Regular m~eting of the Common Counci1'of the city of Eugene, Oregon was called to order by His Honor
Mayor Lester E. Anderson at 7:30 p.m. on August 11, 1969 in the Council Chamber with the following
councilmen present: Mrs. Hayward, Messrs. Purdy, McDonald, Wingard and Teague, Mrs. Beal, Messrs.
Gribskov and MOhr. .,
Minutes of Council meetings held July 14 and 17, 1969 as mailed to Council members were approved.
Appointments - Mayor Anderson announced appointment of the following to serve on a committee
to study possible new sources of local government revenues: Mr. Joe Richards; Mr. Ralph Cobb;
Mr. Herman Kehr1i; Councilmen Nancy Hayward and George Wingard; Mrs. Betty Niven; Mayor Anderson
and City Manager Hugh McKinley.
il Assistant Municipal Judge - Council President Hayward said the Council had met in executive e
session for the purpose of choosing an Assistant Municipal Judge. Pierre Van Rysse1berghe was
elected.
Mrs. Hayward'moved seconded by Mr. McDonald that the Council appoint Pierre Van Rysse1berghe as
Assistant Municipal Judge for the city of Eugene. Motion carried.'-
Resignation, Chief of Police - The City Manager said he had, this morning, received a letter of
resignation from Chief of Police Ellsworth.He~:read the memorandum, and commended Chief Ellsworth I
on the excellent job he had done, and for. his contribution toward developing an outstanding police'
department in the City.
Mrs. Hayward commented that, as President of the Council, she wished to echo Mr. McKinley's
stat'ements, and that the entire City appreciates Chief Ellsworth's contribution to the city.
Mayor Anderson said he was sure Mrs. Hayward spoke for himself and th~ entire Council.
Health Department, Milk Inspection - Mayor Anderson outlined discussion of this matter at previous
committee meetings, and explained that the City may not, under State law, ban the sale of raw milk
without maintaining an inspection s'ervice. A letter was received from Dr. Fox, President of Lane
County Medical Society urging 'the City Council to maintain milk inspection service in the City.
He felt the City should continue to protect its citizens from the hazards of unpasteurized milk.
I In answer to Councilwoman Hayward's question, Assistant City Attorney Combs said the State was I
I responsible for milk inspection, but'had left one exception. A city within boundaries of the I
I State which wishes to have an inspection prognm may do so. Without this inspection, there can I

be no restriction on the sale of milk, grading, etc. This includes sale of raw milk. Eug~ne is.
currently the only city in the State operating a milk inspection program. I
In answer to Councilman McDonald's question concerning reduction in the budget, the City Manager
said approximately $22,000.00 would have to be made up in the budget. Mr. McDonald said he had
II received a letter from Dr. Emile Furrer advocating continuance of the ban on raw milk sales in
the city of Eugene. I
I Mrs. Hayward-moved seconded by Mr. McDonald that the Council authorize continuance of the milk
inspection program.

I Councilwoman Hayward said she could not vote to allow the city to go backward in such an important
I health manner. She hoped citizens anxious to continue the program would request the legislature
to establish. such a program over the entire state.

Councilman Teague reaffirmed his position in favor of continuance of the milk inspection pro~ram. -

11 Mr~ William J. Daniel explained that he felt th~ Planning Commission action was unjustified, and

If that he could not afford to remodel his building to comply with requirements for a 15 year amort-
!i ization period. He felt. that no .complaint.s had been received, and that he was compatible with.

II Mr. Rhodaback of the Planning Department explained that the complaints mentioned in the Planning

I Commission report had been received from the Building Department, and that these had been
I received over a period of several years. There are no written statements in the files.

Ij Mr. Daniel wanted it clarified that he had been in this location since 1949, and that the
Planning Commission minutes were in error in this regard.

Ii There was a discussion concerning methods of bring Mr. Daniel's property up to code, and whether

I it could not be depreciated within the 15 year period allowed by the Planning Commission.

