councilmen present: Messrs. McDonald and Teague, Mrs. Hayward, Mr.

The City Manager distributed a questionnaire prepared by Mr. Ali Alidjani, who is doing a study
community priorities. It is requested that these be returned to the City Manager's 6ffice.
2.
City Manager said Mayor Anderson has agreed to call a special council meeting .Friday, March 13 at
12:00 noon in City Hall Council Chambers for further consideration of this petition.
3.
Public Hearing, Appeal to Conditional Use = In a letter to the Eugene City Council Mrs. Gordon
Barron has asked to appeal the decision of the Eugene Planning Commission not to revoke the
conditional use permit of Lakewood Mobile Home Park, and'has protested that some conditions of
the Planning Commission have not been met. The matter has been reviewed' with the City Building
Department and the City Attorney's office. Building Department indicates tree heights are not
in compliance with plans previously approved. Regarding turn-arounds, it is understood Eugene
Sand and Gravel is to construct them, but is awaiting favorable weather conditions. In answer
to Councilman Williams, Assistant City Attorney said that the pr0vision of the zoning ordinance
quoted by Mr. Williams deals specifically with revocation of license and provisions of zoning
ordinance. This matter pertains to conditions of the permit ,which have not been complied with.
The Council has no means for enforcement except revocation.
In answer to Councilman Gribskov, City Manager said the only alternatives the Council has are
to revoke or refuse to revoke the Conditional Use Permit. If it is revoked the operator must,
within a reasonable period of time, abandon the park or discontinue its use. It is the intent
of the Planning Commission to develop revisions to conditional use permit procedure to give
alternatives and enforcement powers.
In answer to Councilman'~eague's question, City Manager said a permit could be revoked for a
specified period of time.
Morvan Thomas, President of the Planning Commission, explained the Planning Commission action.
He commented that the Mobile Home Ordinance will certainly need amendment,. and that the Planning
Commission is in the process of studying that ordinance. He said the Planning Commission had been;
concerned at putting people out of their homes, and felt revocation was too drastic for the condi-i
tions not complied with. The Plannigg Commission sympathised with neighbors, but were unable !
to obtain compliance.
Regarding Councilman Teagues suggestion for revocation for a specified period, Assistant City
Attorney suggested continuing the public hearing for 60 days, at which time the Council could
consider again the matter of revocation. Owners should understand that if the situation has
not been improved, the Council will revoke the permit. The building department would be notified
the property must be vacated, and that it can no longer be used as a mobile home park.
Mr. Gordon Barron, 1540 Hughes, agreed with the Attorney's proposal. He said they felt this
would be a reasonable approach. He advocated amendment of the ordinance so that some other
course could be followed to enforce compliance.
Mr. Jim Britton said he was an engineer doing work for Lakewood Mobile Home Park, He agreed that
some procedural matters needed change, not because of errors in the past, but because of lack of
experience. He outlined problems and expense incurred, and explained that turn-arounds will be
constructed when weather permits. He commented on the 'Sign, and said the Board of Appeals had
recently permitted a vari~nce.
There was some discussion about Mr. Britton's statement concerning drawings and problems in
arriving at agreement on construction of paving. Public Works Director said his office had just
today received drawings, and that they had not been examined.
Councilman Mohr observed that if a vote were taken at this time he would vote for revocation. He
wanted the developers to know exactly where the Council stood and the seriousness with which the
Council views the matter. If the conditions are not changed, the Council will have no alternative
but to revoke the permit.

Mr. Gribskov, Mr. Williams and Mrs. Beal agreed with Mr. Mohr.
Mr. Larry Loper explained to the Council problems in planting trees, and said they would gladly
put up a fence, if the Council required them to do so.
Mr. Teague moved seconded by Mrs. Beal to continue the public hearing on appeal to Conditional
Use Permit, Lakewood Mobile Home Park, until May 11, 1970. Motion carried.

