I Petition, North Eugene High School Students - Mayor Anderson introduced Miss Pam O'Sullivan, who

I presented a petition signed by 3)3 students from North Eugene High School, requesting that the
I cross on Skinner's Butte be retained as a symbol of our City and community.

I Foreclosure Sale on Delinquent Liens - Foreclosure procedure for delinquent assessment liens was
established to allow the City to stay abreast of principal and interest on Bancroft Bonds. The e
I City is currently proceeding, with a sale involving 246 assessments on 203 properties for a delin-
quency of $262,322.44. Many of these have become delinquent since the last foreclosure sale in
I' November of 1968. The sale date has been 'set for January 8, 1970. Delinquent assessments will be

II published and "may be,paid prior to sale date, to avoid legal foreclosure sale.

In answer to Dr. Purdy's question the Manager said no prev{ously foreclosed properties have been sold.

" 3. Availability of Movies - Councilman Mohr commented on 'concerns of the community about

ij of persons wishing to expand'on various kinds of movies in terms of a filming society
:1 or private club which could show movies. Mr. Mohr did not feel government should get

I ~ into the business of subsidizing movies, but could provide help to groups. Mr. Mohr

" suggested that the School Board was a proper agency to provide facilities for such an

expanded film entertainment program, and he volunteered to draft a letter outlining e
i1 responsibility and a sense of the opportunity to make a concerted effort in this direction.

I Councilwoman Hayward agreed that this was a good suggestion, and suggested that perhaps
Parks D~partment might find citizens interested in establishing a film society.

Mayor Anderson said he had been contacted by several people who expressed concern. He
I
thought Mr. Mohr's suggestion was very good, and requested that he bring a letter to
the Council for consideration. Councilman Williams thought the point was well taken.
Mrs. Hayward moved seconded by Mr. McDonald to file Items 1,2 & 3 of the Committee Report. Motion carried.
I 4. Laurel Hill Area Petition - Eugene Planning Commission granted site approval for a 92 I
unit apartment development on property' long zoned commercial. Manager .read a petition I
! signed by 293 residents of the Laurel Hill area requesting postponement of all construction, i
other than single family, until residents of the neighborhood and the Planning Commission
develop a comprehensive growth plan for the neighborhood.
A memo was distributed which had been prepared by the Planning Director and City Attorney I
explaining development permitted under theZoning Ordinance, and the probability of
e postponement of other conditional uses, as requested by the citizens group.
The Planning Director described this as an area of long narrow lots, not suitable for
modern needs. He explained that the Conditional Use procedure was used to exchange
density, and th?t the appeal time had expired before residents filed an objection.
Mayor Anderson asked that discussion be confined to the q~estion of whether or not to
I proceed with a public hearing, rather than trying to resolve problems at this point.
The City Attorney commented that, under the City Zoning Ordinance, the legal time limit
for an appeal had expired. If the Council wished a public hearing, it would have to be
on some other basis.
In answer to Mr. Louis Durchanek, Planning Director said notification and appeal period
are the same for Planned Unit Development or Conditional Use Permit. Mr. Durchanek
could not see why conditional use was required under zoning regulations. Planning
Director explained by using conditional use permit, RG density and commercial service
were obtained on RA zoned property. These are transferred to the Planned Unit Develop-
ment, since that procedure is more stringent.
There was further discussion of appeal procedures and notification required.
Mr. Jim Bartell, chairman of the Committee, said the petition made it clear that they
wished to have a hearing.,
Mrs. Hayward suggested setting a time for discussion at a committee meeting. City Manager
felt an evening meeting would be a more convenient time for petitioners.
r Mr. George McGinnis said the main consideration was that a public meeting be held where

I they can establish a framework of discussion .at which these points may be handled.
I Councilman Mohr asked if it was understood, that a public hearing could be held about
development of the entire area, but in the judgment of city administration there was
no way to prevent the start of construction on the development already granted approval.

Mr. Bartell 'said the committee 'was not concerned necessarily about the 92 unit d'evelopment, I
but that the total character and complexion of the area were not changed. He agreed a
- joint meeting might be desirable.
Mayor Anderson suggested that this matter be heard at the meeting of December 8. Citizens
of Laurel Hill agreed that this would be convenient.
I, Mrs. Hayward moved seconded by Mr. McDonald to hold a public hearing Monday, December 8,
I 1969 at 7:30 p.m. in the City Council Chambers regarding development of Laurel Hill area.

