II At the request o~ the Mayor, the Public Works Director said that figures from the

Ii City Health Department estimated a co.st of about $23,000 annually for the milk in-
spection operation and brings in about $7,000 a year in fees and license revenues.
I. The Director also wished it noted that Ellis Rackleff, the City's dairy sanitarian, I,

I' control is a Statewide concern. The City's milk inspection program must conform to il

I rely on the State inspection program and utilize the money funded for the milk in~
I: spection program to hire two or three more police officers.

Ii program and felt also that people should be allowed a freedom of choice in the matter

II his opinion that basically there was no difference in that the City must follow

'I Councilman Wingard suggested charging high fees for raw milk producers as a way of

!I control if City inspection is.discontipued. He said he felt the City uould set as
" high a fee as wanted. The City Attorney commented. that this returns to the question

Ii of whether there is basis for such a classification and whether such classification
Ii is reasonable. It .was his opinion. that the City might find itself .in trouble if it
I, attempted to add a tax on one commodity only which. is.no~ disallewed in the State. ,

Councilman Mohr asked Mr. Carl if he would quickly state in his pwn terms what the
Ii issue is, and Mr. Carl replied that it appears to him the debate is whether the. City

ii can retain a local service in order to retain a ban of raw milk sales. He explained
i/ the State labeling requirements, in answer to ~s. Hayward, stating milk must be
i: labeled as to whether it is raw or pasteurized, name and address of distributor,

II said she felt it might be well to postpone action since there are legal questions' involved.

of the City in connection with a laundromat for low-income people. Mr. Ray Eaglin 'I
explained that they are not asking for funding, but for land sites, which the City II
would retain in ownership. In answer to Councilwoman Hayward, he said they did not I!

have a particular site in mind. If the City could not comply with this request, il
they asked the Council to simply endorse the plan. In answer to Mrs. Beal, Mr. Eaglin I,

I Mr. 'Mohr moved seconded by Mrs. Bea1' that the City Managerc,anvass properties' to
find those that might be available for use by' Lane Human Resources laundry
facility. Motion carried. Mrs. Beal asked that property not just be limited to
vacant property, but to that with houses or other buildings which might be utilized.

The Manager in~tructed Mr. Eaglin to contact the Planning Director, who will work I
with them. . I
The Planning Director said he met with representatives of LHR and showed properties owned by the City
and discussed possible location of laundry at.three or four sites. He said he assumed LHR representa-
tives would be coming back with a proposal. _
Mrs. Cecil Dammen, 525 Berntzen Road, commented she is and has been in laundry busine~for many years.
She feels there is overabundance of laundry facilities within the City in prime locations. Felt
there might be way someone now established' could help with this problem. She commented that there is
I a laundry association in Eugene of which she is a member and that th~y would certainly be appreciative
e of the opportunity to help the low-income people.
Councilman Mohr complimented Mrs. Dammen on her presentation and said he felt if the Association has
time and is willing to bring infor~~tion to the Council, they should be asked to do so.' Councilman
Wingard commented that because of la4ndry ownership he has a conflict of interest, but that he hoped
both sides would work together to try to understand this problem. He said he has lost money on the
operation of aaundries in apartment hduses, and would hope the two parties could work out this problem.
I Mrs. Hayward agreed that it would be i~P. ortant for all, members of the community to help if they could,
but did not think the Council is setting any more direction than on anything else. There may not be
property available, and Council cannot look at this unless this is known for sure. She felt the
Council should caution people interested in laundry facilities to see if they can get together with
Lane Human Resources.
Mrs. Hayward moved seconded by Mrs. Bea1 to approve Item 2 of the Coinmittee report. Motion carried,

