Mrs. Beal, Mr. Gribskov and Mr. Mohr. Councilman Wingard had resigned.
I Council President Hayward announced that the Council had, in executive session before this meeting,
I elected Mr. Tom R. Williams to fill the Council position being vacated by George Wingard; Ward 2,
II for the term ending January, 1971. Mr. Williams will be sworn in later in the evening.

Mrs. Hayward announced that Dean Ray, University of Oregon School of Journalism class was present.

I An appeal was filed by Mr. Ellis C. Jones. A letter was read from Mr. Jones, outlining reasons
II for appea l. Information has been supplied to the Council by the Planning Department, including .

II Mr. Ellis Jones explained his appeal had been based on two things - zpning procedure and pollution.
II ~ince the property has been rezoned, he now bases his appeal on the matter of poliliution. Mr~. ~nes

il ~xplained the threat of pollution in the Willamette River, especially during periods of flood.
" He felt the applicant should receive approval from the State Department of Environmental Quality.

11 explained that his residence was close to this site,
Ii Mr. Gordon Corum, 200 Green Acres Road, and

II that this area was all under water during the flood of 1964. He felt this was an improper site
Ii
II for a landfill operation, and that pollution would result.
II Mr. Marvin Knutson, developer in the area, objected to this use, saying it would be detrimental
II to his development because his buildings overlook the area, and it would be an ey~sore.
II Mr. Robert Elfers, assistant to the Board of County Commissioners, explained that they were
discussing only a 38 acre site at this hearing, and that plans have been drawn for a park on this
I site when filling is completed. This should occur within six months or one year. He explained
methods of compaction and precautions taken to insure pollution will not occur. Test drillings
II a're being taken now on three proposed sites in this area. Mr. Elfers explained that permits,
as such, are not provided by the State Department of Environmental Quality, but that they "watchdog" ,
11 the site, and will not allow filling if there are pollution problems.

" In answer to Councilman Mohr, Mr. Elfers said with normal commercial haulage this area could be

I filled in six months. He said the County has absolute control over septic tank dumpage in
I sanitary land fill. Lane County Health Officer does not allow it. This could be a condition of I I
! the City permit for use. As far as flooding is concerned, the State Sanitary Authority has
, control over this, and will not allow operation within a certain distance of the river.

Mrs. Jones commented on the area to be filled, saying tha t, to them it was a thing of beauty as I

Dr. Purdy said this will be a beautiful park with lakes and streams. The Council could not vote
II for the landfill unless these future plans were to be carried out. In answer to Dr. Purdy's -'
question, Mr. Attig, County Director of Public Works, said there are certain phases of park I
'I development which could be implemented immediately upon completion of the sanitary landfill. "'-

II Overall development is dependent upon availability of funds. Trees cannot be planted until
I decomposition has taken place.
I Councilman Mohr recorrnnended tabling this item until the Council can view the site. Councilman
I
I Teague agreed. Mrs. Beal requested that a representative from the Department of Environmental
'I Quality to discuss possible problems of pollution.
II Mr. Cliff Everett said it was his understanding only industrial waste would be dumped at this I
I
site. Mr. Elfers said this would be for commercial haulers and only dry waste would be put in
I the area below any existing water table, with domestic waste above that. Mr. Everett was
I concerned about the soil composition, and whether seepage might occur.

I COMMITTEE REPORT
Committee meeting held November 5, 1969:
"Present: Mayor Anderson; Councilmen Hayward, McDonald, Purdy, Wingard, Te~gue, Beal,
Gribskov and Mohr; City Manager and staff; and others.

1. Resolution,_Government Defense Expenditures - Ma'yor Anderson read a letter froni Wendy
Ray suggesting that the Council forward a resolution outlining the Council position
questioning government defense expenditures, especially related to supersonic transport
aircraft, and indicating the higher priority to solve urban problems.