COMMITTEE REPORTS
I Committee meeting held J.uly 30, 1969: I

1. Field and BackYard Burning - Councilman Mohr commented on recent air conditions, and said
it is quite evident that regulations pertaining to field burning aoopted by the last
session of the legislature had failed to give the desired results. He suggested the
City might obtain an injunction to stop the field burning.
I Mrs. Hayward was interested to know the status of the ban on back yard burning, which
was referred to the Lane Regional Air Pollution Authority. Mr. Ray said the Authority
is gathering statistics, but that the City now has authority to ban back yard burning
by administative order.

I Mr. Ray said the Regional Authority has adopted regulations calling for a ban of' all out-
I door trash burning as of January 1, 1971. Mayor Anderson suggested representatives of
I Lane Authority and the Oregon Department of Environmental Quality '(formerly State San-
itary Authority) be invited to the August 11, 1969 Council meeting, and that representa-
I tives of the Lane Authority be asked to be present at the August 6, 1969 Committee
meeting to present information regarding the degree of the proglem as it exists today.
He stressed'too, the importance of publicizing the situation to encourage the public to
send complaints to the State Authority, thereby bringing to the Authority's attention
the seriousness of the situation in this community., It was agreed that the Lane
Regional Authority would be invited to send representatives to the August 6 Committee
meeting, and both the Authority and State Department of Environmental Quality to the
August 11 Council meeting.
I A vote was taken on, the motion to ban back yard burning., and the motion carried unanimously.
I COUQcilman Wingard commented on the intent of legislation adopted in the last session
I I of the State Legislature, and asked the City Attorney to check the record to see if the
I law is being violated by those persons receiving permits who burn when air conditions
I are not favorable. Councilwoman ,Beal asked the City Attorney also to check on the
I enforcement measures with regard to the situation.
Mayor Anderson suggested that action be delayed on this item until Item 1 of the Committee report
of Augusto6 is heard.
2. Youth Center - Councilwoman Hayward said she was favorably impressed with the youth program
~ being carried on by the Mental Health Center, the University of Oregon and the City Parks
Department with ,teenagers in the South Amazon Park area. The Parks 'Director said the
program is being coordinated with the youth center idea at the Amazon Building.
3. Misrepresentation in Advertising - Councilwoman Hayward asked if the City can take ac,tion
I in the case of advertising misrepresentation in the flyers distributed for the recent

I Rock,Festival. The City Attorney said individuals could sue the promoters in small claims
I court, but that the City has no standing in the matter. Councilman Mohr commented that he
felt closure of the streets for the Festival proved to be a worthwhile action.

4. Resolution, Earl McNutt - At the request of Mayor Anderson, the City Attorney said he would '
prepare a resolution honoring Earl McNutt, former Mayor of Eugene, who recently passed away,
I I to be presented at the August 11, 1969 Council meeting, and a copy would be sent to his
family after adoption by the Council.
Mrs. Hayward moved seconded by Mr. McDonald that Resolution No. 1710 honoring Earl McNutt, former
Mayor of Eugene, be adopted. Motion carried.
5. Prog~ess Report, Central Eugene Pro,iect .. ERA Director David Hunt reported to the Council

commercial tenants was discussed, and Mr. Hunt said formation of a corporation ,by small I
businessmen in the downtown area will be proposed whereby, as a copporation, they can
pool resources and lease properties to themselves-as individuals. A meeting is scheduled
for July 31, 1969 between the Agency and the Council to review preliminary ideas with
regard to new structures in the area, possible expansion of the mall area,. and. schedule '
for proceeding with street closures. He said some improvements are going ahead, such as
sewers and service area for the interior of'the project, meetings are scheduled to
discuss the possibility of another parking structure on the west side, and the Citizens
Advisory Committee is being reviewed for possibility of restructuring.
Mrs. Hayward moved seconded by Mr. McDonald to 'receive and file Item 5 of the Committee report.

