I, Adjourned meeting of the Corrnnon',Council of the ,city of Eugene, Oregon, called to order by Counc.il
II President Nancy Hayward in the absence of Mayor=' Anderson - at 7:30 p.m. on A9gust 25, 1969 in the
Council Chamber, with'thefollowing,councilmen present: Mr. Wingard, Mr. Teague, Mrs. Beal and
Ii Mr. Gribskov. Councilmen Purdy, McDonald and Mohr were absent.

The City Manager reminded Councilmen of the Eugene Renewal Agency meeting Wednesday, August 27, 1969
at 8:00 p.m. to review planning and designs for the downtown mall. He also reminded Councilmen
of the National League of Cities annual congress December 1st to 4th.
II Field Burning - Statements by Lane Regional Air Pollution Authority were distributed to the e
Council at the request of the Mayor. The Authority is attempting to find a solution to
r accelerat~ the burning program, which will give ,relief to the City, and some financial relief
II to farmers. They have urged the Department of Environmental Quality to encourage burning on
Ii days when winds are from the west or'southwest.

Councilman Wingard said he could not endorse blowing smoke up to Salem and Portland; which might
)1 be caused by southwest winds. The Manager explained that it was felt smoke would dissipate I
II over the Coburg hills, and that Salem had no hills to trap smoke~ Councilman Teague rema~ked
that these were ;jiust suggestions offered to Environmental Quality, for their consideration.

11 l. Field Burning - Mayor Anderson expressed appreciation to members of the Council for
II taking part in the discussion with the Governor to attempt to alleviate the smoke

.11 problem in the Willamette Valley. He corrnnented that, subsequent to testimony at
II Salem he had called Governor McCall, asking him to come to Eugene. He consented,
and arrived in the City at about 5:30 p.m., meeting at City Hall with Councilmen,
II staff and press. He indicated he would meet with the Attorney General the';morning I..
I: of August 13 to work out some kind of statement or executive order which would
It determine the course of the future.
II The Board of Environmental Quality is meeting at City Hall the evening of August 13

II at 8:30 p.m. to discuss the problem, and try to find a solution.

Mrs. Hayward said she had placed before the Council copies of a letter from David I

It Harrnnons reporting on the possibility of institution of legal action by the City to abate
H pollution of air resources, and urging that the City continue, through the courts, its
11 campaign to clear the air, even though the Governor has invoked the State Attorney I
II General's office to outlaw all field burning. The Council should not feel that the I
II I
problem is being resolved, and take no action on its own. I
II Councilwoman Beal agreed with Mrs. Hayward and urged that the City 'institute legal
II action irrnnediately. I

Ii Mr. Terry Harrnnons said there are four kinds of action that could be instituted; one I
I: against the Department of Environmental Quality, another against the State Fire
II
II Marshall, a third against the burners themselves, and a fourth to seek injunction
!i against the Fire Chief issuing the permit. In answer to Councilwoman Beal's question,
n Hammons said the City could not sue for damages. This would have to be done under complaint

j' by individual citizens.

" Mayor Anderson said the Council has instructed the City Manager to bring back a

'I recorrnnendation on action to proceed in obtaining legal counsel.,: The Mayor agreed that
II what is done at the State level should not be. considered the City's final move.

Ii Councilwoman Beal said it was hoped a citizens committee could be established to draft I
I' a petition and obtain signatures, especially as regards the health and welfare of the
II
" corrnnunity, petitioning t~e Mayor and Corrnnon Council to bring legal action, because of
11 the damage incurred by them. Mayor Anderson said it was important to gather data I
regarding effects of smoke on the health and welfare of people in the area.

II Mrs. Beal moved seconded by Mrs. Hayward that the City authorize an official petition

II form to be circulated by a citizens corrnnittee against pollution, exact wording of form I'
II to be developed by a committee of the corrnnittee, dealing prfncipally,with the health II
II and safety aspect of the problem. Motion carried.

