Adjourned meeting of the Common Council of the city of Eugene, Oregon was called to order by His Honor
Lester E. Anderson at 7:30 p.~.on March 23, 1970, in the Council Chamber, with the fOllowing'Council-
men present: Mr. Teagve, Dr. Purdy, Messrs. Gribskov, Mohr and Williams.
Minutes of meetings held February 23, 24 and March 9, 1970 as mailed to Council members, were approved.
Invitation, Agricultural Tour - City Manager circulated a sign-up sheet for an agricultural tour to
leave the Fairgrounds at 9:30 March 31, 1970.
Appointments - Mayor Anderson appointed Mr. A. Deane Owens to serve on the Human Ri&hts Commission.
Mrs. Everett Smith, Freeholder Ward 1, was nominated by Mrs. Hayward~to fill the unexpired temof
Mrs. Eleanor Herbert on the Budget Committee.

Mr Teague moved seconded by Dr. Purdy to approve the nom~nation by Mrs. Hayward of Mrs. Everett Smith
to the Budget committee for a term ending December 31, 1971. Motion carried.
Public hearing, Eugene Renewal Agency - Pedestrian Mall, Downtown Shopping Area - Mr. David Hunt,
Executive Director of Eugene Renewal Agency, explained proposed development of a downtown pedestrian
mall, as designated in the renewal plan. ' He outlined the boundaries proposed in the Ordinance, and
explained the areas where vehicular traffic will be permitted.
Councilman Mohr was concerned that the City would be responsible for maintenance of the mall area. The
City Attorney explained that the City is responsible for maintenance of city streets' and sidewalks, the
difference being that pedestrians, rather than automobiles, will be_ using the streets.

Since there were no written protests, and no one in the audience spoke for or against the closure,
Mr. Teague moved seconded by Dr. Purdy to approve the Ordinance and Resolution which will enable this
closure to proceed.
Mr. Mohr questioned the City being faced with this maintenance cost. In answer to Mr. Mohr's question,
the Manager said the estimated cost for maintenance per year would,be between 40 and 50 thousand
dollars. In answer to Councilman Williams the Manager said the property owner is now responsible for
maintenance of sidewalk area, but there will no longer be a line of demarcation. He agreed this would
set a precedent in a similar situation. The City Council would have authority to review and modify,
should this seem justified.
Mr. Mohr suggested that if the City could do this, it could justify funding low cost housing.
After further discussion, a vote was taken, and the motion carried.
Public Hearing, Sidewalks in area between 20th Avenue and 29th Avenue, Willamette and Jefferson -
Director of Public Works showed transparencies of the area proposed for construction of sidewalks,
areas with sidewalks in existence, and the entire study area. Notices were mailed to all affected
properties, and replies to these notices were read by the City Manager

Petitions were submitted 'both for and against the proposal, and are on file ~n City Hall.
Mr. and Mrs. Clyde Gump; Mr. Robert Paylor, 2207 McMillan; Dr. John W. Bishop; J. Glenn Cougill;'
Beatrice E. Cooper; Francis J. Nuttman; P.D. Ma~kie, Jr, 294 West 22nd Avenue, submitted letters
protesting the sidewalk proposal.
Robert C. Paylor, 2207 McMillan, took a survey between 26th Avenue and 27th Avenue. and felt sidewalks
were unnecessary. He complained they would replace trees and shnubs.

Mr. Erick Cooper, 2380 Charnelton and Mr. JohnHotchkiss, 2315 Charnelton, spoke in favor of the pro-
posal. Mr. Cooper presented a letter of support signed by owners of 49 properties in the vicinity.
Dr. John Bishop, 287 West 23rd, showed slides to demonstrate what'damage installation of sidewalks
would do to landscaping in the area. He felt there was no need for sidewalks on both sides of the
street.
Mr. A. Wheeler, 2410 Charnelton, said his driveway was a vacated portion of 24th Street, and said
he understood sidewalks were not no be put in on his side at this time. This was confirmed by staff.

