Mayor's Message - As provided'for in the City Charter, Mayor Anderson presented his annual message to the City Council. He touched on problems of pollution, housing and government finance, and urged the formation of a metropolitan government, explaining that proliferation and fragmentation caused by countless districts and jurisdictions compound the problems. He said development of better financing methods had highest priority, and that revenue producing s.ystems would have to be revised. He outlined hopes and p1a~s for the future. Gilbert, change Barger Drive; west of of zone from AG to RA on property between Royal Avenue and Candlelight. Appeal f~om Conditional Use Permit. A public hearing on ~pp1ication for zone change ~as scheduled for the meeting of December 22. Because of an appeal from the Conditional Use Permit granted by the Planning Commission to permit a mobile home development on the property, Council postponed change of zone hearing so that it could be heafd in conjunction with the conditional use permit appeal. Mr. Ken Gilbert, owner of the property, reaffirmed statements made to the Planning Commission, explaining that he will develop this property so that it will be of benefit to the community. He has been working with a design team to insure the best development possible. Mr. A. Bennett, a neighboring property owner, said the conditional use permit for this mobile home had been approved without regard to the' criteria established in the ordinance. He objected that the preliminary plan would eliminate one street, leaving his property land-locked. He also objected to the increased traffic and requested a traffic study of the effect of the development on the neighborhood streets. I There was a discussion of existing and future streets in the area, and the effect increased density would have. Mr. Bennett was assured that requirements for mobile home approval state that the street system has to meet Planning Commission approval. Ii I' Ii I: :1 II II I; " " " q Ii Ii I, Ii I: " I' 1\ ;1 :1 I: II i; Ii Mr. James Pearson, Planning Commission member, said the criteria mentioned by Mr. Bennett were not contained in an ordinance, but were a Planning Commission policy statement for Planning. Commission or applicant's guidance. The policy was established in 1964, and was updated before this application was approved. Mobile home construction and the concept of mobile home park development have changed considerably, necessitating updating of the policy. 1 e Mr. McDonald moved seconded by Mr. Teague that the City Council uphold the recommendation of the Planning Commission and approve the change of zone from AG to RA on property located between Royal Avenue and Barger Drive, west of Candlelight, and the Conditional Use pre-preliminary site approval. Motion carried. 2. Drs. Pearl and Chambers, change of zone from R-l to RG on property located on the east side of Agate Street, south of 19th. Appeal to Conditional Use Permit. A public hearing on application for zone change was scheduled for the meeting of December 22, 1969. Because of an appeal from the Conditional Use Permit granted by the Planning Commission to permit a den.tal clinis; on. the prdlperty, the Council postponed _ the zone change hearing so that it could be heard in conjunction with the conditional use appeal. II I I !, ;: 'I Ii II 'I " I, I, I ~ Ii ,I Ii Ii In answer to Mr. Mohr, the City Attorney said the decision on a zoning classification must be made on grounds other than refusal to rezone to hold for future public use. Mr. Mohr suggested that opponents and proponents should not speak to the issue of holding the property for future park use. Mr. Bert Pinkerton, 1972 Emerald, said this is a declining neighborhood, in need of a shot in the arm. He felt a clinic, properly landscaped, would provide a buffer-strip between commercial and residential. Mrs. Francis Drury, 1646 East 19th, said the back yards of the rental houses on the pr.operty faced her house, and it was her opinion the clinic would improve theneighborhood. Mr. H. R. Axtell, 1985 Friendly Street, said he owned one of the lots adjacent to the park, and that three previous zoning requests had been before the Council. He presented a peti- tion favoring the rezoning which, he said, represented a cross section of the southeast section of town. Mr. John Reynolds, architect, said that the Pllanning Commission had arrived at the answer that the petitioners request was the best use of. this. land, and their judgment should be considered. Mr. Ed Whitelot asked for an explanation of what precluded this property from being made into a park. Mrs. Hayward explained that the city could not refuse to rezone the property to a higher use in order to keep it at a low value until it could budget money to purchase it for park purposes. e Mr. Jack Craig, 2159 Emerald, Mr. Walter Miller, 2176 Agate and Mr. Michael Ewing, Rt. 3 Box 83 Springfield, felt the public would benefit from the City buying this",for'park purposes, and tha t theCi ty should arrange to b~lY it. Mr. Marvin Krenk, 2100 Eaton Drive, was puzzled by the conditional use attached to the RG designation. City Manager explained that the applicant had requested rezoning to RP to permit dental offices, but the Planning Commission was concerned that other businesses allowed under this classification would not be suitable. With "the RG zoning the dental clinic"would be allowable under conditional uSe, but no other commercial uses would be allowed. Mr.G-lyde Patto,n;2l60 Onyx, felt zoning should be decided by the community as a whole, not by request of buyer and seller. I Mr. Craig said he bad lived, in this area for twenty years, and felt nothing but residential should be allowed on this property. He feared the whole block would become commerc~a1. Mrs. Sylvia Schumacher, 1800 Columbia Street, suggested that if the Council rezoned this property, she would like hers rezoned too. - il I' " I! I' II Mr. Al Urquhart, 1960 Agate, said he had appealed the decision for a Conditional Use Permit. He presented a petition signed by 515 persons. It was his opinion' that" there