Regular meeting of the Common Council of the city of Eugene, Oregon was called to order by Council
President Nancy Hayward in the absence of Mayor Anderson - at 7:30 p.m, on June'9, 1969 in the
Council Chamber. Other Council members present were: Dr. Purdy, Messrs, McDonald, Wingard and
Teague, Mrs. Bea1, Messrs. Gribskov and Mohr,

Minutes of May 26, 1969 were approved as amended by Mrs. Hayward, Page 6, Paragraph 7, Line 3,
substitute the words "City Council" for the words "budget committee".

Mr. McDonald moved seconded by Dr. Purdy to accept the recommendations of Department of Public Works
on Projects 1 through 18 with the exception of Nos. 8, 9, 13 and 15, which will be taken up indiv-
idua 11y.
Mr. Alan Curtis, 2370 Douglas Drive, protested paving of Douglas Drive on the basis of cost of the
project, which he fe1t-~was too high. He felt that Mr. Wi1dish should have been excluded from bidding
on this project, since-.he is an owner of over 50% of the property. In answer to his 'question, the
City Manager said, there is no legal obligation 'to~obtain 100% of signatures on a petition, but
generally speaking, the Council requests 50% of the owners. Mr. Curtis presented a petition protest-
ing this project, signed by Mr. and Mrs. Marvin' Girardeau, 2398 Douglas Drive, Mr, and Mrs. Harley
Coxen, 2380 McLean Boulevard and Mr. and Mrs. Curtis. Dr. Slocum had protested paving and sewer,
saying the property boundary could not be accurately determined. Department of Public Works has
checked into these claims and feels they are not justified.

Mr. Marvin Girardeau agreed with Mr. Curtis' statements, and was concernee:about the high price of
this project. In answer to Mr. Girardeau's concern over low bidder, Mr. Allen explained that a low
lid could not be disallowed on a city project, just because the, bidder was a property owner. He also
explained that the street would not terminate in a cuI de sac, but would be terminated with a guard

The 16th Avenue project will. pave the street to Jefferson Memorial Pool. A letter of protest was
received from Mr. John A. Beck, 1590, Washington Street, citing old age and lack of income as a
basis for protest.
Paving of Alley between Portland and Wi1Uimette, Mr. Edgar ',D. Tower, 2290 Parks ide Lane, owner of an
apartment abutting this alley objected to paving and stated he had not been petitioned. Manager
explained that this project is result of exchange of land between City and Mr. Rubenstein, which
resulted in vacation of a portion of 26th Avenue. Director of Public Works said petition signed by
81% of owners of property.
In answer to question from Councilman Mohr, Director of Public Works said construction costs had
increased in paving projects, which involved mate~ia1s climbing in costs. Department. now includes
a 10% figure in the bids for contingencies, and there has been a 5% increase in engineering costs.
Contractor employee wages are continually increasing.

Councilman Mohr felt it was becoming increasingly difficult to justify passing on increased costs
to property owners, and that perhaps there should be a moratorium on certain projects to allow
stabilization of costs in this area.
Question called on motion. Rollcall vote. Motion carried with all councilmen voting aye.

No. 15, subject to opinion of City Attorney. Rollcall vote. All councilmen present voting aye,
the motion carried..
Mr. McDonald moved seconded by Dr. Purdy to accept the recommendation of the Public Works Department,
on Item 13, to reject the bid.
Mr. Neil Brown said he represented 75% of the frontage involved on this project, and that they were
opposed to the project at the present time.
In answer to a question from Mr. Teague, Pub1icWorks Director said the City pays cost of installation
of anything over 8" line, and the difference in this price was so inflated that it was an unreason-
able amount for the City to pay. The bid will be withheld until petitions ,are receiv.ed from the
property owners.
Question called on motion. Rollcall vote. All councilmen present voting ,aye, motion carried.
Mrs. Bea1 moved seconded by Dr. Purdy to refer to the Joint Housing Conunittee the question of'assess-
ments for benefits to property where the owner would suffer definite hardship because of age or low
income.

In answer ,to question from Councilman McDona1~ the Finance Director- said once a project is bonded,
money has to be available to pay bonds when they mature. The City would have to absorb this cost,
Mr, McDonald wanted to point out that the City had never foreclosed on anyone, and that persons
seemed to manage to pay their assessments and still remain on their property.