1. Items from Mayor and Council
a. Ordinance Prohibiting Visible Emission from Automobiles - Councilman Williams requested
a report from the City Attorney on the desirability of an ordinance to prohibit excessive
emission of automobile smoke and pollution into the atmosphere, and asked if enforcement
of such an ordinance was possible.
Councilwoman Beal said the Air Pollution Authority has such regulations, but police
have no authority or traillning to enforce them. She felt a City Ordinance would
implement the regulations, and make them enforceable in the City.
The City Attorney expiliained that state law controls exhausts and mufflers, but doesn't
cover emissions. Lane Air Pollution is a separate government entity, so the City will
require its own ordinance to enforce pollution regulations.

Mr~ Williams moved seconded by Mrs. Hayward that the City Attorney draft an ordinance to
permit Eugene City Police to enforce control of visible emission from automobiles, in
accordance with standards set by Lane County Air Pollution Authority and the State of
Oregon.

Councilman Purdy requested a report on diesel trucks, and how they fit into the entire
picture.
Vote taken on motion as stated. Motion carried.

Mr. Williams was concerned that a section on diesel trucks should be included in the ordinance.
Mrs. Beal explained that the air pollution standards do deal with trucks separately. She said the
Council could not make changes in these regulations, and invited the Council to come to the rules
hearing Marfch 18 so that they could discuss the regulations and perhaps come to a better understand-
ing of them. Councilman Williams requested a staff report discussing potential for controlling
visible emission so the Council could understand it, and implications on people when trying to enforce
the ordinance. He asked for information on the extent diesel trucks exceed requirements of Lane Air
Pollution Authority regulations, and an analysis of the rules to be included in the ordinance.

b. Rally, Support Governor's Stand on Nerve Gas - Councilman Mohr announced that Governor
McCall will speak at a rally to be held Friday at 11:30 at City Hall. Other speakers will
be Charles Elliott and Jack Doughty. The public is invited and Council members and staff
are asked to participate.

2. Lane County Auditorium Association, Site Report - Copies of the report were previously distribu-
ted to the Council. Staff recommends Council accept recommendation of Lane County Auditorium
Association to reserve Site "B", based on 1) Authorization of financing; 2) Satisfactory com-
pletion of technical and design studies; 3) Establishment of and agreement on site purchase price.
Mr. Lee Bishop outlined the association report. He indicated that a second design seminar will
be held March 12 and 13 in the Council Chambers, and urged members of the Council to attend.
Mr. Don Lutes, Architect, explained selection of the site, reasons for selection of an urban
site for the Center, and possible parking problems.
Mr. John Amundson of the Architectural firm commented on probable heights of buiilldings, and
possible effect on Skinner Butte vista.
In answer to Councilman Mohr's question, Mr. Bishop said the Council is requested to accept
the report so that planning may proceed.

his concern was that Council action should not be taken at a committee meeting on this

Mr. Williams expressed concern over the location of the site, noting some interest in North Bank
Park. Mr. McDonald explained that there had been many hearings and discussions, and that this
general area was chosen so that the facility would have wider and more frequent usage.
Mr. Bishop explained that a seminar had been scheduled to permit local use groups to discuss
needs of the center. Another seminar will be held March 12 to further study needs.
There was further discussion about the location of the center, and how it will be tied in with the
Buttep"Park, River and downtown area.
Mr. Theron Rust said reserving this site for the auditorium will give Eugene Renewal Agency an oppor-
tunity to develop an urban design plan for the area.
Mr. Mohr wanted to make sure all efforts are focused in the right direction.

Agreements, Oregon State Highway Department - Public Works Department has reviewed proposed
agreements, and met with the State Highway Department. Staff recommends approval of
contract and passage of a resolution authorizing the Manager to sign an agreement. No
action taken at this time.
Mr. Teague moved seconded by Mrs. Hayward to authorize the City Manager to sign an agreement between
Oregon State Highway Department and the City. Motion carried.
Ordinance Amending Code - Code prohibits barbed wire fences in the City. Amendment will
permit stnands of barbed wire on fences at Jefferson Memorial Swimming Pool. The City's
liability insurance carrier has requested this installation to discourage youngsters
climbing the fence, in order to get into pool during hours of closure.

that the City might participate in a community facilities funding program. Eugene Renewal
Agency met with representatives of that Department and the City Parks Department, and
hopes to develop a new center in Amazon Parks area. This area qualifies under present
plans to obtain assistance from the Department of Housing and Urban Development.

