i1 4. On-Street Parking - Councilwoman Beal saidhthe City Attorney had reported on the problem
Ii of reserving on-street parking spaces in congested areas for owners of homes. In I
,I general his response was favorable. Copies were sent to staff, and Mrs. Beal would

I 5. Personnel Policies - SICK LEAVE - The present policy is one day for every month of
I 1
I employment, which is not available for use until employed 90 days. There has been
a limit of 90 days accumulation, and staff is recommending that the maximum be removed
from this. There is a proposal from employe representatives to provide that the City
pay in cash or in some way compensate for a portion of sick leave not used. It is
recommended that sick leave be allowed for sickness of employes and be allowed for
illness of employe immediate family, unless illness of too basic type, or would require
extensive close care. In those cases they are expected to make other arrangements.
Firefighters concur in this.
COMPENSATION FOR SICK LEAVE TIME UNUSED.- Doug Post commented the employe group felt
some type of compensation should be given after a certain length of time with the
I City. Upon termination of at least ten years employment, an employe would receive pay
for 25% of unused sick leave, up to a maximum of thirty days. This would provide a
financial cushion until other work is found. The City has no unemployment compensation
or insurance. This would also provide an incentive to accumulate sick leave, rather
than abuse the privilege.
e Pat Flynn said the Fire Fighters have a proposal, but felt if and when the philosophy
of collective bargaining is accepted, this would be brought up.
I Councilman Gribskov viewed sick leave as a type of insurance. It is nice to have
when needed, but if you don't need it, you don't normally collect.
I Mrs. Hayward felt there was something to be said for the argument that people are more
apt to treat it as a kind of insurance rather than abuse the privilege if they have an
incentive for accumulating it.
Director of Public Works agreed that abuse was a problem in large departments, but did
not understand the reasoning behind ten years. He felt there would still be abuse
until the ten years was up. The staff would vote for some type incentive program.
I Councilman Teague thought of this as a total package Certain people in the City don't
I receive things like this, and the Council is interested in the overall package.
Mr. Flynn suggested that this could be considered payment in lieu of unemployment
insurance.
COMPASSIONATE LEAVE - The City has a policy when a death in immediate family, department
head may grant sufficient time off with pay to make arrangements and attend the funera 1,
up to a maximum' of five calender days, which would not be charged to sick leaye.....The
reasoning is that time required may vary in relation to distance. The Employe 'Assn.
recommends five working days, and that brother-in-law. and sister-in-law be included,
immediate family. ....

Mr. Post said the reasoning was that a person might die at a time when it was necessary
to include a weekend. It was also felt that a brother-in-law or gister-in-law might -

I Mr. Jackson said the Fire Fighters did ask for two shifts. This could account for
six days, and firemen would police own ranks so that six days would not be abused.
Personnel Director said throughout the discussion the concern of the administration
has been voiced. These things are all at the discretion of supervisors and department
heads, who are .paid to carry this responsibility.
e I Public Works Director said it is not the City's policy to carry the entire burden. I
Individuals may still resort to vacation time, or leave without pay, for extreme cases.
Mr. Gribskov moved seconded by Mrs. Hayward to add brother-in-law and sister-in-law
to immed ia te family, under terms of compassionate leave. Motion carried.
WITNESS ON JURY DUTY - Employe Assn. wants deletion of section saying "As a result of
duties with the City". When an employe is subpoenaed as a witness for a reason other I
than city business, the City has no part of it and should not pay his salary.

Councilman Wingard said an employe who is an innocent bystander should be paid for his i
time. The City attorney said compensation for a witness is about $5.24 per day. !

I Mrs. Beal asked about a person accused of a crime. Mr. Jackson said a Fireman is
suspended without pay, if accused of a felony. If exonerated, he is reimbursed for I

There was further Council discussion about.the right of the City to suspend a man I
accused of crime. Mayor Anderson said this should be brought up at a later time.

