Council Chamber I Eugene, Oregon September 8, 1969 Regular meeting of the Common Council of the city of Eugene Oregon - called to order by His Honor Lester E. Anderson at 7:30 p.m. on September 8, 1969 in the Council Chambers, with the following 11 councilmen present: Mrs. Hayward, Messrs. Purdy, McDonald, Wingard and Gribskov. Minutes of the Council meeting held August 11, 1969, as mailed to Council members, were approved. I I COMMITTEE REPORTS I r Committee meeting held September 3, 1969. / "Present: Mayor Anderson; Councilmen Hayward, Purdy, Wingard, Teague, Beal and Gribskov; City Manager and staff; and others. e 1. Appointments - Mayor Anderson recommended that the Council appoint the following to an Advisory Committee on Aging, to assist in decision-making and administration programs for older citizens: Elsie Bloomer, 161 West 21st; Ruth N. Snyder, 610 High Street; Marty Stauffer, ! 661 Sterling Drive; Edna Amidon, 65 West 30th; Edna Gildea, ~76 Tyler; Ruey I~ Thomas, 2271 Birch Lane; George and Florence Gallop, 825 Sprague Avenue; Charles I I Dean, 2785 Sorrel Way; Norman Stone, 930 East 44th; Anna Montgomery, 1006 West 7th; I Catherine Lauris, 1240 Wes t 18th; Dr. Marian Miller, 2904 West 18th; William I I Johnson, 1515 West 2nd; Reverend Emil H. Keis, 1062 Charnel ton. The Mayor recom- I mended that Councilman Teague and LeRoy Owens serve as advisors to the gr~up. I I Mrs. Hayward moved seconded by Mr. Gribskov that the Council approve the appointments I recommended by the Mayor, to the Committee on Aging. Motion carried. Mrs. Hayward moved seconded by Mr. McDonald that Item 1 of the Committee report be approved. Motion carried. 2. Field Burn~ing - Mayor Anderson reported'on a recent meeting wi th seed growers from the Junction City area, which resulted from concern on the part of seed growers concerning misunderstandings which seemed,to be developing. Common problems and objectives were discussed, with a better understanding resulting, and ~ hope for eventual formal contact with the seed growing industry, which may result in a joint effort to reach agreement. This meeting in no way changed the Mayor's position of seeking complete elimination of field burning, and the Council nay be sure its objectives will be observed. Mrs. Hayward moved seconded by Mr. McDonald to receive and file Item 2 of the Committee report. Motion carried. 3. Council Representative, Lane County Air Pollution Authority - Councilwoman Hayward I reminded the Council that State law now entitles the city of Eugene to another repre- sentative on this Board, and nominated Councilwoman Beal to be its second representa- tive on the Lane Air Pollution Authority Board. There were no other nominations, and Mrs. Hayward moved seconded by Mr. Gribskov that the Council cast a unanimous ballot for Mrs.. Beal. Motion carried unanimously. Nrs. Hayward moved seconded by Mr. McDonald to approve Item 3 of the Committee report. Motion carried. 4. Parking, University Area - Councilwoman Beal again commented on difficulty with parking e in the University area during school time, and suggested that persons owning property I could reserve parking space in front of that property, upon p~yment of a fee to the City. Apartment owners could. also rent space in this'manner, to allow more parking for tenants. When asked.to look into this, the City Attorney said he has previous studies. 1 on the subject, and that many cities have paid on-street parking programs. Dr. Purdy I I asked the Attorney to investigate feasibility of this program in the downtown area. I I Councilman Purdy indicated that installation of stop and yield signs in the area between I 12 th and 18th, High and Patterson, have proved very effect~ve, and feels this is a I step toward improved traffic conditions. - Mrs. Hayward moved seconded by Mr. McDonald to receive and place on'iile Item 4 of the Committee . report. Motion carried. 5. Room Tax Allocation - The Committee appointed to suggest to the Council allocat~on of I receipts from the room tax, met and' have presented a recommendation to the Council. Mr. Rube Ross explained that the committee voted to recommend appropriation of $1,000 "- to the Eugene Area Chamber of Commerce for promotion of tourism i~ the City beginning I October.l, 1969. The Committee set September 30, 1969 at 7:00 p.m. for a hearing on I other proposals. Several of the proposals were related, and it is hoped proposals for II a youth activity and cultural program or center will be combined into one comprehensive reques.t. Receipts for July room tax were $8,387.29, which was below the estimate of $9,000. Operators attribute the 'drop to a number of factors, including lack of conven- Ii Ii tions ~nd tourism promotion. Mr. Ross said Mrs. Lauris, who is I on the Committee, had understood funds were to be paid to the Association in a nine month period, starting October 1, at $6,000 per month. The Manager said the initial indication is that there will be sufficient funds to appropriate the $54,000 for the Auditorium Association, plus the Chamber request. Councilman Gribskov felt tourism and conventions