Regular meeting of the Common Council of the city of Eugene, Oregon was calied to order by His
Honor Lester E. Anderson at 7:30 p.m. on February 23, 1970, in the Council Chamber with the
following councilmen present: Messrs. McDonald and Teague, Mrs. Hayward, Messrs. Purdy, and
Gribskov, MFS. Beal and Messrs. Mohr and Williams.
Minutes of the meeting held February 9, 1970, as mailed to Council members, were approved.
Appointments - Mayor Anderson announced the appointment of David G. Sparks to replace Douglas
Orme on the Library Board, for a term ending January 1, 1974.
Dr.Purdy nominated Mr. James L. Hershner; as a freeholder for Ward 3 on the Budget Committee,to
replace Wilfred R. Stephens. Term ends December 31, 1972.
Mr. McDonald moved seconded by Mr. Teague that approval be given to the appointments listed above.
Motion carried.
All-America City. Eugene - Mr. Wally Olson, representative of Curtis Publishing Company congratulated
Eugene for being the only city in the entire western half of the United States to be selected as an
All-America Award City. Mr. Olson presented an engraved copy of Look Magazine to the Mayor.

Initiative petitions - The City Attorney reported that on City initiative measures, petitions should
be filed more than 70 days prior to date of the next election. Therefore, petitions could be placed
before the Council at the next regular Council meeting for placement on the Ballot at a special elec-
tion to be held in con4unction with the statewide primary.

The City Attorney said the recorder must present the proposed amendments to the charter to the Council
and the Council must take action to call a special election in conjunction with the state election.

a. Preliminary Budget - Items for consideration for preliminary budget should be
submitted to the City Manager not later than February 28, 1970
Mr. McDonald moved seconded by Mr. Teague to receive and place on file Item la of the Committee
report.
City Manager commented that the first budget committee meeting will be in the second week of March.
Vote taken on motion. Motion carried.
b. Human Rights Ordinance - Councilman Mohr was concerned that, in a recent discrimination
case, the defendant elected to forfeit bail of $100, rather than appear for trial.
Councilman Mohr suggested that the bail be increased to $500 to discourage for-
feiture, and co~tinuation Of discrimination practices by owners.
Mr. Mohr requested that the City Attorney prepare an amendment to this effect, and
that a section be added requiring a condition to a contractual ag~eement with the
city of Eugene that a contractor must sign a statement of compliance with the pro-
visions of the Human Rights Ordinance. Councilman Mohr felt this represented
another major step to provide for application of the principles of the City's
Human Rights Ordinance.
Mr. McDonald moved seconded by Mr. Teague to receive and file Item lb of the Committee report.
Mr. Mohr seconded by Mrs. Hayward moved to amend the motion to file this item, and request the Human
Rights Commission to consider a proposed amendment to the Human Rights Ordinance. regarding. anti~ -
discrimination certificates in city contracts and increasing the fine for violation. Motion Carried.
c. Council By-Laws - Councilman Mohr suggested amendment of Council By-Laws to require a
2/3 vote on any Council Resolutions for passage.

In reply to Dr. Purdy, the City Attorney said he would report to the Council whether
this was a 'provision of the charter, and whether a charter amendment would be
required if they wished tq accomplish this.

e. Noise Control - Councilwoman Hayward asked if there was some way to effectively
enforce an ordinance controlling noise, especially as it relates to vehicles. Manager
said there is such an ordinance'in effect, but it is difficult to define noise.
Mrs. Beal suggested that studies he made of ordinances enacted in other cities,
and success with enforcement, and means to provide enforcement.
Mr. Ray said the City has a machine for measuring relative decibels, but its noise
limit is evidently set too low. Planning Director said the zoning ordinance provides
for limitation of noise level for new industry. He said the Community Goals state that
the City should press for state action on noise control.

f. Air Pollution - Councilwoman Beal suggested that the amount budgeted by the City for
Lane Regional Air Pollution Authority should be increased sizeably. It was her
opinion that increased staff and equipment were a must if pollution was to be
eliminated in this area.

Councilman Teague, Council representative on the Authority, said a budget is being
prepared at this time, which would be presented to the State and Federal governments,
as well as to, the Cityc~.., In reply to Councilwoman Hayward's question, Mr. Teague
said the Authority would undoubtedly increase its scope if it felt the City and other
jurisdictions were willing to increase budgets.