3. Means of Financing City Expenses:....-Mrs:-Hayward.commented-that.shewas concerned
with financing of local government, and felt a broadly based committee should be ap-
pointed ~the Mayor to make recommendations to the Council on possible means of im-
proving revenue received by the City. j
Mrs. HayWard moved seconded by Mr. Mohr that the Council establish a committee, to I
be appointed by the Mayor, to study possible means of improving City revenue, and I
that such a committee be of reasonable size. i

The Council should make recommendations to the Mayor of persons to serve on such a. i
committee. It should be borne in mind that this involves not only the city of Eugene, Ii
I but local government in general. Ii

The Planaing Director said the Commission questioned interpretation of Article 24 of the Zoning I
Ordinance since it mentions motor vehicles but does not mention trucks, thus questioning whether log I,
trucks could be controlled under provisions of the Ordinance,and felt this item should be referred
to the City Attorney. I

Mr. J. Wesley Morgan, representing Nils B. Hult ana Associates, commented that this situation exists I
due to lack of zoning lcarification and intent of the City at the time this property was originally I
zoned, leaving the souther 170 feet as RA and zoning the bal?nce M-2. He contended if the RA classi- I
I
fication remains they have no way of utilizing the property, and said the owner of property to the I
south for which a trailer park is proposed is not interested ih purchasing this piece. If t~e M-2 Ii
zone is approved, it is intended to develop the parcel in conjunction with that to the north, using
the entire property for truck' maintenance shop and parking area. II I

Mr. John Mulder, attorney representing A~bert Jagger, owner, of the property to the south on which a Ii
trailer park is proposed with an approximate investment of $350,000, said he did not oppose. the 'I
rezoning but would like to see certain controls and restrictions placed on any appro~al, particularly I,
in the area of noise control. He suggested hiring of an acoustical engineer, property screening, II
time limit on hours trucks can drive on ,and off the property, and continued regulation or review of
! ~ the site. II
Mr. Albert Jagger, 4080 Castelloe Avenue, presented a report from the Workmens Compehsation Board II e

I Mr. .Deschnes asked about future rezoning in the area and possible effect on his
property. The Planning Director said there is no doubt there would be rezoning
but probably not during the life of Mr. Deschne's building, and that no devaluat'ion
of the existing home is anticipated inasmuch as access will be taken'from 18th
rather than from Taylor.
Mr. Teague moved seconded by Mr. Mohr to table this item until the August 11, 1969 Council meeting
since Mr. McDonald had reported receivipg a number of calls on this issue. Motion defeated, Council-
men Hayward, Wingard, Gribskov, and Mayor Anderson voting no; Councilman Teague abstaining; Council-
men Beal and Mohr voting aye.
Mrs. Hayward inquired what effect a two-week delay would have on the development, and Mr. Leneve re-
plied they would' not be hurt too much financially, but that it would' delay construction. Councilman
Wingard commented that he felt the Planning Commission decision should be upheld and that neighbors in
the area appeared to be satisfied with conditions:.applied to approval.

Item 5h of the Committee report. Motion carried, Mr. Teague abstaining.
i. Rezone to C-2 area east of:'Coburg Road south of Centennial, Bartel and Bennett ~ i

of the area by the Commission, the ordinance effecting the change to be held

j. Rezone to C-2, north side of Oakmont west of Coburg Road, Rethwill - The Planning
Commission recommended RP zoning for this property which would allow the use de-
sired by Dr. Rethwill but would also act as a buffer between the C-2 and R-l zones.

-Dr. Rethwill accepted the RP zone si~ce he was informed he would be able to constr~ct I
I
the type of building planned without problems.