2. Since there were many persons present to discuss this matter, the Council heard it, first.
Delegation, Nuclear Generator Planning - Mrs. Bea1 moved seconded by Mrs. Hayward that the
City Council offer to cooperate with EWEB in spo~soring public discussions of a proposed
'nuclear power plant, and in these discussions seek, the advice of the State Sanitary Authority,
Board of County Commissioners, Central Lane Planning Council and other interested governmen-
tal and quasi-governmental units.

Mrs. Bea1 explained that a number of. people are concerned about the power plant authorized
by the voters. They are conc~rnedabout the facility, and whether it should be built at all.

Mr. Stan Cook was particularly anxious that an interested body encourage some pub1fc
discussions on the pros and cons of a nuclear plant. Federal regulations do not require
public hearings until the power authority applies for its firm construction permit. The
hearings are conducted by the A~E.C., and there is some question whether or not they will
be unbiased. Mr. Cook feels a public hearing should be held by an unbiased local group
who would bring in spokesmen and ask opinions abo~t the location of this facility. Mr.
Cook suggested that environmentalists be included, and that mechanism be set up for
comprehensive planning.

Councilman Mohr asked how this hearing would be implemented, Mrs. Beal said {f this motion passed,l!
she would move the Mayor appoint an ad hoc connnittee to work with EWEB to set up these hearings. I'
Councilman Teague felt EWEB should be consulted before a conunittee is set up. The City Manager II
s aid there had been some staff level discussion with EWEB staff, and both are anxious to ,i
cooperate with the Council in this regard. Councilman Mohr was concerned that such a public hear- I')
ing would not be documented so that it would be available for public bodies for future use. The f

Mr. Gordon Murphy pointed out that the public looks upon atomic power recognizing great
potential for beneficial force and an-easy answer to unlimited energy, and thinks they
have been misled into thinking that this will be a solution without attending problems.
Mr. Ray Wolfe asked the Council to consider implementing Mrs. Bea1's suggestion with the
further suggestion that this hearing be sponsored by the City Councilor an agency other
than EWEB.
Dr. Purdy asked if these people had appeared before the Water Board and asked for an
hoc committee. Mr. Cook replied that they did not ask the Water Board for the reason

could legislate to override what was a majority vote of the people to authorize this
nuclear plant, but that public concerns should be aired through public discussions.

Dr. Purdy felt EWEB was a very responsible body,with a responsible board of directors,
and that they woutd be unbiased in a public hearing, He- felt this was an EWEB problem
and moved, seconded by Mr. Gribskov to table this motion. Messrs. Teague, Purdy, Grib-
skov and McDonald voted in favor; Mrs. Hayward, Mrs. Beal, Messrs. Wingard and Mohr
against. Mayor Anderson broke the tie by voting against the motion to table.

Mr. Bonnett did not feel EWEB was responding in a way the public wanted them to r.espond.
Mr. Robert Sudman said EWEB is responsible to the City for producing power, but that the
City is responsible for planning and development of the City, and should look into
such things as placement and impact ,fo~ immediate needs of the City.
Councilman Wingard said the planning and development connnittee of the Oregon Legislature
spent many hours discussing this 'problem, without reaching any decision. Mr. Wingard
is in favor of discussion, and feels members of EWEB would be willing to cooperate in
public discussions.

Mr. McDonald moved seconded by Mrs. Beal to approve Item 2 of the Conunittee Report.
Mr. Axel Berntzen said EWEB had always done a good job, but he had doubts about location of such
a plant in the valley, since po~lution was already such a problem.
Mr. Franks, Mr. Paul Koblas, and Mr, Fred ~o all spoke in favor of public discussion of this

There was further Council discussion about the role that the Councilor EWEB might play in
public hearings.
Question called on motion. Motion carried with Dr. Purdy and Mr. McDonald voting no, Beal, Wingard,
Mohr, Gribskov and Teague voting yes.
Mrs. Beal moved seconded by Mr. Wingard that the Mayor appoint a committee of 2 or 3 people to work
with EWEB and with representatives of people at this meeting tonight, to set up a procedure for
public hearings, Mr. Teague suggested that the Council wait until after discussion with EWEB.
The City Manager suggested that such a committee be available to cooperate with the Water Board in
whatever effort comes from the Council action of this evening.
Mrs. Beal amended her motion to include this suggestions, with the agreement of her second.

