Anderson at 7:30 p.m. on April 27, 1970, in the Council Chamber, with the following Councilmen present: Messrs. McDonald and Teague; Mrs. Hayward; Dr. Purdy; Mrs. Beal; Messrs. Mohr Gribskov and Williams. p Barricading of 13th Avenue - Mayor Anderson said events of the past twenty-four hours had'caused much public concern in connection with blockage of l3th Avenue from Kincaid to University. The Council met in executive session prior to the meeting to discuss the matter informally, hoping that the issue could be resolved, and that long range traffic plans for the neighborhood could be expedited. Mayor Anderson outlined action that could betaken, and explained consequences that might result. He said he had proposed that the Council schedule a public hearing May 11 to give all people concerned an opportunity to be heard. He said one condition attached would be that the barriers be removed. Councilman McDonald said he was in favor of a May 11 hearing, but that this was a public street, and it was his opinion the barriers should be removed by the time the Council convened for a committee meeting at noon, April 29. Mr. McDonald felt this closure should be done legislatively with the administrative department of the University of Oregon. Councilwoman Hayward felt the matter could be reassessed at the Wednesday noon meeting, but did not feel a deadline should be set for removal of the barricades. Councilmen Mohr and Williams agreed with Mrs. HaywaBd, both feeling no real discussion could be held until the barricades were removed. Mr. R. B. Anderson, 163 East 12th, said he and other citizens appreciate the University in this area, but that rules and regulations have been made to protect the majority of citizens. If the rules are not enforceable, then they should be changed. He felt the matter of clousre of 13th should not be considered for at least 24 months. , " Mr. Jeff Gates, 2395 Madrona Drive, re-ad a statement prepared by a group of University students who were concerned about the campus and the community. He said the majority of students were not in favor of illegal blockage of 13th. " , " Mr. Jim Bostwich, 2501 Franklin, read a letter written by students and faculty of the School of Architecture and Allied Arts and the Associated Students of the University of Oregon senate, requesting that 13th Avenue traffic be diverted to allow time for study of alternative uses of the street. A request was made for hearings on the issue in theibmmediate future. , : ~ " " Mr. Tom Chalk, 1790 Alder, presented a petition for. closure signed by 1310 students. The petition stated that the students and faculty of the School of Landscape Architecture support legal action to close 13th frim Kincaid to Agate. Mr. Dale Austin, 3515 Kincaid, deplored action taken by students in violating the law. Mr. Dennis Stoval, 328 Willamette and Mr. Walker Eaton, gave arguments for continuing the closure of 13th Avenue. I Mr. Bob Winger, president of the Senate of the University of Oregon, said they had this evening passed a resolution requesting that the street be closed, and said they were willing to discuss alternatives. He stated that, if the city would re-erect barricades, they would take responsi- I,; bility for removing those now erected. " Mr. Art Stone, merchant in the area, said they had worked with students to get the street closed for the Su~vival Fair. It was closed for three days for this event, and this was done legally. He felt it could be done legally again, if students would petition. Dr. Purdy said the Council had agreed eight years ago with the University that 13th should be closed. Up to this time alternate traffic p~ans and financing have .not been worked out. ': Environmental Quality Hearing - Councilman Mohr read a letter drafted for Council signature which would establish the position of the Council regarding the next public hearing to be held by the Department of Environmental quality. Mayor Anderson expressed displeasure at the reception given the Council at the last hearing, and urged the Council to send this letter. Public Hearing, Appeal from Conditional Use Permit A. B. K. D. Gilbert Lutheran Laymen's League Conditional Use Permits were granted by the Planning Commission for construction of apartment facilities, after rezoning. These are two different projects - one a 33-unit apartment house, and the other a low-income apartment. Objections are substantially the same, so they can be handled simultaneously. ; ~ City Manager read letters received from Peter Kelsey, attorney for both appeals, outlining objections to granting of the conditional use permits. He also read a memorandum from the Planning Commission outlining reasons for granting the conditional use permits. 