Mr. Sylvanus Smith, 2361 Charnelton, felt the sidewalk needn't be 5 feet, since almost, everyone has
a 3 foot sidewalk, curbside, and he felt the houses were too close to have them extended. Public
Works Director said these would be 5 feet, and the 3 foot walks would be extended. In answer to Mr.
O. H. ,Dean, 39 West 22nd, Public Works Director said sidewalks would be curbs&de.in his area. Mr. Dean
did not think the children would use sidewalks if they were instal~ed.

be built without a reataining wall. Manager said construction of retaining wall could be included
in the contract, at owners expense.
Mr. Paul Mackie, 294 West 22nd, affirmed what he had said in his letter, and said property should
gain more than it ~oses.
Councilman Williams questioned whether there had been danger to children, and ~sked whether there
had been any injuries, whether efforts had been made to show that sidewalk installation reduces the
incidence of injuries, and what influence a sidewalk on one side of the street had versus sidewalks on
two sides of the street.

The Traffic Engineer said there are no statistics to show that sidewalks reduce accidents. It only
takes one vehicle versus a pedestrian conflict to create an accident. It has been shown that side-
w.alks on both sides of arterials are safer.
The City Manager said in areas where hazards are involved, schools have been successful in convincing
children they should use facilities which are available. In answer to Councilman Teague, Manager
said the Council has the right to consider a less than 5 foot sidewalk. He s~id the Council could
consider modifications, and view the areas again, particularly those from which testimony came.
Mr. Teague said he would like to take another look at the property and weff:gh the testimony j.ust
heard.
Dr. Purdy asked for a map showing the area where people live who approve the project, widths of
sidewalks already in and whether they are curb or otherwise.
Mr. Williams asked for a drawing of the area showing sidewalks in question, but attempting to
limit sidewalks to one side of street, and that this,one side of the street be based upon topograph-
ical damage to properties in the area, so that serious retaining wall problems would not occur.
The Public Works Director agreed to prepare drawings for the Council.
Mr. Teague moved seconded by Dr. Purdy that the Council review the proposal in light of testimony
presented, examine graphic material and make another inspection of the area.
There was discussion whether to continue the hearing, and the Manager said another hearing could be
called, or it could be taken up at the hearing where bids are opened.
Councilman Mohr said he felt there was merit in the Frances Willard PTA proposal, and he did not
feel the sense of the motion should preclude getting children to school in safety from the whole area.
Vote taken on motion as stated. Motion carried.

1. I.Q.L. (I quit littering) - Several students of the third grade class of Condon School
explained events leading up to formation of their club, and invited members of the Council
to join them in their clean-up attempt. They distributed I..Q.L. bags decorated by
class members, and asked that they be filled with litter.

Mayor Anderson expressed thanks of the Council, and Mrs. Hayward moved seconded by Mr.
Williams that the class be commended for their action, and expressed their hope that
the idea could be extended to other parts of the City. Motion carried.
Mr. Teague moved seconded by Dr. Purdy to receive and place on file Item 1 of the Committee report.

a. Housing Program - Councilman Williams thanked the Commissioners for attending this
meeting. He explained t~e role of the City in its Joint Housing Committee, and said

and said the leased housing program operated by the Lane County Housing Authority is
limited to corporate boundaries of the City. 10% to 15% of applications cannot be
filled because they ask for residences outside the city of Eugene. He also said
that a number of people are moving into the City specifically to apply for leased
housing. The Housing Committee is concerned with people migrating to the urban
area simply to find housing.

Commissioner Omlid asked if the Joint Housing Committee intended that the Housing
Expediter implement and carryon a program outside the City, or whether it intended
that Lane County Housing Authority enter into? separate program.

Mr. Hal McCall, chairman of Lane County Housing Board, said expansion outside the
City had been discussed by the Joint Housing Commit~ee and Lane County Housing
Authori ty for some time. It was discussed several years ago with the County, but
it was a different program at that time. Since entering into the leasing program,
it would appear the Housing Authority must involve itself in a coun~y-wide housing
program. The problems accompanying this step would be' primarily administrative.
The Board has been talking about it for a year and a half, and the time has come
to develop an approach.

