Regular meeting of the Common Council of the city of Eugene, Oregon was called to order by His Honor
Lester E. Anderson at 7:30 p.m. on February 9, 1970 in the Council Chamber, with the following
Councilmen present: Mrs. Hayward, Dr. Purdy, Messrs. McDonald and Teague, Mrs. Beal, Messrs. Mohr
and Williams.
Minutes of the meeting held January 26, 1970, were approved with the following correction:
"Page 3, Paragrpph 5, vote on amendment should be reversed, and delete Mayor's vote, since
he did not vote on the motion"
Parks Department Award
Manager displayed placque' received by Parks and Recreation Department for Grand Award Winner in
Class III of 1969 Gold Medal Award competition for excellence in Park and Recreation management.
This award was presented by the National Sports Foundation.

The Director of Parks and Recreation explained that Class III included cities with a population from
50,000 to 100,000. The placque was accompanied by a $1,000 prize.
Mayor Anderson congratuled Ed Smith, P~ks Director, and the Parks Department, for their fine work.
COMMITTEE REPORTS

to the Joint Housing Committee.

of the Firefighters concerning time off for holidays. Mr. Mohr will act as chairman.
Mr. McDonald moved seconded by Mr. Teague to receive and place on file Item la of the Committee
report. Motion carried.
b. Liquor Control Commission - Mayor Anderson reported on his meetin~,with the Liquor Control
Commission. He previously distributed to the Council copies of a statement by the Commission
which was presented to him when he came before them. He said it was unfortunate that the
conversation at the meeting did not take a very constructive note,-and they never really
got down to discussing this particular statement. He pointed out that some of the things
the Council had s ~gested were included in the statement, but they did not at the meeting,
indicate any inclination to develop guidelines. The Mayor recommended that the Council wait
for further developments.

Mr. McDonald moved seconded by Mr. Teague to receive and file Item lb of the Committee report.

c. Peti~ion, Skinner Butte Cross - Mayor Anderson commented that the Council, by not taking
action at the last Council meeting, had felt the petition to designate the cross a war
memorial would appear on the ballot at the "next election". A question arose as to
what would constitute the "next election."

The City Attorney said he would address himself to this question at a later date, since
he had corresponded with the SeGretary of State and Attorney General requesting inter-
pretation of the statute pertainigg to placement of a charter amendment on the ballot.
The Council could set a special election if it placed the measure on the ballot, but
since it "did not, there is a question of interpretation of the statute.
The City Attorney distributed a memo to the Council regarding date of election for initiative
measures presented to the City Council for action prior to February 26, 1970. After reviewing
appropriate sections of State law." City Charter and Code, the Attorney found initiative measure
may be placed on the election ballot of the first election more than 90 days after presented to the
Council. Since Eugene does not automatically have a primary election, it will be necessary for the
Council to enact an ordinance establishing a special election. Otherwise, any initiative measures
will not be on the ballot until the November election.
Dr. Purdy moved seconded by Mr. McDona~d that the City Council declare May 26, 1970 the date of a
special City election.

Mr. Oral Robbins, Commander, Eugene Post #3, American Legion, said they had passed petitions for
signatures, and had told signers the election would be in May. He requested the City Council to
pass this motion, so that an election could be held at that time.

Mrs. Beal was not sure the Council should act in this matter. Dr. Purdy explained that people had
expected to be able to vote in May, and that his motion would enable the Council to call an election
'without making a, recommendation.