I 6. Report, Community Seminar on Aging - Mr. LeRoy. Owens"director of the Community Seminar
I on Aging, presented copies of a brochure on the recent Seminar sponsored by the Council,
and financed through an Oregon State Program with funds from the Department of Health,
I Education and Welfare. Also presented were mimeographed copies of recommendatio?s from
I the Advisory Committee appointed by the Council to investigate proble~s of the aging in e
I this community. The recommendations were (1) to appoint a permanent Advisory Committee
I on Aging to act as liaison between elderly citizens and the Council with special cpmmeQd-
II ation given for efforts of the temp~rary committee to ,esta~ 1i~h.a Metropoli~a~ Information /
and Referral System; (2) that the C~ty and County do all poss~ble to make c~t~zens aware
of the growing economic disaster facing aging people, with efforts made to encourage
flexible retirement requirements, and that the organization "Helping Elderly People
Locate Positions" be encouraged to expand its efforts to generate creative employment I
I opportunities for older people; (3) addition of varied recre, ational programs to allow
'increased participation by the elderly; (4) a study of ~ousing for older citizens to,
I include consideration of maintaining individual housing with possible tax rebates;
'I (5) careful consideration of sociological aspects in relocating older people'in the
I process of physical improvements; (6) establishment of a public supported mass transit
I system and support of the'efforts of the Emerald Empire Council on Aging Transportation
II Committee, seeking that Committee's participation in, planning of transportation affecting
, I older people.

cerned with problems of aging, to make recommendations to the Council a~d offer suggestions
I and help in solving so~e of the problems of the,aging in this community, the co~ittee

Ii Members of the Advisory Committee commented on the Seminar and the recommendations.
j With regard to the financial status of the elderly, Councilwoman Beal asked whether
II improvement assessments against properties of elderly people could be assumed by the
II City until they could be-charg~d against estates. It was' explained this matter is now
before the Joint Housing Committee and a report will be made at a later date. I
Mr; Owens commented on the problem developing because of the ever-increasing number of I ~
elderly people who are forced to retire at a fixed, age with income drastically reduced.
" He also commented on the difficulties with lighting and sound system encountered in _
I the City facilities used for the Seminar. I
j Councilwoman Hayward expressed appreciation for the report and asked if it is planned
I to present the same information to Springfield and Lane County. Mr. OweBS said it would
be given to both governmental units.

II' Mr. Ed Adkins requested that this motion be delayed until more study has been made of needs of the
1 Community. He felt this committee should have a wide representation., Mr. Owens.agreed.with Mr.
II Adkins that the committee should have wide representation, and hoped that some representatives of

1. Field Burning - Mayor Anderson presented a six-point program for the Council's considera-
tion with regard to'air pollution conditions as a result ,of .field .burning... .He ,said- , , .
I legisl~tion sponsored by the seed growers has failed to alleviate smoke conditions and
that a,plea from the Governor for complete voluntary ban on burning has gone unheeded.
He urged the Council to (1) seek complete elimination of field burning in the Willamette 4It
Valley airshed; (2) seek maximum enforcement under existing laws by other governmental
agencies, and ask for greater effort on their part to document problem areas; (3) seek

new legislation by working with the Lane County delegation and through them contact
legislative leadership and committees primarily concerned with the air pollution problem
(Mayor Anderson commented on the Governor's cooperation in asking for the voluntary ban;
he also said he would support Senator Ed Fadeley's call for a special sessi~n of ~he
Legislature to deal with the problem); (4) examine possibility for relief through the
courts; (5) enact restrictive measures banning outdoor- trash burning in the City by
ordinance; providing penalties for violation, to strengthen the City's position in
seeking elimination of field burning; and (6) initiate new action program to implement
greater public awareness of the problem involving the entire community. He urged
greater participation by those catering to tourists, merchants, property management
people, University summer school, etc., getting firm commitments with no deviation
from the objective. The Mayor asked Council~oman Beal to assume the responsibility,
with staff help, of devising a program to coordinate organized citi~n effort to bring
I about results sought.