The Mayor suggested the policy indicate that jury duty is certainly a function to-be I
performed and should be paid for, and that participation in other legal matters should
be paid for, with the sanction of administrative superiors, Mr, Wingard suggested
that the language could be "if called as a witness under circumstances beyond his
contro 1. " Mayor Anderson thought this was a good suggestion.
Mr. Post asked to state that he agreed that the present administration would be fair
and that there were no major problems, but be felt that with a change in administration
this could change, and a written policy would protect employes in that case.
EDUCATIONAL AID - The present policy is to pay 50% of cost of books and tuition for
courses related either to a job employe now has, or may reasonably aspire to, up to
$50 per term, The reasoning behind this limitation is that an employe cannot take
more hours than this and still perform his job satisfactorily. The problem has been
encouraging use of this program.
PAYMENT FOR INDUSTRIAL ACCIDENT OR ILLNESS. An emplo~ injured on the job will receive e
pay from the City in conjunction with Workmen's Compensation, to total his full pay I
i per month, for a period not to exceed six months. This will be authorized each month
. by the Department head. In the seventh month he goes back to what he gets from the
State. The reasoning is that the sick leave program is designed to cover off the
,
job illnesses, and this policy is designed to supplement workmen's compensation in ,
cases of on-job injuries. I
Mr. Flynn felt a man totally disabled from an on-job injury was entitled to use his I
remaining sick leave, after six months. He felt in this instance, use of sick leave
would be humanitarian.
In answer to Mrs. Hayward's question, Mr. Mills said it is not often a person is off
more than three days under workmen's compensation.
Mrs. Hayward said she could understand Mr. Mills point, but she agreed with Mr. Flynn
that it would be humanitarian to allow a disabled person to use sick leave after six
months. Councilm~n Gribskov concurred. Public Works Director said City had this
i policy at onetime.

Councilwoman Hayward felt it should be possible to devise a policy where an employe
could use his accumulated sick leave, without making it too unpalatable to the
administration. She. felt it could be left to the discretion of the City Manager.
Mrs. Hayward moved seconded by Mr. Wingard to approve this policy with the addition
that in special circumstances accrued sick leave may be paid after the sixth month,
at the discretion of the City Manager. Motion carried.
This concluded preliminary study of the Personnel Policy, and Mr. Mills recommended I
a meeting with representatives of employe groups to go over past minutes and attempt
to shape a policy for the Council as a total package.
Mayor Anderson, with concurrence of the Council, directed staff to do this.
I Mr. Flynn asked to discuss a proposal from the fire fighters, regardingacting-in-
I
capacity pay. The policy is after ten shifts a man can receive the higher pay, and -
they feel the limit of ten days should be reduced. The fire fighters also request
consideration of modification or elimination of the fifteen mile residency require-
ment for firemen.
The Council will consider whether or not these items are administrative, and comment
at a later meeting.
No action was taken on this item.
Committee meeting held October 22, 1969:
"Present: Mayor Anderson; Councilman Hayward, McDonald, Wingard, Bea1, Gribskov and Mohr; City
Manager and staff; and others.

1. Police Department, Commendation - Mayor Anderson said an unusual number of letters I
have been received commending members of the Police Department. These cover a wide range
of activities, and indicate that our Police Department is providing a high level of
I service.
2. Willamette Valley Air Quality Conference - Mayor Anderson announced that representatL\les~:
of the grass seed industry, farmers, Oregon Seed Council, city of Eugene and others
will meet November 28 to discuss problems of air quality in the Wi11amette Valley. Mayor
Anderson said he thought this was a significant step toward finding some solution to the
field burning problem, because all interested parties will sit down together on an equal e
footing to share information, suggest solutions and alternatives and work toward having
them implemented.

I Mayor Anderson thanked representatives of the Seed Council for their cooperation in
jointly arranging this conference with the.City.
3. Sub-Committee, Employe Fact Finding Committee - Mr. McDonald reported that the Council,
Sub-committee, appointed last week, has met, and expects to have a report from the original
Fact Finding Committee within the next few weeks.
Mrs. Hayward moved seconded by Mr. McDonald to place Items 1, 2, and 3 on file. Motion carried.
4. Court Action Against City - In answer to Councilman Mohr's request for a report about
a suit filed against the City in regard to a hair cutting incident at City Jail, Assist-
ant City Attorney said an answer will be filed, after.a study of the matter.

