r Proclamation - A proclamation was read naming January 1970 as March of Dimes Month in the City.

Ii Kendall Ford, Variance Request - A letter was read from Kendall Ford requesting a six month

II extension of a temporary Variance allowing an office trailer, office building and tent at 1290 Olive
Street. These will expire within a short time, and Kendall has not started construction at its
II new location. e
I. Mrs. Hayward moved seconded by Dr. Purdy that Kendall Ford be granted a six month extension for use

II 3. Council Support, Veto 1969 Tax Reform Bill - Councilman Williams suggested a\letter
I, be written to President Nixon pledging Council support of a possible veto of the 1969
II Tax Reform Bill. He said the Council position should be made contingent on whether the
II bill would decrease financial flexibility of the federal government and result in less
money being distributed to local communities.

Ii After some discussion, Mr. Williams moved seconded by Mr. Gribskov to direct a letter
I to President Nixon indicating that, if the 1969 Tax Reform Act would decrease the
I financial flexibility of the federal government and result in less money being distrt- I

Ii Mr. Williams said the President will face an extremely difficult decision, and such

I meet in. execu'tive session before the meeting of January 12 to elect new officers. This will be
fat 7:00 p.m. in the Conference Room.

I Dr. Purdy requested that review of the by-laws be scheduled on the January 7 noon meeting so they
could be in final form for the regular meeting of January 12.

I 7. ~roposed Agreement with School District - This agreement formalizes established procedures

on priorities of joint school and city-owned facilities for park and recreational
I' purposes. Use of the agreement minimizes misunderstandings and outlines procedures.
I Staff recommends adoption of the proposal.

school-park facilities for the City of Eugene and School District No. 4J.
In answer to Councilman Purdy, the Parks Director said it was his hope adoption of
this policy would pave the way to solve problems regarding keys and clean-up respon-
sibility. The Parks Department hopes to have a similar agreement with School District
No. 52.

I A meeting was held with EBAA which resulted in an agreement that Item B-3, having to do with prior-
I ities on school district facilities should include an agreement that EBAA may remain in Junior
'iHigh School gymnasiums from 5:30 p.m. to 8:00 p.m. An attempt will be made to amend Page 4 so
:!that these gyms would be usable until 11:00 in the evening, rather than 10:30 p.m. Other than these
Ii changes, the agreement is satisfactory.

8. State Speed Control Board Proposals

!I The Manager explained that the State Speed Control Board is charged with the responsibility
tl for setting speed on all streets within the State of Oregon. He explained the procedure
:1 followed to determine pr9per speeds, and that studies are then reviewed by city staff.
II Staff has recommended that approval be given for these three proposals.
\\ Dr. Purdy felt the recommended speed on Oakway Road was too high. .Manager explained
I .that studies indicate that motorists travel at what they consider to be safe speeds,

I I regardless of posted limits. Studies showed that 85% of motorists traveled on this
road at speeds between 37.25 and 42 m.p.m.

1. National Gold Medal Award, Parks - President Hayward read a news release concerning the
City Parks and Recreation Department having been named finalist in Class III of the ~ :
National Gold Medal Award. Mrs. Hayward extended her congratulations on behalf of the
Council to the Parks Department.

2. Joint Housing Committee report and Recommendation - Mrs. Betty Niven outlined the history ,:
and circunstances of past applications for housing for the City. Mrs. Robin Cushman, "
City Housing Expediter, defined Turnkey Housing, and explained how it ~iffered from ,
other types of leased housing. The tight money market has made this the most preferred
method to receive HUD approval. Mrs. Cushman explained that a subcommittee of the Joint
Housing Committee had submitted a recommendation for 400 total units of Turnkey Housing. i
Their reasoning was that the City Council had ad9pted a ho~sing policy in June of 1968 e
calling for 450 units of low income housing. As of this date, only 45 units have been
allotted. The leased housing program and Parkview Terrace now have a total of 568