4/27/70 - 1 ~ e I e I I - I \ I ,I , q II II I 'i e e "'IIIl J~8 J -e -I -I e I e I I I Mr. Glen Petterson, 3480 Strathmore, represented Lutheran Laymen's League and explained a proposal to solve the potential traffic problem by terminating the service road in a cuI de sa9. Mr. Ken Gilbert, 261 Hollyview Avenue, explained that drainage projects to be made by the City will take care of drainage problems anticipated by opponents. I II II II I I The City Manager explained in this connection that two weeks ago the City Council had authorized work on the Marshall Street drainage ditch. Mr. Peter Kelsey, attorney, said he represented a number of people from the Bethel area, and present'ed a petition with 220 signatures. He said that many objections on which his _ clients had filed their appeal had been overcome. He requested that the ditch be fenced, and that it be tiled in the area of the Lutheran project. City Manager explained that the Planning Commission would have the final authority on plans for the Lutheran Laymen's League, because thls was being constructed under Planned Unit Development regulations. Councilman Mohr suggested that the meeting be adjourned to May 4, and that tpis matter could be continued to that date. City Manager felt Mr. Kelsey and his clients were aware bf changes which have removed most of their objections, and that further delay would be a hardship on the part of the petitioners. Mr. Kelsey said that his cl~ents h~dhop'ed~h~;r request~ could be met, and that everyone., seems_ to b~ in \ agreement ,and-that they would give-up the appeal. Mr. McDonald moved seconded by Mr. Teague to give approval for a Conditional Use Permit to K. D. Gilbert and Lutheran Laymen's League, as recommended by Planning C9mmission, and deny appeal to these permits. Motion carried. City Manager read a letter from Mrs. Marketa W. Bennett, 2288 Hilyard Street, objecting to paving of the alley between16th and 17th, Mill and Ferry, saying it would not benefit her property. In re~ponse to Councilman McDonald the City Manager said seven out of nine parcels had been in favor of this project. Rollcall vote was taken on the motion. All councilmen present voting aye, the motion passed. A short break was taken. 4/27/70 - 2 ~ J~ e 4/27/70 1 ~ COMMITTEE REPORTS I, Meeting held April 15, 1970: ,i II I I II ~ II I I "Present: Mayor Anderson; Councilmen McDonald, Teague, Hayward, Purdy, Beal, Gribskov, Mohr and Williams; City Manager and staff; and others. 1. Items from Mayor and Council a. Additional Council Meetings - Councilman McDonald expressed concern at recent lengthy Council meetings, and said he felt the Council could not do justice to the people's needs. He suggested that the Council should meet every Monday, rather than the 2nd and 4th Mondays of each month. Mayor Anderson agreed that lenghthy meetings had become a problem, and asked for thoughts of other Council members. I I Dr. Purdy felt that, perh?ps meetings had become longer since the Council dispensed with public hearings at Wednesday meetings. He asked if the Council would still have the noon committee meetings. Mr. ~GDOnald felt these meetings would be in addition to those already held. e I II Councilwoman Beal suggested that p~lichearings could be held on the Mondays when the Counci~ did not have regular busines~. Mayor Anderson thought this was a good idea. He suggested that the Council set up a special meeting, after budget meetings are over~ to consider these suggestions. I~ b. Film Committee - Councilman Mohr said he had only an interim report on the film committee, and would present the report at a later date. Mr. McDonald moved seconded by Mr. Teague to receive and file Items la and Ib of the Committee report. Motion carried. II I I I c. Earth Day, Street Closure - Councilman Mohr said he had received a report from the University Association of Students on re~ponsibility for street closing. He read a letter from the ASUO countersigned by the Dean of Administration in support of this closing. Mr. Mohr urged the Council to reconsider and close 13th from the requested area of Alder to Onyx. The yniversity cannot give a financial commitment, but the activity has University moral support. After discussion, Dr. Purdy said he had voted on the basis of the traffic problem, and he could not see that anything had changed in this regard. Mr. Teague had been concerned about the University commitment, and the heavy traffic on 13th, and whether this closure would establish a precedent. I~ .~l - The City Manager said the staff was proposing a special Council meeting before the budget meeting on Monday night, and that further action could be taken at that time. The City Manager said there has been some public misunderstanding of the role city trucks will play in pick-up of trash on Earth Day. City trucks will not be used for pick-up of private residential garbage or trash, but will assist professional organizations and school groups in cleaning up public parks. Citizens are urged to take advantage of free dumping privileges at County dumps on April 22. e Mr. McDonald moved seconded by Mr. Teague to receive and file Item lc of the Committee report. Carrie~. The City Manager gave a report on earth day activities which was prepared by the Director of Parks, and asked that authorization be given to forward letters of commendation to those who took a particularly active part in this observance. Mr. McDonald moved seconded by Mr. Teague that letters be forwarded to schools doing outstanding work in observance of earth day. Motion carried. Mr. McDonald said students had done an outstanding job clearing trails and providing access to the river in Alton Baker Park. d. Statement, Voters Pamphlet - Mrs. Beal was concerned about inclusion of a Council statement in the voters pamphlet, not