Donna Cross, 140 wish to have the remained gravel, North Jackson said she was representing persons living on North Jackson who did not street paved at all~ They did not feel it would be an improvement, and felt if it traffic would be slower and children would be safer. Councilwoman Hayward asked why staff felt it necessary to pave this area. Public Works that888% of the property had petitioned for paving. There is a dust problem and owners City will pay for the portion bordered by the park. Councilman Mohr suggested that the area should be marked as a playground, and manager said policing may be necessary, as well as signing. Vote taken on motion. Rollcall. COMMITTEE REPORTS Meeting held May 20, 1970: "Present: Ci ty Manager and Councilmen Teague, Hayward, Purdy, Beal, Mohr and Williams; staff; and others. 1. It~ms from Mayor and Council A. Filing of Burning Permits - Mrs. Beal read a letter signed by the Mayor and Manager and addressed to the State Department of Environmental Quality requesting that burning permits be filed with the Department when they are issued. Mrs. Hayward moved seconded by Mr. Mohr that the Council endorse the letter being signed by the Mayor and City Manager addressed to the State Department of Environ- mental Quality. He explained that permits showing the type of c~op and when it was burned would be filled out in triplicate, with the final copy going to the Department. Vote taken on motion. Motion carried. Salary Scale for Women - Mrs. Beal asked Counc~l permission for discussion of this item at the next committee meeting, but asked that it not be an agenda item. D. 13th Avenue Closure - Mr. Mohr introduced Bernie Corrigan, representative of 5/25/70 - 2 ..lI1Il "... 1 },,71 e 5/25/70 : I I I I j :! j, II I ASUO"'~ 'Mr., Corrigan asked permission to lis~ 13th Avenue from Tuesday;'--.!'1ay 26 until the end of the current test closure period. Experiments would be conducted for various uses of this space. He explained some of the plans being made for this time, and that student marshals would be appointed to keep order and eliminate garbage problems. I Dr. Purdy asked if there shouldn't be guidelines set up regarding responsibility ,to make sure fire lanes are kept open, responsibility as to noise, responsibility for payments of costs of cleanup, and whether the University approved the project. Mr. Corrigan said the ASUO would take full responsibility for any expenses necessary to clean up litter. Plans have been ~ade for fire lanes. They are aware of the noise problem created previously, and there will be no amplified instruments. I j II Mr. Mark Swain, student, said he had met with university officials and they were concerned about noise. He said the group would like to bring together people and, exhibit to the community the positive things that can come out of the closure of 13th. e The Manager explained that one of the p~rpElses, of this closure was to allow the university to test their problems of interior circulation. This should be kept in mind, if drawing up a plan. Public Works Director said they had been asked by the University to extend the study to incorporate a one-block area between University and Onyx. His department should be kept informed of the time-table of any activities, so that the street 'may be opened at any section. I I !I I Steve Wertz requested that the Council deny this permission. Finals are com~ng up, and students have been disrupted quite a bit already this quarter. He felt this might be a good idea, bu~ this was the wrong time to do it. Dr. Purdy asked to delay action until the regular monday night meeting, and that the Council be furnished a written statement from the President of the University and the student body requesting these things. He felt a procedure and policy should be set up whicr could be used to handle further requests. Mayor Anderson said he felt the proposal had very definite merit. a formal r~quest from the University administration to the Council that the closed street be utilized for this purpose, and accepting for the time it went on in that area. He asked for requesting responsibility I II I I I Mr. Mohr pointed out that, if the~'motion to vacate the street be passed, title to that land will be with the university. The City Manager said Mr. Merwin, representing Mr. Corrigan and the ASOO, had called asking to 'withdraw their request for use of 13th Avenue. They have not had sufficient time for planning, and problems might be created which would jeopardize final closure of 13th. No further action was taken. I I II I! II II E. New State Constitution - Mrs. Hayward introduced Senator Glen Stadler, and asked him to outline the proposed new Oregon constitution. Senator Stadler explained misconceptions about the new constitution, and how it will improve state government. He pointed out improvements, and new provisions incorporated. - 2. Public Employe Relations Board Procedures - Mr. Ken Brown, State mediator on the staff of PERB, explained that the Public Employe Relations Board had been created to administer a collective bargaining law enacted by the 1969 State Legislature. He explained that it acts as a neutral th~rd party to provide uniform procedure to determine public employe representation and to provide labor dispute settlement. In-answer to Councilman Mohr, Mr. Brown said he saw no conflict with the Eugene Ordinance which provides for the State fact finding committee to continue on as a city committee, in case of an impasse. In answer to Councilman Purdy, Mr. Brown said the