Adjourned meeting of the Common Council of the city'of Eugene, Oregon - adjourned from the meeting
of April 28, 1969 - was called to order by His Honor Mayor Lester E. 4nderson at 7:30 p.m. on
April 29, 1969 in the Council Chamber with the following councilmen present; Mrs. Hayward, Messrs.
McDonald, and Wingard, Mrs. Bea1 and'Messrs. Gribskov an'd,Mohr. ."
The City Manager read a motion made the previous evening which said that the Manager be instructed
to prepare and present to the budget committee a schedule of salaries for firemen equal to the
salary schedule for police, up to the two top positions 'in each department. Mr. McKinley said in
attempting to comply with that directive he was presenting salary schedules which compared his
recommendation and that of the firefighters.

Mr. Mohr said it was always difficult to assess the impact. of a set of figures, and he did not want
the Council to get into the position of setting exact ~a1ary levels for each position.

Mrs. Bea1 said that rather than just be given a set of figures, she would like to take this under
advisement and bring it up at Wednesday's Committee meeting, and continue with the rest of the
budget work.
There was further discussion of the two plans, and whether the Council should be deciding salaries.
Mr. Jackson explained the reasoning behind their proposal, and compared firemen and patrolmen
and their duties.
Mr. Mohr said the question before the Council is to establish m~n~ma and maxima salary range as'
between policemen and firemen. Tgey are not engaged in determination of personnel policies within
those ranges.
Mr. Flynn asked to point out that the City Manager I s version of parity was' the firefighters. con-
ciliatory proposal, previously presented to the City Manager, which would have been presented to
the budget committee, had the budget committee not rejected it and referred the question to the
Counci 1.
The City Manager said that this proposal was not his recommendation, but was the recommendation after
the motion of last night. He said it should be understood a Patr.olman C is not .an automatic increase, I
but is determined through educational qualification and a point system.

Mr. Mohr said as he understood the substance of his motiQn of last night, it was addressed to the
problem of the Fire Department as a whole, matched against the Police Department as a whole. What
is presented tonight is a different kind of problem; a different issue than originally was taken.
Mr. Mohr did not believe that this was the time .or place to discuss the individual cases within the,
range.

Mr. N.ohn McMahon read figures from 1960 and said the pay scale had gradually gotten wider and wider.
He pointed out the disparity in wages between firemen and policemen.
Mayor Anderson asked to go .back to his original recommendation to the Council that a committee of
the Council, along with a third party, at least go over this material and talk to representatives
of the firefighters and City Manager, and hopefully bring back some recommendation on definition
of terms on which agreement can be reached.
Mrs. Hayward asked to vote on the motion and see if they could get it passed. Perhaps they had
learned a lesson and there may be a better way of arriving at salaries than that in which the
Council had been engaged.
Mrs. Bea1 suggested an amendment to compromffise might be to put all firemen in Range 19, instead
of in 18 or 20. Mr. Wingard secondedrtithe amendment.

The Manager did not think this would solve the problem without creating others. This would create
a disparity between starting patrolmen and 'starting firemen. If the motion was adopted as
originally made, the staff would be glad to work with the Fire Chief to determine whether there is
a logical and justifiable basis for creating two ranges of firemen, based upon such .things as
education and achievement.
Mr. Mohr said this was a personnel administration policy and should not be before the Council.
Mrs. Bea1 suggested to cut. down on any source of disagreement, 50% of the firemen could be raised
and beginning firemen could be put at Range 18. The Manager said he could not make that judgment
at this time.

Mr. Wingard withdrew his second.

Mr. Jim Curtis, fireman, said he had worked ten years for the Fire Department, and he was very dis-
~P9inted that what had been promised to them at last'nights meeting did not seem to be material-
izing.
Mr. Gribskov said he felt they had achieved parity by starting out with a low equal to the police
and going to a high equaling that requested.
Mr. Flynn again outlined the firefighters request.:
Mr. McMahon said he had met with the Fire Chief and informed him of the decision of the Council and
the Chief had accepted the position .that the firefighters proposal for parity had been accepted.
The Fire Chief has said he supported it.
Mrs. Beal said she would go along with Mrs. Haywards motion, but would hope during the next twelve
months that a s~stem be worked out so that a fireman doesn't have to stop at two points below that
which a policeman stops at. The firemen should be given a chance to progress in the range of
police in the present level.0 Mrs. Hayward felt this should be discussed between the administration
and the Fire Chief..