In answer to Mrs. Beal's suggestion that the motion be amended 'to include the Planning Com-
mission, Mayor Anderson said it was not necessary to invite them - they are always 'welcome.
Vote taken on motion, and motion carried.
Mr. Louis Durchanek, 1760 Sylvan, said he was a member of Laurel Hill Citizens Committee and explained
tha t , in the absence of Mr. Bartell, he would act as chairman. The committee was requesting that a
plan be decided upon and adhered to for the Laurel Hill neighborhood. He said members of the committee
I have not accepted the proposed Planned Unit Development for their neighborhood as an accomplished fact,
and hope it will become evident this plan is inappropriate for the Laurel Hill neighborhood.
I Mr.
Sid Armstrong, 2640 McMillan Street, asked that the Council impose a complete moratorium on buiJd-
ing in the Laurel Hill area. He asked for clarification of Planning Commission procedure, and cited
the General Plan for 1990 as setting aside this area for low density building. He felt this was a
unique valley, and wanted to keep it that way.

development or stop Mr. Weaver, but felt they should have identity as a neighborhood, and a voice in I
planning that neighborhood.
Mr. AU Tussing, 2437 Riverview, spoke about the relationship between City Hall and the Citizen. He_
felt the ctty CouncH: should help and advise citizens, and should not ignore the wishes of the people.
He explained that it was at the Planning Commission President's advice that they formed a citizens
committee. He said Mrs. Niven did not advise them that they could file an appeal within ten days, and
II they felt there must still be some recourse to the Council.
Mr. George McGuinness, 1790 Riverview, sppke on "Planning Considerations." He did not feel reasonable
i consideration had been given to the valley with regard to the impact of a 92 unit apartment project,
I and the increased density. He urged that planning consideration be applied to a Laurel Hill dev-
i elopmental plan, beneficial to the neighborhood.
! Mr. Durchanek read a summary which made three specific proposals: 1) postponement of all construction,
:,
II includ:ing the proposed PUD, excepting single family residential units, until such time residents of
I Laurel Hill and the Planning Commission or other appropriate body are able to develop a comprehensive
II plan for growth of the neighborhood; 2) Council establish a committee to which it will appoint City e
II Planning representatives, and to which Laurel Hill will appoint its representatives. This committee
! should be formed with the express intent to develop a comprehensive growth plan for Laurel Hill
) neighborhood. They asked for equal representation and an equal voice in developing such a plan.
They also requested involvement of appropriate Lane County offices, since 250 acres on the outer
I edges of the area are considered to be part of the neighborhood, by virtue of their topography;
3) Request the City Council to utilize its prerogative under ORS 227.090 to direct the Planning Com- I
mission to reconsider the preliminary approval granted for the proposed PUD.
The Planning Director explained the process for granting prelimina~y approval of a PUD, and written
notice, posting and advertising preceding public hearing for this approval.,
II The City Attorney addressed himself to recommendations of the committee, the first recommendation
I being that the City ,Council postpone issuance of'building permits for construction. As long as
property within a zoning 'classification meets requirements of that zoning classification, the Council
I has no authority to withhold building permits. The only legal basis for withholding permit would be
noncompliance with zoning requirements.
Regarding the Council telling the Planning Commission to revoke prior action, this presents other
legal problems. ,All procedural requirements have been satisfied in this case. When requirements
of the ordinance are met, certain rights and privileges accrue therefrom. In regard to a moratorium,
this is a matter for the Planning Commission to determine whether proper or improper. Council could
suggest or give direction to the Planning Commission in this regard~ In answer to Councilwoman
I, Hayward, the Attorney said apartments could be prohibited in that zone, except where Mr. Weaver
already has a pe~mit. In answer to Mrs. Beal the Attorney said t~e Council could initiate a change
in zoning classifica~ions. They must go to the Planning Commission for a public hearing, and have
the zoning classification changed in accordance with State law and the City Zoning Ordinance.
Mayor Anderson said there may ~ave been occasions of misunderstanding or differences of opinion, but
I the Council is interested in the Laurel Hill situation. They do not treat the area as an island,
but consider it part of the City, and the General Plan for the area will be part of a plan for the I
,I city of 'Eugene, as well as the entire metropolitan area.
II Mrs. Betty Niven, President of the Planning Commission, said if the Planning Commission had failed
to inform the citizens of Laurel Hill of their right of appeal, she apologized. She had never known
it to happen that someone did not comment on this at, a public hearing. She commented that it was
interesting that citizens had referred to the Planning Commission's great interest in the developer.
The Planning Commission is constantly hearing from developers that the Planning Commission has no
interest in what they want to do,:only in trying to preserve the City exactly as it is. Mrs. Niven
I explained problems of housing in the City, and impossibility for middle income people to obtain loans '.
to buy homes. Therefore, they must be housed eithe~ in apartments or in substandard homes. These
apartments must be built in neighborhoods like Laurel Hill, and others like them, who also feel their
I area is unique.