cities of Portland and Eugene now utilize the PERB. He did not believe employe groups would be satisfied with the seqtion of the Eugene Ordinance concerning arbitration which was binding upon the City Manager but not upon the City Council. I 3. Women for Agriculture - Mayor Anderson introduced Mrs. Kent Wiley, Mr. Bill Rose, Mrs. Clarence Venell and Mr. Charles Kizer, representing Women for Agriculture, an organiza- tion to communicate problems of the seed industry. ,\ I, I' Mr. Bill Rose explained that they were still only able to control insects and disease in grass seed by burning, but that this would be a much better summer in Eugene. There was discussion about cereal crop burning, and the Council request for elimination of all burning of this type. Mr. Kizer pointed out that there were only a limited number of days for burning, and if a cereal field was burned and not enough scheduled days remained, it might be impossible for that farmer to burn his seed field. The Council pointed out that they were requesting a reduction in acreage burned. Mrs. Wiley explained that the cities are dependent on agriculture, and that they needed to be aware of this when they tried to reduce acreage grown. e Mayor Anderson said it was not the intent of the City Council to doom the grass seed industry, but that it was asking that they look at alternate methods of sanitation and give a commitment to reduce the amount of acreage being burned. I 4. Lakewood Mobile Home Revocation, Conditional Use Permit - Mr. Larry Loeber was notified of Council revocation of permit and requested a rehearing. He indicated a desire to find a solution to the problem, and suggested a contractual arrangement for alternate buffering. Dr. Purdy requested a report from the Planning Commission. that it might be better to plant other plain cedar trees to obligations, rather than construct a costly fence. Mr. Williams suggested fulfill conditional I I I I I II i II II Ii I I I II Mr. Joe Richards, attorney, said the mobile home park had been upgraded from what it was originally, and that owners had gone to great expense to plant the required trees. He said there were forty families living there, and that it would cost each $1,000 to move. He suggested a temporary fence, but requested that it be placed on the outside perimeter of the project. He felt trees would be difficult to water outside the fence. / Mrs. Hayward felt the matter should be brought back with an agreement which had been worked out between owner and staff. Mr. Mohr concurred. Mr. Richards requested that the Council act on this matter at its next meeting, since Mr. Loeber has tenants waiting to move in. I Mayor Anderson said he felt the Council had merely upheld the conditions in the permit that were violated, and that the Planning Commission and people in the area should have sufficient time to examine alternatives. Mrs. Alice Barron agreed with members of the Council, and s aid she would like to see plans for any construction of a ,fence. She objected to a fence on the property line, as this would border her driveway. e Manager suggested that Mr. Loeber meet with staff to come up with an alternative plan. If the Council wishes, this can be sent to the Planning Commission for its recommendation. Mrs. Hayward moved seconded by Mr. Mohr that the staff meet with Mr. Loeber to work out an acceptable plan, and refer this to the Planning Commission for recommendation. In answer to Councilman Teague, the Mayor said this would not rescind previous Council action. I II Vote taken on motion. Motion carried. Mr. Teague moved seconded by Dr. Purdy to approve Item 3 of the Committee report. Manager Said the plan had been referred to the Planning Commission and was approved at their noon meeting. ,He read the agreement, and explained that a six foot fence and tree plantings would be maintained in a satisfactory condition as a site-obscuring screen until the trees would provide an adequate screen. The decision for removal of the fence lies with the City. If adjoining property owners agree, it would be proper for Lakewood Mobile Homes to give an easement so they could assume responsibility for maintenance of that'strip between the property line and the fence. Lakewood Park would be responsible for replacing any trees and for wo~king out an agreement with property owners. I Mr. Teague and Dr. Purdy withdrew the original motion. Motion carried. Mr. Teague moved seconded by Dr. Purdy to rescind action taken at the previous council meeting to revoke a conditional use permit for Lakewood Mobile Park. Motion carried. Eugene Renewal Agency Request to Place Empty Conduit in Mall Area - Mr. Frank Shearer, ERA member, explained that placement of conduit in the mall area might eliminate future tearing up of pavement. A decision is necessary because it sh0uld be installed within the next few days. Mr. Dave Hunt explained a diagram of proposed underground conduit and what future uses it could accommodate. e Mr. Mohr said he would be willing to consider approval of this request if a method of control were proposed. Mr~ Hunt pointed out that this would be city property, and permission would be required for any use after completion. I i I II II Ii Ii II l' II II II Several Council members were concerned that this conduit would be used for amplifica- tion of music or other loudspeaking systems in the mall, and were ,not in favor of any noise generation. Mr. Williams felt options shofuld be kept open, and that the expense of installing it later would be tremendous. He