I applications on hand, the majority of which are for two bedroom non-elderly units. . The
Committee recommended an additional requirement that an advisory committee be appointed
to assist Lane County Housing Authority Board of Commissioners in selection of sites
and plans. This group should be made up of low income citizens of the community.
Dr. Purdy moved seconded by Mr. Gribskov to approve the application and recommendations
of the Joint Housing Committee. Motion carried.
I Mrs. Niven said the Council will probably be asked to consider three things, one of
which is revocation of the Resolution which limits applicants to people residing in the
\ city of Eugene for six months; 2) A formal request to the County and Springfield to
budget funds to help support the City's Housing Expediter (95% of the housing applicants
have been from outside the city of Eugene; 3) Encourage the Housing Authority to write
to HUD, asking for authority to lease housing outside the city of Eugene.
Mrs. Niven presented a check to the City Council from Lane County Housing Authority for
e payment in lieu of taxes in the amount of $6,061.

Mrs. Hayward said she understood that Mr. Schmaedick had a presentation which advocated referral of
the report to the Joint Housing Committee for further'study.

I Mr. Ron Schmaedick, 947 Hiwan Court, said he was speaking as a representative of the Eugene Area ,
I Chamber of Commerce, Eugene Springfield Homebuilders Association and Eugene Area Board of Realtors.
Mr. Schma,edick said he is also a member of the Joint Housing Committee. It is his feeling there is
adequate public housing available for persons of moderate means. Mr. Schmaedick was also concerned
that makfng low income housing available was encouragreng low income families to move into the City,
and that the type of housing requested would create an additional tax burden to the taxpayers of
I the City. Mr. Schmaedick suggested that the Joint Housing Committee encourage Lane County Housing
, Authority to submit the application already pending for 100 additional units of leased housing.
Mr. Morven Thomas, Planning Commission member and also a member of the Joint Housing Committee,
pointed out that most of the housing available in the City is for those of moderate incomes, and that
there is not housing to fill the hundreds of applications on file for low income people. He said
that the proposal, if referred back to the Joint Housing Committee, would probably come back to the
Council in its original form. He explained difficulties with finding housing to fill the leasing
program, and that the Department of HUD was encouraging applications in the form submitted by the
Joint Housing Committee.
Mrs. Hayward asked if the Joint Housing Committee had heard Mr. Schmaedick's objections. Since they
had not, she suggested that the recommendation be referred back, so 'that the committee could have an
opportunity to discuss Mr. Schmaedick's suggestions.

IMrs. Hayward commented regarding Mr. Schmaedick's concerns about low income residents, and its

I financial effect on the community, that citizens must realize the problems of low iricomefami1ies,
I land provide other kinds of programs in this connection.

IMrs. Cushman clarified that the 95% referred to in the committee report was 95% of the applications
lreceived in her office during the last month. The 'Housing Authority 'receives about 10% 0ut:ofthe City
!apPlications out of approximately 1500.

3. Planning Commission Reports

Mrs. Hayward moved seconded by Dr. Purdy to approve Item 3Al.
Mr. Chris Wegelin, 2736 Laurelwood Lane, asked if his property'wou1d become an island, and when, in
connection with this annexation, that property would be annexed. He also asked how much the assess-
ments might likely be, and whether there would be access off 30th.

'The City Manager agreed that this annexation would create an island, and that, under State law,
Cities may initiate annexation of islands. However, since the last legislative session, annexations I
must be approved by the Boundary Commission~ Annexation of the islands would take place very shortly

Public Works Director ,said that the proposed sewer system would be relatively small, and the contract
cost would be 10% to 20% more than a previous one Mr. Wegelin,had. '
Mr. Thomas indicated' that the Planning Commission recommendation had included a statement asking the
City Council to include the islands in the annexation request, and that the Boundary Commission adver-
tise them for public hearing.

