I Councilman Mohr said he had a representation from the International Cooperation Committee requesting
that a United Nations flag be displayed at City Hall on special occasions. In answer to a question
I from Mr. McDonald, Mr. Mohr said the International Cooperation Committee will 'provide the flag. Mayor
I Anderson said this was certainly appropriate, and could be complied with without inclusion in the ---'.1. I
11 Proclamation. He said th~ committee has made excellent plans for observance of this day, and, en-~

e Project Nos. 4, 5, 6 and 7 were rebids of State Street. This was split into four separate projects,
with the Alternate bid a'jchange in design to a lesser depth. The total of four' low bids on the

alternate was $155,764. It is recommended the project be awarded to the' low bidders on alternate

Recommended award .on Projects 8 and 9.
Projects 10, 11 and 12 were split of original bid which had been refused because it was too high;
Total of three bids was $86,154. Recommend award of these three projects.
Projects 13 and 14 Re~ommended award.
Project No. 15 the project contract was awarded to R:C. Parsons previously. Staff asked Council to
terminate because it was determined the project had to be redesigned because of depth of som~ existing
sewer connections. Recommend award new contract to Wildish Const. Co.

On September 17 opening, recommend award to low bidder, Wildish Const. Co., and on September 22

II In answer to a question regarding No. 13, Director of Public Works said there is an agreement the I
Ii project will be assessed to owners in an amount no more than $84,497.02, which covers two projects.
I On Project No. 2, which W.W.Walker objected to, a petition, signed by owners of 52% of the frontage
, to be paved had been presented to the City.

I Mr. Walker objected to paving of the alley, saying he had requested commercial zoning, which had
been refused, and he felt the alley was of no use to him without commercial zoning. The Mayor
I said the matter of zoning a~d paving of the alley were two separa,te, issues. - The',Manager said a com-
mercial building is on the property now, but it is non-conforming.
I Councilman Mohr asked Mr. Walker if he would feel the'paving were more equitable if the property were

. rezoned, and suggested Mr. Walker initiate a request for rezoning.

I! Dr. Purdy reminded the Council that rezoning matters are up to the Planning Commission, and have
il nrhing to do with this issue. Mrs. Hayward said if 52% of the property had petitioned, the Council
I' should certainly go ahead with the project.

I been pr~nted in Albany. He did not think this problem could be solved through vitriolic
letters, economic or other boycotts. We should meet the situation on its merits, not
try to deny freedom of expression. Councilman Mohr drew a parallel between this ordinance
and the Human Rights Ordinance, and felt they should be handled in the same manner. Ml. yor
Anderson did not agree, and felt the administration aspect should be considered. The City
Manager, said the City does its best to deal economically, without consideration of
political position. . Dr. Purdy did not think the Counc i1 should consider this proposal.

Mr. Richard McClintic, representing the U.S. National Bank,
always been a good corporate citizen, and asked to explain that the Bank has had a
standing policy with the newspaper on any non-political public interest issue, that it
be included in a joint ad with merchants of the community. The Bank, was not aware of
this ad until it appeared.
No action was ta~en on this item.

2. Dog Control Ordinance, Amendments - The City Manager outlined problems encountered with
the Dog Control Ordinance, with the. impoundment fee and preservation of a dog owner's
right of appeal to municipal court.
Mrs. Hayward asked how the mun~cipal court establishes bail. Can this bail be changed
I at any time? Assistant City Attorney said some bail schedules concerning state law
are established by the Supreme Court, but he did not think this applied to the Dog
Control Ordinance. The Municipal Judge has the right to estab~ish ,~easonable ~ail.
In answer to Councilman Purdy the Assistant City Attorney said in many instances the
fine has been only $5.00. Mr. McVicker, Manager of the Lane Humane Society, said
at times it is only $2 or $3, with the majority being $5. ,This seems to encourage
repeated offenses. Councilman Purdy felt the $lO.impound fee would be fair. Mrs.
Hayward was concerned about control of dogs, .and wanted to be sure the decrease in
impound fee might,not encourage a decrease in bail: She sll;ggeste,d sOIl\e ',kind of
graduated fee for repeated offende~s. The Assistant City Attorney said this could be
established in a manner similar to driving offenses.
Dr. Purdy moved seconded by Mrs. Hayward that the Council approve the proposed amendments
to the Dog Control Ordinance. . ,
Mr. A.W. Krieg, 3252 Onyx Place, approved of the Ordinance, and said he thought the
amendments would make it more workable.
Mrs. (Otis Wold, 1955 Terresa, said she lives in the Cal Young District, and suggested
that enforcement could be improved in this area. She complained that maDY dogs are
still running loose and coming into her yard. She approved of the Ordinance, and the
amendments proposed.

Mr. Ray was requested to read the ordinance amendments for the information of the audience.
Catherine Peters objected to an impound fee of $20.00 and felt it should be reduced. Blaine
e Ackley.agreed, and said there is general agreement the fee is. too high. He approved of the,amend~
ments. He said he felt dog owners should be contacted when their dogs were picked .up if they were
licensed, and asked if it were true that a percentage of this fee went to reimburse farmers for
damage to livestock from dogs. The Manager said this is State law.
Councilman Wingard said the legislature had tried to pass a bill to allow humans to be reimbursed for
injuries, but this was not passed. It is hoped the law will be changed some day.