moved, seconded by Dr. Purdy that a raceway be provided in the mall as requested by Eugene Renewal Agency. I Mr. Williams explained that there was a difference between keeping an option and installing a sound system. Councilman Mohr asked if Mr. Williams would, as part of his motion, ask the City Attorney to draw an ordinance specifying conditions for use of the raceway. Mr. Williams said he would add to the motion that the City Attorney prepare a report on legal title, controls over the conduit, and suggest any measures he might feel appropriate to assure that control. II II I i IJ Dr. Purdy pointed out that what the Council was app~oving was expenditure of $1,000 for a conduit, and:mot an expensive system. He said he would hate to bind a future Council. Public Works Director explained that installation of conduit at this time might prevent ripping up the mall in the future. In answer to Mrs. Hayward, City Attorney said the report would be ready at the next regular meeting. II 'I II Ii II r I I I I t It was decided to defer action until the regular meeting. I City Manager read a memorandum from the City Attorney which stated that the City'had the power to install the conduit in the mall, and had control over any use made of that conduit. Mr. Williams moved seconded by Dr. Purdy that the Council recommend t9 Eugene Renewal Agency that the conduit be installed in the underground area for the use that might be ordained at some future time by the Council. ,~ Councilwoman Hayward felt that this was not really planning for the future at all. There had been no indication of any use of this conduit other than some kind of noise. There was further Council discussion on possible uses for conduit, and whether it should be installed in the mail at this time. Mr. Bob Harland felt there might be a need for some type electrical system in the future in the mall. Mr. Alan Seder felt the Council should plan now so that there would never be a sound system in the mall. Mr. Leonard Nicola, 1954 Grant, was in favor of installation of conduit ,'and felt it might prevent tearing up the mall in the future. I I I II I! :1 I I I I I ~' There was Council discussion about limiting uses of this conduit, and it was pointed out that future Councils could decide on permitted uses after such uses were proposed. Vote taken on motion. Messrs. Williams, Teague and Purdy voted in favor. Mrs. Hayward, Mrs. Beal and Mr. Mohr voted against the motion. Mayor Anderson voted in favor. Motion passed. Mayor Anderson said he felt future Councils would find noise just as objectionable as this Council. He would hate to see jack hammers tearing up concrete. Invite a Student to Dinner -,M~Y'0r,,,,Anderson introduced Mr. Dave Smith of the "Escape Program" at the University. He explained an "Invite a Student to'Dinner" program, and that the Council is asked for its endorsement. Mr. Smith read a circular relating to this program, and asked that citizens of Eugene participate', and told how the group could be contacted'. I I I, II il II Ii i Councilman Williams moved seconded by Mrs. Hayward that the Council endorese the "Invite a Student to Dinner" program, and ask that citizens of Eugene participate in it. Motion carried. Mr. Teague moved seconded by Dr. Purdy to approve Item 6 of the Committee report. Motion carried. 7. Street Access, Rubenstein-Rhombus Property on' Pearl between 20th and 24th - At the time permission was given for this access, it was felt a fee should be attached. Staff recommends payment of $2952.00 in lieu of paving assessments and $635.00, one-half the cost of land for 80' right of way. Dr. Stansbury, representative of the corporation, said they felt this fee was fair,; but was concerned because of the nature of a "zipper" clause attached to this access, and felt if it was clesed at a later date, they should be reimbursed the amount of the fee. 'I Ii II Manager said a future Council could certainly consider such a request in the event permission was revoked. Omitting this from the agreement would not close the door to a future Council making this commitment. City Manager said it is recommended that the owners be 'charged the cost of paving as it would have been had the property had access charged to the property, as well as an amount for their portion of the 80' right of way which would have been dedicated by the property owner. It is recommended a revocable agreement be signed. II I I I I II I I I II ,[ II Ii I[ I Mr. Teague moved seconded by Dr. Purdy that an assessment for paving in the amount of $2952 and dedication land value in the amount of $635 be charged, and authorization given for signing of revocable agreement. Rollcall vote. All councilmen present voting aye, the motion carried. Items for Council Consideration not Previously Discussed: 1. Eugene Water and Electric Board Sale of Surplus Property, approval of sale of a substation site at 6th and Filmore no authority to sell property without Council approval. Water Board and approved by them. Approval- EWEB has requested Council and one at Howard Avenue. EWEB has This matter has been acted on by the Mr. Teague moved seconded by Dr. Purdy to authorize sale of substation site property at 6th and Filmore and on Howard avenue. In answer to Mrs. Beal, Manager explained monies received go into EWEB funds. The property was purchased by them, and held in their ownership. Rollcall vote taken. All councilmen voting aye, the motion carried. 