Mr. McDall agreed that this would be a likely approach, and would facilitate
administration. In answer to the City Manager, Mr. McCall said funds might be
available for added staff if this step were taken.
Commissioner Hill was concerned that if the program was not county-wid~, there
would be problems decidi~g where boundaries should be.
Mrs. Betty Niven said it was not clear whether legislative change would be required
to initiate a county-wide program, but in light of the supreme court decision on
welfare and HUD interpretation of this, programs must move .outside the corporate
city limits. There was further discussion of possibility for a county-wide program,
and problems establishing such a program.
In answer to Commissioner Hill's fears concernipg non-urban areas of the County,
Mrs. Niven pointed out that the Federal government has recognized differences
between concentrated areas and non-concentrated ones. Farmers Home Administration
operates in areas where concentration is 5,000 or less.
In answer to Mayor Anderson's question, the Commissioners agreed they were favorably
inclined to a housing program outside the city of Eugene. Commissioner Hill said
their legal counsel could givei~ an opinion whether the Housing Authority could do
this, and the Commissioners will meet again with the Council.

b. Appeal for Funds - Councilman Williams explained that the office of the Housing
Expediterrcurrently spends 50% of its time on housing requests from .outside the
Eugene area. In view of this fact, the City is requesting financial assistance
to expand this office. Mayor Anderson explained that ,this office was created
to look at the broad range of housing problems in the community, and that it is
important to broaden these activities.

Commissioner Hill suggested that a written request be forwarded to the Commissioners
to make this a budget item, and said it would be considered at budget level.
c. Lane County Housing Authority as Visualized by County - Joint Housing Committee
is unsure what the County feels is the role of the Housing Authority as it exists
today, and what its proper role will be ten years from now. What is the proper
role of "government" in total on a local level now and ten years from now.
Cammissianer Hill gave a brief history of the inception of the Hausing Authority,
and how it has grown to, its pre~ent level. He explained that their primary
concern had been for the low income elderly~ but the advent of the leased housing
program had somewhat changed this coneeption. With the new programs available,
they are in a position to broaden their goals.

Mr. McCall said the Housing Authority merely serves as a vehicle for utilizing
federal programs, and has no authority to initiate programs.
. Mrs. Niven quoted state law regarding housing. Mr. McCall pointed aut that the
Authority is funded federally, and unless there is a commitment for an area,
there are no funds set aside.

Mayor Anderson s.aid that the' Joint Housing Committee has come to realize the
private sector is taking a much different position than it used to. It becomes
incumbent on government to extend the hand of fellowship to business and to seek
participation.
Commissioner Omlid said that there has been a change in times, housing needs, and
recentily, a tight money situation, and that he is sure the Housing Authority is
cognizant of the tremendous change, and will cooperate in getting something
started, as far as county needs are concerned.
Councilman Williams suggested that a commitee be established representing the
Housing Authority, Joint Housing Committee, Council and Commissioners to review
the policy under which they are operating within Lane County, and draft proposed
policy representing consensus of the various units on the possibility of changes
and revisions in existing institutions in years to come.

Commissioner Hill agreed that this was a good suggestion and that the Houisng
Authority and Commissioners would be glad to coopeate.

d. Alton Baker Park - City Manager explained a meeting with Maurie Jacobs Committee
which proposes to start development of a "Showcase Section" in Alton maker Park.
He felt a decision should be made on areas of responsiblity of governmental
agencies having property there. It will be necessary for a body to be formed
with responsiblilty for decisions and maintenance.
Commissioner Elliott agreed an agency should be established to develop, operate
and maintain the park. Commissioner Omlid pointed out the metropolitan study
commission may come up with recommendations, and he felt the results of this
study might influence any decisions concerning such an agency. He was concerned
that there should be a total planning study made, including traffic needs.
Commissioner Hill suggested that the City and County get a group together above
staff level and form policy statements.
Commissioner Omlid suggested such a group should include both City and County
Park Directors
In answer to Mayor Anderson, Commissmoner Hill said they would be glad to meet
with Councilmen in arcommittee to formulate policy on Alton Baker Park.

Airport - Progress has been made on planning for transfer of the airport from
the City to the County. Mr. Elfers said administration had met with personnel
at the airport and discussed personnel programs 'and benefits. Airport Manager
has prepared a budget for the County and one for the City. Legal steps cannot
be taken until voter approval is given.'

Commissioner Omlid said the County envisions no difficulty with the transfer,
and requested Council members to advertise the program.
Mayor Anderson eommented on City-County relationship, and thanked the Commissioners
for meeting with the Council. Commissioner Hill agreed that the meeting had
been fruitful, and suggested that they meet again soon.
Mr. Teague moved seconded by Dr. Purdy to receive and place on file Item 2 of the Committee report.