In answer to Mrs. Hayward, Mrs. Niven said it was not clear if the Planning Commission would be
i able to stop all development in the area until a general pian is provided. 'She said transportation
I is one of the most difficult problems to resolve in planning for an area.
I
II Councilman Mohr asked the City Attorney how the Planning Commission, to which the Council has dele-
II gated no authority in terms of law making, couldhave created a condition from which there seemed
no escape. The City Attorney explained that the Council, in 'adopting the Zoning Ordinance, set
!1 forth in Article 28 procedures for Planned Unit Development, and delineated to the Planning
I Commission administrative function of hearing, giving notice and making decisions. The Planning

I Commission decision was an administrative decision under criteria of the Ordinance.
I Councilman Mohr discussed the possibility that the Council choose a course as proposed by the People I
I of Laurel Hill, and whether the City Attorney would be in a defensible position. Mr. Mohr did not

I feel the Council could take an opinion about what it could do and just rest there.
I, Mr. Williams felt that, since people were not advised of their right of appeal, there should be some
Ii way the matter could be brought before the Council at a later time.

request. She felt this was one way to accomplish what ,~he Laurel Hill citizens asked without asking e
the Council to break rules.

I The City Manager said the Citizens Committee had presented' a well thought-out presentation which
raised many questions, some with legal ramifications, some regarding policy. He suggested these
should be studied and reviewed by the Council, Planning Commission and staff. Mayor Anderson
concurred. In answer to Mr. Mohr, the Mayor said three proposals had been made from ,the committee,
and the Council had been asked to consider them. The Council should study information presented
to support these proposals and the gackground of the rezoning. The Council could then make a
reasonable and considered'decision upon the proposals.
Mrs. Niven suggested that, even though the City Attorney had said the Council could not direct the
Planning Commission to reconsider, the Planning Commission could perhaps reconsider on its own.
Mr. Mohr felt the Council should make a decision on the requests of the Laurel Hill Committee at
this time. He could see no advantage to delay.
The City Manager felt the Council should have an opportunity to review what had been presented at
,this meeting, and give the Planning Commission a chance to review its past decision, if they should
e decide to do so. The Council had the option of ordering a moratorium on issuance of buildi~g permits.
This might, or might'not create problems.
The City Attorney disagreed with Mr. Mohr, saying when there is a legal zoning classification and
people want to,deve10p in accordance with the law, theCouncil has to abide by the rules it fias made~
At this point the City Council has nothing to indicate the Planning Commission permission for pre-
I liminary approval was not correct.
I There was further discussion about issuance of a building permit for this pub and whether another
appeal could be filed at the time the Planning Commission gave final approval fo plans. The Planning
Director explained that appeal at the time of final approval was only on the basis of whether

requirements of the Ordinance had been met. The applicant will not receive a building permit
until such final approval has been given.
i Mrs. Hayward moved seconded by Mr. McDonald that the Council postpone action on a request from Laurel
Hill committee until the Council has discussed presentations and recommendations have been reviewed
by staff, and the Planning Commission and Council have an opportunity for a joint meeting.
) Mayor Anderson hoped that"through discussion and hearings, the committee and Council might reach
some kind of agreement.
Vote taken on motion as stated. Motion carried.
I Dr. Rei the1, 2600 Floral Hill Dri ve, commented on the large delegation from Laurel Hill. Mayor
Anderson said the Council had previously received such delegations, but it usually takes a crisis
to bring them out.
In answer to Mr. McGuinness question, Mayor Anderson said it was his understanding there would be
a public response to the committee's questions. The Planning Director said the Lan~ County Planning
\ Director would welcome an opportunity to work with the citizens of the community living outside the

5. Truck Parking in Residential Zones - Proposed ordinance restricting parking of oversize
vehicles in residential zones was discussed at a previous Council meeting. There were
problems with the definitionof'a truck and a limitation of parking in front yards. The
City Attorney has changed the ordinance to limit parking in front yards within the legal
set back area. As far as the definitioU"is concerred, it is felt the State definition of
I a truck being any vehicle exceeding 6,000 lbs. gross weight is the best available.