Parks and Recreation Drr.ector said a research study has been done for this area. Present
plans are for a $250,000 project, but rohe scope could be enlarged considerably through
federal assistance.
Mr. Don Lutes, Architect, showed proposed plans and said this was an excellent opportunity to !,
build a facility which incorporated multi-use and flexibility.
Mr. Otto Poticha asked about city policy regarding joint use of sChool-city buildings.
Director explained that there has been a long-st~nding policy in this regard, but that
school facilities are generally in use, either by students or EBAA. Meeting rooms are
also shared, but there are scheduling problems.

community facilities fund for a community center at the Amazon Park, to be knows as Amazon Village

7. Correspondence - Public Works Director read a letter from EWEB inviting Council members to
attend a special showing of model of Trojan Nuclear Power Plant soon to be under construction
near Rainier, Oregon. Mr. Mohr, Mr. Williams, Dr. Purdy, Mr. McDonald and Mayor Anderson
will attend.
Letters were distributed commending employes of police and parks departments. Public Works
Director read replys rec~iYed to Council Resolution concerning nerve gas from' President
Nixon's assistant and from Senator Packwood.

8. Danebo Neighborhood Development Program - Mr. Theron Rust of Eugene Renewal Agency explained
that the Department of Housing and Urban Development had approved a renewal project in
the Danebo area in the amount of $524,030.71. He said they have only a year to complete
the project, and recommended a public hearing be scheduled in April at a regular City
Council meeting.

In answer to Dr. Purdy, Mr. Rust said the only costs to residents will be sanitary
sewers, which are already in.
Mr. Otto Poticha was concerned that this renewal would include only streets, sewers and
lights, and felt residents wishes should be considered. Planning Director outlined
meetings held with neighborhood residents, and said public hearings will be held. Mr.
Rust said a plan has been drafted for the area which, if the Council approves, will
be implemented immediately.

Mayor Anderson explained that the Council recognized that it had to get community
participation, and that the staff and others should be commended for their approach.
The Mayor felt the fact that this was a neighborhood effort was important.
Mr. Jim Britton asked if this area was still considered in an airport noise zone.
Planning Director said the aviation authority reviewed the application and FHA approved the
application. He recommended that a public hearing be held April 13, 1970.
Mr. Teague moved seconded by Mrs. Hayward that the Council schedule a public hearing April 13, 1970
for discussion of a proposed urban renewal project in the Danebo area.

Mr. Otto Poticha said members of the Urban Affairs Committee of AlA were concerned that residents of the
area were not aware of the expense likely to be incurred in connection with renewal. He felt public ,~
hearings should be held and committees should meet with residents. Councilman Mohr pointed out to
Mr. Poticha that the motion was to hold a public hearing to hear the kinds of questions he was
asking.
Mr. Rust and the Planning Director explained that residents of the neighborhood had asked for help,
arid that many community meetings have already been held. Mr. Rust explained that the Eugene Renewal
Agency staff and city staff will be meeting with residents of the area and explaining what will
be done prior to this_public hearing.

Bids, Publie Works Department (Public hearing February 23, 1970)
The Council was asked to postpone a decision on Items a, band d until the bid could be
reviewed. Based upon information which was examined by the City Attorney's office and
Finance Department, staff recommends D G D Backhoe Service bid be disallowed and not
considered as the lowest bid, and the bid be awarded to Kenneth R. Bostick.
Mr. Teague moved seconded by Mrs. Hayward that on Sections a, band d the D G D Backhoe
Service Bid be disallowed and that they be awarded to the next lowest bidder, Kenneth R.
Bostick Construction Company.