After discussion about procedure, Dr. Purdy moved seconded by Mrs. Hayward that the City forward
a request to County Commissioners to ",budget an item to share in the cost of the City Housing
Expediter office.
The City Manager said wages for this position would amount to about $5,000, and would be about 1/3
the cost of maintaining the office.
Councilman Williams did not feel the request was excessive, since 50% of the time in the Housing
Expediter office is spent on people outside the City.
Since there were two motions on the floor, Councilman Teague, with Dr. Purdys concurrence, withdrew
his motion to file.
Mr. McDonald entered the meeting.

of representatives of the Housing Authority;,Joint Housing Committee, Council and Commissioners, to
review Housing Authority policy and draft proposed policy, representing consensus of various units on

Study Need for Eugene Police Advisory Board - City Manager
by ACLU in support of a proposed Police Advisory Board for
Mr. Richard Miller, attorney, said a need was seen for checks and balances, and it was
felt this was'an opportunity for further citizen participation. The report has been
discussed with ActinggChiefof Police Smith, Human Rights Commission and Lane County Bar
Association Committee on Administration of Criminal Justice.
Mayor Anderson suggested that the Council study the report and delay action until the
regular meeting.
Councilman Mohr recommended that a subcommittee be formed to study this issue and
report to the Council. The committee could hold hearings and develop discussion prior
to the Council taking action.

Mr. Mohr moved seconded by Mrs. Hayward that a subcommittee be formed to study the
question of formation of a police advisory board, and that it ~mclude members of the
Human Rights Commission and other citizens.
Mr. Teggue suggested the Council read the study the report before taking any action.
Mayor Anderson pointed out that the committee would be for the purpose of study and that
other proposals could be studied.

Mr. Mohr did not agree with the Mayor's ruling, and felt the material should be studied by the sub-
committee before presentation to the Council.
Mr. Mohr moved seconded by Mrs. Hayward that the Council establish a sub-committee with appropriate
guidelines from the Council for the conduct of its inquiry on the matter of establishment of a
police advisory board for the city of Eugene, with representation from the Council, Human Rights
Commission and other interested citizens.
Dr. Purdy said he would like to hear the staff report on advisability of sub-committee formation,
and the letter from Mr. Brown.
The Manager sa~d the letter questioned whether this was the appropriate time for formation of a sub-
committee, and whether the proposal from ACLU was the appropriate proposal to be considered by the
sub-committee. The staff would recommend that this was not the appropriate time, nor the appropriate
proposaL

Councilwoman Beal suggested that the City convert one car to propane gas to test
its efficiency in pollution'control. Councilman Mohr said he had been contacted
byaa propane gas company, and that perhaps they would install a new carburetor for
liquefied propane in a city-owned vehicle.
Mrs. Beal moved seconded by Mr. Mohr that the City immediately investigate conversion
of city-owned cars to propane gas to eliminate or control air pollution.
Dr. Purdy requested a comparison with anti-pollution devices, and their effectiveness
in controlling pollution.
Vote taken on motion. Motion carried.
There was further discussion about Lane Air Pollution proposed regulations. The
City Manager explained problems with conversions of steam plants at EWEB, and
University, and that possibly the deadline should be extended to 1975. Mr. Mohr
felt the deadline should remain 1972, and explained that an extension could be
requested, if it proved necessary.

Mr. Mohr said he had suggested an investigation of propane conversion units, and woiliilld be glad to
continue the investigation. The Manager said the purchasing agent would be happy to work with
Mr. Mohr as a subcommittee.
In answer to Mr. McDonald, the Manager said the Police 'Department had tried a propane auto about
ten years ago, and it had worked very well.

2. Transient citizens in Eugene - Mr. Ed Adkins expressed concern that the article in Look
Magazine concerning our All-America City might encourage more transients to migrate
., to the City, and that facilities are now overtaxed. He suggested that the city contact
other west coast cities to inform them that there are no opportunities in industry,
and that housing is a problem.
Dr. Purdy suggested that the Eugene Council of Churches could report mo the City Manager
on the number of requests received and problems being encountered. Mr. Mohr suggested
a directory of services list in the newspaper, so that persons coming to the city would
know where to apply for social services.
In answer to the Manager's question, Mr. Adkins said the City could contact university's
in coast cities for information on mumbers of transients, and inform them of lack of
facilities in our city.