d. caurel Hill Citizens Committee - Mr. Williams asked if it would be proper for the
Council to defer development for a reasonable period of time on conditional use permits
and PUD developments in this particular area, and whether it would be appropriate
to prohibit issuance of building permits for C-l property in that area, to defer
development until such time as a plan was developed for the entire area.
The City Attorney said the City would be legally required to issue a ,building
permit for any outright use on any property. A moratorium could be called with
regard to conditional use or planned unit developments, which are subject to criteria.
Mrs. Hayward asked if building permits comilld be denied because of lack of sewers.
Director of Public Works said Lane County Sanitarian could deny building permit
because of health hazard, but it was his opinion that this area was entirely
sewered.
In reply to:Mr. Williams, Planning Director said he would like the Council to
take some action, and had suggested that Mr. Durchanek come to the Council. He
felt the Planning Commission was an advisory body of the Council, and that estab-
lishment of a citizens committee would have to be sanctioned by the City Council.
Mr. Williams moved seconded by Mrs. Beal that the Council endorse the request of
the Laurel Hill Citizens group to meet with the Planning Commission and develop
a general plan for the area, and that the. Council ask the Planning Commission to
take their views into consideration when developing a g~neral plan for that area.
This should be completed by July 1st. Conditional Use Permits should be restricted
while the plan is being developed.
Mr. Allen pointed out that use of septic tanks is not a basis for denying a permit
in the City. If they are required, they must meet the approval of the Lane County
Health Department, even though they are inside the City.
Vote taken on motion. Motion carried.
Mayor Anderson left the meeting and Vice President Teague took the chair.
Mr. McDonald moved seconded by Mr~ Teague that the Council direct the Planning Commission to work
with residents of the Laurel Hill area to develop a general plan for the area by July 1, and
that no conditional use permits be issued in the interim.
Councilwoman Hayward said she had read testimony presented by citizens of Laurel Hill at a previous
meeting, and had some questions relating to the area.
In answer to her question, the Manager said the City of Eugene is still operating under the 1959
General Plan, which inrlludes the Laurel Hill Area. This plan will be in use until the new General
Plan has been adopted. He said the questions of traffic, schools and parks were all considered
by the Planning Commission at the public hearing for zone change.
Mr. Harold R. Holets, 1702 Riverview Street, said he was a member of the Laurel Hill Citizens
Association, and invited the Council to attend a meeting Thunsday evening, when they will attempt
to get acquainted and get the General Plan for the area started. He discussed the changes the
suggested housing project will create in their valley, and suggested that there may be better
understanding of suggested zoning when they have met and studied the proposed general plan.
In answer to Councilwoman Hayward's question, Planning Director said a portion of Mr. Weaver's
property is zoned C-l and this allows density up to R-4 under the old plan.

In answer to Councilman Mohr's question, Mayor Anderson said the motion should state that no
conditional use permits may be issued during the term of this study.

.'. . e. Traffic Speed - Mrs. Hayward asked the Traffic Department to investigate speeds
on Emerald Street between 28th and 24th. Mrs. Scott McFadden had called this to
her attent'ion. Traffic Engineer will investigate.

f. Liquor License Application - Re-application for construction of new tavern (Brass
at 746 West Park, Vernon Bonner, RMBA. Council approved this previously, but
construction has not proceeded on schedule and it must be reapproved.

the foregoing license, contingent upon confirmation at the next Council meeting.

2. Sidewalk Installation - Staff has recommended installation of sidewalks in .the area bounded
by Willamette Street, 29th Avenue and Washington Street and 24th Avenue. This IDS
Frances Willard School Area. Council toured the area prior to the meeting.

There was discussion about a public hearing and notification of property owners.
Public Works Director explained rthat, if bids are not rrwarded immediately, property owners
have an opportunity to save money oy installing sidewalks themselves. Mrs. Beal was
concerned some low income'persons might be included in the area and would be financially
unable to install sidewalks.
Mr. Gribskov moved seconded by Mrs. Hayward to initiate action on sidewalk installation
in the area bounded by Williamette Street,_29th Amenue. W~~ington Street an1=24th

Public Works Director commented that the improvement ordinance could be scheduled at
a public hearing in the future.

Mr. McDonald moved seconded by Mr. Teague to approve Item 2 of the Committee report.

Mayor Anderson suggested the Council delay discussion of the merits of this installation until a
public hearing is held. City Manager said an initiating ordinance will be prepared to be considered
at the night of the hearing, rather than wait for bid opening to hold a hearing.

3. Street Improvement - ~C~eshi~e/from High Street west to existing improved area. In answer
to Council questions, the Public Works Director said there are private property owners
on one side of this street, and they would be assessed for the curb.

No action was taken - formal action to be taken at regular meeting.
In answer to Manager's question, Director of Public Works said property owners had been notified,
and no protests had been received. Public hearing wIll be called at time of bid opening, at_ which
time property owners may be heard.

