\ Regular meeting of the Connnon Council of ,the city of Eugene, Oregon was called to order by His Honor I
Mayor Lester E. Anderson at 7:30 R.m. on July 14, 1969, in the Council Chamber. Councilmen present I

were: Mrs. Hayward, Messrs. Purdy, McDonald, Wingard and Teague, Mrs. Beal and Mr. Mohr. Gribskov absent.

! The minutes of the meeting. of June 26 and June 30,/1969, as mailed to Council members, were approved. II
II Street Closures, FAME - FAME Festival (Film, Art, Music in Eugene), sponsored by the Eugene Downtown !!
II Association and the University of Oregon School of Music, has requested temporary closure of the Ii
Ii following street locations: Park Avenue from 6 to 11 p.m., July 23 and 24; Broadway between Charnel- i'

I Councilman Mohr expressed some reservations concerning setting a precedent for use of public right I:
II of way, and how future requests might be handled. He felt some limits should be established. Ii
I Wendy Ray outlined the wide variety of activities planned for this Festival, and explained that no II

selling will be done on the streets.

Other Councilmen shared Mr. Mohr's concern and felt some procedures should be established concerning II
I use of public rights of jway, and types of uses to be allowed.

Mrs. Hayward moved seronded by Mr. McDonald to award contracts to the low bidder in all of the projects

I Project No. 10 received a letter of protest from Mr. Carl McDowell. Another adjacent. property
owner spoke in favor of the project, saying the road was in terrible condition.
I Project No. 17 - Mr. O. Dean, 39. West 22nd, asked why such a short section of alley being paved.
I City Manager explained that the recommendation was to reject the bid.

Waiver of Bidding - Director of Public Works explained that the subdivider may legally waive bidding
I ana project, which occurred in this case.

Mrs. Hayward moved seconded by Mr. McDonald that the bids opened July 8, 1969 be awarded to the
low bidder in each case, and that No. 2 be subject to recording of plat and agreement that subdivider
i be assessed on storm sewers, No.3, that subdivider accept bid, subJect t_o recording of plat.
Contract shall be awarded to Wi1dish Construction Co. on each of Waivers, for amount stated.
In answer to a question from Dr. Purdy, Director of Public Works said it would be in order to
require a subdivider to show bonding ability. This has been done in thepas.t..'Dr;'Purdy.fe1t'
I this would be desirable in the case of A. & B. Subdivision.

In answer to Dr. Purdy's question regarding problems of city acquiring undesirable property by
default, City Manager said Planning Department responsible for calling Manager's attention to any.
e subdivision which, in the judgment of the planning staff, is questionable regarding salability of
lots. At the present time one subdivision has placed securities on file with the City to assure
payment of as:sessments. Securities are released as lots are sold and built upon.

I will be available for a meeting to make it profitable. Mrs. Bea1 was anxious that this

d. City Council-Audi.torium Assoc. Joint Meeting - Manager suggested that -the Council meet
with the Auditorium Association after -the meeting to set ~he budget electi(:m amount on
June 30. All' councilmen present agreed to this, and that it would not be a public
hearing. The meeting will be at 8:00 p.m. in the McNutt Room. I

I' Since the garbage levy'was not approved by the voters, Lane County is collecting a

I detail on them. Mrs. Niven will attempt to arrange this. She explained that Council
members are welcome to attend Joint Housing Committee meetings.
Mrs. Hayward moved seconded by Mr. McDonald to approve Item 4 of the Committee report. Motion carried.
5. Highway Priority Listing - The following are proposed for recommendation .tothe State'High-
I way Commission for priority in construction:
r L 1-105 - Wi11amette River to 7th Avenue Section
2. Roosevelt Freeway - US99 to 1-105 Section
3. Skinner's Butte Freeway - 1-105 to.Hi1yard Street Section
4. Northwest Expressway - Irving Road to Roosevelt Freeway Section
I 5. Improvement of 2nd-3rd Street Interchange with.Q street in Springfield
, These priorities were established by the Technical Advisory Committee, considering the
I
future traffic demands of the entire Eugene-Springfield area. It has been found that a
united recommendation receives better attention.
e Mrs. Hayward moved seconded by Dr. Purdy that the Council concur with the proposed priorities
listing recommended by T.A.C.. Motion carried unanimously.
Mrs. Hayward moved seconded by Mr. McDonald to approve Item 5 of the Coinmittee report. Motion carried.

6. Appeal from Amortization Action, Daniel Hotel Supply, 2740 Chambers - Planning Commission
I selected a number of nonconforming uses resulting from adoption of zoning ordinance, one
of which was Daniel Hotel Supply. A public hearing was held on this matter by the Planning
Commission, and a limit placed on continuation of this non-conforming use. Ijanie1 Supply
I filed an appeal, and the Council should now set a date for public hearing on the appeal.
Dr. Purdy moved seconded by Mrs. Hayward that the Council set a public hearing Ju}y 14 on
I the appeal of Daniel Hotel Supply to the decision of the Planning Commission regarding
nondconforming use.
I There was Council discussion on procedural requirements in this type case, and whether'or
not written arguments would be presented. The Planning Commission will provide the Council
with a written record of past action. (The hearing will have to be set for the 28th)
Vote take~ on motion. .Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald that the City Council set a public hearing for July 28,
1969 on appeal of Daniel Hotel Supply to the decision of the Planning Commission regarding noric~nform-
I ing use. Motion carried.
7. Distribution. Proposed Ordinance for Administrative Action on Revocable Permits - A for~a1-
I ized ordinance will be submitted at the regular meeting. No action taken.