because of the content of the statement, but because the Council would be using city money to pay for the statement. It was her opinion"the Council should give equal space to the firemen free of charge. I In answer to Mrs. Hayward's question, the City Attorney said/the Council could do this if they wished. After further discussion of alternatives, Dr. Purdy moved seconded by Mr. McDonald that no public funds be used in publication of a Council position statement. Mr. Mohr explained that he was going to vote against this motion as a matter of principle. Mrs. Hayward was not sure opposing an initiative petition thwarted the initiative process. A vote was taken on the motion as stated. Motion carried. Mohr voted no. Mayor Alderson said he had reviewed the statement, and wanted to appoint a committee of the Council to review it. He requested Mr. Mohr, Mr. Teague and Dr. Purdy to assist him in preparing a statement. Councilman Mohr said in view of his objections, he would withdraw his services. Mayor Anderson requested Mrs. Beal to serve. She agreed, but said she felt a statement should be impartial. In reply to a question asked by Pat Flynn, Mayor Anderson said the committee would have to have a secre~ary, and file a financial statement. Mr. Mcdonald moved seconded by Mr. Te.ague to receive and file Item ld ~f the Committee report. carried. Motionl II II I 2. Council on Aging, Report - Mrs. Margaret Stauffer, representing Emerald Empir~ Council for Aging and Mayor's Advisory Committee on Aging, reported on accomplishments of these committees to assist the elderly. She said the President had designated May as Senior Citizens Month. Mrs. Stauffer requested the Mayor to appoint delegates to a Blue Ribbon Committee representing the Metropolitan Area, County Commissioners and City Councils of Eugene and Springfield. This committee will meet the first time Onday, April 20 at 12:00 hoon. She also requested a Mayor's Proclamation of Mayas Eugene Senior Citizens Montp. Mayor Anderson commended the Council on Aging for their work, and said he would sign a Proclamation, and appoint members to the committee. I ,f I' ,I 'I I I I i I: I' II II ,j Mrs. Hayward moved seconded by Mrs. Beal that the Council follow the recommendations of the Council on Aging regarding appointment of an area-wide representative, and that the Mayor issue a proclamation. I I !/ 'i I Dr. Purdy suggested that Mr. Smith from the Parks Department be appointed as this representative. Mrs. Stauffer said Mr. Smith is already involved in these activities. Mrs. Hayward asked the City Manager if the City has employed on a part-time basis, elderly citizens. Mr. McKinley said the City does not, at the present time, hire any elderly, but he felt it was a good suggestion, and that this would be a good source of skills. Vote taken on motion. Motion carried. Motion .carried. 3. D.E.Q. Proposed Field Burning Regulations - Mayor Anderson invited members of the Council to attend a public hearing on new field burning regulations before the Environmental Quality Commission at 2:00 p.m., April 23, 1970, in Salem. Mrs. Beal outlined the proposed field burning rules and regulations. Councilman Mohr proposed that a subcommittee be apppinted to prepare responses for April 23. Mayor Anderson agreed to appoint a Council committee to work on this. He said he found it depressing that no effort had been made to reduce any acreage to be burned. ~r. McDonald moved seconded by Mr. Teague to receive and file Item 3 of the Committee report. Motion carried. 4. Organizational Structure - The City Manager explained that, when the determination was made to establish a position of Community Relations Director, it was decided to try to el~minate the position of Assistant City Manager. It has become increasingly difficult to keep up with the responsibilities of the office. The Personnel Manager has been helpful, but his office is becoming:.increasingly demanding. The Manager 0e~plained that the Community Relations office has been very rewarding, and that many more things can be accomplished. He said addition of an Assistant Manager and Clerk Typist would mean a total cost of $25,000, including fringe benefits and funds for providing space. II II II " I' I 11 :1 : : ..... Mayor Anderson agreed that additional staff was needed in the City Manager's office. 4/27/70 - 4 ,...-- -132 - e 4/27/70 He said the Community Relations office is engaged in many new activities. Activities have been expanded without an expansion in personnel. Councilwoman Hayward agreed that the community relations position should be maintained, and that additional personnel was needed in the Manager's office. Councilman Mohr 'suggested that staff could be expanded through use of intersn. . I I 11 II !j !I I I I I Mrs. Hayward suggested that the Council, at a later date, discuss the position of Community Relations, and whether it should be responsible to the Manager or to the Mayor and Council. She felt perhaps the Council should be responsible for hiring that person. Dr. Purdy felt it was the consensus of the Council that more staff was required, and moved, seconded by Mr. Teague to ask the City Manager to submit a recommendation to the budget committee, outlining the duties of Assistant City