A vote was taken on the main motion. Mr. Mohr voted no. The motion carried.
Mr. Mohr explained his vote by addressing Mrs. Hayward and Mrs. Beal that the way to formalize
expectation between employer and employe is through a written contract that makes solid hope, in
terms of judicial unity. Mr. Mohr hoped not one more minute would be spent in collective bargaining.

Mr. Wingard felt it might' be appropriate to go back to the motion for arbitration and get these
things defined so that, at least, the firemen will know the Council is not going any farther in
defining these slots.
Mr. Wingard moved that a committee formed of three people, with ;an outside arbitrator, be formed
to decide which numbers go into those slots. This will not be done for this budget year, but this'
material should be available and ready for the next years budget meetings.
Mr. Mohr asked for a ruling on that-motion~ It would establish a system or policy outside the
purview of the City Council to determine. The City Council is not allowed to participate in personnel
administration policy. He judged the motion out of order on that grounds.

a~ Air Pollution Legislation - Mayor Anderson thanked the many people who cooperated with
the hearing at Salem Tuesday, and said he had received a number of favorable comments
on the hearing. He thanked Council members who made the trip, and Mrs. Beal who coor~
dinated the effort. He also thanked students who attended the meeting and Cottage
Grove and Springfield for their support.

Mrs. Hayward moved ,seconded by Mr. McDonald that Item la of the Committee report be received and
placed on file. Motion carried.
b. Council Representative, Joint Housing - Due to conflicts, Mayor Anderson finds it
difficult to attend meetings, and asked the Council to consider a replacement. He
will attend when possible, but has nominated Ivan Gribskov to be Council representative.

Mrs. Hayward moved 1;leconded by Mrs. Beal that the Council appoint Ivan Gribskov
Council representative to the Joint Housing Committee. Motion'carried.
c. Ruling on Council Request for Administrative Reports - Mr. Mohr distributed a memorandum
to the Council, which he read to those present. He questioned the Mayor's ruling at
a previous meeting on the matter of individual council member's requests f~r reports
from the Administration. Means of access to information should not be dependent on a
majority vote. Such a restriction would jeopardize a basic princip~l of Council govern-
ment.
Mr. Mohr moved seconded by Mrs. Hayward that members of the Council may .request reports
and make requests for informatlon from the administrat~on directly.

Mayor Anderson said this may have been a matter of an interpretation of the difference
between reports and information and asking for a decision from the City Manager. The
request related to a decision from the Manager as to what he would do in a particular
instance. As far as reports and information are concerned, the Mayor thinks any Council
member, -individually or collectively, has the right to go to the Manager and request
r.eports and information. He does not feel they have the right to request -pi-m.- to come

back with a decision within a given time, and 'expect the .Council to act on his
decision.
'Mrs. Hayward felt this was a grave issue, and that the Council should be kept
advised on this personnel matter.,
Mayor Anderson said a threatened strike required some strategy, and the City Manager
would be privileged'to utiliie such'strategy. Mr. Mohr said/the point was that a
ruling should not be made on an ad hoc basis, and this would seriously damage the
general principal.
Dr. Purdy felt a decision had been made by the budget .committee with respect to
wages, and a possible strike had been brought because of wages and salary parity.
The Manager should not be expected to make decisions on budget c9mmitte~ matters.

Mr. Mohr said his question pertains to the general principal, rather than a specific
case. The Managerlsaid requests for information are normally no problem, and the
staff is happy to comply. However, there have been occasions when the requested
information involved so much staff work or decisions which had not been arrived at,
that it would be very difficult or time consuming to comply with the request. The
staff would like to feel free to ask the Council how they want time spent.
A vote was taken on the motion as stated. Motion carried.

d. Civil Air Patrol Request - the Civil Air Patrol has requested permission to use a
portion of the airport property to provide a site for a hangar and storage building.
Because the Civil Air Patrol is a nonprofit organization, they have requested that
the site be provided rent-free. The project would require a ground area approx-
imately 150 x 2'00 feet. The Airport Commis'sion, at its meeting of April 3, recom-
mended permission be .granted, and that the space be provided rent-free. The staff
concurs, but feels the agreement should include a'time limit of perhaps ten years, at
which t~me the privilege could be reconsidered. The Civil Air Patrol should take the
responsibnity for finishing the str'ucture, or demolishing it, if unfinished, and
the building sho~ld remain in the possession of the Civil Air Patr~l. Mr. Teague
suggested that a clause be included in the agreement that such an arrangement would
terminate if space was used by a firm or organization other than the Civil Air Patrol.
Mrs. Hayward moved. seconded by Mr . Gribskov that the Council approve an agreement
with Civil Air Patrol as outlined by the City Manager. Motion carried.