should be promoted to bring in revenue; Mrs. Hayward agreed. In answer to Councilwoman Beal, Mr. Ross said there had been some reports tourism had suffered because of the air pollution problem. The City Manager suggested that a contract be drawn between the City and the Chamber providing for kinds of services to be performed by the Chamber of Commerce. If the Council favors this recommendation, the staff could bring the proposed contract and a schedule of disbursement of receipts, which would resolve the question of appro- priation of monies. e Mayor Anderson suggested that the contract should include a requirement for a report from the Chamber as to disbursement of funds, and results of operation. I Mrs. Hayward moved seconded by Mr. Gribskov to accept the recommendation of the City Manager" Motion carried. Mrs. Hayward moved seconded by Mr. McDonald that the contract be drawn between the city of Eugene I and the Chamber of Commerce in the amount of $9,000, and that this contract include a requirement for a repQrt from the Chamber as to disbursement of funds, and results of operation. I II After discussion concerning method of disbursement of funds, both to the Chamber and Auditorium -1 Association a rollcall vote was taken. All councilmen voting aye, the motion carried. 1 i In answer to a query from Mr. McDonald, the Manager .said if insufficient funds are received from the I tax, the City will not be obligated to disburse any. 6. Planning Commission, Increased Membership - State law passed by the 1969 legislature regarding Planning Commission membership necessitates amendment of the city ordinance I -from seven to nine, with a quorum of five. Two of the members may be residents from I outside the City. City Attorney recommended adoption of the amendment, which also deletes the requirement that the Mayor, City Attorney and Director of Public Works be ex officio members of the Planning Commission, and provides instead that no more than II two city officials may be designated as non-voting, ex officio members of the Planning Commission. This would not prohibit other city staff from attending meetings and I participating in discussion. Planning Commission terms are fa~~four years, and are appointed by the Mayor. No action taken. I I 7. Liquor License - Approved by Police Department - Class "A" RMBA, T & T Tavern, 20 Highway 99 North. No action taken. ) Mrs. Hayward moved seconded by Mr. McDonald to approve Item 6 and since there is no opposition, I 11 Item 7 of the Committee report. Mot.:h6n carried. Litv Fire Department. c 11 8. Commendation - A letter was read from Springfield Mayor McCulley I expressing gratitude to Eugene Fire Department for help in combating a large fire in I downtown Springfield, under the mutual aid agreement.- Mrs. Hayward moved seconded by Mr. McDonald to receive and file Item 8 of the Committee report. Motion carried. e 9. Revision of Personnel Policy - Copies of a revised manual of Personnel Policy were submitted with the Agenda to the Council, with items having budgetary implications underlined. Those with double underlining will require Council approval. Personnel Director reviewed the updated manual in detail, and explained proposed I changes and their implications. In answer to a question from Dr. Purdy, Mr. Mil~s I said temporary employes are on an hourly basis, and do not accrue fringe benefits. I Councilman Purdy felt a stric'ter policy should be applied regarding sale of tickets I to merchants. Mayor suggested before any such project initiated, it should be cleared with the City Manager's office. Councilwoman Beal objected to the section requiring . resignation of one party, should two employes of one department marry. She felt this I was discriminating against women. ! 1 I Pat Flynn asked to comment on the proposed manual. He,outlined objections of the -I fire fighters, and the Mayor said those would be discussed at the regular Council meeting. The Employes Assoc. feels this ,matter has not been ~eso1ved, and have requested review. Regarding call backs, Personnel Director quoted figures to show a total of 120 hours callback during an 18 month period for the Fire Department. This is not a major problem. Mr. Dogg':'Post, speaking for the Employe Assoc. said when called in to work overt~me, an employe should at least be informed whether he will be paid in.comp time. or paid overtime. It was felt employes should have a choice in method of payment. Mrs. Hayward moved seconded by Dr. Purgy that the City Manager change the rules to provide for mutual agreeme~t in the matter of payment or comp time for overtime. Employes and supervisor must reach agreement. The Personnel Director explained that budgetary problems sometimes preclude monetary payment for overtime. The Manager said he v;o u1d not object to a procedure to permit agreement between employe and department head if the administration had the final decision regarding manner of payment.' .: Councilman McDonald suggested amount for overtime be budgeted, and if funds are not available, pay- ~ e ment would have to be in manner of compensatory time. ~ Personnel Director said an amount is now budgeted for overtime, and this is the preferred method for payment. When there are no available funds in the budget, comp time must be worked out. Mayor Anderson suggested rewording of Line 5 to say "Payment shall be at the discretion of the employe". I Mrs. Hayward moved seconded by Dr. Purdy to change Line 5 under Overtime to read "Whenever possible, method of payment shall be';at the option of the employe" Motion carried. Overtime for Shift Personnel - Employe Assoc. has requested further review. . Mr. Post said they feel the solution offered is equitable, but unworkable. Person~e1 Director suggested a trial period to see if it will work. Dr. Purdy recommended that a previous quarter be studied to locate inequities. Mrs. Hayward moved seconded by Mr. McDonald' to accept the proposal of the administration regarding I rotating shifts. Motion carried. Callbacks - The Administration recommends continuance of the present policy of guaranteeing a two hour minimum on callbacks. Fire Department requests that two hours be given for call back if no work done, but that those required to work'shou1d be given four hours callback. Mr. Pat Flynn outlined reasons the Fire Department has requested this cfause and justifications for I a change. Mr. Post said the Employe Assoc did not consider this a major issue. The Manager said such a change would probably only have minor financial implications in the Fire Department, but would create major problems in the Public Works Department. Suggested the entire I financial implication be studied. Manager felt two hours paid for callback was sufficient compen- sation. Councilman Wingard suggested that adding a four hour minimum for work clause might cause a supervisor to be more cautious about calling someone in to work. The Manager explained that Public Works has a great many emergency cal1backsfot which 'a supervisor cannot use discretion. Counci 1man McDona 1d was inclined to agree with the four hour worked callback clause. e Mayor Anderson suggested there was a need for more information, and suggested a delay to allow the Personnel Director to bring back information regarding financial implication when applied to all departments and record of hours worked under a particular situation. The Council agreed. The Fire Fighters also requested that overtime be paid, based on a forty hour week, rather than 56 hour week. They felt this would be more in line with overtime pay received by other city employes. Mr. Frank Jackson explained that the Fire Department now ~perates under this policy and requested that the policy. be continued. Mrs. Hayward moved seconded by Dr. Purdy that the Council approve payment for overtime for firemen" to continue on a 40 hour basis. Motion carried. Mr. Post asked that consideration be given to computation of overtime on the basis of an eight hour day rather than a forty-hour week. He felt some inequity might occur if the supervisor insisted an employe take time off at the end of the week worked, which could annul overtime worked. Councilman I Wingard felt the eight hour day could be established, and said this is standard in industry. The City Manager requested a meeting with Mr. Post to attempt to improve'wording so that employes would be protected w~thout nindering administrative discretion. In answer to a query' from Councilman McDonald, the City Attorney said state law provides a 40 hour week, not more than 8 hours in anyone day. e Holidays - Personnel :bire?to~ outlined. holiday. char:ges 'receR~ly insti7uted, and prop~sed holiday additions'. Personnel Director felt, with regard to las~ request, this should be decision of Council, rather than President or Governor. Mayor Anderson felt the City should observe any holiday declared by the President or Governor. The Personnel Director explained his concern with the impact of the City image on the Community, and said he personally objected to any more holidays. Councilwoman Hayward felt the request concerning a floating holiday was reasonable. She moved seconded by Mr. McDonald to approve that request. f The Personnel Director explained that most personnel, after having taken the floating holiday,earlier~ I will want a day during the Christmas season. He also explained that previously this had been an I unscheduled holiday, and if personnel ~ere unable to take advantage of it, they were not reimbursed, I since it was unofficial. Dr. Purdy felt the Hayward motion crea~~~.a real problem, and felt that the administration had I come up with a good suggestion for time off during the holiday season. Mayor Anderson agreed that e this was a convenient time for a holiday. Vote taken on motion as stated. Hayward, Wingard aye; Purdy McDonald Gribskov no. Motion defeated. I Holiday Pay - The .recorrnnendation of staff is for compensation for all hours worked on a holiday I at straight time, in addition to regular salary. Employe group has requested time and one half in addition to regular pay. Firemen request deletion of requirement that employe .must have worked I at least fifteen days prior to holiday