Manp,ger. , Motion carried. Mr. McDonald moved seconded by Mr. Teague to approve Item 4 of the Committee report.. Motion carried. , I I I II 'i 5. Pedestrian Mall, Commercial Signing- Street signs will heed to be re~0eated as part of urban renewal. An ordinance amendment will be required to allow the proposed plan to be put into effect. e Mr. Gribskov moved seconded by Mr. McDonald to authorize the City Manager to prepare an amendment to the ordinance to facilitate relocation of signs in the urban renewal area. I Councilman Williams suggested that this should be reviewed by the Sign Boar.d and the Planning Commission. Manager assured the Council it would go before these bodies before coming to the Council. j Vote taken on motion. Motion carried. Mr. McDonald moved seconded by Mr. Teague to approve Item 5 of the Committee report. Motion carried. 5. Proposed Amendment, Equal Opportunity Ordinance - Amendment of the Equal Opportunity Ordinance will provide for inclusion of fair employment practice provision in city contracts, to prevent discrimination against employes or applicants. In answer to Councilman Moh~, City Attorney said they have prepared proposed amendments to city contracts to eliminate problems caused by failure of employers to abide by State labor laws. No action taken. Mr. McDonald moved seconded by Mr. Teague to receive and file Item 6 of the Committee report. Motion carried. I j II 7. License Application - 375 East 7th, approved by Police. Motion Meeting held Apr~l 22, 1978: Present: Mayor Anderson; Councilmen McDonald, Hayward, Purdy, Beal, Gribskov, Mohr and Williams; City Manager and staff; and others. 1. Items from Mayor and Council a,: Earth Day ;::; Kelly Putney, Uni versi ty students, exp1ained that students, in cooper- ation with University Parks and Recreation, had prepared 38 litter barrels, which will be placed around the campus as part of the Earth Day survival fair. They will then be placed in parks around the City. Mayor Anderson said this was observing Earth Day in the best tradition, and thanked them for their participation. I \ I: q ~ b. Campus Violence - Mayor Anderson commented about campus violence, and concern that the tqtal university population would be blamed for the attitude and actions of so few. He expressed confidence in the community, and said members of the Univer- sity were regarded as citizens of the city. e 4/27 /70 - 5 e '11III J3~ 4/27/70 I e I 'I e. I e c. Mass Transit System - The City Manager commented on the possibility of cessation of transit service by April 30, and attempts by interested public officials to contlnue service. He outlined difficulties of the present system to meet expenses, and reasons for their decision not to proceed under the present circumstances. Central Lane Planning Council was asked to act as pepresentative body to represent the urbanized community to try to develop a plan to keep mass transit available. The City has been asked to work with Emerald Transit System to attempt to keep the system running for two months. Lane County has been requested to develop an administrative process to buy the system and keep it operating until a perm- anent mass transit program can be developed.. Springfield City Council and Lane County Commissioners are willing to cooperate to work out a solution. In answer to Councilman Williams, the Manager said working with the Dorsey Bus Company will be considered as one of the possible solutions. In answer to Councilman McDonald, the Manager said the deficit will be primarily payment of drivers wages, and could vary from $1,000 to $5,000. Two Pledge - Mr. Mohr introduced Mr. .Tom Cloyd and his wife, who represented an anti-population growth committee. Mr. Cloyd presented a "Two Pledge", which he asked members of the Council to sign, and presented them with Zero Population Growth pins. Mr. McDonald moved seconded by Mr. Teague to receive and file Items la, lb, lc and ld of the Committee report. Motion carried. e. Field Burning Regulations - Mrs. Beal distributed a proposed Council position on new field burning regulations, and requested Council endorsement of the statement. Mr. Mohr and Mrs. Hayward, with Mrs. Beal, will attend a hearing in Salem on the regulations. Mr. McDonald moved seconded by Mr. Teague to receive and file Item Ie of the Committee report. Motion canried. Regarding Item Id, "Two PI~dge", Councilman Teague asked that the record show that he had not signed the Two Ple@ge. Mr. McDonald pointed out that he, too, had refrained from signing the pledge. II II II I 1 I I, II II II I I I Mrs. Hayward pointed out that Councilmen, when signing the pledge, had suggested that their children would be well advised to have only two natural children. Regarding Item Ie, Field Burning, Mrs. Beal asked that the record show that the Council endorsed the statement she presented at the hearing in Salem, and that it was an official statement of the Council. Mrs. Beal moved seconded by Mr. McDonald that the minutes be amended to show that the statement distributed at the committee meeting was endorsed by the Council as its official statement. Motion carr&ed. 2. Collectiua Bargairiing Procedures Report - Mr. Rober~ Fraser, chairman of the Employer- Employe Relations Committee, distributed copies of a