The Council asked about the administrative ordinance to eliminate much of Council action on
traffic matters.. City Attorney said conferences have been held and ground work done to
I prepare such an ordinance.
8. Speed Checks - A letter was read from the 5th 'grade math class at Fairfield School, enclos-
ing a speed check made of cars passing their school. A traffic department speed check was
made on Patterson Street, in the vicinity of the YMCA, and it was found that speeds are not
excessive in this area, and that it is posted reasonably. No action taken.

9. Parking Restriction, Bethel Drive - Traffic Engineer recommended removal of parking restric-
tion on both sides of Bethel Drive from Al1ane Avenue extending southerly for a distance
of 2000 feet. This prohibition was installed because of the use of Bethel School, and
I since it is no longer used, the parking restriction is no longer necessary.
Mr. Gribskov moved seconded by Dr.. Purdy to rescind the parking restriction-on'Bethe1 Drive,
as recommended by the Traffic Engineer. Motion carried.
Councilwoman Hayward asked whether work had been done on an ordinance prohibiting parking
of trucks and trailers in residential areas. The Manager, City Attorney and Traffic Engineer,
have been working on an ordinance, but there have been some problems in writing the ord inance.
In checking, there has'not appeared to be a great problem with.parking of trucks on residen-
tial streets.

I e. Resolution Opposing ABM Expenditure - Coup~i1man_Mohr 'explained_his reasons for sub-
mitting this resolution and said he did not wish to debate governmental issues. He
felt the Council should make judgment only on issues of local government. The. Council
would, by this resolution, try to add a balancing factor.
Mr. Mohr moved seconded by Mrs. Hayward to adopt' a resolution memorializing the Pres-
ident of the United States. to reconsider the Anti-Ballistic Missile Plan.
Mayor Anderson questioned what the Council would actually be trying to convey by
being too specific in its directions. He felt they would not be getting across' the
real concern for the cities. Mayor Anderson proposed that a resolution be prepared
which would more specifically state concern regarding cuts in the budget in favor of
weapons systems and other national safeguards. The .Counci1 .shou1d cite domestic
problems and request the administration to set up, at some level of government',a
program that would redefine national priority.
e Councilman Mohr said he would be willing to try to draft some language to change the
resolution.
Mrs. Hayward and Dr. Purdy agreed that this resolution was too specific, and that it
should say the Council feels defense and space budgets are too large in proportion, to
what 'is going to Cities, and that there should be a reass'essmerit of priorities.
Dr. Purdy moved seconded by Mrs. Hayward to table the resolution submitted by Mr. Mohr.

table. Motion tarried.
Councilman Mohr said the resolution had been. revised by the Mayor and he, and distributed copies to
the Council. The emphasis of the new resolution was on'impact of defense expenditures, asc:exemp1i-
I fied by the ABM missile, on local government and establishment of those kinds of priorities the

I Council believes to be pre-eminent at the local level.

Mrs. Hayward moved seconded by. Mrs. Bea1 that the City Council of Eugene adopt the resolution as
outlined.
Mr. Mohr pointed out that there was some discomfort on the part of the Council in dealing with this
issue. They should take testimony at a. public hearing to speak for citizens of the City. "The
Council should state its concern for the welfare of the Cities.
Vote taken on motion. Motion carried with Mr. McDonald voting no.
Mrs. Bea1 requested the Mayor to address a letter to accompany the resolution.
I f. Room Tax Allocation - Mrs. Hayward said th.e Chamber of Co~erce. had presented a requeS3t
for.a110cation from the room tax. She suggested that. this .'be forward to the allocations
I ~ommittee. The Manager asked if other proposals should also be sent to this committee.
He informed the Council the University of Oregon will cooperate and work.with the City
on collection of the tax.
I g. Budget Election - _Manager recommended adoption of an ordinance requiring voting in
I all local election, and providing a $5.00 fine for failure to vote. City Attorney said
this was unconstitutional.

h. Widening of Harlow Road; Condemnation - Mr. and Mrs. Henry C. Foster, 3411 Harlow Road,
I have offered to settle condemnation suit for $775.00. This is extremely high, but if
the jury awarded any a9-di~iona1 cillowapce to property owners, the City would be faced
I with approximately $700 in additional costs, besides the cost of extra staff time.
Mrs. Hayward moved seconded by, Dr. Purdy to acquire the property from Henry C. Foster
for $ 77 5. 00.
After Council discussion of advisability of settling this suit, and fairness to adjoin-
ing property owners, a votes. was taken on the motion, motion carried unanimously.

I 2. Newspaper Sales on Street - Section 39.11' of the Eugene Code provides that it .is unlawful
to sell or vend any article upon the sidewalks of the city of -Eugene, and the City Attorney
has doubts about the constitutionality of such a law. He wishes to amend the code to make
an exception ~or newspapers.
Councilman Mohr was concerned that the question of obscenity or pornography might be raised.
Councilman Purdy asked for a brief on why this amendment was necessary. The City Attorney
said he would prepare such a brief 'and forward it with a copy of the. proposed amendment to
e the Council.. No action was taken.-_

proposal will be sent to the Planning Commission, where priori~ies will be considered.

five proposed amendments to the by-laws and have asked .for a vote on each of the amendments

A copy 9f the proposal has been sent to the Council previously,. and there is nothing in the
~ recommendations that might be considered controversial. Approval of the proposed amend-
ments is recommended.

laws of the National League of Cities, based upon the recommendation of the City Manager.