I elimination of open f.ield burning, including slash, trash, and land clearing burning,
e in the Willamette Valley air shed .
I Councilwoman Beal suggested requesting agencies issuing permits for field burning to
publish the names of those receiving permits, type of burning, and acreage burned, as
a deterrent to the present condition. She also suggested exploring the possibility of-
engaging expert counsel on this type of legislation to determine whether court action
would be successful, and that the Council sponsor a petition signed by Eugene citizens
I supporting institution of legal action by the Council with. an attachment whereby they
could subscribe some small amount to defray expenses.
Some discussion took place with regard to seeking a ban on slash burning and require-
ments under Federal-timber contracts for such burning. The Director of the Lane Reg-
ional Air Pollution Authority read resumes of H.B. 1228 and S.B. 168 concerning open
burning on agricultural and forest lands, and said the Regional Authority has no legal
jurisdiction or enforcement facilities for these two areas.

Councilwoman Beal asked the Council to adopt a resolution sponsoring a petition request-
ing the City to seek court action, the petition to carry an attachment explaining the
City's lack of funds, and seeking subscription of small amounts - probably $1.00 _
to be collected when needed for legal fees. It was agreed to await a report previously
requested from the City Attorney with regard to implications of present State law.
Councilman Purdy said he felt State and Federal funds should be provided for research
to discover methods other than burning to help the seed industry, that the seed growers
J I should be given assistance if burning is outlawed. It was determined that a total of
about $300,000 has been made available for this purpose.
I The proposed ban on back yard trash burning was discussed, considering possible alter-
natives for disposing of trash and expense involved should the City attempt this
I service. Councilwoman Hayward distributed copies of ,a letter from Orval Etter of the
office of Local Government Research and Consultation suggesting a partial ban only, or
if an absolute ban, then provision of equipment to mulch yard debris. The City Manager
said a major 'expenditure would be involved- in use of present equipment, based on exper-
ience of leaf pickup only. Mrs. Hayward commented on the possibility in the budget'
I process of establishing fees to be paid by citizens for this type of service.
I The ,City Attorney said legislation would be presented to the Council at its August
~ 11, 1969 meeting, which would ban open burning in the City.
Mrs. Hayward moved seconded by Mrs. Beal to adopt a resolution urging all other govern-
mental jurisdictions in the metropolitan area, especially Lane County, to enact the
same type legislation banning open burning in the metropolitan area. Motion carried.
It was pointed out that under the Regional ~uthority open burning restrictions were
I imposed to be effective January 1, 1971. Discuss.ion continued on i~suance of permits
and areas of responsibility for enforcement of regulations - State Police and Air
Authority.
The City Attorney introduced Paul Speck, law student from the University of Oregon, who
has worked with the Attorney's office in researching Oregon law with regard to field
burning. The City Attorney said because the law is vague and becuase of the complexity
I of the problem, considerable research will be-necessary to determine whether a court
suit would be effective. He commented further on probable difficulties of instituting
I legal action, and said that, although a mandamus suit could be initiated the field burn-
ling would continue because of the length of time which would be involved in the suit.
He said he would report and give' recommendations in about 30 day's as to' how to proceed
for legal relief as well as to whether to retain outside counsel to completely explore'
all facets, including liabilities which the City might incur with any future law suits
in this regard. Mr. Speck commented on his.;research in the matter, and said he felt
legal action should be tried.

Mr. H. M. Patterson, State Department of Environmental Quality explained duties of his office, and I
that recent legislation, while a step in the right direction; is still inadequate, and does not
provide the legal tools to allow the Agency to control field burning and eliminate the problem.
There was discussion concerning methods of determining field burning days. Mr. Arnold Silver,
Attorney for the Department of Environmental Quality, said the City could instruct its own Fire
Marshall regarding burning, but that State law supersedes City law. Mr. Silver, in answer to Council-
woman Beal, said that, under the law, field burning is an exempt activity. The law only 'establishes
a schedule of days when field burning is permissible, and incorporates restrictions in permits for
burning. There is need for stronger legislation.
There was further discussion concerning legal aspects, and possfuble' legal action to be taken by the
City.
Mayor Anderson said the City had been willing .to cooperate with the grass seed industry, but has recog-
nized the futility of seeking this type of regulation. The Council now has to declare itself and seek
complete abolition of open field burning in the Willamette Valley Air Shed. e
Mr. Carl Broome presented a petition circulated in the City, and requested that'funds be allotted for
research for other methods to alleviate problems of grass burning farmers.
Mr. Ed Deardorff, a taxpayer, spoke against field burning, but did not feel local citiz'ens should be
prohibited from burning on their property.
A letter was read from Don Fox, M.D., president of Lane County Medical Society, addressed to'Governor I
McCall, advocating cessation of field burning for medical reasons, and requesting that research funds
be provided by the State to assist in finding a solution to the problem.
Councilman Teague agreed that something must be done to alleviate the City's smoke problems.
I Mr. Pat Flynn, speaking' as a m~mberof Upper"Willamette Air Pollution League, suggeste? that the City
I go before the courts and determine the intent of the law, and what corrective steps are needed.
Mr. Becker upheld the back yard burning ban, saying it would be inconsistent to complain of burning
and do nothing in our own City. The Mayor said the matter of back yard burning will be taken up later
on the,agenda.