Jimi Mathers, petitioner, said the Planning Commission hadindic~ted that this property could no
I' longer be considered residential, but that they pospponed rezoning c?nsideration for one year. Mrs.
d Mathers felt this delay was unfair, and she did not feel the Planning Commission was realistic in
!' its recommendation for apartments. The lots were too small, and this type zoning would require
,j owners to join for rezoning.

I There was discussion about present zoning of surrounding property. Planning Director explained that,

I under the ordinance, Mrs. Ma thers ro uld have a home occupancy, so long as only members of the family

I Mr. Orland Howard, 4846 Brookwood Way, explained that he represented the property owner, and that
this property had been on the market for three years. Because of the uncertainty of the future
highway, prospective buyers were reluctant to invest in the property. He felt that the State had
indicated a possible need for the property, but would not condemn it, and that the actual location
of the centerline had not been established.
The City Manager indicated that Mr. H ward had been misinformed regarding the highway centerline.
A public hearing was held approximately two years ago, an~ the centerline was fixed at that time.
The design of the interchange has not been fixed at this point, and there is a question whether or
not there will be an interchange at that intersection. Mr. Howard also apparently misunderstood
the Planning Commission reference to the Mapped Street Act, which provides that the City may protect
future rights of way, but must be in a position to buy property if and when the protection intereferes
with proposed development. The Planning Commission position has been that the portion lying between
the centerline and the Southern Pacific-Coos Bay branch should be zoned industrial, and that the
I highway itself would be the dividing line between industrial and residential. A mobile home south
of the highway wouldnot be compatible with the industrial uses now located there.
e There was further discussion concerning possible rezoning of the southern part of the property.
The Manager read a letter from the State Highway Division which indicated that the State had notfirm
plan for an interchange, and that until a plan is approved, no development should be made along
Danebo Road which does not take into account the possibility of approach fills for an overcrossing
for the freeway.
I Mr. Howard said that the State of Oregon letter assumes the restriction of plans, leaving right
of way for the State of Oregon. He felt this was taking without condemnation, and that this was
wrong. I
The Manager said the Planning Commission recommendation does not in any way attempt to protect this

Regarding appeals to Mobile Park Conditional Use Permits, Mrs. Niven pointed out the
changes in housing needs, and that people will have to realize that the only way needs
can be met is with this kind of housing.
II In reply to Mr. Mohr, Mrs. Niven said petitioners have to submit PUD plans for Mobile
I Home Conditional Use Permits. The Planning Commission is now studying that ordinance
I in light of recent developments in mobile homes. Some revisions may be necessary, and
I
they will probably make a distinction between those homes really mobile, and those
which will be permanently attached to the ground.
I Planning Director said the Planning Commission had recommended a change of zone from
I AG to RA and had given site approval for a mobile home park on the property. It will
I ask the Council to hold rezoning until final approval of plans for development. Mr.
I Bennett has filed an appeal.
Regarding the request by Mobile Towns of America, Mr. Porter explained that the Planning
Commission had given approval for rezoning of property north of the proposed highway.

e south of 19th, requested R-l to RP denied, recommended R-l to RG with
Conditional Ise to permit dental offices and apartments. An appeal is on

4. Pro;ect Agreement, Lane County and State Highway Department - This agreement for construction
of comfort station in Hendricks Park. It provides $3,351.89 in Land and Water conservation
funds for 50% of the project cost. Staff recommends approval.
Mr. Gribskov moved seconded by Dr. Purdy to enter into this agreement for construction of
a comfort station at Hendricks Park.
In reply to Councilman Williams, Parks Director said this agreement provides for attachment I
I to sewers, rather than septic tanks.

5. EWEB Land Sale - Lots 1 through 7, Larch East' Subdivision. This land was bought by EWEB
and subdivided to secure a site for a substation north of Larch Street and west of
el West Amazon. This agreement disposes of lots not needed for the substation.