was sufficient commercially zoned property in this area, and that reasons for this request were purely economic. He felt that, since the property was adjacent to a park, it should be used as an extension to provide a needed playground. He explained that 1/12/70 - 2 ....1 ..3 e 1/12/70 his property was adjacent to property purchased by the neighborhood grocery, and that he feared it too would be rezoned. I Mr. Walter Miller said it was his understanding the burden of proof to show a need for rezoning was with those requesting the change. He felt sufficient proof had not been shown, and he felt the Planning Commission was not being consistent. Mr. Vernon Gleaves, attorney, said he represented Dale Fisher, 2105 Fairmount, and that they objected to the rezoning, feeling property south of 19th should remain residential. Any increase in density would create a traffic problem. A mistake had been made by allowing a service station on the corner, and it should not be compounded by this rezoning. Mr. Everett Smith, 2015 University, was concerned with the amount of land already zoned commercial, and felt the clinic could be built elsewhere. Mr. Karl Johannessen, 1284 East 21st, Pauline Whitney, 1970 Columbia, objected to rezoning in this area. e Mrs. Urquhart asked to clarify, a rumor that all property wou~_c;1.. b~.._<?<?~,~r<;:~?~ on this street. She said Mr. Hodges had bought the property adjacent to his store, and this had apparently started this rumor. There was further discussion of best use of the property and effect on the neighborhood. I Mr. James Pearson, Planning Commission member, explained Planning Commission reasons for rezoning this property, and that it would provide a good buffer between the existing commercial property and the residential neighborhood. The Planning Commission felt the Conditional Use would provide controls which would make this development a real asset to the community. He explained a Planning Commission policy that uses the alley south of 19th Avenue as a boundary between commercial uses and siggle family residences. He explained there is a shortage of RG zoned property in the area, and that this decision was consistent with the policy of increasing density of land around the University. Mr. Charles Rhodaback, Planning Department staff, said the staff had recommended RG zoning, and felt the property should be used for multiple family housing. The staff was not in favor of the dental clinic. I' Mrs. Mary Krenk said she could understand a rezoning for multiple housing, but could see no need for a dental clinic here. There was Council discussion concerning action to be taken at this time. Mr. McDonald moved seconded by Mr. Teague that the rezoning be referred to the Planning Commission for a joint meeting with the City Council. Mr. McDonald explained that he was concerned with the conditional use, and felt discussion with the Planning Commission might clarify certain points. After Council discussion of the motion, a vote was taken. Mr. Williams, Mr. McDonald, and Mr. Teague voted in favor. Mr. Mohr, Mr$. Hayward, Mrs. Beal and Mr. Gribskov voted against. The motion failed. I II I I I I I In answer to Mr. Teague, Mr. Pearson said the petitioners had accepted the Planning Commission suggestion of RG zoning with a conditional use to allow a dental clinic as a valid compromise. Use of the clinic would limit density of residential use, and create less traffic through the varied use. .The exterior appearance would be residential, and parking and landscaping would be controlled through the conditional use. The condi- tional use would give safeguards not available with RP zoning, 'and 'woulcr.elif!"linate many uses allowable in RP zoning, which the Commission felt not compatible with the neighborhood. Specific conditions have not been imposed by the Planning Commission, since only preliminary approval has been given. Any conditions suggested by the Council can be incorporated. -- ~r Mr. Gleaves said there is no procedure for preliminary approval of a conditional use permit, and this was the reason he had suggested a Planned Unit Development. After further Council discussion, Mr. Mohr moved that the Council defer action on the ordinance relating to this rezoning until plans are before them detailing mutually arrived at conditions. Mr. Williams suggested that the Bill could be read, and held for final approval. Mayor Anderson agreed and said what the Council would be saying was that there was merit in the proposal, but the Council wanted to see the finished product. The City Attorney agreed. Mr. Mohr suggested that the Council change its order of business to hear Council Bill No. 9043 at this time. He felt it contributed to an improved outlook and that progress was being made. Mrs. Hayward asked for a report from the attorneys retained by the Council regard- ing possible court action in connection with field burning. Mr. McKinley said they had made a preliminary report on their progress, but more work was needed before bringing it to the Council. c. Liquor Control Commission Communication - Mayor Anderson read a letter from the Oregon Liquor Control Commission explaining their action in the Golden Canary tavern license hearing. He also read his reply; stating that it was his recommendation that the Council take action to seek guidelines from the Commission, and if these were not made available, that such reviewing procedure by local governments be more clearly defined in the Act itself, through action by the Legislature. He stated that the license application reviewing process should be public, whether by the City Council, County Government or Liquor Commission. Mrs. Hayward moved seconded by Mrs. Bea1 that the Council request some guidelines from the Oregon Liquor Control Commission in making recommendations, and that the Council should refuse to make recommendations unless they receive such guidelines. I The City Manager said he had corresponded with the Assistant Attorney General and suggested that if renewals were to be made on the basis of violation of statutes, there would be no point in City Council