemen. If
this motion passes, .the Manager will bring back his best judgment as to what the equivalent schedule

is.
Mr. Mohr affirmed the Manager's statement, and said it is not the job of the Council to state exact
salaries, but to set a policy 'toward schedules. He agreed the Council should look oversa salary
schedule.
Mr. Flynn objected to the statement being placed before the Council when the firefighters had had
D previous knowledge of it.
Mr. Frank Jackson said a firefighter could be compared with a Patrolman C, Sergeant to Lieutenant
in the Fire Department; and right on down the line. There would be no difficulty in comparing
grades. He asked that the Council go ahead with its original motion to establish parity, and asked
them to take a vote.

Mayor Anderson said' there was no question in the minds of the Councilor citizens of Eugene as to
the ability of the Fire Department, but there is some question concerning, responsibility. This
matter should be put in proper perspective. The City Manager is empowered by the City Council tQ
make certain recommendations. It is up to the City Council to either reject them or accept them,
and that the City Manager was doing what he was asked to 'do. The Mayor thought the Council should
be objective in its thinking and be fair in the approach to a very difficult problem.
The question was called on the motion. Mr. ~ague voted no. The motion carried.

Kendall Ford Suit - Mr. Mohr asked to have it recorded' in the minutes that he had changed his vote-
on the Kendall Ford rezoning issue to vote no. The City Attorney said unless the Council voted to
reconsider the matter, it is terminated as of now. He'$aid Mr. Mohr wanted to move to reconsider
L because there had not been enough discussion on the issue;" The matter has been recorded and is not
II before' the Council now. The Attorney did not think Mr. MOhr could change his vote. The Council has
11 not adopted a set of by-laws .

I Mrs. Hayward said she had really failed to point out other points of the discussion held at the
II committee meeting when the Council took a vote on this. They did discuss in some detail the relation-
ship with the County, ways to enter the suit because they all were concerned about the relationship
I with the County. One of the members of the County Commissioners has said this is an area where the
city might have ~0me jurisdiction, and one of the others would like to have.it clarified and would
be delighted to have it clarified in the courts. To clarify this issue in the courts would be helpful
for all.

Council Bill No. 8810 - Equal Opportunity Ordinance - See Item 1, Page 133 of Minutes of
April 28, 1969 for action taken.
Council Bill No. 8811 - Authorizing issuance and sale of $1,190,000 of General Obligation
Improvement Bonds, Series "Y", of the City of Eugene, Oregon and directing that they be adver-
tised for sale, all in accordance with the provisions of Chapter 223, Oregon Revised Statutes,
commonly known as the "Bancroft Bonding Act" as amended, was submitted an'd read in full.