Councilwoman Hayward commented that the purpose of the fee is to encourage owners to control their
dogs, rather than to collect the money.
Councilman McDonald was against the, amendments, feeling the 'object of the ordinance was to keep
animals under control, and he felt the higher fee had accomplished some good.

I Virginia Gleaves, Highland Oak Drive, wanted dogs controlled, but felt there should be -some information
available at the Humane Society informing people of their right to be heaid in court. She was informed
that information is available at the -Humane 'Society. :
Mrs. Howard Skj'ei was in favor of the amendments, and felt they recognized both sides of the case.

e 3. Lane Auditorium Association Contract - The Manager read an agreement which has been drawn
to provide conditions under which the Auditorium Association will act for the city of Eugene
~n planning phases of the Auditorium-Convention-Touriocfacility. The Contract has been

.reviewed and approved by the City Attorney and attorney for the Association. I
Councilman Purdy was concerned about the clause concerning monies remaining at com-
pletion of the contract, and felt the contract should be worded to say that monies
- would be paid as received into that fund following that date, and would receive top
priority. City Manager agredd the City might wish to be in a position that, if the
j contract was not completed on time, an exception could be made. . Dr. Purdy was also
I concerned that the convention-tourist group had not been included in the planning, and
the Manager explained that the City would. be representing their interests.

4. Eugene Renewal Area Mall Study - The Director of the Renewal Ag~ncy requested.a meeting
with the Council September 29, 1969 at 7:30 p.m. in the Council Chamber. This was
II agreed upon.

5. Paving Alley, 24th to 25th - A petition signed by owners of 52% of the ~rontage was
presented requesting paving of the alley between Willamette and Portland Streets from
24th Avenue to 25th Avenue.

I handled under Item "Bids". Motion carried.

I, 6. Personnel Policy Discussion - Discussion of holiday pay continued. Mr. Mills outlined

Ii the city position relative to pay for holidays.when an employe has been off work for
11 a three or four week period. A time limit has been proposed in which employes will
!, be eligible for holiday pay.

II Mr. Pat Flyhh explained the Fire Fighters industrial accident clause. For a period of
II six months the injured employe is paid in part by the state, and the remainder of his
'I salary by the City. After six months, the State makes a settlement, and if.the employe
Ii is still not able to work, theCity does not allow him to take sick leave. The Fire
II Fighters feel they should be allowed to take earned sick leave at this time.
Mayor Anderson felt a philosophy needed to be established on sick leave before this
I
discussion could be settled.
Regarding vacations, the Personnel Director outlined administration position relative I
I to vacations, and said the Fire Fighters recommend a change in designation of accrual
I after ten years service. There has been some variation in departments in the method of
I accounting for vacation, and this proposal would eliminate the problem.

I Councilman Gribskov felt for administrative purposes, the policy would have to be
I followed that vacation has to be earned.

j Post.said the employe group is advocating three weeks vacation after seven years

II and four weeks after fifteen years, to be more in line with other city employer ~ -
practices. They feel the trend is to more time off.

1. Committee on Social Goals - Mayor Anderson announced his intention to form a committee
I to study problems and outline to the Council possible courses to follow to reach social I
I goals. Mrs." Hayward will be named chairman of the steer.ing committee.

if 2. Truck Parking Ordinance - Councilwoman Hayward requested that the amended truck parking
!, ordinance be delayed for further Council action until November. Manager said he has not
II yet seen a draft of the amended Ordinance, and that this delay will be' no problem.

II 3. Lions Club Forum - Councilman Purdy. requested the C~ty Council to ~ttend Lion's Club
meeting for question and answer type forum. Council agreed to date of October 29 to
meet with the Lion's Club. e

I 4. Resignation, Sign Appeal Board - Mayor Anderson announced the res~gnation of Richard
Portwood from the Sign Appeal Board, and said he will have an appointment to fill that
vacancy at the next council meeting.
5. Walking Tour, Downtown Agency - Eugene Renewal Agency has invited the Council to Bloin
downtown businessmen and members of the Renewal Agency on a walking tour of the down-
town area on Tuesday, September Z3. They will meet ~t the 10th and Oak parking structure
and will tour spots being developed to get a conception of.the proposal.
Mrs. Hayward moved seconded by Mr. McDonald to receive and file Items 1, Z, 3, 4, and 5 of the