2. ~Planning Commission Report (April 13 meeting) a. Extension of Conditional Use Permit, Lane County Council on Alcoholism - This property, which has been used as a half-way house known as Carlton House, is operateadby Lane County Council on Alcoholism. No complaints have been received about the operation of the facility, and there was no testimony at the Plannigg Commission meeting. b. I II 'I I I I II I, II I Accepting Grant of Powers, Low Rent Housing - The Planning Commission proposed this ordinance I because there are several applicants plannigg construction of low income housing. This would utilize authority granted to cities by $tate Statute. It would allow cooperation with non-profit sponsors similar to the way the city cooperates with the Housing Authority. Mr. Teague moved seconded by Dr. Purdy to grant extension of conditional use permit for Lane County Council on Alcoholism for Carlton House, located at ~th and Lawrence. Motion carried. Sign Code Amendments - The Planning Commission has held public hearings regarding several amendments to the sign code and forwarded these to the City Council for public hearing. The Manager explained that an ordinance adopted at a previous meeting was the one which should have a public hearing at this meeting. Staff recommends that the ordinance be repealed, and call a public hearing on the amendments to the code for the June 8 meeting. I II II I I I Ii I' Mr. Teague moved seconded by Dr. Purdy to rescind Ordinance No. 15936, passed at the meeting of April 27, and call a public hearing for June 8 on amendments to the sign code. He asked the, Council to protect the rights of other citizens, and that zoning regulations be considered. ;: i I I I I City Manager explained that the ordinance would authorize the Council to exercise powers granted by sections of the State code. Planning Director said it would allow the city to cooperate with non- profi t sponsors and limited dividend corporations, which would be on the tax rolls, and paying their fair share of taxes. It would give the Council the right to waive zoning if this was proved in the best interest of the City. I II r Mr. Otto Vonderheit, 260 East 11th, said it appeared this was the result of actions of the Planning Commission when they adopted a conditional use planned unit development which the Council referred back to them, after an opinion that the ordinance had not been followed. The proposed ordinance would not have the type conditions and criteria required by the present ordinance for this type housing. He could see no reason to adopt this ordinance. Mr. Thomas E. Hedgpeth, 939 Jefferson, asked if this ordinance would allow Fhe Planning Commission to make exceptions to rules that other builders would not be able to get. e The City Manager explained that only non-profit housing corporations or similar agencies would be eligible for these exceptions. Building codes would still have to be complied with. The City Attorney read this section of the State Statute, and explained that this would enable cities to get into low rent housing development programs, and to spend public funds for the purposes named in the statute. In answer to Dur Purdy, Planning Director said some non-profit corporations are interested in using this provision, and that the Planning Commission felt it should go into effect immediately, if at all possible. I Mayor Anderson said the problem of construction of housing for low income people was in itself an emergency. This ordinance really implements the housing resolution passed by the City Council in 196:8. In answer to Mr. Vond~rheit, Mayor said the Council was recognizing a social need which exists today without applying it to a specific case. After further discussion, Mr. Teague moved seconded by Dr. Purdy to approve the Plannigg Commission recommendation to amend the city code for acceptance of grant of powers for a city program of low income housing, Motion carried. d. Amendments to Zoning Ordinance - Amendments proposed are 1) Conditional Use Procedures; 2) Variances and Zoning Board of Appeals; 3) Planned Unit Development Procedures; 4) Enforcement regulations. Planning Director reviewed proposed amend- ments which had been reviewed by the Building Official, and recommended by City Attorney, and are regulations to enforce compliance with conditions or failure to adhere to approved plan. City Attorney explained that this ordinance will enable the city to take advantage of equity powers of circuit court to enjoin. I Mr. Teague moved seconded by Dr. Purdy to approve the Planning Commission recommen- dation to amend the zoning ordinance relating to conditional use procedures, uarliances, zoning board of appeals, planned unit development procedures and enforcement regu- lations. Motion carried. e. Amend zoning ordinance, add skating rink to conditional uses in C-3 and M-2 - Planning Commission recommended amendment of zoning ordinance Articles, 13 and 15 to provide that buildings and uses which may be permitted conditionally in the C-3 Business District and M-2 Light Industrial District would include indoor skating rinks. '-: Mr. Teague moved seconded by Dr. Purdy to amend the zoning ordinance as recommended by the Planning Commission. Motion carried. 3. Willamette Street Paving Assessment Ordinance - Bids have been opened on this project. Analysis proves them exceedingly high, and it is estimated cost to property owner for 36 foot paving would be $13.38 per front foot. If the city participated in additional excavation, front foot cost would be $12.55. The present bid is 86% higher than those received in 1968. Staff recommends that the project be dropped until a more favorable bid can be obtained. The City Manager pointed out that this was not a public hearing on a bid, but a discussion whether the assessment ordinance should have first reading. If the project is to be dropped, the ordinance should not be read. I I I I I .! 