I Councilman Wingard though Council efforts would prove to be very fruitful. The House I

,\ of Representatives is ready for action. H.B. 1228 has been formalized, and a summary '_
circulated for Council information. There is still action that may be taken under this

Mrs. Beal moved seconded by Mr. Wingard that the Council request the Weather Bureau,:;press, radio
and television to include in formal weather forecasts a prediction of smokiness or smoke dispersal
problems. Motion carried.) I
2. Salvage Operation, Highway 99 North - Councilman Gribskov asked that the staff prepare
a report on the salvage operation at the overpass of Highway 99 North. Citizens have
been complaining about this blight on the community.
Mr. Wingard moved seconded by Mr. Gtibskov to receive and file Item 2 of the Committee report. Motion
carried. I
3. Hult Rezoning Request, RA to M-2, West of Wallis Street - Rezoning"has been requested on
property south of West 11th for a garage for truck repair and storage. Tabled at the
last meeting, pending effort to work out screening problems between Mr. Hult and Mr.
Albert Jagger, who is planning a mobile home park to the south of this site. A meeting
~ was held with staff in an effort to solve the pboblem. They discussed installation of a
twelve foot high fence, but Mr. Jagger does not wish to participate in cost of the
installation~ Staff recommends this item be taken from the table and referred back to
the Planning Commission, with suggestion conditional use restrictions be placed on
property, or another;solution found.
Mrs. Hayward moved seconded by Mr. Gribskov that the Council refer this item back to
I the Planning Commission.
Mr. Wes Morgan stated Mr. Hult's position, and said they preferred a planting buffer,
feeling it would provide better insulation, but agreed to the fence, since this was
Mr. Jagger's preference. However, they were willing to pay for only 50%, since Mr.
Jagger was also required to buffer his property for mobile home park use. Mr. Ray
explained that, until the operation starts, there is no way to tell what the noise
problem will be. A 12' fence could .even aggravate the problem. The mobile park
property has only been given site approval, and has not yet received rezoning.
Vote taken on motion as stated. Motion carried.
Mr. Wingard moved seconded by Mrs. Beal to refer this item back to the Planning Commission.
Councilman Teague said he understood both parties were ~n favor of this action.

4. Taxi Fares, Requested Rate Increas,e - The Manager read a report written by the Director
of Finance and explained that rates of neighboring cities had been compared. Based on
his study, it is recommended that an increase of 10~ on the first 2/5 mile is justified.
Mrs. Hayward moved seconded by Mr. Wingard to grant a rate 'increase for taxi 'service, as
recommended by staff. Motion carried.
I Mr. Wingard moved seconded by Mrs. Beal to approve Item 4 of the Committee report.
Council President Hayward asked if she was correct in her recollection that Councilman Mcponald was
to serve as a committee to investigate taxi rates regarding an increase. City Manager said Mr.
McDonald had worked with Mr. Flogstad, and not only studied rates and reports from other cities,
but had studied financial problems of taxi companies in the Eugene area. Mr. McDonald participated
in the study, and agreed with the recommendation of the Finance Department.

5. Truck Parking in Residential Areas - The staff has been meeting many months to prepare an
ordinance which will accomplish the desired results without creating additional problems.
Points of the ordinance were outlined by the City Manager.

I Councilman Wingard asked if an owner who parked a truck in front of his commercial
I property which was within 200 feet of resident~al property, would be in violation of the
ordinance. The City Attorney said this particula'r' 'problem had not bee'n' disc'usse'd ,and
should probably be considered for change. Mr. Wingard felt the ordinance should be
rewritten so that commercial property owners would be allowed to park trucks in front
of theit property. I

( Mr. A. W. Krieg felt that no truck parking should be allowed in a residential zone, even
on owners prop,erty.
I Mr. Gribskov was concerned that many individuals in the City earn theirU ving' through I
owning a truck, and that they will have to rent space to park at night.
In answer to Councilwoman Hayward's quest ion, the City Attorney said it would be p.ossf.ble
to add trucks to the section of the Zoning Ordinance which prohibits parking of trailers
in the setback.
I Mrs. Hayward moved seconded by Mr. Wingard to set a public hearing on this ordinance, as
~ 'I amended, to correct the problem relating to parking in front of commercial property.