~ Councilman Mohr said prior to actually taking action, he felt the Counci1shou1d consider whether
,., to continue or drop this action. Manager said staff has checked into the incident, and adminis-
tration feels the City's position should be one of resisting this law suit. The matter has been
referred to the insurance company for investigation. The staff believes the City is in no position to
drop the case. Mr. Mohr felt this involved a matter of City policy, ,and the Council should participate
to some degree. Councilman Purdy said this was an administrative matter, and the Council should ~.
examine the matter of policy later.
I There was further Council discussion of this matter and the policy involved. Policy discussion will
be scheduled for a later meeting.
Vote taken on motion. Motion carried.
5. Emerald Baseball Park - Councilwoman Hayward reminded the Council that the matter of
billboards at Civic Stadium was .tab1ed, and she thought the Council should take some
action. ~r. Ray said a meeting has been scheduled with interested persons to talk
over all neighborhood problems regarding operation of the baseball park.
Mrs. Hayward moved seconded by Mr. McDonald to receive and file Item 5 of the Committee report. Motion
carried.
Mr. Ray said School Board representatives and representatives of Emerald Baseball and residents
of the neighborhood will be meeting Wednesday, October 27 at 4:00 in the Manager's .Conference Room.
6. Treatment of Jail Prisoners - Councilwoman Hayward said she had received a staff report
regarding a recent complaint of inhumane treatment of a prisoner at city jail. She
suggested the Council explore the procedures used in ,the City..County Jail, and asked
for a staff report. Manager said he would provide Council members with copies of rules
and regulations for operation of the:jail, which might .provide an insight into i.ts
operation. In answer to Mr. Mohr, Manager said the County also operates under these rules.

7. New City Automobiles, Anti-pollution - Councilman Wingard suggested that the City consider ~~
including anti-pollution devices on bids for new City vehicles.

In answer to Councilman Wingard, Manager said Purchasing Agent has been.instructed to investigate the

8. Walk for Development - Mary Beth Hinds reported tnat last wintets' "Walk for Development" in
Eugene resulted in a $22,000 scholarship fund for local Aid to Dependent Children mothers
to attend Lane Community College. Mr. Leonard Wolf said:Mayor Anderson was the only Mayor
in the country to endorse such a walk before it occurred, and had probably inspired many
such walks across the country. Mayor Anderson thanked the participants and 'offered his
resources for any further effort.
Mrs. Hayward moved seconded by Mr. McDonald to receive and file Item 8 of the Committee report. Motion
carried. ~
9. League Convention, Labor Council Objection - A letter was read from Lane County Labor Council
I requesting that the Convention be moved.to a union hotel, and if this was not 'possible,
to refrain from attending'. Manager explained. that these' conventions are set up a year
or two in advance, arid it isdmpossib1e to.anticipate:all problems.
Mrs. Hayward moved seconded by Mr. McDonald to receive and file Item 9 of the Committee repo~t.
Manager explained a communication sent by the League of Oregon Cities was from the attorney for the
Hilton Hotel, and that the dispute was apparently between employes of the Hotel arid the union, because
employes voted not be be represented by the union. Manager contacted National Labor Relations
a Board representative who handled the matter, and he reported when election held; employes voted not
.. to be represented by the union, and that unfair labor practice charges. filed against the hotel were
I unfounded, 'except one, which was corr:ected.. Management is in no way involved in the present dispute.

10. Report, Solid Waste Pick Up - A letter was read from Wallace A. Swanson, President of
Eugene:Garbage Board, requesting that the Council give publicity to the fact that the ban
on open burning will not be lifted, and that tne City is not going to provide free'
pick-up. Garbage haulers have offered to help with the problem by picking up such
refuse if it is containerized and placed in a designated location.
Councilman Mohr agreed with Mr. Swanson, but said the Council has not resolved 'on whether
the City will or will not pay for this pick-up. The Council gave no warning that this
ban would be imposed, and may have placed a substantial burden on residents.
In answer to Mrs. Hayward's question, Mr. Swanson said the least expensive way to handle
pickup would be to containerize leaves and branches and place where garbage hauler des- e
ignated. Charges on additional pickups will be minimum.
Mrs. Beal expressed doubts of ability of some residents to pay for such garbage service.
Some on social security have no garbage pickup at all. Mr. Swanson said some garbage
haulers do not charge those on social security for pickup.
In answer to a question from Mrs. Wilmot, the Manager said when a great accumulation of I
leaves and weeds occurs on a residents property, and a complaint is received, the rodent
control officer contacts the property owner and makes arrangements for him to take care
of the problem.
II. Teleprompter Rate Increase - Dr. Purdy has called a meeting November 3 at 7:30 p.m. in
the Council Chamber to allow the committee to consider information regarding ~ proposed rate
increase for teleprompter. This is a public hearing, which will be conducted by a three-
man Council committee.
Mrs. Hayward moved seconded by Mr. McDonald to receive and file Items 10 and 11 of the Committee
report. Motion carried.
Dr. Purdytreported that the committee had met with service repairment and would meet at noon,
October 30 at the Eugene Hotel with the Cable Company and their attorney to go over franchises and
hear their comments. On Saturday morning the committee, representatives of the Cable Company and
service representatives will tour facilities with a TV set to check reception. Dr. Purdy invited
council members to join the committee for this tour. . - ' "-
II Mayor Anderson commended the committee for its approach to this matter.
I 12. Appeal from Conditional Use Permit - Sanitary landfill located north of Beltline Road
between Willamette River on west and Delta Highway on east;Ellis Jones - Council will
call a ,public hearing,~ol"o..November 10, 1969 to hear this matter.