These hearings would be sponsored jointly by EWEB and the City Council, and a committee would be
set up as provided in the original motion.
Mr. Wingard seconded the new motion. Vote taken on motion. Motion carried with Dr. Purdy vo~ing no.
A short break taken. Dr. Purdy did not return when the Council reconvened.

3. County Library Support - Mrs. Hayward said better services f~r the amount of money spent
could be obtained for citizens of Eugene by improving services in the County library service.
Mrs. Hayward moved seconded by Dr. Purdy that the Council go on record in support of expand-
ing library services throughout Lane County a~d that th~ City Council cooperate with Lane
County at the time these services are being planned for and carried out.
Mrs. Hayward explained that this would not mean a new library building, but a consolidation
of services, including bookmobile and s'chool library, central purchasing ,and cataloguing of
books throughout the County.
Mr. Atkinson of the Library Board s,aid the Board has reaffirmed its stand that library
service for all people of Lane County is desirable, and will communicate this feeling to
the County Commissioners.

Arboretum, World Court' of Trees - Mr. Robert Carlson introduced Mrs. Barbara Newton, member
of the Mayor's Committee for International Cooperation, whose idea it was to establish a
world court of trees in a park area, dedicated to the United Nations. This idea has been
investigated the past year, and discussed with people, including th~r:,City Manager and
Mayor. There are a number of possibilities, among them, that of cooperating with the
City or County Parks Departments and establishing such a world court of trees in Hendricks
Park or Alton Baker North Bank Park.' This could lead to increased cooperation between
0nations, and could be a tourist attraction, thus serving as an economic benefit. There
are many possibilities connected with such a project. The International Cooperation Com-
mittee recommends that the Council create a committee, not to exceed 15 members, authorized
to conduct whatever further investigation seems desirable to create an arburetum site to
include a world court of trees; to prepare plans, specifications, desirn and operating
procedures for creation, development, growth and maintenance of such an arboretum; to
coordinate their activities with the Parks Department and to report to and be responsible
to the Common Council.

Dr. Purdy moved seconded by Mrs. Hayward that a committee as outlined above, be appointed.
Mayor Anderson commended the International Cooperation Committee for projects undertaken,
and asked Mr. Carlson if it would be possible to have the International Cooperation Com-
mittee itself designated to undertake this project. Mrs. Newton said there were several
persons in the community willing to be part of such a committee, who had offered their
talents toward this project. Experts are needed.at this point. Mr. Carlson suggested that
an ad hoc committee be created for this special purpose.
Councilman Mohr recommended that tnis proposal be 'included with those submitted in connec-
tion with various projects the Council would anticipate funding with proceeds from the
room tax. The City Manager asked for a clarification of the motion. As he understood it,
it indicated certain responsibilities would be administrative. He presumed it was intended
that the committee develop a program and a plan first, and that the administrative res-
ponsibilities be determined after the concept is dev~loped.
Mr. Carlson said that, once the project is rolling, a Doard of trustees will be required
to review ideas and make decisions.
Dr. Purdy said this was the intent of his motion.

Taxicab Rate Increase - It has been requested that the Council consider a revision of the
ordinance governing taxicab rates in the city of Eugene. An increase from fifty cents for
the first two-fifths mile to sixty cents for the first two-fifths mile is requested. ;Mr.
Donald F. Bach outlined reasons for the requested increase, citing increases in union
contracts, employe benefits, .purchase and upkeep of equipment.

Workable Program Renewal Submission - Material to be included in this submission is somewhat
different than submissions in 'the past, and council approval of material is required. With-
out an approved Workable Program, new federally funded projects are not possible. A short
summary of the 1969 Workable Program Application was presented to the Council, and the full
document is available for their study before the regular meeting.
MrS. Hayward moved seconded by Mr. Gribskov that the application for recertification of the
1969 Workable Program to the Department of Housing and Urban Development be approved.
Planning Director said a member of staff had gone to San Francisco for instructions con-
cerning this application. Some changes were necessary in the code enforcement program,
but otherwise they' were very happy with the document. It will be available in published
form for Council and Planning Commission study within the next day or two.