Mayor Anderson commented on the matter of seeking relief through the courts. He urged the Council to
commit itself to such a policy, and requestec' the City Manager to recommend a course of legal action,
based on a survey of the problem, and findings in other cases of this kind. After this survey is
completed, legal counsel selected would make recommendations to the City Council as to the best course
of ~egal_action to be ta~en, apprQximate cost to the City, and suth other obligations as might be
incurred. The time required for this would place undue burden on the City Attorney, and the cost
I should be borne by all the City.
Mrs. Hayward moved seconded by Mr. McDonald to request the City Manager to come back to the Council I
with a plan for relief through the courts.

Mr. Paul Koblis said it seemed current controls on field burning are based on weather, and that weather
cannot be counted upon. Since agriculture is exempt under current law, some provision should be
made for protecting health and welfare of the people of this valley.
A vote was taken on the motion as stated and motion carried.
Mrs. Hayward moved seconded by Mr. ~cDonald to establish a ban on outdoor burning, except for certain -
kinds of recreational burning, for the city of Eugene, and urge other jurisdictions to undertake
similar _action.
Mrs. Hayward commented on a suggestion made by Mr. Becker that the City recognizes the problem of
clearing away cuttiags and other yard debris. Due to financial problems, the City cannot go into
I remo~al in a full scale manner. There has been discussion of charging individuals who request this
serv~ce.

Councilman McDonald said Mr. Clyde Smith, 1970 Polk Street, and Mr. Byron Taylor, 2520 Lawrence, had
contacted him, speaking against the ban on backyard burning.
Dr. Purdy reported he had received a call regarding the'wigwam burner on Garfield, and was told by
Mr. Vern,Adkison that this company has been making a feasibility study for equipment to. try to eliminate
that burrier entirely., Mr. Adkison said very few industrial burning permits are being issued. Mr.
Teague added that Mr. Adkison has been very successful in finding a new. market for products ordinarily I
burned.
Mrs. John Bascomb, president of the League of"Women Voters read a statement from them in support of a
ban on burning.

Mayor Anderson explained that one of the chinks in the City's armor was that local government had done
nothing within the scope of its own. responsibility. The City must be willing to do its part. -

Mr.J: H. Sorenson, 4300 Avalon, said air pollution had not bothered them particularly, and that the
Council was going off the deep ena over field burning and back yard burning. He felt there were
other ways to eliminate the nuisances.
Mr. John R. Axtell, 2573 Sharon Way, felt everything should be done to try to eliminate pollution,
and that this ordinance was a step in the right direction.
The City Manager read a letter from Mrs. Gi lles LeRoux, 2220 Jeppesen Acres, objecting to the ban on
outdoor burning.. 'The Manager pointed out to Mr. Becker that the City' does have a leaf collection
service and a machine for chipping trees when they are trimmed.
A vote was taken on the motion as stated and motion carried. Mr. McDonald voted no.
2. Appointment, Assistant Municipal Judge - Councilwoman Beal reported that the Committee
e appointed to select an assistant municipal judge to replace Gordon Cottrell, resigned, had