to take advantage of holiday, and recorrnnended that temporary employes be eligible for holiday pay, regardless of status. I A short break was taken. I I I Mayor Anderson suggested that a limit be set on discussion of this item, and that it be mntinued f at the Committee meeting, after regularly scheduled agenda. I I Mrs. Hayward moved seconded by Mr..McDonald to accept the recorrnnendation of the City Manager in I the matter of holidays proclaimed by the President or Governor. Motion carried. II Mr. Post explained with regard to recognizing Saturday holidays, that what the employe group is II asking is the same number of holidays each year. If a holiday falls on Saturday, part of personnel il could take Friday, and the other part take Monday, at the discretion of the Supervisor. The City Attorney said that when the State declares a holiday, it applies to the city of Eugene. I I The Manager disagreed, saying the City had already done away with Washington and Lincoln's birthdays. I Mrs. Hayward said she was not yet ready to make a decision with rega}d to Saturday holidays. Mayor said this may be considered later. I I With regard to overtime pay for worked holidays, Mr. Flynn requested that the Fire Department receive compensation on the basis of a 40 hour week rather than 56. Manager asked if any estimate had been made as to increased cost if employes were paid for holidays worked on basis of .time and I one half. Mayor felt the Council should consider the budgetary aspect, and, asked Mr. Mills to II include some data on this. I' Mrs. Hayward moved seconded by Mr. McDonald to accept recorrnnendation of the City Manager with .regard to part time and temporary employes for holiday pay. Motion carried. 'I Mr. Flynn requested the Council to consider the matter of 15 calendar days with regard to holidays paid. Mayor said this would be considered after recei pt of more information. e 11 The discussion was closed until the next corrnnittee meeting. It \1 10. Milk produ2ers Permit Fees - Recommendation has been made to increase city license fees II to be more in line with new State feeB. In answer to Dr. Purdy's question whether this II would not still be lower than the State fee, the Manager said the billing would be fairly comparable at the maximum'/level, but would give a break to small producers. Mrs. Beal moved seconded by Dr. Purdy to accept the recorrnnendation of the City Manager to adjust city fees for milk producers permits. Motion carried. I Mrs. Hayward moved seconded by Mr. McDonald to approve Item 10 of the Corrnnittee repott. Rollca!'l vote. All councilmen present voting aye, motion carried. I 11. Eugene Salvage Company - A number on inquiries have been received concerning the appearance of this operation, and the staff has been requested to determine whether I . any action can be t?ken with regard to improving the appearance. A review of the minutes of the Council and Planning Corrnnission.meetings at the time the facility was established indicate that the location was discussed, in view of the fact people -- , from the area objected, but the property was properly zoned, and the City had no legal basis for refusing a license for the operation. At' that time, there was discussion of screening, and Mr. Siegel expressed a willingness to plant screening trees. Poplars were planted, but have now been topped, and fail to provide proper screening. Mr. Siegel has been .contacted and has installed a new fence, which is attractive, but not high e enough for effective screening. I general appearance of the operation, and has eliminated most of the pollution problem. The location is visually imcompatib1e at that point, but there is no legal recourse for the City. \ Mrs. Hayward moved seconded by Mr. McDonald to receive and file Item 11 of the Committee Report. Motion carried. 12. Care of Park Animals - A petition circulated by Mr. Bill Burwell protested treatment of animals at Skinner's Butte Park. A letter to Mr. Burwe 11 from Assistant Parks Director explained problems of custodial care of animals, and invited petitioners to compare the quality of City care with any other zoo facility. No action was taken. Mrs. Hayward moved seconded by Mr. McDonald to receive and file Item 12 of the Committee report. Motion carried. 13. Abateqlent, 2270 West 18th - A memorandum was read from the Superintendent of Building, outlining condition of buildings and recommendation for Council action. Council e examined the site on tour preceding the meeting. Dr. Purdy moved seconded by Mr. Teague that the Council set a public hearing for abatement proceedings at 2270 West 18th. Motion carried. Mrs. Hayward moved seconded by Mr. McDonald to approve Item 13 of the Committee report. Motion carried. ,. I Bids submitted by Parks Department for sidewalk for Laurel Hill Park - recommended award to R. C. Parsons low bidder for amount of $2,780.00 Mrs. HayWard moved seconded by Mr. Gribskov to accept the low bid of R. C. Parsons for the amount of $2,780.00 for paving of sidewalk for Laurel Hill Park. Rollcall vote. All councilmen present voting aye, motion carried.