1. Sanitary Sewers, Bethel Drive - Director of Public Works said Council, at the meeting of
April 14 had referred this matter to the Lane County Sanitarian and Planning Department.
After the reports were received the Department determined a sewer system to best ser~e~
the area. A map was shown and new sewer layout explained, and staff recommended author-
ization be given to proceed with the design of these sewers, and that bids be called.

Mr. McDonald moved seconded by Mr. Wingard to approve recommendation of the staff and call
for bids and proceed with sanitar~ sewers in Behte1 Drive area, with exception of area
south and north of Roosevelt Boulevard, and any other areas it might be determined should
not be included in the project.
In answer to Mr, McDonald's question, Director of Public Works said the City would pay
the cost of any lines over 8". Property owners would bear the entire cost of all 8" lines.

2. Vehicle-Pedestrian Conf1ic, Y.M.C.A. - A report from the Traffic Engineer was read, outlining
problems, and suggesting that the "Y" provide adequate facilities to conduct passenger
loading and unloading within their own parking lot, l?ather than utilizing- street right of way
for this purpose. Councilman Teague suggested that this matter be referred to the new "Y"
Director, with suggestions for improvement.

3. Parking Meter Request, U. of O. - A letter was read from J. O. Lindstrom requesting install-
ation of parking meters on the east side of Agate, 15th to 17th. A report from the Traffic
Engineer was read in which he recommended approval of the request with the following
conditions:
1. Purchase of 24 single head meters or 12 tandem head meters is required. Time
limits to be 2 hour and 5 hour. It is anticipated that approximately 16 would
be 2 hour with the other 8 being 5 hour meters.

2. This area is included in 7 a.m. to 6 p.m. enforcement zone.
3. Reason for approval is due to need for some shorter term parking by patrons of
officesiin the area.
Mr. McDonald moved seconded by Mr. Gribskov to approve the recommendation of the Traffic
Engineer with respect to parking meters on the east side of Agate from 15th to 17th. Motion'
carried.

4. Petition, Sanitary Sewer Northwest of 5th kvenue and Highway 99 North - Petitioned by owners
of 37% of property. Easements will be requ~red to get a line to the property petitioned,
and approval is recommended, subject to necessary easements.

5. Amazon Community Center - A report was read from the Director of Parks outlin~ng a new
concept 0T design and use for the proposed Amazon Community Center.

Dr. Purdy asked if any consideration had been given to a covered swimming pool at the
Laure1wood property. The Parks Department had been investigating the possibility of making
the YMCA pool more available to the general public, so that better overall service could be
given. Dr. Purdy asked for determination of general overall plan, not just in this location,
but for the whole area.

Council Bill 8880 - Amending Ordinance No. 14815 relating to cutting grass and weeds, payment
therefor, punishment for violation, and declaring an emergency was submitted and read the first time
in full on May 26, 1969, and lacking unanimous consent on the third reading by council bill number
only, was held over to this meeting for ~urther consideration, was submitted and read in full.

Mr. McDonald still had rese~vations about the date for cutting of weeas set out in the ordinance, and
said some discussion should be entered into.

Mrs. Margaret Patoine, 2552 Alder, protested the change of date for cutting, saying people sensitive
to pollens were aggravated when cutting was done at a later date. In answer to Mrs. Hayward, the
Manager sai? the ordinance was for the purpose of control of sensitivity, as well as fire control.
He explained the difficulty in the City getting grass mowed by the 1st of June, especially when the
weather was not favorable. The ordinance also provides for a change in the method of crerging,
sets up a new, more flexible system, which will enable the City Council to set charges annually by
resolution. After further Council discussion, Mr. McDonald moved seconded by Dr. Purdy to amend
the ordinance amending Ordinance No. 14815 relative to cutting grass and weeds, to remd June 1, 1969
for cutting deadline, rather than June 15, 1969, and that it be given final passage, Rollcall vote.
All councilmen present voting aye, the bill was declared passed and numbered 15706,