Councilman Williams said he was aware the City had had problems with D G D Backhoe Service,
but he was concerned that the City would be penalizing property owners by assessing them
the additional $10,000 quoted by the next lowest bidder. He felt the low bidder would, in
all probability, now conform with the law. Manager agreed that this was a valid question.
He explained that this company had deliberately signed wage certificates which were not
true, and it was felt the bid should be disallowed as not responsible.

Councilman Williams felt this action would be tantamount to assessing a penalty without due
process of law. He felt there should be a provision to penalize a contractor who does not
fulfil his obligation. City Manager said action for violation of the law would be taken by
the District Attorney. Assistant City Attorney said the question before the Council is that
of policy - whether or not someone who apparently knowingly. filed false statements3with the
city of Eugene is an individual the City wants to do business with.
There was further discussion about how the City had determined the company had filed false
statements, and what other remedial action the city might take.

The City Manager read a letter from Mr. Robert Meltebeke in which he objected to being assessed
twice. His lot fronts on both Gilham Road and Elyssium Street. The City Manager explained that this
is standard assessment procedure on lots which have access to paved streets on both front and back.
Mr. Meltebeke said he would pay what was fair, but he had been told there was a case in the City
similar to his which has not been resolved. The City had to get slope easements to pave the street

and said at that time it would not be reasonable to pay for streets with slope easements. The City
Manager said in the case Mr. Meltebeke mentioned, the property owner protested at the public hearing
and the Council felt the assessment was proper and made the assessment.

Madrona Drive from Capital Drive to 100' north; Woodlawn Avenue from Capital Drive to 70' W~st; and
Dresta de Ruta from Capital to 2001 north was submitted and read in full the first time on February
9, 1970, and held over to this meeting to allow proper notice of assessment to be given owners of
affected properties, and brought back for consideration with two written protests on file.

Mr. Fred Yahn, 2540 Woodland Drive, asked why the project had been extended to Madrona Drive which
had already been paved. Public Works Director explained there were several public hearings and notice
had been sent to everyone about what would be paved. He explained reasons for this work being done,
and that Madrona had not been paved to city standards. The City Manager said the city would be
pleased to review the matter with Mr. Yahn, but that the ordinance should be ppssed. If the city is
found to be in error, a correction can be made.

Mr. Gary Rholl, 3235 Alaer Street, complained that he had been billed for 165 feet, but that 15 feet
of his property had not been paved. Public Works Director explained that there are no lot corners
in this neighborhood and property owners are not sure where their property begins and ends. City
has to go by deeds, and Mr. Rholl was only assessed for property listed in the deed. He said they
would check into Mr. Rholl's complaint concerning a spring and with EWEB concerning the valve which
is apparently aggravating the problem.
Mr. Lee Raish, 2510 Spring Boulveard, complained that a strip beyond the intersection had not been
completed. Public Works Director explained that part of the street had been an overlay, and that the
maintenance department could complete the job. Neighborhood would not be charged.

Mr. Mohr asked if Mr. Teague had amended his motion to exclude Ordinances 9081 and 9082. Mr. Teague
said he had not.
Councilman Mohr felt there were substantial problems between the Engineering Department and owners
on these two ordinances, and that it might be well to hold the~. Councilman McDonald explained that
the projects had been completed, and that the C{ty had assessed on the usual policy of deed and ti~le
insurance reports. The City could not survey each lot.

assessment project. If an error in calculations is dills covered later, a correction can be brought to

Mr. Donald Lower, 2500 Spring Boulevard, said there was a discrepancy in his property line, and he
had purchased another 18' so that he could use his garage. He said the whole hillside is off on the
survey.

*Councilman Williams was still concerned about prohibiting mobile homes in M-l and M-2 zones. Hestill
felt they should be allowed in M-2 zone as a conditional use. The Planning Director explained that
uses allowed in M-2 are not compatible with mobile home living, but he felt that allowing them condi-
tionally would certainly be better than outright uses, as'.they are now. City Manager explained that Mr.
Williams suggestion would not be contrary to the ordinances before the Council, and that these could
be passed and Mr. Williams suggestion presented to the Planning Commission for further consideration.
