Adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned from the meeting
of November 24, 1969 - was called to order by His Honor Mayor Lester E. Anderson at 7:30 P.N. on
November 25, 1969 in the Council Chamber, with the following councilmen present: Mrs. Hayward,
Dr. Purdy, Mr. Teague, Mrs. Beal, Messrs. Gribskov, Mohr and Williams.
Continuation of Items not Taken at meeting of November 24, 1969:
Zone Change recommended (Oakpatch Road) - The Planning Commission recommended granting of this zone
change, subject to removal of the existing house and that only one driveway access be permitted, and
that it be on Oakpatch, rather than on 18th Avenue.
Mrs. Hayward moved seconded by Mr. McDonald to approve the zone change on the northeast corner of
Oakpatch Road and West 18th Avenue from RA to R-2, subject to conditions listed by the Planning e
Commission. Motion Carried.
EMPLOYE RULES AND REGULATIONS
I The Personnel Director has prepared a brief summary of policies that require Council action. Council
has been asked to consider parts of employe rules and regulations which have significant budgetary
I implications. The Policy is not conceived as a collective bargaining agreement or set of standards
I which cannot be adjusted by a department head, but as a set of standards or guidelines to promote I
I consistency in personnel administration throughout the City. The City staff has presented what is,
in their judgment, re?sonable and fair policies. Employe groups have presented what they feel is
I desirable. -'

Mrs. Hayward moved seconded by Mr. McDonald that the Council adopt the Personnel Policy statement
I as submitted by the City Manager's office.
I In answer to Councilman Mohr, Mr. Mills' said he had requested the Council to vote at committee
meetings for the purpose of providing staff with some indication of what Council'feeling was. He
I thought he had indicated to the Council that he did not want to be tied to this prior to formal,
adoption. This policy. is, in effect, the best judgment of the City Manager's office in both areas
where there was direction from the Council and where direction. could be taken from the employes
I groups.
I There was discussion between the Council and staff concerning previous Council decisions on some
I items, and whether or not they had been changed in the policy presented at this time. It was
decided to take each item on which there had been dissention, deciding what the Council proposes
I by motion.

OVERTIME:
In answer to Mrs. Beal's concern regarding overtime pay basis for firemen, Personnel Director said
j: this was a departmental working condition which might well vary. Administration will implement I
this policy and interpolate it in most appropriate manner. Shift personnel hours will be determined
I quarterly, and used as a guiGeline for scheduling next quarter. Incase of fire suppression
personnel, administration agrees time and one half after 56 hours is appropriate.
I Mr. Doug Post, representing the employe group, said,minutes of a previous meeting showed the Council
agreed to pay time and one half for a 40 hour week or pay time and one half for allover eight
hours for one day, and whenever possible, the method of payment should be at option of employe.

I After Council discussion, Dr. Purdy said it was his opinion that the Council agreed that overtime e
I should be paid for allover forty hours (56 hours for Fire Department) at time and one half,
and that method of payment, wherever possible, should be at option of employes.

II Dr. Purdy seconded by Mr. Mohr moved to include 56 hours in method of payment for overtime as
comparable to 40 hours, and whenever possible, method of payment shall be at option of empmbye.
I Mr. Post felt it should be stated that time and one half be paid for over eight hours worked in
II one day.
Mrs. Beal seconded by Mrs. Hayward amended the amendment that overt~me shall also be compensated
I for any time in excess of eight hours, except when shift is longer than eight hours.
The City Attorney said State law plainly says compensation shall not be less than l~ time for
,I employment over eight hours in any one day or 40 hours in anyone week.

II Personnel Director asked if adoption of this amendment would mean camp time could not be allowed
I on basis of one to one for convenience of employe.

II Vote taken on amendment to amendment. Teague, ~cDonald, Beal and Hayward voted in favor; Willtams,
Mohr, Gribskov and Purdy voted against. The Mayor voted against to break the tie. Motion to
II amend main motion to include cover firemen at rate of time and, one half for hours in exces of
56 and whenever possible method of payment shall be at option of employe. Motion carried.

I In answer to a question concerning State law requiring overtime payment for time worked over eight
hours in one day, Councilman Mohr said it would be redundant to put this into policy.
In answer to question "What constitutes work week," Personnel Director said holidays, sick leave
etc. are included when counting.
CALLBACKS~i
Prior discussions have included requests by employes to be paid a minimum of four hours when called
back to work. Only two hours would be paid when employe ,did not actually work.
Mr. Jackson pointed out that in minutes of meeting of September 8, 1969 the City Council referred
I this back to City Manager with a request for more information.
'I After discussion, it was decided to discuss firemen callbacks under paragraph "Firemen callbacks."
With this decision, it was agreed that section referring to callbacks was all right.

e FIREMEN CALLBACKS:

Mr. Flynn requested the Council to amend t~is section to include a minimum of 4 hours on callbacks
worked and 2 hours on callbacks when no work was required, and ,that firemen should be paid at'rate
of time and one half based on 40 hour week for all shifts less than 24 hour shift.. Firemen would
be willing to accept maximym of overtime pay based on a 56 hour week.
I I In answer to Mr. Flynn the City Manager said wording could be incorporated to include overtime pay
I for over 56 hours on the basis of a 40 hour week, but that he would not propose this. With this,
I: the Mayor said he assumed the paragraph on fire callbacks, as proposed by staff, would be acceptable.
Ij This would, in effect, continue the present practice.
II HOLIDA YS:

The Personnel Director explained that, earlier in the year, Washingtonmd Lincoln's birthdays were
deleted as holidays, and the day after Thanksgiving and a floating holiday were ,added to compensate.
Election days have been deleted, and it is suggested that an addition of either the day before
I Christmas or the day before New Years be substituted.
In answer to Mr. Post the Penonnel Director said if Christmas fell on Monday, it would be recognized
that the day before was Sunday. Mr. Post requested that the words "working days before a holiday"
be added. Dr. Purdy thought this was reasonable.
Dr. Purdy moved seconded by Mrs. Hayward to change the wording ,in this section to read "either the
last working day before Christmas, or last working day before New Years Day." Motion carried.
HOLDAY PAY:
! This was discussed at considerable length previously. Employes are agreed that time and one half
in addition to regular salary should be allowed.

Mrs. Hayward moved seconded by Mr. McDonald to amend the policy to recommend employes be paid
time and one half in addition to regular salary for time_worked on a recognized holillday.
There was discussion regarding the impact and meaning of the proposed policy. Mr. Post indicated
that maintenance men working holidays are presently paid time and one half for working holidays.
Public Works Director said the maintenance divis:ion of his department has been paid at this rate
for twenty years. Many emergency calls are answered on holidays.
e Vote taken on motion. Motion carried.
Dr. Purdy asked if an employe who was required to work on a Saturday holiday would be paid time and
one half in addition to regular salary. Personnel Director said "no", holidays falling on Saturday
are ~ot recognized.

Short break taken.
VACATIONS:
When an employe has finished his 9th year of employment, vacation starts to accrue at the rate of
three weeks per year, and he can start to take it after the tenth year. The 4th week of vacation
would be available after the 20th year.
Employe group recommended proposal of ,three weeks at end of 7th year and four weeks at end of
1 15th year. Mr. Post said this practice is becoming more prevalent in this area. Mayor Anderson
I said assuming no motion to amend, this section is all right as written.
SICK LEAVE:
This is an increase in existing policy ,which has a maximum of ninety days accumulation.
Mr. Post said many employes feel that, with change in administration, this could be misconstrued,
and requested wording to state that there was, no limit as to the number of hours s,ick leave which
e can be accumulated.
Mayor Anderson requested that this wording be incorporated in the final document.

The employe group ailiso requested that, upon termination of employment after ten years of continuous I
employment, an employe will receive 25% of his unused sick leave, up to a maximum of thir-tiy days.
There was: no action to include this.
COMPASSIONATE LEAVE:
City. Manager pointed out that this clause now included the words "brother and sister in law" as
recommended by Council in committee meeting. Five days leave with pay may be granted in event of
death in immediate family, and this is left to the discretion of the department head to administer
as he feels appropriate, depending on circumstances of individual situations. Section is all right
I as written.

Personnel Director said this is the original proposal, with an effort made to incorporate consensus
of feeling of Council.

I INDUSTRIAL ACCIDENT:

I Mr. Jackson said it was his understanding the Council had approved use of sick leave after six I
months of industrial accident payments had ceased. Personnel Director said Council had suggested
I this be left to the discretion of the City Manager. Mr. Jackson asked that it be written into the
I policy that the City Manager had authoiity to .grant this.

I Dr. Purdy moved seconded by Mrs. Beal that "in'special circumstances, accrued sick leave may be
I paid after six months industrial accident payments have expired, at discretion of City Manager" be

included in this section. Motion carried.
I Mr. Post asked, with regard to the section referring to married employes, that the last sentence
be stricken. Manager said this was a metter of administration and could be resolved without
Council. Mayor agreed.
ADDENDUM:
I Pay for Acting Capacity - There has been some feeling in the Fire Department that, after some length
I of time in acting capacity, the salary for that position should be paid. Mayor Anderson suggested
Mr. McKinley discuss this item with firemen and arrive at a solution. '
In answer to Mr. Post, Manager said final wording of Personnel Policy will be brought back for
I Council approval. For administrative purposes, they can go into effect as soon as procedures are
set up.
Mrs. Beal suggested that the completed document be discussed with employes so that their differences
'I regarding wording, can be documented and brought back. I
Councilman Mohr suggested that adoption of the policy be in the form of an Ordinance. City Attorney
I said that Personnel Rules and Regulations are guidelines and administrative rules, without grievance
II or enforcement procedures. No court would have jurisdiction over these matters.
The City Manager pointed out that these rules incorporate grievance procedures to provide for employes
to bring up through the administrative heirar~hy to the Manager's office, a grievance. Appeal stops
at the Manager's office. To be put into ordinance form would remove much of the flexibility which is
important to the working of the policy. e
I After discussion of the time and one half pay if a holiday fell on Saturday, Dr. Purdy said the City
should come up with a policy similar to that for firemen, for all city employes. Mr. Mills said
j that this was not possible, because of the basic difference in work schedules for fire personnel.