6. Planning Commission Report, September Z, 1969
a. Wester, West side of Jefferson between Clark and West First - Planning Commission
recommended change of zone from R-Z to RG, modifying Mr. Wester's request for
R-3. There was some discussion regarding paving of an alley, and it was the
e general feeling this alley would receive a great dea1 of use and should be paved.
Mrs. Hayward moved seconded by Mr. Teague that the Council uphold the recommendation
of the Planning C~mmission regarding rezoning of property on the west side of
Jefferson between Clark and West First. Motion carried.
b. ' Rexius, northeast corner 8th Avenue and Chambers - Planning Commission recommended
I change of zone from RG to RP, and recommended that a conditional use application
for nursery stock display' and sales be submitted later. The Planning Commission
also modified this request, which was for, C-Z.
Mrs. Hayward moved seconded by Dr. Purdy that the Council approve rezoning of the
Rexius property as recommended by the Planning Commission. Motion carried.
Councilman McDonald commented that he was happy to see this rezoning - that Rexious had
improved the area with their nursery.
c. Hannum Motors, east of Coburg and so~h of Centennial - Planning Commission recommended
rezoning from PL toC-Z. The'County has proposed to vacate a portion of Day Island
I Road lying between Country Club and Centennial. Hannum Motors will purchase the

II property, which is adjacent to their proposed new auto agency. The Planning Commission

Mrs. Hayward moved seconded by Dr. Purdy, to approve rezoning of,the,area east of
Coburg and south of Centennial from PL to C-Z subject to conditions recommended
by the Planning Commission.
There was Council discussion of curb cuts, and concern that traffic should be under
I strict controls. The Planning Director said Lane County Public Wor~s Department and
the City Engineer had been setting up criteria for entrances and exits. There will
I be no new curb cuts on the property being rezoned.
Vote taken on motion as stated and moti~n carried.
Mrs. Hayward moved, seconded by Mr. McDonald that Items 6a, 6b, and 6c of the Committee report be

7. ' Proposed Joint Civic Center Plan - Representatives of Lane Coun~y, State of Oregon,
United States, Eugene Water and Electric Board and the city of Eug~ne agree that there
e is need for coordinating planning of ownerships, land use, traffic handling, parking,
pedestrian facilities, utilities and building locations, and have proposed that the
County apply for a non-interest loan from the Community Facilities Administration for
planning funds. The loan would be repaid by agencies proceeding with construction in
an amount proportional to the total project. Estimated cost is $37,000. Since the
City has completed new construction, it will not be a major partner in repayment of the
loan, but will participate in planning the overall program.
Mrs. Hayward moved seconded by Dr. Purdy that the city participate in the civic center
plan study.
In answer to Councilman Purdy, the City Manager said this area is outside the present
urban renewal area, but there will be close coordination with ERA.
Vote taken on motion as stated. Motion carried.

8. Lane County Deed of Property to City - Lane County pas proposed to deed to the City
Tax Lot 15600, which lie~ between Washington Street and Jefferson Street on the
Amazon Channel. This property may be needed later for development of the Amazon
Parkway. Staff recommends that the Council accept this deed from the County.

District drainage canal runs across the'extreme northeast corner of Mahlon Sweet runway
clear zone. It is not anticipated that this area will ever be utilized, as a new
runway will be constructed in a different location.

'I 13. Personnel Policy Discussion, Continuation - Personnel Director distributed copies of a
I benefit comparison sheet, and explained benefits paid by different companies in the area.

There was Council discussion regarding holidays, and the Council consensus was that
holidays .falling on Sunday would be recognized on the follow.ing Monday, but that those
.1 falling on Saturday would not be recognized. The Council agreed that those working
on Saturday would receive additional compensation for the day worked, and felt
policy modification should be considered. I
I Mr. Flynn felt firemen should pe paid time and a half for working on holidays and proposed
six days off in lieu of four. The employe group has requested the same consideration.
II The Council discussed the rate of pay for holidays worked, and suggested further study
II of this policy. Mayor Anderson said it was not necessary'to compare with the best
'I in industry, but consideration should be given to ,the entire.policy for city employes.
Mr. Flynn said this had been discussed at length with'the PersOnnel 'Director; and ' .
they were requesting an equitable solution to the problem.

l' *Counci1 Bill No. 8992 - Dog Control Ordinance Amendments - Councilman McDonald requested that
II this ordinance be amended to fine second offenders $20.00. He felt if the results were reported, it

Mrs. Hayward explained that the Cpuncil is trying to work out a means of control, and that th is amend-
II ment may not be satisfactory, but it is worth a try. If it is found not effective, then another
amendment could be proposed. Mrs. Hayward requested that records be kept for three months, and reporter e
to the Council so that they could judge the effect of the amendments.
Mr. McDonald felt if the impound fee were kept at $20.00 people might voluntarily keep their dogs under'
I control.

" Councilman Mohr said he was the only Council member to participate in the dog-in last spring, and he
Ir felt that the climate of opinion had changed in the City concerning control -pf dogs. 'The amoun t of
the fine is not important, but enforcement of the ordinance will encourage better control.

Ii Mrs. Hayward said. she shared Mr. McDonald's concern, but felt lowering the impound fee would make it
Ii consistent with bail, and the amount of the fine. Councilwoman Bea1 felt this decrease might ease
j the burden on the court by lessening court appearances.

I Mayor Anderson assured Mr. McDonald that the ordinance co~ld be amend~d if it was found these amend-