recommendation on renewals. probably the city's only function would be to supply police records. Councilwoman Hayward agreed that the Council should not make recommendations unless given guidelines. She felt it was the function of the Liquor Commission to hold public hearings. e Mayor Anderson suggested that the Council direct the Manager to prepar~ something for formal action by the Council to give the Commission notice of Council concern, and to request guidelines and suggestions. Mrs. Hayward and Mrs. Bea1 withdrew the motion. d. Committee on Aging - Mr. Teague said the Committee on Aging had met and discussed methods of transportation for disabled or elderly. They will communicate with the Joint Housing Committee regarding special designs to accommodate elderly or dis- abled, when building low rent housing. I e. If there are any questions, Council may schedule discussion for a future committee meeting. h. Chin;u Sister City Committee - Mrs. Catherine Lauris requested the Manager to extend an invitation to the Council to attend an informal reception celebrating the 9th Anniversary of Eugene's affiliation with Chinju, Korea, at the home of Mayor and Mrs. Anderson, Friday, January 9, 1970. i. Ordinance, Palmistry - Mrs. Hayward asked for a repo~t ~n enforcement of an ordinance relating to palmistry, and whether this Ordinance makes sense. e The Manager suggested that the Ordinance be reviewed during the codification process. In answer to Dr. Purdy, the Manager said the City has contracted with the Bureau of Governmental Research to codify the ordinances. They have been reviewed, sorted, and are now being individually studied by the attorney doing the work. The Mayor's Committee to review the criminal section of the .Code has been meeting with the Bureau Attorney on codification. Policy questions will be referred to the Council for decisions. This should be completed by the end of this calendar year. It will .be in loose leaf form, printed by the City, so it can be kept up to date on a weekly basis. I Mr. McDonald moved seconded by Mr. Teague to receive and place on file Items 19, lh and Ii. The Manager said since the committee mee~ing he had received m~teri~~ from the codification attorney, who had questioned the purpose of the .ordinance concerning palmistry. The City Attorney said he would report ~o the Council on this' Ordinance. Vote taken on motion as stated. Motion carried. 2. Progress Report, Lane County Auditorium Association - Mr. Lee Bishop, Chairman of the Auditorium Committee, said he had asked Mr. Ed Ragozzino to report to the Council. Mr. R gozzino said the consulting team has been selected. Potential users of the facility have met. Concept seminars will be held January 15 and 16, with the consulting team and potentia 1 users. Several individuals have requested that film facilities be included, and this aspect has been pr~gramed into the architects plan. Mr. Don Lutes, Architect, said he has done sit~ confirmation study, the general location has been fixed, and it is very well located. Parking is ~ne of the critical elements. It is hoped some plans can be worked out for joint use of parking. In answer to Dr. Purdy, Mr." ~utes said they have been studying): methods of providing park- ing in fringe areas, and bu~sing patrons to the auditorium. I Mr. John ~mundsen, Architect, explained the design concept and additional firms employed for the team. In answer to Mr. Williams, Mr. Amundsen said facilities in other cities had been oriented to performing arts - the concept of this facility is multiple use, and use both day and night. Broad utilization will strengthen economic viability. In answer to Councilman Mohr, Mr. Ragozzino said the Council will be called upon to make decisions regarding the new facility. A potential user may appeal to the City Council. . Mr. Ragozzino said the Association is on schedule and hopes plans can be completed in time for voter consideration. Mr. McDonald moved seconded by Mr. Teague to receive and place on file Item 2 of the Committee report. Motion carried. 3. Council By-Laws - Dr. Purdy suggested Page 4, 3b should be amended to include provision for 24 hour public notice of any executive session. Dr. Purdy suggested under "Council Procedures" that prov~s~on for presentation."ofmotions by President and Vice President should be restricted to regular sessions of the Council. After further discussion about public notification, it was decided to provide for 24 hour public notice under 3d. This could be accomplished.by announcement at the regular meeting, or other notice, if a meeting was not held. Ii ,I I I On Page 5, Section 6, it was suggested the words "President and Vice President" be inserted after "Executive Session". On page 7, "List of Candidates," it was suggested the Budget Commission be "nominated," rather than "appointed." Page 9, 6b, beginning of third sentence, strike "In such event," starting sentence with "The counc i 1man. . . . " On Page 8, 3b, "Notice of Committee Appointments," the Mayor asked if it might not be possible to include notice of selection of committee members on the Agenda. It was decided the Agenda was public notice, and public notice should not be given before Council approval. It was decided the Mayor could send out a separate notice with the agenda. No change in wording is required. Mrs. Hayward said wording had been worked out in Section 3b to provide for written notice of executive sessions which were not announced at public meetings. Study of Maintenance Shop Facilities - Space Utilization Associates is studying facilities for Lane County, since the County must move its maintenance shop. Manager asked for authorization to proceed with a contract for a joint study, since the City four shops, all of which are in need of more space. Possible combination of city- county facilities will be investigated. Approximate cost will be $6,000. has Councilman Teague felt such a study would be beneficial to the City. Dr. Purdy moved seconded by Mr. Gribskov that the Council authorize the City Manager to contract with SUA to study shop facilities. Motion carried.