11 ~J Mr. Teague moved seconded by Dr. Purdy that, for the time being the Council drop the project. I Councilwoman Hayward felt the property owners should be given an opportunity to decide whether to proceed with the project, when the prices would surely be even higher at a later date. Street Right of Way Purchase (Fairlee) - A request has been made for authorization to purchase street right of way on Norkenzie Road frbm William M. and Gailey Fairlee at the appraisal price of $59.00. Mr. Teague moved seconded by Dr. Purdy to authorize administration to purchase property located on Norkenzie Road for $59.00. Rollcall vote. All councilmen present voting aye, motion carried. Improvement Petition, Sanitary Sewer Mahalo Drive - 100% (Request for direct assessment of costs to owners on petition) - e 6. Discussion of Saturday Market Request for June 6, 1970.- A Saturday Market was held early in May and was a success. ~rs. Streisinger has requested Council approval to proceed with saturday markets beginnipgon June 6. ~usiness people in the area are in favor of continuing, with one exception, a restaurant. It has been indicated that there is concern that there must be proper control. Staff can see no reason not to give permission to continue. 1 In answer to Mr. Teague, City manager said the Council had given permission to try the Market for one saturday, and review this trial. Permission granted now would be for weekly saturdays, unless a problem arose. Councilwoman ,Hayward asked to have included in the motion something looking to the future, and planning for a permanent arrangement. Mr. Teague moved seconded by Dr. Purdy to grant the request for a Saturday Market until September 14, subject to: 1) Review in the fall; 2) Proper control; 3) Planning for the future; 4) Direction to staff to bring problems to Council for consideration. Motion carried. A short break was taken. , ' Environmental Information Center"'"- Mr. Bob Green of the University of Oregon Survival Center, explained the concept of expansion of the survival center into the community. Councilman Mohr explained that Mr. Green is proposing a Eugene Department of Environmental Quality which wmll concentrate on issues pertaining to Eugene. 1 In answer to Councilman Teague, Mr. Green said he would not suggest that the City withdraw support from the Regional Air Pollution Authority. There are many problems peculiar to the entire region. He explained that the Eugene Authority would be concerned with nuclear power problems, as an environmental issue facing the City, Water pollution, thermal pollution, and said there is a tremendous traffic p~oblem. They would be concerned with planning ahead for a mass transit system. Mayor Anderson said several cities in the country have adopted similar programs, some going even further than this, functioning immediately under the Planning Commission and using the Planning Cmmmission as a vehicle to get the ideas before the City Council. Councilwoman Hayward asked if it would be useful if the Council began exploration of the plan with the idea of including the necessary funds in the 1971-72 budget. 'e Dr. Purdy felt the idea of trying to incorporate a program between the city and the university was a good one. In answer to Mr. Green the Mayor said there were other things the Council wnated to explore, and, that it would be a good idea to have a later discussion. He thought the concept was excellent. Mr. Mohr suggested that this could be started as a small seale, well-delineated program, and that the Council could discuss that kind of planning program on the basis of funding for the current year. I ORDINANCES Council Bill No. 9152 - Calling public hearing June 29, 1970 re: Vacation of 13th Avenue East netween Alder Street and Agate Street was submitted and read in full the first time at the meeting of May 4, 1970, and held over upon failure to receive unanimous approval for second reading at that meeting, was brought back for second reading on May 11, 1970, and upon failure to receive unanimous approval for third reading at that meeting is brought back to this meeting for final passage. Dr~ Purdy suggested that June 29 was too early for a public hearing on Vacation of ,13th Avenue, since it was possible the Planning Commission and Traffic Department could not have reports.by that time. Mrs. Hayward said she felt it was not necessary to make a final decision at that meeting. The hearing process could be started and the hearing continued to another meeting. e The City Manager said the traffic information and analysis would probably be complete by that time, but if it involved an alternative facility or expenditure of funds and decision as to responsibility, this would have to be worked out later. If the facts are on hand by June 29, the Council can hear the public, and then discuss agreements or controlling arrangements which might have an effect on final decisions.' The purchase should be completed within a week. The City Manager suggested a reasonable iength of time be given to Mr. Kenyon to develop his plans. ,Since this is a dangerous building, it should not be extended:any lon~er than necessary. e Mayor Anderson suggested that this matter be held over to the nex~ meeting.