The Council toured this property prior to the meeting. The Manager said a letter had
been' received .from the Fair Board requesting a delay until they could make a decision
as to possible expansion on the' site for the Fair' Board. Under the rules of a court
case decision in Salem, the City has no right to hold up a decis}on on zoning for
further development by a public body, if the z9ning request is proper.,

In answer to a question from Mr. Teague, the Manager said the rezoning ordinance
would not go into effect for thirty days. The Planning Director said this delay
would ~robably help the Fair Board, and he explained their director ha~ been ill, and
this had delayed action.
Mr. Gribskov moved seconded .by-Mrs. Hayward that the Council grant the zoning as
recommended by the Planning Commission. Motion carried.

c. Recommendation to request U.S. General Services Administration to study site for
Federal Office Building - General. Services Administration has an authorization for
construction of a federal building in Eugene, but not appropriation. They have not
taken action to locate a site, and Eugene Renewal Agency has been trying to encourage
them to make a sitestudy.to considerthepossibility of use of the former school ad-
ministration building north of City Hall. The' Planning Commission recommended this as
a logical site for a.Federal Office,Building, and the School Board coutd make a decision
to rent or lease the building until G.S.A. actually.had need for it.

tion to study the School District #4J stie north of City Hall as a possible location

and plans for building a cu1 de sac. The Planning Commission recqmmended approval, I
subject to conditions that a pedestrian way and public utility easement be permanently .
maintained, and that the 'area of dedication off the Rich property be accepted; and
that the costs of improvements be based on front footage of existing street.
Mrs. Hayward moved seconded by Mr. Gribskov to approve vacation of that portion of
20th Avenue between Madison and Monroe. Motion carried.
.2) Tyler Street betweeq 15th Avenue and 16th Avenue (C. Rob~rt Suess) - The Manager

and recommend the amount to be assessed to abutting properties for vacation~

P~anning Director explained the future location. of Amazon Parkway, and that this
street would dead-end.

Planning Commission Report - April 1, 1969

of an amendment to the Zoning Ordinance, Section 12.03, Buildings and Uses permitted

Conditionally. This refers to the C-2 District, in which ground floor apartments are
not now permitted, but living units are permitted over commercial uses. The Planning
Commission has considered this, and felt this was not a desirable requirement; and

Director explained the Planning Commission wanted to maintain commercial continuity,
and would therefor,e require that. this privilege be under Condit'ional Use Penn it.

Director explained the location of the property, and that the Planning Commission was
concerned that allowance of this request might create a demand for otheJ commercial
zoning, and strip development would. occur on Donald Street and on Willamette. A duplex
may be built on the property under its present zoning.

8. Casebier Lawsuit - The Manager explained that same time ago. a lawsuit was instituted
against two. city pa1ice afficers for false arrest. The suit was triea in Circuit Caurt,
and Mr. Casebier was awarded $S,OOO by the Court. The City appealed the case to. the
supreme caurt. The City Attarney's affice has been negatiating with Mr. Casebier;and
his attarney reg"arding' a settlement af the case. .The City Attarney explained the lawsuit
filed against the City and anather case braught against the city far malic~ous prasecu-
tian. There are several very valid reasans for appeal, but there are same real prab1ems
af law inva1ved. Mr. Casebier has talked to. the Mayar and Caunci1men and wants to. settle
the case. The City Attarney recarrnnends the judgment be paid in settlement 'af this
matter.

In answer to. a question fram Dr. Purdy, the Manager said the City did nat have false
arrest insurance at the time af this incident, but is naw cavered.

exist against the pa1ice officer. The Attarney said acceptance af such a prapasa1 is
unlikely, but he will appraach Mr. Caseb.ier with a sett1emen, based an Mr.' Marraw' s
request. It was ~gr~ed, hawever, that this wau1d nat be an afficia1 canditian far
settlement.

9. Traffic Recommendations
a. 1 hour parking, southwest corner 11th and Mill - Dr. Purdy asked why a reduction to
one hour was necessary'in this particular location. Director of Public Works said
a restaurant has opened at this corner, and has requested t~is reduction.
Mrs. Hayward moved seconded by Dr. Purdy to approve the recommendation of the Traffic
Engineer. Motion carried.