Mayor Anderson said it should be recognized that this is a regional problem and the
pieces must be fitted together. He said Central Lane Planning Council has a
proposed health plan, a portion of which will be to assess environmental health
problems to recommend priorities for further environmental health programs. The
City should get the benefit of their thinking and developments before proceeding
into a program which may not fit into the overall regional objectives. He
suggested that a meeting should be arranged to get all ideas, before committing
any money.

Mr. Teague said he was sure the budget commiteee would be mindful of this Council
discussion, and that the Council, as well as other government bodies would support
a larger program if they can justify it.

Mayor Anderson suggested that the committee go ahead with its budget, and if they
wish, bring it back to the Council for ffiossible revision or expansion.

g. Proposed 1990 General Plan - Councilwoman Beal was concerned about pqssible differences
in population figures used for preparation of the General Plan and those used by
Eugene Water and Electric Board in their power need estimates. She felt it was
extremely important to be sure those in use for the General Plan were correct.

Mayor Anderson said that there would be many public hearings before this plan was adopted,
and ample opportunity for changes.
City Manager said the Planning Commission is in the process of developing a schedule
for a series of meetings on this'plan. Councilman Gribskov agreed that the plan
will come under very careful scrutiny and changes will be made.

Mrs. Hayward seconded by Mrs. Beal moved to amend the motion to direct the City Manager to seek
out projected population figures from appropriate agencies to resolve the discrepancy between those
quoted in the 1990 General Plan, and those quoted by EWEB to arrive at future power needs. Motion
carried.
The City Manager said he knew Central Lane Planning Council had reviewed their population projections
a number of times, and he felt sure he could find the basis for EWEB projections.

h. ..Electrical Code Committee - Councilman Teague reported that the committee appointed
by the Council to investigate changes in the Electrical Code has had a meeting with
various interested people, but haven't finished their work. They will report back
as soon as possible.

i. Lane County Housing Authority Board Meeting - City Manager announced Lane County Housing
Authority Board is meeting February 17, at 6:30 p.m. and has invited members of
the Joint Housing Committee and Council to attend. Mr. Williams and Mr. Gribskov
will represent the Council at this meeting.
Mr. McDonald moved seconded by Mr. Teague to receive and file Item II of the Committee report. Motion
carried.
j. Alton Baker Park Committee - City Manager and Parks Director attended a meeting to
discuss overall development of Albton Baker Park. County Commissioners have
proposed proceeding with initial phase for development as soon as possible. Man~ger
outlined plans and said the proposed budget of $300,000 is for the 20 acres
first phase development. Council should meet with Lane County Commissioners to
align responsibilities so that both govermimgtbodies have an idea of the extent
of participation by agencies they represent. Phase I can be developed without
any interference with total development.

Mr. McDonald moved seconded by Mr. Teague to ap'prove Item lj of the Committee report.
Financing, Cul-de-sac Construction, Portland Street - Construction of a CuI de sac on
Portland Street between 29th Avenue and 30th Avenue is considered mandatory in order to
relieve through traffic on Portland Street, which would be intensified if denser residen-
tial zoning is permitted. Since it is believed that denser .residential zoning is app-
ropriate for the area west of Willamette Street, and since previous zoning decisions
by the City have caused some of the existing problem, the staff recommends that the City
construct the cuI de sac and charge property owners in the area their proportionate
share of costs at the time they obtain rezoning. City would be the interim financier
of the cuI de sac. Staff recommends this policy be followed.

Motion
The City Attorney has indicated some court cases show the City could not close this street without
consent of property owners using the street. Zoning decisions must be based upon proper land use,
and cannot be contingent upon paying of costs. Assessment procedure would have to be through
regular assessment district, with city making, assessments to cover cost, and asking City Council
to defer benefits until such time benefit accrued to the property. Manager suggested the item be
tabled.

This area is almost surrounded by City property. Staff recommends proceed with

Dr. Purdy moved seconded by Mr. Williams to refer annexation of property located west

Foreclosed assessment redemption policy - Foreclosure sale for property located at 843
Snell Avenue was held January 8, 1970. The owner now ' wishes to regain title. Manager
recommended the City make every effort to help property owners retain their property,
provided they comply with the statute requiring a 10% penalty plus 10% per annum, and
that complete redemption be made within one year after the deed has been issued to the
City. Since the deed is issued from 12 to 14 months after date of sale, property
owner has between 24 and 30 months to make redemption. Staff recommends proceed with
this property owner, and asked council direction on desirability of policy.