1 Councilman Williams suggested that the definition of a truck be' 10, 000, Ib~. :,rather than
I 6,000 for this particular ordinance. Mrs. Hayward~said that service-type vehicles
I were under 6,000 1bs., and, it was felt for residential parking they sholdd"not exceed
this limit.
The ordinance will be brought to the meeting of December 8. No action taken.

Mrs. Hayward moved seconded by Mr. McDonald that the Council adopt the ordinance as proposed.

Dr. Purdy suggested the definition of a truck be based on'whee1 base size, rather than gross weight.
He was concerned that pick-ups would be ticketed~ The City Manager exp~ained that' pick~ups had
been excluded by reference in the Ordinance.
The City Manager read the ordinance. He then-read a letter from Mr. A. Krieg objecting 'to sections
I of the ordinance and asking the Council to tab1e~it for further study. He felt trucks should not be
allowed to park in side yards or vacant lots. This was turning residential neighborhoods into
commercial areas.
Councilwoman Hayward said she had toured a residential area with Mr. Krieg, and until that time,
had been ;unaware of the magnitude of the problem.
Mr. Max Beninga,:, 775 Arcadia, objected to :parking of semi-trucks or logging trucks @n streets ~m a
residential neighborhood, saying it appeared that parking of one encouraged more to park in the same I
- II area. The City'Manager agreed this needed correction from a safety standpoint.

There was some discussion about hours of prohibition of truck parking.. It was agreed that if a I' -
truck had to be moved after midnight, it probably would not be parked in the first place.

Mayor Anderson urged the Counci1.to take some action to direct further staff study. ~ather than
trying to debate the weight of trucks,' it should ask for staff guidance.
Dr. Purdy moved seconded by Mrs. Hayward to amend the motion to refer the .ordinance back to the staff
for further study. Motion carried.
6. Cost Sharing, Civic Center Planning':' The Council agreed previously to cooperate with~
Lane County, EWEB, School District No. 4J and the State of Oregon in joint planning of ",.""
land use, including building sites, traffic control, parking, open space and pedestrian
I needs in the Civic Center area. Lane County has filed application for advanced' planning
I loan from HUD, of which the City's share is $7,350. This would be repaid only if and
I when a major addition to City Hall was contracted. It is recommended that the Council
I au~horize such a commitment to Lane County.

J 8. Storm Sewer Construction, 18th and Chambers - Citizens Bank requested that asto~~ sewer
I be installed in the north/south alley bordering Albertson's Food Center located at 18th
I 'and Chambers. Staff recommends that the City proceed with this project, participating
I with Citizens Bank on a 50/50 cost sharing basis. It is estimated the City share would
I be $3,450.

Mrs. Hayward moved seconded by Mr. Gribskov that the Council approve joint participation
in sotrm sewer construction in this area. Motion carried.

the direction programs could go and relationship, it was found there was no up to date
information available. Proposal is for a three month period and would provide funds for,
a director to develop a questionnaire, app0int interviewers, compile information and
I codify so it could be utiliied to ,report to Human Rights Commission and aid Planning
il Commission and other agencies who require such information. Estimated cost is $4,b20.

Ii In answer to Councilman Mohr, Mrs. Ruey Thomas said substantive questions would be very
much a part of the questionnaire. In answer to Mr. Porter, Mr. Brewer said this would
I not be limited to the City, but would encompass, the metropo1itari area.
Mr. Willie Mims said the committee had discussed contacting other minority groups for ~
data, but location of the black community is known, and the task could be completed in ~
a shorter time.

In answer to Mayor Anderson's question, Mr. Brewer said a differentiation would be.made
between black residents of the community and black students.
In answer to Councilman Williams, Mrs. Diane Nechak said practically no information of
a substantive nature will be available from the 1970 Census. Nothing which can be
obtained from the '70 census will be duplicated.
A vote was taken on the motion as stated. Rollcall vote. All councilmen present
voting aye, motion carried.
2. Maintenance Agreement, West Beltline - The City joined with EWEBand the County to
purchase right of way for west Beltline Road between Barger Drive and West 11th in
I order that all three agencies could get space required for various needs. City's share
.of purchase was $54,000. We are now requested to join Lane County in an agreement which
sets forth responsibilities of County and City with regard to'this property. It
requires the City to maintain and operate a drainage ditch and the County to maintain
roads and shoulders~ Staff recommends approval.

Council Bill No. 8978 - Prohibiting Overnight parking of trucks upon certain -streets of the