3. Ja~anese Vismtors - Mr. Robert Harrison introduced Mr. Yamanokuchi, Mr. ~ajima and Mr.
Fumoto, industrial representatives from Asahikawa, Hokkaido, Japan, who are in this
area on business. They presented gifts to the city of Eugene, and a~letter from the
Mayor of Asahikawa, wishing well to the city of Eugene.
Mrs. Hayward presented all three with a graphic story of Oregon. She thanked them
for the gifts, and said it was an honor to have them visit our city.

4. Voters Pamphlet - The Future Power Committee has requested the city of Eugene to issue
a voters pamphlet for the primary election. There are three city measures on the
ballot, and the City could issue a statement supporting the airport transfer and the
County garbage levy. Estimated city cost is $3,000, and the City can charge only for
the cost of paper and printing. This amounts to about $250 per page. The following
city measures are on the ballot:
1. Future Power Committee initiative re: delay in nuclear plant construction
2. Initiative declaring cross on butte a war memorial
3. Initiative compelling collective bargaining with IAFF and AFSC~E.

The City Attorney said he had contacted Mr. Calins, EWEB attorney, as requested by Councilwoman Beal.
Mr. Calkins said EWEB has complete control of funds, and their only responsibility is to report to
the City annually on the status of funds. There are no laws restricting or limiting expenditure
of EWEB funds, since they are obtained from operation of the utility and are not tax-based funds. So
long as they budget and meet requirements of state budget law, they can use a reasonable amount to
inform the electrorate of the City on measures before the voters having to do with operation of
programs of EWEB.
In answer to Mrs. Beal's question whether or not limitation of state election law expending money
for campaigns pertained to Eugene Water and Electric Board, Attorney said EWEB is controlled by
Section 20220 ORS, which only prevents them from engaging in partisan politics.
5. Appeal, Conditional Use Permit (Lutheran Laymen$ League) - Residents in the area of
Fairfield and Hawthorne who are concerned with drainage problems have appealed a
Conditional Use Permit granted by the Planning Commission to Lutheran Laymen's League
to build a 94 unit low rent housing project. It is recommended a public hearing be
held April 27. This will allow time for the Engineering Department to study the
problem. Action will be taken at the regular meeting.

6. Request for Mobile Home Permit - Mr. J. J. Goodrich, 1785 West 11th, requested a variance
to allow a trailer for a watchman. Staff recommends permit be granted and recommends
public hearing April 13, 1970. Action will be taken at ~egular meeting. '

7. Planning Commission Meeting, March 3
Council viewed sites on tour prior to meeting. Action will be taken at public hearing
at regular meeting March 23.
A. Recommended:
1) Amendments to Zoning Ordinance, Section 26.04, to include "non-profit sponsors"
as qualifying sponsors for Controlled Income and Rent Housing. Also amends
Article 34, definitions of "Controlled Income and Rent Housing," and "Housing
Project" to include "non-profit sponsors." Also, adds and includes "Cooperative
Housing Corporations" under the definitions.
2) An ordinance to authorize acceptance of grant of powers to the city of Eugene
as provided in Chapter 185 of Oregon Laws of, 1969, relating to housing for
low-income citizens.
Mr. Teague moved seconded by Mr. McDonald to approve Items 7Al and 7A2 of the Committee report.
The City Manager explained these items, and the need for amendment. Planning Director explained
under Item 7A(2) that state law provides that the city may cooperate with non-profit sponsors similar
to the way they now work with the Housing Authority, but the city must accept grant of power. Plan-
ning Commission wanted Council approval before calling a public hearing.
Mayor Anderson suggested these items should be separated.
Vote taken on motion to approve Item 1. Motion carried.

particular item had no bearing on drainage in the Baxter Street area. Another bond issue will probably'

Mr. John M. Norstrom, 120 Ingalls Way, objected to the assessment and requested that it be deferred
until he could sell part of his property. Public Works mmrector explained that, under terms of the
ordinance pertaining to use of deferred assessments, his property would not qualify. He suggested that
the property be uiliilized through use of a panhandle, and said this would have to go through the Plan-
ning Commission.