berghe. The Council was asked to convene prior to its August 11, 1969 meeting to reach
a decision between t~e two adequately qualified candidates. Mayor Anderson asked the
Council to meet in executive session at 7:00 p.m., August 11, 1969 for that purpose.
Councilman Teague said he would abstain from voting because of his relationship to Mr.
VanRysselberghe.
I 3. Motel Room Tax Allocation Committee - The Chamber of Commerce requested that the committee
appointed to recommend distribution of room tax funds be organized and proceed with its
l investigation. It was understood the committee would be called for an organizational meeting.
I 4. Ordinances - Copies of proposed ordinances for (1) legal procedure in issuing parking
citations, (2) delegating authority to the Manager's office to establish traffic controls
with provisions for appeal to the Council, and (3) control of overnight'parking in
residential areas of heavy trucks, were distributed.to Council members.' The ordinances
will be scheduled for future discussion.
5. Milk Inspection - The City Manager .commented on a memo from the City Attorney with regard
to the Council's jurisdiction in the control of raw milk sales and said the item will be
. discussed at the August 11 meeting.
I 6. Federal Expenditure, Defense - A letter was presented from the Pres~d~nt's'office with
regard to the Council's resolution questioning priorities _ in'. National expend.itures in
terms of defense vs. metropolitan problems, and defending the President's position on
the ABM controversy.
Mrs. Hayward moved seconded by Mr. McDonald to receive and file Items 2, 3, 4, 5 and 6 of the
'Committee~report. -Motion carried.
7. Schedule Discussion on Collective Bargaining - The City Manager reported the committee
I appointed to make recommendations to the Council on employe-employer relationship systems
will not have completed its work by August 15, the date set by the Council in requesting
a report, and asked if the Council wished to schedule further discussion o.fthe issue
before receipt of the committee's report.
Pat Flynn, Fire Fighters business agent, expressed concern about further delay in the
matter, and said he felt the best procedure was to proceed with bargaining, using the
committee's services should an impasse develop. It was the Council's consensus that
e the intent of creating a committee was to help describe procedures for employe-employer
relations, and that that interest would best be served by awaiting the commitee's report
before further discussion on collective bargaining. The Mayor stressed the point that
there has been no delay, as such, in the committee's organization, that it has moved
I as quickly as possible, and said he would 'rather have, the committee do a thorough
study, in order to present facts on which to base a decision. Mr. Flynn again commented
on delay in the committee's work, and was joined by Frank -Jackson, president of the
Fire Fighters, who asked that a time limit be set as to when the committee's report
would be given to the Council. The City Manager recognized the help given by the Fire
Fighters and other City employes in ;the recent City election, and, in answer to Mr.
Flynn's comment that the issue has been before the Council for at least six years, said
a decision in' the matter was made twice, but the question was again raised by the Fire
Fighters.
Dr. Purdy moved seconded by Mr. Gribskov to await the co~mittee's report before
scheduling further discussion of collective bargaining. .. Mo:tion carried, Mrs. Beal
I voting no.
. It was agreed the committee should- be requested to bring back its report as quickly as
possible.
Mrs. Hayward moved seconded by Mr. McDonald to' approve Item 7 of the Committee report.
Pat Flynn objected to the delay in committee action and requested that the Council act without await-

8. Concept Study, Amazon Park RecreationBuilding - Permission was requested 'for a concept , I
sutdy to identify'potential users and acitivites to be provided in the proposed'community
building at Amazon Park. Estimated cost is $600, and it was felt more knowledge of
needed uses would be helpful in designi~g the structure.

Weaver be requested to renew the condition that paving be' accomplished, 'as agreed in
the 'original alley vacation.'

record show that authority was given to split Jensen assessment into two parcels and allow him to sign
contract on portion taken up by Highway 126. In Bethel~Danebo area, split assessments are allowed

C.B. 8956 - Outdoor Burning Ban - There was Council discussion regarding the definition of
I fire in campsites in fire pits provided. Assistant City Attorney said this could not be construed
as a private back yard. Dr. Purdy felt a bonfire at home should be allowed. After further discussion,