proposed ordinance relating to public employment and collective bargaining with employe representatives. He asked that the Council review it and have a hearing at a future Council meeting. He explained that the ordinance could be changed if it was found that portions of it,would not work - that it was an experiment. I I II Mr. Eaton Conant, member of the committee, said the ordinance dealt with impasse proce- dures, and that by declaring itself a public employer, collective bargaining machinery would apply. Councilmen thanked the committee for doing an excellent job. Councilman Mohr requested that the committee remain impaneled until public hearings on the ordinance have been completed. Mr. Fraser said they would remain at Council disposal. I I I Mayor Anderson suggested that a public hearing be seheduled for the May II Council Ii meeting. Motion Councilman Mohr suggested that the hearing on this report should be moved to the meeting of May 25, since testimony will be taken May II concerning closure of 13th Avenue. . City Manager agreed that this would, make a heavy agenda, but pointed out that this ordinance should be aaopted prior to the election, and the May 25 meeting would be rather late. , I i II II II I! Saturday Market - Mrs. George Streising~r~ member of SCORE committee, recommended estab- lishment of an open air "Saturday Market" for downtown Eugene. She suggested that it occupy space adj acent to the parking structure, and that it be 'allowed to occupy space in the mall when it is completed. . The matter has been discussed with the City Attorney, and this is prohibited by ordinance on the public right of way, and would require amendment. Mrs. Streisinger suggested that arts and crafts and local produce could be marketed in such a way. . I Dr. Purdy felt this could be an asset to the downtown, but he felt licensing procedures should be investigated, and arrangements made for clean-up. Mr. Gribskov agreed, and felt-there ~hould be controls in types of booths, and that they should be in keeping wi th the mall. I I I Mr. Bob Thomas, Eugene Renewal Agency ;..gave.the backgrounddof the request for a Saturday Market, and said designers of the mall had suggested uses for the square. The City Council would have to make decisions on types of uses and administration of space. Mr. Everett Smith, PresI@ent of SCORE, appointed a committee to look into this suggestion, and the legal aspects. He felt permission should be given to try it for a month or so, and then look at it again to find what problems had developed. e Mayor Anderson felt a member of the city staff could be designated to work with Mrs. Streisinger on any problems that might come up. Mr. Vince Farina suggested the Council should look into some things before taking action, such as a demonstrated need for this type thing and who would be served. He said he was in favor of activities in the downtown area, but felt many problems could be raised by this sort of use. I Mr. Rasmussen, president of the downtown association, felt'there were some good points to this suggestion, but he concurred with Mr. Farina's objections, and suggested the Council move slowly. Councilman Mohr said the Council has agreed to provide maintenance for the mall. Council= man Williams was concerned about the city providing free rental space in the downtown area. Councilwoman Hayward felt this should be limited to goods produced in the community. Mr. Bill Wooten felt the City should be concerned and support local production. ,I I I I r II ,\ !l I I 'I I I I Mr. Lance Carden felt it might be in the best interest of the downtown merchants to back this sort of market. Mayor Anderson was only concerneddthat the markethbe operated properly, and was a credit to the community. He suggested that temporary guidelines be established. The City Manager suggested a person or groupCof persons be named to take responsibility for resolving problems and making decisions. Mrs. Streisinger said she would be willing to take on ~ome responsibility, especially with regard to crafts. She was not too familiar with the produce people. I~ Manager suggested Mrs. Streisinger be designated, and she could select others to assest her. Dr. Purdy suggested that a committee composed of a Council member, downtown merchant, member of the renewal agency, Mrs. Streisinger, arid of city administration be formed to set up definite rules. Mr. Smith felt this would be superfluous. This would be a small, piiliot project. '~ Mrs. Hayward moved seconded by Mrs. Beal that the Council designate Mrs. Streisinger, and illyone she chooses, to work with city staff to work out details of a Sa~urday Market. The City Manager said Mrs. Streisinger had met with staff and started to resolve some of the problems which h~d concerned Council. Many Councilmen felt a trial market should be approved for one ?aturday, and the results assessed before continuing on a permanent basis. Mr. Con Amacher'questioned whether the Council had authority to grant use of right of way. Since this is an assessment district, those properties being assessed for that property should be asked whether they approve. City Manager explained that it was proposed to have a Market on the set-back area on the west side of lOth and Oak Overpark. Title