Hall Council Chambers to hear to objection to conditional use for sanitary landfill located north
of Bel tline Road between Willamette River on west and DeltaHigh~~y on ~ast by ~!-_lis ;rones.,
In answer to concern expressed by Dr. Purdy, Manager said Mr. Jones is primar~ly concerned about
, seepage ,into Willamette River from any site along the river.

I 13. Condenmation, Storm Sewer Easement, P~erce-Dart - This is a request for the City to proceed
with a condemnation action for right of way for a storm drainage channel along the Belt
I Line Road. Present plans call for open construction of a ditch approximately 55 ~eet
wide and 12 feet deep. Property owners request installation of ..tile, ~ather th8:n an
I open ditch. This is part of an SCS project, and city would bear an estimated cost of
II $45,000 for tiling this portion.
Public Works Director showed map illustrating present and proposed project, and explained
i' present plans.
Mr. Paul Lansdowne requested a clear plan, and that tiling be done, at least adjacent to
his house. He wanted assurance that agreement to this portion of the project would not
jeopardize his claim for damages and right of way costs in the future.

Mrs. Hayward moved seconded by_Mr. Gtibskov that the City administration be, authorized to I
file a condemnation procedure on Pierce-Dart for right of way required to the Lansdowne
property for that portion needed to take the ditch to the existing north-south drainage,
and that the Lansdowne condemnation not be filed in the event the City can work out a
mutually agreeable contractual agreement to get entry to that point, prior to having to
get on the land.
Motion carried.
Mrs. Hayward moved seconded by Mr. McDonald that the citYredministration be authorized to file e
condemnation procedure on Pierce-Dart for right of way required to the Lansdowne property for the
portion needed to take the ditch to the north south drainage,. Motion carried.

I Mr. Al Pierce, 2515 Terrace View, explained that the ditch in question was 12 feet deep. by 52 feet
wide, and that he had thirteen lots facing the proposed location. He felt this construction would
devalue these lots $1,000 ,each.
City Manager explained .that the requested right of way is only a small portion of this length. Mr.
Pierce agreed that the City was only taking 400 feet of land, but he would have about 1,000 feet
against the ditch. Manager said Pierce property wou~d be in same position as property along West
Belt Line and property backing up against Amazon Ditch. If the City cannot negotiate to obtain
Pierce proper~yy,it will have to be settled in court. Staff is in no position to negotiate damage
question.
Mrs. Karen Lansdowne said she had signed an agreement, and at the time of signing had been told a letter
would be presented to the Council, along with the agreement. She said the City will betaking some
of her property for this first phase"- a strip 32 feet wide.
City Manager read a letter from Mrs. Lansdowne, and explained that the motion had to do only with
filing of. condemnation, which would no longer be necessary on her property, in view of the document
e agreed to that day. Mrs. Lansdowne's letter requested that the City review its policy'~nd further
provide adequate planting or screening adjacent to the channel in all construction.
Mr. Paul Lansdowne explained the properties in question, and that the one presently under discussion
belonged to his wife. His name should not be included.
Manager said question of screening will be put on future committee agenda, with a tour preceding.

Planning Commission Report, October 7, 1969:
1. Amendment to Zoning Ordinance, Section 11.02 - having to do with sale of alcoholic beverages in
restaurants in C-l District - Manager explained that, at the present time, grocery stores in C-l
District are permitted to sell package beer, but a restaurant in the same district is not permitted
this pr i vilege. Planning Commission recommended deletion of word "not" from description of restaurant
as permit~ed in C-l Zone.
Mrs. Hayward moved seconded by Mr. McDonald t~ approve the recommendation of the Planning Commission in
regard to amendment of the zoning ordinance with regard to sale of alcoholic beverages in restaurants
in C-l District. . -. . . .
Councilman Wingard asked City Manager if C-l Zone was not Neighborhood Commercia1 and asked how many
sandwiches had to be sold to be considered a restaurant. He felt this should be kept a conditional
use, as he did not approve of taverns in residential districts. Planning Director. said tavern,
lounges and bars are specifically mentioned in other zones and would not be permitted in a C-l Zone.
Mrs. Hayward indicated that OLCC has control over this, and what Planning Commission is really
trying to do is eliminate inconsistency in zoning ordinance.