The Planning Director explained the basis of"the Planning Commission recommendation. Dr. Rethwill
said that upon applying for building permits, numerous problems were encountered with regard to re-
quired setbacks, coverage, etc. , and he asked permission for the C-2 zone originally requested.
The Planning Director said the Commission was agreeable to the C-2 zone.
Mrs. Hayward moved seconded by Mr. Gribskov to rezone the area C-2. Motion carried.
,h':Dr. Purdy was concerned with the location of the property in relation to North Bank Park.
Mrs. N~ven said this property was similar to that owned by Parrish, and the Council
feels treatment in these instances can be ensured through Planned Unit 'Development.
Planning Director said general plan for Willakenzie area shows this property commercial.,
but tighter controls are possible through PUD.
I "'\~':"'C'Mr S . Niven, Planning Commission president, said commission was not really satisfied, since
they are trying to screen against noise, and log truck repairs are not quiet operations.
A solution is needed, as there are many properties falling into this category.
6. Report on Activities of Housing Expediter - Mrs. Robin Cushman, housing expediter for
the city of Eugene, distributed a revised report to the City Council and explained that
President Nixon's suggestion for consolidation of assistance programs would be welcomed,
since there are now many overlapping programs involving multiple agencies and diverse
criteria. She explained the lack of housing for low-income persons in the City and
e I steps taken to relieve the shortage.
I Mayor Anderson thanked Mrs. Cushman for her presentation. Mrs. Hayward complimented
I
her on her work thus far. Councilmen questioned Mrs. Cushman regarding availability
of applicants and methods of advertising. Mrs. Cushman explained'methods of contact-
ing property owners and realtors, and ~aid she is already deluged with.calls from.
those in need of low-rent housing.
Mayor Anderson requested Mrs. Cushman to circulate her report to the Salvation Army,
Lane Human Resources, and other agencies concerned with this program, County Com-
missioners and other units of government, so that they can be aware of what the ,
City program is.

the barricades at 29th Avenue and Willamette Street; and explained the study made
before and after of volumes using these streets, and that indications are that the.
circulation problem has been solved. Traffic does not appear to have affected other
areas, although one complaint from an apartment house owner on ?Oth Avenue has been
registered. Traffic Engineer has recommended that barricades' be r~mbved from' Oak' .
Street south of 29th to see whether the traffic pattern remains the same. This would

3. Property Sale, 27th and High - The Public Works Director explained location of the
property and reviewed prior bids received. An appraised v~lue had been set at
$17,500 on this RG site. A letter was read from Mr. Gary. A. Bernik, offering
I $14,000, with a 10% payment, balance to"be paid in one year,. with interest of 7%,
for the property. The previous highest bid"was from Gordon Olson for $13,000. \

In answer to a question from Dr. Purdy, ~he Public Works Director said 12 to 18
units could be built on this site, and access would be- to High Street.
Mr. Wingard moved seconded by Dr. Purdy to accept the offer of $14,000, but that
it be cash.
e Mrs. Hayward moved to amend the motion to authorize the City Manager to make the
best deal possible, with a minimum of $14,000. Mr. Wingard seconded the amendment,
saying that the Council doei not wish to create any bad publtc relitions.
After further Council discussion, a vote was taken on the motion to authorize the
"I City Manager to negotiate the sale of this property at a minimum price of $14,000
cash. Motion carried.
Gary Bernik, 3295 Fillmore Street, said that he had bid on the prope~ty three times and been rejected.
I On last bid City called him and asked if he wished to submit bid on property, and he fold the City
Manager he would offer $14,000. He said he would pay cash, but since he had submitted three previous
bids would like a decision.
The Public Works Director said the City has other offers on the property and that it was his under-
standing the intent was not to cut other parties out of the picture. He further commented that the
City has the right to negotiate the sale of the property in the best interest of the City since the
property is appraised at $17,500.
Mr. Wingard moved seconded by Mr. Mohr that this item be postponed until it can be discussed with the
City Manager. Motion carried.
4. Gilham Road Options
a. Woodward, 1990 Gilham Road, $225.00
b. Determan, 1980 Gilham Road, $400.00
These are final purchases of right-of-way in the Gilham Road project, and the staff
recommends that the options be exercised.