to this property lies with the City, and the City Council has the legal right to grant use of space. The report indicates Mr. Hult has given his approval. Mr. WesMorgan said he represented Mr. Nils Hult, and that his feeling had been favorable to a Saturday Market. They felt it should be given a trial. Mrs. Hayward seconded by Mrs. Beal amended the motion to say the Council authorized a Saturday Market May 9, 1970, after which the Council will review the matter. Mr. McDonald objected to this amendment, saying he felt the merchants would not be given proper notice of this approval. , Marcia Dahlquist felt this was a chance to improve the downtown area, and would benefit those living in the downtown area. Mayor Anderson said_he was in favor of the proposal, and felt it should be required to meet the standards of the 'communi ty', Vote taken on motion to amend. Authorization of Study of Neighborhood Renewal Plan for East-Central Univesity Area - Mr. Stan Wolfe introduced a group from the University who were part of the "Can Man Survive" group. They have been studying the area in question, and compiling information. They offered cooperation to provide a better living environment in the area, and felt students, owners and residents in the area should have a say in what is being developed. Mr. James Pearson, Planning Commission member, welcomed the input of these young people, and assured them the Commission would be delighted to have that kind of activity on campus, and to see what they have in mind. The Council discussed the relations hip of this study with the E-SATS Program. Manager ~xplained the relationship of the two studies. Planning Director said they felt they had to determine whether the route was going through, and the impact. Decisions would have to be made on land use around the central area. 6. Report pn Employment Discrimination - Mrs. Beal asked that this item be placed on a later agenda, when the Council would have ample time to discuss it. Mr. McDonald moved seconded by Mr. Teague to receive, and file Items 5 and 6 of the Committee report. Alignment and Impact Study, Amzaon Freeway North Planning Commission reported that future of these areas is profoundly affected by what is done about freeways. A request is made for Council resolution on questions of whether a freeway is needed and what routes should be used. e Mr. McDonald moved seconded by Mr. Teague to approve the recommendation of the Planning Commission. City Manager commented that, if these s~udies were approved, it should be contingent upon 1970-71 budget providing funds for necessary study. It was felt they could be con- sidered at the same time. Mr. Mohr moved seconded by Mrs. Hayward that the Council as part of its authorization for study of Skinner's Butte and Amzaon Freeway Programs formally request a presentation of that portion of the report of the Citizens Advisory Committee which deals with a critical review of these two projects. Mr. Ronald Lovinger was concerned that peoples needs and wants should be considered, and that people should not be displaced unnecess.arily. Planning Director explained that the Planning Commission has been working from recom- mendations on Community Goals, and that these two facilities will have such an impact that studies should be made now. Al Urquhart, 1960 Agate, was concerned with this proposal and felt environmental interests should be considered. Manager explained that the area of concern was the area between the University and the Central Business District, and that a detailed study was needed regarding the impact of these proposed freeway systems on the area. Mayor Anderson stated that the motion is to request simultaneously with authorization for a study of Skinner's Butte and Amazon Freeways a report from citizens advisory c ~mittee which has studied these neighborhoods, and have a.public hearing on those issues to take testimony. Darrel Lanz, south of Stewart Road, west of Bailey Hill Road, from RA to M-2 for construction of a cabinet shop. Manager explained location of this property, and explained that the Council had looked at it on tour. He explained how neighboring properties were zoned, and said the Planning Commission had felt no additional industrial zoned land was needed in the area, and that rezoning would be detrimental to the property immediately to the north. Mr. McDonald moved seconded by Mr. Teauge to uphold the Planning Commission recommendation for denial 6f rezoning for property located south of Stewart Road and west of Bailey Hill Road. . Mr. Neal Sande, 502 Stagecoach Way, Salem, Oregon, stated his reasons for requesting rezoning of this property, and said there was no valid plan in effect which included this area. Planning Director explained that rezoning should be based on an overall plan for an area, and that density should not be increased in that area. City Manager read letters of protest from Mr. M. F. Mesman and Donald J. Henderer. He explained that Mr. Henderer's original sewer was a private sewer and was never assessed to the property owner. I Director of Public Works commented with regard to Mesman letter that no consideration is given to the .use made of property, and that this is a legitimate assessment, according to the cit~ procedures.