I ,2. Zone Changes recommended for approval:
I a. Pohll, O'Connor, Melevin, .Lyman, Coleman, Allen and .Lee - located east.side of Portland
Street between 29th Avenue and 30th Avenue. Recommended change from RA to RG-PD for
I apartments. Planning Commission recommended installation of traffic diverter because
of increased traffic. Approved only 20 units.
This request has been held several months pending. resolution of several problems, including
e increased traffic. The commercial activity at the intersection of 29th and Willamette
has made resid'ential development less desirable. Traffic Engineer recommended installation
of traffic barrier to prohibit north and south movement of traffic on Portland Street
between 29th Avenue and 29th Place. Planning Commission recommended RG , . PD wi th
control over number of apartments to be built... The Council should hold a public
hearing to allow residents to express sentiment over construction of cuI de sac.
Councilman Teague felt parking should be eliminated on Portland Street.,
Mr. Arthur Ruhndorf, representing. Cascade Manor, felt Portland Street was..too narrow,
and complained that no effort had been made to remove.parking. Dr. Purdy pointed out
that there is an existing problem of parking and sight obstruction created by Cascade
Manor.
Mr. Wally Swanson, l40.Coachman Drive, said many traffic problems were created by persons
I avoiding congestion at 29th and Willamette by traveling Portland Street as. far as Crest
.Drive. He felt the problem would be further aggravated hyclosing off.Port.land Street
to through traffic. Mr. Porter explained that a by-pass is planned for . this' inter-
section in the future. - . .,
Mr. Dave Mobley, 331 Portland Street, felt any more traffic would be hazardous to
residents and children. He was inagreement.with suggestion of ~ traffic barrier.

Mrs. Hayward was concerned that the diverter should be approved before allowing a
I zone change. Planning Director explained the.Council action required. Approve the
diverter, which was needed even without a zone change; classify area between Cascade
Manor and 30th RG under Planned Unit Development; rezone applicants requested area
on the east side of Portland Street.
Mrs. Hayward moved seconded by Mr. McDonald that the City proceed with the public hearing
to vacate necessary portions of Portland Street and accept necessary dedications for
a cuI de sac. Motion carried. -
Mrs. Hayward felt the other actions should be held over to permit ~ore study at a
committee meeting. Councilman Wingard said the applicants had been put off several
months, and the Council should proceed to act on the request for rezoning.
Mr. Douglas Melevin explained that rezoning had been applied for several months ago, e
and any more delay will make construction difficult. He realized there was a traffic
problem, but felt the zoning request was reasonable.
Mrs. Hayward still favored holding action on the rezoning until a public hearing was
held on the matter of a traffic diverter. Mayor Anderson recommended that a tour of
the area be scheduled.
No action was taken. These items will be scheduled for Committee meeting of November 12. I

b. McKay Investment Company - RA to RP-PD on Tax Lots 2004, 2005 and 2006 and from R-l to
R-2 PD on Tax Lots 2007, 2000, 5800, and 5900~ Planning Commission denied requested
C-2 zoning, but recommended RP-PD to allow garden center under conditional use permit.
Hold final reading until final PD approval given. Located east sideof.City- View
Street between West 11th and West 13th.
Planning Commission recommended RP-PD rezoning of area north of Amazon Parkway and R-2
for that portion south of Amazon Parkway.
I Mrs; HaYward moved' seconded by Mr. McDonald to approve the recommendation of the Planning
>,c Commiss10n to rezone McKay property RP-PD to allow a garden center facility under a
Conditional Use Permit, and R-2 on the remainder.
Mr. Douglas McKay said they would go along with the R-2 zoning south of the Amazon,.
but they had appli~d for C-2 north of the Amazon. They agreed to the lesserRP
classification, but did not believe that the PD suffix wa~ necessary in this case.
He felt the Planning Commission lacked confidence in their own ordinance.
Planning Director said they hoped to maintain good appearance along the parkway,
and because of the critical traffic situation, PD controls were necessary.3

3. Rezoning of Newly Annexed Areas - (heard also at meeting of October 13, 1969) - located
north of Beltline Road between Willamette River on west and Delta Highway on east.
Planning Commission recommended rezoning to AG for Hewitt and James properties. (Tax