Mrs. Hayward asked the staff to report regarding drafting of a blanket traffic ordin-
ance so that the Council may discuss the implications of such an ordinance.
Mrs. Beal moved seconded by Mr. Gribskov that the City Attorney proceed to draft
a blanket traffic ordinance to allow the'staff to make traffic revisions, with a
memo to the Council concerning such decisions.
Mrs. Hayward moved seconded by Mrs. Beal to approve the, recommendation that the City At'torney

13. Air Pollution, Senator Bateson - The Council discussed a request from Senator Bateson
to Mayor Anderson regarding pollution caused by industry, motor vehicle emission, out-
door burning, etc., on marginal days. In reply, the Council could indicate it has
under consideration banning of backyard burning, The Council's position on pollution
control should be expressed in terms of the 'positive actions "taken by the City Council
in establishing goals, enacting ordinances, initiating a Eugene Air Pollution Authority,
etc'.

Mayor Anderson reported that'he and Mrs. Bear had attended a work session of the committee on air
and water quality control, the first work session since the hearing. Mrs. Beal explained that the
amended version. of S. B. 165 was under disc'ussion, and she felt much encouraged, -since this bill
does many of the things suggested in the Eugene amendments.

Non-conforming Uses - Mrs. Hayward said she had received many calls from people
owning property with non-conforming uses, concerning letters received from the
planning office. Mr. Mortier explained that the new zoning ordinance sets cer~a~n
cri teria on non-conforming uses to establish status with regard to an amortization"..,...
period. The Planning Commission has initiated action to start public hearings. The
action- taken will depend on the hearing. The Planning Commission may take action
to legalize the use by conditional use permit.

Dog Control Ordinance - Dr. Purdy. has received a number of phone calls on the Dog
Control Ordinance and has invited two constituents to speak.

Mrs. Da~e Peterson, 2423 Pioneer Pike, was concerned about the amount of the impound-
ing fee, and the fact that' no warnings will be issued. Most dogs are children's
pets, and accustomed to running with the children. It is very difficult to say at
what point a dog is running at large. Mrs. Peterson also felt written warnings should
be issued, and that, after two complaints, the owner could be taken to court.

Mrs. Howard Skjei, 860 Pioneer Court, agreed that the impounding fee was too high.
She did not think laws should be enacted which would only be enforced in certain
sections of the city.
Mrs. Hayward sympathized with the ladies, but explained that peopl~ who have
complaints about animals also have to be listened to, and all complaints must be
given attention.
Mayor Anderson said the Council recognized problems involved in enforcement,. but
explained that the ordinance has been designed to eliminate particular nuisances when
they; occur. The ordinance is not directed at khe child with a dog.
Mrs. Hayward said dogs should be on leashes when outdoors and that children can be
trained to keep their dogs on leash when 'they take them o.ut.
Mr. Anderson explained that the Council can modify the ordinance if it appears
injustices have occurred. A person always has the right to appeal to a court of law.
Mrs. Beal thanked the ladies for appearing, and explained that many persons had com-
plained, but none had appeared before this time.

Mrs. Peterson asked that the ordinance be amended to require written complaints before
a dog could be picked up. The Manager explained that, as now written, the ordinance
does not require a complaint, and any dog off owners property not on a leash is in
violation and can be picked up. A police patrolman has the authority to issue a
citation to the owner of a dog if he knows who the owner is, without having to pick
the dog up. The owner would be brought into municipal court and would have to answer
to the citation. Complaints are not necessarily from anneighbor, but could be from
the dog control or police. officer.

Mrs. Skjei asked that the Humane Society send writte.n notice .to a family before a
dog is put away. Mrs. Hayward explained that the Council feeling was that a famiJY
who really cared about a dog would call the Humane Society as soon as p dog was missing.
This was the main reason for posting notices at the Humane Socie.ty, rather than at
City Hall.
The Manager said there has been considerable newspaper publicity concerning this law,
and there will undoubtedly have to be more.
Mrs. Hayward moved seconded by Mr. McDonald to receive and place on file Items lb and lc of the

d. Rev:okable Permit, L. R. Jarrard - The Manager presented a request from Mr. L. R. Ja.rrard
to build a retaining wall on city right of way at 3190 West 18th Avenue. The staff
recommends approval.
Mrs. Hayward moved seconded by Mr. Gribskov that the Council grant a revokable permit
to Mr. Jarrard, subject to removal at the City's request.