Dr. Purdy felt it would be well to forward a general resolution reaffirming the Council
position regarding defense expenditures, but he did not feel it wise to enumerate
particular expenditures.
Mrs. Hayward said if the Council had strong feelings about a particular appropriation,
they were obligated to express these views and pass a specific resolution.
I Mayor Anderson suggested a preamble in the resolution, citing previous Councit position.
Vote taken on motion. Motion carried with Dr. Purdy voting 1).0.
Mr. McDonald moved seconded by Dr. Purdy to approve Item l,of the Committee report.
Mr. Ray read the resolution. Dr. Purdy reaffirmed his previous stand, saying he did not feel
the Council should specify a particular project and amount, because he did not feel they were expert
on the subject.
Mr. Williams made two points - one, that the initial part of the resolution dealing with defense
expenditures did not relate to the SST, and that over $600,000.00 has already been invested in the
SST, and over 300 aircraft will be sold for use over the ocean. Mr. Williams felt this investment
should not be thrown away, and that sale of the aircraft would insure "re covery of, funds.
Mr. Mohr explained that this res?lution dealt with emphasis on establishing national priorities.
The intent of the Council was to reemphasize political and social values as preminent in its

There was further discussion regarding .economic aspects of the resolution. Vote was taken on motion.
Mohr, Teague, Beal and Hayward voted in favor; Williams, McDonald, Gribskov and Purdy voted no.
President Hayward declared a tie vote.

3. Environmental Commission Meeting, Film - Mrs. Hayward commented that a film made especially
for the Environmental Quality meeting by Mr. McHarg, would be shown at 4:00 p.m. that
- day on the University campus. Mrs. Beal said she had planned to make a report on the
Environmeqtal Quality meeting, but due to press of other Council business, she would

4. Legal Council for Indigent Defendants - Mr. Mohr requested a report from the staff on
implementation by the City of the recent Supreme Court aecision regarding assistance
for indigent defendants; Manager has:met with Municipal Judge Bocci,and,the City will
provide such assistance. Manager authorized the Municipal Judge to attempt to establish
eligibility for this assistance. Councilman Mohr felt this was an excellent attitude.

1 5. Committee on Aged - Councilman Teague reported that this committee had met recently and
I have suggested representation on the Social Goals Committee to eliminate possible dup-
lication of efforts. , ' ,
6. Teleprompter Rate Increase - Dr. Purdy reported that his committee will submit a report
and recommendation at the ,meeting of November 19. " ,
I I 7. School District Property, Parkway - Dr. Purdy was concerned that the warehouse property ,
I
owned by the School District was being improved, and that the City might wish to purchase
this .property for, inprovement of Amazon 'Parkway. The Manager explained that all
property needed has been acquired, and that this property will form an island between
lanes. There will be access provided.
8. Contractor's Negligence Hauling Dirt - Dr. Purdy wondered if, through permit, there could

tractor, he is billed for cost of cleaning, requesting exeEcise of care in working I
unimproved sites. Manager will report on effectiveness of billing procedure.
Mr. McDonald moved seconded by Dr. Purdy to receive and file Items 2, 3 , 4, 5, 6~ 7, and 8 of

the Committee report. Motion carried.
9. Resignation, Tax Allocation Committee - Mayor Anderson announced the resignation of Mrs.
Allie Jacobson, who served as chairman-'of the :Rpom Tax Allocation Commi.tte.e.. Mrs.
Jacog;son, as chairman of this Committee, was most helpful in getting it organized.
Mr. McDonald moved seconded by Dr. Purdy to receive and file Item 9 of the Committee report and
I accept Mrs. Jacobson's resignation. Motion carried.
II 10. College Crest Annexation - Oregon State Board of Health found College Crest area to be
I: a health hazard, and that this condition could be corrected through annexation to the
!I cllity of Eugene. The finding.was appealed, and the Board of Health affirmed-its previous
action, and certified its decision October 8, 1969. The city is concerned with the e
II problem because the area drains into the City. Resistance centers around hope of a
Ii metropolitan sewer district, which could provide the needed system. In view of the san-
i itary situation, and speculative nature of a metropolitan system, it seems prudent to
I proceed with annexation and sewer construction.
Manager said it is his understanding the goup opposing annexation will not appeal Board
decision to court, but will request a Council delay, hoping county service can be pro- I
vided. Physical problems of metropolitan sewer service structur~ are being studied by
Central Lane Planning Council, but it is estimated such a aystem could not be implemented
I' for at least two years.
I Mrs. Hayward moved seconded by Mr: McDonald to direct administration to prepare an
, ordinance for annexation of this area, to be prepared November 24, 1969.