Mr. McDonald moved seconded by Mr. Teague to approve Item 4 of the Committee report.
Dr. Purdy questioned the length of time allowed property owners to redeem property, and the Manager
explained that after the deed is issued, property owners still have the right to redeem their
property with payment of certain penalties. At the end of the second year the city would start
quiet ti~le proceedings.

5. Gas Company Franchise _~h~.rate of payment was subject to reppening on July 1, 1969.
Northwest Natural Gas Company has agreed to increase the percentage rate of compen-
sation from 2% to 3%. This would be retroactive to July 1, 1969, and would continue
through the ~O year remainder of the franchise term.
In answer to Councilman Williams, the City Manager saidt,cthe 3% franchise is in addition
to property taxes. He said he would attempt to determine what tax the gas company pays,
in addition to the 3% franchise. He explained that the franchise percentage is considered
by the Public Utilities Commission ~s one of the costs of doing business when the rates
are set;
Dr. Purdy moved seconded by Mr. Gribskov to approve an increase in percentage rate to
3% and authorize the Manager to sign the contract. Motion carried.

6. ~mprovement Petition - Petition to pave an alley between 14th Avenue and 15th Avenue from
Pearl Street east 1/2 block was signed by owners of 50% of the property to be assessed.
One letter of protest has been received from the property owner on the north side. Staff
recommends approval, since this is approved by 50% of the front footage, and is in a
commercial district.
Mr. Gribskov moved seconded by Mr. Teague to proceed with consideration of improvement
of alley between 14th and 15th from Pearl Street east 1/2 block. Motion carried.
Mr. McDonald moved seconded by Mr. Teague to approve Item 6 of the Committee report. Motion carried.
7. Segregation of Assessment - Mr. Ray C. Borger, 2740 Homestead Place, has requested segre-
gation, since a portion of a lot is being sold. $70.06 will be segregated, leaving a bal-
ance of $1,566.70. Staff recommends approval.
Mr. Gribskov moved seconded by Mrs. Hayward to approve segregation of assessment, as
recommended by staff. Motion carried.
Mr. McDonald moved seconded by Mr. Teague to approve segregation of assessment on property located
at 2740 Homestead Place. Rollcall vote: All councilmen present voting aye, the motion carried.

8. National League of Cities Conference - The Manager explained that the Mayor will be
attending this conference at the expense of the League of Oregon Cities; since he is
President. Council may authorize attendance of Council members. After a poll of
Councilmen present, Mr. Teague moved second~d by Mrs. Hayward to authorize Mrs. Beal
and Dr. Purdy to attend the Congressional-City Conference in Washington, D. C. March
8-10, 1970. Motion carried.

9. Correspondence - The City Manager read the Mayor's reply to an answer received to his letter
of December 15 to President Nixon, and accompanying fact sheet. No reply has yet been
received to the Council Resolution mailed to the President and Oregon representatives.

1. Items from Mayor and Council
a. All-America City Award - Councilman McDonald announced that Eugene was one of eleven
cities in the nation to be named All-America City. In the Mayor's absence, he
conveyed thanks of the Council to the citizens of Eugene and the many committees
involved, and especially to the JC's, who spearheaded the effort.
Dr. Purdy suggested it would be appropriate to write a letter of thanks to the
Junior Chamber of Commerceefor their efforts to win this award. Councilwoman
Hayward thanked Ed Kenyon, who wrote the presentation. The City Manager said
March' 6 has been set aside as a day of celebration, and Mr. Ray reported that
Look Magazine and Municipal League representatives will be in Eugene to present
a plaque and All&America flag.

Councilman Williams suggested the Council officially take action congratulating
the J.C;'s, and moved seconded by Dr. Purdy to request the staff to prepare a
resolution congratulating the J.C. 's for sponsoring our All-America City.
Motion carried.

b. Special City Election - Councilwoman Hayward questioned the City Attorney regarding
procedure for certifying signatures for initiatives for the city special election,
and when the last poss~ble day would be for certification. City Attorney explained
that they must be presented aththe February 23 Council me~ting, unless ~he Council
wishes to call a special meeting. He said it was possible the County Clerk might
hire additional help to facilitate certifying of signatures, but that this was out
of the City jurisdiction.