High Street west to existing improved area. Motion carried.

The staff agrees with ~tate recommendations exeept on Bailey. Hill Road, Elmira .Road
from Maple to Bertelsen and Goodpasture Island Road, Norkeznie to West City Limits.
It is the staff feeling in thes~ instances that the speed should be incre~sed to
40, rather than 45.

The traffic engineer outlined the manner in which speed records are made, and that
the State has jurisdiction over speeds set in all Cities and Counties, as well as
the State. Dr. Purdy and Mr. Gribskov felt speeds should not be higher than now
posted in areas.around schools or school bus loading areas. The Traffic Engineer
explained that speeds are set to conform to speed cars are driving. Posting does
not change the speed of drivers, but proper posting keeps them within the law.
After further discussion of speeds and accident rates, it was decided this matter
should be considered at the regular meeting.
Mr. McDonald moved seconded by Mr. Teague to approve the staff recommendations regarding posted:

1. That the City Council revoke Resolution No. 1602 restricting residency requirements
of six months within the City for applicants of the Leased Housing Program. This
action w?s taken due to a recent Supreme Court decision relating to the unconsti-
tutionality ~f residency requirements in federally subsid~zed programs.
2. That the City Council enter into discussion with Lane County Commissioners on the
following items:
a. Securing approval to utilize Eugene's Leased Housing Program in
unincorporated areas outside the City.
b. Suggesting that the Lane County Commissioners consider the establishment
of a Leased housing Program within the County.
c. Request financial support to the office of the Housillgg Expediter.
d. Discuss the role of the Lane County Housing Authority, as it is understood
by the Lane County Commissioners.
,Mrs. Betty Niven, chairman of the Committee, discussed the recommendations and cmarified
several points. She explained that the Housing Assistance Administration will not fund
additional federal programs unless the residency requirement is abolished. The committee
suggested that the Council ask Lane County to consider establishment of a Lane County
leasing program.
Mrs. Niven explained that the Housing Authority has the impression that Lane County Comm-
issioners have directed them to concentrate their efforts on housing for the elderly.
The Committee has requested that they consider data collection and other kinds of develop-
ment.
Mrs. Niven further explained that; when the positi9n of housing expediter was created it was
hoped a master list of people receiving shelter aid could be prepared. This will require
the cooperation of the Housing Authortty, Welfare Department, Assessor's office and
others involved in housing. She asked Council approval of a letter to be sent to all
processors of housing aids, requesting assistance in preparing such a list.
Mayor Anderson indicated that. Eugene had gone ahead with a leased housing program, but
now finds itself in a position of trying to get help from other areas, and seeking better
coordination with other jurisdictions.
After further discussion, Mr. McDonald moved seconded by Mr. Teague to adopt the recom-.
mendation of the Joint Housing Committee as outlined above, and authorize Mrs. Niven to
proceed with her program of requesting information from the various agencies charged
with providing shelter aids to low income families. Motion carried.

2. Firefighters Request - The firefighters have requested a charter amendment requiring
collective bargaining between the City and those groups who wish to set up collective
bargaining and have requested the City Council to place this amendment on the ballot at
an election. If the Council does not grant this request, firefighters propose to have
petitions signed and submit an in~tiative.'

Mr. Pat Flynn, Business Agent, Eugene Firefighters Local -~4A, asked the. Council to
refer a proposed charter amendment on the 1970 primary ballot without prejudice. He
explained firefighters re~sons for this request, and said that if the Council refuses
they will circulate petitions. He said they have only 14 days, but are cOnfident
they can obtain the necessary signatures.
Mayor Anderson commented he hoped the Council would not follow the recommendation of the
firefighters in this case. He felt this would be premature, since a special ad hoc
committee appointed by the Council has been meeting regularly, and will present a
report within the next month.
Mrs. Beal felt the Council would be doing the committee a great discourtesy if it
did not wait for its recommendation.
Mr. Flynn said they had applauded appointment of this committee, but felt it was moving
too slowly and/that it would be 1971 before any action could be taken.
After further discussion, Mr. McDonald moved seconded by Dr. Purdy that the Council
table the request of the firefigheers. Motion carried with all voting in favor but
Mr. Mohr.
Mr. Jackson asked the Cit~ Attorney for a ruling on when a petition would have to be in.
City Attorney said an initiative measure would have to be s bmitted to the Council 90 /
days before an election. It would have to be submitted to the Council at its February
23 meeting.