II Mr. Charles Endicott, 450 Horizon Road, said residents of College Crest area recognize
there is a sanitation problem, but feel annexation so close to completion of Gentral
Lane study is "jumping the gun." They feel a six month delay to enable them to exhaust
I all possibilities wOuld create ,a better feeling toward annexation.
In answer to Councilwoman Hayward's question, Mr. Endicott said a recommendation made

II about a year ago by a committee appointed by the County to study the problems;"in the area
made clear that Lane County will never be in the sewer business. This attitude appears
to have relaxed recently.
Dr. Purdy asked what solution the residents could have, if given a six month extension.
Mr. Endicott said a logical solution would be to tie into city lines through contract
or some similar arrangement.

Assistant Public Works Director explained that the area is broken into three districts
for sewer construction. Some time will be required to obtain easements, and work I
I, should be started on this now, to enable start of construction in t~e spring.

In answer to Mr. Mohr's concern about avenues still'"open to. ;residen):_s.,. Mr. _ D;:lVis of
County Sanitarian's office explained steps in health hazard annexation, and that the
thirty day period for court appeal is about to expire.

I Mrs. Hayward asked the staff to report the implications of a delay until March 1.
II Mayor Anderson pointed out that studies do not necessarily mean solutions. He could --

not see what could be accomplished by delay. Mrs. Hayward felttthe delay might actually
II be harmful.

Dr. Purdy was concerned about community relations in this type annexation. Mayor
II Anderson suggested if the Council had reservations, staff might review with 'them
I the status of sewer planning in this area. Manager suggested it might be feasible
to inquire into the attitude of the County Commissioners concerning the County getting
I into the sewer business. He pointed out that the question is how long the city can
permit residents to suffer from the condition of drainage of material into, the. City.

I Mr. Endicott could not answer Councilman Teague as to whether he would have anything
I
I definite to offer in the next thirty days.

Planning Direc~or pointed out that .the Planning Commission reviewed this annexation, I
and felt that fire service, police protection and parks were needed, in addition to
I sewers, in this area. -

After further discussion, Mayor Anderson said there will be a public hearing when the
ordinance is prepared.

annexing the area, leaving very little choice whether or not to proceed with annexation.
Vote taken on motion to approve. Motion carried.
11. Petition, Sanitary Sewer -Located on McKinley Street, south of Roosevelt Boulevard.
, Signed,by owners of 35% of property to be assessed. Manager explained that sewers
I are needed in this area, and staff recommends proceed, at least to bidding and
public hearing stage.
Mr. Wingard moved seconded by Mrs. Hayward to approve petition for sanitary sewer on
McKinley Street, south of Roosevelt Boulevard. Motion carried.
Mr. McDonald moved seconded by Dr. Purdy to approve Item 11 of the Committee report. Motion carried.
12. Announcements - Manager announced that State Board of Aeronautics contributed $50,000
e to Mahlon Sweet Airport Repair,; PUC denied Southern Pacific petition to reduce passenger
train service; HUD recertified City Workable Program for Community Improvement until
I October 1, 1971.
Mr. McDonald moved seconded by Dr. 'Purdy to receive and file Item 12 of the Committee report.
Motion carried.
I Items not Previously Discussed
1. City acquisition of property -
a. Concord Street Right of Way - This is a small portion of Concord Street which can
be obtained from the Federal government for $100. The property is needed for proposed
,right of way for future development. Staff recommends approval.
Mr. McDonald moved seconded by Dr. Purdy to approve resolution to authorize City
Manager to represent the City to acquire that portion of Concord Street right of
way from Federal Government for $100. Rollcall vote. All councilmen present voting
aye, motion carried. .
b. Lane County, Lorane Highway and 29th at Washington
c. Lane County, Small Portion Elk Avenue
Lane County will relinquish interest in tax delinquent properties. On Lorane
Highway site the City has a lien for improvements. The other piece is a small
portion of property northeast of Elk Avenue already used for street right of way.
Staff recommends acceptance.
Mr. McDonald moved seconded by Dr. Purdy that the Council accept properties outlined
in items lb and lc above. Motion carried. I
2. Authorization to apply for Federal Government for TOPICS funds
a. Roosevelt Boulevard at Highway 99
I b. Prairie Road at Highway 99
This new federal program (TOPICS) is designed to improve traffic flow and safety
on existing streets. The City and State each pay 20% and the Federal government
pays 60%.
I Traffic Engineer explained that at Roos~velt Bo~levard intersection will be improved.
I This should improve traffic flow at this intersection. Signalization would be added
- at Prairie Road and improved at Roosevelt.