\ a. 8th Avenue, through street from Jefferson to Garfield - Memorandums from the
I Traffic Engineer and P'anning Director were distributed to the Council and read.
I The Traffic Engineer recommends that 8th Avenue be a through street from Jeffer-
son to Monroe, Monroe to Polk, Polk to Chambers, Chambers to Garfield. Planning
Department recommends traffic control on uncontrolled intersections for a test
- period, and that, if volumes increase, traffic diverters be considered, to dis-
courage through traffic.
Mrs. Hayward moved seconded by Mr. Gribskov to accept the recommendation of the
Traffic Engineer to make 8th Avenue a through street from Jefferson to Garfield.

Dr. Purdy said he had many phone calls concerning increased spe~d of traffic on
15th and Villard. Traffic Engineer has talked to several people, and Po lice De-
partment will put more control on the street. Increase in use of motorcycles
has resulted in increased noise level.

b. Truck Loading Zone, 1750 West 8th - Due to change in size of milk trucks, it is
recommended a truck loading zone be -established for Echo Spring Dairy on the
south side of 8th Avenue extendi~g westerly 25 feet from 8:00 a.m. to 5:00 p.m.

loading zone on West 8th Avenue. Motion carried.
6. Distribution, Dog Control Ordinance Amendment - Dr. Purdy moved seconded by Mrs.
Hayward that the Council schedule a hearing on this amendment for a future committee-
of-the-whole meeting, and notify those concerned. Motion. carried.

7. Ordinances
a. Administrative Approval, Revocable Permits -. This ordinance outlines criteria for
approving revocable permits.' It will allow staff to issue revocable permits with
favorable recommendation, so that only appeals to negative staff decisions will
come to the Council for action. This ordinance was requested by the Council.
Mr. Wingard moved seconded by Mrs. Ha:Ywar~ to accept the'ordinances. Motion carried.

b. Amendment, Vehicle Immobilization Ordinance - Amends requirement for issuance of
warrant before booting a car for overtime parking t~ckets, as well as for violation
I of other parking regulations.
I There was Council discussion concerning minimum number of parking tickets outlined
I in the ordinance before resorting to such immobilization. The Council fe1t,two
tickets were .insufficient grounds, and recommended amendment to five. e
I Mrs. Hayward moved seconded by M~. Gr~bskov that the Council approve the ordinance
with an am~ndment to extend to five the number of traffic citations before immobilizing
a vehicle. Motion carried.
Mrs. Hayward moved seconded by Mr. Gribskov to approve Item 7b of the Committee report.
The City Attorney called attention to an amendment suggested by the Finance Director which was to I'
~uthorize use of the boot also if traffic citations were not paid within a certain time. The ,
Attorney said. the ordinance was rewritten to reflect this amendment as well as increasing the number
of citations to five.
Mrs. Hayward withdrew her previous motion and moved, seconded by Mr. Gribskov, to adopt the ordinance
in accordance with the amendments cited. Motion carried.
c. Amendments to sign code, strings of lights - Building Superintendent explained amendment,
and that the Sign Code Board of Appeals had numerous complaints, especially from used car
dealers. Proposed amendment to allow use of bare light bulbs of more than l~~watts if 25
feet from edge of street, was acceptable to them. After Council discussion of lighting"
as it relates to buildings and security, Mr. Gribskov moved seconded by Mr. Wingard to
accept amendment to Sign Code. Motion carried.

I Discontinuation of Rail Service - Mayor Anderson said Southern Pacific had been discussing'plans:for
Idiscontinuation of service between PortlandandEugen~. The Council will re call a resolution adopted
,September 9, 1968 opposing discontinuance of service on this particular route. The Mayor said that
\congressman Dellenback had advised him that be is making.a presentation .before the FICC noting that the
,Eugene City Council had adopted this resolution and suggested that the Co~ncil reaffirm its:position.

September 9, 1968 by Resolution N . 1578, opposing dis,continuance of Southern Pacific. "Cas.cade" trains