Vote taken on motion to adopt personnel policy statements, as amended. Motion carried. --
I In answer to the Mayor's question, the Manager said th~~ policy will be brought back in final written
form for inspection and action by the Council.
Mr. Pat Langan asked to discuss Tech II salary ranges. At the time of the budget committee, this
I, was to be resurveyed and brought back to,City Council. He requested that this salary be stepped
up to 5% through the range, as was done with all other City employes. Personnel Director said the
Manager has authority to make these adjustments as necessary throughout the year. Survey did not
I indicate an additional increase was justified for this classification. I
Mayor Anderson suggested this matter be discussed willth the Personnel Director again for clarification,
and if he wanted then to bring it to Council, it should be at a committee meeting.
At this time the balance of the Agenda not taken on November 24 was continued.
Easement Vacation, south of Harlow Road and west of Walnut (Hugo Kriekis) - Hayward moved
seconded by Mr. McDonald to vacate this easement, as recommended by the Planning Commission,
located south of Harlow Road and west of Walnut. Motion canied. e

I Easement Vacation, east of Centennial Loop and north of Centennial Boulevard ,(Parmenter
Pontiac - This involves exchanging location of sewer ,easements ,and reimbursement for
relocqtion of phone and electrical installations.
Mrs. Hayward moved seconded by Mr. McDonald to approve vacation of easement, as outlined above,
subject to conditions listed by Planning Commission. Motion carried.
Dangerous Building Abatement Recommendations
l. 300 feet east of 27th Avenue and Chambers Street
2. 2350 Chambers
3. 1122 and l122~ West 2nd
4. 226, 248, 266 and 294 Jefferson Street
Mrs. Hayward moved seconded by Mr. McDonald to call a public hearing with regard to the abate-
ments listed above. Motion carried.
e Paving Petition, Elk Avenue - 26% Petition - This is a difficult project because of topography.
Staff polled owners of property which would be assessed, and found a majority against it. It
is an unimproved street, which requires much maintenance because of drainage problems. It
serves only the residential properties abutting it. Driveways will have to be cut or grade
raised.
Mrs. Hayward moved seconded by Mr. McDonald to refuse this petition.
I In answer to Dr. Purdy the Manager said from a maintenance standpoint the street should be paved
sometime, but it is not important to do so now.
Vote taken on motion'as stated. Motion carried.
Assumption of County Contract with Southern Pacific Company re: Drainage Ditch, SCS, A-3
crossing of railroad right of way.
The City will assume the original County Contract to take over responsibility for a portion of I
I S.C.S. drainage ditch where it crosses West B~ltline Road just north of SPRR tracks. Right of
way will be needed for SCS channel.
Mrs. Hayward moved seconded by.Mr. McDonald to assume the contract with Southern Pacifc
Company, as outlined.
In answer to Mr. McDonald the Manager said some of the work has been done on ditching and I
culverts, but it will be an expense to the City. I
Vote taken on motion 'as stated. Motion'carried.
Bid Opening, Public Works Department, November 24, 1969 - This is for liner pipe and
sanitary and storm sewers in the Mall area, ERA Contract No. 3. Plastic liner will be
inserted into existing sewers so all connections will not have to be relocated and the
I downtown area torn up. Wild ish Construction Company was low bllEer. Staff recommends
award. Bids were as follows:
Wild ish Construction Company::, $81,057.80
D & D Backhoe Service 84,313.00
Kenneth R. Bostick Const. Co. 155,357.80
Public Works Director said the City will only contribut approximately $5,654.00 on this
ERA project. The City let bids and acts as engineer for ERA.
e Mrs. Hayward moved seconded by Mr. McDonald to allow the City to expend approximately
$5,654 for this ERA project. Rollcall vote. All councilmen present voting aye, the
motion passed.
Bid Opening, Parks Department, November 19, 1969 - This was for restronms to be constructed
at Laurelwood Park. Staff recommended the contract be awarded to the low bidder. Bids
received for the project were:
McVay Construction Company $6,910.00
Lane Construction Company 6,808.59
Howard Nelson Construction Company 6,442.00

Parks Design Estimate 6,085.00
I Mrs. Hayward moved seconded by Mr. McDonald to award the oontract for restroom construction
in Laurelwood Park to Howard Nelson Construction Company for $6,442.001 Rollcall vote.
All councilmen present voting aye, the motion carried.