decisions on matters of this kind instead of coming to the Council with them. The

for the employe. 1'he cost for spouse or dependents will be borne by the employe.
One reason this plan was preferred was that the employe could insure children without
having to insure the spouse, who, in many instances, is insured with his company.
This would result in lower employe premiums.

g. H.B. 1880 - The Mayor said H:B. k88U had been submitted and passed through the House of
Representatives, calling for certain governor powers in connection with conflict that
may arise on state campuses. The Human Rights' Commission, at i,ts meeting last evening,
discussed the issue and had sent a wire to Senator Fadeley opposing hurried passage
of the bill without adequate hearings, and proposing that ~heyreconsider and schedule
further hearings. They opposed infringement on law enforcement rights of local govern-
ments. The Human Rights Commission asked that the Council be informed of this bill,
and comment or possibly take action.
Mrs. Beal said she thought the bill reflected on the ability of the city to manage
for itself, and moved seconded by Mrs. Hayward, that the Council go on.. record opposing
H.B. 1880. Mrs. Beal said state police are not as well trained to handle these matters
as city police, and might simply inflame and incite further trouble. This bill would
take away authoritypreviotisly granted to the City under home rule.

Mayor Anderson said the Council had not had a chance to review this bill, and he felt
-it might be more advisable to appeal to the,'senate to conduct public hearings on this
bill and g1.venari opportunity for review and testimony.
Mr. Mohr felt the Council should take a position opposing ~he procedural process which
this bill has gone through. It does hav,e some impact on local government, and the
local government voice in Eugene has not been heard. The Council needs an opportunity
for more deliberation.

poirit of the cities and'local autho4ities, H.B. 1880 takes ~ f~ndamentaiiywrong- approach. It
does no't address itself to the authority of institutions of higher education to make regula-
tions concerning their buildings or grounds or to call on the Governor for assistance. Rather,
H.B. 1880 gives orders directly to local police forces. H.B. 1880 directs local police to
enforce this law, by excludirig designated classes of persons without indicating how police are

to make the necessary identifications. It circumvents the normal chain of authority, both at
the institution and in the city. It may subject cities to unpredictable liability for police
actions. If any law at all is needed, it should, provide ~or penalties for violation of
orders made by the institution, excluding designated persons, not order the local author-
ities to enforce exclusions stated in the bill itself. T he changes needed thus go beyond
the mere amendment of H.B. 1880. We urge the legislature. to reconsider the problem on a
clean slate, after soliciting information and views from the state and local, agencies
directly concerned.
:. Mr.. Mohr said he had polled as many members as possible and the Mayor, because the time factor
was pressing. He pointed. out that the position was that this bill should have gone through a
longer history of legislative development. This bill did not go through the legislative process
normal for such a bill.

2. Appeal, Hugh B. Wood -.Mr. Wood is appealing the decision of the Board of Appeals on
requests for waiver of parking area. The Superintendent of Building Inspection explained
the past history of this case and waivers already granted by the Boa~d of Appeals. The
Council discussed the ,reason for the request and the importance of parking in the Univ-
ersity district, where these apartments are located. Mr. Gribskov suggested that a
conditional use permit could be granted to allow this waiver of parking requirements.
It was pointed out that .parking is of great importance.

'ruling with regard to relief from parking requirements requested by Hugh Wood.
There was further discussion about the possibility of Mr. Wood providing parking in
another location.. Mr. Mortier explained that this was not permitted in this district.
In answer to a question from Mrs. Beal, Mr. Mo~tier said Mr. Wood could request the
Board of Appeals to review the decision with. regard to another solution.

Grass Burning Experiment, Airport Land - The City Council revised, its original decision
regarding use of city-owned property to allow experimental burning, and subseque~t to
that d,ecision, Mr. Marvin Ringsdorf, les.see; asked to discuss the Council's action as
it affected him.

Mr. Ringsdorf said he had communicated with Dr. Chilcote regarding proposed experiments,
and that experiments could not be carried out with the Council's restriction against
open burning. Adjacent fields have either younger or older growth a~d could not, be
used as a ,control. It is Dr. Chilco~e's opinion research would have little value with-
out the comparison of field burning in the us~al manner.
Mrs. Hayward asked the staff to get in touch. with Dr. Chilcote, and sugges.ted the Council
defer any decision until he can be present for discussion. This approach was approved.

use the city pools, just as Sheldon does.

facility is constructed by the city of Eugene, the City would assume. the burden of
repaying advance planning loan.

Council to approve the low bid and exercise both alternates one and two. Total cost,