Mr. Tony Kalez, 260 Cherry Drive, asked whether campers and trailers were to be included in t~is I
Ordinance. The ordinance was read, and Mrs. Hayward explained that citizens in the community who were
concerned about parking of trucks in residential areas had urged adoption of this ordinance. She
explained that campers and trailers are regulated by the Zoning Ordinance, and the proposed ordinance
applies to trucks over 6000 pounds. The Planning Director explained that parking is prohibited in
front yard? for any period over 48 hours. Mr. Kalez was concerned about the economic hardship on
small business operators.
Mr. Austin petersen,2228 Olive, owner of Austin Pl~mbing, objected to the wording of the ordinance,
s?~ing he had two identical looking trucks, but one weighed twice as much as the other. He felt
weight was not a proper criteria. The City Attorney'explained that the intent was to use state
law criteria as definition of a truck. Mr. Peterson explained he does business from his home, and one
truck is outfitted to care for emergency calls.
Councilman Wingard suggested a variance, procedure to be used in conjunction with the law. The
Attorney said it would be better tOl'ewrite the .law, ~and to relax requirements as to size and
weight.

as suggested at this he aring.
Mr. Wingard suggested that single axles could be used as definition of allowable trucks. Attorney
said criteria would be studied.

6. Air Pollution - Mayor Anderson asked to interrupt the meeting to read an AP release just
received from Governor McCall. The Governor has ordered the State Environmental Quality
Commission to meet in Eugene tonight and act on field burning problem to rectify the field
burning situation, which is untenable both for citizens of the Willamette Valley 'and the
Agricultural Industry. All burning was banned until after the Commission meeting. The
Commission has authority to prevent air pollution in the valley, and has been asked to
ban all field burning for seven days, except burning with propane gas, when combustion is
complete. He recommended the Commission review and strengthen burning schedules to
prevent future burning in the area, and called on all law officers to cooperate with the
Commission to carry out the Governor" s orders.

The Mayor commented that this was certainly a step in the right direction, and appreciation
should be expressed to the Governor for his willingness to assist the City, and to the
people in the community, whose support accomplished this. The Mayor requested the Council
to attend the Environmental Quality Commission meeting.
Mr. Wingard moved seconded by Mr. Gribskov to receive and file Item 6 of the Committee report.
Motion carried.
7. Administrative Decisions re: Traffic Control - An brdinance was previously distribut~d
which would increase tqe duties of the City Manager regarding traffic control, in an
effort to relieve the Council of making decisions on minor traffic control matters. Mayor I
Anderson said he strongly supported this ordinance, and felt it was a significant step ,
toward better administration, and would lessen the work of the Council.
Mrs. Hayward moved seconded by Mr. Wingard to support the Traffic Administration Ordinance.
Motion carried.
I Mr. Wingard moved seconded by Mrs. Beal to approve Item 7 of the Committee report. Motion carried.
8. ' Issuance of Parking Citations - This Ordinance would allow issuance of parking citations -
without requiring a formal complaint by: the issuer. The City'Attorney said this is
presently covered by State law, but it is appropriate for the City to have an ordinance
with the same provision. u

Mrs. Hayward moved seconded by Mr. Gribskov to approve the ordinance on issuance of
parking citations. Motion carried.
9. Curb Cut Request, 245 Jackson Street - Shell Oil Company has requested an oversize curb

I cut to permit entry of large trucks to their property. The staff recommends approval.
II Mr. Wingard moved seconded by Mrs. Hayward to approve the curb cut requested. Motion
I carried.
Mr.. Wingard moved seconded by Mrs. Beal to approve Items 8 and 9 of the Committee report. Motion carried.