Mrs. Hayward reported she had called the County election office and found that state law permits
the County to have 15 days beyond the City deadline for validating signatures. City Attorney
explained that they must be presented to the Council 70 days before election, which means they
will have until the March 9 meeting to validate signatures.

c. Committee to Review Employe Relations - The City Manager said Mr. Robert Fraser, chairman
of the Ad Hoc Employer-Empl~ye Relations Committee, had informed him the Committee
was prepared to make an interim report to the Council, and would have material
available before the regular Council meeting, if the Council wished to scheduleaa
discussion for that time.

Dr. Purdy asked that the Council meet on another night, so that they can give the
report undivided attention, and perhaps analyze the effects of the proposed charter
amendment. Councilman Williams said he disliked scheduling a meeting until he
had reviewed the report. Councilwoman Hayward felt the Council should meet with
the committee as soon as possible, but she felt there should be sufficient time
for an unhurried meeting.
Messrs. Teague, McDonald and Gribskov agreed that the Council should have. an oppor-
tunity to read the report pefore scheduling a meeting, and that another evening
would be preferable. Mr. McDonald suggested that a meeting be scheduled for
Tuesday, February 24. This being agreeable to most councilmen, the Manager will
attempt to set ,up .a meeting 'at this time.

The Manager pointed out that the Committee report has not yet ,been received, and in view of the fact
that only five councmlmen can attend, it might be well to ,postpone the meeting. 0 A poll was taken,
and it appeared that Tuesday, March 3, would be the best night to meet. In answer to,Mr. Mohr's
suggestion that they study the report on Wednesday noon, the Manager explained that Mr. Fraser's
committee cannot get together at noon. Mayor Anderson suggested the Manager look at the material,
make a decision about the meeting, and'notify the Council.

2. Planning Commission Report, February 3, 1970 - Planning Commission recommended deletion
of Mobile Home Parks as a listed outright use in Mel Limited Industrial Zone, suggesting
that such a use be "Conditional" in this zone. The recommendation proposes deletion of
mobile home parks entirely from M-2 Light Industrial Zones. The recommendation recognizes
that mobile homes are a form of residence, and as such, properly belong.inresidential or
commercial zones. With this change, they would be conditional uses in RA, Suburban~~~~-
dential; R~3, Multiple Family; RG Garden Apartment; C-2 Community Commercial; and C-3
Central Business Zones. Experience indicates that permitting mobile home locations
in'industrial zones results in incompatibility with industrl'al

Mr. Williams was still concerned about 'the propriety'of this change. The Manager said he had a memo
from Mr. Porter which had not been received early enough for distribution. Mi. Williams moved sec-
onded by Mr. Mohr to pos.tpone action on Item 2 until the next Council meeting. Motion carried.
3. Topics Program Agreements, State Highway'Department - Federal Highway funds are available
for improvement of intersections at Highway 99 N and Pratt~e Road, and Highway 99 at
Roosevelt. This would include installation of fully actuated signals, widening and
re-aligning the intersections, and at Prairie Road, installing drop armiailroad cross-
ing protection. This program would be funded with 20% city money, 20% state money and
the remainder, federal money. ~he state will allow the city to design the project so
that it will be compatible with the city system. There are some questions about the
contract, but it will be brought for approval when these are settled. Funds have been
budgeted for the projects.

4. Joint Housing Committee Recommendation ~ The 'Joint 'Housing Committee has requested support
for Lane County Housing Authority request to the Department of Housing and Urban Devel-
opment for an increase in the amounts that leased housing rents can be ,subsidized. This
would not result in an increase in tenant rents, but would assist the Housing Authority
to keep leased housing when leases are renegotiated. Each lease would be handled separately.
Councilman Williams explained that the Joint Housing Committee is requesting the City
Council to give moral support, since the 'City feels this is one of the best methods of
providing housing for low income persons. In answer to Councilman Teague, Mr. Williams said
this wQuld be based on the amount that the average rent has gone up in the private sector.
It is geared to inflationary factors. Iu'answer to Mr. Teague"s request for the amount
of increase, the Planning Director said he would provide these figures at the regular meeting.
Mrs. Hayward moved seconded by Mr. Williams to support action of the Housing Authority in
an ,attempt t~ increase rents ~hat may be paid to landlords for the leased housing program.
Councilman McDonald said increased budgets have caused increased taxes, and it would be
unfair to ask the Authority ,to attempt to rent homes at the 'same figures as they did a
year or two ago.