Mr. McDonald moved seconded by Dr. Purdy to authorize staff to apply for 'federal
TOF.ICS funds. Motion carried.
3. EWEB Electric Easement - Reiliease of easement for EWEB at 18th and Mohawk in Springfield
because property no longer needs easement for construction.onRecommend authorization to
approve release.
Mr. McDona ld moved seconded by Dr. Purdy to give approval for release of EWEB Electric
easement at 18th and Mohawk. Motion carried.
4. Personnel Policy, Set Discussion - Personnel Officer has dtstributed copies of memo
outlining final areas of disagreement between city administration and employes association.
Would like date set for discussion, perhaps a special meeting to allow sufficient time.
I Mrs. Beal felt discussion of personnel policies should be deferred until a report had
been received from the Fact Finding Committee. Manager explained personnel rules
and regulations apply to all employes, whether represented by union or not. Probably
only 1/3 of employes belong to unions at this time, and have not asked for collective
bargaining. Personnel rules and regulations are required in any case.
Mr. McDonald pointed out that the fact finding committee was just what the name implied,
and Council would still have to study findings.

5. Laurel Hill Petition - Manager said 293 citizens of Laurel Hill area had submitted a pet-
ition asking that, other than single family residential' units, all future development
be de1ayeo until more planning can be done on total development of neighborhood plan.
Petition was result of area concern about proposal for 92-Unit..P1qI).neQ .Deve~Qpment .for
rental p~rposes' on Augusta Street. . This will be put on committee' agenda, and residents
notified of hearing. In reply fo Dr. Purdy, Manager said they will get complete report,
including entire legal procedure, bef9re bringing to committee.

Mr. McDonald moved seconded by Dr. Purdy to ap~rove all licenses, including that 'for change
I of ownership, with the exception hf application of the Golden Canary Tavern, 2000 West 11th.
Mr. Bud Nixon asked upon what grounds this recommendation was based. Manager read a brief
report from the Police Department and Acting Chief Smith, which outlined the number of calls
received from this tavern, nature of incidents, lack of cooperation and poor attitude on
the part of the owners.
Mr. Nixon felt there was a great deal of generalization in these charges, and asked for more
explicit explanation. He explained that he no longer calls the Police Department but makes
citizens arrests and presses charges against violators.
Acting Chief Smith said a disproportionate number of complaints have been made against this
tavern, including gambling on the premises, mmnors on the premises, and most recently,
complaints from patrons regarding video shows described as pornographic. Mr. Nixon denied
that his shows were pornographic.
After further discussion about previous activities of this tavern, City Attorney requested
time to check out charges made by Mr. Nixon. Councilwoman Hayward requeste,d Police
Department to furnish information regarding complaints received regarding other taverns in
City.
City Manager said Council endorsement indicates that Council feels the operation is acceptable
in the city of Eugene.
I Mrs. Beal moved seconded by Mr. Mohr to amend the motion to table section dealing with Golden
I Canary TalTern. Motion failed.
Mr. Mohr asked what the implication would be of a "no" vote on the motion as it now stands, and I
felt this should be separated into two separate issues.
Mr. McDonald seronded by Dr. Purdy changed the motion" to ~~Q,le that part of the motion having

e one for change of ownership, and table application of Golden Canary Tavern, 2000 West 11th.