II 10. Skinners Butte Park Boat Landing -,A letter was read from Mr. Robert C. Mention, president
Ii / of Lane County Willamette River Greenway Association, requesting construction of a boat
landing site in the vicinity of the boat storage area near the west end of Skinner's Butte
II Park. The Director of Parks reported that this had l?een planned for the future, but no
money has been budgeted for the project. Grading and cleaning may present a temporary
I solution, but no permanent installation is anticipated at this time.
In answer to Councilwoman Hayward, the Manager said there is no boat landing on the river
except in Springfield. The City Attorney suggested construction of two or three dams in e
tryg river beyond the park, ,for a recreation area. No action taken.

Items not previously discussed.
1. Vacation 36th Avenue - The Manager read the Planning Commission recommendation for approval
of this vacation, subject to conditions. This street serves apartments on both sides,
and the owners felt the street could better serve as parking than for general use. The
Planning Commission agreed it was not needed for through traffic. A public hearing should
be ca lIed, and the staff will work with owners to determine value of the vacated area.
Mr. Wingard moved seconded by Mrs. Beal to uphold the Planning Commission recommendation
regarding vacation of 36th Avenue between West Amazon Drive and Hilyard Street (Suess
and Johnson) and call a public hearing. Motion carried.
2. Reassessment of Park Department Capital Proiects for 1969-70 - Park Department has
requested approval of redistribution of allocated funds for capital improvement projects.
e No increase in expenditure is required, since reassessment of priorities has resulted
in a change in allocation. A list of requested changes has been distributed to the
Council.
Mr. Wingard moved seconded by Mr. Teague to approve changes as outlined in the Park
Department memorandum. Motion carried.

4. Dog Control Ordinance - Amendments have been recommended which would reduce bail from $20.00 I
to $10.00 ,and would provide a dog owner the opportunity for appeal after the release of
the dog.

After discussion, the Council set a public hearing for Wednes~ay, September 10. President
Hayward requested that the staff notify those who had expressed an interest in this law
of the public hearing.
Bid Opening, Public Works Department, August 22, 1969, Urban Renewal Project - The Director of
Public Works said that at a prior bid opening on this project, only one bid was received, which
was 43% over the engineer's estimate. By splitting the bid for paving and sewer the amount was
reduced about $12,000. Staff recommends award of paving to Eugene Sand and Gravel. The City
will participate in paving in the amount of $3,762.50. I
Mr. Wingard moved seconded by Mr. Gribskov that the Council authorize Public Works Department to I
participate in urban renewal paving in the amount of $3,762.50, payment to be made to Eugene Renewal ,
Agency for 10th and Oak Overpark. Rollcall vote. All councilmen present voting aye, motion carried.
I Bid Opening, Parks Department - Parking Lot, Celeste Campbell - The Manager read bids received for
construction of a parking lot and related sidewalks, and recommended the city accept the low bid
in the amount of $22,047.85 submitted by Wildish Construction Co.
Mr. Wingard moved seconded by Mr. Gribskov that the Council accept the bid from Wildish Construction
Co. in the amount of $22,047.85. 'Ro,D~_a;H vote. All councilmen present voting aye, the motion carried.
Waiver of Bidding, contract for storm sewer within Royal Ann Park, award to Lassen Bros. Builders in
- amount of $2,142.30. Public Works Depar~ment recommends award of contract for storm sewer to be
constructed in Royal Ann Park to Lassen Bros. Builders in the amount of R2,142.30.
Mr. Wingard moved seconded by Mr. Gribskov to accept recommendation of Public Works Department regarding,
I waiver of bidding in Royal Ann Park. Rollcall vote. All councilmen present voting aye, motion carried.

I Mrs. Hayward asked for an explanation of the expenditure for the Richards Property. Manager explained
that this property was being purchased by city funds, with a portion allocated from Wi~lamette
Greenway funds and Federal Open Space funds. The property was purchased by the Riverfront
Deyelopment Corporation to hold for the City. Councilwoman B~al felt this was a high price,
but 'the Manager explained this price was in accordance with appraisals, and was agreed to by the City