4. Park Dedication, Planning Commission Recommendation - Planning Commission recommended
City Council accept dedication of land from Paul Lafferty with the understanding an
assessment for sewers be taken out of the City Park Budget. They suggested Mr. Lafferty
be requested to allow the City, if it seemed necessary in the future, to either trade
or sell that land, if the proceeds were used for park purposes. Manager felt this
could be worked out.

Mr. McDonald moved seconded by Mr. Teague that the Council accept the Planning Commission
, recommenclation regarding dedication of property for parks purposes by Paul Lafferty,
and 'that the assessment for said property be paid out of parks department budget, and
that Mr. Lafferty be requested to permit the city to trade or sell the land if necessary,
for future park purposes. A letter of appreciation should be sent from the Mayor and
Council. Motion carried.

5. Bids, Demolition of Building at 2469 Miami Street
Mr. McDonald moved seconded by Mr. Teague that the contract be awarded to Atlas Crane
Company, low bidder, for demolition of property located at 2469 Miami Street.
In answer to Councilman Williams City Manager said a lien is placed on the property
for this assessment.

Manager read a letter from Mr: Gordon R. Lamb stating that the Planninz Commission would not
~onstruction to proceed on their property (Lots 44 and 45) until Sylvan Street is improved.

The Direc~br of Public Works said this would in no way qualify for a deferred assessment. In
answer to Councilman Purdy, the Manager said it was his understanding the street abutting the
property was dedicated, but ther.e was no dedicated street connecting the property, and there was
therefore no way out. A Minor Subdivision was denied because there was no continuous dedicated
street to serve the property.
Mr. Lamb said the Planning Commis$ion had written saying the subdivision had been approved. The
Planning Director said there was no minor subdivision involved. Mr. Lamb had requested dedication
of the street so he would not 'be required to apy assessments on it. The Planning Commission would
not allow development until there was street access.

Mr. Lamb said it ,was possible to get to the property, and that he drives over it. Manager suggested
staff be authorized to meet with Mr. Lamb and,attempt to straighten out this problem. As faraas
the assessment is concerned, there is no precedent to defer the assessment, since it doesn't meet
criteria for deferment of assessment. Manager recommended ,passage of the ordinance.

Manager read a letter of protest from Mr. Wilbur Crum, 2330 Floral Hill Drive, and the reply of I
the Public Works Director, stating that the City had no choice qut to assess Mr. Crum for the new ,
project. ,He explained in the letter that the sewer to which Mr. Crum is now connected was completed !
in 1958 and owners involved were assessed at that time. Sin re his property was not part of the ,
system nor within the city l~mits, an assessment was not levied. In May of 1963 Mr. Crum annexed I
to the city of Eugene for the purpose of attaching to the sewer. No assessment was made at that
time because the previous system had been paid for by others, and the Department was aware that a 1
separate system would eventually include Mr. Crum's property. On November 21, 1968, property owners i
located to the south petitioned the City Council to construct the sewer system which illncludes Mr. I't
Crum's land, and Mr. Crum was mailed a call for bids and proposed assessment. No answer was received I
, ,
and no ~rotests were lodged at the, public hearing. The Director of Public Works explained that I
attaching to a system already paid for does not relieve Mr. Crum from paying for a sys,tem required !
for his property and other adjacent properties. If he was 'not required to pay the assessment,
the other property owners would be required to pay a higher assessment, which would not be equitable.
Mr. Crum has ,had seven years use of an existing sewer system at no charge.

Mr. Crum explained that he obj ected to paying a higher charge. He had been quo,ted an assessment
figure of $420.71 for the original sewer, and did 'not feel he should be required to pay a higher
amoun t .
In answer to Councilman Williams Public Works Director said if Mr. Crum had been assessed for the
original sewer, he could not now be assessed again.

Mrs. Niven explained assessments made against her property, and that'it could be conceivable that
Mr., Crum could still be assessed if a sewer were to be run along another side of his property.