Mr. Williams assured the Council that the Housing Authority was aware of inflationary
trends, and did not want to drive up the price of other property in the area by their
action. Mr; Gribskov, and pointed out that HUD will'make the decision.

The City Manager'read a report from the Housing Expediter which stated that the Housing Authority
had suggested raising rents to landlords from 12 to 15%, which is the increase in market rates in
this area. The memorandum explained that participating owners would not be affected automatically
but that each owner would be handled separately when his 'lease was 'renegotiated. If the Housing
Authority felt the request was not justifiable,' the owner could remove his unit from the program.
Vote taken on motion as stated. Motion carried. '

EWEB Property Transaction Requests
Deed to Lane County for land purchased by EWEB along West Belt Line during joint
right of way purchase program. EWEB has asked for City Council approval to deed
two properties to the County in comnection with acquisition program for construction
of transmission line. .

6. Easement Purchase, Sewer - Mr. and Mrs. Frederick M. Combellack, 3021 Friendly, have
agreed to give an easement for sewer construction, provided a pyament of $95.00 is
made to cover damage to shnubbery. Staff recommends payment of this amount, since
it is a reasonable cost for damages. No action was Baken at this time.
Mr. McDonald moved seconded by Mr. Teague to approve payment of $95.00 to Mr. and Mrs. Combellack,
3021 Friendly, to cover cost of damage to shrubbery. Rollcall vote. All councilmen present
voting aye, the motion carried.
7. Correspondence - A letter from Governor Tom McCall 60nveying appreciation to the City
Council for support of his position on sotrage of nerve gas in Oregon; letters of
commendation to the Police Department.f~om Weyerhauser Company, the District
Attorney's office and'Howard School; and a letter from Oregon Park and Recreation
Society 'congratulating the community for winning the Gold Medal Awardffrom the
National Sports Foundation, were read at the meeting. An invitation to schedule
a demonstration ride in a helicopeer was distributed. The Manager said purchase
of a helicopter was not contemplated in this year's budget.

8. ERA Mall Lighting - Dr. Purdy requested a cost estimate on proposed "unbreakable"
lights to be used in the mall. He felt the cost might be prohibitative, and
something else should be considered.

carried.
9. Housing Authority Meeting - Councilman Gribskov reported on a meeting with Lane County
Housing Authority=Board, and said they will follow through with the City request for
300 units Tur~ke-yJiousing and will consider reactivating ,the application for 100 units
of leased housing requested last summer.
Councilman Williams said the Housing Authority agreed in principal with points out-
lined in a letter the Council authorized requesting information about applicants
and directing their staff to work with Mrs. Cushman to provide specific forms that
would eliminate duplication of information.
The Manager has written the County Commissioners requesting a joint meeting to discuss
and resolve some Council questions on the Housing program.
Mr. McDonald moved seconded by Mr. Teague to receive and file Item 9 of the Committee report.
Mr. Williams suggested minutes be corrected to say Housing Authority will consider reactivation
application for 100 units leased housing. Minutes corrected as above.

'l.o'~ Occupancy Permit, Baitis CompiLaint - Mr. Henry Baitis, who had requested abatement of a
house on East 43rd, objected to issuance of an occupancy permit, which he said was
issued December 1st. He outlined corrections required by the Building Department which
he said have not yet been completed.
Dr. Purdy requested staff to report on this situation, and comment on the occupancy
permit. He asked what steps, legal or otherwise, had been taken since the court
prohibited abatement.

11. Air Pollution Authority - Mr. Teague reported that the Air Pollution Authority is bringing
rules and regulations up to date, and is preparing its budget.

The City Manager read a letter from Mrs. Milildred JUdson requesting a del~y in construction of a
sidewalk in the 3200 block of Filmore (Project 13). She explained that she plans to build a home
on this site, and_ that heavy equipment would damage a sidewalk. At the present time contractors
are waiting for the ground to dry.
Public Works Director said there had been a change in conditions, and suggested that the bid be
held, and Mrs. Judson granted a delay until July 1, 1970.
Mr. McDonald, seconded by Mr. Teague amended their motion to delete No. 13 from approval.

In answer to Mrs. Hayward's question regarding signs at the ballpark, the Manager said the
staff had a number of meetings with management, and they are planning to increase their
off-st,reet parking area and planning to readjust the lights. They will add to police patrol
of the area, and plan to appeal to the citizenry to control their litter.
